thing about it is, is this motion is a subject matter jurisdiction motion [07:44.500 --> 07:56.500] which, you can still raise the issue of subject matter jurisdiction at any time, doesn't matter what they do tomorrow, you can still file the motion and challenge everything they did [07:56.500 --> 08:06.500] so tomorrow, tomorrow's irrelevant in what they do, you could go down there and twiddle your thumbs and crochet the whole time and it wouldn't make any difference [08:06.500 --> 08:13.500] because this motion is specifically written to challenge the court's jurisdiction to do anything [08:13.500 --> 08:15.500] correct, I understand that [08:15.500 --> 08:19.500] okay, okay, so [08:19.500 --> 08:28.500] what you could do tomorrow is go in there and say that you're still looking for legal counsel because they're going to ask you if you're prepared to go to proceed [08:28.500 --> 08:31.500] all you have to do is say no [08:31.500 --> 08:42.500] I am attempting to get legal assistance for this matter and I have the calls in but no one has returned those calls, now that's what you could do [08:42.500 --> 08:45.500] and they could have, you know, they can do whatever they're going to do [08:45.500 --> 08:52.500] but you still need to go in there, the first word, well unfortunately you have this problem [08:52.500 --> 08:56.500] first off, how long ago was it when you entered your plea [08:56.500 --> 08:58.500] um, October [08:58.500 --> 09:04.500] in October, was this before or after you started coming to my class [09:04.500 --> 09:06.500] before [09:06.500 --> 09:08.500] you're sure [09:08.500 --> 09:09.500] I think so [09:09.500 --> 09:14.500] okay, and how about, how often had you heard the show prior to that time [09:14.500 --> 09:18.500] oh, well, five years ago, I heard you on Alex [09:18.500 --> 09:22.500] you heard me five years ago but you haven't heard me since [09:22.500 --> 09:28.500] well, I keep my nose pretty clean, I stay under the radar, I don't want to do this kind of stuff [09:28.500 --> 09:32.500] but I'll take it on when I know it's wrong [09:32.500 --> 09:40.500] well, you can't do both, that's kind of a contradiction in terms, because this stuff goes on every day [09:40.500 --> 09:41.500] okay [09:41.500 --> 09:47.500] I just, you know, not to speed, I really work hard and it was a neighborhood [09:47.500 --> 09:57.500] and I did find out that the city has never done its fiduciary responsibility of making sure that it can be lowered from 30 to 25 in the neighborhood [09:57.500 --> 10:05.500] if they've never, well, the problem is, is you don't have any way to get that up there, what you can do is you can ask the officer about it [10:05.500 --> 10:13.500] they're going to prevent him from having to answer the question by saying that, hey, he's not required to know that [10:13.500 --> 10:19.500] and then you can say, well, someone by the city's required to know that, someone in the city's required to do it [10:19.500 --> 10:24.500] the problem you're going to have is they're going to say, well, you had the opportunity to find out who that was through discovery [10:24.500 --> 10:30.500] see, they throw you in this knowing full well you have no clue how to swim [10:30.500 --> 10:37.500] okay, first off, they know you don't know how to swim, not in their pool, because their pool is full of quicksand [10:37.500 --> 10:40.500] and they're the only ones with a tether to get them out [10:40.500 --> 10:44.500] you have nothing, and that's what they count on [10:44.500 --> 10:50.500] everything about what you're going to experience tomorrow is completely corrupt and underhanded [10:50.500 --> 10:54.500] there is no other description for it, okay [10:54.500 --> 10:55.500] okay [10:55.500 --> 11:05.500] so what you can do when you go in there first thing is say, no, I challenge the jurisdiction of this court to act in this matter against me personally [11:05.500 --> 11:12.500] I do not consent to it, and I am not prepared to go to trial where jurisdiction has not been proven on the record [11:12.500 --> 11:14.500] you can do that, okay [11:14.500 --> 11:15.500] okay [11:15.500 --> 11:24.500] but the problem is the motion to be as effective as we need it to be needs to be notarized [11:24.500 --> 11:30.500] you can file it without it along with the supporting documents, but they're going to turn around and try to say it's too late [11:30.500 --> 11:34.500] even though this is a written challenge to jurisdiction [11:34.500 --> 11:39.500] and the problem that I see with you taking it in there is this [11:39.500 --> 11:44.500] and don't take this personally, but you're not assertive enough [11:44.500 --> 11:48.500] you let them bully you [11:48.500 --> 11:55.500] okay, and the reason I know this is because of how worried you've been about tomorrow [11:55.500 --> 12:00.500] you're afraid of what they will do because you don't know enough to make them stop [12:00.500 --> 12:01.500] am I right? [12:01.500 --> 12:02.500] right [12:02.500 --> 12:03.500] okay [12:03.500 --> 12:04.500] correct [12:04.500 --> 12:12.500] so this is not going to fly if they can bully you into avoiding