[04:40.600 --> 04:49.200] Little update on what's been going on around here, I've been working on a set of documents [04:49.200 --> 04:50.800] for traffic. [04:50.800 --> 04:55.600] I'm kind of working over South Lake, Texas. [04:55.600 --> 05:06.360] South Lake is just south of or just west of the DFW airport, and it's a couple hundred [05:06.360 --> 05:10.240] thousand people and they write lots and lots of tickets. [05:10.240 --> 05:17.080] They wrote a friend of mine, one of his drivers, a ticket, and I went down there to a hearing [05:17.080 --> 05:22.640] and they were having one of these cattle call hearings where they order you to show up so [05:22.640 --> 05:27.040] that you can meet with a prosecuting attorney. [05:27.040 --> 05:35.680] And subsequently filed with the municipal judge 58 counts of impersonating a public [05:35.680 --> 05:36.680] official. [05:36.680 --> 05:47.840] As you might guess, the municipal judge was not pleased with my filing and instructed [05:47.840 --> 05:57.720] me that I could not file a criminal complaint unless I was harmed by the crime. [05:57.720 --> 06:04.360] And I told her that was confusing since 38.171 Texas Penal Code makes it a Class A misdemeanor [06:04.360 --> 06:08.720] if you have knowledge that a felon has been committed and you don't report that knowledge. [06:08.720 --> 06:13.640] Now you're telling me I can't report the knowledge unless I've been injured by the act. [06:13.640 --> 06:20.080] And that's absolutely, that's the deal, she's not taking my complaint. [06:20.080 --> 06:34.280] So I went to the local JP and you probably won't believe this, but he was no more receptive. [06:34.280 --> 06:36.480] You can take my complaint if you can believe that. [06:36.480 --> 06:43.040] Now this guy, well both of these are, I haven't bargrieved them in five judicial condo complaints [06:43.040 --> 06:52.280] quite yet, but I'm in the process of stacking the chips on them. [06:52.280 --> 06:58.880] My next stop is the county court and when the county judge refuses to hear the complaint [06:58.880 --> 07:03.840] then the next stop will be a district court asking for a court of inquiry. [07:03.840 --> 07:08.320] So that side should get interested. [07:08.320 --> 07:15.400] I have a complaint in against my local federal judge. [07:15.400 --> 07:19.880] He dismissed one of my cases with prejudice. [07:19.880 --> 07:24.880] I'm trying to take a bit of a different approach toward judges. [07:24.880 --> 07:32.040] This is not something that I've been actively doing in the past, but when the judge sits [07:32.040 --> 07:42.240] on the bench and renders a ruling that has the effect of denying a litigant in the due [07:42.240 --> 07:50.080] course of the laws, for instance, if you file a motion or a pleading with more than one [07:50.080 --> 07:57.240] issue in it and the judge rules against one or two of the issues and just ignores the [07:57.240 --> 08:00.320] third one. [08:00.320 --> 08:08.160] Well the way I read the law, that's an act of official oppression wherein the judge denied [08:08.160 --> 08:14.960] the petitioner the right to petition the court for redress of grievance because he refused [08:14.960 --> 08:18.880] to hear his complaint. [08:18.880 --> 08:22.520] And the courts say, well if you don't like the ruling you get from the judge you can [08:22.520 --> 08:27.080] always appeal to a higher court. [08:27.080 --> 08:32.680] Yeah you go before a corrupt judge, he renders a bogus decision and they say, oh that's okay. [08:32.680 --> 08:37.520] You can go before a whole panel of corrupt judges and they'll really screw you royals. [08:37.520 --> 08:43.000] Now that's what I told Bob Perkins, head criminal district judge in Travis County when I was [08:43.000 --> 08:48.360] filing criminal charges against all the highest judges in Texas. [08:48.360 --> 08:52.760] Well I had a better idea then, I have a better idea now. [08:52.760 --> 08:59.320] Instead of appealing to the court of appeals or in conjunction with appealing to the court [08:59.320 --> 09:06.560] of appeals, I filed criminal charges against the judge or the grand jury and appeal to [09:06.560 --> 09:13.640] them to indict the scoundrel and see how that works out for them. [09:13.640 --> 09:20.040] So I filed criminal charges against Judge John McBride. [09:20.040 --> 09:23.480] Judge McBride is a real stinker. [09:23.480 --> 09:30.720] This guy is, he just not, doesn't play well with others and all of the lawyers hate to [09:30.720 --> 09:36.480] get in front of this guy because he will sanction them at the drop of the hat. [09:36.480 --> 09:44.240] He's been sanctioned himself by the higher courts on more than one occasion for his treatment [09:44.240 --> 09:47.760] of litigants before his court. [09:47.760 --> 09:56.760] If you file a pro se pleading before John McBride, John McBride will dismiss your pleading [09:56.760 --> 10:05.400] with prejudice absolutely without regard to the right of things of the rule of law. [10:05.400 --> 10:13.560] I filed a quiet title action in the state which had only state issues in it. [10:13.560 --> 10:18.840] Wells Fargo removed