[01:25.000 --> 01:30.000] In Austin over the weekend, more than 2,000 inmates were evacuated from prisons in low-lying [01:30.000 --> 01:31.000] regions. [01:31.000 --> 01:35.000] Consider that just two years ago, the Brussels River had run dry in some places due to drought, [01:35.000 --> 01:37.000] but is now in an obviously saturated state. [01:37.000 --> 01:41.000] A flash flood watch is currently in effect for all of south central Texas, according [01:41.000 --> 01:45.000] to the National Weather Service, and a river flood warning is in effect for the Brussels [01:45.000 --> 01:46.000] River. [01:46.000 --> 01:53.000] A dozen fatalities have been a consequence of this flood. [01:53.000 --> 01:57.000] In what can be some of the most eyebrow-raising endorsements for presidential hopefuls in [01:57.000 --> 02:01.000] the United States, the president of Venezuela, Nicolas Maduro, came out and endorsed democratic [02:01.000 --> 02:06.000] socialist Bernie Sanders on Tuesday, calling him our revolutionary friend and implying [02:06.000 --> 02:10.000] that it is our broken political system as to the reason why Sanders is being marginalized. [02:10.000 --> 02:15.000] If that wasn't enough, North Korean state media, DPRK Today, published a column also [02:15.000 --> 02:19.000] released on Tuesday which came out and endorsed Republican newcomer Donald Trump, calling [02:19.000 --> 02:23.000] him a wise politician and stating that it turns out that Trump is not a rough-talking, [02:23.000 --> 02:28.000] screwy, ignorant candidate they say he is, but is actually a wise politician and pristine [02:28.000 --> 02:29.000] presidential candidate. [02:29.000 --> 02:33.000] As of yet, no authoritarian dictator has come out and endorsed Hillary Clinton, though [02:33.000 --> 02:37.000] some suspect this is due to many of them wanting to retain some level of credibility. [04:50.000 --> 04:56.000] Because everything those verses are talking about is the remaining solution that I believe [04:56.000 --> 05:01.000] we actually have to regaining control of our government. [05:01.000 --> 05:07.000] And it will have to begin and end with taking all of those bad boys out in the street [05:07.000 --> 05:10.000] and hanging them high for all the people to see. [05:10.000 --> 05:15.000] That's exactly what this is going to wind up taking the way things are going. [05:15.000 --> 05:21.000] Now, the thing I want to talk about tonight is going to be specifically directed at you folks [05:21.000 --> 05:26.000] in California and those of you that are in similar states where traffic infractions [05:26.000 --> 05:33.000] and the courts that handle them are civil administrative issues. [05:33.000 --> 05:37.000] Now, California has this problem where it can't make up its damned mind [05:37.000 --> 05:41.000] whether the courts are supposed to treat these as civil or criminal, [05:41.000 --> 05:45.000] at least when you're talking to the administrative hearing officer. [05:45.000 --> 05:51.000] Their third court of appeals has already set precedent for this no less than three times, [05:51.000 --> 05:57.000] and it has contradicted itself one of those times and gone the opposite way. [05:57.000 --> 06:06.000] So right now the score even for the appellate court on this issue is two for civil and one for criminal. [06:06.000 --> 06:11.000] So right now the preponderance of the case law says California traffic citations [06:11.000 --> 06:15.000] are civil administrative functions. [06:15.000 --> 06:20.000] Being civil, they of course have no criminal elements. [06:20.000 --> 06:26.000] Having no criminal elements, a seizure by a peace officer for the purpose of detaining you [06:26.000 --> 06:33.000] and arresting you for the purpose of issuing that citation is absolutely illegal. [06:33.000 --> 06:39.000] The problem is somehow the people of California that are listening to this show [06:39.000 --> 06:44.000] and fighting these tickets aren't seeming to get the issue here. [06:44.000 --> 06:48.000] So tonight I'm going to tell you about two articles that are on my blog, [06:48.000 --> 06:51.000] one of which I just posted yesterday or the day before, [06:51.000 --> 06:57.000] and that one is called Why California Should Be Allowed to Slide Off into the Ocean, [06:57.000 --> 07:02.000] and the one prior to that is civil infractions and what to do about them if your state has them. [07:02.000 --> 07:07.000] These two articles go hand in hand to deal specifically with the kinds of issues [07:07.000 --> 07:13.000] that are going on in California and other states where people are getting stopped by an officer [07:13.000 --> 07:18.000] and seized in their liberty without a warrant and without probable cause [07:18.000 --> 07:24.000] so that they can issue these revenue generating citations that are civil in nature. [07:24.000 --> 07:30.000] Now someone sent me a link to a video that deals with exactly one of these cases [07:30.000 --> 07:34.000] as recorded in one of these California courts, and it's all audio, [07:34.000 --> 07:38.000] but the things that are going on in that audio are absolutely infuriating [07:38.000 --> 07:43.000] when you know that the person speaking, the administrative hearing officer, [07:43.000 --> 07:52.000] is lying through their teeth and intentionally violating the rights of the accused in this matter. [07:52.000 --> 07:56.000] Now I listened to this video recording or this audio recording carefully. [07:56.000 --> 07:57.000] I made notes about it. [07:57.000 --> 08:00.000] I went and looked at the comments that were posted on YouTube about it, [08:00.000 --> 08:04.000] and as usual the morons and statists were crawling out of the woodwork, [08:04.000 --> 08:08.000] throwing all kinds of legal theories and, oh, you got what you deserved out of it [08:08.000 --> 08:14.000] without having a real clue at all about what the hell they're talking about. [08:14.000 --> 08:20.000] Now