[01:07.280 --> 01:11.240] In recent news, the United States Environmental Protection Agency is alleging that the Volkswagen [01:11.240 --> 01:15.440] Group not only cheated emissions regulations on their diesel cars, but also installed a [01:15.440 --> 01:18.360] defeat device in some of their SUVs as well. [01:18.360 --> 01:21.880] These new accusations raise concerns about the extent of the automakers' response to [01:21.880 --> 01:26.040] the initial EPA accusation that the company was cheating on emissions regulations for [01:26.040 --> 01:28.120] their diesel cars back on September 18. [01:28.120 --> 01:32.120] The Volkswagen Group quickly admitted that it had circumvented regulations on up to 11 [01:32.120 --> 01:37.520] million cars worldwide, primarily diesel versions of the Jetta, Passat, Golf, and Beetle. [01:37.520 --> 01:42.720] However, if the EPA's accusations are founded, it could potentially affect 10,000 new vehicles [01:42.720 --> 01:44.040] in the US alone. [01:44.040 --> 01:51.120] The 3-liter diesel engine version of the 2014 VW Touareg SUV and the 2015 Porsche Cayenne [01:51.120 --> 02:00.880] and the 2016 Audi A6 Quattro, A7 Quattro, A8, A8L, and Q5, estimating roughly $375 million [02:00.880 --> 02:05.800] in Clean Air Act fines and penalties on top of the $18 billion in penalties for their [02:05.800 --> 02:12.680] diesel car violations. [02:12.680 --> 02:16.440] Representatives of Bishops' conferences from around the world sign an appeal to push and [02:16.440 --> 02:21.000] encourage climate negotiators meeting at the UN Climate Summit in Paris next month to [02:21.000 --> 02:25.360] consider Pope Francis' call to protect God's creation and the poor who suffer most from [02:25.360 --> 02:26.560] climate change. [03:40.560 --> 03:45.840] So Grandpa Sylvia told my Papi back in my day, son, the mayor had to answer for the [03:45.840 --> 03:55.840] Take all the rope in Texas by the tall old tree Round up all of them bad boys and hang them high in the street [03:55.840 --> 04:00.840] For all the people to see [04:00.840 --> 04:08.840] That justice is one thing you should always find You gotta saddle up your boys, you gotta draw a hard line [04:08.840 --> 04:16.840] When the gun folks settles, we'll sing a victory tune And we'll all meet back at the local snow [04:16.840 --> 04:39.840] We'll raise up our glasses against evil forces Singin' whiskey for my men, beer for my horses [04:46.840 --> 04:51.840] This is a serious question for all of you that are listening, wherever you may be listening from [04:51.840 --> 04:59.840] And it doesn't really matter what country you're in All that matters is that you can relate to what I'm about to say [04:59.840 --> 05:05.840] And that is, why have the people of the world not revolted yet [05:05.840 --> 05:13.840] And thrown everybody that pretends that they have the right to tell us what to do off of a tall building [05:13.840 --> 05:21.840] Let me give you some straight up facts that support my asking this question [05:21.840 --> 05:28.840] Now, this is true the world over, but I'm going to stick with just referencing America [05:28.840 --> 05:32.840] Because here's where I live, but it's true no matter where you're at [05:32.840 --> 05:41.840] The only difference between them is the overt levels of violence they're willing to exhibit at every moment of the day [05:41.840 --> 05:47.840] Other than that, there's no difference between what I'm about to talk about here in America and anywhere else [05:47.840 --> 06:04.840] Now, we have people in power that are guilty of running drugs, murdering innocent women and children the world over [06:04.840 --> 06:10.840] Stealing national resources from other countries using force of the military [06:10.840 --> 06:18.840] That locally using the force of the military disguised as local police departments [06:18.840 --> 06:30.840] We have people that pass laws that say it is a crime to lie to them, but it is politics to lie to us, their boss [06:30.840 --> 06:43.840] That it is okay to steal from us by force, that it is okay to take products of nature and charge we the people for using them, possessing them, growing them [06:43.840 --> 06:55.840] Or anything else with them that we deem feasible to do, tax us for doing so, license us to do so [06:55.840 --> 07:06.840] And are willing to kill us if we don't comply with any or all of the above [07:06.840 --> 07:15.840] So I ask you again, why have the people of the world not revolted? [07:15.840 --> 07:23.840] Because this is true in any country, anywhere on the planet [07:23.840 --> 07:33.840] Why do we allow a small clique of individuals, regardless of how much money they've got [07:33.840 --> 07:44.840] To gather power to themselves to treat the rest of us like peons and serfs [07:44.840 --> 07:52.840] And kill us if we disagree with them doing so [07:52.840 --> 07:57.840] What's wrong with us? [07:57.840 --> 08:04.840] We let them poison our food, we let them poison our water, we let them indoctrinate our children [08:04.840 --> 08:17.840] We let them mass distract us using all kinds of mental manipulations through drugs, advertising, television, radio [08:17.840 --> 08:21.840] You name it [08:21.840 --> 08:31.840] There is no person anywhere that is free to do what they feel is right, just, and honest [08:31.840 --> 08:35.840] In any given situation that they may face [08:35.840 --> 08:37.840] You want to grow your own food? Too bad [08:37.840 --> 08:41.840] Code enforcement's knocking on your door and demanding that you kill all your livestock [08:41.840 --> 08:43.840] And you eat the stuff in the supermarket [08:43.840 --> 08:46.840] Whether you can afford it or not is irrelevant [08:46.840 --> 08:50.840] Whether or not it's healthy for you or not is irrelevant [08:50.840 --> 08:54.840] Whether or not they sell what you prefer to eat is irrelevant [08:54.840 --> 08:57.840] Your masters have spoken [08:57.840 --> 09:10.840] You must rely upon them and those that support them if you wish to live on this planet [09:10.840 --> 09:13.840] How did we get here? [09:13.840 --> 09:18.840] Why did we get here? [09:18.840 --> 09:31.840] Why would we think it is okay for someone that allegedly is no better and admittedly no worse than any of us [09:31.840 --> 09:37.840] Get the power to tell us that we have to live as they dictate [09:37.840 --> 09:42.840] That they can charge us to live as they dictate [09:42.840 --> 09:47.840] You're going to live and eat and drink and sleep and work and do everything the way I want you to do it [09:47.840 --> 09:52.840] And then you're going to pay me for doing [09:52.840 --> 09:54.840] Anything you want, you buy from me [09:54.840 --> 09:56.840] Anything you do, you pay me to do [09:56.840 --> 10:02.840] You get a license and buy permission, you pay [10:02.840 --> 10:10.840] You know, that used to be something that was frowned upon [10:10.840 --> 10:13.840] Miners used to have that problem [10:13.840 --> 10:18.840] They would go in, how's the old song go, I owe my soul to the company store [10:18.840 --> 10:24.840] Because you'd get a job in a coal mine or a gold mine or some other kind of mine [10:24.840 --> 10:27.840] And you would have to buy your uniform from the company store [10:27.840 --> 10:29.840] You'd have to buy your tools from the company store [10:29.840 --> 10:32.840] You'd have to buy your supplies from the company store [10:32.840 --> 10:40.840] And of course, that would always cost more than what you were being paid to work for the company [10:40.840 --> 10:48.840] That happened to also own the store [10:48.840 --> 10:52.840] It's slavery, folks [10:52.840 --> 10:58.840] If you want to see your chains for what they are, look in your wallet [10:58.840 --> 11:08.840] Your chains will have the form of green paper or little square pieces of plastic [11:08.840 --> 11:13.840] Those are your chains and you don't even know it [11:13.840 --> 11:21.840] You have been taught to look at them and see them as representations of freedom rather than of slavery [11:21.840 --> 11:30.840] And yet, I defy you to prove that possession and use of any of those things [11:30.840 --> 11:37.840] Gives you more freedom than it does less freedom [11:37.840 --> 11:42.840] You say money will set you free, well, that's good, except you don't have any [11:42.840 --> 11:54.840] You have a pocket full of IOUs and the more of them you have, all you have is more debt [11:54.840 --> 12:00.840] Not more money and certainly not more freedom [12:00.840 --> 12:11.840] We've become a nation the world over of people that cannot pay a debt, even a valid one [12:11.840 --> 12:18.840] With anything other than a straight up barter for something else of equal value [12:18.840 --> 12:21.840] Because there's nothing else in the system to pay for it with [12:21.840 --> 12:29.840] The only people that have the gold are the ones making all the rules to ensure that the gold trickles to them and away from us [12:29.840 --> 12:38.840] The moment we had a president that said we're taking all of your gold and silver, you'll give it to us because only the government can have it [12:38.840 --> 12:46.840] We should have given it to them all right, but we should have melted it down and molded it into bullets and sent it to them express mail [12:46.840 --> 13:00.840] We have allowed ourselves to be enslaved and we have cooperated [13:00.840 --> 13:12.840] It is absolutely no different than the allegations of the Jews boarding the trains to the prison camps and gas chambers [13:12.840 --> 13:21.840] It's no different than those that