I've got a couple things I want to go through before I turn them on, and to kind of conserve funds where we have to pay for that time that people are staying up on the board. [05:21.880 --> 05:31.880] Now, tonight is the night of the so-called presidential debates between Hillary Clinton and Donald Trump. [05:31.880 --> 05:48.880] Now, folks, if you can spend five minutes in this debate, and your BS meter is not pegging out, no matter which one of them you're listening to, then I really feel for our country. [05:48.880 --> 05:57.880] Neither one of these people is going to do what they are leading you to believe they're going to do on the good side of anything. [05:57.880 --> 06:07.880] When this is all said and done, what will come out of this is that they will be serving themselves just as they always have. [06:07.880 --> 06:19.880] Now, I would love to be pleasantly surprised by Trump if he gets elected, but my inner gut tells me that will not be the case. [06:19.880 --> 06:24.880] My common sense tells me that will not be the case. [06:24.880 --> 06:32.880] He did not get rich by being an honest individual and being forthright with the people he was doing business with. [06:32.880 --> 06:43.880] And Hillary Clinton did not get rich by doing anything even remotely honest and beneficial to anyone other than Hillary Clinton. [06:43.880 --> 06:54.880] So I don't believe either of them have any interest at heart other than their own, just as it has been for decades now. [06:54.880 --> 07:06.880] So if you're watching this and you're actually believing this stuff, please lower the level of medication you are on because it is seriously affecting your judgment. [07:06.880 --> 07:16.880] That being said, some of the information I want to get into has to do with this case that I'm working on where the state is attempting to use the Transportation Code [07:16.880 --> 07:30.880] as a fraudulent means of allowing a DPS trooper to perform a warrantless search and seizure, not just a trooper, but every law enforcement officer we've got. [07:30.880 --> 07:45.880] They have used and abused the Transportation Code in more ways than the general public is even aware of to do more unlawful and unconstitutional things than we should have to think of. [07:45.880 --> 07:49.880] But it is true nonetheless. [07:49.880 --> 07:59.880] Now, some of the things that we're going to get into with the issues of this case, some of the issues I'm bringing up are what does transportation mean in the context of the Texas Transportation Code? [07:59.880 --> 08:17.880] The reason this is relevant to a felony evading case is that the specific offense of felony evasion is limited to someone doing so in a vehicle that matches the definition found within the Transportation Code [08:17.880 --> 08:25.880] under Chapter 541, 541.201 to be exact, Sub-Item 23, I think it is. [08:25.880 --> 08:38.880] Where there, the definition of vehicle is whatever it is, but it is specifically relevant solely to the subject matter of transportation, which is what the Code regulates. [08:38.880 --> 08:52.880] Okay? Doesn't regulate everything on the roads, it regulates only those things relevant and subject, part and parcel, to transportation. [08:52.880 --> 08:55.880] Now, let's get in a little bit about what I'm putting into this. [08:55.880 --> 09:14.880] The bill title of the current recodified Transportation Code as enacted in 1995 by the 74th Legislature in the provisions of SB 971 states that the singular subject matter of that bill is to regulate the privileged occupation of transportation. [09:14.880 --> 09:34.880] Within any Texas Code, and while the legislature either chooses or chose or neglected to specifically define the term transportation within any Texas Code, we can still determine what it legally means by using the rules of statutory interpretation within Section 312.002 of the Texas Government Code. [09:34.880 --> 09:46.880] By applying the rules of Section 312.002 of the Texas Government Code, we find that transportation means the movement of goods or persons from one place to another by a carrier. [09:46.880 --> 09:56.880] And this is the interpretation of the United States Supreme Court and Interstate Commerce Commission versus Brimson at 154 U.S. 447. [09:56.880 --> 10:08.880] Now, in other words, it is a privileged and regulable commercial transportation business occupation or transportation-related business activity. [10:08.880 --> 10:22.880] It does not mean simply anyone and anything traveling upon the public right of way as a matter of right, whether by use of a car, automobile or other motorized device of any make or description. [10:22.880 --> 10:50.880] On another issue, are Texas courts authorized and empowered to expand the legislative meaning and intent of an enactment by judicial interpretation or by legislating from the bench by either ignoring the specific language of the legislation or by creating additions, alterations or removal of the terms and phrases used in the language to construct the