it rather than standing on it [12:12.500 --> 12:14.500] that's the problem [12:14.500 --> 12:25.500] hence the reason why I so much did not want to have to put this motion in the hands of people to file it that were not prepared to fight [12:25.500 --> 12:29.500] because it's only going to work if they are [12:29.500 --> 12:30.500] okay [12:30.500 --> 12:31.500] all right [12:31.500 --> 12:32.500] so [12:32.500 --> 12:33.500] yes sir [12:33.500 --> 12:35.500] you can file it [12:35.500 --> 12:42.500] I would wage money on them attempting to just trump on you anyway [12:42.500 --> 12:44.500] but listen carefully [12:44.500 --> 12:48.500] if they do that all you have to do is object [12:48.500 --> 12:50.500] okay [12:50.500 --> 12:55.500] that's all you got to do, objection, the court lacks jurisdiction [12:55.500 --> 12:58.500] I do not consent [12:58.500 --> 13:05.500] and then whatever they do from that point forward has been preserved as jurisdictional error [13:05.500 --> 13:08.500] whether you file the motion or not [13:08.500 --> 13:15.500] and then we can go and file the written motion on the appeal which you would have to make sure you follow through with [13:15.500 --> 13:18.500] or it would be a moot point [13:18.500 --> 13:19.500] okay [13:19.500 --> 13:20.500] all right [13:20.500 --> 13:26.500] now the other thing you're going to have to know is whether or not this is a court of record [13:26.500 --> 13:33.500] because whether or not it is affects the amount of time you've got to make that appeal happen [13:33.500 --> 13:39.500] and what you have to do to make it happen [13:39.500 --> 13:41.500] are you following me? [13:41.500 --> 13:43.500] I'm taking notes, yes sir [13:43.500 --> 13:51.500] okay so the problem here is if this is a court of no record you've got five days to file your motion for new trial [13:51.500 --> 13:55.500] you've got ten days [13:55.500 --> 13:59.500] they run together now not separately [13:59.500 --> 14:05.500] five days for the motion for new trial and ten days to perfect the appeal and the bond [14:05.500 --> 14:11.500] which means you file a notice of appeal and you pay double the fines to perfect the bond [14:11.500 --> 14:19.500] now you could do all of that with a surety and never put money in their hands and under no circumstances should anyone ever put money in their hands [14:19.500 --> 14:24.500] because they will do everything to never give it back again once you have [14:24.500 --> 14:25.500] okay [14:25.500 --> 14:32.500] but if you take this up on appeal then we can get the complete motion filed for the purpose of appeal [14:32.500 --> 14:39.500] because your appeal brief is different than your motion for new trial as far as the time frame goes [14:39.500 --> 14:46.500] all right so once again I'm going to step up there hello hello hello and then I say [14:46.500 --> 14:55.500] you're not even going to say hello you're going to say judge I am here to challenge the personal and subject matter jurisdiction of this court [14:55.500 --> 15:00.500] it has never had it it will never get it [15:00.500 --> 15:11.500] there is no evidence in the record that I was engaged in an activity that is vesting this court with jurisdiction none [15:11.500 --> 15:13.500] okay [15:13.500 --> 15:23.500] all right now like I said you can file that motion as it is with the certified documents and the other documents that go with it [15:23.500 --> 15:29.500] and they're going to try to poo poo them and say you can't file these now and you're going to have to say objection [15:29.500 --> 15:41.500] this is a subject matter jurisdiction challenge I can do that anytime I want to [15:41.500 --> 15:48.500] and if this is not a court of record it won't matter what all you say at all [15:48.500 --> 15:55.500] but if it is a court of record if you don't say this then it's not going to reflect well in the record of you trying to preserve the error [15:55.500 --> 16:03.500] but it's still a subject matter jurisdiction issue and it can still be raised even if you do it wrong [16:03.500 --> 16:04.500] okay [16:04.500 --> 16:13.500] so what happens tomorrow is not the end of the line if you are prepared to fight back afterward [16:13.500 --> 16:17.500] but you need to be able to do as much upfront as you can [16:17.500 --> 16:20.500] all right [16:20.500 --> 16:26.500] so if you cannot get to a notary before 830 then just sign it and file is most apropos as to the truth of things regardless of the belief of things [25:01.500 --> 25:13.500] now for those of you that don't know what it is a legal maxim is supposed to be an assertion of fact so true that it is absolutely irrefutable [25:13.500 --> 25:24.500] okay that is supposed to be what a maxim of law is it's just like the maxim something similar is never the same [25:24.500 --> 25:34.500] it is a truth so true it can't be rebutted okay that's what a legal maxim is supposed to be [25:34.500 --> 25:40.500] well I'm not going to read you the Latin version of this one because it's kind of long but I'm going to read you the English translation of this [25:40.500 --> 25:43.500] and then I'm going to tell you my thoughts