kneel on the edge of the trench and wait to get shot in the back of the head so they don't have to be fed and clothed anymore [13:21.840 --> 13:30.840] And they're not a drain on the economy or the supply trains [13:30.840 --> 13:38.840] You sit in front of your TVs and you think that your world is complete [13:38.840 --> 13:52.840] But what you're really going to do is you're going to kneel down in front of that same TV one day and you're going to get yours to the back of the head [13:52.840 --> 13:59.840] And if we stay the way we are, there's not going to be any way to turn that around [13:59.840 --> 14:08.840] There are too few people that even though they are awake, they are willing to do what's necessary to stop it [14:08.840 --> 14:18.840] Now, granted, I'm not advocating violence as the sole means of doing this and preferred that it not be the means of doing this [14:18.840 --> 14:32.840] But the fact is if we don't stand together and raise our voices and become active as one instead of individuals that are easy to silence, we're done for [14:32.840 --> 14:40.840] And it doesn't matter what country you're in. It doesn't matter how safe and far away from it all you think you are [14:40.840 --> 14:48.840] The only way you could do that is to be completely lost on a continent large enough that no one could hope to find you [14:48.840 --> 14:53.840] And that is not very likely [14:53.840 --> 14:58.840] It's not like you can move off planet [14:58.840 --> 15:03.840] So what do we do? Do we stay where we're at? [15:03.840 --> 15:08.840] Or do we get together and finally say enough is enough? [15:08.840 --> 15:23.840] I understand why government is necessary to a degree, but it should never have been allowed beyond that degree [15:23.840 --> 15:36.840] Because the moment it gained the power to declare its own power, our destruction began full tilt [15:36.840 --> 15:44.840] Both as a free people and a free country [15:44.840 --> 15:55.840] I mean, how many congressional hearings have we had on subjects like Benghazi, the gun-running scheme of fast and furious? [15:55.840 --> 15:58.840] What's going on right now with ISIS? Are they subsidizing it in some way when you pay for the seeds or you pay for the starter material or plants or whatever [24:16.840 --> 24:24.840] And you do all the work and pay all the electric bills and the water bills and all the stuff necessary to grow it and then process it [24:24.840 --> 24:37.840] You do all of that and then they come waltzing in and say okay now give us our cut [24:37.840 --> 24:46.840] I don't see it folks I don't see how you can look at that and say that's an okay thing for anyone to do [24:46.840 --> 24:54.840] Especially someone that works for everyone [24:54.840 --> 25:08.840] It's one thing to be governed by consent and it's another thing entirely to be governed by threat of force violence and death [25:08.840 --> 25:16.840] We fought a national war because of the latter [25:16.840 --> 25:22.840] We used to call it slavery [25:22.840 --> 25:31.840] And now you are the most willing of slaves and don't even know it [25:31.840 --> 25:34.840] It's a joke [25:34.840 --> 25:47.840] We used to be a nation that was the light to the rest of the world as to how things could be and should be [25:47.840 --> 26:01.840] We are now the laughing stock because we have become everything that was despised in the form of government we had before we became that shining light [26:01.840 --> 26:14.840] The whole reason we rebelled we have now surpassed by a thousand orders of magnitude in its oppressiveness [26:14.840 --> 26:25.840] And we just sit back, stare at our TVs, put on our headphones, look at our cell phones, teach our children not to pay attention to the important things in life [26:25.840 --> 26:31.840] But to be distracted by the trivial [26:31.840 --> 26:38.840] And just tell everybody if you keep your head down and your mouth shut things will be fine [26:38.840 --> 26:41.840] Well they won't [26:41.840 --> 26:48.840] Didn't work that way on the plantations, it's not going to work that way here [26:48.840 --> 27:09.840] The problem when someone believes that you are their property is that a property owner has the right to accumulate, transfer, or destroy the property that belongs to them [27:09.840 --> 27:15.840] In any manner it suits them [27:15.840 --> 27:22.840] It was not unheard of for a slave that was a problem to be whipped to death, shot to death, hung [27:22.840 --> 27:36.840] Or maimed in some way if they were a runaway, had the front of their feet chopped off so they couldn't run, had their Achilles tendon severed so they couldn't run [27:36.840 --> 27:49.840] And yet you don't need physical chains to be more of a slave than anyone before you [27:49.840 --> 27:58.840] It doesn't matter