[01:17.880 --> 01:26.080] Today in history, in recent years, NATO's biggest military proliferation on Russia's [01:26.080 --> 01:30.640] border since the Cold War is underway, with Great Britain announcing Wednesday today that [01:30.640 --> 01:34.740] it is planning on sending fighter jets to Romania next year, and the United States has [01:34.740 --> 01:39.360] vowed troops, tanks, and artillery to Poland, along with Germany, Canada, and other NATO [01:39.360 --> 01:43.920] allies also pledging forces at a defense ministers meeting in Brussels. [01:43.920 --> 01:48.240] Meanwhile, two Russian warships entered the Baltic Sea between Sweden and Denmark and [01:48.240 --> 01:50.440] are said to be armed with cruise missiles. [01:50.440 --> 01:54.440] The ships were part of an eight-ship carrier battle group, including Russia's one and [01:54.440 --> 01:59.080] only aircraft carrier, the Admiral Kuznetsov, which is expected to join around 10 other [01:59.080 --> 02:02.060] Russian vessels already off the Syrian coast. Okay, I just tiraded on Tom Kiley's show, so I'm in the perfect mood [04:32.640 --> 04:37.640] I'm gonna tirade again for our listeners who may be tuning in online [04:37.640 --> 04:41.640] That are just now picking up the airwaves here [04:41.640 --> 04:48.640] This is a breaking story that just broke on Infowars yesterday [04:48.640 --> 04:54.640] Concerning our Director of Elections here in Texas [04:54.640 --> 04:59.640] One of the highest level positions in the executive branch [04:59.640 --> 05:05.640] Not supposed to be a political animal, is an appointee in the Secretary of State's office [05:05.640 --> 05:11.640] The Director of our Texas elections, his name is Keith Ingram, an attorney [05:11.640 --> 05:18.640] So this guy has been pulling shenanigans with our elections here in Texas [05:18.640 --> 05:21.640] Ever since he got into office eight years ago [05:21.640 --> 05:25.640] Ever since he was appointed eight years ago, he's been around for a while [05:25.640 --> 05:35.640] He has, as of late, been doing everything he can to cut off all paper backup audit trails [05:35.640 --> 05:42.640] And audit trails of any type so that we could check on these voting machines or have recounts or anything [05:42.640 --> 05:50.640] By law, according to the election code, they're supposed to have paper ballot printouts of the ballot images [05:50.640 --> 05:57.640] For at least 1% of the vote, just so that they can do a statistical analysis to check on the machines [05:57.640 --> 06:01.640] They don't want to do that either, not even 1% [06:01.640 --> 06:07.640] For the folks out there that don't know the shenanigans that he pulled this last August [06:07.640 --> 06:11.640] I'll tell you what happened, we call it burning the paper trail [06:11.640 --> 06:21.640] In this past August, very much under the radar, very much subversive, quietly [06:21.640 --> 06:27.640] He attempted to make last minute rule changes before this November election [06:27.640 --> 06:36.640] That would eliminate printing of all paper audit logs that poll watchers are entitled to monitor at the main tabulation computers [06:36.640 --> 06:44.640] In Texas, the public is allowed into the main tabulation room to watch everything that happens [06:44.640 --> 06:51.640] And they're supposed to print out paper audit trail logs of everything at the main tabulation computers [06:51.640 --> 06:53.640] And everywhere for that matter [06:53.640 --> 06:58.640] He wants to say, no more printing of paper audit logs at the main tabulation computers [06:58.640 --> 07:03.640] He wants to kick all the poll watchers out of everywhere, especially at the main tabulation machines [07:03.640 --> 07:07.640] He wants to eliminate printing of the early voting results [07:07.640 --> 07:12.640] Which, by the way, is where they do a lot of the election stealing, is during early voting [07:12.640 --> 07:16.640] So we tell people, do not vote early, vote on election day [07:16.640 --> 07:20.640] He wants to eliminate printing of the ballot images [07:20.640 --> 07:27.640] All kinds of stuff, this last minute rule change, he passed very much under the radar [07:27.640 --> 07:33.640] So low key was this maneuver that not even the secretary of state knew about it [07:33.640 --> 07:35.640] Or at least the secretary of state said he didn't know about it [07:35.640 --> 07:41.640] Members of the legislature, the chair of the elections committee in the House didn't know about it [07:41.640 --> 07:43.640] Nobody knew about it [07:43.640 --> 07:50.640] Somehow some constituents found out about it and they made a big deal about it [07:50.640 --> 07:58.640] And some