[01:03.480 --> 01:08.520] In recent news, it seems that this presidential campaign cycle has sparked more than 185,000 [01:08.520 --> 01:13.440] citizenship applications submitted in the final three months of 2015, according to government [01:13.440 --> 01:19.680] numbers, which is roughly a 14% year-to-year increase, and around 15,000 more voter registrations [01:19.680 --> 01:25.120] were submitted compared to the same three-month period in 2011, leading into the 2012 presidential [01:25.120 --> 01:26.120] campaign cycle. [01:26.120 --> 01:30.880] Typically, the rate of citizenship applications and voter registrations historically increases [01:30.880 --> 01:34.760] in the months leading up to a presidential election, as various state deadlines draw [01:34.760 --> 01:39.060] into a close, and even though the latest statistics from the U.S. Citizenship and Immigration [01:39.060 --> 01:43.280] Services on citizenship applications for the first quarter of the year aren't expected [01:43.280 --> 01:47.880] until June, this year's increased activity is suspected to be as a result of the Republicans' [01:47.880 --> 01:57.600] most likely front-runner candidate Donald Trump's heavy anti-illegal immigration rhetoric. [01:57.600 --> 02:02.960] The Jama'at-e-Islami party leader, Murtiur Rahman Mizami, was hung today for genocide [02:02.960 --> 02:08.320] and other crimes committed during the 1971 Bangladesh War of Independence from Pakistan. [02:08.320 --> 02:13.280] He was executed at Dhaka Central, a jail just after midnight, after the Supreme Court rejected [02:13.280 --> 02:18.320] his final plea against the death sentence imposed by a special tribunal for genocide, rape, [02:18.320 --> 02:21.440] and orchestrating the massacre of intellectuals during the war. [02:21.440 --> 02:25.280] He was sentenced to death back in 2014, and though several international human rights [02:25.280 --> 02:29.440] groups say that the tribunal procedures fall short of international standards, the government [02:29.440 --> 02:30.940] is rejecting such notions. [03:59.820 --> 04:02.820] You took it on that one, you took it on this one [04:02.820 --> 04:05.320] You took it on your mother and you took it on your father [04:05.320 --> 04:10.320] Hey, howdy, howdy, this is Randy Colton, Deborah Stevens, Wheel of Law Radio [04:10.320 --> 04:15.320] And I come into this show embarrassed [04:15.320 --> 04:21.320] I was talking to Deborah before the show started and explaining the situation to her [04:21.320 --> 04:28.320] And she accused me of using too many pronouns [04:28.320 --> 04:33.320] Now, that was embarrassing because I tell everybody else to quit using pronouns [04:33.320 --> 04:36.320] And here I get zapped doing it myself [04:36.320 --> 04:38.320] Shame on me [04:38.320 --> 04:47.320] Okay, anyway, this is the Thursday, the 12th day of May, 2016 [04:47.320 --> 04:53.320] And I went to the city of Decatur today [04:53.320 --> 04:59.320] A couple weeks ago I had a Decatur police officer write me a ticket [04:59.320 --> 05:05.320] Turned out he was a new police officer and I had no idea who I was [05:05.320 --> 05:08.320] He knows now [05:08.320 --> 05:14.320] He wrote me a ticket for expired registrations [05:14.320 --> 05:17.320] And I got the ticket and read it [05:17.320 --> 05:19.320] I'm looking for it, I don't have my case here [05:19.320 --> 05:28.320] But the ticket where I signed it said that I agreed to appear before the court [05:28.320 --> 05:32.320] On or before the 12th day of May [05:32.320 --> 05:39.320] And I didn't know that I would be required to appear before the court [05:39.320 --> 05:46.320] As a matter of fact, I cannot be required to appear before the court [05:46.320 --> 05:51.320] What you can be required to do if you get a citation [05:51.320 --> 05:58.320] Is appear before some magistrate, not the court [05:58.320 --> 06:02.320] And they've rewritten all of these tickets [06:02.320 --> 06:09.320] So that now they require you to appear before the court [06:09.320 --> 06:15.320] So what I did was went down to the court within the time limit [06:15.320 --> 06:25.320] And I filed two information requests and a challenge to subject matter jurisdiction [06:25.320 --> 06:32.320] And I have to admit, I went to the city of Decatur municipal court [06:32.320 --> 06:35.320] It's a small town [06:35.320 --> 06:41.320] And, excuse me, it is the county seat of Wise County [06:41.320 --> 06:47.320] And I did my usual stuff, I went in there and I told them that [06:47.320 --> 06:52.320] Some dirty rotten scoundrel police officer wrote me a ticket [06:52.320 --> 06:55.320] And she said, well, why did he write you a ticket? [06:55.320 --> 07:01.320] Well, because my registration was expired [07:01.320 --> 07:05.320] Well, how long had it been expired? Only six months [07:05.320 --> 07:08.320] And she said, that dirty rotten scoundrel [07:08.320 --> 07:14.320] So she said, would you like to eat or play? No [07:14.320 --> 07:21.320] And I was really, I wasn't short with them, I was pleasant with them [07:21.320 --> 07:25.320] But I clipped all my answers [07:25.320 --> 07:27.320] I didn't explain anything [07:27.320 --> 07:34.320] When she asked me if I, first she asked me if I got my registration, I said no [07:34.320 --> 07:42.320] Well then, you know, if all you have to do is get your registration and come down here for $20, we'll drop the case [07:42.320 --> 07:44.320] Yeah, I know [07:44.320 --> 07:49.320] And she's getting kind of confused, did you know when I do that to clerks [07:49.320 --> 07:56.320] Especially when you're municipal clerks or especially municipal, more than any other, or JP clerks [07:56.320 --> 08:03.320] Then they begin to think they have some kind of power and authority and they get annoyed with me [08:03.320 --> 08:07.320] I could not annoy these women [08:07.320 --> 08:13.320] And I was short and clipped all my answers and they never did get annoyed with me [08:13.320 --> 08:16.320] I was impressed [08:16.320 --> 08:18.320] These were pros [08:18.320 --> 08:20.320] I keep saying, never mess with the clerks [08:20.320 --> 08:23.320] For the most part, the clerks are wonderful [08:23.320 --> 08:27.320] And these were a perfect example, these were excellent [08:27.320 --> 08:32.320] And I dropped off these two information requests [08:32.320 --> 08:36.320] Well, in a