[07:17.720 --> 07:21.720] The problem is is nobody seems to care about the judges that are elected. [07:21.720 --> 07:24.720] They just vote for whoever. [07:24.720 --> 07:35.720] But when you go around the city of Austin and you see an election sign up for a judge, you better look at that sign really, really hard. [07:35.720 --> 07:50.720] And if you see the word progressive on that sign, you better not only vote no but hell no on that person getting a public office. [07:50.720 --> 08:00.720] Because their idea of progressive is to rewrite the law to suit how they believe it ought to work [08:00.720 --> 08:12.720] and they want it to work instead of how it was written to work and how it constitutionally is limited in how it works. [09:09.720 --> 09:31.720] It is utterly criminal how these people have stolen an entire department of the people's government and used that department to subvert our ability to serve in the other departments equally [09:31.720 --> 09:37.720] and to prevent them from taking over the system the way they have. [09:37.720 --> 09:46.720] See, again, this is my problem with the patronut mentality on this and the people saying you can't win, you can't win, you can't win. [09:46.720 --> 09:52.720] The reason you can't win is not because of a magic piece of paper, people. [09:52.720 --> 09:55.720] It is not because your name is in uppercase or lowercase. [09:55.720 --> 09:59.720] It's not because of where you live. [09:59.720 --> 10:02.720] It's not because of the 14th Amendment. [11:34.720 --> 11:37.720] We didn't give those people that power. [11:37.720 --> 11:40.720] They stole it. [11:40.720 --> 11:51.720] And they used the power they were given to make that theft appear legitimate. [11:51.720 --> 12:06.720] We don't need all of these myriad methods that we are all spending so much time doing legal research on trying to figure out why did they do what they did. [12:06.720 --> 12:13.720] Because the law clearly says they can't, but they did it anyway. [12:13.720 --> 12:18.720] So let me be very clear on this. [12:18.720 --> 12:28.720] If you can prove to me that the patronet methodology works, great, but no one's done that. [12:28.720 --> 12:30.720] People ask me about it all the time. [12:30.720 --> 12:32.720] People challenge me on it all the time. [12:32.720 --> 12:42.720] Up until the very point where I say, what is your admissible evidence supporting that statement or fact? [12:42.720 --> 12:59.720] Well, go look right here, and then they send me to some third-party doofus Internet web blog where somebody else just like them threw up the same damn theory and they're using it as being authoritative when it isn't. [12:59.720 --> 13:13.720] You know there's a problem when the clowns in the circus cite each other as an authority as to what's funny. [13:13.720 --> 13:17.720] And that's what we have here. [13:17.720 --> 13:31.720] These attorneys cite other attorneys as the authority for the law to work the way it does when it is very easy to show that those other attorneys are completely wrong. [13:34.720 --> 13:51.720] If not in the exact letter of the law, almost always in the spirit of it, because the spirit of the law is supposed to be subordinate to the Constitution, which is an individual rights agreement. [13:51.720 --> 14:08.720] It is a covenant to the people that the government is here to protect those rights of the individual from intrusion by other individuals or other entities that have no lawful basis for the intrusion. [14:08.720 --> 14:11.720] Notice I did not say legal basis for the intrusion. [14:11.720 --> 14:14.720] I said lawful basis for the intrusion. [14:14.720 --> 14:22.720] And lawful simply being the same thing that the medical field has to go by, do no harm. [14:22.720 --> 14:35.720] You are free to exercise your rights and do as you please, provided when you do it you do no harm to anyone else or their rights or their property. [14:35.720 --> 14:42.720] That is as far as government was ever supposed to intrude upon the lives of the American people. [14:42.720 --> 14:46.720] That's it. [14:46.720 --> 15:00.720] But here we are, making King George look like a pal compared to what we