it to the federal court which they had a right to do. [10:18.840 --> 10:29.160] However with the 2011 venue and removal clarification act, the judge was required to sever all state [10:29.160 --> 10:32.800] claims and remand them to the state. [10:32.800 --> 10:35.760] He was required by statute. [10:35.760 --> 10:45.320] This is a relatively new law that went into effect in 2012 that had the effect of changing [10:45.320 --> 10:49.200] several, couple hundred years of law. [10:49.200 --> 10:58.760] It had been held that if a state case is appealed to the county court, the county court can [10:58.760 --> 11:09.480] hear, I'm sorry, if a state case is appealed to the federal court and it has federal and [11:09.480 --> 11:16.320] state issues, the feds can hear both the state and the fed issues under judicial economy. [11:16.320 --> 11:23.760] Well, some of the circuits began to disagree with that so there was a split in the circuit. [11:23.760 --> 11:28.640] Some of the circuits said, no, we can't hear state issues, it's an undue preemption of state [11:28.640 --> 11:29.640] law. [11:29.640 --> 11:35.960] So the legislature weighed in on the issue and they agreed with the latter and said while [11:35.960 --> 11:44.960] a case with state issues can be appealed to the federal court, the state issues cannot [11:44.960 --> 11:49.600] be heard by the federal court, they must sever them and remand. [11:49.600 --> 11:53.680] Well there were only state issues in this case. [11:53.680 --> 12:00.600] And since the statute forbade the judge to hear them, I didn't file a motion to remand, [12:00.600 --> 12:04.680] I filed a challenge to subject matter jurisdiction. [12:04.680 --> 12:09.760] The other side immediately filed a 12B6. [12:09.760 --> 12:16.640] Without hearing the subject matter jurists challenge, Judge Mupuy dismissed my case with [12:16.640 --> 12:19.640] prejudice. [12:19.640 --> 12:29.400] The same day I non-suited, the reason I non-suited is that Wells Fargo claimed they weren't the [12:29.400 --> 12:30.400] lender. [12:30.400 --> 12:36.040] Oh my goodness, since you're not the lender, I made a mistake and I non-suited. [12:36.040 --> 12:44.720] What that did is subjected Wells Fargo to a collateral estoppel. [12:44.720 --> 12:51.520] They cannot now come back to the court and claim they have standing to enforce this contract [12:51.520 --> 12:57.320] because they've already stated in the court that they are not the lender and because they [12:57.320 --> 12:59.280] stated that I'm non-suited. [12:59.280 --> 13:03.680] So the point was I didn't have a dog in the hut. [13:03.680 --> 13:11.480] The judge dismissed with prejudice but I didn't care because I was dismissing it anyway. [13:11.480 --> 13:16.480] And yes, he didn't have the authority to do that. [13:16.480 --> 13:25.080] So I filed criminal charges with the local special agent in charge, the FBI in Dallas. [13:25.080 --> 13:27.960] Now he's had time to report it to the attorney general. [13:27.960 --> 13:36.560] Now I am preparing a FOIA to the attorney general requesting a copy of the notice given [13:36.560 --> 13:46.040] to him under 28 USC 535 by the special agent in charge in Dallas. [13:46.040 --> 13:50.200] When a federal official has it made known to them that another federal official has [13:50.200 --> 13:55.960] violated the law or committed a crime, it doesn't say related to his office or anything [13:55.960 --> 14:04.480] else just committed a crime, that employee is required to report the crime directly to [14:04.480 --> 14:07.160] the attorney general. [14:07.160 --> 14:10.960] Somehow I bet the SAC did not do that. [14:10.960 --> 14:14.840] And when I send my information request to the attorney general, I'll get a response [14:14.840 --> 14:21.040] saying we have no documents responsive to your request and then I'll file against the [14:21.040 --> 14:28.360] SAC with the attorney, with the US attorney and just start a big fight down there. [15:11.680 --> 15:18.600] I'm in the middle of the, the best way I can describe it is the steamroller process [15:18.600 --> 15:25.920] and we have not got government response yet and I'm told to expect that on tomorrow. [15:25.920 --> 15:32.440] But all the pre-trial papers are in and we have a pre-trial hearing on the 2nd of March [15:32.440 --> 15:42.920] and basically the action brought against me was based on a task force officer who came [15:42.920 --> 15:50.080] onto my property while I was not even in the country and between him and his good friend, [15:50.080 --> 15:57.480] his confidential source created a big problem for me. [15:57.480 --> 16:08.160] And they got a warrant based on a trespass and things have gone downhill from there. [16:08.160 --> 16:15.280] We got the warrant unsealed only less than a week ago and there's an entire attachment [16:15.280 --> 16:23.040] section missing from the warrant and the warrant has no something called particularity in either [16:23.040 --> 16:28.880] departments, the area to be searched or the other side of it. [16:28.880 --> 16:36.120] But the issue is quite complex because they did a lot of damage to me while