[05:58.000 --> 06:01.000] Now, what we did in class yesterday, [06:01.000 --> 06:06.000] as you remember a couple weeks ago I told you all about a video that I did [06:06.000 --> 06:12.000] for the class where I was talking about the one and only written rebuttal [06:12.000 --> 06:15.000] to the Constitutional Challenge motion that we have had [06:15.000 --> 06:21.000] and that it was written by a completely incompetent city attorney [06:21.000 --> 06:23.000] in Williamson County. [06:23.000 --> 06:30.000] Now, I decided that that video was overboard for public consumption, [06:30.000 --> 06:32.000] even in my mind today, [06:32.000 --> 06:36.000] because I was mad that day that somebody could be that openly [06:36.000 --> 06:41.000] and brazenly stupid and still be given a law degree. [06:41.000 --> 06:43.000] I was mad that day. [06:43.000 --> 06:46.000] So yesterday I redid all of that. [06:46.000 --> 06:49.000] I went into a more detailed discussion [06:49.000 --> 06:54.000] over the constitutional passing of the bill, [06:54.000 --> 06:56.000] unconstitutional passing of the bill, [06:56.000 --> 07:01.000] and went through line by line rebutting her assertions and arguments [07:01.000 --> 07:06.000] in relation to that specific area of the motion itself. [07:06.000 --> 07:08.000] Now, as I've told you before, [07:08.000 --> 07:12.000] the motion is divided up into three specific areas. [07:12.000 --> 07:16.000] It is the unconstitutional enactment. [07:16.000 --> 07:20.000] It is the unconstitutional interpretation by the courts, [07:20.000 --> 07:27.000] and it is the unconstitutional application by everyone to the general public, [07:27.000 --> 07:32.000] rather than only to those that are engaging in the occupation [07:32.000 --> 07:36.000] that the subject is being regulated. [07:36.000 --> 07:39.000] It regulates an occupation. [07:39.000 --> 07:44.000] Everything in that code applies only to someone in that occupation [07:44.000 --> 07:50.000] that is engaging in that occupation that is not the general public. [07:50.000 --> 07:53.000] Now, that, of course, would be true [07:53.000 --> 07:57.000] if the whole code was not unconstitutional on its face. [07:57.000 --> 08:01.000] But yesterday's class, I think, went fairly well [08:01.000 --> 08:04.000] in going through that step by step and line by line [08:04.000 --> 08:10.000] and showing you exactly how incompetent these attorneys really are. [08:10.000 --> 08:13.000] They want you to think that they understand the law, [08:13.000 --> 08:16.000] that they know the law, that they know how to argue it, [08:16.000 --> 08:20.000] that they understand things that you don't. [08:20.000 --> 08:23.000] That's a farce, okay? [08:23.000 --> 08:25.000] That's not true. [08:25.000 --> 08:31.000] This woman's written paperwork is proof positive it's not true. [08:31.000 --> 08:39.000] And I just finished doing the encoding for one video camera's stuff, [08:39.000 --> 08:41.000] and I've got to do the encoding for the other, [08:41.000 --> 08:45.000] and I've got to merge the two if I do that. [08:45.000 --> 08:48.000] And then I'm going to get it uploaded onto YouTube. [09:36.000 --> 09:41.000] Do you folks really understand what I'm trying to do here [09:41.000 --> 09:46.000] and what it would mean to you to support it by coming to the class [09:46.000 --> 09:50.000] and learning how to fight back against what's being done to you, [09:50.000 --> 09:53.000] your family, your neighbors? [09:53.000 --> 09:56.000] Do you really understand that? [09:56.000 --> 10:04.000] Because what I'm going after here is their stepping stone to everything. [10:04.000 --> 10:13.000] They use this code to do more harm to Americans in every state [10:13.000 --> 10:23.000] than anything else because they use it to fabricate every false stop they make. [10:23.000 --> 10:30.000] They use it to fabricate probable cause to conduct illegal searches, [10:30.000 --> 10:36.000] warrantless arrest, seizures of property in every state. [10:36.000 --> 10:38.000] You understand that, right? [10:38.000 --> 10:50.000] Without this stepping stone, their ability to do those things is greatly lessened. [10:50.000 --> 10:56.000] It is time for us to recognize where they're beginning this [10:56.000 --> 10:59.000] and put a stop to it, and that's what I'm trying to do. [10:59.000 --> 11:06.000] This is not about me and my desire to not follow the rules, okay? [11:06.000 --> 11:11.000] It is my desire to get you to understand that there aren't any such rules [11:11.000 --> 11:16.000] and that there never could be when it comes to you and I [11:16.000 --> 11:21.000] acting in our private capacities as free individuals. [11:21.000 --> 11:27.000] It's an oxymoron to believe that you are free and at the same time bound [11:27.000 --> 11:32.000] by every dictate from everybody that goes into a public office [11:32.000 --> 11:35.000] and tells you now that I'm here you have to do everything I tell you [11:35.000 --> 11:38.000] whether you like it or not, whether it's constitutional or not, [11:38.000 --> 11:42.000] whether it's moral or not. [11:42.000 --> 11:49.000] Because if you believe that, then you're not free at all. [11:49.000 --> 11:52.000] And that's the part you've got to overcome. [11:52.000 --> 11:56.000] Now that being said, I want to go ahead and start taking calls early on tonight. [11:56.000 --> 11:59.000] I've got several people up on the board already. [12:18.000 --> 12:22.000] Okay, so what I would really like is for you to tell people honestly [12:22.000 --> 12:29.000] without any impetus from me what you thought of the class and the information that was in it. [12:29.000 --> 12:31.000] Well, I love the interaction. [12:31.000 --> 12:35.000] First of all, when we're in a live setting like that there's no suppressor. [12:35.000 --> 12:40.000] So being able to go back and forth in conversation is relatively easy. [12:40.000 --> 12:44.000] And I was impressed that you didn't even need a microphone for that venue. [12:44.000 --> 12:47.000] You must have quite a set of pipes there. [12:47.000 --> 12:51.000] But I was kind of surprised that there weren't that many people there. [12:51.000 --> 12:55.000] I was expecting that more people would be engaged in this fight. [12:55.000 --> 12:56.000] You and me both, brother. [12:56.000 --> 13:00.000] You and me both, especially with the number of emails and phone calls I get. [13:00.000 --> 13:01.000] Help me, help me. [13:01.000 --> 13:06.000] And how many of them are in Austin and still never show up for the class? [13:06.000 --> 13:13.000] Yeah, and even with my, what, yellow belt maybe even in this fight I get, you know, [13:13.000 --> 13:14.000] several requests. [13:14.000 --> 13:17.000] Everyone I know is asking me about their traffic tickets, [13:17.000 --> 13:19.000] and I just have to kind of explain to them, [13:19.000 --> 13:24.000] look guys, you better be ready for this fight before the fight comes. [13:24.000 --> 13:30.000] So you got to kind of look into this stuff before you even know that it's germane [13:30.000 --> 13:34.000] or important and that's how you're going to win it. [13:34.000 --> 13:39.000] And I really liked that you were focusing on the constitutional challenge that [13:39.000 --> 13:41.000] you've made because that is the Achilles heel. [13:41.000 --> 13:44.000] Like you said, that is the tip of the spear. [13:44.000 --> 13:47.000] I mean it's such an easy argument that anybody who can read, [13:47.000 --> 13:50.000] except for these lawyers apparently, you know, [13:50.000 --> 13:55.000] can clearly see that they've used an illegal emergency clause. [13:55.000 --> 13:57.000] And so the whole thing's invalid. [13:57.000 --> 14:03.000] And if we can get this victory or support Eddie getting this victory, [14:03.000 --> 14:06.000] everybody needs to do it. [14:06.000 --> 14:09.000] Well, I appreciate that input. [14:09.000 --> 14:12.000] And that's what I'm trying to get you to understand, folks. [14:12.000 --> 14:16.000] This benefits everyone, everyone. [14:16.000 --> 14:21.000] This sets precedent in Texas for the entire state, not just Austin, [14:21.000 --> 14:26.000] not just Eddie, everybody everywhere in Texas. [14:26.000 --> 14:30.000] This puts a whole new spin on what's on the drawing board. [14:30.000 --> 14:32.000] I'm sorry, go ahead, Max. [14:32.000 --> 14:37.000] Yeah, if I may, Eddie, if we can continue at the classes and, you know, [14:37.000 --> 14:42.000] on the Facebook group sharing the idiotic responses that these lawyers have to [14:42.000 --> 14:47.000] make an obvious argument, then we can keep bolstering our, you know, [14:47.000 --> 14:51.000] the constitutional challenge motion to completely, you know, [14:51.000 --> 14:55.000] hammer all these leaps shut and those supposed leaps anyway. [14:55.000 --> 14:56.000] Absolutely. [14:56.000 --> 15:02.000] And it also allows us to practice a specific verbal rebuttal on the fly if we need it. [15:02.000 --> 15:07.000] Because, like I said, I went through the case law that this female attorney used [15:07.000 --> 15:12.000] her idiotic rebuttal, and it does not support her position. [15:12.000 --> 15:16.000] In fact, it completely undermines her position when you read what the case [15:16.000 --> 15:18.000] actually says. [15:18.000 --> 15:21.000] So this is what you have to understand about these attorneys. [15:21.000 --> 15:25.000] They count on your ignorance and inexperience. [15:25.000 --> 15:30.000] They know that you don't know how or even most of the time have the capability [15:30.000 --> 15:33.000] to go look up a case that they cite. [15:33.000 --> 15:37.000] And then if you read it, you may not understand what you're reading because [15:37.000 --> 15:42.000] sometimes the opinion is written with a nuance rather than straightforward [15:42.000 --> 15:50.000] language to let them basically make an undercurrent for you to understand what [15:50.000 --> 15:53.000] they are really saying without actually saying it. [15:53.000 --> 15:56.000] And this is lawyers speak intentionally. [15:56.000 --> 16:01.000] This is how they hide what they do from the eyes of the public to make [16:01.000 --> 16:07.000] themselves look absolutely necessary. [16:07.000 --> 16:11.000] Yep, and they think that we're not going to understand or be too lazy to look [16:11.000 --> 16:15.000] up a cite that they make in their rebuttals or in their answers. [16:15.000 --> 16:20.000] And I don't think that's the case for a lot of the people that I've run into [16:20.000 --> 16:21.000] out there. [16:21.000 --> 16:25.000] They're not too lazy to look up these case laws and see if they're on point. [16:25.000 --> 16:29.000] And the subtlety of the way these rulings read makes it even clearer to [16:29.000 --> 16:31.000] understand that they're not on point. [21:52.000 --> 22:05.000] In fact, I read a case