on it [25:43.500 --> 25:54.500] the decision of a judge may be impugned only for error either in law or a fact but his honesty of purpose or office cannot be questioned [25:54.500 --> 26:04.500] whatever moron came up with that maxim of law has obviously never been subjected to or made familiar with in any way [26:04.500 --> 26:11.500] the legal and due process atrocities and abuses of a Texas justice or municipal court [26:11.500 --> 26:19.500] okay the judges in these courts openly conspire with the prosecutor against the accused [26:19.500 --> 26:30.500] they directly violate and subvert the rules and the law and the due process rights of anyone appearing in that court [26:30.500 --> 26:48.500] yet this maxim would have us believe that the motives of a criminal acting criminally are never to be challenged as long as he's acting in a capacity that authorizes his criminality [26:48.500 --> 26:54.500] this maxim is not irrefutable not in my book [26:54.500 --> 27:04.500] all right that being said I want to go over a little bit of what I'm eventually going to put into the lawsuit over this [27:04.500 --> 27:11.500] but part of this goes to dealing with like Sandra Bland's issue for instance the Texas transportation code [27:11.500 --> 27:19.500] even if it were constitutional which it absolutely is not I now have the certified documents that prove that [27:19.500 --> 27:28.500] I am filing a lawsuit because of that and I need your financial assistance in making that happen and here's why [27:28.500 --> 27:34.500] okay and I'll get to the other this back to this here in a second but here's why lawsuits don't come cheap [27:34.500 --> 27:43.500] here's the way I'm having to look at this I don't have any choice I have spent literally years of my life [27:43.500 --> 27:55.500] trying to find how this system got its power to protect people from the abuse of that power and the corruption involved [27:55.500 --> 28:04.500] so that they stop stealing us enslaving us and taking from us in any way I can [28:04.500 --> 28:15.500] it has cost me a business it has cost me a marriage it has cost me time in jail it has cost me money out of my pocket to fight this crap [28:15.500 --> 28:24.500] every single step of the way while everybody else reaps the benefits of my successes when and where they come [28:24.500 --> 28:35.500] they reap the benefit of the experiences I have developed firsthand at no expense to themselves most of the time [28:35.500 --> 28:47.500] so for just once okay I am about to do something that benefits right up front every single person [28:47.500 --> 28:59.500] within the territorial boundaries of the entire geographical region called Texas and potentially many outside of that region [28:59.500 --> 29:13.500] by setting an example both in case law and in attitude and it's gonna cost me just as everything else has [29:13.500 --> 29:25.500] win lose or draw it's gonna cost me okay but you once again are gonna be the people that ultimately reap the benefit [29:25.500 --> [33:28.500 --> 33:57.500] Alright folks, we are back [33:57.500 --> 33:59.500] This is Rule of Law Radio [33:59.500 --> 34:06.500] Alright, now I want to go into this a little bit and let you know what's going on here and some of the stuff that we're going to be bringing up in this lawsuit [34:06.500 --> 34:17.500] First off we're going to bring up documented evidence that the intent of the Texas legislature was to limit commercial activity or regulate commercial activity upon the highways [34:17.500 --> 34:30.500] The code that all this is attached to was never intended to be applied to the general public. The documentation, the purpose of the legislature shows that to be absolutely 100% true [34:30.500 --> 34:38.500] They never defined the term transportation but there is one that exists and it's got nothing to do with you and me [34:38.500 --> 34:57.500] Never did, not even prior to its recodification in 1995. The 1995 recodification SB 971, the bill tells us very clearly that it is a recodification of existing statutes relating to transportation [34:57.500 --> 35:09.500] Which means that's what they were relating to before they were recodified and it's what they have to relate to after they're recodified because it also says these are non-substantive changes [35:09.500 --> 35:23.500] And the reason that they cannot apply this code to us is because we have a right to move about of our own free will, our own volition and our own whim using our own property [35:23.500 --> 35:43.500] The cars we move about in belong to us, they are our property. If we bought them to use to travel from here to there, then it is an unlawful taking by the state to make us register it and get a license from them to use the property we bought [35:43.500 --> 36:00.500] It's an unlawful taking. The courts have said time and time again such is an unlawful taking. Plus the fact the highways don't belong to the state, they belong to the people of the state for their own free use [36:00.500 --> 36:10.500] Any other use is an extraordinary use. When it's used as a place of business, that's an extraordinary use, not an ordinary use [36:10.500 --> 36:23.500] So the application of the transportation code to the people of Texas that are not engaging in transportation was unconstitutional and illegal from day one [36:23.500 --> 36:41.500] And if you watched the news on the subject, it was this very misapplication of this unconstitutional statutory scheme that was directly responsible for the assault, kidnapping and death of Sandra Bland [36:41.500 --> 36:59.500] It was this misapplication that caused the death of injuries and incarcerations and thefts and kidnappings of thousands upon thousands of people just in Texas [36:59.500 --> 37:17.500] Every single day someone is assaulted, accosted, shot, killed, abused, injured or jailed illegally under a code that doesn't apply to them [37:17.500 --> 37:34.500] So one has to ask the question, are our cops really this stupid or are they actually intentionally trained to be ignorant of these facts? [37:34.500 --> 37:50.500] If you talk to one, he'll tell you right away that he's gone to school for this, he's been taught this, but not once will they ever admit that they have sat down and studied the transportation code or the law that created it in the form of SB 971 [37:50.500 --> 38:08.500] Because they haven't. They'll try to tell you, they may try to puff up and say, yeah, I've read it and I'm in law enforcement, I know it better than you. Hey, news flash Beauregard, wearing a badge does not increase your IQ [38:08.500 --> 38:24.500] Wearing a badge and working in law enforcement is not automatically the granting of intellect, intelligence or knowledge and understanding of legalese in any way, shape or form [38:24.500 --> 38:34.500] Because if it were, you would be arresting the people that made that law and not the people that it's abused upon [38:34.500 --> 38:42.500] But then again, logic also like reason and understanding is not the forte for which these individuals are hired [38:42.500 --> 38:58.500] It is their willingness to follow orders, do what they're told and inflict whatever level of pain, punishment or death is required for those at the top to maintain control of those that they see as being at the bottom [38:58.500 --> 39:04.500] That, ladies and gentlemen, would be you and I [39:04.500 --> 39:31.500] Now, when DPS trooper Brian Encina or Encina accosted Sandra Bland, there's the, I've heard all kinds of analysis of the videos relating to her stop from all kinds of attorneys, legal scholars, so-called investigative reporters [39:31.500 --> 39:42.500] And they all touch on a small bit of truth or no truth at all, depending upon what their personal perspective of right, wrong and law actually is [39:42.500 --> 40:10.500] But the one thing that is universal across all of these videos is that not a single one at any time ever mentioned the actual law that gave him that authority as being SB 971 and that it only dealt with transportation [40:10.500 --> 40:17.500] Why? Because they haven't read it. They don't care. There's no motivation for them to care [40:17.500 --> 40:29.500] Because they've got money to earn by lying to everybody else that sits in their classrooms or is in a courtroom with them. It doesn't matter [40:29.500 --> 40:48.500] The system is designed to take away your ability to question what it does. And it does this by making you want to do anything but learn what needs questioning [40:48.500 --> 41:06.500] And that's pretty much how they're getting their hands into everything, because you would rather be distracted by something else than to do what's necessary to protect your rights and govern yourselves from things like this [41:06.500 --> 41:20.500] See, the part about this for me that is so hard for me to understand, and it's not because I believe I'm more intelligent than everybody else, it's not. It's none of that [41:20.500 --> 41:28.500] It's absolutely none of that. I don't believe I'm the smartest individual in any room I'm in [41:28.500 --> 41:45.500] Until it comes to this specific subject, because all I have to do is stand there and listen to someone else talk about it as if they understand it, and I know right away that they don't [41:45.500 --> 41:59.500] And if I went around and was able to listen in on the conversations dealing with this particular subject, and these are people that have never been in my class or listened to my radio show, and even some that have [41:59.500 --> 42:10.500] And listen to how they translate what they think they understand into words for someone else to hear, they won't even be close [42:10.500 --> 42:24.500] It's like that old game you play as a child around the campfire in camp or on a big field trip or something like that where you start off, one person is given a phrase and what to say [42:24.500 --> 42:31.500] And they have to whisper it in the ear of the person to their right or to their left, and it goes all the way around the circle back to the person [42:31.500 --> 42:43.500] And then it stops at the person on the opposite side of where they started, and that person has to say out loud what that phrase was [42:43.500 --> 42:48.500] And it's almost always different than the one it started