I was not [16:36.120 --> 16:37.120] even on the property. [16:37.120 --> 16:44.960] They destroyed certain computer evidence in terms of that nature and hence this has become [16:44.960 --> 16:48.400] a very, very big problem. [20:03.000 --> 20:13.280] One of the things we talk about on the radio about cases in court, about going to court, [20:13.280 --> 20:20.280] you can expect the court to rule against you out of hand at every turn. [20:20.280 --> 20:27.120] Now maybe they want you to treat the court as if they're going to, and you will never [20:27.120 --> 20:34.400] win your case simply because you have the law and the facts on your side. [20:34.400 --> 20:36.000] To think so is naive. [20:36.000 --> 20:39.360] It is not that way now. [20:39.360 --> 20:44.800] It never has been that way in these United States. [20:44.800 --> 20:53.320] You'll win your case if you have the politics on your side, and all politics is local. [20:53.320 --> 20:57.640] So if you're going to have a chance of beating these guys, you've got to understand where [20:57.640 --> 20:59.280] they live. [20:59.280 --> 21:09.560] And right now, that U.S. attorney, he's living in a very precarious place. [21:09.560 --> 21:18.720] When a new president takes office, every U.S. attorney in the country must file a resignation [21:18.720 --> 21:22.000] with the new president. [21:22.000 --> 21:29.480] And the president decides rather to accept that resignation or not. [21:29.480 --> 21:36.680] And with Trump coming in, he ran as a Republican, but he's really not. [21:36.680 --> 21:42.440] Neither the Republicans nor the Democrats like him, and he doesn't like either one of [21:42.440 --> 21:44.840] them. [21:44.840 --> 21:48.480] So everybody's nervous. [21:48.480 --> 21:51.080] Nobody knows what's going to happen. [21:51.080 --> 21:54.720] They don't know if they're going to keep their jobs or not. [21:54.720 --> 21:59.680] And Trump is new to politics. [21:59.680 --> 22:05.000] So he's going to need some folks he can count on to be on his side. [22:05.000 --> 22:11.000] And one of the ways presidents generally do that is with really nice appointments. [22:11.000 --> 22:18.440] So Trump is going to want to make some really nice appointments with that political climate [22:18.440 --> 22:19.440] set. [22:19.440 --> 22:22.400] Let's talk about the U.S. attorney. [22:22.400 --> 22:29.720] For the most part, U.S. attorneys do not care if you are innocent or guilty. [22:29.720 --> 22:35.200] What they're going to try to do is force you to take a deal, and they have some really [22:35.200 --> 22:41.600] dirty, rotten, lousy tricks in order they use to get that done with. [22:41.600 --> 22:54.680] One of the things that you need to do is put in a request to the federal court requesting [22:54.680 --> 23:03.520] the billing to the court reporter for the grand jury for the period of time before and [23:03.520 --> 23:05.680] after you were indicted. [23:05.680 --> 23:06.680] Okay. [23:06.680 --> 23:13.480] Here's the reason. [23:13.480 --> 23:21.800] You want the billing that the grand jury's court reporter gave to the clerk. [23:21.800 --> 23:29.600] Now everything about the grand jury is secret except the money they have to pay out. [23:29.600 --> 23:38.040] We did this in California, they were going after our next player, and when we put in [23:38.040 --> 23:42.320] the request, the court reporter came back and said, I mean, the clerk came back and [23:42.320 --> 23:50.680] said there was no billings on the day we were looking for. [23:50.680 --> 23:53.520] Wonder how that happens. [23:53.520 --> 23:55.720] This is how that happens. [23:55.720 --> 24:02.000] The U.S. attorney has a rubber stamp with the grand jury's name on it. [24:02.000 --> 24:11.640] Generally, what the U.S. attorney do is go to the grand jury for a minor issue to get [24:11.640 --> 24:13.240] an indictment. [24:13.240 --> 24:19.920] Once he has a minor indictment, now he'll start his research and everything else he [24:19.920 --> 24:28.280] finds, every other subsequent indictment is called a superseding indictment, and he rubber [24:28.280 --> 24:31.520] stamps all the superseding indictments. [24:31.520 --> 24:33.000] Wow. [24:33.000 --> 24:34.560] Yeah. [24:34.560 --> 24:44.800] So, when the litigant filed the claim that there was no grand jury hearing that day, [24:44.800 --> 24:47.680] all of a sudden the indictment went away. [24:47.680 --> 24:50.600] That was really ugly politics. [24:50.600 --> 24:56.840] So that's the first thing you want to look at, and when you do this, they will let the [24:56.840 --> 25:01.520] U.S. attorney know what you're asking for. [25:01.520 --> 25:07.960] Even if he hasn't rubber stamped a superseding indictment, this will absolutely make sure [25:07.960 --> 25:11.600] he doesn't because he knows you're watching. [25:11.600 --> 25:12.600] Okay. [25:12.600 --> 25:20.920] Next thing, he doesn't care if you're guilty or innocent because the saying is you may [25:20.920 --> 25:24.000] beat the time, but you won't beat the ride. [25:24.000 --> 25:32.400] He's going to try to drag you through the courts and hound you