rather short time, just a couple days later [08:36.320 --> 08:41.320] I got a call from a Mr. Rex Hoskins [08:41.320 --> 08:46.320] Rex Hoskins is the chief of police at Cater [08:46.320 --> 08:53.320] We know one another rather well [08:53.320 --> 09:00.320] And he questioned me about these information requests [09:00.320 --> 09:02.320] I'm going to read the first one to you [09:02.320 --> 09:07.320] You're hereby directed to provide for my inspection and or copying all records collected [09:07.320 --> 09:11.320] Simply maintained by your department to include the following [09:11.320 --> 09:17.320] Evidence of authority to enforce the provisions of the Texas traffic laws [09:17.320 --> 09:23.320] Chapter 644 for all officers so authorized in the city of Decatur [09:23.320 --> 09:26.320] Well, if you look up 644 [09:26.320 --> 09:32.320] Let me go back over here to my subject matter jurisdiction [09:32.320 --> 09:38.320] And I've got 644 [09:38.320 --> 09:42.320] 644 [09:42.320 --> 09:46.320] City of Decatur actually [09:46.320 --> 09:52.320] The Texas administrative code rule 413 reads as follows [09:52.320 --> 10:00.320] Authority to enforce, an officer of the department may stop, enter or detain on a highway [10:00.320 --> 10:06.320] Or a port of entry, a motor vehicle that is subject to the transportation code [10:06.320 --> 10:12.320] Chapter 644, a non-commissioned employee of the department that is trained [10:12.320 --> 10:17.320] And certified to enforce the federal safety regulations may stop, enter or detain [10:17.320 --> 10:22.320] A commercial motor vehicle inspection site or at a port of entry [10:22.320 --> 10:26.320] A motor vehicle that is subject to Texas transportation code [10:26.320 --> 10:28.320] Chapter 644 [10:28.320 --> 10:32.320] We go on down to 644 [10:32.320 --> 10:38.320] 644.001 certification of certain peace officers [10:38.320 --> 10:46.320] The department shall establish procedures including training for the certification of municipal police officers [10:46.320 --> 10:53.320] And when this says the department, it is referring to the Department of Public Safety [10:53.320 --> 11:01.320] The department shall establish procedures including training for the certification of municipal police officers [11:01.320 --> 11:05.320] Sheriffs and deputy sheriffs to enforce this chapter [11:05.320 --> 11:13.320] A police officer of any of the following municipalities is eligible to apply for certification under this section [11:13.320 --> 11:20.320] Guys, you are going to love this. This is so crazy [11:20.320 --> 11:24.320] I don't know who did this or why they did this this way [11:24.320 --> 11:33.320] But it appears as though all of these places where the Texas transportation code can be enforced [11:33.320 --> 11:40.320] It appears as though these are designed for specific places [11:40.320 --> 11:51.320] This is how it reads. The department shall establish procedures including training for the certification of municipal officers, sheriffs and deputies to enforce this chapter [11:51.320 --> 12:00.320] A police officer of any of the following municipalities is eligible to apply for certification under this section [12:00.320 --> 12:07.320] A municipality with a population of 50,000 or more [12:07.320 --> 12:18.320] A municipality with a population of 25,000 or more, any part of which is located in a county with a population of half a million or more [12:18.320 --> 12:28.320] A municipality with a population of less than 25,000, any part of which is located in a county with a population of 3.3 million [12:28.320 --> 12:34.320] And that contains or is adjacent to an international airport [12:34.320 --> 12:44.320] A municipality with a population of at least 34,000 that is located in a county that borders two or more states [12:44.320 --> 12:52.320] A municipality, any part of which is located in a county bordering the United Mexican states [12:52.320 --> 13:10.320] A municipality with a population of less than 5,000 that is located adjacent to a bay connected to the Gulf of Mexico and any county adjacent to a county with a population greater than 3.3 million [13:10.320 --> 13:29.320] That's got to be Houston or Harris County. Anyway, a municipality that is located within 25 miles of an international airport and in a county that does not contain a highway that is part of the national system of interstate and defense highways [13:29.320 --> 13:34.320] And is adjacent to a county with a population greater than 3.3 million [13:34.320 --> 13:52.320] That's got to be one specific place down near Houston. And the last one, a municipality with a population of less than 8,500 that is the county seat and contains highway that is part of the national system of interstate and defense highways [13:52.320 --> 14:08.320] Decatur would have made it if Wise County had a interstate defense highway running through it, but I-35 runs just east of Wise County, doesn't have one [14:08.320 --> 14:20.320] A sheriff or a deputy sheriff in a county bordering the United Mexican states or of a county with a population of 1 million or more is eligible to apply for certification under this section [14:20.320 --> 14:33.320] A sheriff, a deputy sheriff or any peace officer that does not attend continuing education courses on the enforcement of traffic and highway laws and on the use of radar equipment as prescribed by subchapter F [14:33.320 --> 14:51.320] Chapter 1701 Occupations Code shall not enforce traffic and highway laws. The department made by rule established reasonable fees sufficient to recover from a municipality or county the cost of certifying as peace officers under this section [14:51.320 --> 15:14.320] Now, most cities and towns in Fort Worth, Dallas, they're big enough that they exceed the 50,000 population amount, but most of the rest of them are just out of luck [15:14.320 --> 15:33.320] So these smaller towns simply cannot enforce the traffic law and these go on to say that the sheriff can appoint five people in the county to enforce the traffic laws [15:33.320 --> 15:46.320] But that's only in counties where they can enforce the traffic laws and according to this, the only counties where the sheriff could enforce the traffic laws is the county bordering the Mexican states [15:46.320 --> 16:07.320] So it's confusing. Ask me what it means. I have no idea, but they can't figure