the article that I just posted basically gives you 10 specific questions or statements [08:20.000 --> 08:26.000] to be asking this administrative hearing officer through the course of these proceedings. [08:26.000 --> 08:31.000] And of course, as always, the very first thing out of your mouth [08:31.000 --> 08:36.000] when you go into one of these courts is I am here by special appearance [08:36.000 --> 08:39.000] to challenge the jurisdiction of these proceedings. [08:39.000 --> 08:46.000] Don't even say here until you have made this statement, okay? [08:46.000 --> 08:53.000] If you say anything at all prior to reserving your right of special appearance [08:53.000 --> 08:58.000] to challenge impersonal jurisdiction, you have waived it. [08:58.000 --> 09:01.000] Am I clear on that? [09:01.000 --> 09:04.000] So don't do it. [09:04.000 --> 09:08.000] The second thing that I would have been asking this administrative hearing officer, [09:08.000 --> 09:11.000] had I been the one in this case, would have been, [09:11.000 --> 09:17.000] are you presiding over this proceeding in the capacity of a sworn judicial officer [09:17.000 --> 09:20.000] of the state of California? [09:20.000 --> 09:25.000] Of course, the answer to that is either going to be a lie or no if they're telling the truth, [09:25.000 --> 09:27.000] because they're not. [09:27.000 --> 09:31.000] They are not real judicial officers. [09:31.000 --> 09:37.000] Now, for those of you that don't know, my blog is located at dowoflaw.wordpress.com. [09:48.000 --> 09:52.000] All right, number three of what I would have asked, [09:52.000 --> 09:56.000] is the nature of this matter alleged to be civil or criminal? [09:56.000 --> 09:58.000] I know the answer to this question, [09:58.000 --> 10:05.000] and the thing is that you should never ask a question you don't already know the answer to. [10:05.000 --> 10:06.000] Okay? [10:06.000 --> 10:08.000] Be aware of that. [10:08.000 --> 10:13.000] They're going to, of course, tell you whatever they want to tell you. [10:13.000 --> 10:15.000] If they tell you it's criminal, that's a lie. [10:15.000 --> 10:19.000] If they tell you it's civil, they are correct. [10:19.000 --> 10:25.000] But we're going to address what happens if they tell you it's criminal. [10:25.000 --> 10:32.000] Number four, by what lawful authority do you presume to act by both ignoring [10:32.000 --> 10:37.000] and overruling the judicial decisions of the California Third Court of Appeals, [10:37.000 --> 10:42.000] who has specifically ruled on no less than three separate occasions [10:42.000 --> 10:48.000] that traffic infractions in the state of California are not crimes? [10:48.000 --> 10:52.000] And we have the three individual cases right there in that, [10:52.000 --> 10:57.000] and I linked copies of those cases into the article with the links that you see there. [10:57.000 --> 10:59.000] All right? [10:59.000 --> 11:04.000] Number five, if this case is criminal, as you allege, [11:04.000 --> 11:07.000] now before I get into five, let me explain something else. [11:07.000 --> 11:14.000] In California, you are not allowed a jury trial in these cases, [11:14.000 --> 11:18.000] which if it is truly criminal, is a due process violation. [11:18.000 --> 11:23.000] Okay? And I'll get into the details when I ask five to exactly why that is. [11:23.000 --> 11:26.000] But you are not allowed a jury trial. [11:26.000 --> 11:30.000] This is all done completely administratively without a jury. [11:30.000 --> 11:33.000] When they tell you you have no right to a jury trial, [11:33.000 --> 11:38.000] that is a dead-bank guarantee this is not a criminal case. [11:38.000 --> 11:39.000] Okay? [11:39.000 --> 11:44.000] No matter what this idiot tells you, it's not a criminal case [11:44.000 --> 11:51.000] because you have a protected, guaranteed right to a jury in a criminal proceeding. [11:51.000 --> 11:53.000] How do we know this? [11:53.000 --> 11:55.000] Well, let's ask number five. [11:55.000 --> 11:58.000] If this case is criminal, as you allege, [11:58.000 --> 12:04.000] then I demand my inviolate right to a trial by jury as guaranteed and protected [12:04.000 --> 12:10.000] by Article 1, Section 16 of the California Constitution's Declaration of Rights, [12:10.000 --> 12:14.000] my rights. [12:14.000 --> 12:16.000] Number six. [12:16.000 --> 12:32.000] Furthermore, if this case is truly criminal, then I demand my inviolate right to be provided [12:32.000 --> 12:36.000] with assistance of counsel as guaranteed and protected by Article 1, [12:36.000 --> 12:41.000] Section 15 of the California Constitution's Declaration of Rights. [12:41.000 --> 12:43.000] Number seven. [12:43.000 --> 12:49.000] By what lawful authority do you presume to act in denying me in any fundamental right [12:49.000 --> 12:52.000] that is protected and guaranteed as inviolate [12:52.000 --> 12:57.000] by the provisions of the California Constitution's Declaration of Rights? [12:57.000 --> 12:59.000] Now, of course, these questions are all presuming [12:59.000 --> 13:03.000] that the administrative hearing officer is continuing to lie to you [13:03.000 --> 13:10.000] and circumvent your right of due process and deny you these rights that the California [13:10.000 --> 13:15.000] Constitution's Declaration of Rights says are inviolate. [13:15.000 --> 13:20.000] They cannot take them away from you. [13:20.000 --> 13:26.000] Not if this is a criminal proceeding like they're trying to tell you that it is. [13:26.000 --> 13:29.000] These things go hand in hand. [13:29.000 --> 13:32.000] You tell me I'm not entitled to a jury trial in this case. [13:32.000 --> 13:35.000] Therefore, this case cannot possibly be criminal [13:35.000 --> 13:42.000] because I have an absolutely guaranteed protected right to a jury if it is criminal. [13:42.000 --> 13:50.000] I have an absolute guaranteed right to assistance of counsel if it is criminal. [13:50.000 --> 13:55.000] I can find no authority whatsoever for you or any other judge in this state [13:55.000 --> 14:01.000] to throw the Declaration of Rights out the window and deny me access to it. [14:01.000 --> 14:07.000] So by what authority do you pretend to do so? [14:07.000 --> 14:10.000] Number eight, objection. [14:10.000 --> 14:15.000] No judge in any court operating under the laws and Constitution of the state of California [14:15.000 --> 14:21.000] has any more authority to ignore or deny the accused in violent protections and guarantees [14:21.000 --> 14:26.000] as written into the California Constitution's Declaration of Rights than you do, [14:26.000 --> 14:30.000] which is to say none at all. [14:30.000 --> 14:35.000] Nine, I must inform you that your actions in this proceeding are not only criminal [14:35.000 --> 14:39.000] and civilly actionable, but also border on sedition and treason, [14:39.000 --> 14:49.000] and therefore I hereby move that you be disqualified and remove yourself from these proceedings. [14:49.000 --> 14:53.000] Ten, if you refuse to remove yourself, you will leave me with no alternative [14:53.000 --> 14:57.000] but to file criminal charges in a civil rights violation suit [14:57.000 --> 15:03.000] against you personally for your actions here today. [15:03.000 --> 15:10.000] Now, you have a protected right to say and do every single one of those things right there. [15:10.000 --> 15:11.000] Okay? [15:11.000 --> 15:13.000] Every one of them. [15:13.000 --> 15:17.000] The California Constitution says so. [15:17.000 --> 15:24.000] No court, no judge, no one in California has the authority to ignore the Constitution [15:24.000 --> 15:28.000] that gave them the power to act in the first place. [15:28.000 --> 15:30.000] None of them. [15:30.000 --> 15:33.000] You need to stop acting like they do. [15:33.000 --> 15:39.000] You need to stop letting them act like they do. [15:39.000 --> 15:46.000] Now, most of the comments on this on the YouTube channel were just blatantly outrageous [15:46.000 --> 15:50.000] as far as the statist attitude of you got what you deserve, man. [15:50.000 --> 15:52.000] You think you know more than the judge, man. [15:52.000 --> 15:54.000] In this particular case, the kid did. [15:54.000 --> 15:58.000] He just didn't know enough to control him. [15:58.000 --> 16:04.000] He was right, but he wasn't right with authority. [16:04.000 --> 16:09.000] He couldn't and didn't, if he could, cite any authority [16:09.000 --> 16:13.000] for his demands of this administrative hearing officer. [16:13.000 --> 16:16.000] Remember, this guy is not a judge. [16:16.000 --> 16:20.000] None of these people conducting these cases are judges. [16:20.000 --> 16:23.000] There's nothing judicial about it. [16:23.000 --> 16:28.000] That means they have zero immunity for what they do [16:28.000 --> 16:38.000] because everything they're doing is administrative, i.e., it is magisterial, not judicial. [16:38.000 --> 16:42.000] Now, you couple these ten statements and questions [16:42.000 --> 16:47.000] in with the seven interrogatories in your discovery for the purpose of your case, [16:47.000 --> 16:51.000] and you've got this administrative hearing officer locked into a corner [16:51.000 --> 16:54.000] he is never easily going to get out of. [22:59.000 --> 23:03.000] The point of the interrogatories is to show that the warrantless detention [23:03.000 --> 23:07.000] or arrest of the individual by the officer was both completely unlawful [23:07.000 --> 23:12.000] and illegal because there could never have been any reasonable suspicion [23:12.000 --> 23:17.000] or probable cause associated with the warrantless seizure of the accused [23:17.000 --> 23:23.000] for a civil infraction, making anything that was obtained or discovered [23:23.000 --> 23:28.000] by the officer during the detention or arrest for any purpose [23:28.000 --> 23:32.000] inadmissible under the Fruit of the Poison Tree doctrine. [23:32.000 --> 23:36.000] Therefore, there is no evidence or testimony that can be made, [23:36.000 --> 23:41.000] no proof that can be offered, thus no case of controversy before the court [23:41.000 --> 23:43.000] or, in this case, the tribunal. [23:43.000 --> 23:48.000] No case or controversy, no jurisdiction of any kind. [23:48.000 --> 23:51.000] That's the simple logic of the whole thing. [23:51.000 --> 23:55.000] In stateless civil infractions, this is your case. [23:55.000 --> 23:58.000] This is how you control the hearing officer. [23:58.000 --> 24:02.000] This is how you get the evidence that the prosecutor otherwise is going to [24:02.000 --> 24:07.000] attempt to hide if there's a prosecutor at all or that the judge is going to [24:07.000 --> 24:12.000] attempt to ignore in order to get away with falsely convicting you [24:12.000 --> 24:14.000] and taking your money. [24:14.000 --> 24:20.000] So you folks in California, Washington, and Oregon and other places where [24:20.000 --> 24:25.000] these are civil infractions rather than criminal misdemeanors, [24:25.000 --> 24:30.000] this is how you put up a defense and this is how you control the proceeding. [24:30.000 --> 24:37.000] It shouldn't be difficult as long as you do it and don't back down from doing it. [24:37.000 --> 24:38.000] Okay? [24:38.000 --> 24:41.000] You're the only one that can protect your rights. [24:41.000 --> 24:43.000] You're the only one that wants to protect your rights. [24:43.000 --> 24:45.000] Trust me on that. [24:45.000 --> 24:50.000] Your money is too important to them for them to care whether your rights are [24:50.000 --> 24:54.000] protected or not because if they cared about your rights, [24:54.000 --> 24:57.000] this would have never been a law. [25:25.000 --> 25:30.000] I was told by these guys in colorful soccer shirts like red, [25:30.000 --> 25:35.000] white and blue and purple and green striped shirts on bicycles that came up [25:35.000 --> 