out with [42:48.500 --> 43:06.500] So that is exactly how this turns out, because everybody takes it from someone else rather than every one of them looking at the same scrap of paper that had the phrase written on it [43:06.500 --> 43:12.500] So that everyone started off on the same page [43:12.500 --> 43:20.500] And the thing that astounds me is that nobody makes that effort [43:20.500 --> 43:27.500] I came to a conclusion a long time ago when it comes to discussing virtually anything with people [43:27.500 --> 43:32.500] And that is that you can tell me anything you want [43:32.500 --> 43:41.500] My level of belief will be directly affected by your ability to prove to me that you know what the hell you're talking about [43:41.500 --> 43:50.500] Unless it's something I have already delved into personally, I take nobody's word for nothing [43:50.500 --> 43:55.500] So we legal research by her [47:43.500 --> 47:54.500] When in fact they're documents the Constitution says the legislature is required to maintain as records of a bill's progress through the legislature [47:54.500 --> 48:02.500] And those records are in the journals of the houses that are in the hands of the Secretary of State for record keeping [48:02.500 --> 48:09.500] And she's trying to tell me that's legal research but the bill to which those records pertain isn't legal research [48:09.500 --> 48:18.500] No they're public records and I want them but I'm having to fight to get them just like I have every other scrap of paper I've ever gotten from these people [48:18.500 --> 48:24.500] Despite a policy of open governmental records in Texas [48:24.500 --> 48:37.500] They do their best to hide as much from us as possible and they get away with it because we're worse than the drunk sitting in a Siegfried and Roy show in Vegas [48:37.500 --> 48:42.500] Oh look at that trick that was good how do you think you did that? [48:42.500 --> 48:48.500] Hey where'd the tiger go? Where'd Roy go? Why is he bleeding? [48:48.500 --> 48:58.500] Just stupid stuff that we ought to know better than and they get away with it because no one pays any attention to what they're doing [48:58.500 --> 49:08.500] Well we pay attention we pay attention for your benefit we pay attention for our benefit we fight so that we're all free [49:08.500 --> 49:15.500] But what would be the point if we're the only ones that wants to be free? [49:15.500 --> 49:25.500] What would be the point if everybody else sits back and lets the few folks that are sitting up here on this show and on this network [49:25.500 --> 49:34.500] Do these things and make self sacrifice of these things and then tell them hey great job [49:34.500 --> 49:41.500] Great we have a cheering section but doesn't help us okay [49:41.500 --> 49:46.500] We need your financial support I need it for this lawsuit Debra needs it to pay the bills for the network [49:46.500 --> 49:54.500] The electric and everything else to keep all this stuff running okay that's why every year she starts the fundraiser at the beginning of the year [49:54.500 --> 50:00.500] Unfortunately this year I managed to get my hands at least on some of the primary documents I need [50:00.500 --> 50:06.500] And hopefully in time to get a lawsuit off the ground that won't die out before I have it [50:06.500 --> 50:11.500] So we're having conflicting things going on here with fundraising [50:11.500 --> 50:18.500] But the thing about the motion that I'm doing is this right now I'm offering that motion to everybody for 100 bucks [50:18.500 --> 50:26.500] Okay but here's the deal come February 29th that motion is 200 bucks okay [50:26.500 --> 50:37.500] And I don't know what else to tell you that that motion alone is going to save you way more than 200 bucks by the time they got done with you in one of these traffic courts [50:37.500 --> 50:42.500] And the only way you would have gotten out any cheaper would be just to pay it and walk away [50:42.500 --> 50:50.500] But if you pay it and walk away then you're going to pay the next one and walk away too so you're going to go over 200 bucks regardless [50:50.500 --> 50:56.500] It may take time but it's going to happen [50:56.500 --> 51:04.500] But what choice are we getting we've gotten only a handful of people that have gotten a copy a preliminary copy to even study [51:04.500 --> 51:16.500] They paid for it and I sent them what I've started with but I still have to finish hashing this out because it's broken down into three separate challenges [51:16.500 --> 51:25.500] Okay and I'm working on getting the last two put together the constitutional challenge is done it's just got to be organized it's completely written [51:25.500 --> 51:33.500] The others are mostly written and still need to be organized then everything's got to be tagged tabled and ready to be filed [51:33.500 --> 51:40.500] So there's work involved in this it takes a lot of time and effort and I hate to belabor that point [51:40.500 --> 51:50.500] But I am so tired of living on light bread and lunch meat it's not even funny [51:50.500 --> 52:02.500] I can't pay bills every month because this is all I do and I do it