have now. [15:00.720 --> 15:03.720] How much longer are we going to sit and do this? [15:03.720 --> 15:06.720] How much longer are we going to allow them to sit and do this? [15:06.720 --> 15:12.720] You have lost an entire department of your government. You know that, right? [15:12.720 --> 15:17.720] The people can no longer sit in any position of authority in the judicial branch. [15:17.720 --> 15:21.720] The attorneys have stolen it for themselves. [15:21.720 --> 15:33.720] And then they have used it to legitimize their crimes and to protect themselves in the commission of those crimes. [15:33.720 --> 15:42.720] And then they have spread that corruption to every other branch of government. [15:42.720 --> 15:49.720] They now hold power in every branch. [15:49.720 --> 16:07.720] But they completely monopolize two of them, entirely in the judicial and in every other way except for a few seats in the legislative. [16:07.720 --> 16:14.720] The system of law that we have is not the one this country was founded on and the one it's supposed to have. [16:14.720 --> 16:26.720] It's the one that's been created through the whims of the elitist class called attorneys and the bar associations to which they belong. [16:26.720 --> 16:30.720] Now, that part, that's not a patronite myth. That's a given fact. [16:30.720 --> 16:36.720] You can demonstrate that just by looking at how things have progressed in the centuries since this country was founded, [16:36.720 --> 16:44.720] and you will see very clearly that's exactly how it came about. [22:01.720 --> 22:12.720] We allowed that system of government to be completely corrupted and completely restructured to do exactly the opposite. [22:32.720 --> 22:40.720] Our lack of attention and understanding as to what the Founding Fathers were trying to put into place, [22:40.720 --> 22:57.720] no matter what the patronates want to say was happening, a government of the people by the people for the people requires the freaking people to be involved in it or it will fail. [35:51.720 --> 35:58.720] What do you mean there's no address? You were given a citation that doesn't tell you a specific location to where you're supposed to appear? [35:58.720 --> 36:05.720] No, the courtesy letter is a peel box and you either guilty. [36:05.720 --> 36:08.720] Yeah, but what about the citation itself? [36:08.720 --> 36:13.720] Oh, let me. [39:59.720 --> 40:03.720] Something to quash the complaint, whatever, challenge its form and substance. [40:03.720 --> 40:06.720] You just got to play it by ear to see what there is. [40:06.720 --> 40:13.720] But when you get there, what is the very first thing you want to do after you have these documents filed [40:13.720 --> 40:19.720] or even while you're getting them filed? [41:32.720 --> 41:34.720] And then when I conveniently told the guy, [41:34.720 --> 41:40.720] God, no, I intend to challenge this seeing how I'm not engaged in commerce, he told me... [41:40.720 --> 41:44.720] He goes, look, just pay the effing ticket. [41:44.720 --> 41:46.720] He said that? [41:46.720 --> 41:47.720] Yeah. [41:47.720 --> 41:50.720] This was the cop who issued it said that? [41:50.720 --> 41:54.720] No, it was the other officer that was there. [41:54.720 --> 41:55.720] Oh, you got to make... [41:55.720 --> 42:00.720] You got to get that officer subpoenaed to appear as a witness. [42:00.720 --> 42:03.720] Was he wearing his gun when he said that? [42:03.720 --> 42:04.720] Yes. [42:04.720 --> 42:09.720] Was he acting in his official capacity when he said that? [42:09.720 --> 42:10.720] I would say so. [42:10.720 --> 42:12.720] Was he in uniform? [42:32.720 --> 42:38.720] The officer just used the authority of his office to threaten you to pay the ticket, not challenge it. [42:38.720 --> 42:41.720] That's exactly what he just did. [42:41.720 --> 42:47.720] When you notified him that you intend to fight it while he was wearing his gun in his uniform [42:47.720 --> 42:53.720] and acting in his official capacity, he told you just pay the effing ticket. [42:53.720 --> 42:55.720] That's a direct threat. [42:55.720 --> 42:57.720] Now, and check this out, Eddie. [42:57.720 --> 42:59.720] I said, excuse