today on a foreclosure where a bank was asking the court to ignore the word all [22:05.000 --> 22:07.000] and interpret it as some. [22:07.000 --> 22:13.000] And the court said, you're asking us to throw away the common meaning of the word. [22:13.000 --> 22:15.000] Not going to happen. [22:15.000 --> 22:21.000] But that's exactly what this attorney did in her rebuttal with several things, [22:21.000 --> 22:25.000] which hopefully I made clear in the class yesterday. [22:25.000 --> 22:27.000] Yeah, you made it abundantly clear. [22:27.000 --> 22:31.000] And I must say, watching you live, you're a lot more animated, [22:31.000 --> 22:36.000] and you can see your gestures as opposed to just imply them. [22:36.000 --> 22:40.000] No, he doesn't mean those kinds of gestures, folks. [22:40.000 --> 22:42.000] No, no, not those kind of gestures. [22:42.000 --> 22:49.000] But definitely, and the ability to be able to get angry and drop an S-bomb every now and then, [22:49.000 --> 22:53.000] it's a little bit of a different experience than catching it on the radio. [22:53.000 --> 22:54.000] True. [22:54.000 --> 22:57.000] I do kind of have to clean it up language-wise here. [22:57.000 --> 23:00.000] And I know not everybody appreciates language for what it is. [23:00.000 --> 23:07.000] But folks, you have to remember, words are just somebody's interpretation of a thought. [23:07.000 --> 23:10.000] If I told you to go shove a pickle up your nose, [23:10.000 --> 23:15.000] but I said it with the same intent that I would drop the F-bomb U on somebody, [23:15.000 --> 23:18.000] then what would be the difference between the two? [23:20.000 --> 23:24.000] It's just simply your interpretation of the words that make the difference, [23:24.000 --> 23:26.000] not the words themselves. [23:26.000 --> 23:32.000] So just because of language or something like that, that's not really a reason to not learn. [23:32.000 --> 23:37.000] That's not really a reason to not come to class because, believe me, [23:37.000 --> 23:42.000] if you went through what I went through trying to get people to understand what, [23:42.000 --> 23:45.000] to me, should be pretty simple concepts, [23:45.000 --> 23:51.000] and every single day just to watch them go out and hang themselves anyway, [23:51.000 --> 23:58.000] or you watch these criminals lie to people's face about how things apply and how they work, [23:58.000 --> 24:01.000] you'd want to be dropping F-bombs here and there, too. [24:01.000 --> 24:03.000] Believe me. [24:03.000 --> 24:08.000] I mean, for instance, and Max, [24:08.000 --> 24:11.000] is there anything else you want to say before I get on this part of it here? [24:11.000 --> 24:17.000] Just one other thing. I'd like a copy of that attorney's rebuttal. [24:32.000 --> 24:37.000] But her rebuttal will not make nearly as much sense until you've read the arguments [24:37.000 --> 24:44.000] that I put against them that she's trying to rebut and failing miserably to do so. [25:20.000 --> 25:22.000] We were having a discussion on Facebook, [25:22.000 --> 25:26.000] and this is what I'm talking about with people either A, not wanting to understand, [25:26.000 --> 25:29.000] B, not listening so as to understand, [25:29.000 --> 25:35.000] or C, deciding that no matter what you tell them, it is a pointless conversation, [25:35.000 --> 25:38.000] which you're just wasting your breath engaging in anyway, [25:38.000 --> 25:40.000] because they're not going to get it. [25:40.000 --> 25:42.000] They don't want to get it. They can't get it. [25:42.000 --> 25:45.000] At that point, it doesn't matter which one it is. [25:45.000 --> 25:48.000] The fact is your time is being wasted. [25:48.000 --> 25:51.000] Now, in this particular discussion, [25:51.000 --> 25:56.000] this gentleman is being charged with a rather serious offense, cruelty to animal, [25:56.000 --> 26:01.000] i.e., specifically the charge of torturing an animal. [26:01.000 --> 26:05.000] Now, based upon the facts that he presented, [26:05.000 --> 26:08.000] there is no torture that was intended here, [26:08.000 --> 26:11.000] and under the statute in Texas for that act, [26:11.000 --> 26:16.000] intent to commit torture is an element of the offense. [26:16.000 --> 26:22.000] You must have specifically wanted to inflict that cruel harm, [26:22.000 --> 26:30.000] that pain, that suffering, and then engage in the acts to perpetrate that harm. [26:30.000 --> 26:33.000] That's the requirements, elementally speaking, [26:33.000 --> 26:37.000] under the torture statute when it comes to animal cruelty. [26:37.000 --> 26:41.000] Now, in this discussion, we are trying to get this gentleman to understand [26:41.000 --> 26:50.000] that his affirmative defense is to simply rebut the concept of intent, [26:50.000 --> 26:54.000] because the facts, according to what he gave us, and without being there, [26:54.000 --> 26:59.000] I'm going to accept those facts as true without contradicting evidence, [26:59.000 --> 27:06.000] is that he had a dog that he found and had been raising with his family and everything, [27:06.000 --> 27:09.000] but he didn't know the background of the dog. [27:09.000 --> 27:14.000] Well, the dog became aggressive and attacked his little girl. [27:14.000 --> 27:21.000] He took the dog out back and attempted to put it down with a shot to the head. [27:21.000 --> 27:26.000] Well, the dog dropped, but it didn't die. [27:26.000 --> 27:30.000] And within