and pressure you until [25:32.400 --> 25:35.560] you make a deal with it. [25:35.560 --> 25:42.280] So my suggestion is, and this is a little radical, it may be difficult at first, but [25:42.280 --> 25:48.440] if he wants to start a fight with you, accommodate him. [25:48.440 --> 25:55.200] Two people can do this. [25:55.200 --> 25:59.440] First thing you need to do is look at everything he's done. [25:59.440 --> 26:02.620] These guys are so corrupt. [26:02.620 --> 26:08.560] They wouldn't follow the law even if they knew what it was, and they don't. [26:08.560 --> 26:14.280] I have yet to find a single prosecutor who knew the law he was enforcing. [26:14.280 --> 26:17.320] Now, there is a statute. [26:17.320 --> 26:18.320] Bar grievance. [26:18.320 --> 26:19.320] Yeah. [26:19.320 --> 26:24.840] Well, more than bar grievance, U.S. attorney, this is even better. [26:24.840 --> 26:25.840] It's a... [26:25.840 --> 26:26.840] Okay. [26:44.520 --> 26:53.360] The effect of it is, you are a government official and you have knowledge that another [26:53.360 --> 26:56.840] employee of the government has committed a crime. [26:56.840 --> 27:06.120] It's kind of tough for you to tell on your fellow officials. [27:06.120 --> 27:11.760] So the legislature passed this statute that says, if you're a federal official and you [27:11.760 --> 27:19.000] have knowledge that another official has committed a crime, you are to give notice to the attorney [27:19.000 --> 27:22.820] general in Washington, D.C. [27:22.820 --> 27:28.280] So you bypass all the locals, all the people you work with. [27:28.280 --> 27:37.880] And since you are statutorily required, if you don't and the fact of the crime comes [27:37.880 --> 27:45.320] out and the fact that you knew about it comes out, then you're subject to prosecution. [27:45.320 --> 27:50.320] So it gives the official plausible deniability. [27:50.320 --> 27:52.120] Okay. [27:52.120 --> 27:58.240] I doubt that any official has ever given notice to the attorney general. [27:58.240 --> 28:05.640] So I was saying earlier, I filed some criminal charges against the federal judge. [28:05.640 --> 28:18.240] And once you file against them, the prosecutor, an FBI agent, anybody, then you kind of poison [28:18.240 --> 28:21.720] their well. [28:21.720 --> 28:32.200] Now that I filed against the federal judge, the FBI agents absolutely will not talk to [28:32.200 --> 28:34.840] me. [28:34.840 --> 28:36.960] Part of it is they know who I am. [28:36.960 --> 28:47.760] The other part is, if an agent or anyone working for the FBI says one word that I can construe [28:47.760 --> 28:56.920] as a threat, for instance, I've had a U.S. attorney in Fort Lauderdale tell me when I [28:56.920 --> 29:04.560] filed a criminal complaint with the grand jury there, that if I did that again, that [29:04.560 --> 29:09.880] he would charge me with jury tampering. [29:09.880 --> 29:16.040] Oh, my, I took that as a threat. [29:16.040 --> 29:22.640] That is tampering with a witness, obstruction of justice. [29:22.640 --> 29:30.000] So I told the U.S. attorney, I'm going to send a complaint in against you for threatening [29:30.000 --> 29:31.000] me. [29:31.000 --> 29:35.840] And if you interfere with that complaint, then I'll charge you with witness tampering [29:35.840 --> 29:37.360] and obstruction of justice. [29:37.360 --> 29:41.920] If you want to charge me with jury tampering, you knock yourself out. [29:41.920 --> 29:45.040] We'll see who comes out ahead on this. [29:45.040 --> 29:51.200] The next day, they fired the IRS agent group going after it. [29:51.200 --> 29:55.000] They fired that agent to get us to go away and leave them alone. [35:16.280 --> 35:24.040] A month later, when I declined his offer, which was not an offer, he actually sent two [35:24.040 --> 35:31.280] of the agents to my son's high school, dragged him out of class, to serve in the subpoena. [35:31.280 --> 35:44.200] Okay, I don't know enough about the case to understand whether he has grounds for that [35:44.200 --> 35:52.800] or not, if it is your position that someone entered your property while you were out of [35:52.800 --> 36:00.480] country and secured information that they then used to get a warrant, that's a great [36:00.480 --> 36:11.360] thing to keep them in court with, but that goes to the merits of the case, and there's [36:11.360 --> 36:15.080] something important to understand before you get to the merits. [36:15.080 --> 36:22.560] One thing about going into a meeting with the prosecuting attorney, never ever go into [36:22.560 --> 36:29.240] a private office with the prosecuting attorney. [36:29.240 --> 36:36.280] They can lie like dogs, don't ever talk to them without a recording. [36:36.280 --> 36:43.600] Take two recorders with you, one they can see, one they can't see. [36:43.600 --> 36:47.280] Take the one they can see and place it on the table, and they're going to insist that [36:47.280 --> 36:52.880] you turn it off, turn it off, don't tell them about the other one. [36:52.880 --> 37:00.200] We had someone call in from New York and played the audio of the police officers trying to [37:00.200 --> 37:05.640] figure out how to erase the first tape. [37:05.640 --> 37:12.440] That was a hoot, but if you can avoid it, never go into his office. [37:12.440 --> 37:21.120] If he wants to meet with you, public place, make sure you take a witness, and he may tell [37:21.120 --> 37:28.880] you, well, only you can be here, and you tell him, then we don't talk. [37:28.880 --> 37:31.240] That's not going to happen. [37:31.240 --> 37:37.040] If he doesn't want what he said recorded, there's a real good reason he doesn't want [37:37.040 --> 37:40.960] what he says recorded. [37:40.960 --> 37:47.440] Every time you talk to one of them, as soon as you're finished, sit down and write out [37:47.440 --> 37:50.640] a statement of what was said. [37:50.640 --> 37:56.060] Immediately, that is one of the most powerful tools you can have. [37:56.060 --> 37:59.800] That's better than a recording. [37:59.800 --> 38:04.320] They will jump up and down and rail in righteous indignation about recordings and try to keep [38:04.320 --> 38:05.320] those out. [38:05.320 --> 38:14.040] But if you write a transcript, especially if you have a recording, then you write out [38:14.040 --> 38:17.600] a transcript of what's in the recording. [38:17.600 --> 38:24.400] In the transcript, you can make comments about what was going on that aren't necessarily [38:24.400 --> 38:33.720] represented in the voice recording, what was going on when the person was speaking or in [38:33.720 --> 38:36.480] between. [38:36.480 --> 38:45.000] That is more powerful in court than a recording, and that's not something they can keep out. [38:45.000 --> 38:49.360] Those are just some basic things to know and understand. [38:49.360 --> 38:55.080] Have you read the code, the statute that they're charging you with? [38:55.080 --> 38:58.040] I have, yes. [38:58.040 --> 39:05.120] Have you looked up case law concerning how that statute is to be enforced? [39:05.120 --> 39:20.440] There's two of the things that they propose that not even seasoned people, seasoned lawyers, [39:20.440 --> 39:23.920] can actually narrow down and make sense out of. [39:23.920 --> 39:29.320] It's so messed up, two of those issues. [39:29.320 --> 39:40.920] Even the agent who has false officer calling what you want, high at hand, has serious... He [39:40.920 --> 39:43.760] does not understand what he wrote either. [39:43.760 --> 39:52.800] Okay, then that should... Before I say anything about that, I would need to see what's there [39:52.800 --> 39:56.120] to best evaluate how to handle that. [39:56.120 --> 40:00.640] Something like that is good for you, but you need to be careful how you use it. [40:00.640 --> 40:02.320] You don't want to give them fair warning. [40:02.320 --> 40:04.560] That's one of my rules. [40:04.560 --> 40:09.280] Never ever give fair warning. [40:09.280 --> 40:16.960] Bushwhack is better, and bushwhack's perfectly acceptable in criminal trials. [40:29.840 --> 40:35.720] It's hard for me to... I can't really give you a whole lot on your issue, but all I can [40:35.720 --> 40:38.520] do at this point is give you general information. [40:41.520 --> 40:48.520] I've got elbow counsel, and it's better that way because the one I had before was actually [40:48.520 --> 40:51.320] probably the best friend's golf mate. [40:59.480 --> 41:09.800] The lawyer's going to try to screw you, however, he hasn't ran into the pro se from hell yet. [41:09.800 --> 41:12.440] This is how you handle your lawyer. [41:12.440 --> 41:19.120] You tell the lawyer what he's going to do, and when he doesn't, you bar-grieve him. [41:19.120 --> 41:24.000] When you bar-grieve him, he's going to have a conniption fit, and he's going to run to [41:24.000 --> 41:30.200] the court and ask the court to remove him from the case. [41:30.200 --> 41:34.480] You're going to go to the court and tell the court, don't you dare remove him from that [41:34.480 --> 41:35.880] case. [41:35.880 --> 41:39.880] He is my counsel of choice, and he's under contract. [41:39.880 --> 41:45.080] We had a woman in a bankruptcy recently, and the judge, she bar-grieved the lawyer because [41:45.080 --> 41:49.000] he wouldn't file motions of pleadings. [41:49.000 --> 41:54.920] He asked to be removed, and she went in and objected, and the judge said, well, Miss Ortiz, [41:54.920 --> 41:59.120] if you can't get along with your lawyer, why don't you want him to withdraw? [41:59.120 --> 42:02.000] She said, he's under contract. [42:02.000 --> 42:04.120] I paid him. [42:04.120 --> 42:05.440] He owes me. [42:05.440 --> 42:09.680] I don't care if he likes me or not. [42:09.680 --> 42:13.840] The judge turned to the lawyer and said, I'm sorry, counsel, you're going to have to find [42:13.840 --> 42:17.000] a way to get along with your lawyer. [42:17.000 --> 42:24.800] If the judge had removed the lawyer, then you get to sue the judge for interfering with [42:24.800 --> 42:27.480] a private contract. [42:27.480 --> 42:32.360] That's outside the scope of his authority. [42:32.360 --> 42:43.160] He can allow the lawyer to withdraw, but only if you authorize it, so don't authorize it. [42:43.160 --> 