legislation? [10:50.880 --> 11:03.880] The authority to regulate transportation under the guise of the police power is legislatively limited to the specific subject matter of transportation as codified within the transportation code, [11:03.880 --> 11:23.880] which does not extend to and encompass the legal power and authority to regulate we the people, i.e., the general public, under that same subject matter when we are acting solely within our private common law capacity to use the public right of way as a matter of right and not as a government-granted, [11:23.880 --> 11:38.880] licensable privilege to engage in transportation. Respondent maintains that he is one of the people and is not subject to the provisions of the transportation code when acting solely within his personal private common law capacity [11:38.880 --> 11:58.880] and using the public right of way as a matter of right for his own personal business and pleasure, but only to that law which prohibits him from causing an unjust or negligent injury to another person or their property while engaging in the free exercise of his own rights, [11:58.880 --> 12:09.880] which injury the state is not free to simply fabricate out of thin air or presume as being true absent a complaining party with a demonstrable injury. [12:09.880 --> 12:28.880] It is insanity to claim that the state as a legal fiction can use its own agents to charge a harm to itself and then use those same agents to act as the primary witness or witnesses to testify to that harm and have another agent prosecuting the matter [12:28.880 --> 12:47.880] and yet another that presides over the proceedings to ensure that the state wins its case. As nothing more than a legal fiction, the state is incapable of sustaining and proving any tangible injury to itself, [12:47.880 --> 13:09.880] a primary requisite of standing in any legal matter, and yet the state prevails in case after case on such claims despite the fact it produces absolutely no evidence of having suffered any tangible injury and therefore acquired any legal standing to pursue a case at all. [13:09.880 --> 13:22.880] Therefore, each title, chapter, and section, i.e. everything within that code and its legal application, must have a direct relationship with the subject matter of transportation, [13:22.880 --> 13:36.880] or it violates the requirements and prohibitions respectively of legislating on multiple subjects within a single bill under Article III, Section 35A and B of the Texas Constitution. [13:36.880 --> 13:47.880] It is important to note that the bill's title plainly states that the previously existing statutory scheme also related solely to the regulation of transportation, [13:47.880 --> 14:00.880] and that this recodification does not create any substantive changes to the original statutes and underlying law, which would constitute a violation of Article III, Section 36 of the Texas Constitution. [14:00.880 --> 14:20.880] Issue. By what authority do our Texas courts act to authorize and empower a governmental agency with a regulatory or enforcement power that neither the language or stated subject matter of a legislative enactment specifically provides for [14:20.880 --> 14:34.880] or infers, but rather by legal definition, such enactment specifically denies the existence of any such legislatively delegated regulatory authority to that agency? [14:34.880 --> 14:50.880] In light of what transportation legally means and is, then it should be readily apparent and understood that under Texas law, reasonable suspicion or probable cause to conduct a transportation stop of any one of a commercial or a motor vehicle, [14:50.880 --> 15:05.880] must be within the subject matter context of transportation itself, as the terms operator, driver and any grammatical variations thereof, as well as the terms commercial motor vehicle, motor vehicle or vehicle, [15:05.880 --> 15:14.880] are all specifically defined within and are only relevant to the regulation of the privileged business activity of transportation. [15:14.880 --> 15:25.880] To read the statutes otherwise is to unlawfully and unconstitutionally expand their application beyond the legal meaning and applicability of the subject matter being legislated, [15:25.880 --> 15:33.880] which the courts are forbidden to do under the provisions of Article I, Section 29 and Article II of the Texas Constitution. [15:33.880 --> 15:51.880] It should be further understood that Article I, Section 29 is within the People's Bill of Rights of the Texas Constitution, which means that we have a right and therefore legal standing to demand and defend any violation of any and all constitutional provisions and prohibitions, [15:51.880 --> 16:02.880] as we are the source of all political power within this state. It is not the legislature nor the courts that set and determine that standard, it is we the people. [16:02.880 --> 16:11.880] The courts egregiously err and step outside the bounds of acting judicially and begin legislating and practicing law from the bench, [16:11.880 --> 