some length of time, that area is kind of gray, [27:30.000 --> 27:34.000] but within some length of time after being shot in the head, [27:34.000 --> 27:41.000] the dog was found scratching and alive at the back door wanting to come back home. [27:41.000 --> 27:46.000] Well, the guy then took the dog out and attempted to shoot it again [27:46.000 --> 27:49.000] to put it out of whatever suffering it might be undergoing, [27:49.000 --> 27:52.000] but at the same time to complete the original intended act [27:52.000 --> 27:57.000] of putting the dog down for attacking his daughter. [27:57.000 --> 28:04.000] Apparently, two more shots and the animal still would not die. [28:04.000 --> 28:08.000] So either A, the guy's using way too small a caliber of gun on the type of dog [28:08.000 --> 28:13.000] he's trying to execute, and that's basically what he's doing. [28:13.000 --> 28:17.000] He's attempting to execute a bad dog because he can't afford [28:17.000 --> 28:22.000] the exorbitant amount of money that the veterinarian wants to put the dog down. [28:22.000 --> 28:24.000] And I can't blame him for not wanting to spend that either [28:24.000 --> 28:26.000] when it's just as simple to do it with a gun. [28:26.000 --> 28:29.000] But that's not a here and an there. [28:29.000 --> 28:35.000] As far as the facts of the case go, three shots, the dog still won't die. [28:35.000 --> 28:39.000] So the district attorney in the area is attempting to charge him with torture [28:39.000 --> 28:44.000] because he shot the dog three times and it didn't die. [28:44.000 --> 28:49.000] His affirmative defense here is, A, yes, I shot the dog. [28:49.000 --> 28:52.000] Yes, I shot the dog three times. [28:52.000 --> 28:57.000] However, there was never any intent to cause pain and suffering [28:57.000 --> 29:02.000] as the location and type of shots clearly indicate. [29:02.000 --> 29:07.000] Therefore, there was no intent to torture. [29:07.000 --> 29:11.000] That's an affirmative defense to that specific element of that charge. [29:11.000 --> 29:18.000] And remember, they must have all of the elements in order to successfully prosecute. [29:18.000 --> 29:25.000] If they don't have even one out of three or five or ten or however many there are, [29:25.000 --> 29:32.000] if they lose even one element, that charge is dead in the water. [29:32.000 --> 29:40.000] Intent to commit the cruel suffering is an actual element of the torture charge. [29:40.000 --> 29:44.000] That's all he has to rebut is that intent. [29:44.000 --> 29:47.000] And the guy could not get this concept. [29:47.000 --> 29:50.000] Tried and tried and tried and it wouldn't sink in. [29:50.000 --> 29:54.000] So folks, you don't know what you think you know and you need to learn it. [29:54.000 --> 29:55.000] Y'all hang on. [35:06.000 --> 35:11.000] And I know there's got to be people that are just right there that can do it. [35:42.000 --> 35:44.000] And basically, I remember your words were, [35:44.000 --> 35:48.000] if you could survive what I'm telling you now, what I'm doing to you now, [35:48.000 --> 35:50.000] you could survive them in court. [35:50.000 --> 35:55.000] And then last night, you said the same thing basically as Ed. [35:55.000 --> 35:59.000] You've got to learn how to answer this because you've got to answer in court. [35:59.000 --> 36:03.000] And if you're going to try to fight this fight, you're going to learn this stuff. [36:03.000 --> 36:08.000] I read into the raw material all the time. I'm honestly into it. [36:08.000 --> 36:12.000] I think I have a pretty good grasp on it. [36:12.000 --> 36:17.000] But when you go to the class and then you sort of ask the question, [36:17.000 --> 36:21.000] and I know I know the answer, but I can't be quick enough. [36:21.000 --> 36:27.000] You've got to be really fast to be able to reply in court. [36:27.000 --> 36:29.000] Will you do the same thing to us? [36:29.000 --> 36:34.000] That experience is invaluable because if you're not in trouble at the time, [36:34.000 --> 36:37.000] but you get that practice, that is invaluable. [36:37.000 --> 36:38.000] Absolutely. [36:38.000 --> 36:43.000] I mean, when I ask you a question in class or I get you up there on the stage [36:43.000 --> 36:46.000] and do one of those mock interrogations on the witness stand, [36:46.000 --> 36:54.000] I'm going to be as mean and as obnoxious and as scary to you as I can possibly be. [36:54.000 --> 36:59.000] I'm going to do my best to make you feel foolish, look small, and feel bad. [36:59.000 --> 37:01.000] And the reason for that is very simple. [37:01.000 --> 37:04.000] It's not because I want you to take it personally. [37:04.000 --> 37:08.000] It's because this is what you're going to face in the court. [37:08.000 --> 37:12.000] That's exactly what that prosecutor is going to attempt to do to you [37:12.000 --> 37:15.000] if you're getting the upper hand for any reason. [37:15.000 --> 37:21.000] It's what they may do to you if they feel like you're too weak to defend yourself in any way. [37:21.000 --> 37:28.000] So if you can face me, they're going to be easy because I can say things to you [37:28.000 --> 37:33.000] that they can't in a courtroom in my classroom. [37:33.000 --> 37:36.000] And that's the whole point, folks. [37:36.000 --> 37:42.000] Yeah, I think a lot of times people here, and I think I've made comments then before, [37:42.000 --> 37:46.000] I think I just called in to this