with the purpose that you guys are worth it because I'm worth it [52:02.500 --> 52:08.500] I want to be free I want to be left alone [52:08.500 --> 52:17.500] Then I could do what I wanted to do to earn the money that I need to live on to exchange the goods and services that I'm capable of providing [52:17.500 --> 52:24.500] Well folks that's all this is this is a good and service I am capable of providing [52:24.500 --> 52:32.500] That for some reason most people are not capable of providing to themselves like most services tend to be [52:32.500 --> 52:39.500] Either they don't know enough don't want to know enough don't care enough doesn't matter what the reason is they just don't do it [52:39.500 --> 52:45.500] This however is something we all need to learn to do for obvious reasons [52:45.500 --> 52:55.500] But since not everybody can do it and not everybody will do it it's up to people like us on this network that do [52:55.500 --> 52:59.500] What is that worth to you in the long run? [01:03:26.500 --> 01:03:36.500] Alright, now there is something else before I start taking callers that I want to read you that is from a Texas Supreme Court case decided just last year [01:03:36.500 --> 01:03:43.500] Now listen carefully to this. This is Texas's own Supreme Court [01:03:43.500 --> 01:03:54.500] As mentioned earlier, the term judicial activism is a legal Rorschach test. I oppose judicial activism, inventing rights not noted in the law, or not rooted in the law [01:03:54.500 --> 01:04:06.500] But the opposite extreme, judicial pacifism, is corrosive too. Judges who, while not activists, are not active in preserving the liberties and the limits our framers actually enshrined [01:04:06.500 --> 01:04:16.500] The Texas Constitution is irrefutably framed in prescription, imposing unsubtle and unmistakable limits on government power [01:04:16.500 --> 01:04:25.500] It models the federal Constitution in a fundamental way, dividing government power so that each branch checks and balances the other [01:04:25.500 --> 01:04:45.500] But as we recently observed, the Texas Constitution takes Madison a step further by including, unlike the federal Constitution, an explicit separation of powers provision to curb overreaching and to spur rival branches to guard their prerogatives [01:04:45.500 --> 01:05:00.500] The Texas Constitution constrains government power in another distinctive way. It lacks a necessary and proper clause, often invoked to expand Congress's powers beyond those specifically enumerated [01:05:00.500 --> 01:05:11.500] Moreover, as noted above, it contains a privilege or immunities clause that, unlike the federal version, has never been judicially nullified [01:05:11.500 --> 01:05:24.500] As judges, we have no business second-guessing policy decisions. But when the Constitution is at stake, it is not impolite to say no to government [01:05:24.500 --> 01:05:33.500] Liberties for we the people necessarily mean limits on we the government. That's the very reason Constitutions are written [01:05:33.500 --> 01:05:42.500] Where have I heard that before? To stop government abuses, not to ratify them [01:05:42.500 --> 01:05:58.500] Our supreme duty to our dual Constitutions and to their shared purpose to secure the blessings of liberty require us to check constitutionally verboten actions, not rubber-stamp them under the banner of majoritarianism [01:05:58.500 --> 01:06:08.500] For people to live their lives as they see fit, a government of limited powers must exercise that power, not with force but with reason [01:06:08.500 --> 01:06:14.500] And an independent judiciary must judge government actions, not merely rationalize them [01:06:14.500 --> 01:06:35.500] Judicial restraint doesn't require courts to ignore the non-restraint of other branches, not when their actions imperil the constitutional liberties of people increasingly hamstrung in their enjoyment of life, liberty, and the pursuit of happiness [01:06:35.500 --> 01:06:51.500] The power to protect the public is a heady and fearsome one. Government is charged with promoting the general welfare, but it must always act within constitutional constraints [01:06:51.500 --> 01:06:55.500] That was from our own Supreme Court here in Texas [01:06:55.500 --> 01:07:21.500] Now, I've read many of our Supreme Court cases in relation to challenges to constitutional issues here in Texas, and it has been an extremely long time since I have found one that even marginally recognizes the existence of the Texas Constitution as the controlling basis of law in this entire Republic [01:07:21.500 --> 01:07:37.500] But this case that I'm reading from is 50 some odd pages long in the opinion, and virtually every other paragraph is about limiting government under the Texas Constitution [01:07:37.500 --> 01:07:52.500] Now, this particular case is specifically relevant to occupational licensing because that was the issue before the court in this case [01:07:52.500 --> 01:08:07.500] And the occupational licensing discussion portion of this motion, the Texas Supreme Court did a very odd thing, unless of course you're me and fully understand why it isn't odd at