[11:59.920 --> 12:12.480]  dr joe and she's likely to claim that that's work product or whatever i don't care what she claims

[12:19.520 --> 12:27.040]  with the attorney general a lot of you have heard recently about a case in texas where
[12:27.040 --> 12:35.760]  some folks filed criminal charges with the attorney general over voter fraud issues and the courts
[12:35.760 --> 12:41.680]  ruled that the attorney general didn't have subject matter jurisdiction and i kind of agree
[12:41.680 --> 12:47.920]  with that because there's only one place that the attorney general of texas has original jurisdiction
[12:47.920 --> 12:55.520]  in a criminal prosecution and that is a violation of the open records act by a district attorney
[12:55.520 --> 13:03.040]  yuck yuck so i'm giving the district attorney an opportunity to give the attorney general
[13:03.920 --> 13:09.440]  the regional jurisdiction to come after her you know she's likely to do that they're pretty
[13:09.440 --> 13:16.160]  accommodating yes they are paxton seems to be that's our attorney general in texas he seems
[13:16.160 --> 13:22.800]  to be pretty gung-ho about going after these people who violate the open records stuff i hope
[13:22.800 --> 13:31.360]  open records stuff i hope so about him well i have some decisions by some of his funky lawyers

[13:37.280 --> 13:43.920]  open records act and if anybody has looked at my blank forms they'll see that it states in there

[35:19.600 --> 35:21.600]  He's not paying attention to all that stuff.
[35:21.600 --> 35:29.600]  And so you have to highlight it, put it out there on some bullet points, and put it out there.
[35:29.600 --> 35:34.600]  What did you call it, Randy, a motion for a contempt hearing?
[35:34.600 --> 35:45.600]  Yeah, if you want the judge to find her in contempt, you need to ask the court to find her in contempt, because the judge is busy.

[35:47.600 --> 35:50.600]  You remember all the details in this case.
[35:50.600 --> 35:52.600]  He doesn't.
[35:52.600 --> 35:56.600]  So you have to remind him, you have to bring him back up to speed.
[35:56.600 --> 36:02.600]  And say, Judge, you told her to do this, you told her to do that, and she just ignored you.
[36:02.600 --> 36:11.600]  She treated you totally with disrespect, and she deserves sanctions.
[36:11.600 --> 36:13.600]  And I think it's great, Tina.
[36:13.600 --> 36:17.600]  I just want to congratulate you on what I know is a difficult effort.
[36:17.600 --> 36:22.600]  You're keeping track of all of these details and making notes over time.

[36:38.600 --> 36:47.600]  But when I wrote the declaration to the court to detail our effort to resolve the conflicts,
[36:47.600 --> 36:54.600]  as per the judge's November 30th order, I put a conclusion in, you know,
[36:54.600 --> 37:00.600]  saying the story is constantly changing and defendants appear to be finding any excuse they can to avoid timely providing filed
[37:00.600 --> 37:09.600]  and verified tax returns, and their prior counsel stated in his withdrawal that defendants refused to produce documents for him.
[37:09.600 --> 37:14.600]  While the defendants appear to seek to blame everyone but themselves for their current situation
[37:14.600 --> 37:21.600]  and should have filed their taxes every year, this is not the only defining and problematic quality of the issue at hand.
[37:21.600 --> 37:27.600]  The main issue we find is that we are faced with months and months of false and misleading statements
[37:27.600 --> 37:30.600]  about the taxes actually being in the mail.
[37:30.600 --> 37:38.600]  Ms. Baumgardner's final email, one of several affirmative statements about the taxes being in the mail, clearly indicates falsity.
[37:38.600 --> 37:42.600]  Further, while attempting to find solutions to procuring the taxes,
[37:42.600 --> 37:47.600]  we have been met with what we interpret as aggressive and improper responses.
[37:47.600 --> 37:51.600]  We should not be subject to statements such as, your email is full of crap,
[37:51.600 --> 37:55.600]  you have overstepped the lines and threats to call the police, which he has done.
[37:55.600 --> 38:03.600]  When our own emails have been reasoned and polite, and our requests well within the parameters of legally sanctioned protocol.
[38:03.600 --> 38:07.600]  As proselyticans based on our inability to afford an attorney,
[38:07.600 --> 38:14.600]  we have to rely on the power of the court to ensure that suit proceeds in a timely and manly fashion.
[38:14.600 --> 38:21.600]  Thus, we are notifying you in advance of the Joint Status Conference in March of the defendant's evasive behavior.
[38:21.600 --> 38:26.600]  At this point, it appears to be clear they have no intention of releasing the documents to us,
[38:26.600 --> 38:32.600]  thereby not only wasting our time, but the court's time and resources with the constant delays.
[38:32.600 --> 38:38.600]  Plaintiffs respectfully ask slash request that this honorable court apply any and all remedies,
[38:38.600 --> 38:44.600]  sanctions that they are able to against defendants who have and still are evading,
[38:44.600 --> 38:49.600]  resolving the discovery dispute per the court's November 30th order.