senators and House members basically told Greg Abbott, you better rein your boy in [07:58.640 --> 08:02.640] Talking about Ingram, who works in the secretary of state's office [08:02.640 --> 08:05.640] I'm just summarizing here [08:05.640 --> 08:09.640] There's a state senator, Don Huffins, released a statement that said [08:09.640 --> 08:16.640] The state's chief election officers must reconsider and redraft their proposed election rules [08:16.640 --> 08:21.640] To pursue more real-time paper records and backups, not fewer [08:21.640 --> 08:26.640] The comfort and convenience of election administrators should not take priority [08:26.640 --> 08:30.640] Over voters' confidence and election integrity [08:30.640 --> 08:35.640] So we got at least somebody who gets it in the Senate here [08:35.640 --> 08:38.640] He was wanting to waive all this stuff [08:38.640 --> 08:44.640] So because of public pressure and some pressure from the legislature [08:44.640 --> 08:54.640] Keith Ingram was forced to back down and postpone these horrendous rule changes [08:54.640 --> 09:00.640] Until after the election when they could have a more formal public hearing on the matter [09:00.640 --> 09:02.640] To take public input, etc. [09:02.640 --> 09:08.640] He has been pulling these kinds of shenanigans for eight years [09:08.640 --> 09:11.640] This is nothing new with this guy [09:11.640 --> 09:19.640] He has issued waivers that would normally require the partial manual recounts [09:19.640 --> 09:25.640] He's issued waivers requiring printing of paper backups of the results [09:25.640 --> 09:35.640] He's ignored laws requiring printing of what would be classified as a legally sufficient ballot image for recounts [09:35.640 --> 09:42.640] Ignoring laws that specifically allow poll watchers to monitor all election activities [09:42.640 --> 09:50.640] Including and especially printing of paper audit logs to check on the computerized result tabulation [09:50.640 --> 09:56.640] Now listen, I don't even trust these paper printouts of these logs from these voting machines [09:56.640 --> 10:00.640] Because we don't know what really happened [10:00.640 --> 10:06.640] They can make these machines print out and say anything they want, people [10:06.640 --> 10:08.640] Not even that matters [10:08.640 --> 10:13.640] But it's something, it's all we have because here in Texas according to the election code [10:13.640 --> 10:23.640] The proprietary code, computer code for the software that runs these machines don't have to be released [10:23.640 --> 10:29.640] They don't have to be released to the general public for auditing to make sure that it's legitimate code [10:29.640 --> 10:31.640] Not full of errors or not rigged [10:31.640 --> 10:32.640] Don't have to do that [10:32.640 --> 10:40.640] So we have very little to go on here other than the printing of the zero tapes of the machines themselves [10:40.640 --> 10:45.640] The day of the election at the polling places to prove so-called quote unquote [10:45.640 --> 10:53.640] I say that with a big grain of salt like a boulder of salt prove that the results are zeroed out on each machine [10:53.640 --> 10:55.640] They don't want to do that anymore [10:55.640 --> 10:57.640] They don't want to print out audit trails [10:57.640 --> 10:59.640] They don't want to do nothing, okay [10:59.640 --> 11:06.640] They don't want to print out the results anymore at the precinct level to post them on the door of the precincts [11:06.640 --> 11:14.640] So that in theory we could run around all over town to all these precincts and take photographs of their printed results [11:14.640 --> 11:20.640] And tabulate the results ourselves to make sure that what's being reported to the county is accurate [11:20.640 --> 11:24.640] They won't post the precincts results anymore on the doors [11:24.640 --> 11:35.640] They don't want to post any precinct information at all any more period until after information has passed through the central tabulation office [11:35.640 --> 11:37.640] I mean this is ridiculous, okay [11:37.640 --> 11:40.640] This has been going on for a long time, alright [11:40.640 --> 11:42.640] We've been fighting this for years [11:42.640 --> 11:44.640] Well, so it begs the question [11:44.640 --> 11:46.640] Who is this guy, okay? [11:46.640 --> 11:48.640] Who is this guy Keith Ingram? [11:48.640 --> 11:50.640] Why is he pulling this? [11:50.640 --> 11:52.640] Who's protecting him? [11:52.640 --> 11:53.640] Who's his cover? [11:53.640 --> 11:55.640] Who is he covering for? [11:55.640 --> 12:03.640] Why is he bucking up against state senators and state house reps and just doing whatever he wants [12:03.640 --> 12:14.640] And acting all uppity on the phone to constituents that call and running away from David Knight of InfoWars refusing to talk to him [12:14.640 --> 12:18.640] Okay, acting all big for his britches and bowing up to our legislature [12:18.640 --> 12:20.640] Who is this guy anyway? [12:20.640 --> 12:25.640] Where does he think he gets off pulling this kind of crap, alright [12:25.640 --> 12:33.640] So certain people a while back decided to do a PIR on this guy, public information request [12:33.640 --> 12:41.640] Hit the governor's office, hit the secretary of state's office with a PIR to pull this personnel file and put the pieces together [12:41.640 --> 12:47.640] Well, as it turns out, this guy's a political animal and he's not supposed to be [12:47.640 --> 12:49.640] He's the director of our elections [12:49.640 --> 12:55.640] It turns out he is compromised, politically compromised with a conflict of interest [12:55.640 --> 12:59.640] Listen to this guy's work history, Randy, I want you to pay close attention, okay [12:59.640 --> 13:12.640] In 1996, from 1996 to 2006, he had a cushy, high paying, high salary gig, easy gig at a big major law firm here in Austin [13:12.640 --> 13:20.640] For 10 years, okay, private practice, easy money, big, big, big salary, okay [13:20.640 --> 13:24.640] I'm talking high tens of thousands per month, okay [13:24.640 --> 13:30.640] This guy was pushing over half a million a year, okay, was what he's raking in [13:30.640 --> 13:48.640] He leaves a major, easy, private gig that he had locked down in the bag for 10 years to go work at a law firm in Little Rock, Arkansas, okay [13:48.640 --> 13:56.640] He goes to work in 2006 for QTAC Rock LL in Little Rock, Arkansas [13:56.640 --> 13:59.640] Why would he do such a thing at a pay cut? [13:59.640 --> 14:01.640] He took like a 30% pay cut [14:01.640 --> 14:04.640] What? When does a lawyer turn down money? [14:04.640 --> 14:07.640] What's up with this? Very bizarre, right? [14:07.640 --> 14:15.640] Well, as it turns out, well, before I tell you more [14:15.640 --> 14:21.640] Within a year of working at this law firm in Little Rock, Arkansas, he moves back to Austin [14:21.640 --> 14:30.640] And sets up what I would consider a bogus independent law practice of his own like independent law firm as a fake show [14:30.640 --> 14:35.640] To make it look like he was making a different, better career move for himself [14:35.640 --> 14:38.640] And it was, what it looks like to me is it's all BS [14:38.640 --> 14:44.640] Because a few months later, he shuts down, he closed a shop of his own private law firm [14:44.640 --> 14:49.640] And is immediately whisked into the governor's office under Rick Perry in the secretary of state's office [14:49.640 --> 14:54.640] In a high level position in charge of appointments, okay [14:54.640 --> 14:58.640] Of appointments in the executive branch, administrative appointments [14:58.640 --> 15:01.640] And specifically working in the elections division [15:01.640 --> 15:07.640] And becomes almost instantly in charge of the entire elections division of Texas [15:07.640 --> 15:09.640] Now, what is this all about? [20:35.640 --> 20:39.640] Or possibly even a pre-litigation discovery, etc. [20:39.640 --> 20:44.640] But take advantage of the open records laws at the federal level, it's FOIA, okay? [20:44.640 --> 20:50.640] These people are accountable to us, they don't want to be, but we need to hold their feet to the fire [20:50.640 --> 20:57.640] And so that brings me again, Randy, to what I just started talking about before the break, how do we hold this guy to the fire? [20:57.640 --> 20:59.640] Okay, here's what we do, all right? [20:59.640 --> 21:07.640] We give Greg Abbott what's called plausible deniability, the governor, we pressure him with faxes, emails, phone calls [21:07.640 --> 21:12.640] Go up there in person if you're in Austin or if you have time to get yourself to Austin [21:12.640 --> 21:18.640] And talk to Greg Abbott's staff, the governor, go to the Secretary of State's office and chant them down [21:18.640 --> 21:25.640] Storm the Capitol, not violently, but with words, okay, and in person [21:25.640 --> 21:34.640] And say, look, this guy, there's a conflict of interest here, he's a political animal, he's compromised, get rid of him, okay? [21:34.640 --> 21:45.640] And so then what the goal is, is that we put so much pressure on Greg Abbott and his office to throw his boy under the bus [21:45.640 --> 21:53.640] That Abbott is going to have to make a choice, is he going to salvage his own political career over this? [21:53.640 --> 21:57.640] Or is he going to go down in flames to