all [01:08:07.500 --> 01:08:18.500] While they're discussing occupational license and the state's right to license certain activities, it goes through listing certain occupations, for instance [01:08:18.500 --> 01:08:39.500] It states that one cannot practice medicine in Texas without a medical license, and right next to that it says one cannot zoom down I-130 in Austin or outside of Austin without a driver's license [01:08:39.500 --> 01:08:51.500] Now, knowing what I know about the transportation code and the bill that created the transportation code and the legislative intent stated in the title of that bill that created the transportation code [01:08:51.500 --> 01:09:02.500] I know exactly what the court is alluding to, but I would bet you a stack of dollars from here to Pluto and back [01:09:02.500 --> 01:09:09.500] That there are going to be attorneys that attempt to argue that is not what the court meant [01:09:09.500 --> 01:09:15.500] But let's look at facts. This is an occupational licensing case [01:09:15.500 --> 01:09:23.500] The court is listing specific occupations which Texas recognizes as requiring to be licensed to engage in them [01:09:23.500 --> 01:09:36.500] Right next to the occupation of practicing medicine is a discussion on driver's licenses before you can zoom on the highway [01:09:36.500 --> 01:09:54.500] If it has nothing to do with commerce and economics, why is the driver's license mentioned in an occupational licensing case at all? [01:09:54.500 --> 01:10:12.500] Could it possibly be that we are now at a point where someone on the Texas Supreme Court actually bothered to read the damn bill to know exactly what this code is for? [01:10:12.500 --> 01:10:27.500] But they never get to hear any issues on it because it's all been criminalized, so the other Texas Supreme Court in the Court of Criminal Appeals keeps ruling on it and ruling incorrectly, and every court between us and them does the same thing [01:10:27.500 --> 01:10:49.500] But folks, I'm not going in on a criminal action where they get to come after me. I'm filing a lawsuit to go after them, which means my case will go to the same Supreme Court that wrote this case that alludes to the fact that driver's licenses are in fact occupational [01:10:49.500 --> 01:11:06.500] I have the chance to put this before a court that recognizes the code for exactly what it is, but I don't have the money to get there [01:11:06.500 --> 01:11:24.500] That's where you guys come in. Once again, for your own benefit, help us with the money. It couldn't be any simpler than that. No one around here was born with deep pockets [01:11:24.500 --> 01:11:50.500] They've given up everything to make everybody out there aware of what's going on. I know I have. I know Deborah and Jerry have. I know just like everybody else out there, we fight every single day against a system whose sole purpose is to suck the lifeblood and wealth and opportunity out of everything we say or do [01:11:50.500 --> 01:12:09.500] We can fix this this time. I'm holding in my hand my Louisiana driver's license. [01:15:22.500 --> 01:15:29.500] And I noticed on the back of it, the lower right hand corner, it says, printed on the back of the license, [01:15:29.500 --> 01:15:44.500] holder of this license must be 21 years of age or older to utilize the privileges of this license and interstate commerce pursuant to 49 Code of Federal Regulations 391.11. [01:15:44.500 --> 01:15:48.500] Right. This is what I've told everybody on this show multiple times. [01:15:48.500 --> 01:15:58.500] Every state's motor vehicle slash transportation code is based on 49 USC, every one of them. [01:15:58.500 --> 01:16:05.500] They all get permission to do what they're doing from the Fed. And you know how we know this? [01:16:05.500 --> 01:16:15.500] That's it on the license. That's one way. That's a definite key. But how is your Louisiana license good in Texas? [01:16:15.500 --> 01:16:22.500] Yes. Well, how could that possibly be? How could your license for Louisiana be any good in Texas? [01:16:22.500 --> 01:16:32.500] Through a dual state agreement. Correct. And what does the federal Constitution say about states entering into agreements? [01:16:32.500 --> 01:16:36.500] Think about that while we're on break and we'll pick you up on the other side. [01:19:49.500 --> 01:20:00.500] The federal Constitution says that no state may enter into any contract, compact or other form of agreement without congressional approval. [01:20:00.500 --> 01:20:10.500] What is the only power through which the federal Congress may directly impact the people of the states? [01:20:10.500 --> 01:20:13.500] Through the Regulation of Commerce. [01:20:13.500 --> 01:20:28.500] The Commerce Clause. Therefore, where would they get authority to approve a licensing scheme if that scheme did not relate to commerce? [01:20:28.500 --> 01:20:32.500] They weren't able to issue that authority. [01:20:32.500 --> 01:20:49.500] Correct. So right there, the authority for any state to make the compact for a commercial use license through all the states had to be agreed upon so that your license in Louisiana would be good