[06:12.680 --> 06:21.200] They had exactly one bidder and there's all kinds of ways that this just doesn't sound [06:21.200 --> 06:22.200] right. [06:22.200 --> 06:23.200] I don't know. [06:23.200 --> 06:31.160] But yeah, now he's out and he is ready to become a criminal complaint machine. [06:31.160 --> 06:32.160] Good. [06:32.160 --> 06:43.520] When a property is sold at auction by the government, it must be, there's notice requirements [06:43.520 --> 06:48.960] and it must be sold on the courthouse steps. [06:48.960 --> 06:51.880] Not inside, behind some closed doors? [06:51.880 --> 06:53.360] Absolutely not. [06:53.360 --> 06:59.160] The code actually designates the courthouse steps. [06:59.160 --> 07:04.600] So yeah, he's got a good claim. [07:04.600 --> 07:15.360] And he should keep in mind that in using the criminal laws to address his claim, he will [07:15.360 --> 07:28.480] be creating all sorts of opportunity to use the civil laws to empty their pockets. [07:28.480 --> 07:30.920] That sounds good. [07:30.920 --> 07:38.400] And so tell me something, what would be a good way for him to start, because right now [07:38.400 --> 07:44.280] he can't even go back to his own property, they've got no trespassing signs, they took [07:44.280 --> 07:47.920] his no trespassing signs down and they put up some of their own. [07:47.920 --> 07:53.160] So it's pretty clear what their intent is if he tries to go home. [07:53.160 --> 07:55.240] We need more information. [07:55.240 --> 08:05.880] Who actually sold the property and what was the claim on which they relied for authority [08:05.880 --> 08:07.960] to sell the property? [08:07.960 --> 08:13.720] Well they called it a contempt of court for failure to pay child support. [08:13.720 --> 08:19.120] So he had a little bit of child support where they locked his bank accounts so that he couldn't [08:19.120 --> 08:25.760] make a payment, child support, and then got him a contempt of court for not paying the [08:25.760 --> 08:28.080] child support as ordered. [08:28.080 --> 08:35.880] And then the judge who was the one who wanted to buy the land and he's the neighbor and [08:35.880 --> 08:43.920] didn't want to, this man didn't want to sell it, well the judge signed an order of sale [08:43.920 --> 08:49.560] and the sheriff went over there, sheriff that had already been, had a history of stealing [08:49.560 --> 08:55.160] cattle off of this man's land, the sheriff went over there and executed the order to [08:55.160 --> 09:00.760] sell it and the bank didn't want to do this. [09:00.760 --> 09:10.400] They said that's not right and so the sheriff got his deputies to go over there and force [09:10.400 --> 09:18.280] the bank personnel to ignore the existing deed and create a new deed. [09:18.280 --> 09:22.520] They called it a sheriff deed, I'm not really sure yet what that's about, sheriff deed, [09:22.520 --> 09:28.400] but yeah they went ahead and called it new owners. [09:28.400 --> 09:35.160] It just happens to be that the law firm that bought up the land in that one bid, the law [09:35.160 --> 09:43.040] firm, he said it's owned by that same judge, so I guess we'll see how that's going to [09:43.040 --> 09:48.600] turn out, but I'm thinking right now he needs to get some injunctive relief first. [09:48.600 --> 09:50.000] You're making me nervous. [09:50.000 --> 09:52.120] You don't care? [09:52.120 --> 09:54.560] Is he still in the county? [09:54.560 --> 09:57.800] Physically, no. [09:57.800 --> 10:00.640] These sound like bad guys. [10:00.640 --> 10:04.840] Yeah, that's kind of what I thought. [10:51.840 --> 10:59.720] He needs to find a way to get these guys into the federal court, and they may be able to [10:59.720 --> 11:03.920] buy and control the state court, but they're not going to be able to buy and control the [11:03.920 --> 11:06.520] federal court. [11:06.520 --> 11:15.320] Get somebody else looking over their shoulder, and he definitely, in this case, I would want [11:15.320 --> 11:20.640] to take the state to the Fed. [22:08.160 --> 22:15.160] Yeah, but give us a brief, not too long involved [22:15.160 --> 22:20.160] Just give us a timeline, enough to get us oriented on where you're at [22:20.160 --> 22:29.160] Okay, so my situation stems from a search and seizure that took place in the fall of 2020 [22:29.160 --> 22:34.160] No charges or arrests were made at that time [22:34.160 --> 22:38.160] Fast forward 10 months [22:38.160 --> 22:39.160] Okay, hold on, hold on [22:39.160 --> 22:44.160] Search and seizure, was it done based on a warrant? [22:44.160 --> 22:52.160] It was, but there was no affidavit attached to the warrant, just a magistrate signature [22:52.160 --> 23:00.160] What was the nature of the accusation in the claim that led to a search and seizure? [23:00.160 --> 23:07.160] Did they see real property or personal property? [23:07.160 --> 23:14.160] I guess personal property, it was related to cultivation [23:14.160 --> 