it out. They gave it to the city of Decatur. This is one of two and the chief called me [16:07.320 --> 16:17.320] And he was trying to do this song and dance and seltzer down your pants and find a way to get inside the code [16:17.320 --> 16:37.320] But unfortunately, he didn't know the code as well as I did and couldn't find a way around it. And when I was going out, I was seeing how the officer could not have me sign a citation agreeing to appear before a magistrate, because there's very specific statutes on that particular circumstance. [20:26.320 --> 20:50.320] In this circumstance, I have been arrested in my freedom of movement. And in the penal code under 1406, and the transportation code, or I mean, yeah, transportation code, under five, let me find it in my cases here, 543-003. [20:50.320 --> 21:18.320] If I'm arrested under 1406, 1406, a peace officer who is charging a person, including a child, with committing an offense that is a Class C misdemeanor, other than an offense under Section 49.02 penal code, may instead of taking the person before a magistrate, issue a citation to the person that contains written notice of the time and place the person must appear before a magistrate. [21:18.320 --> 21:30.320] The name and address of the person charged, the offense charged in the following admonishment, in boldface or underlined type, if you're convicted of misdemeanor, blah, blah, blah. [21:30.320 --> 21:58.320] Okay. Now, under the transportation code, a person arrested for a violation of this subtitle, punishable as a misdemeanor, shall be immediately taken before a magistrate, if the person is arrested on a charge of failure to stop in the event of an accident causing damage to property, or the person demands an immediate appearance before a magistrate, [21:58.320 --> 22:03.320] or refuses to make a written promise to appear in court as provided by the subject. [22:03.320 --> 22:08.320] So he arrested my freedom movement, I was under arrest. [22:08.320 --> 22:19.320] But, and he charged me with violating a, with a violation that was a misdemeanor. [22:19.320 --> 22:25.320] But he, he had a duty to take me before a magistrate, but he had an alternative. [22:25.320 --> 22:30.320] He had the alternative appears here. [22:30.320 --> 22:33.320] Let's see, the person must be taken, okay. [22:33.320 --> 22:39.320] Notice to appear required, person not taken before a magistrate, 543.003. [22:39.320 --> 22:53.320] An officer who arrests a person for a violation of this subtitle, punishable as a misdemeanor, and who does not take the person before a magistrate, shall issue a written notice to appear in court, [22:53.320 --> 23:08.320] showing the time and place the person is to appear, and the offense charged, the name and address of the person charged, and if applicable, the license number of the person, person's vehicle. [23:08.320 --> 23:09.320] Okay. [23:09.320 --> 23:11.320] Now, that's what he can issue. [23:11.320 --> 23:12.320] Okay. [23:12.320 --> 23:26.320] Then we go to 543.004, notice to appear required. An officer shall issue a written notice to appear if the offense charges speeding or a violation of the open standard law. [23:26.320 --> 23:34.320] And the person makes a written promise to appear in court as provided by section 543.005. [23:34.320 --> 23:50.320] 543.005, promise to appear, to secure release, the person arrested must make a written promise to appear in court by signing the written notice to a mode notice prepared by the arresting officer. [23:50.320 --> 24:00.320] The signature may be obtained on a duplicate form or on an electronic device capable of copying, of creating a copy of this signed notice. [24:00.320 --> 24:07.320] The arresting officer shall retain the paper or electronic original of the notice and deliver the copy of the notice to the person arrested. [24:07.320 --> 24:11.320] The officer shall then promptly release the person from custody. [24:11.320 --> 24:13.320] Okay. [24:13.320 --> 24:28.320] 543.006, the time specified in the notice to appear must be at least 10 days after the date of arrest, unless the person arrested demands an earlier hearing. [24:28.320 --> 24:45.320] The place specified in the notice to appear must be before a magistrate having jurisdiction of the offense who is in the municipality or county in which the offense is alleged to have been committed. [24:45.320 --> 24:53.320] I can only be required to appear before a magistrate. [24:53.320 --> 24:58.320] A magistrate can only do three things. [24:58.320 --> 25:03.320] They can marry people as they make a few extra bucks. [25:03.320 --> 25:10.320] He can hold an examining trial and he can set bail and that is it. [25:10.320 --> 25:14.320] Those are the only three things a magistrate can do. [25:14.320 --> 25:18.320] They cannot hold an arraignment hearing. [25:18.320 --> 25:26.320] An arraignment hearing is a hearing, Article 26.01, arraignment. [25:26.320 --> 25:35.320] In all felony cases after indictment and all misdemeanor cases punishable by imprisonment, there shall be an arraignment. [25:35.320 --> 25:39.320] That's the only time there can be an arraignment. [25:39.320 --> 25:50.320] This is not a, and the legislature went to special effort to make this clear and single out these circumstances. [25:50.320 --> 25:55.320] So I can't be called to an arraignment. [25:55.320 --> 26:02.320] Arraignment is a hearing for the purpose of identifying the accused and taking the plea. [26:02.320 --> 26:04.320] That's what they call it. [26:04.320 --> 26:09.320] I went to the court and they asked for a plea and I said, well, where's the magistrate? [26:09.320 --> 26:10.320] I want to talk to the magistrate. [26:10.320 --> 26:12.320] Well, the magistrate's not here. [26:12.320 --> 26:14.320] Well, I came to appear before the magistrate. [26:14.320 --> 26:16.320] I want you to go get one. [26:16.320 --> 26:17.320] We can't go get one. [26:17.320 --> 26:18.320] Sure you can. [26:18.320 --> 26:19.320] Just call him up. [26:19.320 --> 26:20.320] Tell him I'm here. [26:20.320 --> 26:21.320] I come to see him. [26:21.320 --> 26:24.320] Tell him to come on down. [26:24.320 --> 26:29.320] And the clerks, to their credit, they never once lost their cool. [26:29.320 --> 26:30.320] They didn't get excited. [26:30.320 --> 26:34.320] They were really patient with me. [26:34.320 --> 