16:31.880] when operating and formulating decisions using the unrebuttable presumption that the transportation code is in any way relevant, applicable or legally capable of regulating the general public's private common law use and travel upon the public right-of-way as a matter of right, [16:31.880 --> 16:34.880] of which respondent is one. The legislature, if any such enactment could be constitutionally viable at all, [20:06.880 --> 20:11.880] would be required to enact an entirely different code with its own statutory scheme, [20:11.880 --> 20:19.880] the context and subject matter of which would be an entirely different legislative bill with a title specific thereto. [20:19.880 --> 20:21.880] And there is none. [20:21.880 --> 20:27.880] It is the state that bears the burden of proof to show that there is such a statutory scheme in place [20:27.880 --> 20:33.880] that allegedly regulates the general public's private common law use of the public right of way [20:33.880 --> 20:37.880] rather than the commercial business activity of transportation, [20:37.880 --> 20:42.880] and to then provide respondent with proper, sufficient, and timely notice of its existence [20:42.880 --> 20:51.880] and how he allegedly violated some known or required legal duty under some provision thereof, which has not been done. [20:51.880 --> 20:58.880] Our courts are not empowered, nay, they are strictly forbidden, from rewriting legislative enactments [20:58.880 --> 21:03.880] to encompass subject matter within a code statutory scheme that is completely unrelated [21:03.880 --> 21:09.880] to the clearly stated subject matter context of the legislative bill that created that code. [21:09.880 --> 21:15.880] Regardless of whether such judicial rewrite is through interpretation or outright judicial fiat, [21:15.880 --> 21:21.880] the courts are simply not authorized to create or rewrite law and statute as they see fit [21:21.880 --> 21:24.880] or for a particular desired legal outcome. [21:24.880 --> 21:32.880] And they violate the Separation of Powers Clause of Article 2 and Article 1, Section 29's prohibition [21:32.880 --> 21:38.880] of violating any provision of the Texas Constitution by adding, ignoring, [21:38.880 --> 21:42.880] or taking away from the terms and phrases of the statute's language [21:42.880 --> 21:47.880] or their legal meaning as used by the legislature to construct it. [21:47.880 --> 21:52.880] To do so is to violate the basic rules of statutory construction and interpretation [21:52.880 --> 21:57.880] as found within Chapters 311 and 312 of the Texas Government Code. [21:57.880 --> 22:03.880] It is inconceivable under the requirements of Article 3, Section 35A of the Texas Constitution, [22:03.880 --> 22:09.880] where every legislative bill formulating an enactment is strictly limited to the context of a single subject, [22:09.880 --> 22:15.880] that the transportation code could be read and interpreted by our courts to in any way apply [22:15.880 --> 22:21.880] to the general public, our private conveyances, or to our use of the public right of way [22:21.880 --> 22:24.880] in a lawful, not legal manner. [22:24.880 --> 22:30.880] The prosecutors and the courts do this by conspiring and colluding to use completely unsubstantiated [22:30.880 --> 22:37.880] and unrebuttable legal presumptions that automatically presume that the whole of the general public [22:37.880 --> 22:43.880] are acting within the legally defined capacities of an individual and or person [22:43.880 --> 22:50.880] that is engaging in transportation and therefore is a legal person that is subject to that code, [22:50.880 --> 22:57.880] despite the fact that the general public were not and are not legally engaged in any form of transportation [22:57.880 --> 23:06.880] as a legally defined carrier, operator, or driver of a commercial motor vehicle, motor vehicle, or vehicle. [23:06.880 --> 23:11.880] For example, the Texas Court of Criminal Appeals has ruled that a prosecutor alleging car [23:11.880 --> 23:17.880] rather than commercial motor vehicle or motor vehicle or vehicle within a criminal complaint [23:17.880 --> 23:24.880] and then using only the term car during the trial process was legally sufficient under the statute [23:24.880 --> 23:27.880] to prosecute and convict. [23:27.880 --> 23:30.880] This is not simply judicial error or mistake. [23:30.880 --> 23:37.880] This is nothing short of a willful and wrongful judicial rewrite and misinterpretation of the actual law [23:37.880 --> 23:43.880] through unlawful judicial activism and unlawfully legislating from the bench. [23:43.880 --> 23:50.880] The legislature defined the proper legal term or phrase to describe a device used to engage in transportation [23:50.880 --> 23:58.880] to be that of commercial motor vehicle, motor vehicle, or vehicle, not car, not automobile, and not bobsled. [23:58.880 --> 24:02.880] The legal analysis on this point should be very simple. [24:02.880 --> 24:08.880] Can a car be used as a commercial motor vehicle, motor vehicle, or