23:20.160] Oh, okay, you were growing tea? [23:20.160 --> 23:21.160] Sure [23:21.160 --> 23:30.160] Okay, go ahead, now I kind of got a little orientation [23:30.160 --> 23:35.160] I thought that had been legalized in Colorado [23:35.160 --> 23:37.160] I think that depends if they like it or not [23:37.160 --> 23:42.160] They just ignore their procedure and rules and go right ahead [23:42.160 --> 23:49.160] Anyway, so that happened fall of 2020, no arrests, no charges [23:49.160 --> 23:54.160] A warrant was eventually issued I think about 10 months later [23:54.160 --> 23:57.160] And of course I received no notice [23:57.160 --> 24:00.160] And then another 6 months later [24:00.160 --> 24:02.160] Wait, wait, wait, wait, wait, wait, wait [24:02.160 --> 24:07.160] Warrant, there had to be a warrant for the search [24:07.160 --> 24:08.160] Sure [24:08.160 --> 24:12.160] Was there a warrant for the search issued timely? [24:12.160 --> 24:17.160] Was that the warrant that was issued 10 months later or was there another warrant? [24:17.160 --> 24:22.160] The arrest warrant was issued 10 months later [24:22.160 --> 24:30.160] So at that point I just sat around at the same house that I had been living at [24:30.160 --> 24:36.160] So they could have come and arrested me that whole time but chose not to for whatever reason [24:36.160 --> 24:42.160] And that's not uncommon because they're trying to get all of their ducks in a row [24:42.160 --> 24:48.160] And so another 6 months go by after the issuance of the arrest warrant [24:48.160 --> 24:55.160] And eventually I got picked up and spent a week in jail [24:55.160 --> 25:00.160] Extradited from the city I was arrested in back to the home county [25:00.160 --> 25:06.160] Didn't see a judge until the day my bond was issued [25:06.160 --> 25:12.160] So that's essentially where I'm at in the proceeding [25:12.160 --> 25:18.160] Have you looked at the law concerning preliminary hearings in Colorado? City of Riverside [25:41.160 --> 25:45.160] And it's 48 hours [25:45.160 --> 25:51.160] If they get you to a magistrate for the purpose of a preliminary hearing [25:51.160 --> 25:57.160] Not this magistration thing they do, not just reading you your rights and setting bail [25:57.160 --> 26:02.160] But a preliminary hearing where probable cause is determined [26:02.160 --> 26:07.160] If they get you there before 48 hours [26:07.160 --> 26:14.160] The taking is presumed on its face to be timely [26:14.160 --> 26:19.160] And it's up to you to show that they could have gotten you to a magistrate [26:19.160 --> 26:24.160] That a magistrate would have made himself available in a shorter time [26:24.160 --> 26:32.160] If they get you there after 48 hours then the presumption is that the taking was not timely [26:32.160 --> 26:38.160] That goes to due process and would give you a go to a right to discharge [26:38.160 --> 26:41.160] Okay, continue [26:41.160 --> 26:44.160] Did you say McLaughlin v. Riverside? [26:44.160 --> 26:48.160] Yes, City of Riverside [26:48.160 --> 26:50.160] Riverside, okay [26:50.160 --> 26:56.160] It might be City of Riverside v. McLaughlin is one of those two [26:56.160 --> 27:05.160] Sure, yeah, so the 48 hours thing I ran into in terms of the bond hearing [27:05.160 --> 27:08.160] According to the Colorado Revised Statute [27:08.160 --> 27:16.160] It says you're entitled to that bond hearing within 48 hours of arrest [27:16.160 --> 27:25.160] And it's worth noting that this was, the warrant was issued without any formal complaint or information charged [27:25.160 --> 27:32.160] That didn't get filed formally until five days after my release if I remember correctly [27:32.160 --> 27:39.160] So I was in two jails, like I said I was extradited from the city I was arrested in [27:39.160 --> 27:47.160] And taken to my home county and in both those places I was there for more than 48 hours [27:47.160 --> 27:56.160] Without seeing a judge in the original arrest jurisdiction and then in the home county also [27:56.160 --> 28:02.160] I did not get a bond hearing within 48 hours [28:02.160 --> 28:04.160] Okay, that's a claim you can make [28:04.160 --> 28:07.160] Now, let's continue [28:07.160 --> 28:19.160] Okay, so basically my next, I had a hearing for the formal charges being filed [28:19.160 --> 28:25.160] About a week or two after I was released after the bond hearing [28:25.160 --> 28:34.160] And my next hearing is for appearance of counsel in about two weeks which I'm looking to delay [28:34.160 --> 28:39.160] Appearance of counsel, what does that mean? [28:39.160 --> 28:51.160] Just, you know, should I hire an attorney or assistance of counsel? That would be when they appear [28:51.160 --> 28:54.160] No, no, that would be when they would appear [28:54.160 --> 28:58.160] Is that just for the court to find out if you have counsel? [28:58.160 --> 29:04.160] Or does that give you an opportunity to request for court appointed counsel? [35:42.160 --> 