[52:30.600 --> 52:33.600]  She's filed her first lawsuit.

[52:34.600 --> 52:37.600]  That is the hump.
[52:37.600 --> 52:42.600]  Once you've done it the first time, after that they get it a lot easier.
[52:42.600 --> 52:45.600]  Now, this is your first lawsuit.
[52:45.600 --> 52:49.600]  They'll throw all kinds of curveballs at you.
[52:49.600 --> 52:52.600]  But you don't care.
[52:52.600 --> 52:53.600]  We have some rules.
[52:53.600 --> 52:58.600]  And I've developed these rules over a long time to help people understand how things work.
[52:58.600 --> 53:07.600]  And one of the rules is you can never expect to win your case in the trial court.
[53:07.600 --> 53:14.600]  You should expect the court to rule against you out of hand at every turn.
[53:14.600 --> 53:16.600]  And that's okay.
[53:16.600 --> 53:21.600]  Because you're not in the trial court to win.
[53:21.600 --> 53:26.600]  You're in the trial court to set the record for appeal.
[53:26.600 --> 53:34.600]  And the worse rulings you get against you, the better it will be for you when you get to the appellate court.
[53:34.600 --> 53:40.600]  So when the judge is really nasty and arrogant and rules against you on everything,
[53:40.600 --> 53:49.600]  okay, no problem, I'll get you back when we get in front of the court of appeals.
[53:49.600 --> 53:52.600]  Get your facts and law on the record.
[53:52.600 --> 53:56.600]  That's your only purpose in the trial court.
[53:56.600 --> 54:02.600]  This understanding that protects you from feeling betrayed by the court.
[54:02.600 --> 54:06.600]  And a lot of times the court is not betraying you.
[54:06.600 --> 54:16.600]  They're working within the limits they have available to them, and you don't always understand what it is.
[54:16.600 --> 54:25.600]  Any time you don't understand what the judge is doing, you file a request for clarification.
[54:25.600 --> 54:31.600]  For the most part, the judges are not out to get you.
[54:31.600 --> 54:33.600]  They don't have time.
[54:33.600 --> 54:36.600]  They're just too busy.
[54:36.600 --> 54:40.600]  Give me what I need and I'll give you the ruling you need.
[54:40.600 --> 54:43.600]  I just don't have time for anything else.
[54:43.600 --> 54:49.600]  So when you don't give the judge what he needs, he gets annoyed and frustrated.
[54:49.600 --> 54:54.600]  And he can't really tell you how to write your pleadings.
[54:54.600 --> 55:03.600]  That's what I did once as a judge in a mock trial, and I was amazed at how difficult it was.
[55:03.600 --> 55:11.600]  This guy is arguing issues that are meaningless, that won't help him win his case.
[55:11.600 --> 55:14.600]  And I'm on his side.
[55:14.600 --> 55:17.600]  And I want to tell him, stop all that garbage.
[55:17.600 --> 55:20.600]  Facts and law, facts and law, facts and law.
[55:20.600 --> 55:27.600]  Anything else, generalizations, your perception of law, what you think it should be,
[55:27.600 --> 55:30.600]  what you think it shouldn't be, that's meaningless.
[55:30.600 --> 55:32.600]  I can't do anything with that.
[55:32.600 --> 55:33.600]  I'm the judge.
[55:33.600 --> 55:36.600]  All I can do, facts and law, facts and law, facts and law.
[55:36.600 --> 55:39.600]  If you give me anything else, you're going to annoy me.
[55:39.600 --> 55:45.600]  So the judge is just there trying to get through this case.
[55:45.600 --> 55:48.600]  Listen to him very carefully.
[55:48.600 --> 55:50.600]  Carefully, okay.
[55:50.600 --> 55:56.600]  They will tell you, if you don't give them what they need, they will tell you.
[55:56.600 --> 55:59.600]  Read their opinions carefully.
[55:59.600 --> 56:12.600]  The judge, he wants to take two opposing positions and find a just adjudication for all parties.
[56:12.600 --> 56:20.600]  He wants the best information from both sides so that he can make the best ruling.
[56:20.600 --> 56:27.600]  And when you don't give him what he needs, he gets frustrated.
[56:27.600 --> 56:33.600]  I'm sitting here and these guys are talking about all this patriot mythology nonsense.
[56:33.600 --> 56:41.600]  And for my part, my perspective as the judge, I don't really care about that.
[56:41.600 --> 56:46.600]  You're just giving me a headache, even forcing me to think about this.
[56:46.600 --> 56:53.600]  I want to hear the facts in the case and the law as it applies to the facts in the case.
[56:53.600 --> 56:56.600]  I don't care about anything else.
[56:56.600 --> 57:01.600]  That's the only thing I can make my ruling on.
[57:01.600 --> 57:10.600]  You can give me the greatest arguments and the most convincing reasons as to why I should rule in your favor.
[57:10.600 --> 57:22.600]  And I may agree with you, but if you don't give me facts and law as it applies to the facts, I can't give you your ruling.
[57:22.600 --> 57:25.600]  Does that make sense?
[57:25.600 --> 57:27.600]  Yes.
[57:27.600 --> 57:35.600]  So avoid doing these philosophical arguments about how things should be.
[57:35.600 --> 57:37.600]  These are the facts.
[57:37.600 --> 57:41.600]  This is the law as it applies to those facts.
[57:41.600 --> 57:44.600]  The judges will like you for that.
[57:44.600 --> 57:53.600]  And I'm going to stop preaching now.