me, sir. [42:59.720 --> 43:02.720] I go, what word did you just say? [43:02.720 --> 43:05.720] He got up and I asked him, I go, can I have your name as well? [43:05.720 --> 43:07.720] He said, no, you can't have my name. [43:07.720 --> 43:12.720] He walked away, said the exact same quote again, and then stopped at the end of the hall, turned around [43:12.720 --> 43:15.720] and just stayed staring at me. [43:15.720 --> 43:18.720] Did you ask the clerk his name? [43:18.720 --> 43:19.720] No, I apologize. [43:19.720 --> 43:24.720] I go, sir, I am sorry if I have aggravated you in any way. First of all, on the ticket that I got some time back or driving there, so you told me to look up the seven interrogators and I did that for what you sent, for what you posted. So I filed a few things in court. I filed a declaration, which explains in detail what you told me to file. [48:26.720 --> 48:45.720] Then I filed the order of dismissal, which was a ticket number to be dismissed. And then I filed a motion for order dismissal. And I stated as the court to dismiss facts of the case. [48:45.720 --> 49:10.720] And the funny thing was on that paper that was sent, and I don't know why I even did that, but it was something where you was questioning why a, I'm looking at it, it says, interrogator asked an officer and the, let me make sure I get this right, and the officer and the plaintiff attorney alleged prosecutor, those special questions relating to the facts of the case. [49:10.720 --> 49:31.720] And then at the bottom it says somehow can that possibly be an actual prosecutor rather than a plaintiff attorney. So I did put that in. I don't know if you wanted to put that in, but I did. But the bottom thing was when I, when I wrote the seven, you know, arbitrary statements down, there was one more statement. [49:31.720 --> 49:53.720] And I don't know if I was supposed to put that in there, which is what I intended to email you, but I lost my old phone. So there was a point after the seven interrogatory statements you did, it says the statements, the point of interrogatory is to show that the warrant, detainment, and arrest. Was I to put that on that? [49:53.720 --> 50:06.720] No, that's an explanation as to why you're asking these specific interrogatories. And that's what you use as your argument if they try to challenge you. Why would you be asking these questions? [50:06.720 --> 50:26.720] Because those answers tell me whether or not you people are intentionally violating my constitutionally protected rights, whether or not you're violating the laws of the state, whether or not you're violating due process, the response to those interrogatories prove or disprove whether you're doing that. [50:26.720 --> 50:35.720] So that was commentary for you, not for them. You simply have to know how to respond to them if they challenge you on it. [50:35.720 --> 50:51.720] And that's why I'm calling. So my question is, because this is the first time I've done this since you told me to do this, where do I need to go reading at if they do ask or challenge me? Where do I need to go so I'm not looking at an idiot and be dumbed out on it? [50:51.720 --> 50:54.720] What do you mean? Where do you have to go? [50:54.720 --> 51:07.720] I mean, where can I look this up? I mean, there were those specific statements that you made and asked them that, but you said in case they decide to challenge me on it. So I need to know more facts than what you just wrote because you knew this when you typed this up. [51:07.720 --> 51:10.720] And so all I did was followed it. [51:10.720 --> 51:14.720] Okay, let's go over this real quick, Charles. Now pay attention here. [51:14.720 --> 51:28.720] Is the allegation being made considered to be a civil infraction under Washington law? All you got to do is look at the Washington statutes in the court of appeals to see whether or not civil infractions are civil or criminal. [51:28.720 --> 51:30.720] Okay. [51:30.720 --> 51:39.720] And whether or not the particular allegation against you falls under civil infractions versus criminal allegations. [51:39.720 --> 51:41.720] Okay. [51:41.720 --> 51:55.720] That's what the first interrogatory is