what color of skin you have, you are a slave whether you're red, yellow, brown, white, doesn't matter [27:58.840 --> 28:03.840] You're a slave and you don't even know it [28:03.840 --> 28:10.840] And if you do, what are you doing about it? [34:39.840 --> 34:41.840] Good evening Eddie [34:41.840 --> 34:44.840] Well Eddie, I've listened to you for about four years [34:44.840 --> 34:47.840] And I've been running without plates for about two years [34:47.840 --> 34:50.840] And I've done okay [34:50.840 --> 34:54.840] I've had officers laugh at me and tell me I'm a troublemaker [34:54.840 --> 34:57.840] But I got stopped this week [34:57.840 --> 35:01.840] And boy I got arrested in a heartbeat [35:01.840 --> 35:04.840] Officer came up to my truck [35:04.840 --> 35:07.840] Demand and license and registration [35:07.840 --> 35:11.840] I politely asked him for his name and badge number [35:11.840 --> 35:16.840] Again he demanded a license and registration [35:16.840 --> 35:21.840] I asked him, officer, could you use those documents in the court of law against me? [35:21.840 --> 35:24.840] He ordered me out of the vehicle [35:24.840 --> 35:28.840] He tried to open the door, the door was locked [35:28.840 --> 35:32.840] I said, no thank you, I'm comfortable in here [35:32.840 --> 35:37.840] And he asked me if I was refusing to identify [35:37.840 --> 35:42.840] I told him, officer, to my knowledge I'm only required to identify if I'm under arrest [35:42.840 --> 35:45.840] I asked him, I said, am I under arrest? [35:45.840 --> 35:48.840] He said, you're under arrest [35:48.840 --> 35:52.840] So at that point I unlocked my door, stepped out [35:52.840 --> 35:55.840] I was surprised, he cuffed me up [35:55.840 --> 35:59.840] I was surprised, he took all my possessions off me immediately [35:59.840 --> 36:03.840] Including my recorder [36:03.840 --> 36:07.840] You know, locked me in the back of his car [36:07.840 --> 36:13.840] And then he proceeded to search my truck [36:13.840 --> 36:17.840] As we were getting ready to head off towards jail [36:17.840 --> 36:19.840] I asked him, I said, are we going to the magistrate? [36:19.840 --> 36:22.840] He said, nope, you're going directly to jail [36:22.840 --> 36:27.840] I said, officer, I said, 1338.98 [36:27.840 --> 36:29.840] Says in a warrantless arrest [36:29.840 --> 36:33.840] You're supposed to go to the magistrate without delay [36:33.840 --> 36:36.840] And he said, I don't know the law [36:36.840 --> 36:41.840] He said, I just follow policy [36:41.840 --> 36:44.840] I said, oh good, an admission [36:44.840 --> 36:45.840] What's that? [36:45.840 --> 36:48.840] I said, oh good, an admission [36:48.840 --> 36:53.840] Well, yeah, I hope it's on his recording [36:53.840 --> 36:57.840] So I was really surprised [36:57.840 --> 37:01.840] I had my traffic stop script with me because my memory isn't that great [37:01.840 --> 37:03.840] I had it in hand [37:03.840 --> 37:07.840] But boy, this guy was just tough [37:07.840 --> 37:11.840] He wasn't going to have any conversation [37:11.840 --> 37:15.840] So I guess what my biggest question is [37:15.840 --> 37:18.840] I didn't go to the magistrate [37:18.840 --> 37:20.840] Took me to jail [37:20.840 --> 37:23.840] I put together a support team [37:23.840 --> 37:25.840] And I made a phone call to my support team [37:25.840 --> 37:28.840] They had me bailed out in two hours [37:28.840 --> 37:32.840] But the bail wasn't set by a judicial officer [37:32.840 --> 37:36.840] It was set by somebody at the jail [37:36.840 --> 37:41.840] Well, most likely what's occurred is that is required to be done by a judicial officer [37:41.840 --> 37:46.840] So let me explain real quick for everybody listening exactly how most states have set this up [37:46.840 --> 37:52.840] The judges have established a set bail amount for a particular type of offense [37:52.840 --> 37:57.840] And they have left a list of those bail amounts with jails [37:57.840 --> 38:04.840] So that people can bond out without having to get the magistrate to intervene [38:04.840 --> 38:09.840] Basically it's so they can stay home with their families at night rather than do their job [38:09.840 --> 38:16.840] Now the courts, which of course is also peopled by other magistrates that like their golf games [38:16.840 --> 38:19.840] And everything else without interruption [38:19.840 --> 38:22.840] Have said that's okay [38:22.840 --> 38:25.840] The jail didn't set the bond [38:25.840 --> 38:32.840] They are simply following a predisposed bond set by a judge for a particular type of offense [38:32.840 --> 38:38.840] Now I don't personally agree with it [38:38.840 --> 38:40.840] Don't think it's right [38:40.840 --> 38:43.840] But the courts allow it [38:43.840 --> 38:49.840] However, the warrantless arrest part