vehicle, or vice versa? [24:08.880 --> 24:16.880] The answer is yes, a car can be used as a commercial motor vehicle, motor vehicle, or vehicle. [24:16.880 --> 24:24.880] However, legally speaking, a commercial motor vehicle, motor vehicle, or vehicle can never be used as a car, [24:24.880 --> 24:32.880] as doing so would immediately deprive it of its legally defined character as a commercial motor vehicle, [24:32.880 --> 24:37.880] motor vehicle, or vehicle for the purpose of engaging in transportation. [24:37.880 --> 24:44.880] So now the only question is, what evidence exists to actually prove that the car was being used [24:44.880 --> 24:50.880] as a commercial motor vehicle, motor vehicle, or vehicle to engage in transportation? [24:50.880 --> 24:57.880] And if there is no actual evidence, merely an unrebuttable legal presumption, [24:57.880 --> 25:04.880] then it absolutely is not legally sufficient to allege and or prove only that a car was used [25:04.880 --> 25:08.880] to commit an offense under the subject matter umbrella of transportation. [25:08.880 --> 25:16.880] This is a perfect example of the worst sort of judicial activism, where the court takes it upon itself [25:16.880 --> 25:24.880] or upon themselves to literally add to or expand the specific terms or phrases beyond the scope of those listed [25:24.880 --> 25:29.880] within the language of legislative enactments, or to interpret them into the statutory language, [25:29.880 --> 25:37.880] where no such phrasing or legislative intent exists, and for no other reason than to achieve a preconceived [25:37.880 --> 25:40.880] and desired outcome to a case. [25:40.880 --> 25:48.880] Which begs the question, when the courts use judicial interpretation and legislating from the bench [25:48.880 --> 25:55.880] to go where no law or statute has gone before in direct violation of Article 2's separation of powers clause [25:55.880 --> 26:01.880] and the judge's individual oath of office under Article 16, Section 1 of the Texas Constitution, [26:01.880 --> 26:07.880] does the ruling and opinion of the court then constitute judicial paper terrorism [26:07.880 --> 26:13.880] against the general public and the Republic of Texas as a whole? [26:13.880 --> 26:20.880] Now that's a question we need to get answered, folks, because there should be no way the courts can accuse us [26:20.880 --> 26:27.880] of defending our rights as something bordering on paper terrorism when their judicial opinions violate [26:27.880 --> 26:35.880] every mandate of individual rights, liberties, and freedoms, and constitutional prohibitions, [26:35.880 --> 26:41.880] and the language of the statutes they pretend to understand and interpret for the rest of us, [26:41.880 --> 26:50.880] and say that they are not themselves guilty of judicial terrorism. [26:50.880 --> 27:01.880] It is absolutely the same thing if it could be levied against us at all, but it most certainly can be levied against them. [27:01.880 --> 27:09.880] Every opinion they write that alters the terminology used in a statute or the law [27:09.880 --> 27:18.880] to gain a particular outcome suitable to the state is nothing short of judicial terrorism. [27:18.880 --> 27:24.880] It is a violation of everything that the Constitution stands for, state and federal. [27:24.880 --> 27:28.880] It's a violation of the will of the people. It's a violation of their oath of office. [27:28.880 --> 27:38.880] It's a violation of the separation of powers. It is a freaking criminal enterprise. [27:38.880 --> 27:43.880] And every attorney on this planet, whether they be sitting as a judge, acting as a prosecutor, [27:43.880 --> 27:52.880] acting as a defense attorney, or practicing some other area of law, knows this and is in on it [27:52.880 --> 27:56.880] and does nothing to change it because they will not bite the hand that feeds them. [27:56.880 --> 28:02.880] And the few that do get disbarred. [28:02.880 --> 28:08.880] The bar association is nothing more than the judicial equivalent of the code of silence [28:08.880 --> 28:12.880] and the thin blue line in the law enforcement arena of the executive department. [28:12.880 --> 28:16.880] It's the exact same thing. [28:16.880 --> 28:26.880] It is a way to hide the criminality of those acting in a manner that preys upon the people. [28:26.880 --> 28:33.880] And we're allowing it to go on and on and on. And I can't help but wonder why. [28:33.880 --> 28:38.880] Why are these questions not being asked by every person in this country? [35:21.880 --> 35:26.880] I'm sitting here like, man, you just gave me all the goodies. I didn't even have to do anything. [35:26.880 --> 35:31.880] He just jumped out on tape and accused me of this, accused me of that, told me I was under arrest. [35:31.880 --> 35:36.880] And I needed to help him get out of the car before he broke the window. [35:36.880 --> 35:41.880] So, I got out of the car and got arrested. One jail got out. [35:41.880 --> 35:51.880] So, my big brother, Giddy, because he thought I was crazy, but after I