[01:05:06.600 --> 01:05:12.600]  When I'm helping somebody else, it's very easy for me to construct motions and pleadings.
[01:05:12.600 --> 01:05:25.600]  But when I'm addressing my own issues, there's just something in there that drags on me and holds me back and I have to struggle through it.
[01:05:25.600 --> 01:05:34.600]  And you talked about being a procrastinator. Now, there's something about your own cases that makes it hard.
[01:05:34.600 --> 01:05:40.600]  It's an odd thing. You would think it would be easy.
[01:05:40.600 --> 01:05:53.600]  When they were coming after me wanting to put me in jail for a year, I had to really struggle to sit down and focus on my case and produce the documents I need.
[01:05:53.600 --> 01:05:56.600]  It was incredibly hard.
[01:05:56.600 --> 01:05:58.600]  Yes, it is.
[01:05:58.600 --> 01:06:07.600]  It's easier to work on somebody else's. It's easier to give other people advice about what they should be doing.
[01:06:07.600 --> 01:06:13.600]  But when it comes to doing it yourself in your own case, it is just a struggle.
[01:06:13.600 --> 01:06:19.600]  So expect that. But you have to grind through it.
[01:06:19.600 --> 01:06:25.600]  Once I get started, then I can move right along.
[01:06:25.600 --> 01:06:30.600]  But you should set a time every day to work on your case.
[01:06:30.600 --> 01:06:35.600]  No matter what else is going on, you owe it to yourself.
[01:06:35.600 --> 01:06:44.600]  And once you take that first step, then it kind of comes and gets a lot easier.
[01:06:44.600 --> 01:06:53.600]  But anybody out there, you get a ticket, you get anything happens, you have to go defend yourself.
[01:06:53.600 --> 01:06:58.600]  That is so hard.
[01:06:58.600 --> 01:07:06.600]  You call into the show and you ask me a question, and Brett and I, and we just throw these answers out for you.
[01:07:06.600 --> 01:07:10.600]  And you think, oh, these guys got it all together. It's so easy for them.
[01:07:10.600 --> 01:07:16.600]  Well, yeah, it is easy for us when it's not our issue.
[01:07:16.600 --> 01:07:22.600]  When we don't have a dog in the hunt, yeah, it's really easy for us to throw advice at you.
[01:07:22.600 --> 01:07:30.600]  There's no emotional pressure on us to tell you, go handle that.
[01:07:30.600 --> 01:07:36.600]  When it's your own, there's this odd thing that makes it so difficult.
[01:07:36.600 --> 01:07:38.600]  Psychologically, it's heavy.
[01:07:38.600 --> 01:07:46.600]  Just that first step. Once you make the first step and get into your case, then it gets a lot easier.
[01:07:46.600 --> 01:07:47.600]  Okay.
[01:07:47.600 --> 01:07:50.600]  But making that first step.
[01:07:50.600 --> 01:07:55.600]  Making the first step and Tina really, it's all her fault, all her fault.
[01:07:55.600 --> 01:08:06.600]  And if Tina is still online, she did help me go to some kind of site and they help you write some legal pleadings.