42:45.120] Here's how it works. [42:45.120 --> 42:48.760] You go into court, and you sit down at the table. [42:48.760 --> 42:53.120] It's like a four-sided chessboard. [42:53.120 --> 42:54.240] You're one of the players. [42:54.240 --> 42:56.560] You're sitting at the table. [42:56.560 --> 43:01.960] Your lawyer's to your right, opposing counsel is to your left, the judge is across from [43:01.960 --> 43:03.520] you. [43:03.520 --> 43:06.920] You have a relationship with your lawyer. [43:06.920 --> 43:12.720] Your lawyer has a relationship with opposing counsel and with the judge, so you're the [43:12.720 --> 43:22.040] odd man out, unless you can use their relationships with one another to your advantage. [43:22.040 --> 43:29.280] The way you do that is you kick your lawyer right square in his professional pants. [43:29.280 --> 43:34.480] He then goes to the judge and the other lawyer and say, I've got an unruly client here. [43:34.480 --> 43:36.080] He's going to ruin my career. [47:08.560 --> 47:09.560] Tennessee is one of them. [47:09.560 --> 47:12.280] They're legal in Tennessee too. [47:12.280 --> 47:14.440] So they're legal in Tennessee. [47:14.440 --> 47:19.880] So what is their claim? [47:19.880 --> 47:26.320] Their claim is that I knowingly avoided and I have possession of without paying a tax [47:26.320 --> 47:30.240] stamp. [47:30.240 --> 47:33.360] So they're claiming an import tax? [47:33.360 --> 47:38.240] An import tax and an ownership tax of some sort. [47:38.240 --> 47:40.280] So this is just a tax issue. [48:58.080 --> 49:04.840] I look at the applicable law and then I look to see if the public officials followed the [49:04.840 --> 49:07.080] law. [49:07.080 --> 49:10.160] When I help somebody, I don't care if they're guilty, innocent. [49:10.160 --> 49:12.600] I don't care. [49:12.600 --> 49:15.160] That's not what I do. [49:15.160 --> 49:26.360] I make sure my public officials follow the law to the letter and when they don't, I have [49:26.360 --> 49:32.320] tools you can beat them up with big time. [49:32.320 --> 49:38.600] If you haven't listened to the show before, it sometimes takes a couple of times through [49:38.600 --> 49:42.040] it before you begin to understand it. [49:42.040 --> 49:47.960] At the beginning of the show, I told about sending a criminal complaint against the federal [49:47.960 --> 49:56.840] judge to the special agent in charge in Dallas, Texas, the special agent in charge of the [49:56.840 --> 50:00.320] FBI in Dallas. [50:00.320 --> 50:06.920] And what I wanted, they had somebody call me from their intake section and said, Mr. [50:06.920 --> 50:11.400] Kelton, what do you want us to do with this? [50:11.400 --> 50:20.360] I said, I want you to do exactly what the law commands you to do. [50:20.360 --> 50:27.760] But I suspect that you don't know what that is and I'm not going to tell you. [50:27.760 --> 50:33.040] This is a test and that's exactly what it was. [50:33.040 --> 50:39.000] I have never, this 28 USC 535, one of my listeners brought that to my attention a few months [50:39.000 --> 50:43.840] ago and it was like a Christmas present. [50:43.840 --> 50:49.040] Now I will check with the attorney general to see if this guy actually gave notice to [50:49.040 --> 50:57.600] the attorney general and when he didn't, then he violated a law relating to his office and [50:57.600 --> 51:02.800] in the process denied me the full and free access to and joined it in my right to petition [51:02.800 --> 51:08.800] court for redress agreements and I will file criminal charges against him under 18 U.S. [51:08.800 --> 51:15.600] Code 242, which is a class A misdemeanor in the federal government. [51:15.600 --> 51:19.440] Up to a year in jail, $10,000 fine. [51:19.440 --> 51:24.040] You want to play hardball, Bubba, we'll see how this works for you. [51:24.040 --> 51:34.000] And I will file it with the U.S. attorney and the U.S. attorney will exercise his prosecutorial [51:34.000 --> 51:36.840] discretion and refuse to prosecute. [51:36.840 --> 51:41.280] Well, at least I hope he does. [51:41.280 --> 51:48.360] See another rule I have, never ask a public official to do anything you actually want [51:48.360 --> 51:55.800] them to do because you never ask a public official to do anything that the law does [51:55.800 --> 52:01.680] not command them to do and when they don't do it, you get to land on them like a ton [52:01.680 --> 52:03.720] of bricks. [52:03.720 --> 52:12.840] So we'll look through your case and I will find numerous places where the agents and [52:12.840 --> 52:21.160] the U.S. attorney did not follow law and then we'll pick something seemingly minor. [52:21.160 --> 52:28.800] File a criminal complaint against an agent with the SAC, with the special agent in charge. [52:28.800 --> 52:32.680] And then we check with the attorney general to see if he gave notice to the attorney general. [52:32.680 --> 52:37.480] When he didn't, then we file against the agent with the U.S. attorney and when the U.S. attorney [52:37.480 --> 52:46.400] doesn't give notice to the attorney general, then we file against the U.S. attorney, except [52:46.400 --> 