35:50.160] When your liberty is at stake, we are always most concerned with liberty [35:50.160 --> 35:55.160] Before we're concerned with the right of things in the rule of law [35:55.160 --> 36:00.160] I don't want anybody going to jail if I can avoid it [36:00.160 --> 36:06.160] So I am, you know, I'm not a purist [36:06.160 --> 36:13.160] I understand what the rule of law says, but I also understand these guys don't always follow the rule of law [36:13.160 --> 36:15.160] Exactly [36:15.160 --> 36:20.160] And you get them too upset at you and you got a big fight [36:20.160 --> 36:27.160] They will sometimes do things that are unconscionable and unreasonable, even dangerous for them [36:27.160 --> 36:30.160] Just to pay you back for annoying them [36:30.160 --> 36:33.160] They tend to get extremely arrogant [36:33.160 --> 36:37.160] And yes, we can fight those issues [36:37.160 --> 36:43.160] But we don't want to fight those issues from jail [36:43.160 --> 36:47.160] Ask me how I know that, been there, done that [36:47.160 --> 36:51.160] Got sentenced to a year in prison [36:51.160 --> 36:55.160] Smart mouth to the jury, take your best shot because when you're done, you're still going to be here [36:55.160 --> 37:03.160] And they threw the book at me over an absolutely ridiculous charge because I annoyed them [37:03.160 --> 37:15.160] I got it all thrown out, but had I been more cautious, I would have never got convicted in the first place [37:15.160 --> 37:17.160] Sure [37:17.160 --> 37:21.160] So we got all these tools, we got all these dirty rotten things we can do to them [37:21.160 --> 37:25.160] But you are making me very nervous [37:25.160 --> 37:33.160] I'm concerned that we may be advising you toward a much longer jail sentence [37:33.160 --> 37:37.160] If you have any culpability [37:37.160 --> 37:45.160] The only time you can really go in there and beat them up with abandon is when you have absolutely clean hands [37:45.160 --> 37:51.160] And for my part, I don't care if you have clean hands or not, that's not my concern or my issue [37:51.160 --> 38:02.160] My concern is giving you options based on what your situation actually is [38:02.160 --> 38:03.160] Sure [38:03.160 --> 38:06.160] Can you tell that I'm concerned? [38:06.160 --> 38:09.160] I can, yeah [38:09.160 --> 38:17.160] So you have to make that determination. If you think they've got something on you they can actually get a conviction with [38:17.160 --> 38:20.160] Be careful [38:20.160 --> 38:31.160] Demonstrate to them that you can fight your issue but do so with professionalism and courtesy [38:31.160 --> 38:38.160] So they don't get the idea you're some kind of radical that needs to be gotten off the street [38:38.160 --> 38:48.160] Now, with that said, where do you want to go? [38:48.160 --> 38:57.160] Well, I mean, we spoke with limited time in previous shows in the past couple weeks [38:57.160 --> 39:02.160] And you pointed me in a few directions that have given me ideas [39:02.160 --> 39:10.160] And like I said, I am interviewing counsel and my most recent meeting with some lawyers [39:10.160 --> 39:16.160] They were on board with the direction that you were pointing at [39:16.160 --> 39:23.160] But just to put that aside for a moment, just looking at their evidence and affidavits [39:23.160 --> 39:28.160] And what I've learned from the likes of Dr. Gray's course [39:28.160 --> 39:35.160] I mean, they severely overcharged on, as I understand they tended to [39:35.160 --> 39:39.160] Okay, I understand that that's a strategy [39:39.160 --> 39:48.160] They charge the highest thing they can possibly charge knowing full well they could never get a conviction on that [39:48.160 --> 39:57.160] The trick is for you, you're looking at this and I'm sitting here listening to it and heck, I'm not going to jail [39:57.160 --> 40:01.160] So I can feel like I'm looking at this rationally [40:01.160 --> 40:06.160] You're looking at this and this is your freedom we're talking about here [40:06.160 --> 40:08.160] Indeed [40:08.160 --> 40:11.160] So it'll be a lot more difficult for you [40:11.160 --> 40:21.160] And I'm trying to make sure that I'm not being contrite here and incautious with your liberty [40:21.160 --> 40:29.160] With that said, they always charge you the highest thing they can and it's always a negotiation [40:29.160 --> 40:37.160] So even if you're pretty sure they can get a conviction of some sort [40:37.160 --> 40:39.160] That doesn't mean you have to lay down and roll over [40:39.160 --> 40:44.160] They're going to make you an offer [40:44.160 --> 40:48.160] But the offer is always a negotiation [40:48.160 --> 40:52.160] They make you an offer, you make them a counter offer [40:52.160 --> 40:58.160] And you kick this back and forth until you come up with something you can live with [40:58.160 --> 41:03.160] If you're completely innocent, it doesn't always matter [41:03.160 --> 41:12.160] Get the best deal you