you were getting at [38:49.840 --> 38:52.840] Where he arrested you and refused to take you to the magistrate [38:52.840 --> 38:55.840] You need to be looking up the case law in Arizona on that immediately [38:55.840 --> 38:58.840] And find out whether or not that makes the arrest illegal [38:58.840 --> 39:03.840] It may not nullify the arrest or the allegations for the offense [39:03.840 --> 39:09.840] But it may give you a separate cause of action for false imprisonment or false arrest against the officer [39:09.840 --> 39:14.840] Regardless of the outcome of the other [39:14.840 --> 39:17.840] Oh, okay [39:17.840 --> 39:19.840] I know you don't know Arizona law [39:19.840 --> 39:21.840] I mean I've looked through the Arizona law [39:21.840 --> 39:24.840] I've found where I've been assaulted [39:24.840 --> 39:26.840] It's been false imprisonment [39:26.840 --> 39:30.840] It's been kidnapping [39:30.840 --> 39:32.840] I haven't found anything that would say that that would make [39:32.840 --> 39:34.840] No, you need the case law [39:34.840 --> 39:40.840] You need to find out what the courts have ruled on in relation to that statute and its predecessors [39:40.840 --> 39:46.840] Here in Texas, for instance, there's tons of case law in the book that makes it very clear that the duty of the officer [39:46.840 --> 39:51.840] Is to deliver you to a magistrate if he makes a warrantless arrest [39:51.840 --> 40:01.840] If he fails to do that, you can sue the officer separately from everything else for false imprisonment [40:01.840 --> 40:06.840] Because the officer does not have the authority to incarcerate [40:06.840 --> 40:09.840] He only has the power to arrest [40:09.840 --> 40:16.840] Only a magistrate or judge can incarcerate [40:16.840 --> 40:17.840] Okay [40:17.840 --> 40:27.840] So you need to find case law on that statute in Arizona on how the courts have ruled on that [40:27.840 --> 40:28.840] Okay [40:28.840 --> 40:31.840] Okay, now I have an arraignment next week [40:31.840 --> 40:35.840] And I have the traffic seminar material [40:35.840 --> 40:39.840] But there's not a lot in there about an arraignment [40:39.840 --> 40:47.840] Is there anything special I should do to fight this at the arraignment? [40:47.840 --> 40:51.840] Well, the arraignment is not for hearing anything relating to the case [40:51.840 --> 40:59.840] Here in Texas, for instance, the only purpose an arraignment serves is to fix the identity of the accused and to set his bond [40:59.840 --> 41:02.840] Or I'm sorry, to take his plea [41:02.840 --> 41:04.840] That's all an arraignment is for [41:04.840 --> 41:10.840] And these particular type of offenses here in Texas don't have arraignments [41:10.840 --> 41:12.840] But they're supposed to [41:12.840 --> 41:14.840] The statute says they're supposed to [41:14.840 --> 41:17.840] Statute also says you're supposed to have an examining trial [41:17.840 --> 41:22.840] The examining trial is necessary because it was a warrantless arrest [41:22.840 --> 41:32.840] Because nothing is valid until the warrantless arrest itself has been reviewed and determined to be valid [41:32.840 --> 41:37.840] Okay [41:37.840 --> 41:44.840] When they perpetrate a warrantless arrest, the presumption is always that the warrantless arrest is invalid [41:44.840 --> 41:46.840] Always [41:46.840 --> 41:52.840] And therefore, they must make two probable cause determinations in such cases [41:52.840 --> 41:56.840] The first one being, was the arrest valid? [41:56.840 --> 42:00.840] It can't be presumed valid if it was done without a warrant [42:00.840 --> 42:04.840] It has to be proven to be valid [42:04.840 --> 42:15.840] Then, if the arrest was valid, now we can move to the issue, is there evidence that a crime was committed, this was the person that did it [42:15.840 --> 42:21.840] And that a jury would find probable cause to convict on it because of the evidence [42:21.840 --> 42:26.840] If so, now we've got probable cause to do whatever we do next [42:26.840 --> 42:30.840] Which is go to trial, set a bond, incarcerate, and hold over until trial [42:30.840 --> 42:37.840] Whatever comes along for whatever type of offense [42:37.840 --> 42:40.840] Okay, so I've obviously been left out of the loop [42:40.840 --> 42:44.840] When I saw the magistrate, I should have had some arguing room [42:44.840 --> 42:48.840] So when I show up for the arraignment, is there anything [42:48.840 --> 42:51.840] Well, when did you see the magistrate? [42:51.840 --> 42:52.840] What's that? [42:52.840 --> 42:54.840] When did you see a magistrate? [42:54.840 --> 42:56.840] I haven't seen a magistrate [42:56.840 --> 42:58.840] Okay, well then you're confusing me [42:58.840 --> 43:02.840] You said when I saw the magistrate, I was left out of the loop [43:02.840 --> 