26:35.320] Oh, here. [26:35.320 --> 26:36.320] I'm sorry. [26:36.320 --> 26:37.320] I missed this. [26:37.320 --> 26:40.320] 26.02, purpose of arraignment. [26:40.320 --> 26:50.320] An arraignment takes place for the purpose of fixing his identity and hearing his plea. [26:50.320 --> 26:51.320] So that's established. [26:51.320 --> 26:53.320] That's all they can do. [26:53.320 --> 26:59.320] So they tried to have an arraignment hearing and they tried to have an arraignment hearing through the clerk. [26:59.320 --> 27:02.320] Well, the clerk can't take my plea. [27:02.320 --> 27:04.320] She's not a judge. [27:04.320 --> 27:07.320] So the clerk was impersonating a judicial officer. [27:07.320 --> 27:13.320] And she assured me that if I didn't enter a plea that, you know, I told him I can't enter a plea. [27:13.320 --> 27:15.320] I need to see a magistrate. [27:15.320 --> 27:18.320] And I'm here at arms links to the court. [27:18.320 --> 27:20.320] So, oh, well, if you don't enter a plea, that's okay. [27:20.320 --> 27:23.320] The judge will enter one for you. [27:23.320 --> 27:29.320] I told her, ooh, you better not do that. [27:29.320 --> 27:36.320] If he does that, then that's an exercise of his judicial discretion. [27:36.320 --> 27:38.320] I didn't tell her that part. [27:38.320 --> 27:41.320] I struggled not to give legal advice. [27:41.320 --> 27:50.320] But if he enters a plea for me, then that's an exercise of judicial discretion, which he doesn't have. [27:50.320 --> 27:53.320] Because I have a child subject matter jurisdiction before the court. [27:53.320 --> 27:57.320] And now she gave me a notice to appear. [27:57.320 --> 28:11.320] And when I read it, I asked her to send it to me by certified mail because the notice to appear was an order to appear before the prosecuting attorney. [28:11.320 --> 28:14.320] And I read it and I said, say what? [28:14.320 --> 28:16.320] This is a persecuting attorney. [28:16.320 --> 28:19.320] I don't talk to persecuting attorneys. [28:19.320 --> 28:25.320] There's only one persecuting attorney in all the state of Texas that I trust and would talk to. [28:25.320 --> 28:27.320] And that's Greg Lowry. [28:27.320 --> 28:30.320] He's a district attorney in Wise County. [28:30.320 --> 28:31.320] He's the only one. [28:31.320 --> 28:34.320] I don't talk to persecuting attorneys. Let me qualify the question. You're speaking to real property. [34:36.320 --> 34:39.320] Yes, land, you know. [34:39.320 --> 34:54.320] Okay. In Texas, 13.001 addresses this, and most every state has a statute similar to this one, [34:54.320 --> 35:06.320] and it says any claim against real property not properly acknowledged or proven and filed with the county recorders void is to the holder. [35:06.320 --> 35:15.320] Now, this raises an issue concerning property that has an alloidal title [35:15.320 --> 35:24.320] or has had the brought forth for the grant. [35:24.320 --> 35:34.320] Anyway, if you have an alloidal title, then there is no title filed with the state. [35:34.320 --> 35:46.320] So that raises a question. If you've brought forth your land patent and you're not registered with the state, [35:46.320 --> 35:51.320] can a claim be brought against your property? And it's not something of research. [35:51.320 --> 36:00.320] I seem to remember assertions that it could not, other than by specific contract. [36:00.320 --> 36:08.320] Oh, the short answer is no, you don't have to file anything as a recorder. [36:08.320 --> 36:19.320] The long answer is claims against real property are for the most part unenforceable unless they're filed in the public record. [36:19.320 --> 36:29.320] Well, this is the problem. The land was originally bought for taxes and was sold to me after it was bought by the other person. [36:29.320 --> 36:37.320] I didn't think it right that I should register with the county. [36:37.320 --> 36:45.320] You don't have to. You're not required to. [36:45.320 --> 36:49.320] This is why I was wondering if there was a law requiring me to do that. [36:49.320 --> 36:58.320] No, the only state I know of that has one requiring you to is Pennsylvania. [36:58.320 --> 37:10.320] You don't have to. But if somebody makes a claim against your property and you try to stand forward with your warranty deed, [37:10.320 --> 37:16.320] you're not going to be able to enforce your warranty deed. [37:16.320 --> 37:19.320] Let me explain why. [37:19.320 --> 37:29.320] If I go real price, I need a way to know if there is a claim against that property. [37:29.320 --> 37:38.320] And when they landed at Plymouth Rock and started dividing up property, [37:38.320 --> 37:46.320] they created a land registry for this purpose to register who held property. [37:46.320 --> 37:54.320] So a citizen could go to the land registry, see who held this property. [37:54.320 --> 37:59.320] So somebody is trying to sell me the Brooklyn Bridge. [37:59.320 --> 38:09.320] I need to be able to go to the land records and look up the Brooklyn Bridge and see who actually owns it. [38:09.320 --> 38:18.320] If you want to sell me your house, I need to know if there are any claims against your property. [38:18.320 --> 38:22.320] So they set up land registries for that purpose. [38:22.320 --> 38:27.320] If you have a claim, then in order for you to be able to enforce that claim, [38:27.320 --> 38:34.320] you need to make that claim public by filing it in the public record. [38:34.320 --> 38:38.320] If you don't, then you can't enforce the claim. [38:38.320 --> 38:39.320] Okay. [38:39.320 --> 38:45.320] The problem I have with all this is that they will then be able to use the information you provide [38:45.320 --> 38:50.320] to issue tax liens and stuff like that against you. [38:50.320 --> 38:54.320] They don't need that. [38:54.320 --> 39:00.320] They can do that anyway. [39:00.320 --> 39:04.320] But are you saying they want to hide the fact that you own the property [39:04.320 --> 39:13.320] so they won't know that they can leave your property? [39:13.320 --> 39:18.320] So you're in a catch-22. You can't get away from them, do you? [39:18.320 --> 39:20.320] Yes, there is a way to get away from it. [39:20.320 --> 39:26.320] Take your property and put it in a private trust. [39:26.320 --> 39:38.320] Put the property in a trust that doesn't incur liability, then you can lease the property back from the trust. [39:38.320 --> 39:41.320] This is what the rich folks set up so they could protect everything. [39:41.320 --> 39:43.320] This is what lawyers do. [39:43.320 --> 39:46.320] So there is a way to do that. [39:46.320 --> 39:54.320] But not filing your claim, that will cause you far more problems than filing it. [39:54.320 --> 39:56.320] Just transfer the property to the trust. [39:56.320 --> 40:05.320] Create a trust that has the, where you are not the, you can be the beneficiary. [40:05.320 --> 40:09.320] I'm sorry, you can be the benefactor. [40:09.320 --> 40:14.320] But you cannot be the beneficiary and you cannot be the trustee. [40:14.320 --> 40:19.320] You can donate your property to the trust. [40:19.320 --> 40:24.320] But once you do that, you're not the beneficiary and you're not the trustee. [40:24.320 --> 40:33.320] But you have a private backside contract with the trustee that restricts what the trustee can do. [40:33.320 --> 40:37.320] The contract makes you the managing director of the trust. [40:37.320 --> 40:40.320] However, this is a private contract. [40:40.320 --> 40:44.320] You know, you heard this talk about the straw man. [40:44.320 --> 40:51.320] The straw man is your public side and on the public side, the trust holds the property. [40:51.320 --> 40:56.320] On the private side, you have a private contract with the trustee, [40:56.320 --> 41:03.320] allowing you, making you managing director and you can fire the trustee anytime you want to, [41:03.320 --> 41:11.320] reverse any of his actions, put in a new trustee to reverse his actions if you want to. [41:11.320 --> 41:21.320] This puts you at arm's length to the trust so that the courts won't call the trust an alter ego of yourself. [41:21.320 --> 41:27.320] If you're the benefactor and the beneficiary and the trustee, [41:27.320 --> 41:32.320] they say the trust is merely an alter ego of yourself. [41:32.320 --> 41:36.320] But if you're not the trustee or the beneficiary, [41:36.320 --> 41:43.320] then you're not, the trust is not an alter ego of yourself. [41:43.320 --> 41:46.320] That private contract is in the private. [41:46.320 --> 41:51.320] It never comes out of the private unless the trustee does something you don't like. [41:51.320 --> 41:55.320] Then you haul that out, you bring it in the public and you fire the trustee. [41:55.320 --> 41:59.320] And then you tear up that contract and trash it. [41:59.320 --> 42:06.320] Then you hire another trustee where you get a contract that goes into private. [42:06.320 --> 42:09.320] Does that make sense? [42:09.320 --> 42:11.320] Not really for one reason. [42:11.320 --> 42:17.320] If the property is currently in my name, I just bought the property, I donate it to the trust. [42:17.320 --> 42:20.320] I am now the benefactor to the trust, right? [42:20.320 --> 42:22.320] Yes. [42:22.320 --> 42:32.320] Okay, now if I got to fire the trustee, at that point I am back again being the benefactor. [42:32.320 --> 42:37.320] No, trust still holds the property. [42:37.320 --> 42:42.320] You're still the benefactor, you can be the benefactor, [42:42.320 --> 42:49.320] but you can't be the beneficiary on paper. [42:49.320 --> 42:54.320] The only way you're going to get your property where it's untouchable, [42:54.320 --> 42:58.320] it has to be out of your name. [42:58.320 --> 43:02.320] But you still maintain control and you can do that through trust. [43:02.320 --> 43:09.320] I'm not the trust expert, but I understand enough to understand what you can do with it. [47:25.320 --> 47:29.320] How are you doing, Randy? I've got an interesting situation. [47:29.320 --> 47:37.320] I had a calendar call scheduled for a couple months ago that got cancelled due to the judge being on vacation. [47:37.320 --> 47:41.320] However, they never sent me notice that it was cancelled. [47:41.320 --> 47:50.320] They rescheduled it for May 5th, last Thursday, never sent me notice for that. [47:50.320 --> 47:58.320] Now I have two capias on me, one for a $100 bond. [47:58.320 --> 48:05.320] I was just doing some research the other day on precisely this issue. [48:05.320 --> 48:17.320] That is called procedural, I mean, that is called abusive process, and it's a procedural due process violation. [48:17.320 --> 48:24.320] Case on point. Guy leases a property for his restaurant. [48:24.320 --> 48:28.320] The owner of the property fails to maintain the property. [48:28.320 --> 48:32.320] The guy leasing it stops payment until he does the repairs. [48:32.320 --> 48:37.320] Well, it's absolutely clear in law that he can't do that. [48:37.320 --> 48:46.320] And the landlord knows that he's going to win this case, so he files suit against him. [48:46.320 --> 48:54.320] And then he has him come to court and then he gets the hearing cancelled. [48:54.320 --> 49:00.320] The guy has to shut down his restaurant, take a day off, go to court, and then they get the hearing cancelled without noticing. [49:00.320 --> 49:06.320] They do that twice, then he goes to court and he wins the case. [49:06.320 --> 49:21.320] The guy sued him for a breach of, for abusive process using the subpoena power to order him to come to court and then deliberately canceling the court. [49:21.320 --> 49:26.320] Well, your judge may get away with doing this once, but not twice. [49:26.320 --> 49:36.320] And especially in civil, in traffic cases, if you fight the traffic case, they'll tend to do this. [49:36.320 --> 49:47.320] I spoke at the beginning of the show about the city is sending me a notice to appear before a prosecutor. [49:47.320 --> 49:54.320] That's an abusive process. There is no power in the court to do that. [49:54.320 --> 49:59.320] So I'll go after him for abuse process, just for yucks. [49:59.320 --> 50:05.320] But this is certainly a claim that you will have. [50:05.320 --> 50:09.320] Does that sound like fun? [50:09.320 --> 50:24.320] Well, they only cancelled it once, but the thing is, the two tapias I have on me, one's a hundred dollar bond, the other one's a thousand because I posted a hundred dollar bond on that one to get out of jail. [50:24.320 --> 50:28.320] Wait a minute, were you arrested? [50:28.320 --> 50:32.320] On the one charge, yes. [50:32.320 --> 50:36.320] Then that's false imprisonment. [50:36.320 --> 50:44.320] If they violated procedural due process in order to issue a warrant, that's false