can, preferably with no jail time [41:12.160 --> 41:21.160] Once the deal is done, now you can come back and fight them like a tiger [41:21.160 --> 41:25.160] Once you've got the best deal you can get [41:25.160 --> 41:30.160] But if you try to get the best deal by fighting them like a tiger beforehand [41:30.160 --> 41:35.160] You're running the risk of them winning and you losing [41:35.160 --> 41:41.160] And they'll bury you [41:41.160 --> 41:43.160] Consider that [41:43.160 --> 41:48.160] But in either case, they don't want to go to court [41:48.160 --> 41:51.160] They don't have time, they've got too many cases [41:51.160 --> 41:53.160] They can't afford to go to court for all these cases [41:53.160 --> 41:55.160] They've got to deal these things out [41:55.160 --> 41:59.160] So as long as you don't get them angry at you [41:59.160 --> 42:04.160] If you've got a lawyer there that will work with you [42:04.160 --> 42:06.160] Tell him what you want to do [42:06.160 --> 42:11.160] I want to squeeze the best deal I can out of them [42:11.160 --> 42:13.160] And get that best deal [42:13.160 --> 42:19.160] Once you've got that best deal, then you can come back and fight all you want to [42:19.160 --> 42:21.160] Does that make sense? [48:24.160 --> 48:33.160] Yeah, yeah, and like starting with the initial search warrant, like I said, there's no affidavit attached to it [48:33.160 --> 48:45.160] Okay, well what did the search warrant authorize the sheriff or whoever to search for? [48:45.160 --> 48:54.160] I mean, it was really broad and really open, you know, it gave them access [48:54.160 --> 49:02.160] Even though like the eyes and photographs they were able to put on my property was all outdoor [49:02.160 --> 49:09.160] The warrant extended to the whole property and the house and everything [49:09.160 --> 49:16.160] But there's no... I've still yet to see the affidavit that's attached to that [49:16.160 --> 49:22.160] I assume once I obtain the discovery that I will see that [49:22.160 --> 49:31.160] The council suggests the possibility of there being an informant due to the fact that the affidavit was not attached [49:31.160 --> 49:43.160] But the way the both warrants read, it seems to indicate otherwise that it was just like an anonymous pass or by code inspection, blah, blah, blah [49:43.160 --> 49:49.160] So that's an unlikely situation as far as the informant goes [49:49.160 --> 50:00.160] Okay, first thing to do then is to attack the sufficiency of the warrant or the validity of the warrant [50:00.160 --> 50:04.160] If you can get the warrant tossed, everything else gets tossed [50:04.160 --> 50:12.160] You need to look at the warrant. You need to look at the verbiage on the warrant [50:12.160 --> 50:15.160] What were they authorized to look for? [50:15.160 --> 50:25.160] If they were authorized to look for a stolen bulldozer, they can't go in your house and open a drawer [50:25.160 --> 50:30.160] Because the bulldozer wouldn't fit in that drawer [50:30.160 --> 50:40.160] There has to be something in the warrant that authorizes everything they searched for [50:40.160 --> 50:43.160] So check that real careful [50:43.160 --> 50:50.160] I mean like the wording was really broad and very inclusive of what they could do [50:50.160 --> 50:57.160] But from my point of view, that whatever the affidavit was that was supporting it is, you know [50:57.160 --> 51:03.160] No, no, wait. You're focusing on the affidavit. Back up. Look at the warrant first [51:03.160 --> 51:08.160] Specifically what they're looking for and specifically where they expect to find it [51:08.160 --> 51:14.160] It doesn't matter once the warrant's in hand, it doesn't matter what the judge was told [51:14.160 --> 51:22.160] When the judge issued the warrant and he gave that to the officers who executed the warrant [51:22.160 --> 51:33.160] Did the judge specify with, indicate with specificity what was to be looked for? [51:33.160 --> 51:43.160] And did the officers look in places that were not within the scope of the specification? [51:43.160 --> 51:50.160] I think the scope was really broad. I mean, I'll go over it again, of course [51:50.160 --> 51:55.160] It says it needs to be particular. It needs to particularly describe the place to be searched [51:55.160 --> 51:57.160] And the persons or things to be seized [51:57.160 --> 52:06.160] Yes, if it's too broad, then you can challenge the sufficiency of the warrant as being overly broad [52:06.160 --> 52:14.160] Look at that first. [52:58.160 --> 53:05.160] What direct knowledge, what competent witness did they have supporting it? [53:05.160 --> 53:10.160] Well, it doesn't talk about direct knowledge, but it does talk about that it needs to [53:10.160 --> 53:17.160] The warrant has to be issued upon probable cause supported by oath or affirmation [53:17.160 --> 53:24.160] It doesn't say it has to be first-hand information, but it has to have an oath or affirmation [53:24.160 --> 