[01:44.640 --> 01:48.720] We oppose this order, which has implications far beyond the legal case at hand. [24:55.000 --> 25:02.560] he was never eligible for those jobs any more than rubio or cruze or obama are eligible [25:02.560 --> 25:08.120] for the ones they're after or have. [25:08.120 --> 25:17.720] albeit abbott is ineligible for a completely different reason, but it is obvious that none [25:17.720 --> 25:27.640] of them are willing to follow the constitution when it suits them to do something else. [25:27.640 --> 25:34.100] so when you throw your hat in front of a political candidate and say that's my guy, then you're [25:34.100 --> 25:42.840] also saying i don't support the constitution on whatever grounds this guy says we don't [25:42.840 --> 25:45.280] need to. [34:39.640 --> 34:44.480] So I went down to the courthouse and said, why did you change this person's name and [34:44.480 --> 34:45.480] address? [34:45.480 --> 34:48.960] And the clerk said, well, that person's not there. [34:48.960 --> 34:52.040] There's another person there, so the judge changed that. [34:52.040 --> 34:55.880] Is that a trap, or should I do something about it? [34:55.880 --> 35:01.120] If you can verify that the change is correct, then there's no worries. [35:01.120 --> 35:02.120] Okay. [35:02.120 --> 35:06.800] I didn't know if it was a trick that was common that they do or what. [35:06.800 --> 35:08.080] Normally, no. [35:08.080 --> 35:13.160] The judge can't go altering pleadings unless he can give a good faith basis for why he's [35:13.160 --> 35:14.160] doing it. [35:14.160 --> 35:20.920] In this case, if he knows who you meant to get a copy of that to be served, and he knows [35:20.920 --> 35:26.480] that you've got erroneous information there to make that happen, if he corrects it for [35:26.480 --> 35:28.360] you, that's to your benefit. [35:28.360 --> 35:29.360] Okay. [35:29.360 --> 35:32.720] But just make sure that it was correctly changed. [35:32.720 --> 35:33.720] Okay. [35:33.720 --> 35:34.720] Got it. [35:45.920 --> 35:51.720] There are six supervisors that are in this county. [35:51.720 --> 35:55.360] Do I need to list all six to be served? [35:55.360 --> 35:56.440] Would it be dangerous? [35:56.440 --> 35:57.940] Are all three relevant? [35:57.940 --> 36:00.280] Are all six relevant to the lawsuit? [36:00.280 --> 36:05.760] Do they all have something in the chain of command relative to your lawsuit, or does [36:05.760 --> 36:09.560] only one or two of them? [36:09.560 --> 36:16.040] You only need the ones that had direct authority in the chain of command or in action against [36:16.040 --> 36:20.080] you through any process in this to be named. [36:20.080 --> 36:21.340] Okay. [36:21.340 --> 36:23.720] Because the supervisors themselves are only that. [36:23.720 --> 36:26.400] They're officers with supervisory capacity. [36:26.400 --> 36:28.920] They're still not the top of the food chain. [36:28.920 --> 36:29.920] Uh-huh. [36:29.920 --> 36:36.640] So you only need the ones that were directly involved in some manner to be named and sued, [36:36.640 --> 36:38.440] and then you go above them. [36:38.440 --> 36:43.800] Those will be the hands you want to slap that have authority over all of that area. [36:43.800 --> 36:48.320] Do I list them as defendants or as the people to serve? [36:48.320 --> 36:53.200] Well, you only have to serve people that are listed as defendants. [36:53.200 --> 37:00.160] If you are bringing their actions into the case as the basis for your claim, then you [37:00.160 --> 37:04.280] name them as a defendant and you serve them as a defendant. [37:04.280 --> 37:05.280] Got it. [37:05.280 --> 37:06.280] Okay. [37:06.280 --> 37:16.640] And question three, if I was arrested, Randy calls that aggravated kidnapping. [37:16.640 --> 37:22.240] If the