imprisonment. [50:44.320 --> 50:50.320] And is this a municipality or a county? [50:50.320 --> 50:55.320] I misunderstood what you were saying. I have not been arrested on the KPS yet. [50:55.320 --> 50:58.320] Who wrote the ticket? [50:58.320 --> 51:06.320] Municipality or county sheriff for DPS? [51:06.320 --> 51:08.320] The arrest? [51:08.320 --> 51:12.320] Who wrote you the ticket? [51:12.320 --> 51:14.320] The city. [51:14.320 --> 51:31.320] Okay, municipality. The municipality, I guess it wouldn't matter which one, but they've all waived their sovereign immunity in the case of false imprisonment. [51:31.320 --> 51:39.320] There are a couple of places where sovereign immunity has been waived, and that's one of them. [51:39.320 --> 51:47.320] That you can sue them for directly. You can also sue them directly for procedural due process violation. [51:47.320 --> 51:51.320] Actually, you can charge them criminally. [51:51.320 --> 52:00.320] I haven't looked in Florida law, you'll have to look for it. Look up official misconduct. [52:00.320 --> 52:11.320] Every state has a statute. I have seen the official misconduct statute in Florida, but it's been a long time, so I don't remember what it is. [52:11.320 --> 52:17.320] Every state has it. It reflects 18 U.S. Code 242. [52:17.320 --> 52:24.320] And what it says is that, and I'm paraphrasing here because it's kind of long and convoluted. [52:24.320 --> 52:31.320] Essentially, if a public official exerts or purports to exert an authority he doesn't have, [52:31.320 --> 52:36.320] and in the process denies a citizen an informed free access to or enjoyment of a right, [52:36.320 --> 52:45.320] that's a class A misdemeanor in the Fed, and it's a similar level in most every state. [52:45.320 --> 52:55.320] Okay. In Florida, at least this part of Florida, any city charge, they don't have a city court. You go to county court. [52:55.320 --> 52:58.320] So this is a county judge that issued a case. [52:58.320 --> 53:06.320] Oh, okay. This is good. Okay. Florida statutes 838.022, official misconduct. [53:06.320 --> 53:16.320] It is unlawful for a perfect servant with a corrupt intent to or to obtain a benefit for any person or to cause harm to another to falsely [53:16.320 --> 53:26.320] or cause to falsely or cause another person to falsely falsify any official record or official document. [53:26.320 --> 53:36.320] Conceal, don't cover up or destroy, mutilate, or alter any official record, obstruct, delay, or prevent the communication of information [53:36.320 --> 53:39.320] related to the commission of effect felony. [53:39.320 --> 53:45.320] Okay. This one is official misconduct the way it's stated in Texas. [53:45.320 --> 53:50.320] So what I need to do is look for official oppression. [53:50.320 --> 53:56.320] As in Texas, we have two. Most states group them all under official misconduct. [53:56.320 --> 54:02.320] So we'll go back and look under official oppression. [54:02.320 --> 54:09.320] I have a keyboard here that doesn't spell well. Go ahead. [54:09.320 --> 54:14.320] What was the statute number on that? 838 what? [54:14.320 --> 54:17.320] Wait a minute. It doesn't say exactly what 18 U.S. Code 242 does. So you may have to go to 18 U.S. Code 242 and sting them in the bed. [54:52.320 --> 54:55.320] And you can have a lot of fun with this. [54:55.320 --> 55:01.320] We do advocate the joys of being the pro se from hell. [55:01.320 --> 55:05.320] And here's how you have fun with it. [55:05.320 --> 55:14.320] When you file a criminal complaint in the Fed, you will be instructed to go to the FBI. [55:14.320 --> 55:25.320] And when they instruct me to go to the FBI, I ask them, show me that in law. Are the FBI agents magistrates? [55:25.320 --> 55:31.320] If they're not, then I don't want to mess with them. I'll take this to a magistrate. [55:31.320 --> 55:37.320] All criminal complaints are directed to some magistrates. [55:37.320 --> 55:46.320] All judges are magistrates. And in the Fed, they have magistrates appointed that are actually like law clerks for judges. [55:46.320 --> 55:50.320] But they're official magistrates and they can hold hearings. [55:50.320 --> 55:58.320] Well, all complaints are directed to some magistrates for the purpose of examining into the sufficiency of the allegation [55:58.320 --> 56:03.320] and issuing an order showing a finding a probable cause. [56:03.320 --> 56:06.320] FBI agents can't do that. [56:06.320 --> 56:13.320] Now, if you file a complaint with a magistrate, the magistrate will almost certainly ask the FBI to look into it. [56:36.320 --> 56:43.320] And they're not going to do anything that's not politically advantageous to their boss. [56:43.320 --> 56:46.320] They don't care what the law says. [56:46.320 --> 56:51.320] So file a complaint with some magistrate. [56:51.320 --> 57:01.320] And then when the magistrate refuses to hold an examining trial, then you file a complaint against the magistrate with the federal grand jury. [57:01.320 --> 57:03.320] And you never want to go there. [57:03.320 --> 57:04.320] You never want them to see you. [57:04.320 --> 57:07.320] You do all this through the mail. [57:07.320 --> 57:16.320] And you send a verified criminal affidavit to any magistrate, preferably a federal district judge. [57:16.320 --> 57:26.320] And when he sends it back to you and tells it to you, gives you this really pleasant letter saying, oh, wow, G. Willekers, you really need to take this to the FBI. [57:26.320 --> 57:30.320] Then you file one against the judge and you send it to the grand jury. [57:30.320 --> 57:33.320] And this is how you do it. [57:33.320 --> 57:46.320] You make up 12 folders, and on the top one, you write a form of the grand jury and then grand jury one through 11 on the rest. [57:46.320 --> 57:58.320] In the top one for the format, we put a cover letter that says that you have problems with U.S. attorneys secreting complaints from the grand jury, especially when they're against public officials. [57:58.320 --> 58:09.320] Therefore, we'll do initial and return this cover letter to me in the included stamp self-address envelope so I know you actually got it. [58:09.320 --> 58:12.320] Well, you're not going to get that letter back. [58:12.320 --> 58:26.320] And what that would generate is reasonable, probable cause to believe that the former didn't get that document and somebody