[01:09:02.600 --> 01:09:11.600]  Yeah, whatever they do, whatever they tell you you did wrong, 99.9% of the time you can fix it.
[01:09:11.600 --> 01:09:17.600]  There are a few – the worst thing you can do is miss deadlines.
[01:09:17.600 --> 01:09:18.600]  Okay, wonderful.
[01:09:18.600 --> 01:09:22.600]  Deadlines can be sudden death.
[01:09:22.600 --> 01:09:32.600]  And when you start really kicking their behinds, what they're going to try to do is beat you on technical procedural issues.
[01:09:32.600 --> 01:09:33.600]  That's right.
[01:09:33.600 --> 01:09:45.600]  I had a friend in court with them seven years, and the lawyers said, well, you're objecting to this inability to pay issue.
[01:09:45.600 --> 01:09:53.600]  If you'll just drop the inability to pay issue, we will do these concessions.
[01:09:53.600 --> 01:09:55.600]  He dropped – he said, okay.
[01:09:55.600 --> 01:10:01.600]  He dropped the inability to pay issue, and the judge said, boom, case is over.
[01:10:01.600 --> 01:10:07.600]  Since you dropped that, you're out of time.
[01:10:07.600 --> 01:10:11.600]  The lawyers set him up.
[01:10:11.600 --> 01:10:17.600]  Always assume the other side is setting you up.
[01:10:17.600 --> 01:10:18.600]  Okay.
[01:10:18.600 --> 01:10:21.600]  Read the rules.
[01:10:21.600 --> 01:10:22.600]  Okay.
[01:10:22.600 --> 01:10:29.600]  Twice, at least twice, and then you will catch them when they're trying to set you up.
[01:10:29.600 --> 01:10:35.600]  And then you'll also be able to trigger when they do something, and you have to respond in the moment,
[01:10:35.600 --> 01:10:44.600]  and you've got this giant list of rules to look through, but you will think, oh, I've seen something about that, and you can pretty well go find it.
[01:10:44.600 --> 01:10:45.600]  Yeah.
[01:10:45.600 --> 01:10:47.600]  That's why you read them twice.
[01:10:47.600 --> 01:10:49.600]  You don't try to understand them.
[01:10:49.600 --> 01:10:54.600]  Just read them through, and then go back and read them through a second time.
[01:10:54.600 --> 01:11:01.600]  When you read them through the second time, you'll start developing what we call referential index.
[01:11:01.600 --> 01:11:10.600]  You read this rule in the front that didn't make sense the first time you read it, but the second time you read it, you'll say, wait a minute, wait a minute, wait a minute.
[01:11:10.600 --> 01:11:19.600]  That goes to this rule way back here in the back, and you'll start stitching these references together.
[01:11:19.600 --> 01:11:27.600]  And once you've read them twice, you won't remember all that stuff.
[01:11:27.600 --> 01:11:32.600]  You can open the book and look at it and think, I don't remember any of this stuff.
[01:11:32.600 --> 01:11:40.600]  But when you get in the trenches and the lawyer says, well, she should have done this or she should have done that,
[01:11:40.600 --> 01:11:48.600]  your brain will go in and pull out the rule, and it'll hold it in front of you like a flag.
[01:11:48.600 --> 01:11:52.600]  And you'll say, oh, but what about this code or this code?
[01:11:52.600 --> 01:11:57.600]  People listen to me talking on the radio and Brett, and they say something,
[01:11:57.600 --> 01:12:04.600]  and we just jerk out this code or that other code or whatever, and they think we have all these memorized.
[01:12:04.600 --> 01:12:06.600]  No, we don't.
[01:12:06.600 --> 01:12:19.600]  We've just read through them, and you say something that a set of words triggers something we've seen somewhere else,
[01:12:19.600 --> 01:12:27.600]  and our brain says, wait a minute, I've seen that before, and you need to go look over here.