43:09.840] No, if I would have seen a magistrate, I would have had a chance to argue [43:09.840 --> 43:12.840] You know, that there was no probable cause [43:12.840 --> 43:17.840] No, no, no, no, wait a minute, wait a minute, wait a minute [43:17.840 --> 43:19.840] Okay [43:19.840 --> 43:23.840] You have to argue probable cause relating to what? [43:23.840 --> 43:28.840] Well, there's no probable cause to even stop me, I don't think [43:28.840 --> 43:33.840] Based upon? [46:55.840 --> 47:00.840] You need to challenge their ability to conduct the arraignment [47:00.840 --> 47:04.840] Excuse me Judge, there's an issue of probable cause here [47:04.840 --> 47:09.840] The officer never had probable cause to make the stop [47:09.840 --> 47:12.840] The arrest was unlawful on its face [47:12.840 --> 47:17.840] It was a warrantless arrest and the officer never provided any probable cause for it [47:17.840 --> 47:21.840] And then they're going to cite the traffic offense as the probable cause [47:21.840 --> 47:25.840] Alright, the problem here is going to come down to this [47:25.840 --> 47:30.840] Whether or not you have enough information to show that transportation [47:30.840 --> 47:33.840] or as the statute exists in Arizona [47:33.840 --> 47:37.840] that you can make the argument of it being commercial and substantially supported [47:37.840 --> 47:44.840] The problem is that's going to go to merits of the allegation, not the arrest itself [47:44.840 --> 47:51.840] You see how they've convoluted this issue to make it difficult to argue one or the other? [47:51.840 --> 47:55.840] Okay, and the interesting thing, I had no plate [47:55.840 --> 47:59.840] I had my private not-for-hire sticker on the back [47:59.840 --> 48:03.840] You misunderstand, that doesn't matter because [48:03.840 --> 48:10.840] they're operating on what they have established as an irrebuttable presumption of commerce [48:10.840 --> 48:14.840] They don't know that it's commerce, they won't acknowledge that it's commerce [48:14.840 --> 48:19.840] But they start with the premise that you are in commerce [48:19.840 --> 48:22.840] and you are required to be in commerce [48:22.840 --> 48:24.840] You follow? [48:24.840 --> 48:37.840] Okay, my point is my ticket says I was cited for a criminal charge of not identifying [48:37.840 --> 48:40.840] and then cited for no registration [48:40.840 --> 48:47.840] Well, the thing about it is, did he give you an opportunity to identify after he arrested you? [48:47.840 --> 48:49.840] What was that? [48:49.840 --> 48:55.840] Did he give you an opportunity to identify after he said you're under arrest? [48:55.840 --> 48:57.840] No [48:57.840 --> 49:01.840] So he just said you're under arrest and that's when he grabbed you? [49:01.840 --> 49:06.840] When he said I was under arrest, I thought okay, I'm not going to fight this [49:06.840 --> 49:10.840] I unlocked the door, stepped out, he cuffed me [49:10.840 --> 49:14.840] Did he ever ask you for your ID again? [49:14.840 --> 49:15.840] No [49:15.840 --> 49:18.840] Did he ever get your ID? [49:18.840 --> 49:22.840] Yes, he took all my credit cards and things out of my pocket [49:22.840 --> 49:31.840] Okay, then if you get your hands on the video and it shows that he did not ask for your identification [49:31.840 --> 49:45.840] after he arrested you, then that's an affirmative defense if the statute in Arizona is written the same way it is here [49:45.840 --> 49:47.840] Okay [49:47.840 --> 49:51.840] How does the failure to ID statute in Arizona read? [49:51.840 --> 49:54.840] Does it say you have to already be lawfully arrested for something else [49:54.840 --> 50:01.840] or that you have to already be charged with a crime and placed under arrest before identification is required? [50:01.840 --> 50:04.840] That I don't know, I'm going to have to look that up now [50:04.840 --> 50:06.840] Well, you're going to need to [50:06.840 --> 50:09.840] See here it's very simple, you cannot be charged with failure to ID [50:09.840 --> 50:19.840] unless you provide false information during a detention or an arrest for some other offense [50:19.840 --> 50:26.840] or you refuse to provide name, address, and date of birth after you've been arrested for some other offense [50:26.840 --> 50:36.840] But it is imperative that it be for something else other than failure to identify [50:36.840 --> 50:42.840] Failure to identify can't be the sole charge here in Texas, and I don't know about Arizona [50:42.840 --> 50:54.840] But it cannot be the sole charge here unless you were already arrested for something else or detained for something else and you did that [50:54.840 --> 50:58.840] Okay, no, I was not arrested for anything else or detained for anything else [50:58.840 --> 51:01.840] Right, and that's what you need to