showed him the law, he looked at me like, man, just go ahead and do it. I'll bond you out. [35:51.880 --> 36:08.880] So, he's been bonding me out lately. But I called that night and I talked to Randy and Randy told me to do a HAPIS corpus, file a HAPIS corpus, and he said study it, fill it out, and submit it to the court. [36:08.880 --> 36:12.880] He said that the court is supposed to hear it immediately. Is that correct? [36:12.880 --> 36:17.880] Yes. And it takes precedent over any other cases pending before them. [36:17.880 --> 36:24.880] Oh, oh, thank you, thank you, because when I submitted it, right, she went back there and they said, well, they'll take your name and everything. [36:24.880 --> 36:28.880] I said, they'll take my name. I said, you know what? I'm going to write my name and information down here. [36:28.880 --> 36:35.880] But you need to go tell them that this needs to be seen right now. This needs to be brought in front of a judge. [36:35.880 --> 36:45.880] And after that, you can tell me whatever you want to tell me. After that, if I don't see the judge, let me see whatever you have to tell me in writing. [36:45.880 --> 36:47.880] Yeah. Hang on a second, Olivier, let me interrupt here. [36:47.880 --> 36:55.880] Now, the thing to do with a HAPIS corpus in the situation that you're in and you know it's going to be consistently this way, write one in advance. [36:55.880 --> 37:07.880] Just leave the dates, times, and jail locations blank. Leave it in the hands of someone that you trust to go down and file it with the court and get it heard. [37:07.880 --> 37:11.880] That way you're already prepared. You get arrested. You call up whoever you need to. [37:11.880 --> 37:20.880] Hey, that HAPIS corpus I gave you, put this information on it, take it down and file it at this court ASAP. [37:20.880 --> 37:30.880] And then you don't have to worry about bonds and stuff like that because then you can get, if you get the hearing and get it rule four in your favor that they're holding you illegally, [37:30.880 --> 37:34.880] then they have to let you out and nobody's out of bond. [37:34.880 --> 37:44.880] Okay. Right. I understand that part, but let's say I filed it and they didn't hear it immediately like they're supposed to. What can I do next? [37:44.880 --> 37:53.880] Look at the statutes in your state relating to habeas corpus. Look at the constitutional requirements of habeas corpus. [37:53.880 --> 37:54.880] Okay. [37:54.880 --> 38:02.880] They will tell you what the court is required to do in relation to a habeas petition. [38:02.880 --> 38:08.880] Okay. If something is violated in that, what do I do from that? [38:08.880 --> 38:17.880] Then you can judicially conduct complaint against the judge for deprivation of rights and conspiracy to keep you locked away at your liberty. [38:17.880 --> 38:27.880] When he does not perform his magisterial duty, which to hear that writ, once it's put in front of him, he becomes a judicial officer for that purpose. [38:27.880 --> 38:39.880] But when that writ is given to him, he's still in his ministerial capacity. And when he shirks his legal duty to hear that, he has no immunity for that if he's required by law to do it. [38:39.880 --> 38:51.880] Okay. From what I heard, from what they were telling me, it was that the judge was in court at a minute and they related it to his office. And his office said that they'll have to... [38:51.880 --> 39:07.880] Here in Texas, it doesn't matter if he's in court or not. If someone walks into the middle of a trial with a habeas corpus petition, he is required to call a recess and hear that petition. [39:07.880 --> 39:09.880] Okay. So everything goes... [39:09.880 --> 39:14.880] Check the law in your state. I'm telling you what it is here in Texas. [39:14.880 --> 39:25.880] All right. I'll check the law in the state. Okay. I'm headed home. But anyway, this is JD here. As you know, maybe that I just sent you a notification or a message saying that I finished up my judicial conduct complaints and my motion to disqualify the judge. [40:11.880 --> 40:27.880] I sent them in and I got the return receipt back that they received them. Well, today I received a letter from both the Judicial Conduct Committee basically saying that they got it and basically outlined what their procedures are from here. You know, nothing really major on that one. [40:27.880 --> 40:53.880] But I also received a letter from the court. And it says very simply, it says RE case number 16-1221J4 violation speeding, alleged speed 77, speed limit 65. It says a hearing is set for October 4, 2016 at 9 a.m. on the motions you have presented to the court. [40:53.880 --> 41:14.880] One, motion to dismiss for lack of jurisdiction. And two, motion to disqualify the judge. Please plan on hearing this or attending this hearing. And roll short to the point, a little simple little letter. And I guess that after two months of not hearing anything from them, I guess that motion to disqualify the judge kind of stirred some stuff up there. [41:14.880 --> 41:19.880] Well, but here's the problem. What judge is going to be hearing the motion to disqualify the judge? [41:19.880 --> 41:26.880] Well, that was one of my questions. How is that going to work out for one? And what can I expect at this hearing? [41:26.880 --> 41:40.880] Well, that is hard to say since I don't have a crystal ball. I don't know the judge and their habits and the place you're talking about. So that'd be hard to say. They can do a lot of different things. [41:40.880 --> 42:01.880] But what they cannot do is sit in judgment of their own disqualification. Now, they can do it if you ask simply that they recuse themselves. They could rule on that themselves. But when you disqualify them, that's a whole other animal. They cannot rule on that themselves. [42:01.880 --> 42:14.880] That requires a separate judge to do that. And that judge has to be appointed by the head administrative judge of the district. And you're required to be given notice of a hearing date for that. [42:14.880 --> 42:30.880] And normally it is not in the same court where you're disqualifying the judge. I'm not saying it can't be. But now you also have the option of requesting that that hearing for disqualification be done by telephone. [42:30.880 --> 42:43.880] It's written right into the statute that you can request that that be done. But it cannot be the same judge that you're disqualifying that is ruling on that motion. [42:43.880 --> 42:51.880] And to me it sounds like if they have scheduled a hearing on your other motion, then that's exactly what's happening here. [42:51.880 --> 42:55.880] And that's what I thought too. Exactly. [42:55.880 --> 43:06.880] So if you get there and the same judge is sitting to hear both object, you are disqualified. You cannot rule on your own disqualification. [43:06.880 --> 43:16.880] You can only rule on a request to recuse. I didn't recuse you. I disqualified you for judicial incompetence. [43:16.880 --> 43:25.880] Okay. [43:25.880 --> 43:38.880] Anything else? Basically, I'm just taking notes here as I'm going. So basically if I get there and it is that same judge, just object, object, object until they either fill the thing out or get another judge in there, correct? [43:38.880 --> 43:40.880] Correct. Back in May, I got a parking citation for having a truck parked in an emergency parking only area. There was one sign up that I did not see until after the officer sighted me because it was buried in a tree. [47:10.880 --> 47:21.880] It was big, big gravel turnout. Lots of trucks parked there when I got there. I woke up in the morning with the CHP officer banging on the door. He wrote me up a citation. [47:21.880 --> 47:32.880] I filed a special appearance challenge subject matter jurisdiction affidavit of not in commerce because I was not loaded and not dispatched on a load at the time that this happened. [47:32.880 --> 47:51.880] And went to what I thought was going to be my initial appearance, which was a quote unquote arraignment. The commissioner ignored everything I filed, denied it all, told me that the allegations were criminal, entered a not guilty plea for me, and said it was criminal. [47:51.880 --> 47:55.880] Since when is parking criminal? [47:55.880 --> 47:58.880] Well, I said it was a violation of the vehicle code, and that's criminal. [47:58.880 --> 48:03.880] This commissioner is obviously an idiot. You said this was California, right? [48:03.880 --> 48:04.880] Absolutely. [48:04.880 --> 48:08.880] The commissioner is an idiot. [48:08.880 --> 48:23.880] You need to file a tort against that commissioner. Remember, this is all administrative in California. See, here's the thing. If this was truly criminal, that could not be an administrative commissioner sitting there. [48:23.880 --> 48:28.880] It would have to be a judicial judge. [48:28.880 --> 48:51.880] Well, that's the other issue is that in California, they allow a commissioner to sit by stipulation of the parties. When I filed my motion to withdraw a court entered plea, I stated that I did not stipulate to that commissioner and that if any stipulation had been implied or assumed, it was withdrawn. [48:51.880 --> 49:06.880] I haven't got anything back from them except the file stamp copies of my post arraignment motions, so I don't know what's going to happen Wednesday. You know, I still got no complaint, got no summons. [49:06.880 --> 49:12.880] Well, you won't get a complaint because it's California and it's not criminal. [49:12.880 --> 49:27.880] Well, the statute or the code, the vehicle code says that the citation stands as a complaint for a plea of guilty or no lo contendere, but if the accused does not plead to either of those, then a complaint is to be entered. [49:27.880 --> 49:35.880] Yeah, but the problem is, is you can't create a criminal complaint for a civil infraction, which is what this is. [49:35.880 --> 49:46.880] So I guess my question is, what the heck am I supposed to do Wednesday with this court that has no jurisdiction, there's no complaint, there's nothing. What