52:51.560] we don't send that one to the U.S. attorney, we send that one to the grand jury. [52:51.560 --> 52:55.240] And if you send something to the federal grand jury, the U.S. attorney is going to intercept [52:55.240 --> 52:56.240] it. [01:10:30.960 --> 01:10:40.960] You have to claim, you have to show evidence to support each element of the cause of action [01:10:40.960 --> 01:10:45.960] or the judge will rule against you and he won't necessarily tell you why. [01:10:51.960 --> 01:11:00.960] First, the plaintiff must have provided the defendant with something of value while expecting compensation in return. [01:11:00.960 --> 01:11:10.960] Second, the defendant must have acknowledged, accepted and benefited from whatever plaintiff provided. [01:11:10.960 --> 01:11:24.960] Third, the plaintiff must show that it would be inequitable or unconscionable for the defendant to enjoy the benefit of plaintiff's actions without paying for it. [01:11:24.960 --> 01:11:26.960] Those are the causes of action. [01:11:26.960 --> 01:11:31.960] I mean, the elements for a cause of action of unjust enrichment. [01:35:56.960 --> 01:36:01.960] You know, you can get no answer default, but 70% of them are thrown out, [01:36:01.960 --> 01:36:10.960] because the courts do not like someone being ruled against without them having an opportunity to defend themselves. [01:36:10.960 --> 01:36:18.960] Okay, so you're telling me the notice to vacate judgment, book of notice, just in that? [01:36:18.960 --> 01:36:21.960] Yeah, that's about all it takes. [01:36:21.960 --> 01:36:26.960] And then state that you received no notice of this hearing. [01:36:26.960 --> 01:36:32.960] You were involved in an identity theft issue, [01:36:32.960 --> 01:36:40.960] and that could have caused you somehow to have these notices misdirected, but asked for a new trial. [01:36:40.960 --> 01:36:43.960] No, no, this is, I don't know if I'm being clear. [01:36:43.960 --> 01:36:48.960] This is from a conviction back in 2000, where I went to court, [01:36:48.960 --> 01:36:56.960] and I was tried and convicted, driving a license, not having a registration card. [01:36:56.960 --> 01:36:58.960] But I was really cited for suspended license, [01:36:58.960 --> 01:37:04.960] and I didn't realize that all this stuff was from a two-fed to a peer cases prior to that, [01:37:04.960 --> 01:37:08.960] where the misguided identity stuff was. [01:48:20.960 --> 01:48:24.960] But that's not what your issue is. [01:48:24.960 --> 01:48:37.960] They've charged you with a felony for filing a quit claim after foreclosure. [01:48:37.960 --> 01:48:40.960] And you're saying there was a rescission of the foreclosure. [01:48:40.960 --> 01:48:44.960] That seems like an affirmative defense. [01:49:18.960 --> 01:49:26.960] I had removed the case to federal court and this judge continued to make orders. [01:49:26.960 --> 01:49:28.960] And so I sued the judge. [01:49:28.960 --> 01:49:29.960] Hold on, hold on. [01:49:29.960 --> 01:49:31.960] You're using pronouns here. [01:49:31.960 --> 01:49:35.960] This judge, you mean a state judge? [01:49:35.960 --> 01:49:37.960] Yes, the state court judge. [01:49:37.960 --> 01:49:39.960] I sued him in federal court. [01:49:39.960 --> 01:49:42.960] Oh, good. [01:49:42.960 --> 01:49:48.960] I then went to the FBI and told them, you really need to start watching this guy. [01:49:48.960 --> 01:49:50.960] I'm suing him in federal court. [01:49:50.960 --> 01:49:52.960] He's going to pull something. [01:49:52.960 --> 01:49:58.960] And sure enough, two months later is when I was arrested. [01:49:58.960 --> 01:50:01.960] I, at the arrest, asked for the warrant. [01:50:01.960 --> 01:50:05.960] I asked three of the officers at the arrest for the warrant. [01:50:05.960 --> 01:50:08.960] They all blew me off. [01:50:08.960 --> 01:50:13.960] And there's other details of the things that they did to me, including five hours in a chair [01:50:13.960 --> 01:50:16.960] under an air conditioning vent. [01:50:16.960 --> 01:50:20.960] They tried to inject me with something. [01:50:20.960 --> 01:50:23.960] I mean, it's unbelievable. [01:50:23.960 --> 01:50:28.960] Have you countersued or have you filed suit against them? [01:50:28.960 --> 01:50:29.960] I did. [01:50:29.960 --> 01:50:32.960] Have you filed criminal charges against them? [01:50:32.960 --> 01:50:33.960] No. [01:50:33.960 --> 01:50:37.960] And based on your call tonight, I'm going to be looking at that. [01:50:37.960 --> 01:50:38.960] Okay. [01:50:38.960 --> 01:50:41.960] This is the part I do. [01:50:41.960 --> 01:50:48.960] When I talk to somebody, I don't really want to get to the merits of your case. [01:50:59.960 --> 01:51:02.960] Now, this is my law. [01:51:02.960 --> 01:51:05.960] Now, it's yours, too, but it's mine. [01:51:05.960 --> 01:51:13.960] And these public officials are my servants, and I expect them to follow my law to the letter. [01:51:13.960 --> 01:51:22.960] Now, I may not have to follow the law to the letter, but then again, I'm not receiving a check [01:51:22.960 --> 01:51:27.960] based on my sworn oath that I would follow the law to the letter. [01:51:27.960 --> 