53:27.160] And that's the probable cause for the warrant [53:27.160 --> 53:33.160] Have you went to the magistrate's office who issued the warrant? out does not exist by law [55:38.160 --> 55:41.160] They try to bring it in later, no, no, no, no [55:41.160 --> 55:48.160] I put in a request for these records, I got all these records and that one was not in here [55:48.160 --> 55:54.160] So they can't use it later, if they try to hide something you can really screw things up for them [55:54.160 --> 55:57.160] The prosecutor is looking to make a deal [55:57.160 --> 56:04.160] He's looking to make an easy deal because he's got a huge stack of cases on his desk that he has to clear [56:04.160 --> 56:11.160] And when you start going in and asking these questions that's going to give him a headache, cause him time [56:11.160 --> 56:15.160] He's going to want this to go away [56:15.160 --> 56:21.160] So ask these really annoying obnoxious [01:06:55.160 --> 01:07:01.160] I'm still in the process of interviewing counsel, so you know [01:07:01.160 --> 01:07:05.160] Oh, that changes everything [01:07:05.160 --> 01:07:10.160] When you're still interviewing counsel, they'll tell you all kinds of crap all night [01:07:10.160 --> 01:07:21.160] Oh yeah, but if you want them to sign one paragraph contract that says they won't violate your rights, you can't find anybody that will do that [01:07:21.160 --> 01:07:31.160] Now, they'll tell you anything they can to get your retainer from you. Once they get your retainer, they're going to throw you behind under the bus [01:07:31.160 --> 01:07:40.160] So if you haven't hired a lawyer yet, don't pay any attention to these guys, what these guys say who are trying to get your retainer [01:07:40.160 --> 01:07:45.160] The only thing they want from you is your retainer [01:07:45.160 --> 01:07:53.160] Once they have your retainer, you're screwed, they're not going to do anything to help you, and they're going to come to a point to where they say [01:07:53.160 --> 01:07:58.160] Oh wow, this is a lot more difficult than I thought it was [01:07:58.160 --> 01:08:10.160] I charged you a $3,000 retainer, but in order to keep representing you, I'm going to have to have a $9,000 retainer [01:08:10.160 --> 01:08:15.160] You forgot about the part in the plea where they won't return your calls [01:08:15.160 --> 01:08:22.160] And they don't want that $9,000 retainer, they want you gone [01:08:22.160 --> 01:08:30.160] The lawyer makes his money by getting retainers, and he's got this set of motions that he always files [01:08:30.160 --> 01:08:39.160] The prosecutor's got a set of responses to those motions, and that's what Dr. Grave refers to as that flurry of motions at the beginning of the case [01:08:39.160 --> 01:08:44.160] They just send this back and forth to make it look like they're doing something [01:08:44.160 --> 01:08:48.160] They already have planned out what they're going to do to you [01:08:48.160 --> 01:08:56.160] And if you listen to the lawyer, the lawyer will take you exactly to where the prosecutor wants you to be [01:08:56.160 --> 01:09:01.160] So don't pay any attention to what the lawyers you haven't hired yet are telling you [01:09:01.160 --> 01:09:06.160] It's my suggestion that you ask for court-appointed counsel [01:09:06.160 --> 01:09:14.160] And then you give court-appointed counsel some really nasty motions to file with the court, and he's going to refuse [01:09:14.160 --> 01:09:17.160] And when he does, you bar-grieve him [01:09:17.160 --> 01:09:21.160] And when you bar-grieve him, he's going to get apoplexy [01:09:21.160 --> 01:09:27.160] And he's going to run to the court and ask the court to allow him to withdraw [01:09:27.160 --> 01:09:36.160] And you go to the court and tell the court, don't you dare allow him to withdraw, he's my counsel of choice, and he is under contract [01:09:36.160 --> 01:09:48.160] Told that to the last case I had in Austin, told that to the lawyer, and I told him that, you know, when you represent my case [01:09:48.160 --> 01:09:52.160] You're going to go to the judge and ask the judge to remove you from the case [01:09:52.160 --> 01:09:55.160] And I'm going to go to the judge and tell him, don't you dare remove him from the case [01:09:55.160 --> 01:09:58.160] He is my counsel of choice, and he's under contract [01:09:58.160 --> 01:10:04.160] And the lawyer said, the court had appointed this lawyer for me, I didn't ask for it, they just wanted me to have one [01:10:04.160 --> 01:10:09.160] He said, so I'm not under contract with you, I'm under contract with the state [01:10:09.160 --> 01:10:16.160] And I said, yes, you are under contract with the state, but I am the intended third-party beneficiary [01:10:16.160 --> 01:10:19.160] So I have standing under the contract [01:10:19.160 --> 01:10:22.160] And the judge will allow you to withdraw [01:10:22.160 --> 01:10:28.160] And he said, yes, he will, then I get to sue the judge for