interfered with the U.S. mail. [58:26.320 --> 58:33.320] And since the address of the grand jury is the U.S. attorney's office, he's your prime suspect. [01:04:24.320 --> 01:04:28.320] You'll win your case if you have the politics on your side. [01:04:28.320 --> 01:04:33.320] So you got this little municipal court jerking you around. [01:04:33.320 --> 01:04:42.320] So how about instead of you being the jerk or a jerky, you become the jerk or? [01:04:42.320 --> 01:04:44.320] What do you think is going to happen? [01:04:44.320 --> 01:05:03.320] When you start filing criminal charges against a municipal judge for procedural due process violation against you under 18 U.S. Code 242, official oppression, and the federal courts get it. [01:05:03.320 --> 01:05:10.320] The first thing they're going to do is send the FBI out there to say, what the heck is going on here? [01:05:10.320 --> 01:05:15.320] And then they're all going to do this little song and dance and stuff. [01:05:15.320 --> 01:05:19.320] Oh, this is all a bunch of nonsense, blah, blah, blah. [01:05:19.320 --> 01:05:23.320] And then you file against the district judge. [01:05:23.320 --> 01:05:37.320] And then when you send this paperwork to the U.S. Attorney's Office or to the grand jury by way of the U.S. Attorney's Office, U.S. Attorney is going to get your complaint and he's going to trash you. [01:05:37.320 --> 01:05:44.320] And when you send it to the foreman, you send it registered restricted. [01:05:44.320 --> 01:05:49.320] And under registered restricted, only the person named can sign for it. [01:05:49.320 --> 01:05:54.320] So then you go to the post office and see who signed for it. [01:05:54.320 --> 01:05:57.320] And you file criminally against the person who signed for it. [01:05:57.320 --> 01:06:02.320] It's going to be some clerk in the mailroom. [01:06:02.320 --> 01:06:13.320] Send a complaint to the U.S. Attorney accusing the clerk in the mailroom of violating, I think it's 28 U.S.C. 1441. [01:06:13.320 --> 01:06:16.320] No, no, no, that's not it. [01:06:16.320 --> 01:06:32.320] Anyway, whatever the tampering with the mail statute is, 28 U.S.C. 1441 goes to the federal venue. [01:06:32.320 --> 01:06:34.320] But anyways, the tampering with the mail statute. [01:06:34.320 --> 01:06:38.320] So you can use the clerk or the tampering with the mail. [01:06:38.320 --> 01:06:54.320] And you use the same cover letter and send it to the foreman when the U.S. Attorney gets the second one that's accusing the mail clerk of secreting these complaints from the grand jury. [01:06:54.320 --> 01:06:59.320] The U.S. Attorney is going to get excited. [01:06:59.320 --> 01:07:11.320] And what he's likely to do is tell you that if you make any other attempt to contact the grand jury, he will charge you with jury tampering. [01:07:11.320 --> 01:07:27.320] And when he does that, you make up another complaint and file it with the U.S. Attorney in Washington, D.C., accusing the U.S. Attorney of witness tampering. [01:07:27.320 --> 01:07:33.320] And they're all going to get really unhappy, can't do anything to you except not like it. [01:07:33.320 --> 01:07:40.320] And very likely this little municipal court is going to want this stuff to go away. [01:07:40.320 --> 01:07:51.320] Once you get done playing with them with the criminal side, you can send the municipality a tort letter. [01:07:51.320 --> 01:07:56.320] Are you familiar with a tort letter? [01:07:56.320 --> 01:08:00.320] Not very, no. A good copy of one. [01:08:00.320 --> 01:08:03.320] Here's what the courts say. [01:08:03.320 --> 01:08:12.320] We don't want you using our courts as a remedy of first resort, but rather as a remedy of last resort. [01:08:12.320 --> 01:08:20.320] So we're going to ask you to take some action in order to remedy this issue before you bring it to us. [01:08:20.320 --> 01:08:27.320] And the preferred action and the only thing you have to do is give notice and opportunity. [01:08:27.320 --> 01:08:32.320] You give notice that you've been harmed an opportunity to cure. [01:08:32.320 --> 01:08:37.320] So you send them a letter saying, you guys have been dirty rotten scoundrels. [01:08:37.320 --> 01:08:40.320] You did this, that, this, that, the other. [01:08:40.320 --> 01:08:46.320] What I generally do is I write up the lawsuit I intend to file. [01:08:46.320 --> 01:08:55.320] And once I have it all written, I take the court heading off of it and put a business letter heading. [01:08:55.320 --> 01:09:06.320] I take the prayer off of it and change prayer to a demand to cure and then send it to them. [01:09:06.320 --> 01:09:11.320] Well, they're going to give it to their lawyers and their lawyers are going to look at it and they're going to see. [01:09:11.320 --> 01:09:14.320] Now we'll also take out the venue section. [01:09:14.320 --> 01:09:20.320] They're going to see a statement of facts, a statement of factual accusation, a statement of claims. [01:09:20.320 --> 01:09:24.320] They're going to say, this guy's not kidding. [01:09:24.320 --> 01:09:29.320] He really is going to sue us because he's already got it written. [01:09:29.320 --> 01:09:34.320] And most likely they will not respond to it. [01:09:34.320 --> 01:09:36.320] They almost never do. [01:09:36.320 --> 01:09:45.320] Or they'll send you a letter saying, you know, you tell them how much you want to cure and before you decide how much to cure, [01:09:45.320 --> 01:09:49.320] look up, go to the PACER. [01:09:49.320 --> 01:09:54.320] Do you have access to PACER? [01:09:54.320 --> 01:09:57.320] I'm not even sure what it is. [01:09:57.320 --> 01:10:03.320] PACER is the government court website and you can go on PACER and sign up for it. [01:10:03.320 --> 01:10:12.320] They charge you ten cents to do a search and ten cents to pay for every page you download. [01:10:12.320 --> 01:10:16.320] So you can do a search and you can look at all that stuff. It don't cost you anything. [01:10:16.320 --> 01:10:19.320] It just costs you ten cents to do the search. [01:10:19.320 --> 01:10:21.320] So it's not very expensive. [01:10:21.320 --> 01:10:24.320] It's a lot easier going down to the courthouse. [01:10:24.320 --> 01:10:29.320] Actually, I do 90 percent of my research on the Internet. [01:10:29.320 --> 01:10:37.320] I do a search for Florida, municipality, due process lawsuit. [01:10:37.320 --> 01:10:40.320] And