protect his boy, okay? [21:57.640 --> 22:03.640] Well, I suppose, you know, the answer to that question has yet to be revealed [22:03.640 --> 22:08.640] It may all depend on what Greg Abbott's been promised at the end of the rainbow, who knows? [22:08.640 --> 22:15.640] Maybe the Clintons have promised Abbott a position as the Attorney General of the United States [22:15.640 --> 22:21.640] If he protects Ingram's shenanigans to rip off the election here in Texas and turn Texas blue [22:21.640 --> 22:28.640] You know, so Abbott may have to decide if it's worth it, you know, maybe Abbott was not promised that [22:28.640 --> 22:31.640] I'm not saying I have any inside information on that, who knows? [01:03:48.640 --> 01:03:51.640] Well, I'm going to move on [01:03:51.640 --> 01:03:57.640] The Fifth Circuit Court of Appeals has accepted my notice for appeal [01:03:57.640 --> 01:04:01.640] And so I'm going to start writing my brief [01:04:01.640 --> 01:04:05.640] And before, when I was in district court [01:04:05.640 --> 01:04:10.640] You had me file a motion for a new trial, Rule 60 [01:04:10.640 --> 01:04:11.640] Yes [01:04:11.640 --> 01:04:15.640] You said that when that got dismissed or denied, overruled [01:04:15.640 --> 01:04:19.640] You could use that to then work off your brief [01:04:19.640 --> 01:04:22.640] Exactly, when I write a motion for reconsideration [01:04:22.640 --> 01:04:25.640] It tells the judge [01:04:25.640 --> 01:04:30.640] This is where you erred in applying the law to the facts [01:04:30.640 --> 01:04:34.640] And that's exactly what you do when you file an appeal [01:04:34.640 --> 01:04:40.640] So I try to write that to give me a jump start on my appeal [01:04:40.640 --> 01:04:42.640] So I've got kind of a strange problem [01:04:42.640 --> 01:04:46.640] Where it goes down under the table of contacts [01:04:46.640 --> 01:04:51.640] The contents, the certified persons of interest [01:04:51.640 --> 01:04:54.640] Or certificate of persons of interest [01:04:54.640 --> 01:04:59.640] It starts going down into Roman numeral one [01:04:59.640 --> 01:05:05.640] Did the court err or did the judge improperly grant [01:05:05.640 --> 01:05:07.640] And that's where I'm having a problem [01:05:07.640 --> 01:05:13.640] Because in my motion for a new trial, I claimed three things [01:05:13.640 --> 01:05:17.640] And that is that [01:05:17.640 --> 01:05:21.640] Well, the court claimed that I failed to bring a viable claim [01:05:21.640 --> 01:05:25.640] And I claimed that the court made a false statement [01:05:25.640 --> 01:05:29.640] The second one was that the court claimed that the court reporter [01:05:29.640 --> 01:05:32.640] Who I'm suing, pursued the law legally [01:05:32.640 --> 01:05:34.640] That she did everything legally [01:05:34.640 --> 01:05:38.640] And I claimed that the court made a false statement [01:05:38.640 --> 01:05:44.640] And the court stated that I did not claim for declaratory or injunctive relief [01:05:44.640 --> 01:05:49.640] And they're right about that, I never did declare declaratory [01:05:49.640 --> 01:05:52.640] But when I get down to Roman numeral one [01:05:52.640 --> 01:05:57.640] Do I want to say the court erred when it claimed [01:05:57.640 --> 01:06:01.640] That I failed to make a viable claim [01:06:01.640 --> 01:06:02.640] And then go on to number two [01:06:02.640 --> 01:06:04.640] Or do I want to just say the court erred [01:06:04.640 --> 01:06:07.640] When it dismissed my motion for a new trial [01:06:07.640 --> 01:06:10.640] Which kind of bottles it all up into one [01:06:10.640 --> 01:06:14.640] No, you don't address your motion for new trial at all [01:06:14.640 --> 01:06:16.640] Okay [01:06:16.640 --> 01:06:19.640] You only address what occurred in the trial court [01:06:19.640 --> 01:06:24.640] So you don't say he made a false statement [01:06:24.640 --> 01:06:28.640] This is the court of appeals [01:06:28.640 --> 01:06:34.640] So the primary purpose of the trial court [01:06:34.640 --> 01:06:39.640] Is to determine the facts and apply the law [01:06:39.640 --> 01:06:42.640] So when you go to the court of appeals you say [01:06:42.640 --> 01:06:45.640] These are the facts [01:06:45.640 --> 01:06:51.640] And this is the law the judge should have applied to those facts [01:06:51.640 --> 01:06:57.640] But he failed to properly apply the law to these facts [01:06:57.640 --> 01:06:59.640] That's essentially what you say [01:06:59.640 --> 01:07:06.640] You say it in terms of the case law that's available [01:07:06.640 --> 01:07:08.640] The statute of case law that's available [01:07:08.640 --> 01:07:10.640] Does that make sense? [01:07:10.640 --> 01:07:13.640] Yes, but