01:51:31.960] My public officials are. [01:51:31.960 --> 01:51:37.960] And in California, you have a very good grand jury system. [01:51:37.960 --> 01:51:46.960] So what I'm going to suggest you look at is filing felony retaliation and conspiracy against the judge [01:51:46.960 --> 01:51:51.960] and the prosecuting attorney. [01:51:51.960 --> 01:51:57.960] Accused them of retaliating against you because you sued the judge in the federal court. [01:51:57.960 --> 01:52:03.960] And file that with a grand jury and see what they think about it. [01:52:03.960 --> 01:52:06.960] Now, here's what's going to happen. [01:52:06.960 --> 01:52:15.960] When you try to get to a grand jury, the prosecuting attorney is going to do everything he can to block you. [01:52:15.960 --> 01:52:23.960] So get out the California Code concerning grand jury and see what it says. [01:52:23.960 --> 01:52:28.960] The duties of the grand jury very carefully. [01:52:28.960 --> 01:52:30.960] Here's what it says in Texas. [01:52:30.960 --> 01:52:33.960] And I think I know what it says in California. [01:52:33.960 --> 01:52:40.960] In Texas, it says the grand jury shall investigate into all crimes to indictment that come to their knowledge [01:52:40.960 --> 01:52:48.960] by way of any member of the grand jury, the prosecuting attorney, or any other credible person. [01:52:48.960 --> 01:52:57.960] In California, if I remember right, it says the grand jury shall investigate into all crimes subject to indictment [01:52:57.960 --> 01:53:02.960] that come to their knowledge by whatever means. [01:53:02.960 --> 01:53:14.960] What that means is you as the master of the service, [01:53:14.960 --> 01:53:20.960] you don't essentially have defined rights. [01:53:20.960 --> 01:53:23.960] That's a misconception a lot of people have. [01:53:23.960 --> 01:53:28.960] They point to their Constitution as defining certain rights for them. [01:53:28.960 --> 01:53:29.960] No, no, no, no, no. [01:53:29.960 --> 01:53:33.960] That is not what the Constitution does. [01:53:33.960 --> 01:53:43.960] What the Constitution says is there are certain rights that we specifically forbid you to interfere with. [01:53:43.960 --> 01:53:47.960] The Constitution doesn't grant you those rights. [01:53:47.960 --> 01:53:54.960] They forbid anybody to interfere with the rights you already have. [01:53:54.960 --> 01:54:05.960] You as a member of the public and a citizen, you along with all the other members of the public and citizens [01:54:05.960 --> 01:54:16.960] have gotten together and through your legislature have placed certain restrictions upon your behavior. [01:54:16.960 --> 01:54:24.960] You've made it a crime to kill people, to steal from people, to a whole bunch of things that we have made it crimes to do. [01:54:24.960 --> 01:54:28.960] We have limited our behavior. [01:54:28.960 --> 01:54:40.960] For any behavior that is not specifically limited by some statute rule or regulation, [01:54:40.960 --> 01:54:46.960] we can do anything we want to. [01:54:46.960 --> 01:54:57.960] Everything is all right except for those behaviors that have been specifically forbidden. [01:54:57.960 --> 01:55:10.960] Public officials on the other hand, they don't have any rights other than those that are specifically enumerated in the law. [01:55:10.960 --> 01:55:25.960] A public official may only do what they are specifically authorized to do and they must do what they are required to do. [01:55:25.960 --> 01:55:28.960] Does that make sense? [01:55:28.960 --> 01:55:29.960] Yes. [01:55:29.960 --> 01:55:37.960] It is critically important you understand that point, especially when you start going to the grand jury. [01:55:37.960 --> 01:55:44.960] I've sent a set of complaints to the grand jury in Fort Lauderdale, Florida, federal grand jury. [01:55:44.960 --> 01:55:52.960] The U.S. Attorney called me and told me that if I did that again, he would charge me with witness tampering. [01:55:52.960 --> 01:55:56.960] I told him, knock yourself out. [01:55:56.960 --> 01:56:01.960] You charge me with witness tampering, I'll charge you with retaliation and obstruction. [01:56:01.960 --> 01:56:04.960] We'll see how this works out for you. [01:56:04.960 --> 01:56:09.960] Well, the next day they fired the IRS agent we were going after. [01:56:09.960 --> 01:56:13.960] He's threatening to do something he has no power to do. [01:56:13.960 --> 01:56:23.960] If he did that today, I would be down at the federal court the next day with a criminal complaint against him giving it to some judge. [01:56:23.960 --> 01:56:36.960] And when the judge refused to take it, wonderful, just like Judge McBride, I'll file against him with the FBI and just make their lives miserable. [01:56:36.960 --> 01:56:43.960] From what you've told me, this seems like a clear case of retaliation. [01:56:43.960 --> 01:56:47.960] I like to do what you have done. [01:56:47.960 --> 01:56:51.960] You've already got to the federal court. [01:56:51.960 --> 01:57:09.960] Based suing this judge, now you need to go back to the federal court and charge the prosecuting attorney in the federal court with retaliating against you.