building and said something like this before, [37:46.000 --> 37:51.000] that a lot of times you do get a little bit irritable, but by God, [37:51.000 --> 37:55.000] how many times can you tell somebody the same thing about listening to you? [37:55.000 --> 37:59.000] I can see the irritability, but a lot of times it's just a matter of fact [37:59.000 --> 38:03.000] that you just have to get in their face and prepare them. [38:03.000 --> 38:12.000] And I think that sometimes people just don't grasp that tough, let me say it like this, [38:12.000 --> 38:16.000] tough love, that tough love where you've got to get through, [38:16.000 --> 38:21.000] just like you get to your kids in a certain way, get through to people in a certain way, [38:21.000 --> 38:28.000] but you're doing it in a way that makes them realize, I have to man up to do this. [38:28.000 --> 38:36.000] But it's not just being tough, it's like it's all got a systematic process to it, [38:36.000 --> 38:39.000] and it's all backed up with law. [38:39.000 --> 38:44.000] And so Eddie, I thank you, everything you've ever done, [38:44.000 --> 38:50.000] and for all the people out there who want to fight this corruption, [38:50.000 --> 38:54.000] I just say get to the class. [39:18.000 --> 39:24.000] But the feedback I got was they told him that they thought I sounded like an a-hole. [40:06.000 --> 40:12.000] And that's the ones I refer to as the patronuts that will do everything in their power [40:12.000 --> 40:21.000] to look like a UFO snatch job reject on the evening news in a courtroom [40:21.000 --> 40:30.000] rather than do everything they do themselves and do it better and win. [40:30.000 --> 40:32.000] I don't understand, okay? [40:32.000 --> 40:36.000] Well, I can see these kind of people being the ones that as soon as the judge [40:36.000 --> 40:40.000] or the prosecutor kind of gets my feeling, they just kind of all up and cry it out. [40:40.000 --> 40:43.000] Exactly, and then come out and complain about how they got railroaded, [40:43.000 --> 40:48.000] how it wasn't fair, and they didn't even get a chance to defend themselves. [40:48.000 --> 40:52.000] Newsflash, folks, they're not going to give you a chance to defend yourself. [40:52.000 --> 40:55.000] You're going to have to take it. [40:55.000 --> 40:58.000] That's right. [40:58.000 --> 41:01.000] And I sound the way I do, and I talk the way I do, [41:01.000 --> 41:08.000] and I express myself the way I do because I used to be you. [42:53.000 --> 42:58.000] If I don't go in there and speak like I know what I'm saying and why I'm saying it, [42:58.000 --> 42:59.000] it's not going to do me any good. [47:44.000 --> 47:49.000] And then about 100 yards into it, he puts his lights on. [47:49.000 --> 47:58.000] And I pull over, and bottom line is they took a blood test, [47:58.000 --> 48:10.000] and my blood turned out 0.096 or 16,000 over. [48:10.000 --> 48:13.000] Yeah, 0.08 is the legal limit. [48:13.000 --> 48:16.000] Okay, well, let me ask you a question based upon what you've said so far. [48:16.000 --> 48:19.000] You said you were going 20 miles an hour, [48:19.000 --> 48:24.000] and remember to use your turn signal when you change lanes, correct? [48:24.000 --> 48:25.000] Yes. [48:25.000 --> 48:28.000] Okay, when you're going 20 miles an hour, [48:28.000 --> 48:34.000] was the street you owned by any chance marked for faster than that? [48:34.000 --> 48:35.000] It was under construction. [48:35.000 --> 48:38.000] There were construction barricades. [48:38.000 --> 48:41.000] Wait, wait, wait, wait, wait, that's not my question. [48:41.000 --> 48:45.000] My question is, what was the speed limit actually? [48:45.000 --> 48:46.000] 35. [48:46.000 --> 48:47.000] 35. [48:47.000 --> 48:53.000] So you're 15 miles an hour below the speed limit, even in a construction zone, right? [48:53.000 --> 48:54.000] What time was this? [48:54.000 --> 48:55.000] I don't know that fast. [48:55.000 --> 48:57.000] Wait a minute, what time? [48:57.000 --> 48:59.000] It was 1230. [48:59.000 --> 49:01.000] AM? [49:04.000 --> 49:14.000] Well, then you did the one thing that most people that are caught behind the wheel under the influence tend to do. [49:14.000 --> 49:18.000] They tend to slow their car way down. [49:18.000 --> 49:27.000] That is almost a universal training signal to a cop that if you're going that far below the posted speed limit at that time of night, [49:27.000 --> 49:32.000] then odds are you're dealing with someone under the influence. [49:32.000 --> 49:34.000] Now, I understand the reason why you did it. [49:34.000 --> 49:35.000] Don't get me wrong. [49:35.000 --> 49:39.000] And I'm not saying you did a bad thing by doing that. [49:39.000 --> 49:43.000] But you've got to understand that that's a red flag to a cop. [49:43.000 --> 49:53.000] At that time of night, coming from the direction that you must have been coming in where they knew there's probably a bar or at least some place that served alcohol. [49:53.000 --> 49:54.000] I was coming from my house. [49:54.000 --> 49:55.000] I was going over to girlfriends. [49:55.000 --> 49:56.000] Okay. [49:56.000 --> 50:05.000] Well, either way, going that fast in that manner at that time of night, that's going to be a red flag indicator to a cop for a DUI. [50:05.000 --> 50:09.000] And you have to remember that they can fabricate a traffic stop for anything. [50:09.000 --> 50:11.000] They can make it up. [50:11.000 --> 50:22.000] And the only way to beat it is to get video from before the time they stopped you that clearly shows that their basis was a lie [50:22.000 --> 50:27.000] and that they never had a articulable probable cause or reasonable suspicion. [50:27.000 --> 50:29.000] They didn't have anything. [50:29.000 --> 50:32.000] They just stopped you anyway, which they can't do. [50:32.000 --> 50:33.000] So they fabricate something. [50:33.000 --> 50:37.000] What did they tell you when they came up to your car? [50:37.000 --> 50:39.000] They told me I was speeding. [50:39.000 --> 50:44.000] Speeding at 20 in a 35. [50:44.000 --> 50:45.000] Yeah. [50:45.000 --> 50:46.000] I'll show you the video. [50:46.000 --> 50:48.000] I got copies of the video. [50:48.000 --> 50:50.000] Your meeting's in Austin, right? [50:50.000 --> 50:51.000] Yes. [50:51.000 --> 50:52.000] Okay. [50:52.000 --> 50:57.000] Well, what is in this video that's going to prove your side of the story is my first question. [51:04.000 --> 51:05.000] Okay. [51:05.000 --> 51:11.000] Again, not the full correct answer, going slow is relative. [51:11.000 --> 51:12.000] Okay. [51:12.000 --> 51:14.000] I was stopped at a stoplight. [51:14.000 --> 51:16.000] He did not have his lights on. [51:16.000 --> 51:20.000] And then, you know, no indication that I've done anything wrong. [51:20.000 --> 51:29.000] So I've got a tape of the supposed before the infraction and during the infraction. [51:29.000 --> 51:38.000] Well, in Texas, they're not infractions, they're offenses, which is just a fancy way of saying a criminal penalty for a civil act. [51:38.000 --> 51:41.000] But go ahead. [51:41.000 --> 51:45.000] Well, the reason why I was going slow, I have a legitimate argument. [51:45.000 --> 51:49.000] There were orange construction cones all around. [51:49.000 --> 51:50.000] Okay. [51:49.000 --> 51:51.000] Wait, wait, wait, wait, wait, wait. [51:51.000 --> 51:54.000] You still have not answered my question, which is... [51:54.000 --> 51:55.000] Oh, I'm sorry. [51:55.000 --> 52:05.000] What in that video proves your side of the story that they had no basis for stopping you? [52:05.000 --> 52:07.000] I was not exceeding the speed limit. [52:07.000 --> 52:08.000] Okay. [52:08.000 --> 52:15.000] And the video on the cop car generally tells you what the speed of the cruiser itself actually is. [52:15.000 --> 52:18.000] What is it? [52:18.000 --> 52:19.000] Oh, I didn't see that. [52:19.000 --> 52:22.000] I was just basing it upon how far I traveled. [52:22.000 --> 52:25.000] Well, don't base it upon how far you travel. [52:25.000 --> 52:31.000] That requires calculations, which most people aren't going to be able to do or understand. [52:31.000 --> 52:40.000] Every police car's video, almost without fail, shows what the speed of the police car is in the video frame. [52:40.000 --> 52:45.000] It'll be the number that's changing constantly going up and down as the car accelerates and decelerates. [52:45.000 --> 52:53.000] And if you actually were going 20 miles an hour and they stayed the same distance behind you in that video, [52:53.000 --> 52:59.000] then that should be the number that you're looking for on that screen or something really close. [52:59.000 --> 53:05.000] I don't have it in front of me right now, so I can't answer that question. [53:05.000 --> 53:06.000] Okay. [53:06.000 --> 53:08.000] Well, that's what you need to go back and be looking for. [53:08.000 --> 53:18.000] Okay, you need to identify what each of those numbers on that screen are because that's information that's going to play a part in what they use against you in court. [53:18.000 --> 53:27.000] See, the thing is, if you're in that condition, you may or may not fully realize how fast you're going or not how fast you're going. [53:27.000 --> 53:29.000] You may not. [53:29.000 --> 53:41.000] I mean, there's been times that I've talked to people, they thought they were going 100 miles an hour and they were moving in slow motion. [53:41.000 --> 53:45.000] And it affects everyone differently, okay? [53:45.000 --> 53:48.000] No matter what you think, it does. [53:48.000 --> 53:50.000] Sometimes.06 is enough. [53:50.000 --> 53:55.000] You're not legally drunk, but you're wasted off your behind regardless. [53:55.000 --> 53:56.000] So it just changes. [53:56.000 --> 53:57.000] Okay. [53:57.000 --> 54:03.000] So you need to be looking at that video because that video is what's going to say whether or not you are correct. [54:03.000 --> 54:11.000] And that video is what's going to show whether or not they're lying about their initial reasonable suspicion or probable cause. [54:11.000 --> 54:16.000] So pay real close attention to that, okay? [54:16.000 --> 54:25.000] Because in order to beat the DUI, you're going to have to beat the original basis of the stop. [54:25.000 --> 54:29.000] Okay. [54:29.000 --> 54:35.000] So once they got that blood test, they basically have got me. [54:35.000 --> 54:39.000] Did they get a warrant for the blood? [54:39.000 --> 54:41.000] Yes, they did. [54:41.000 --> 54:42.000] Okay. [54:42.000 --> 54:47.000] And how did they get the warrant? [54:47.000 --> 54:59.000] What it was is though, I was trying to ask them, for one, they brought me over to the police station and they said that we're going to take a blood sample. [54:59.000 --> 55:04.000] And I wanted to read the documents prior to them taking a blood sample. [55:04.000 --> 