under the Roman numerals [01:07:13.640 --> 01:07:14.640] I'm just trying to figure out how to word it [01:07:14.640 --> 01:07:17.640] So if I'm going to go straight for the point [01:07:17.640 --> 01:07:23.640] In this case the judge granted a 12b6 and a 56c summary judgment [01:07:23.640 --> 01:07:25.640] For both defendants [01:07:25.640 --> 01:07:27.640] And so under Roman numeral one I could say [01:07:27.640 --> 01:07:33.640] Did the court properly grant the court reporter's summary judgment? [01:07:33.640 --> 01:07:35.640] Go into my argument there [01:07:35.640 --> 01:07:41.640] Okay [01:07:41.640 --> 01:07:44.640] Say that again [01:07:44.640 --> 01:07:49.640] I'm trying to think of how to ask that question [01:07:49.640 --> 01:07:51.640] You need to be more specific [01:07:51.640 --> 01:07:59.640] On what grounds did the judge grant the rule 12b6? [01:07:59.640 --> 01:08:02.640] On the grounds that the court reporter followed the law [01:08:02.640 --> 01:08:07.640] That she did not hold back any transcripts [01:08:07.640 --> 01:08:10.640] Which is what I accuse her of doing [01:08:10.640 --> 01:08:12.640] And that I just made false claims [01:08:12.640 --> 01:08:17.640] He said that I was repetitive in my argument [01:08:17.640 --> 01:08:21.640] In other words just bantering like a caveman [01:08:21.640 --> 01:08:23.640] Okay [01:08:23.640 --> 01:08:29.640] You name the transcript that you claim was withheld [01:08:29.640 --> 01:08:38.640] And the judge ruled that this particular transcript was not withheld [01:08:38.640 --> 01:08:46.640] Was the judge correct when he ruled that this transcript was not withheld? [01:08:46.640 --> 01:08:48.640] Okay [01:08:48.640 --> 01:08:52.640] Then you show the fact to show that it was withheld [01:08:52.640 --> 01:08:54.640] Okay next [01:08:54.640 --> 01:08:59.640] Well in the judge's order [01:08:59.640 --> 01:09:03.640] This may be pointless but it does say [01:09:03.640 --> 01:09:08.640] The judge's order responds that reconsideration is not warranted [01:09:08.640 --> 01:09:12.640] That's just in his order for my reconsideration [01:09:12.640 --> 01:09:15.640] I think that's what I just said isn't it? [01:09:15.640 --> 01:09:20.640] Okay that's reconsideration you don't even address that [01:09:20.640 --> 01:09:25.640] Okay I've got this written down so I just re-read what I was trying to say [01:09:25.640 --> 01:09:32.640] In the judge's order though when he denies my motion for new trial or reconsideration [01:09:32.640 --> 01:09:34.640] I've got this written out [01:09:34.640 --> 01:09:40.640] Court claims rule 60B to relieve a party from judgment under six circumstances [01:09:40.640 --> 01:09:42.640] This is the judge speaking [01:09:42.640 --> 01:09:44.640] Number one, mistake [01:09:44.640 --> 01:09:47.640] Two, new discovery evidence [01:09:47.640 --> 01:09:48.640] Three, fraud [01:09:48.640 --> 01:09:49.640] Four, void judgment [01:09:49.640 --> 01:09:52.640] Five, judgment satisfied [01:09:52.640 --> 01:09:53.640] Six, other [01:09:53.640 --> 01:09:58.640] But he goes on to claim that Hill's references to 66B [01:09:58.640 --> 01:10:06.640] He references 60B without discussing or satisfying any of these six categories [01:10:06.640 --> 01:10:14.640] Did the judge err when he failed to satisfy these categories? [01:10:14.640 --> 01:10:17.640] Okay [01:10:17.640 --> 01:10:24.640] Because I did claim that the court reporter kept making false extensions of time [01:10:24.640 --> 01:10:30.640] So that would go under fraud but it says that I did not actually list the name of fraud [01:10:30.640 --> 01:10:32.640] In other words he's trying to split hairs with me [01:10:32.640 --> 01:10:33.640] Yes [01:10:33.640 --> 01:10:35.640] That's what it seems [01:10:35.640 --> 01:10:45.640] Okay so you ask did he rule correctly when he ruled that he met all the elements [01:10:45.640 --> 01:10:50.640] You're saying he didn't meet all the elements [01:10:50.640 --> 01:10:58.640] Great okay so I will have probably six or seven different Roman numeral topics then [01:10:58.640 --> 01:11:00.640] That's attorney on jury instructions [01:11:25.640 --> 01:11:29.640] And anything else that you all want to get together with like a settlement [01:11:29.640 --> 01:11:36.640] And so I emailed the other attorney and asked him if he wanted to get together on those two topics [01:11:36.640 --> 01:11:40.640] And he emailed me back and refused [01:11:40.640 --> 01:11:45.640] Okay then you make up jury instructions [01:11:45.640 --> 01:11:49.640] Look up pattern jury charges [01:11:49.640 --> 01:11:50.640] Okay [01:11:50.640 --> 01:11:58.640] For your issues and you submit