[01:26:07.600 --> 01:26:13.600]  But if you haven't just stated the proper name in this sentence,
[01:26:13.600 --> 01:26:20.600]  if you're in another sentence, don't put the pronoun in, use the proper name.
[01:26:20.600 --> 01:26:26.600]  There's an interesting thing about how the brain reads words.
[01:26:26.600 --> 01:26:28.600]  When I was helping people with foreclosures,
[01:26:28.600 --> 01:26:33.600]  we're always dealing with the Real Estate Settlement Procedures Act.
[01:26:33.600 --> 01:26:39.600]  That's half a sentence, Real Estate Settlement Procedures Act.
[01:26:39.600 --> 01:26:47.600]  But the brain, when it sees that, it sees the whole thing all at once.
[01:26:47.600 --> 01:26:51.600]  Boom, one fixation, Real Estate Settlement Procedures Act.
[01:26:51.600 --> 01:26:59.600]  If you put in RESPA, the brain will stop and stumble,
[01:26:59.600 --> 01:27:09.600]  and it will go back and read the R, Real, Real Estate, then Settlement Procedures Act.
[01:27:09.600 --> 01:27:16.600]  It has to make sure that the words it thinks this refers to
[01:27:16.600 --> 01:27:21.600]  actually matches the letters that are in there.
[01:27:21.600 --> 01:27:27.600]  Every single time, the brain will have to stop and do that.
[01:27:27.600 --> 01:27:31.600]  If you put in Real Estate Settlement Procedures Act,
[01:27:31.600 --> 01:27:39.600]  the brain will see that in one fixation as if it's one piece.
[01:27:39.600 --> 01:27:42.600]  There are a lot more words in the document,
[01:27:42.600 --> 01:27:47.600]  but they do not take more space in the mind of the reader.

[01:27:49.600 --> 01:27:57.600]  If you say Real Estate Settlement Procedures Act is a consumer protection law,
[01:27:57.600 --> 01:28:05.600]  and everybody in the business is familiar with RESPA, that's okay.
[01:28:05.600 --> 01:28:09.600]  If you say Real Estate Settlement Procedures Act brackets RESPA,
[01:28:09.600 --> 01:28:15.600]  and then you refer to that again in the same sentence, RESPA is okay,
[01:28:15.600 --> 01:28:20.600]  because the brain then doesn't have to make sure this matches,
[01:28:20.600 --> 01:28:23.600]  because they're both in the same sentence.
[01:28:23.600 --> 01:28:27.600]  But if you go to another sentence, don't use RESPA,
[01:28:27.600 --> 01:28:30.600]  use Real Estate Settlement Procedures Act.