55:11.000] So they basically told me that that was a refusal. [55:11.000 --> 55:16.000] So they went out and got a judge to sign a warrant. [55:16.000 --> 55:17.000] Okay. [55:17.000 --> 55:22.000] Did they do a Phil Sobrati test? [55:22.000 --> 55:23.000] Yes, they did. [55:23.000 --> 55:25.000] And it was 20 degrees outside. [55:25.000 --> 55:26.000] Okay. [55:26.000 --> 55:28.000] Wait, wait, wait, wait, wait, wait, wait, wait, wait, wait, wait, wait, wait. [55:28.000 --> 55:30.000] Okay. [55:30.000 --> 55:33.000] Why did you take it? [01:23:15.960 --> 01:23:20.960] And they basically blamed it on a poor lighting situation. [01:35:13.400 --> 01:35:19.400] Well, only because in the lobby I happened to just go up to anybody [01:35:19.400 --> 01:35:23.400] that was standing there to ask him a question as to where the bailiff was. [01:35:23.400 --> 01:35:27.400] And this guy had a very rigid body language and demeanor, [01:35:27.400 --> 01:35:31.400] and he used my own line against me, the very same line that I used [01:35:31.400 --> 01:35:34.400] when I got pulled over on the side of the road, which was, [01:35:34.400 --> 01:35:36.400] I do not answer questions. [01:35:36.400 --> 01:35:39.400] I asked him, I said, excuse me, do you know if the bailiff is in there? [01:35:39.400 --> 01:35:42.400] And he said, I do not answer questions. [01:35:42.400 --> 01:35:47.400] So right away I realized it is close to impossible, highly unlikely [01:35:47.400 --> 01:35:52.400] that just somebody at random would use a very same line verbatim against me. [01:36:44.400 --> 01:36:46.400] She almost got into his truck, [01:36:46.400 --> 01:36:53.400] and he waited for me to be the very last case to be tried for the day before he left. [01:36:53.400 --> 01:36:57.400] So all my evidence, all my suspicion, my clues are coming together [01:36:57.400 --> 01:37:01.400] that he is working either with her or for her or helping her out. [01:37:01.400 --> 01:37:04.400] Hey, no problem, but I almost want to file an affidavit [01:37:04.400 --> 01:37:08.400] or even a subpoena to get information against him. [01:37:08.400 --> 01:37:13.400] Well, one, you don't know who he is, right? [01:37:13.400 --> 01:37:16.400] Not yet, but that's what I intend to find out. [01:38:54.400 --> 01:38:58.400] He may have looked up your information based upon the police report. [01:38:58.400 --> 01:39:00.400] I mean, it wouldn't matter. [01:39:00.400 --> 01:39:12.400] The problem here is if he's somebody that had a legal reasonable basis for knowing that information, and the only place you saw them was in court, [01:39:12.400 --> 01:39:21.400] and they didn't say or do anything that would make you fearful for your safety or to testify on your own behalf or to present evidence on your own behalf [01:39:21.400 --> 01:39:35.400] or undermine your defense with the prosecution by stealing your records and giving them to them, I'm not following your problem here other than potential paranoia. [01:39:35.400 --> 01:39:38.400] No, it's not paranoia, but I did not just see him in the courtroom. [01:39:38.400 --> 01:39:47.400] He made a point to watch me as I walked in my car, and they stayed there together side-by-side chatting, looking directly at my car, [01:39:47.400 --> 01:39:54.400] and I made it a point for them to see me wave at them as, you know, I'll have a good day and I'll see you later on next month. [01:39:54.400 --> 01:39:56.400] Okay. [01:39:56.400 --> 01:39:59.400] So I highly suspect that they're together. [01:39:59.400 --> 01:40:00.400] Okay. [01:40:00.400 --> 01:40:11.400] So let me put this question in. Since we're not getting beyond that point, let me try this. You're not going to be allowed to testify to it because it's not relevant. [01:51:51.400 --> 01:51:57.400] But the problem there would still result in the fact that there's no one to cross-examine. [01:51:57.400 --> 01:52:01.400] You cannot cross-examine a deposition. [01:52:01.400 --> 01:52:04.400] You cannot cross-examine a video. [01:52:04.400 --> 01:52:11.400] And there's no one but the officer to testify to what that video is and what happened at that scene, right? [01:52:11.400 --> 01:52:18.400] Well, somebody called at a convenience store and alerted them of my presence. [01:52:18.400 --> 01:52:22.400] Okay. Presence at the convenience store? [01:52:22.400 --> 01:52:26.400] Yes. Apparently, I was off balance a little bit. [01:52:26.400 --> 01:52:36.400] Okay. Well, when they alerted them to your presence, what did this other person actually see? [01:52:36.400 --> 01:52:41.400] Now, again, when you said video, I'm assuming we were talking about video from a police car. [01:52:41.400 --> 01:52:48.400] If we're talking about video from some building's security camera, [01:52:48.400 --> 01:52:56.400] that would be a whole other matter if there were multiple witnesses available for what was occurring on camera there. [01:52:56.400 --> 01:53:04.400] Now, if this was a stop on the side of the road out in the middle of BFE with the cop in his car, they're stuck. [01:53:04.400 --> 01:53:10.400] But now if the other is the situation, well, that's a different can of worms. [01:53:10.400 --> 01:53:20.400] Yes. So a motion could be made to dismiss for lack of prosecution, [01:53:20.400 --> 01:53:24.400] but it may not stick if there are other witnesses that the... [01:53:24.400 --> 01:53:27.400] Well, in order to get a motion for lack of prosecution, granted, [01:53:27.400 --> 01:53:35.400] you've got to be beyond the statute of limitations or the limitation on time to initiate that prosecution. [01:53:35.400 --> 01:53:42.400] For instance, here in Texas, a Class C finally misdemeanor, they don't have forever to prosecute the case. [01:53:42.400 --> 01:53:49.400] They've got two years to file the complaint, but once that complaint is filed, a speedy trial clock starts ticking. [01:53:49.400 --> 01:53:54.400] They must prosecute that case in less than four months, [01:53:54.400 --> 01:54:00.400] or the Texas courts have ruled you didn't get a speedy trial in that case, and you should have. [01:54:00.400 --> 01:54:05.400] All right, then maybe I'm looking at a suppression hearing or a motion to suppress evidence. [01:54:05.400 --> 01:54:10.400] Well, again, in order to suppress the evidence, you're going to have to show the evidence was illegally obtained [01:54:10.400 --> 01:54:18.400] or was somehow tampered with or was somehow not provided through discovery, but now they want to use it against you. [01:54:18.400 --> 01:54:22.400] That's the way you're going to get motion or evidence suppressed. [01:54:22.400 --> 01:54:25.400] You're not going to get a suppression just because you want it suppressed. [01:54:25.400 --> 01:54:33.400] I need to make a formal request for discovery or have my public defender do that because an informal request has been made, [01:54:33.400 --> 01:54:37.400] but I haven't been able to view the video. [01:54:37.400 --> 01:54:40.400] Has your attorney? [01:54:40.400 --> 01:54:45.400] He's a public defender, and I haven't discussed that with him. He's encouraging me to plead. [01:54:45.400 --> 01:54:50.400] Well, of course he is. That's why he's a public defender. [01:54:50.400 --> 01:55:03.400] Well, I understand. But before I fire him, if there's a frictionless way to utilize him, I would like to do that. [01:55:03.400 --> 01:55:08.400] Well, the thing is, you can tell him what you want him to do. That doesn't mean he's going to do it. [01:55:08.400 --> 01:55:13.400] You cannot file the motion if he's working for you. [01:55:13.400 --> 01:55:19.400] They will never let you file anything if you have representation with an attorney. [01:55:19.400 --> 01:55:29.400] All right. Well, I gave him motion to strike and dismiss the complaint based on no case crime or cause of action and no corpus electi, [01:55:29.400 --> 01:55:31.400] and he still hasn't filed it. [01:55:31.400 --> 01:55:39.400] Exactly. And he won't. [01:55:39.400 --> 01:55:50.400] Well, it sounds like I will file it because I'm filing it against the Commonwealth of Pennsylvania and Officer Jason E. Sapp, who is deceased. [01:55:50.400 --> 01:55:58.400] Okay. Well, again, if he's not the only witness, that's not going to matter. [01:55:58.400 --> 01:56:05.400] The only thing he would be called to testify to is what information he personally is aware of. [01:56:05.400 --> 01:56:10.400] And since he can't do that, they will use any other witnesses that were there. [01:56:10.400 --> 01:56:15.400] If they know and have the person that called in. [01:56:15.400 --> 01:56:24.400] Now, here's the other thing. The person said, I'm assuming, that they saw you arrive in a car and that you appeared to be this, that, or the other. [01:56:24.400 --> 01:56:31.400] At what point did that person come in direct contact with you? At what distance? For how long? [01:56:31.400 --> 01:56:37.400] What did they hear? What did you say? How did you smell? How did you look? [01:56:37.400 --> 01:56:47.400] Those are the kind of things they're going to ask you. Did they observe you walking any distance or any acts that you may have done that seemed impaired? [01:56:47.400 --> 01:56:57.400] Now, when they use a word like seemed or appeared to be, they're asking for an opinion. That has to be objected to. [01:56:57.400 --> 01:57:05.400] They can only ask things because what they're doing there is they're asking leading questions and they're putting words in the witness's mouth. [01:57:05.400 --> 01:57:14.400] That has to be objected to. All they can say is, could you please tell us what you observed the defendant doing for the time they were at the store? [01:57:14.400 --> 01:57:17.400] And then they've got to tell them on their own. [01:57:17.400 --> 01:57:25.400] But if they tell something that can be shown to be incriminating and the video supports it, they've got what they need. [01:57:25.400 --> 01:57:28.400] Even without a blood test and even without a breathalyzer. [01:57:28.400 --> 01:57:34.400] Wait a minute. That all depends on what the jury's willing to accept as evidence. [01:57:34.400 --> 01:57:41.400] If the court says that they've got enough, they don't have to have the blood, they might can. [01:57:41.400 --> 01:57:49.400] But if you can make the case without an attorney that, hey, you don't have any evidence I was impaired. [01:57:49.400 --> 01:57:57.400] You know, I took cold medicine. I didn't know it was going to affect me that way. You see what I'm saying? [01:57:57.400 --> 01:58:04.400] Correct. Can the affidavit for probable cause be admitted at trial without the officer? [01:58:04.400 --> 01:58:08.400] Is that officer the one that signed it? [01:58:08.400 --> 01:58:09.400] Yes. [01:58:09.400 --> 01:58:19.400] Then the answer there would be yes, because it's already been recorded as an official record with a stamp on it. [01:58:19.400 --> 01:58:24.400] Gotcha.