in Texas and vice versa. [01:20:49.500 --> 01:20:54.500] Would that work for a lawyer or a doctor or a plumber? [01:20:54.500 --> 01:21:05.500] It would work for anyone if there was a lawyer, plumber or doctor out there that actually understood it. [01:21:05.500 --> 01:21:12.500] Very interesting, but I really want to ask, please continue on that, but I'd like to put the question in also. [01:21:12.500 --> 01:21:20.500] In the event I get a citation and I go through the procedure as directed in the script and I don't offer any- [01:21:20.500 --> 01:21:27.500] Wait, wait, wait. You have one disadvantage like people living in Colorado. You have one very big disadvantage here. [01:21:27.500 --> 01:21:36.500] You live in Louisiana. Louisiana uses Napoleonic methodology rather than Old English methodology. [01:21:36.500 --> 01:21:37.500] Yeah. [01:21:37.500 --> 01:21:55.500] Okay. So the questions you're asking me are much better suited if you will learn what the process in Louisiana is because their procedures will be most likely somewhat different. [01:21:55.500 --> 01:22:09.500] The procedures, but wouldn't the thing you always say, the Constitution is the law of the land, a Republican form of government, but we the people who agree by the consent of the government- [01:22:09.500 --> 01:22:20.500] Well, yes and no. Again, again, yes and no. Your state Constitution is the law of your land in any way, shape or form that is not in conflict with the federal. [01:22:20.500 --> 01:22:29.500] The federal courts are far too happy, far too often to tell you straight up the federal Constitution has nothing to do with you. [01:22:29.500 --> 01:22:38.500] You can't sue to enforce it. You can't sue for any deprivation under it unless that deprivation is one protected directly in the Bill of Rights. [01:22:38.500 --> 01:22:43.500] You can't sue the Fed for printing money instead of Congress, in other words. [01:22:43.500 --> 01:22:56.500] You can only enforce your individual rights under the Bill of Rights and then only if the actions were taken by a state actor or a federal actor in their violation. [01:22:56.500 --> 01:23:06.500] So when you say it's the law of the land, that's not exactly true. There's a caveat to that. The law of the land in Louisiana is the state Constitution. [01:23:06.500 --> 01:23:22.500] The law of the land in Texas is our state Constitution and that will always be true as long as they exist and whatever protections they afford are not running afoul of the protections in the Fed. [01:23:22.500 --> 01:23:34.500] That's where so many people get this screwed up. Why do you think everything in my case is argued only under the state Constitution and not the federal? [01:23:34.500 --> 01:23:37.500] I didn't know that. [01:23:37.500 --> 01:23:48.500] Well, again, if I could get you to address this, back to the scenario, you know, I pulled over for a light or went through a red light or whatever. [01:23:48.500 --> 01:24:01.500] I don't give up the license. I've got my day in court. Would that information on the back of that license be pertinent to my argument that I wasn't engaged in commercial activity? [01:24:01.500 --> 01:24:11.500] Well, the problem is, yes, technically that would be true. Okay. But we're not talking about an issue relating to the license. [01:24:11.500 --> 01:24:19.500] We're talking about an issue where you ran through a red light and recklessly endangered the public. [01:24:19.500 --> 01:24:29.500] See, this is another misnomer people have. Not having a transportation code does not remove all duty and liability in other ways. [01:24:29.500 --> 01:24:41.500] Okay. You have the duty to do no harm. Okay. In the exercise of all your rights, benefits and privileges, free exercise is your right, [01:24:41.500 --> 01:24:49.500] as long as that exercise is not directed at or negligently responsible for harm to another. [01:24:49.500 --> 01:24:52.500] Okay. All I did was run through the red light. I didn't hit anybody. [01:24:52.500 --> 01:25:02.500] Hitting them is not the issue. The issue becomes one. If it was 5 a.m. and there was no cars on the road, okay, fine. [01:25:02.500 --> 01:25:09.500] But if you did it at lunch hour when everybody is out on the road trying to get from here to there and somebody could have pulled out in front of you, [01:25:09.500 --> 01:25:13.500] no questions asked, that's a whole other story. [01:25:13.500 --> 01:25:20.500] Yes, but wouldn't that regulation be under the transportation code? [01:25:20.500 --> 01:25:27.500] Running the red light would be, but reckless endangerment would be under the penal code. [01:25:27.500 --> 01:25:38.500] Criminal negligence would be under the penal code. And either one of those would fit a lot better in that case when you're not in commerce. [01:25:38.500 --> 01:25:44.500] There are two jurisdictions that are trying you under then. In other words... [01:25:44.500 --> 01:25:50.500] No, no, no, no, no. Not true. Not true. Not true. [01:41:02.500 --> 01:41:10.500] But at default, so they sent me a collection from some collection deal here in town in Portland, Oregon, in the area where I live in.