a proposed jury instruction [01:11:58.640 --> 01:12:08.640] And when the judge asked if you conferred with other counsel you can tell him you attempted to but counsel refused [01:12:08.640 --> 01:12:13.640] Got it I don't need to notice the court that he's not answering my emails [01:12:13.640 --> 01:12:19.640] No just if he don't answer if he don't respond you just make up your own jury charge [01:12:19.640 --> 01:12:22.640] Got it okay I'll get on that [01:12:22.640 --> 01:12:23.640] Alright that's all I've got [01:12:23.640 --> 01:12:25.640] Wait one more issue [01:12:25.640 --> 01:12:26.640] Yeah judgment so you state that the judge erred when he ruled that you did not ask for declaratory judgment [01:13:25.640 --> 01:13:29.640] Okay I thought that was injunctive relief [01:13:29.640 --> 01:13:32.640] Injunctive is declaratory [01:13:32.640 --> 01:13:34.640] Okay great [01:13:34.640 --> 01:13:48.640] He declares a certain thing there's declaratory judgment and there's relief relief is where he grants you compensation for harm otherwise it's declaratory [01:13:48.640 --> 01:13:53.640] So he erred when he claimed that you didn't ask for declaratory judgment [01:13:53.640 --> 01:14:01.640] Well I did want to ask and I'm glad that you reminded me of this let's say I go through all this and I actually win on everything [01:14:01.640 --> 01:14:13.640] But let's say I really do boo boo and left off declarative relief in my in my pleadings so we get all the way to the end could I still lose the entire case because I forgot one one plug in the hole [01:14:13.640 --> 01:14:16.640] No this is where I was going to go with that [01:14:16.640 --> 01:14:19.640] Is he [01:14:19.640 --> 01:14:23.640] Did he dismiss with prejudice [01:14:23.640 --> 01:14:24.640] Yes [01:14:24.640 --> 01:14:27.640] Okay that's your argument [01:14:27.640 --> 01:14:37.640] Is even if you left these off then it the judge erred when he dismissed with prejudice [01:14:37.640 --> 01:14:42.640] And look up the case law on that especially with a pro se filing [01:14:42.640 --> 01:14:49.640] Okay and then turn that into a question also did the judge error when he dismissed with prejudice [01:14:49.640 --> 01:14:51.640] Exactly [01:14:51.640 --> 01:14:56.640] This is like Jeopardy [01:14:56.640 --> 01:14:58.640] Explain [01:14:58.640 --> 01:15:06.640] Well you know how where you have to repeat everything is a question what volcano in Hawaii [01:15:06.640 --> 01:15:13.640] So it's kind of hard to get my head wrapped around it so you have to come and say did the judge error [01:15:13.640 --> 01:15:15.640] When he did this [01:15:15.640 --> 01:15:22.640] So make sure you get that one in because that's the one you're most likely to win with [01:15:22.640 --> 01:15:24.640] Right [01:15:24.640 --> 01:15:30.640] Generally they frown on dismissing with prejudice with a pro se litigant [01:15:30.640 --> 01:15:35.640] Especially if you left something out [01:15:35.640 --> 01:15:41.640] Because that's something you can put back in and correct the error [01:15:41.640 --> 01:15:44.640] So that will almost certainly get you a win [01:15:44.640 --> 01:15:50.640] Another mistake that I made is we're allowed one amended pleading [01:15:50.640 --> 01:15:57.640] Before you file leave with the court for any more and I put in two amended pleadings [01:15:57.640 --> 01:16:01.640] Just because I got bullheaded and ran right over you know wouldn't even thinking about it [01:16:01.640 --> 01:16:05.640] Could that wind up messing me up [01:16:05.640 --> 01:16:06.640] No [01:16:06.640 --> 01:16:08.640] Okay [01:16:08.640 --> 01:16:15.640] These were put in before the dismissal before he told you what was wrong with the suit [01:16:15.640 --> 01:16:19.640] Yeah they were put in nine months ago [01:16:19.640 --> 01:16:22.640] Once he told you what was wrong with the suit [01:16:22.640 --> 01:16:28.640] Your pro se if it's something that can be repaired he should have dismissed without prejudice [01:16:28.640 --> 01:16:32.640] So that you could refile and fix the error that he pointed out [01:16:32.640 --> 01:16:36.640] Because generally the judges are there to instruct [01:16:36.640 --> 01:16:39.640] They generally tell both sides what's wrong with their pleading [01:16:39.640 --> 01:16:40.640] Fix them [01:16:40.640 --> 01:16:41.640] Okay [01:16:41.640 --> 01:16:44.640] Because they want good pleading here the judge is just trying to toss you [01:16:44.640 --> 01:16:48.640] So you'll probably get it thrown out on that that's almost certainly thrown [01:22:01.640 --> 01:22:18.640] Well, I got a, in listening to some of the older episodes and a bit of navel gazing, you or