arrest was false and without any lawful purpose, okay? [37:22.240 --> 37:28.640] And they removed you under force while displaying a deadly weapon from point A to point B against [37:28.640 --> 37:31.040] your will and secreted you from the public. [37:31.040 --> 37:35.800] Now that's the criteria in Texas, okay, for aggravated kidnapping. [37:35.800 --> 37:38.120] They have to be displaying a deadly weapon. [37:38.120 --> 37:42.200] They have to move you from one place to another against your will, and they have to secret [37:42.200 --> 37:45.680] you from the public or prevent you from having access to. [37:45.680 --> 37:46.680] Okay. [37:46.680 --> 37:47.680] Okay? [37:47.680 --> 37:50.320] In which case that becomes aggravated kidnapping. [37:50.320 --> 37:57.200] That may or may not be the full set of criteria in Mississippi, but it probably is. [37:57.200 --> 38:04.520] When I'm typing up the facts section on my complaint, do I want to list that the police [38:04.520 --> 38:10.120] officer committed aggravated kidnapping or do I just want to say I was arrested and taken [38:10.120 --> 38:11.600] to jail? [38:11.600 --> 38:15.580] No, you can assert the elements of aggravated kidnapping. [38:15.580 --> 38:21.320] You can say the officer did this, this, this, and each one of this is an element from the [38:21.320 --> 38:24.320] aggravated kidnapping statute. [38:24.320 --> 38:30.800] The officer placed a plaintiff in handcuffs, removed plaintiff from this location into the [38:30.800 --> 38:36.760] back of a police cruiser and transported plaintiff from this location to the county jail approximately [38:36.760 --> 38:43.560] X miles away, then ordered that plaintiff be booked into a jail cell away from the general [38:43.560 --> 38:53.320] public without any commitment order, warrant, or valid legal allegation for doing so. [38:53.320 --> 38:54.320] Okay. [38:54.320 --> 39:00.960] Thus, plaintiff alleges and believes that defendant, whatever their name is, committed [39:00.960 --> 39:07.260] aggravated kidnapping and that they were aided and assisted in this kidnapping by any other [39:07.260 --> 39:09.680] officers that helped. [39:09.680 --> 39:12.360] Got it. [39:12.360 --> 39:15.120] That was wonderful. [39:15.120 --> 39:16.120] I'm done. [39:16.120 --> 39:17.120] I'm going to let you move on. [39:53.640 --> 40:01.480] In Texas, you can commit aggravated assault as a public servant if you display a deadly [40:01.480 --> 40:05.600] weapon while committing simple assault. [40:05.600 --> 40:11.000] Simple assault is defined as any level of touching which the other person would find [40:11.000 --> 40:17.560] offensive that results in any form of bodily injury that can be seen. [40:17.560 --> 40:24.960] It doesn't matter if it's a red skin, a scrape, a bruise, an indentation from the handcuffs. [40:24.960 --> 40:29.400] If they put them on too tight and cause your wrist to go numb or your hands or fingers [40:29.400 --> 40:35.100] to go numb, that could have resulted in nerve damage, which you need a doctor to verify, [40:35.100 --> 40:37.920] but that would be simple assault. [40:37.920 --> 40:45.720] The added thing of a deadly weapon being displayed then makes it aggravated assault. [40:45.720 --> 40:49.080] And wearing on the side of their hip is also considered display? [40:49.080 --> 40:50.640] Did you see it? [40:50.640 --> 40:51.640] Yes. [40:51.640 --> 40:55.560] Did you feel like they could access it and use it at any moment? [40:55.560 --> 40:56.560] Absolutely. [50:46.480 --> 50:49.920] Can I see your driver's license and your insurance? [50:49.920 --> 50:50.920] And as polite as could be. [50:50.920 --> 50:54.600] I said, well, sir, did any of that information ask that you used against me in the court [50:54.600 --> 50:55.600] of law? [50:55.600 --> 