see that the statute supports [51:01.840 --> 51:06.840] that that has to be the case or you can't be guilty of the offense [51:06.840 --> 51:14.840] Which that is exactly what makes the officers arrest of you and carting you to jail illegal [51:14.840 --> 51:22.840] That's why a probable cause determination has to be made [51:22.840 --> 51:29.840] Okay, and just, I mean, provided this doesn't go the way we hope it's going to go [51:29.840 --> 51:34.840] and I get held over, I've been before this judge before [51:34.840 --> 51:41.840] and at the end of the session, the judge tells you, you will not consume any alcohol [51:41.840 --> 51:46.840] and you will not be in possession of any firearms [51:46.840 --> 51:49.840] Then you need to object and file criminal charges against that judge [51:49.840 --> 51:55.840] because you cannot be deprived of a right without a conviction to deprive you of that right [51:55.840 --> 52:04.840] He can't preliminarily take your rights away from you to go and do as you please if you haven't been convicted of any crime [52:04.840 --> 52:11.840] I totally understand that, like I said, I haven't been in court much, so I was blindsided with it [52:11.840 --> 52:17.840] If he does that, you move to disqualify and you immediately file judicial conduct complaints [52:17.840 --> 52:25.840] Deprivation of rights under color of law and no judgment against you allowing that sort of punishment [52:25.840 --> 52:30.840] Are those punishments allowed in relation to the charges against you? [52:30.840 --> 52:31.840] Nope [52:31.840 --> 52:36.840] Right, if they're not a part of the law as part of the punishment even if you got convicted [52:36.840 --> 52:40.840] How can they be pre-conviction punishment? [52:40.840 --> 52:42.840] I totally agree [52:42.840 --> 52:48.840] Right, so the moment the judge issues that order, that order is illegal and invalid [52:48.840 --> 52:56.840] You immediately object, you immediately ask them to recuse their cells or you immediately demand their disqualification [52:56.840 --> 53:05.840] and then you file judicial conduct complaints against them for pre-trial punishment [53:05.840 --> 53:14.840] Okay, so I can just look at him fairly safely, tell him I object and he needs to recuse himself from the case [53:14.840 --> 53:27.840] No, no, no, I have objection, I move that you recuse yourself for bias and partiality and judicial incompetence [53:27.840 --> 53:28.840] Okay [53:28.840 --> 53:37.840] And when he asks what do you mean judicially incompetent, judge you are rendering a punishment, a deprivation of rights pre-trial [53:37.840 --> 53:42.840] Without any evidence that those were factors involved in the allegations whatsoever [53:42.840 --> 53:48.840] And they're not even allowed as punishments if I was convicted of the allegations [53:48.840 --> 54:05.840] So I fail to see how you would have the authority to issue an order that deprives me of my right to do these things and I haven't been convicted of anything [54:05.840 --> 54:07.840] Okay, okay, sounds good [54:07.840 --> 54:15.840] Okay, now at what point can I file charges against the officer for false imprisonment? [54:15.840 --> 54:19.840] Anytime, but that's going to be a civil suit, not a criminal suit [54:19.840 --> 54:24.840] I mean unless Arizona has a penal statute for false imprisonment [54:24.840 --> 54:28.840] Here we do, but it's also a civil suit [54:28.840 --> 54:34.840] Most likely they will not pursue the actual charges on the criminal side [54:34.840 --> 54:40.840] But your lawsuit, if you can find the case law that supports it, would prevail [54:40.840 --> 54:50.840] He delivered you directly to jail without taking you to a magistrate and there was no conditions or circumstances that would have prevented him from doing so [54:50.840 --> 55:03.840] Such as natural disasters, riots, invasions, enemy attacks, things of that nature that would have made it unsafe for him to seek a magistrate [55:03.840 --> 55:18.840] Okay, last thing, for searching out case law, short of going to the law library with Westlaw, is there any good way to find state case law? [55:18.840 --> 55:21.840] Any special sites? [55:21.840 --> 55:34.840] Well, if you don't have access to something like Lexis, then no, a law library or a college library with a law library is your best option for it [55:34.840 --> 55:43.840] You can go, there are some attorneys that will allow the public to access their law library if you find one that's willing to do that [55:43.840 --> 55:51.840] Some law firms will allow the public in to look at their law library, not many these days, but some do [55:51.840 --> 55:55.840] Yeah, but the law library at our courthouse has Westlaw there, so I can use that [55:55.840 --> 56:08.840] Yeah, then that's where you'll do