you're likely to get hits on lawsuits. [01:10:40.320 --> 01:10:49.320] Let's see if you can find some where the person has actually won the suit. [01:10:49.320 --> 01:10:59.320] And that'll tell you how much they won in decisions and then use that to base your claim. [01:10:59.320 --> 01:11:06.320] And then file a claim against them and ask for triple for punitive damages [01:11:06.320 --> 01:11:12.320] and tell them make me hold and be sued. [01:11:12.320 --> 01:11:20.320] PACER website you're referring to, is that dot com or dot org? What is it? [01:11:20.320 --> 01:11:23.320] Oh, dot gov. [01:11:23.320 --> 01:11:24.320] Dot gov? [01:11:42.320 --> 01:11:52.320] In a criminal case, can you use all those means of discovery like requests for admissions and interrogatories, et cetera? [01:11:52.320 --> 01:11:53.320] Yes. [01:11:53.320 --> 01:11:54.320] Just in civil. [01:11:54.320 --> 01:12:03.320] Yes, but some states restrict discovery in classy misdemeanor cases. [01:12:03.320 --> 01:12:06.320] I'm not sure what Florida does, but you can certainly ask. [01:12:06.320 --> 01:12:08.320] This is a criminal case. [01:12:08.320 --> 01:12:11.320] You have a right to certain kinds of discovery. [01:12:11.320 --> 01:12:16.320] As to admissions, you can certainly ask for them. [01:12:16.320 --> 01:12:25.320] But I generally haven't seen admissions in a criminal case, but I haven't seen anything that says you can't ask for admissions. [01:12:25.320 --> 01:12:27.320] You can ask for anything you want to. [01:12:27.320 --> 01:12:40.320] But I don't know if a refusal to admit or if they ignore the admissions, if that's tantamount to admitting whatever you request. [01:12:40.320 --> 01:12:46.320] So admissions are the only ones that carry a consequence. [01:12:46.320 --> 01:12:55.320] In civil, if you're asked to admit something and you fail to admit or deny, it's presumed that you admit. [01:12:55.320 --> 01:12:57.320] I'm not so sure that would carry to criminal. [01:12:57.320 --> 01:13:00.320] You'd have to check Florida law for that. [01:13:00.320 --> 01:13:04.320] But there's nothing to stop you from sending it. [01:13:04.320 --> 01:13:05.320] I'm going to send them. [01:13:05.320 --> 01:13:17.320] Now, what I have in mind in doing, and I bounced this off Eddie Monday night with these capias, I plan on making myself very public on Sunday [01:13:17.320 --> 01:13:24.320] and hope that my favorite deputy out there that loves to take me to jail, I hope he's swayed by it to get me. [01:13:24.320 --> 01:13:27.320] And so, you know, arrest me on these capias. [01:13:27.320 --> 01:13:35.320] Because Florida has a statute called service of process on Sunday. [01:13:35.320 --> 01:13:39.320] Now, whoever's in whatever state, Google that. [01:13:39.320 --> 01:13:41.320] Look for it. [01:13:41.320 --> 01:13:45.320] In Florida, it's Florida statute 48.20. [01:13:45.320 --> 01:13:48.320] And it's in plain English. [01:13:48.320 --> 01:13:50.320] It reads as this. [01:13:50.320 --> 01:13:52.320] And it's just a couple sentences. [01:13:52.320 --> 01:14:01.320] Service or execution on Sunday of any writ, process, warrant, order, or judgment is void. [01:14:01.320 --> 01:14:13.320] And the person serving or executing or causing it to be served or executed is liable to the party aggrieved for damages, [01:14:13.320 --> 01:14:23.320] or so doing as if he had done it without any process, writ, warrant, order, or judgment. [01:14:23.320 --> 01:14:28.320] Oh, that is beautiful. [01:14:28.320 --> 01:14:46.320] That gives you a statutory cause of action for false imprisonment and the Travizat case that everybody uses to determine the amount claimed is a Florida case. [01:14:46.320 --> 01:14:56.320] And Debra, if you do remember what Travizat is, I think it's like $20,000 a minute or something. [01:14:56.320 --> 01:14:58.320] An hour? [01:52:35.320 --> 01:52:38.320] I always ask them that [01:52:38.320 --> 01:52:47.320] I'm always thinking what will play well in front of a grand jury of my peers [01:52:47.320 --> 01:52:56.320] How is he going to accuse me of being agitated after I ask him to take his chicken suit off? This happened in Cherokee County [01:55:34.320 --> 01:55:36.320] Montgomery County [01:55:36.320 --> 01:55:39.320] That's where I took the habeas [01:55:39.320 --> 01:55:43.320] They threw me out of the courtroom [01:55:43.320 --> 01:55:46.320] There's good old boys all over East Texas [01:55:46.320 --> 01:55:48.320] All these counties are all good old boys [01:55:48.320 --> 01:55:50.320] Yeah, but the good old boys [01:55:50.320 --> 01:55:57.320] When you start kicking them in their teeth and using their own rules and codes to do it with [01:55:57.320 --> 01:55:59.320] They don't know how to deal with you [01:55:59.320 --> 01:56:03.320] If Robert Fox had listened, he could have handled these guys [01:56:03.320 --> 01:56:06.320] But he just wanted to poke the bear [01:56:06.320 --> 01:56:08.320] He just wanted to get him as upset as he could [01:56:08.320 --> 01:56:09.320] That wasn't necessary [01:56:09.320 --> 01:56:11.320] I didn't want to get him upset [01:56:11.320 --> 01:56:14.320] I want to get him wondering what I'm setting him up for [01:56:14.320 --> 01:56:19.320] And what got me out of all that in Cherokee County [01:56:19.320 --> 01:56:24.320] Because I filed 15 criminal complaints against the judge and the prosecutor [01:56:24.320 --> 01:56:28.320] They had a conviction already [01:56:28.320 --> 01:56:34.320] And he sent the prosecutor down to make a deal with me to get me the heck out of his jail [01:56:34.320 --> 01:56:38.320] I did what I should have done in the first place [01:56:38.320 --> 01:56:39.320] Wow [01:56:39.320 --> 01:56:42.320] This has been a learning process [01:56:42.320 --> 01:56:50.320] If I had went after them big time right at the beginning, this stuff would have stopped [01:56:50.320 --> 01:56:58.320] So this court, this justice court, this judge sent me a letter signed by him saying [01:56:58.320 --> 01:57:02.320] Any further contact with us is referred to the county attorney [01:57:02.320 --> 01:57:04.320] Don't talk to me anymore [01:57:04.320 --> 01:57:06.320] Don't call me [01:57:06.320 --> 01:57:10.320] Your case has been transferred to the county attorney [01:57:10.320 --> 01:57:13.320] Talk to them [01:57:13.320 --> 01:57:17.320] Is this a Class C misdemeanor?