25:40.000] real fast and aggressive, give me your ID. [25:40.000 --> 25:46.000] We had a call of domestic violence and give me your ID and about five seconds [25:46.000 --> 25:53.000] later they pulled my shirt over my head and my arms were in it and my head was [25:53.000 --> 25:59.000] in it and they used my hands that were tied up in the shirt to swing it towards [25:59.000 --> 26:02.000] one officer and they said, oh, he's just hit me in the face. [26:02.000 --> 26:06.000] He's just hit me in the face and then they pulled the pepper spray out and then [26:06.000 --> 26:12.000] they sprayed me and my wife and said, no, no, what are you doing? [26:12.000 --> 26:14.000] Who are you? [26:14.000 --> 26:15.000] What are you doing? [26:15.000 --> 26:20.000] And they sprayed her and then they chased me and then they reckoned me to [26:20.000 --> 26:25.000] ground and took us in for four nights jail without ever giving us Miranda [26:25.000 --> 26:27.000] rights or explaining anything to them. [26:27.000 --> 26:29.000] I never gave them any statement. [26:29.000 --> 26:30.000] My wife gave them a statement. [26:30.000 --> 26:32.000] Her statement was, no, he's my husband. [26:32.000 --> 26:34.000] I wasn't trying to get away from him. [26:34.000 --> 26:38.000] No, we weren't in a domestic violence situation. [26:38.000 --> 26:39.000] This is a big mistake. [26:39.000 --> 26:47.000] Apparently someone had seen us at a crosswalk and had my wife, had my arm [26:47.000 --> 26:51.000] around her and she stepped down to the curb because she was looking at her [26:51.000 --> 26:54.000] cell phone and I pulled her back up with my shoulder. [26:54.000 --> 26:56.000] The woman said, is he controlling you? [26:56.000 --> 26:58.000] Was he violating and abusing you? [26:58.000 --> 27:01.000] Do you want me to call 911 and get you away from him? [27:01.000 --> 27:02.000] My wife said, no. [27:02.000 --> 27:10.000] And I said, we've been happily married for a decade and this is not what you [27:10.000 --> 27:12.000] are saying it is. [27:12.000 --> 27:20.000] I'm offended that you bumped into our personal business and her husband [27:20.000 --> 27:24.000] behind her didn't buzz or wasn't affected by what I said and the tone that [27:24.000 --> 27:26.000] I said because it was pretty respectful. [27:26.000 --> 27:30.000] I might have even said with all due respect ma'am, but she dialed 911 [27:30.000 --> 27:36.000] apparently and these bicycle cops, I guess, never identified themselves as [27:36.000 --> 27:38.000] law enforcement agents or showed any ID. [27:38.000 --> 27:43.000] It was a dark alley and they started beating me after five seconds. [27:43.000 --> 27:47.000] Do you have video and audio that will prove that? [27:47.000 --> 27:51.000] Were they wearing body cams and body microphones? [27:51.000 --> 27:54.000] I believe they were not at all. [27:54.000 --> 27:56.000] Then you might have a problem. [27:56.000 --> 28:00.000] You need to check and see if there's any sort of security camera footage that [28:00.000 --> 28:04.000] covers that alley, any business may have it monitored, anybody's got a security [28:04.000 --> 28:09.000] system on their balcony or whatever that monitors it, you need to be looking for [28:09.000 --> 28:14.000] video sources because without that video source in Florida, Florida is one of [28:14.000 --> 28:17.000] those places where the cop is always right no matter how wrong he is and no [28:17.000 --> 28:19.000] matter what there is to prove it. [28:19.000 --> 28:23.000] Without that video, this is going to be not an uphill battle, this is going to [28:23.000 --> 28:27.000] be Skell and Everest on the steep side with no rope. [28:27.000 --> 28:29.000] Okay. [28:29.000 --> 28:32.000] My wife and I, of course, were in jail. [28:32.000 --> 28:37.000] Yeah, the problem is you can't really vindicate each other as witnesses because [28:37.000 --> 28:41.000] both of you were being arrested and treated that way. [28:41.000 --> 28:45.000] Therefore, both of you are guilty in everybody's eyes for anything they want to [28:45.000 --> 28:49.000] say you're guilty for until there's countermanding evidence that they can't [28:49.000 --> 28:51.000] refute. [28:53.000 --> 28:57.000] When we retained an attorney, when the attorney said they have a witness already [28:57.000 --> 29:02.000] that's willing to say that the officer treated us like the officers were dicks [29:02.000 --> 29:03.000] the whole time. [29:03.000 --> 29:10.000] Yeah, but the thing is, okay, the attitude is not supporting your version of the [29:10.000 --> 29:11.000] facts. [29:11.000 --> 29:16.000] Saying that the officers were so-called dicks for the term of the altercation is [29:16.000 --> 29:21.000] not testimony that, yeah, the officers are dicks for five seconds and then they [29:21.000 --> 29:24.000] jump on the guy and start beating and tasing him. [29:24.000 --> 29:25.000] You see the difference? [29:25.000 --> 29:27.000] Yeah, yeah. [29:27.000 --> 29:28.000] Okay. [29:28.000 --> 29:29.000] Exactly. [36:06.000 --> 36:12.000] If the paper is using the report as its source, then you can't go after the [36:12.000 --> 36:16.000] paper because they're printing unless, of course, the facts the paper printed [36:16.000 --> 36:20.000] are not the same facts that are in the report. [36:20.000 --> 36:24.000] Now, if they stuck straight to what's in the report, you can't touch the paper. [36:24.000 --> 36:27.000] They're using an official document as their source. [36:27.000 --> 36:32.000] They're not liable for anything. [36:32.000 --> 36:33.000] Okay. [36:33.000 --> 36:42.000] And another thing is what about in order for me to, like, go back to continue [36:42.000 --> 36:44.000] my job after my short vacation. [36:44.000 --> 36:48.000] Well, good luck with that if they're charging you with felonies. [36:48.000 --> 36:52.000] What's going to happen is if your company or business finds out that you've [36:52.000 --> 36:57.000] been charged with a bunch of felonies, they're likely to terminate you ASAP. [36:59.000 --> 37:02.000] Now, that's something you can sue over, but that ain't going to help you with [37:02.000 --> 37:05.000] that in the meantime, and it may prevent you from being able to complete this [37:05.000 --> 37:09.000] case because you can't pay the attorney. [37:09.000 --> 37:15.000] This is how our justice system has set up the people to fail in their defense [37:15.000 --> 37:17.000] against it. [37:17.000 --> 37:19.000] Yeah. [38:40.000 --> 38:42.000] I've already paid a bail bond to get out. [38:42.000 --> 38:43.000] No, no, no. [38:43.000 --> 38:45.000] You're not following what I'm telling you. [38:45.000 --> 38:48.000] You paid a bail bond to get out of jail. [38:48.000 --> 38:52.000] You're going to pay another one to leave the state. [38:52.000 --> 38:57.000] If you don't, I will be most surprised. [38:57.000 --> 38:58.000] Okay. [38:58.000 --> 38:59.000] Well, when would that take effect? [38:59.000 --> 39:01.000] I do not know that. [39:01.000 --> 39:04.000] I don't know California law like I know Texas law. [39:04.000 --> 39:09.000] But I do know that normally they're not going to let people charged with [39:09.000 --> 39:15.000] felonies just up and leave the state just because they don't actually live there. [39:15.000 --> 39:18.000] My attorneys told me that I'm free to go now. [39:18.000 --> 39:19.000] Okay. [39:18.000 --> 39:22.000] Well, if your attorney's telling you that, then that's great. [39:22.000 --> 39:24.000] Okay. [39:24.000 --> 39:25.000] Okay. [39:25.000 --> 39:28.000] So would you advise post-haste? [39:28.000 --> 39:33.000] I do what my attorneys have advised me, which is to return to my home. [39:33.000 --> 39:37.000] Well, again, I don't know whether post-haste is how you want to do it or not. [39:37.000 --> 39:40.000] Did they tell you to do it post-haste? [39:40.000 --> 39:41.000] No, they did not. [39:41.000 --> 39:44.000] Well, then I wouldn't worry about how fast I'd do it. [39:44.000 --> 39:47.000] I would just double-check and make sure that I can do it [39:47.000 --> 39:54.000] and not have a felony fugitive charge levied against me for doing it. The problem with entering a plea is it removes several rights from your availability. [51:29.000 --> 51:33.000] It removes your ability to challenge impersonal jurisdiction. [51:33.000 --> 51:38.000] It waives your right to challenge the form and substance of the complaint and the charging instrument. [51:38.000 --> 51:42.000] And it waives your right to notice of the allegations against you. [51:42.000 --> 51:51.000] In other words, it is the one of the three most important rights you have, you just killed a dead by entering that plea. [51:51.000 --> 51:55.000] That is why we don't ever do that. [51:55.000 --> 52:03.000] I'm not trying to make you feel bad. I'm just instructing you that this is why we don't do it and this is what you're doing by doing it. [52:03.000 --> 52:07.000] Okay. Because if you don't understand this, you're going to keep doing it. [52:07.000 --> 52:08.000] Yeah. [52:08.000 --> 52:15.000] All right. So don't ever enter a plea. No matter what they tell you, don't enter a plea. [52:15.000 --> 52:26.000] Do not refuse to enter. You simply ask the judge, is the court willing to demand an unconscionable plea of the accused? [52:26.000 --> 52:30.000] And he's going to go, well, what do you mean by an unconscionable plea? [52:30.000 --> 52:37.000] Well, judge, it is my understanding that the entering of a plea waives fundamental rights that I am not prepared to waive. [52:37.000 --> 52:48.000] Nor do I consent in any manner for this court to waive them on my behalf and deprive me of those rights when the court is required to protect them. [52:48.000 --> 52:57.000] And those are the three rights you're waiving and that's the three rights they would be waiving trying to enter one on your behalf because they have not complied with the Code of Criminal Procedure at all. [52:57.000 --> 53:00.000] Has anyone served you with a criminal complaint? [53:00.000 --> 53:01.000] No. [53:01.000 --> 53:06.000] Then what are you pleading to? [53:06.000 --> 53:09.000] I guess just intimidation. [53:09.000 --> 53:14.000] Pretty much because there is no complaint. There is no charge. There is no complaint. [53:14.000 --> 53:22.000] There is no jurisdiction in the court to demand you do anything, much less enter a plea. [53:22.000 --> 53:23.000] Okay. [53:23.000 --> 53:31.000] So what they trick you into doing is to entering a plea to the citation, which is completely denying your right of due process. [53:31.000 --> 53:36.000] But if you're doing that voluntarily, it's no skin off their nose. [53:36.000 --> 53:42.000] They just don't have to tell you that you're doing it voluntarily. [53:42.000 --> 53:47.000] See, everything about this system is just like the rest of it. [53:47.000 --> 53:53.000] It's built to corruptly deprive you of rights by not telling you anything. [53:53.000 --> 54:03.000] See, the court, just like the officer, was required to conduct a 15.17 proceeding and read you your rights, [54:03.000 --> 54:12.000] which you could only do once a valid complaint existed or you made your initial appearance on the citation. [54:12.000 --> 54:13.000] Okay? [54:13.000 --> 54:15.000] All right. I understand. [54:15.000 --> 54:16.000] They didn't do that. [54:16.000 --> 54:20.000] What do I do? Do I just got to pay them? How do I get out of this now? [54:20.000 --> 54:28.000] No, you can still fight it, but now your fight becomes a whole lot harder because now you have to fight on merits. [54:28.000 --> 54:32.000] You have to actually use the statutes to prove you're right and they're wrong. [54:32.000 --> 54:47.000] Fortunately, in a speeding case, it's entirely possible to do exactly that using the very statutes they're using because they aren't using it