all about. Clarifying, is the allegation, the charge you're making against me, is that charge in the state of Washington considered to be a civil infraction? [51:55.720 --> 52:00.720] So you look at the law and the case law to find out whether it is or it isn't. [52:00.720 --> 52:11.720] Number two, can a warrantless arrest or detention be lawfully perpetrated in relation to a civil matter under Washington law? [52:11.720 --> 52:24.720] Well, how can they arrest you without a warrant for something civil? How can they arrest you with a warrant for something civil? [52:24.720 --> 52:30.720] The answer is, no state in the union allows that. [52:30.720 --> 52:32.720] Okay, state in the union, okay. [52:32.720 --> 52:40.720] Three, may a warrant of arrest be obtained without a valid statement of probable cause under Washington law? [52:40.720 --> 52:50.720] No. No state can issue a warrant of arrest without a statement of probable cause attached to the warrant. [52:50.720 --> 52:54.720] Can't do it. No state can do it. [52:54.720 --> 53:01.720] Four, because the constitutionals, both state and federal, all say the same thing. [53:01.720 --> 53:07.720] No warrant shall issue except upon probable cause, right? [53:07.720 --> 53:08.720] Yes. [53:08.720 --> 53:12.720] Okay. So you look at the constitution. That's exactly what it says. [53:12.720 --> 53:18.720] Look at the code of criminal procedure or the penal code or whatever it is in your state. That can be exactly what it says. [53:18.720 --> 53:33.720] Four, under Washington law, is a statement of probable cause sufficient to obtain a warrant of arrest if that statement of probable cause does not allege an actual crime? [53:33.720 --> 53:39.720] If this is a civil infraction, then it would not allege an actual crime, would it? [53:39.720 --> 53:40.720] Correct. [53:40.720 --> 53:46.720] And if it doesn't allege an actual crime, then it's not a valid statement of probable cause, is it? [53:46.720 --> 53:48.720] No, it wouldn't be. [53:48.720 --> 53:56.720] If it's not a valid statement of probable cause, it cannot be the basis for the issuance of a warrant for arrest, can it? [54:00.720 --> 54:20.720] Under the Washington law, did officer so-and-so witness any actual crime that would have provided him or her with the required reasonable suspicion or articulable probable cause authorizing a warrantless detention or arrest of an individual? [54:20.720 --> 54:33.720] If they witnessed a civil infraction, they didn't witness a crime. Without a crime, they cannot get reasonable suspicion or probable cause. [54:33.720 --> 54:34.720] Get it? Under Washington law, did officer so-and-so witness any actual crime that would have provided him or her with the required probable cause necessary to state sufficient grounds of criminal activity in order for a duly authorized magistrate to issue a warrant of arrest for an individual? [55:49.720 --> 55:54.720] One, someone lied in the statement of probable cause that a crime was committed when in fact it was not. [55:54.720 --> 56:11.720] Two, a magistrate failed to act in due diligence to determine by the facts whether or not a crime had actually occurred according to what was in the statement of probable cause and issued an invalid warrant for a civil infraction. [56:11.720 --> 56:21.720] Therefore, both of them have conspired and colluded to commit a crime under the authority and color of their office. [56:21.720 --> 56:23.720] Okay. [56:23.720 --> 56:24.720] Color of office. [56:24.720 --> 56:28.720] So that's the point of the seven interrogatories. [56:28.720 --> 56:30.720] Mm-hmm. [56:30.720 --> 56:39.720] And so that's how, if they was asked any questions, they would have to address that based upon if it was an actual crime or committed or alleged. [56:39.720 --> 56:42.720] Their answers to the question will show one of two things. [56:42.720 --> 56:47.720] They either acted corruptly or they're completely incompetent. [57:19.720 --> 57:23.720] So then he threatened to take me to jail if I didn't wish to comply. [57:23.720 --> 57:27.720] So like I told him again, I said I do not use a license. [57:27.720 --> 57:28.720] I said I'm traveling. [57:28.720 --> 57:31.720] And I said I gave you my name, number, and address. [57:31.720 --> 57:35.720] So then he proceeded to start asking me questions in order to threaten to take me to jail. [57:35.720 --> 57:37.720] And he said, well, have you ever had a license? [57:37.720 --> 57:39.720] I said at one point in time I had a license. [57:39.720 --> 57:45.720] So from that he took my keys, went to the back, ran my plate, came back, and wrote me the ticket. [57:45.720 --> 57:53.720] So there's nothing I could probably do about that because I did roll the windows out part ways and I thought I had to do a lot, but it wasn't. [57:53.720 --> 58:01.720] So that part I'm going to quote on that, so I was just curious on how to address that once I go before the judge. [58:01.720 --> 58:04.720] And so you gave me what I needed, so I'll be concerned with that. [58:04.720 --> 58:11.720] The other thing these interrogatories do for you is to prove that the officer's initial stop was an illegal search and seizure. They just walk up if you're in a parking lot, whatever, and start asking questions. [01:05:52.720 --> 01:05:59.720] Yeah, but what is your obligation to answer those questions when you're doing nothing wrong and they have no evidence of a crime? [01:05:59.720 --> 01:06:07.720] Exactly. That's what he did. And I realized that I know that the officer can't address you and ask you on the street to answer any questions. [01:06:07.720 --> 01:06:17.720] So by him not knowing this stuff, he took off and ran because he had a warrant. So he left. The lady he was there with in the car. And the car, unfortunately, had some guns in it. [01:06:17.720 --> 01:06:27.720] Now he's in jail. So he's going to court tomorrow. And I was curious if this seven derogatory that you're giving me, did that in any way apply to him? [01:06:27.720 --> 01:06:46.720] No, because they didn't stop him for anything. I'm still wondering why he chose to run. But the thing about it is, if they didn't have a particular criminal act for which they were attempting to contact him or knew him by sight as to who he was with a warrant, [01:06:46.720 --> 01:07:02.720] there's already Supreme Court case law in place that says that won't fly. Even if he ran, that was no incentive for the cops to give chase and arrest because they hadn't done anything wrong. He didn't know, as I said, and I knew he didn't. So now he's in jail because the young lady said that he had a warrant, told him his name, so he ended up going to jail. [01:07:21.720 --> 01:07:27.720] Now he's supposed to go to court tomorrow. And I'm trying to see if he could beat this by using this same thing that came from me. [01:36:56.720 --> 01:36:59.720] Well, the thing is is Ron Paul has never been known for choosing [01:36:59.720 --> 01:37:03.720] the lesser of two evils, period. [01:37:03.720 --> 01:37:06.720] He believes in doing it right and doing it right the first time. [01:37:06.720 --> 01:37:10.720] He's not going to support a candidate just because they're of lesser evil, [01:37:10.720 --> 01:37:15.720] even 90% lesser evil than the other evil. [01:37:15.720 --> 01:37:18.720] Evil is evil in his eyes, and I can't argue with that. [01:37:18.720 --> 01:37:23.720] If you're going to do it wrong, you're going to do it wrong. [01:37:23.720 --> 01:37:29.720] And a lot of the things they promise to do, no president has the power to do. [01:37:29.720 --> 01:37:32.720] He can try to get others to cooperate, but he can't make them cooperate. [01:37:32.720 --> 01:37:36.720] He can't keep those promises as easily as he can make them. [01:37:36.720 --> 01:37:39.720] And I've got a problem with people that make promises like that. [01:37:39.720 --> 01:37:45.720] Like I said in the upcoming movie with the one-on-one that Dave and I had, [01:37:45.720 --> 01:37:47.720] if they leave it in the film, I don't know if they will, [01:37:47.720 --> 01:37:52.720] but they should since it wasn't specifically related to the election. [01:37:52.720 --> 01:37:54.720] But one of the things I said in the movie was this, [01:37:54.720 --> 01:38:01.720] if I was to be a candidate for president, the only promise that I could make [01:38:01.720 --> 