[01:34:13.600 --> 01:34:18.600]  like where we write a document and file it with the court,
[01:34:18.600 --> 01:34:23.600]  when someone is reading it, they can't say to us in the middle of reading it
[01:34:23.600 --> 01:34:26.600]  that they don't understand what the heck we're talking about,
[01:34:26.600 --> 01:34:30.600]  or that we've lost them.
[01:34:30.600 --> 01:34:37.600]  And so we have to, especially in something as important as legal documents,
[01:34:37.600 --> 01:34:43.600]  we have to be very conscious of the mind of our reader.
[01:34:43.600 --> 01:34:46.600]  How are we moving the mind of our reader,
[01:34:46.600 --> 01:34:52.600]  and are we making statements that causes the reader to stop and stumble and think,
[01:34:52.600 --> 01:34:58.600]  what in the heck are they talking about, or how did they get to this point?
[01:34:58.600 --> 01:35:02.600]  We have to stitch everything together very carefully.
[01:35:02.600 --> 01:35:05.600]  Does that make sense, E.J.?
[01:35:05.600 --> 01:35:11.600]  Yes, it helps with the basics, always.
[01:35:11.600 --> 01:35:16.600]  So it's really good to hear, yes, it makes sense.
[01:35:16.600 --> 01:35:21.600]  And I'm doing this so that when people are writing their own documents,
[01:35:21.600 --> 01:35:29.600]  I'm hoping that this back and forth will kind of stick in their mind,

[01:50:45.600 --> 01:50:51.600]  And then in parentheses, he's claiming he received my letter on January 20th.
[01:50:51.600 --> 01:50:58.600]  And he's saying here that he immediately responded the same day to the letter when he finally received it.
[01:50:58.600 --> 01:51:02.600]  So he's saying it took my letter 10 days to get to him.

[01:51:35.600 --> 01:51:42.600]  Yeah, that's a box that he has sitting in his office and it never even saw the post office that day.
[01:51:42.600 --> 01:51:46.600]  They just say run it through the meter and throw it in a pile.
[01:51:46.600 --> 01:51:52.600]  And they're supposed to deliver it that same day to the post office.
[01:51:52.600 --> 01:51:57.600]  But the pattern is they don't really necessarily do that.
[01:51:57.600 --> 01:52:01.600]  It's actually worse than that because it's not even metered mail.
[01:52:01.600 --> 01:52:08.600]  The envelope is a pre-paid envelope and so there's no metering.

[01:52:12.600 --> 01:52:19.600]  Does the pre-sorted envelope get a post office cancellation stamp?

[01:52:53.600 --> 01:53:04.600]  I was talking about them being able to verify that this was actually sent on this day.

[01:53:09.600 --> 01:53:23.600]  But that goes back to my informed delivery has got them because the post office sent me documentation of when the post office put it in my PO box.

[01:53:29.600 --> 01:53:36.600]  And eight, nine days is ridiculous.

[01:53:51.600 --> 01:54:02.600]  So when I sent him my first correspondence back, I started out a RE unsigned, undated letter from your office.

[01:54:06.600 --> 01:54:11.600]  And I sent that letter to him on January 11th, put in the mail on January 11th.
[01:54:11.600 --> 01:54:15.600]  I'm sure he got it on the 12th or the 13th of January.
[01:54:15.600 --> 01:54:21.600]  And then he turns around and in this letter, he's claiming to have sent me on January 20th.
[01:54:21.600 --> 01:54:32.600]  In the regarding section, he puts, you know, a response to my letter from January 11th and then in parentheses, received January 20th.
[01:54:32.600 --> 01:54:36.600]  Because he's so prompt and timely.

[01:54:38.600 --> 01:54:43.600]  So, you know, look, he seemed like a nice guy before.
[01:54:43.600 --> 01:54:52.600]  But I did realize after our initial meeting at the court, after I slept on it, that he had been deceptive.
[01:54:52.600 --> 01:54:57.600]  But now I have it in writing that he's deceptive.
[01:54:57.600 --> 01:55:04.600]  But he goes on and he says, thank you for your letter dated January 11th.
[01:55:04.600 --> 01:55:06.600]  I appreciate your perspective.

[01:55:09.600 --> 01:55:19.600]  I have been appointed to represent you through the office of the independent defender in an entity wholly separate from the public defender's office.

[01:55:27.600 --> 01:55:33.600]  Therefore, the lawsuit you have referenced does not create a conflict for my office.