Mr. Craig had stated that the, and I think it was you [01:22:18.640 --> 01:22:28.640] That while the citizens have a burden of just knowing the statutes, lawyers have a burden of knowing statutes, the [01:22:28.640 --> 01:22:32.640] No, no, no, you're going to Screws [01:22:32.640 --> 01:22:35.640] Okay, so we're going straight to Screws there, okay [01:22:35.640 --> 01:22:46.640] Yeah, that's Screws, I think it's 361 US 93 I believe, just look up Screws VUS, what they say is [01:22:46.640 --> 01:22:56.640] Okay, we've got a sheriff and two deputies, I've been saying this in Mississippi but my producer Friday told me they were in Georgia [01:22:56.640 --> 01:23:06.640] Anyway, they're in a bar, drinking, they're upset at this black guy, they're going to go arrest him, the bartender tries to talk him out of it, they won't be dissuaded [01:23:06.640 --> 01:23:10.640] They arrest him and wind up beaten to death on the courthouse steps [01:23:10.640 --> 01:23:20.640] They're prosecuted in the state, they're sued in the state, then they're sued again in the Fed for the civil rights violation and they complain to the Fed [01:23:20.640 --> 01:23:24.640] That they didn't have adequate notice that they could be sued in the Fed [01:23:24.640 --> 01:23:36.640] So the court, and I'm paraphrasing here, said that while a private citizen cannot claim ignorance of the law as a defense to prosecution [01:23:36.640 --> 01:23:40.640] A public official is held to a much higher standard [01:23:40.640 --> 01:23:46.640] And this is not paraphrasing, if a public official violates the ruling of this court [01:23:46.640 --> 01:23:54.640] And he be saying, he may not be heard to say he knows not what he does [01:23:54.640 --> 01:23:58.640] And that's not unreasonable [01:23:58.640 --> 01:24:02.640] If you're a court reporter [01:24:02.640 --> 01:24:09.640] There's not that many laws that affect your job, or that much case law that affects your job you expect to know it [01:24:09.640 --> 01:24:12.640] You're expected to know it, you're a police officer [01:24:12.640 --> 01:24:16.640] You're expected to know the law that affects what you're doing [01:24:16.640 --> 01:24:25.640] I actually had probably a dozen police officers tell me that it was a waste of time for them to try to read and understand the penal code [01:24:25.640 --> 01:24:28.640] Are you kidding me? Arguments heard by court. Court makes no ruling today's date [01:26:26.640 --> 01:26:34.640] The said attorney should file with the court by the 14th a list of documents proposed to be sealed [01:26:34.640 --> 01:26:42.640] Now, the response from the attorney has in the second paragraph [01:26:42.640 --> 01:26:52.640] The court offered to have counsel go through the file to review the portions which it believes should be sealed but indicated reluctance to seal the whole file [01:26:52.640 --> 01:27:03.640] Now, the next paragraph says the defense respectfully would renew its request that the entire file be sealed and removed from CCAP [01:27:03.640 --> 01:27:10.640] So he doesn't send a motion to say, hey, reconsider. He doesn't have a motion to reconsider [01:27:10.640 --> 01:27:17.640] He just puts this in a letter. The letter is filed late, etc. But the word offered [01:27:17.640 --> 01:27:26.640] Now, the judge didn't issue a written order. You want this stuff, you get this paperwork [01:27:26.640 --> 01:27:37.640] But offered seems to be a weak word here. It doesn't have, it seems more casual than the reality of the judge going [01:27:37.640 --> 01:27:43.640] Look, you want these records sealed, get me a list of what's getting sealed [01:27:43.640 --> 01:27:48.640] So is there some magic in the word offered that I'm missing? It actually says meritorious claims and contentions [01:35:08.640 --> 01:35:14.640] Is actually what Wisconsin SCR 23.1 says [01:35:14.640 --> 01:35:19.640] So, if it's not meritorious, then it's frivolous [01:35:19.640 --> 01:35:23.640] Then it's frivolous, alright, I will work on using the word frivolous [01:35:23.640 --> 01:35:29.640] Frivolous is a word I come across like when I was reading through the sanctions against lawyers [01:35:29.640 --> 01:35:34.640] That's the term they tended to always use is frivolous [01:35:34.640 --> 01:35:35.640] Okay [01:35:35.640 --> 01:35:41.640] They're essentially saying you filed this to waste the court's time [01:35:41.640 --> 01:35:45.640] They didn't call it churning the case [01:35:45.640 --> 01:35:49.640] But essentially that's what they're saying, you're churning this case [01:35:49.640 --> 01:35:56.640] Filing these non-meritorious arguments so that you can be your client for doing something [01:35:56.640 --> 01:36:00.640] That shouldn't have been done in the first place [01:36:00.640 --> 01:36:01.640] Okay [01:36:01.640 --> 01:36:09.640] And actually extending litigation is a different violation in Wisconsin, but good [01:36:09.640 --> 01:36:18.640] Alright, the other thing from a public policy standpoint that this touches and to create politics [01:36:18.640 --> 01:36:28.640] We have Wisconsin 950.055, child victims and witnesses, rights and services [01:36:28.640 --> 01:36:38.640] 955.055 per N1, legislative intent, the legislature finds necessary to provide child victims and witnesses with additional consideration [01:36:38.640 --> 01:36:44.640] And goes into that, but at the bottom, program responsibility [01:36:44.640 --> 01:36:51.640] In each county, the county board is responsible for the provisions of services under this section [01:36:51.640 --> 01:36:59.640] This strikes me since this attorney who is now asking for protection of the children [01:36:59.640 --> 01:37:12.640] It seems to me that he's crossed from representing the perpetrator who's now dead to suddenly trying to represent the child victims [01:37:12.640 --> 01:37:20.640] Now the mother, of course, doesn't want this attorney representing the victims [01:37:20.640 --> 01:37:25.640] The children can't sign a contract with this guy [01:37:25.640 --> 01:37:33.640] So what strikes me is his only empowerment as a lawyer to be able to represent these children [01:37:33.640 --> 01:37:45.640] Would be under some kind of contract that ultimately the county board is responsible [01:37:45.640 --> 01:37:55.640] I'm thinking, do we have a right to act in good faith? [01:37:55.640 --> 01:38:05.640] Except he's waiving that right to act in good faith by filing late and not doing what the judge offered him to do [01:38:05.640 --> 01:38:19.640] I'm just addressing him, speaking to the interests of the children, I don't think he would have to be under contract to represent them [01:38:19.640 --> 01:38:22.640] In order to act in their best interest [01:38:22.640 --> 01:38:27.640] His client's dead so he doesn't have to work in his client's best interest anymore [01:38:27.640 --> 01:38:36.640] He could act in what he perceives to be the children's best interest without being under a contract with them [01:38:36.640 --> 01:38:46.640] Except that to act in the best interest of the children, as the judge said, I'm more than happy to, because I was there [01:38:46.640 --> 01:38:55.640] I'm more than happy to seal these children's records and under any sight of the statute, they have a right to have it done [01:38:55.640 --> 01:39:01.640] Attorney, I want you to come up with this list, you're the one requesting the sealing of records [01:39:01.640 --> 01:39:04.640] I want you to come up with a list [01:39:04.640 --> 01:39:16.640] And for him to file late and file nothing except this letter, I would think he's waiving that best interest [01:39:16.640 --> 01:39:19.640] I think that's exactly what he would be doing [01:39:19.640 --> 01:39:28.640] The only reason I said that is I don't think you could go after him claiming he can't represent their interests because he didn't have a contract [01:39:28.640 --> 01:39:43.640] But I agree 100% he has waived any claim before the court by not acting in accordance with the court order [01:39:43.640 --> 01:39:49.640] Okay, alright, how do I get that? [01:39:49.640 --> 01:39:52.640] I'm thinking of how to say that [01:39:52.640 --> 01:39:55.640] He is ingenuine [01:39:55.640 --> 01:40:08.640] He's not speaking, when he asked to seal these records for the benefit of the children, he failed to speak with candor to the court [01:40:08.640 --> 01:40:10.640] Okay [01:40:10.640 --> 01:40:26.640] In fact, he was still acting to get the records sealed for his client and he misrepresented his intention to the court so he failed to speak with candor to the court [01:40:26.640 --> 01:40:28.640] That would be one [01:40:28.640 --> 01:40:39.640] Alright, in failing to speak with candor to the court, I've traveled down that road with bar grievances before so that one's fine, I like that one [01:40:39.640 --> 01:41:00.640] The only other comment, the no publicity is bad publicity, my research into that says that it tied back to the days when the star system that was in Hollywood back in the early 20th century [01:41:00.640 --> 01:41:17.640] And so that applies to publicity, it was originally applied to publicity about stars such that if they're not talking about you, you're dead as a social phenomena [01:41:17.640 --> 01:41:21.640] There is such thing as bad publicity otherwise [01:41:21.640 --> 01:41:41.640] That comment was made by P.T.