correctly. [54:54.000 --> 55:02.000] The other is 545.351 itself, wherein the only way to commit an act of speeding is to do so in such a manner [55:02.000 --> 55:09.000] that you fail to exercise due care that would allow you to maintain control of your vehicle [55:09.000 --> 55:17.000] and not avoid having a collision with another person or vehicle already lawfully upon or entering the highway. [55:17.000 --> 55:19.000] Were you in a collision? [55:19.000 --> 55:21.000] No, negative. [55:21.000 --> 55:25.000] Okay. So what are you going to make the officer testify to on the stand? [55:25.000 --> 55:32.000] Officer, can you please describe the make and model of the vehicle you're alleging that I hit or that I collided with? [55:32.000 --> 55:33.000] What? [55:33.000 --> 55:35.000] And he's going to go, there was no collision. [55:35.000 --> 55:43.000] Well, officer, can you please describe the biological sex of the person that you're alleging that I collided with? [55:43.000 --> 55:46.000] You didn't hit anybody. [55:46.000 --> 55:48.000] Well, then officer, I'm confused. [55:48.000 --> 55:50.000] How then can you make an allegation of speeding? [55:50.000 --> 55:53.000] Oh, well, you were going faster than the posted speed limit. [55:53.000 --> 55:54.000] Objection, officer. [55:54.000 --> 55:56.000] That's an incomplete answer. [55:56.000 --> 56:07.000] The statute requires my failure to exercise due care so as to fail to avoid a collision with another person or vehicle on the highway. [56:07.000 --> 56:13.000] You just testified those elements didn't exist and don't exist. [56:13.000 --> 56:17.000] How then could you charge me with speeding? [56:17.000 --> 56:19.000] Yes, absolutely understand. [56:19.000 --> 56:20.000] That's great. [56:39.000 --> 56:41.000] You need to read that. [56:41.000 --> 56:47.000] Every element in there is something they must assert in the complaint and they won't. [56:47.000 --> 56:53.000] It will not be in the complaint if they ever generate one, and you need to demand that they do so. [56:53.000 --> 57:05.000] And if they try to prosecute you using just the citation, you have to object because the statute they're attempting to use is 27.14D of the Code of Criminal Procedure, [57:05.000 --> 57:13.000] which only authorizes them to use that citation if and only if you and the prosecutor have mutually agreed [57:13.000 --> 57:24.000] and signed a written waiver and filed it with the court saying you waived the requirement of a signed and sworn complaint, which you haven't done. [57:24.000 --> 57:31.000] So they cannot use the citation alone unless you do that. [57:31.000 --> 57:32.000] So don't do that. [57:32.000 --> 57:36.000] Don't sign anything they put in front of you, ever. [57:36.000 --> 57:37.000] Okay. [57:37.000 --> 57:39.000] Let me say this real quick. [57:39.000 --> 57:45.000] This is in two weeks, the court date. Can I reschedule this for later so that I can get educated before I go to the end? [57:45.000 --> 57:50.000] Well, you can try. Whether or not you can or not, I don't know. [57:50.000 --> 57:56.000] The problem is the only way that you can get that type of extension is to file a motion for continuance, [57:56.000 --> 58:00.000] and you have to state a legal basis for requesting the continuance. [58:00.000 --> 58:07.000] That continuance must be signed under oath and penalty of perjury to be valid. [58:07.000 --> 58:12.000] Texas requires all motions for continuance to be verified. [58:12.000 --> 58:13.000] Okay? [58:13.000 --> 58:16.000] So you won't get a continuance unless you do that. [58:16.000 --> 58:23.000] Now what you can do to avoid that is go talk directly to the prosecutor three or four days before trial [58:23.000 --> 58:30.000] and tell them you're requesting a reset because of some other issue. [58:30.000 --> 58:31.000] Okay. [58:31.000 --> 58:35.000] And they can set it for a different date without you having to file for a continuance. [01:08:19.000 --> 01:08:22.000] They're basically doing the same thing the casinos in Vegas [01:08:22.000 --> 01:08:24.000] and Atlantic City do. [01:08:24.000 --> 01:08:28.000] They are playing the odds, the odds that either A, [01:08:28.000 --> 01:08:33.000] you don't know how to appeal and will fail to perfect it in a timely manner [01:08:33.000 --> 01:08:35.000] in accordance with their procedures, [01:08:35.000 --> 01:08:41.000] two, you will get exasperated and give up and not attempt an appeal at all, [01:08:41.000 --> 01:08:45.000] or three, you will get an attorney that will screw you over [01:08:45.000 --> 01:08:49.000] and throw you under the bus and not help you while also taking your money, [01:08:49.000 --> 01:08:51.000] which is part of what the system wants to do, [01:08:51.000 --> 01:08:53.000] is enrich itself at your expense, [01:08:53.000 --> 01:08:59.000] or four, some combination of all of the above, okay? [01:08:59.000 --> 01:09:01.000] The thing is that I've already learned from you and others [01:09:01.000 --> 01:09:03.000] that you don't get a bar association. [01:09:03.000 --> 01:09:05.000] They're just going to work a deal. [01:09:05.000 --> 01:09:08.000] What I'm trying to do is, I think you just mentioned it, to file for an appeal. [01:09:08.000 --> 01:09:12.000] I think that's where my studies haven't worked. [01:09:12.000 --> 01:09:18.000] Right, and the only way you get an appeal is to go through the trial and lose. [01:09:18.000 --> 01:09:21.000] Okay. [01:09:21.000 --> 01:09:22.000] I'm listening. [01:09:22.000 --> 01:09:23.000] That's it. [01:09:40.000 --> 01:09:45.000] So if you have to lose before an appeal becomes an issue, [01:09:45.000 --> 01:09:51.000] but you will lose 99.9% of the time in these courts, you will lose, [01:09:51.000 --> 01:09:55.000] especially if it's a bench trial, okay? [01:09:55.000 --> 01:09:59.000] And the reason for that is is because they will block your every effort [01:09:59.000 --> 01:10:05.000] to