01:38:06.720] and know for sure I could keep with the American people in relation to any law [01:38:06.720 --> 01:38:12.720] is this, I will veto any law that comes to my desk [01:38:12.720 --> 01:38:18.720] that I feel violates any provision of the Constitution [01:38:18.720 --> 01:38:27.720] and that does not cite specific constitutional authority for Congress to enact it. [01:38:27.720 --> 01:38:35.720] That's the only promise any president can legitimately make in relation to a law. [01:38:35.720 --> 01:38:41.720] And I have never seen one make it. [01:38:41.720 --> 01:38:47.720] I'm sure Ron Paul would have done it, but he didn't stand up there and talk about it. [01:38:47.720 --> 01:38:50.720] He wasn't going to give a warning about what he was going to do if he had to do it. [01:38:50.720 --> 01:38:56.720] But that's exactly the only real promise any presidential candidate can make and live up to, [01:38:56.720 --> 01:39:00.720] is to veto a law that he believes to be unconstitutional in any way [01:39:00.720 --> 01:39:07.720] or that he will refuse to sign it if Congress does not provide the constitutional authority [01:39:07.720 --> 01:39:11.720] they are using as the basis for making it. [01:39:11.720 --> 01:39:14.720] Since they only have 18 enumerated powers, [01:39:14.720 --> 01:39:18.720] every bill they create has to fall within that 18 enumerated powers. [01:39:18.720 --> 01:39:22.720] If you can't tell me which one gave you the authority to make this bill, [01:39:22.720 --> 01:39:32.720] I'm not signing it into law. I don't care what's in it. [01:47:11.720 --> 01:47:18.720] When I asked the officer how many elements in our valid cause of action, the judge interrupted and said he didn't have to answer. [01:47:18.720 --> 01:47:21.720] And he objected for the officers. [01:47:21.720 --> 01:47:26.720] I mean, he kept objecting every time I went to try and ask a valid question. [01:47:26.720 --> 01:47:31.720] So he denied me an effective defense. [01:47:31.720 --> 01:47:38.720] And he chose not to see that the brake light work when there was no sun on the brake light cover [01:47:38.720 --> 01:47:45.720] and chose to see that it didn't work when there was a sunlight on the brake cover. [01:47:45.720 --> 01:47:48.720] Okay. [01:47:48.720 --> 01:47:52.720] And now he found me guilty and all that stuff. [01:47:52.720 --> 01:47:55.720] And I don't know enough about writing briefs. That's when you have to make that objection, that's when you have to move to disqualify. [01:48:16.720 --> 01:48:18.720] Okay. [01:48:18.720 --> 01:48:26.720] Well, I had written paperwork already stating that if he interjected or interrupted me and acted as a part of the case, I would have to recuse him. [01:48:30.720 --> 01:48:36.720] What does that have to do with anything when you didn't, and it's not recusal, it's disqualification. [01:48:36.720 --> 01:48:41.720] There are two ways to get a judge off the bench short of shooting him, okay? [01:48:41.720 --> 01:48:47.720] Recusal is when you ask them to leave voluntarily and he doesn't have to. [01:48:47.720 --> 01:48:53.720] He can decide whether or not he wants to leave on a recusal request. [01:48:53.720 --> 01:49:02.720] On a disqualification request or demand, he doesn't normally have the option of choosing. [01:49:02.720 --> 01:49:09.720] Someone else is required to determine whether or not he is properly disqualified. [01:49:09.720 --> 01:49:22.720] Never, ever ask a judge to recuse, and yes, you can demonstrate a conflict of interest that nobody else would question in order to get him off of that bench. [01:49:22.720 --> 01:49:31.720] Anything else, you disqualify them, not recuse them. [01:49:31.720 --> 01:49:32.720] Okay? [01:49:32.720 --> 01:49:42.720] When a judge fails to abide by the requirement to provide a fair and impartial trial, to not be prejudicial to one side over the other, [01:49:42.720 --> 01:49:50.720] that's a violation that is a disqualifying violation, not a recusal violation. [01:49:50.720 --> 01:49:55.720] Well, I did express that he was being biased on the record. [01:49:55.720 --> 01:49:56.720] Again. [01:49:56.720 --> 01:49:58.720] Every time I tried to object.