51:00.560] And he kind of just grinned and looked at me and he said, now, sir, if you're on the [51:00.560 --> 51:05.040] public highway in your vehicle, you need a driver's license. [51:05.040 --> 51:07.320] And I said, you are absolutely correct, sir. [51:07.320 --> 51:11.320] I go, but however, I am in my convenience of choice and I'm simply traveling from point [51:11.320 --> 51:17.200] A to point B. I go, sir, therefore, I'm not in the regulatory activity of commerce, vehicle [51:17.200 --> 51:20.200] for hiring and transportation. [51:20.200 --> 51:21.480] He gave me another grin. [51:21.480 --> 51:25.200] He said, look, if you're going to be on these roads, you need a driver's license, now give [51:25.200 --> 51:27.360] me a driver's license. [51:27.360 --> 51:32.520] And I said, well, sorry, sir, if that information gives me a court of law, I'd like to use my [51:32.520 --> 51:35.840] Fifth Amendment rights and not produce any other information. [01:05:00.400 --> 01:05:07.120] Now I picked up a second offense about a week ago, which they arrested me for instead of [01:05:07.120 --> 01:05:14.080] just giving me the ticket, told my recreational conveyance again, which I'd just gotten back [01:05:14.080 --> 01:05:22.160] out of tow three days earlier, in which they broke into my home, stole my cat, locked him [01:05:22.160 --> 01:05:27.680] up in the kennel and I'm struggling to keep him alive right now and to force feed him [01:05:27.680 --> 01:05:38.840] yesterday, but since that first offense is gone, now the second offense is going to be [01:05:38.840 --> 01:05:48.560] changed to first offense, second offense being a misdemeanor, first being civil, but the [01:05:48.560 --> 01:05:54.240] thing is the second offense can only be if you're convicted on the first offense, right? [01:05:54.240 --> 01:05:59.240] It can't be simply that you were charged, you have to have been convicted, if it was [01:05:59.240 --> 01:06:03.840] dismissed you weren't convicted, so there is no second offense. [01:06:03.840 --> 01:06:10.280] Well, this was my argument when they took me to jail, I told them, I said the first [01:06:10.280 --> 01:06:15.480] offense has not been adjudicated, therefore there cannot be a second, while I sat in jail [01:06:15.480 --> 01:06:24.600] for five days with a $25 bond and went before two magistrates and even the second one was [01:06:24.600 --> 01:06:30.760] leaning towards giving me ROR and then he read the officer's statement that said that [01:06:30.760 --> 01:06:38.240] I claimed to be a sovereign citizen and all this other garbage that I never said and that [01:06:38.240 --> 01:06:45.760] turned the judge and surprisingly enough the prosecutor at that time argued on my behalf [01:06:45.760 --> 01:06:50.200] to our army. [01:06:50.200 --> 01:06:52.800] And? [01:06:52.800 --> 01:06:58.400] And lost, we were both arguing for me and the judge was like no way. [01:06:58.400 --> 01:07:05.160] So the judge left you in jail on a bond for a civil offense without any authority to do [01:07:05.160 --> 01:07:11.680] so, because the arrest itself was unlawful. [01:07:11.680 --> 01:07:17.080] I brought that up to him, I said the first offense has not been adjudicated, therefore [01:07:17.080 --> 01:07:18.080] my... [01:11:23.720 --> 01:11:30.480] I don't know whether I want to plead guilty, not guilty or no contest and he kept going [01:11:30.480 --> 01:11:34.120] and I kept arguing and kept objecting. [01:49:26.440 --> 01:49:30.440] And I have everything that you sent to me, and I'm going to use that, [01:49:30.440 --> 01:49:34.440] where the officer didn't have his statement of facts, he didn't have a warrant, [01:49:34.440 --> 01:49:39.440] he didn't have any probable cause to be able to initiate the traffic stop in the first place for a civil infraction.