present the correct information to the jury to prove that their charges are bogus [01:10:05.000 --> 01:10:10.000] or the jury will be picked that is the dumbest in the county or the municipality [01:10:10.000 --> 01:10:14.000] so that they will never understand why the charges are bogus [01:10:14.000 --> 01:10:16.000] and find you guilty anyway. [01:10:16.000 --> 01:10:20.000] You have to remember that going to trial in these cases these days is for one purpose [01:10:20.000 --> 01:10:21.000] and one purpose only. [01:10:21.000 --> 01:10:26.000] Even though you have the right to due process at every stage of every proceeding, [01:10:26.000 --> 01:10:29.000] you're not going to get it the way the system is set up. [01:10:29.000 --> 01:10:33.000] The lower courts are designed to deprive you of it at every turn. [01:10:33.000 --> 01:10:39.000] So you have to make a good record that shows each and every one of those deprivations. [01:10:39.000 --> 01:10:45.000] You have to get all of your arguments that would prove the charges false or insufficient [01:10:45.000 --> 01:10:50.000] or whatever through your objections, your testimony, your evidence, your cross-examination, [01:10:50.000 --> 01:10:55.000] and your transcript on the appeal and the pleadings that you filed [01:10:55.000 --> 01:10:59.000] and all that goes to the appellate court for review. [01:10:59.000 --> 01:11:04.000] And you have to preserve those issues for them to review those issues [01:11:04.000 --> 01:11:07.000] and that's the way you do it depending upon whether it's a court of record [01:11:07.000 --> 01:11:10.000] or a court of no record, how you do it varies. [01:11:10.000 --> 01:11:12.000] But that's really what it is. [01:11:12.000 --> 01:11:14.000] Go ahead. [01:11:14.000 --> 01:11:19.000] So you are saying that I have to go through the hearing and then the trial [01:11:19.000 --> 01:11:22.000] and then to take it to the appellate court for the appeal? [01:11:22.000 --> 01:11:25.000] In almost every case that will be true. [01:11:25.000 --> 01:11:29.000] It will be the rare thing when they dismiss without a trial. [01:11:29.000 --> 01:11:31.000] But here that's not all that rare. [01:11:31.000 --> 01:11:33.000] I've gotten lots of them. [01:11:33.000 --> 01:11:36.000] But the fact is is I'm using their own procedures against them. [01:11:36.000 --> 01:11:39.000] I know them better than they do. [01:11:39.000 --> 01:11:41.000] And when they don't follow their procedures [01:11:41.000 --> 01:11:45.000] or I catch them red-handed doing something that's outright illegal [01:11:45.000 --> 01:11:49.000] by avoiding those procedures, they don't really have a choice. [01:11:49.000 --> 01:11:50.000] They go to court now. [01:11:50.000 --> 01:11:54.000] They're totally hosed, not just in losing the case that they're charging you with, [01:11:54.000 --> 01:12:03.000] but also putting onto the record that they committed crimes themselves to get you there. [01:12:03.000 --> 01:12:08.000] So learning the process that they're required to follow has its advantages. [01:12:08.000 --> 01:12:13.000] Believe me, it does. [01:12:13.000 --> 01:12:17.000] Because I was trying to see if there's a way that you can just end that. [01:12:17.000 --> 01:12:19.000] Almost never will that happen. [01:12:19.000 --> 01:12:24.000] They don't get any money by ending it. [01:12:24.000 --> 01:12:27.000] Well, not to say they choose to, but yet the evidence that you know you're not. [01:12:27.000 --> 01:12:29.000] No, no, no, you're misunderstanding. [01:12:29.000 --> 01:12:33.000] Until you go to trial, there is no evidence of anything, [01:12:33.000 --> 01:12:36.000] at least not in relation to the charge against you. [01:13:01.000 --> 01:13:04.000] But as far as the allegations against you, [01:13:04.000 --> 01:13:13.000] there is not yet any evidence in the record up until the point of an actual trial. [01:13:13.000 --> 01:13:14.000] Okay. [01:13:14.000 --> 01:13:19.000] Now where can I further my education into the court procedures? [01:13:19.000 --> 01:13:21.000] Because I've been seeing certain things here. [01:13:21.000 --> 01:13:28.000] Well, every state has their procedures published in their codes and statutes. [01:13:28.000 --> 01:13:31.000] For instance, here in Texas, it's the Code of Criminal Procedure for Criminal. [01:13:31.000 --> 01:13:34.000] It's the Code of Civil Procedure for Civil. [01:13:34.000 --> 01:13:38.000] And it's a combination of both of them when the Code of Criminal Procedure [01:13:38.000 --> 01:13:44.000] doesn't cover an aspect of procedure that is required to provide due process [01:13:44.000 --> 01:13:46.000] but is only found in the civil procedure, [01:13:46.000 --> 01:13:48.000] then you jump from the Code of Criminal Procedure [01:13:48.000 --> 01:13:51.000] to the Code of Civil Procedure for that purpose. [01:13:51.000 --> 01:13:55.000] So it's a mixture of the criminal and civil procedure codes, [01:13:55.000 --> 01:13:58.000] and then it's a mixture of any specialized codes [01:13:58.000 --> 01:14:02.000] that are directed at the particular type of court you may be in. [01:14:02.000 --> 01:14:06.000] It's studying whatever the local procedures of court might actually be, [01:14:06.000 --> 01:14:12.000] because a lot of courts have their own procedures they use that have to conform to the law, [01:14:12.000 --> 01:14:16.000] but where the law says they can vary, they might. [01:14:16.000 --> 01:14:17.000] Okay. [01:14:17.000 --> 01:14:19.000] And so on and so forth. [01:14:19.000 --> 01:14:21.000] So those are the kinds of things you've got to look at. [01:14:21.000 --> 01:14:26.000] And also you want to thoroughly investigate the actual penal statutes [01:14:26.000 --> 01:14:31.000] that deal with any particular allegation they've made. [01:14:31.000 --> 01:14:32.000] All right. [01:14:32.000 --> 01:14:37.000] And then last but not least, by a long shot, is to study any case law [01:14:37.000 --> 01:14:44.000] relevant to those types of cases and those particular statutes. [01:14:44.000 --> 01:14:50.000] Are you speaking in regards to, let's say, if they stop you for no plate? [01:14:50.000 --> 01:14:51.000] Yeah. [01:14:51.000 --> 01:14:55.000] Then what you would want to look for is case law dealing with that section of statute [01:14:55.000 --> 01:14:57.000] that deals with license plates [01:14:57.000 --> 01:15:02.000] and any case opinions that decided that this person or that person can't be charged [01:15:02.000 --> 01:15:06.000] and this person or that person can be charged. [01:15:06.000 --> 01:15:08.000] So you're saying use their own statutes against them [01:15:08.000 --> 01:15:11.000] as well as case laws that have already existed? [01:15:11.000 --> 01:15:13.000] Absolutely. [01:15:13.000 --> 01:15:14.000] Okay, then. [01:15:14.000 --> 01:15:19.000] Well, I already have an affidavit of fact written out, stamped, [01:15:19.000 --> 01:15:22.000] and it has Supreme Court ruling as well as other... [01:15:22.000 --> 01:15:28.000] Okay, which is going to do what for you? [01:15:28.000 --> 01:15:32.000] See, the problem most people have, and you ought to pardon the term, [01:15:32.000 --> 01:15:34.000] but this is why I use it. [01:15:34.000 --> 01:15:39.000] The affidavit of truth is a patronet myth, and here's why. [01:15:39.000 --> 01:15:45.000] An affidavit does not stand alone, ever. [01:15:45.000 --> 01:15:48.000] It is a sworn document, true, [01:15:48.000 --> 01:15:55.000] but it is not evidence until it is presented in a court as evidence. [01:15:55.000 --> 01:15:56.000] Yes. [01:15:56.000 --> 01:16:01.000] Well, the only way to do that is for the person making the affidavit to take the stand [01:16:01.000 --> 01:16:04.000] and testify to all the facts in it. [01:47:19.000 --> 01:47:26.000] That's the difference between an equity owner and a legal owner, okay? [01:47:26.000 --> 01:47:32.000] So what the certificate of title is is exactly the same thing for a car [01:47:32.000 --> 01:47:36.000] that a mortgage note is for a house, okay? [01:47:36.000 --> 01:47:39.000] It's exactly the same thing. [01:47:39.000 --> 01:47:43.000] What was supposed to happen with the certificate of title was it was issued [01:47:43.000 --> 01:47:48.000] as long as the vehicle was purchased through a loan, [01:47:48.000 --> 01:47:52.000] and that was done so that the state would have the necessary information [01:47:52.000 --> 01:47:56.000] to make sure that the two parties honored the contract [01:47:56.000 --> 01:48:02.000] and that the lien holder and the borrower's rights were protected. [01:48:02.000 --> 01:48:06.000] Once the lien was paid off, [01:48:06.000 --> 01:48:13.000] the certificate of title was supposed to be traded back in for the actual deed to the vehicle, [01:48:13.000 --> 01:48:18.000] which would be the MCO or MSO, but they don't do it that way. [01:48:18.000 --> 01:48:26.000] Instead, they microfiche the MCO and MSO and then shred and burn the original. [01:48:26.000 --> 01:48:32.000] In other words, they are making it where it is now legally impossible [01:48:32.000 --> 01:48:38.000] to ever have the original ownership papers for a car, okay? [01:48:38.000 --> 01:48:41.000] It's fraud through and through. [01:48:41.000 --> 01:48:47.000] But you're going to the DMV to do something the DMV doesn't actually have any control over [01:48:47.000 --> 01:48:53.000] because that's the way the operation of the state law requires it to be done, [01:48:53.000 --> 01:49:01.000] even though that law violates proper business practices under contracts. [01:50:25.000 --> 01:50:28.000] And the purpose of it was what the people thought about it. [01:50:28.000 --> 01:50:29.000] Did they agree with that? [01:50:29.000 --> 01:50:35.000] Did they like that or did they not like that type of intrusion in their life [01:50:35.000 --> 01:50:39.000] concerning voting, whatever, whatever they were doing. [01:50:39.000 --> 01:50:43.000] But then I presented the idea of how about this? [01:50:43.000 --> 01:50:47.000] How about a petition being put together where people who have a perfect record, [01:50:47.000 --> 01:50:51.000] haven't done anything, haven't engaged in any type of criminal activity, [01:50:51.000 --> 01:50:53.000] have a perfect traveling record, let's call it that, [01:50:53.000 --> 01:50:57.000] a perfect traveling record or a driving record, one or the other. [01:50:57.000 --> 01:50:59.000] How about this? [01:50:59.000 --> 01:51:02.000] Put something on the bill where a person who has a perfect record, [01:51:02.000 --> 01:51:06.000] hasn't broken any laws and has been very duly responsible on the highway [01:51:06.000 --> 01:51:09.000] to be able to exercise their right of travel [01:51:09.000 --> 01:51:16.000] versus having to be forced to contract as a driver to be driving privileged [01:51:16.000 --> 01:51:20.000] and they liked the idea and they said, okay, let me give you some information on it. [01:51:20.000 --> 01:51:21.000] That sounds really good. [01:51:21.000 --> 01:51:25.000] So what I'm going to do here in the state of Oregon is see if they can go around [01:51:25.000 --> 01:51:29.000] and have a bunch reformulated, get it done correctly, go around to the DMVs [01:51:29.000 --> 01:51:32.000] and have a petition that people sign this petition where they think about [01:51:32.000 --> 01:51:36.000] the right to be able to exercise their right to travel [01:51:36.000 --> 01:51:40.000] versus having to be forced to contract as a driver as a privilege. [01:51:40.000 --> 01:51:46.000] Well, the thing is the statutes in the state you're in already do that. [01:51:46.000 --> 01:51:51.000] They're just not written to make it easy to show or to understand. [01:51:51.000 --> 01:51:57.000] Right. Well, this is to make people aware because 99% of the people [01:51:57.000 --> 01:51:59.000] don't know they have a right of travel.