interfering with a private contract [01:10:28.160 --> 01:10:34.160] Well, that was a lie because the judge will not allow him to withdraw [01:10:34.160 --> 01:10:39.160] So he'll go to the judge and ask the judge to let him withdraw, you object [01:10:39.160 --> 01:10:45.160] And because of the Fourth Amendment to the Constitution, it's the fourth or the fifth [01:10:45.160 --> 01:10:52.160] Impair obligation to contracts? [01:22:07.160 --> 01:22:11.160] Not yet, maybe I should [01:22:11.160 --> 01:22:17.160] File it and say no, they'll ignore it, but it gives you a point of appeal [01:22:17.160 --> 01:22:19.160] Great, great [01:22:19.160 --> 01:22:26.160] Harman Taylor up here in North Texas has really fought them over that [01:22:26.160 --> 01:22:32.160] The federal judge gets all these magistrate judges to do all his work for him [01:22:32.160 --> 01:22:36.160] And they use the magistrate judges to do all their dirty work [01:22:36.160 --> 01:22:44.160] So the first thing you want to do if they force a magistrate judge on you is file a judicial conduct complaint against him [01:22:44.160 --> 01:22:46.160] Oh, okay [01:22:46.160 --> 01:22:53.160] It's politics, all these magistrate judges, they want to be appointed as federal judges [01:22:53.160 --> 01:22:59.160] So they're waiting for the federal judge to die or retire and hoping they'll get appointed [01:22:59.160 --> 01:23:04.160] But if you file judicial conduct complaints against them, that really stings them [01:23:04.160 --> 01:23:11.160] So they've got three magistrate judges vying for the federal judge's appointment [01:23:11.160 --> 01:23:16.160] And one of them's got two or three judicial conduct complaints against him [01:23:16.160 --> 01:23:20.160] Well, he's out [01:23:20.160 --> 01:23:30.160] So keep that in mind, the magistrate judge is there to do the dirty work for the judge himself [01:23:30.160 --> 01:23:38.160] So then the judicial conduct complaint would go with the district judge who transferred you? [01:23:38.160 --> 01:23:48.160] No, in the Fed, a judicial conduct complaint is similar to a lawsuit [01:23:48.160 --> 01:23:53.160] It's a lot bigger deal in the Fed than it is in the state [01:23:53.160 --> 01:24:00.160] You file that with the court and it's like filing a different lawsuit [01:24:00.160 --> 01:24:09.160] It really causes them to have to do a little legal song and dance [01:24:09.160 --> 01:24:18.160] But, okay, so you don't know, has the magistrate judge made a recommendation? [01:24:18.160 --> 01:24:23.160] No, not yet, I called him today, there's no recommendation [01:24:23.160 --> 01:24:27.160] So tomorrow I can file to say no to the magistrate judge [01:24:27.160 --> 01:24:32.160] Yeah, yeah, file that, they'll use the magistrate judge anyway [01:24:32.160 --> 01:24:42.160] And there's not much for you to do until the magistrate judge issues your recommendation, it's likely to take two or three months [01:24:42.160 --> 01:24:53.160] Okay, so is there a kind of like a type of letter that I need to, it's in there if I decide not to [01:24:53.160 --> 01:25:02.160] I remember seeing, if we don't wish to proceed with the magistrate judge, then complete this form [01:25:02.160 --> 01:25:09.160] Yeah, complete the form, send it in, they'll ignore it, but it's a point of appeal [01:25:09.160 --> 01:25:16.160] But there's not much you can do until the magistrate judge issues a recommendation [01:25:16.160 --> 01:25:24.160] The magistrate judge will issue a recommendation and then generally the trial judge will accept the recommendation [01:25:24.160 --> 01:25:33.160] So when the magistrate judge issues the recommendation, you file an opposition to it [01:25:33.160 --> 01:25:38.160] So that all your objections are on the record [01:25:38.160 --> 01:25:52.160] Great, great, but you mentioned something about a judicial conduct complaint, is that for the, you're talking about the District Court or the case district court [01:25:52.160 --> 01:26:00.160] No, no, I'm talking about the magistrate, if you object to the magistrate, if you do not agree to the magistrate, they're going to use him anyway [01:26:00.160 --> 01:26:01.160] Right [01:26:01.160 --> 01:26:06.160] And when they use him anyway, you file a judicial conduct complaint against him, that's going to sting him good [01:26:06.160 --> 01:26:10.160] I got it, thank you, you're clarified [01:26:10.160 --> 01:26:18.160] Now I'm going after the city, well the city is listed as one of the defendants [01:26:18.160 --> 01:26:29.160] So now I'm getting records with us through the city clerk, so I wanted a two year stand of how much [01:26:29.160 --> 01:26:33.160] Okay, hold on, there may be an issue here [01:26:33.160 --> 01:26:49.160] In Texas, you have a right to open records, until you file suit, once you file suit, open records no longer applies, you have to use discovery [01:26:49.160 --> 01:26:55.160] I got it, okay, so I need to stop them, okay, got it [01:26:55.160 --> 01:27:01.160] Well, it's not from me, it's from my side [01:27:01.160 --> 01:27:07.160] Well, you're at the point where it's the good part, now you get to start beating them up [01:27:07.160 --> 01:27:11.160] Okay [01:27:11.160 --> 01:27:15.160] Okay, do you have anything else for us? [01:34:19.160 --> 01:34:25.160] Yeah, apparently in Pennsylvania, every time you go on somebody else's property [01:34:25.160 --> 01:34:31.160] It's considered trespassing if you do it without permission [01:34:31.160 --> 01:34:39.160] But then if the owner asks you to leave and you refuse to leave [01:34:39.160 --> 01:34:42.160] Or it actually says, or authorized person [01:34:42.160 --> 01:34:51.160] So if you get it communicated personally to you, then you don't leave, that's considered a defiance [01:34:51.160 --> 01:34:57.160] So you're defying an order to leave [01:34:57.160 --> 01:35:02.160] All that means [01:35:02.160 --> 01:35:07.160] Sorry, I didn't mean to cough in the mic, I thought I had muted [01:35:07.160 --> 01:35:17.160] Okay, this raises an issue as concerns a public accommodation [01:35:17.160 --> 01:35:31.160] Can an entity that is a public accommodation arbitrarily or capriciously ask you to leave? [01:35:31.160 --> 01:35:41.160] They are saying that they can because the plaintiff is the Commonwealth of Pennsylvania [01:35:41.160 --> 01:35:45.160] Wait a minute, were you in a public building? [01:35:45.160 --> 01:35:47.160] Yes, school board meeting [01:35:47.160 --> 01:35:54.160] Whoa, okay, that gets to an issue where you have a right to be there [01:35:54.160 --> 01:35:55.160] Brett [01:35:55.160 --> 01:36:06.160] So did you file against the person who ordered you to leave for denying you access to a public building? [01:36:06.160 --> 01:36:11.160] Now in Texas we have this statute, I had a judge once [01:36:11.160 --> 01:36:15.160] I was in the courtroom, it was empty, just me and the bailiff [01:36:15.160 --> 01:36:21.160] And the judge ran in and stuck his finger in my face [01:36:21.160 --> 01:36:25.160] And ordered me to leave the building because I was creating a disturbance [01:36:25.160 --> 01:36:29.160] And I said, oh I'm sorry judge, I didn't have this turned on [01:36:29.160 --> 01:36:33.160] I pulled this digital recorder out of my pocket, poked the button [01:36:33.160 --> 01:36:39.160] Or he said, order me to leave the building or he'd have me arrested [01:36:39.160 --> 01:36:45.160] So I stuck my recorder in his face, I didn't have that recorded, will you say that again? [01:36:45.160 --> 01:36:49.160] And he just kind of huffed and puffed and turned around and left the building [01:36:49.160 --> 01:36:57.160] I was making criminal accusations to the bailiff as the chief security officer against the district attorney [01:36:57.160 --> 01:37:08.160] And the district judge made a threat against me for the purpose of interrupting my access to a public building [01:37:08.160 --> 01:37:18.160] In Texas under 2206 penal code, that is a terroristic threat [01:37:18.160 --> 01:37:26.160] Look in Pennsylvania, you were in a public building, you weren't in this guy's house [01:37:26.160 --> 01:37:32.160] You had a right to be there [01:37:32.160 --> 01:37:43.160] If he has issued this complaint against you because you did not leave the building based on his order to you [01:37:43.160 --> 01:37:50.160] Then you need to file against him for denying you access to a public building [01:37:50.160 --> 01:37:55.160] Okay, that would be the superintendent and the resource officer [01:37:55.160 --> 01:37:59.160] And anybody who assisted? [01:37:59.160 --> 01:38:02.160] The local township police officer [01:38:02.160 --> 01:38:07.160] Good, that's the one you really want to go after [01:38:07.160 --> 01:38:14.160] You go after the guys who started it, but the poor slob who's in there just doing his job and doing what they told him [01:38:14.160 --> 01:38:21.160] You go after him, he is going to be furious [01:38:21.160 --> 01:38:24.160] He'll turn out to be your best ally [01:38:24.160 --> 01:38:28.160] The resource officer or the local police officer? [01:38:28.160 --> 01:38:37.160] I love them, but the one who's the least culpable, the one who is relying on competent authority [01:38:37.160 --> 01:38:43.160] The local police officer, he's got these officials telling him to arrest this person [01:38:43.160 --> 01:38:45.160] Okay, I'll arrest this person [01:38:45.160 --> 01:38:47.160] Now he gets in trouble for it [01:38:47.160 --> 01:38:51.160] I think he wrote the complaint for him, that's what it looks like [01:38:51.160 --> 01:38:52.160] He is not [01:38:52.160 --> 01:39:00.160] You go after him with a professional conduct complaint and a criminal complaint against him for false arrest or kidnapping [01:39:00.160 --> 01:39:12.160] I'm not sure how it is in Pennsylvania, but in Texas we don't have a false arrest criminal statute [01:39:12.160 --> 01:39:16.160] The statute is kidnapping [01:39:16.160 --> 01:39:20.160] So you charge the police officer with kidnapping [01:39:20.160 --> 01:39:23.160] They didn't take us, they filed charges on us three weeks later [01:39:23.160 --> 01:39:29.160] We actually did leave, we just didn't leave fast enough for them and three weeks later they pressed charges on us, three of us [01:39:29.160 --> 01:39:31.160] Whoa [01:39:31.160 --> 01:39:34.160] Yeah, they're after us, it's a political thing [01:39:34.160 --> 01:39:38.160] Okay, hold on, that's tampering with a government document [01:39:38.160 --> 01:39:40.160] I don't know [01:39:40.160 --> 01:39:43.160] That's perjury [01:39:43.160 --> 01:39:48.160] If they filed a complaint because you didn't leave fast enough [01:39:48.160 --> 01:39:50.160] Yes, that's what they're saying [01:39:50.160 --> 01:39:54.160] But you did leave, that's perjury [01:39:54.160 --> 01:40:05.160] You need to come back after them for aggravated perjury and tamper them with a government document [01:40:05.160 --> 01:40:15.160] The law specifically, the law in this case is going to say, okay, the owner of the building, these guys weren't the owner [01:40:15.160 --> 01:40:23.160] They did not, who has constructive control of a public building? [01:40:23.160 --> 01:40:29.160] Did the superintendent himself order you to leave or did one of his minions? [01:40:29.160 --> 01:40:40.160] He says he did and so did the minions, but in the court, in the actual court case we've already had, the thing we've already had hearing [01:40:40.160 --> 01:40:48.160] He said that he didn't actually address us by name or look at us personally, he was distracting a group of people [01:40:48.160 --> 01:40:52.160] There was actually no, we weren't talking back and forth with him at all [01:40:52.160 --> 01:40:55.160] So he did not order you to leave? go up there and ask for a case number [01:54:46.160 --> 01:54:48.160] And they said, well, he didn't [01:54:48.160 --> 01:54:50.160] The detective didn't have his case number [01:54:50.160 --> 01:54:52.160] Because the police officer hadn't even [01:54:52.160 --> 01:54:56.160] They never even followed up on this robbery [01:54:56.160 --> 01:54:59.160] That they had made out of a motel here [01:54:59.160 --> 01:55:03.160] But nevertheless, they screwed up and arrested him [01:55:03.160 --> 01:55:05.160] And then he got out [01:55:05.160 --> 01:55:07.160] Again, finally, I got him out of that [01:55:07.160 --> 01:55:11.160] I had to bond him out, by the way, for this [01:55:11.160 --> 01:55:15.160] Because they charged him with a class B criminal [01:55:15.160 --> 01:55:18.160] Terroristic, criminal trespass [01:55:18.160 --> 01:55:21.160] Is what they got him for [01:55:21.160 --> 01:55:23.160] And I guess [01:55:23.160 --> 01:55:26.160] Okay, you have a really good case [01:55:26.160 --> 01:55:28.160] Ron, you know the routine [01:55:28.160 --> 01:55:31.160] He needs to write up a timeline [01:55:31.160 --> 01:55:32.160] Okay [01:55:32.160 --> 01:55:35.160] And we'll just walk him through the process [01:55:35.160 --> 01:55:38.160] The timeline, and once he has the timeline down [01:55:38.160 --> 01:55:40.160] Then we'll go through and look at it [01:55:40.160 --> 01:55:42.160] And isolate out all the claims [01:55:42.160 --> 01:55:46.160] And then research each of the claims, what the elements are [01:55:46.160 --> 01:55:50.160] And just start building a set of claims [01:55:50.160 --> 01:55:55.160] A good chance when he files against them criminally [01:55:55.160 --> 01:55:58.160] He may get some of these guys [01:55:58.160 --> 01:56:03.160] 1509, if he files criminal charges against the chief of police with a magistrate [01:56:03.160 --> 01:56:06.160] The magistrate is commanded to issue a warrant [01:56:06.160 --> 01:56:11.160] And when he doesn't, you get to sue the magistrate personally [01:56:11.160 --> 01:56:16.160] Okay, so file 1509 against chief of police with a magistrate [01:56:16.160 --> 01:56:23.160] Okay, 1509 says that when a complaint is forwarded to a magistrate [01:56:23.160 --> 01:56:27.160] The magistrate shall issue a warrant [01:56:27.160 --> 01:56:30.160] So you create a criminal complaint [01:56:30.160 --> 01:56:34.160] Give it to the magistrate and he is commanded to issue a warrant [01:56:34.160 --> 01:56:38.160] When he doesn't, he fails to perform a duty he is required to perform [01:56:38.160 --> 01:56:43.160] And then the process denies you in the full and free access to or enjoyment of a right [01:56:43.160 --> 01:56:46.160] That is a crime in the state of Texas [01:56:46.160 --> 01:56:52.160] It's a class A misdemeanor and criminal acts are not within scope [01:56:52.160 --> 01:57:00.160] And since the magistrate failed to perform a duty he was required to perform [01:57:00.160 --> 01:57:07.160] That's not within the scope of his office and therefore he has zero immunity [01:57:07.160 --> 01:57:10.160] You sue him personally [01:57:10.160 --> 01:57:14.160] And