do I do? [49:46.880 --> 49:52.880] Well, that's exactly what you do. You challenge it on those grounds. You have absolutely no authority. I haven't given it to you. [49:52.880 --> 50:00.880] This is a civil infraction. You had no power for this officer to seize me at my liberty to write this citation. [50:00.880 --> 50:08.880] The citation does not apply in this particular case. It's not criminal. I haven't conceded to give you any authority over this matter as a non-judicial officer. [50:08.880 --> 50:24.880] You lack jurisdiction and anything you do to affect me or harm me in any way, including my license or ability to work, will result in a civil tort against you and go home. [50:24.880 --> 50:34.880] Okay. Okay. Now, if they try to insist on holding a trial anyway in spite of all of that. [50:34.880 --> 50:43.880] You want to know how you have proof positive that it's not criminal? If they're telling you they can convict you without you ever being there. [50:43.880 --> 50:44.880] Right. [50:44.880 --> 50:55.880] I don't know of any state in this entire nation where you can be convicted of a crime in absentia unless you were there when the trial began. [50:55.880 --> 51:04.880] So then do not go to the merits. Do not cross-examine the officer. Do not address the issue of the sign being checked. [51:04.880 --> 51:08.880] You can cross-examine the officer. Did you have a valid warrant of arrest? No. [51:08.880 --> 51:09.880] Okay. [51:09.880 --> 51:19.880] Did you have a valid warrant for search and seizure? No. Then how do you obtain probable cause to accost me on a civil infraction? [51:19.880 --> 51:22.880] Mm-hmm. [51:22.880 --> 51:30.880] They've lost that argument many, many times. They know they would lose that argument if you stand your ground under it. [51:30.880 --> 51:32.880] Okay. [51:32.880 --> 51:39.880] But the problem is if you go into that, you're conceding to the authority of this commissioner. You've got to understand that. [51:39.880 --> 51:40.880] Right. [51:40.880 --> 51:52.880] If you don't want to do that, then don't be cross-examining anybody. Challenge the jurisdiction of this commissioner and any presumptions of jurisdiction and authority granted to this commissioner and say, [51:52.880 --> 52:02.880] Adios, Sara and I will see you later. And anything they do after that, sue the living crap out of them. [52:02.880 --> 52:07.880] They don't have any immunity protections. They're not acting judicially. [52:07.880 --> 52:13.880] Right. But, yeah, I'm a real man. I'm over here in West Texas. I've been a listener for about a year. [53:54.880 --> 54:00.880] But I just got my first ticket knowing this kind of knowledge. So I just got two questions for you, sir, if you don't mind. [54:00.880 --> 54:02.880] Okay. [54:02.880 --> 54:15.880] All right. My first one is, should I bring up the administrative code and use it against them or make them prove I was acting in transportation? Which one should I go at it first? [54:15.880 --> 54:19.880] Well, why do you think they're not both related? Who wrote the ticket? [54:19.880 --> 54:23.880] DPS, of course. [54:23.880 --> 54:32.880] Okay. Then, yeah, you most certainly want to apply the administrative code there, but you've also got to make sure that you make the not in transportation argument. [54:32.880 --> 54:37.880] Because without transportation, DPS has no regulatory and enforcement authority. [54:37.880 --> 54:41.880] None. The administrative code is very clear on that. [54:41.880 --> 54:55.880] The DPS is given specific instructions to create and manage three regulatory programs, licensing, inspection, and financial responsibility. [54:55.880 --> 55:04.880] Okay. Those are the three areas and programs over which they're given any regulatory authority. [55:04.880 --> 55:27.880] But it tells them in the administrative code that that regulatory authority and the programs relating thereto is directly linked to their mission statement, which is to supervise traffic on rural highways and to supervise and regulate commercial and for hire traffic. [55:27.880 --> 55:28.880] Nothing else. [55:28.880 --> 55:29.880] Yes, sir. [55:29.880 --> 55:35.880] They cannot regulate anything else. [55:35.880 --> 55:44.880] Yes, of course. Understood, sir. I was actually going to, that's why I wanted to challenge them, but I just didn't know which one to challenge first, using the administration code or to improve. [55:44.880 --> 55:53.880] Well, you do both because one does not work without the other. You have to do both because one does not work without the other. [01:04:13.880 --> 01:04:21.880] In other words, your entire proceeding is being presided over by a clerk of the court and not an officer of any kind. [01:04:21.880 --> 01:04:33.880] Okay. Okay. So if you sue somebody like that, are you suing the judge because he acted without jurisdiction? I presume you do that. [01:04:33.880 --> 01:04:40.880] You sue them as an individual acting unlawfully in a capacity over which they have no authority if it's been withdrawn. [01:04:40.880 --> 01:04:52.880] As he told you, what they told him is that it was implied that he consented when he did not consent, which implies that they require his consent in order to do it. [01:04:52.880 --> 01:05:06.880] If he withdraws it, they don't have it. If they act anyway, they are the ones breaking the law because they are acting without his consent to do that which he has denied them the power to do, [01:05:06.880 --> 01:05:12.880] which is to prosecute him in an administrative setting. [01:05:12.880 --> 01:05:20.880] Okay. Okay. Last week, we had a caller and towards the end of the call, he started asking you about some real estate questions. [01:05:20.880 --> 01:05:27.880] And you mentioned that real property is commercial property. [01:05:27.880 --> 01:05:28.880] Yeah. [01:05:28.880 --> 01:05:29.880] Correct? [01:05:29.880 --> 01:05:30.880] Yeah. [01:05:30.880 --> 01:05:34.880] How do you prove that? I mean, what's the argument? [01:05:34.880 --> 01:05:44.880] Okay. The argument is more or less fairly simple. Can the government tax or license a right? [01:05:44.880 --> 01:05:45.880] No. [01:05:45.880 --> 01:05:49.880] Okay. And the reason for that should be fairly obvious, correct? [01:05:49.880 --> 01:05:51.880] Yes. Yes. [01:05:51.880 --> 01:06:07.880] If they can tax or license a right, then all they have to do to destroy the exercise of that right is to set the cost of the license or the fee for its exercise so high no one can pay it, thus the right is destroyed. [01:06:07.880 --> 01:06:17.880] The courts have also ruled that the power to tax is the power to destroy. That's in relation to an income tax case, but it's a fact across the board nonetheless. [01:06:17.880 --> 01:06:26.880] So if the government can tax it, the government can destroy it. The government has no power to destroy the rights of the people. [01:06:26.880 --> 01:06:35.880] The government therefore has no power to do so by taxation or by licensing or the charging of a fee for their exercise. [01:06:35.880 --> 01:06:47.880] Now, if they can tax real property, then obviously real property is not something that falls within the realm of common right. It falls within a regulable privilege. [01:06:47.880 --> 01:06:55.880] So we're not talking about private property because private property ownership is a right. [01:06:55.880 --> 01:07:07.880] The transfer of private property, the use of private property, the ownership, disposal, and disposition of private property is an inherent fundamental right. [01:07:07.880 --> 01:07:11.880] Okay. The pursuit of happiness and all that good stuff, right? [01:07:11.880 --> 01:07:12.880] Yes. [01:07:12.880 --> 01:07:19.880] So as that is an actual right, can the government tax it? [01:07:19.880 --> 01:07:20.880] No. [01:07:20.880 --> 01:07:29.880] Therefore, you can draw a distinction between what is private and what is real in relation to taxation. Can you not? [01:07:29.880 --> 01:07:30.880] Yeah, I would think so. [01:07:30.880 --> 01:07:48.880] Therefore, the logic is real property cannot be the legal equivalent of private property and must be commercial as commercial is the only nexus by which the state can tax us under a privilege. [01:07:48.880 --> 01:07:58.880] Then how do we get the assessors and treasurers to recognize... [01:07:58.880 --> 01:08:06.880] You have to learn the difference. You have to learn the difference. You have to learn the history and you have to sue the crap out of them. [01:08:06.880 --> 01:08:16.880] I keep trying to tell folks there is no legal silver bullet here. You will never get a bureaucrat to admit he's doing it wrong. Never. [01:08:16.880 --> 01:08:26.880] Not until you're hanging him by his crotch from the yard arm and flaying him alive will he ever admit that he's doing it wrong. [01:08:26.880 --> 01:08:43.880] And he has tons of these attorneys in the background using legal obfuscation through legalese and language semantics to make it appear as if this is real and this is not when it's exactly the opposite. [01:08:43.880 --> 01:08:58.880] Okay. Now, is there any basis in the argument? I went back and looked up the original Constitution that says taxes cannot be paid with anything but money. And it says that in the current Constitution, too. [01:08:58.880 --> 01:09:11.880] It says it in all of them. And it defines money as gold and silver coin in the federal Constitution. No state shall take anything in payment of a debt other than gold and silver coin. [01:09:11.880 --> 01:09:28.880] Okay. Is that a valid part of the argument? No. Because no court will expose the fraud that is the Federal Reserve. They're all in their pocket. That is not an argument we will win without the barrel of a gun and the point of a knife. [01:09:28.880 --> 01:09:34.880] Okay. Not in their courts anyway. [01:09:34.880 --> 01:09:46.880] Okay. So this isn't something to argue with the treasurer and the assessor. [01:21:29.880 --> 01:21:36.880] Plaintiffs alleged that officers searched the vehicle without permission or warrant or a probable cause to search.