it. That'll be far faster than the books, but you still need to find as much information as you can on the subject for that statute, both state and federal [56:08.840 --> 56:14.840] Okay, well I think that'll do me for tonight. This is about my wife. We had two cars, both the same exact year, model, everything. One was black and one was gray. [01:04:03.840 --> 01:04:21.840] She went in. We gave the gray one that I was driving last May to the Church for some poor people because they needed a car and I bought a used, newer car, different model for me that I wanted and been looking for. [01:04:21.840 --> 01:04:40.840] So we gave it to the Church. They didn't have time to do a couple things to it. It sat around. Come fall, September, she goes down to get plates for the other one. She hands them the envelope, got the registration thing that they mail you in the envelope. [01:04:40.840 --> 01:04:57.840] She gives them the insurance card and says I want plates for this car. The lady gives the plates for us and gave her plates also because the registration form was in there for the other one. [01:04:57.840 --> 01:05:14.840] There was no insurance on it. We gave the car away four months before. She gave her plates for that one anyhow. She gets home, too late to go back. I say what's this? I'm going to put the plates on. Well, I don't know. [01:05:14.840 --> 01:05:27.840] So anyhow, it was $51 with the tabs for a plate that wasn't on anything. It was going to go on my newer car for me whenever I get it running. [01:05:27.840 --> 01:05:42.840] It was just sitting there doing nothing. I said we'll go back and get your money back. Well, first she went to the Church and got the title back from the guy, the pastor, because she hadn't had time to do anything on the other one anyhow. [01:05:42.840 --> 01:06:01.840] It was wasted a good three or four weeks. I go down with it. We go to DMV. The lady's kind of, well, what can we do for you? I said we want our $51 back for the tabs that you gave us. [01:06:01.840 --> 01:06:14.840] For what? Well, what's the plate on? It's on nothing. It's in my drawer. I'm going to put it on my other car. Well, you can't do that. How do we know you're not using that plate for something else? I said how do you know I'm not using the one on the other car for something else? [01:06:14.840 --> 01:06:33.840] She said, well, who made you the police for the plate? So anyhow, she demanded that I return the vanity plate I had for my car, that I bring that into them because they can't trust us. We might not be using it for the car we said we were going to use it for. [01:06:33.840 --> 01:06:48.840] And she fined her $150 and took her driver's license away for doing it. No car, no hearing, no trial, no nothing. That's civil right law for this. [01:06:48.840 --> 01:07:08.840] Potentially, not necessarily, but potentially. The thing about it is the plate belongs to you up to a point. You bought the plate and so on and so forth, but you are not free to put that plate on any particular car. [01:07:08.840 --> 01:07:19.840] Basically, you're renting the plate from them as far as the information contained on the plate. You own the physical plate, but you can't put it on just any car. [01:07:19.840 --> 01:07:43.840] Right, I agree. And we're not. When the car gets... Right, but by the same token, most states, when you sell a car, you simply tell them that the car's been sold and you need to have the plate deregistered for that car. [01:07:43.840 --> 01:07:50.840] That would be the best way to go about it, is have them deregister the plate. [01:07:50.840 --> 01:08:00.840] Well, I guess they didn't do that. And the church didn't put it in anybody's name yet because they didn't have time to do a couple things they wanted to do to it. [01:08:00.840 --> 01:08:13.840] And it was hotter than that here this summer, so I'm okay. It doesn't matter to me. But basically, she paid them $51 too much for something she didn't ask for. [01:08:13.840 --> 01:08:23.840] And why didn't the lady say there was no insurance? She took her driver's license because she said, you brought a car in here to get registered without insurance on it. No, she didn't. [01:08:23.840 --> 01:08:31.840] Why didn't she ask for the insurance card? She had the other one. I mean, they both goofed up. [01:08:31.840 --> 01:08:45.840] Well, the thing about it is they don't necessarily have to see the card. They've put everybody in a centralized database within the state, in most states already, that they can look up any car to see whether or not it's got current insurance. [01:08:45.840 --> 01:09:00.840] They don't have to see a card anymore. They can access that information from virtually anywhere. But the thing about it is if they took punitive administrative action without due process, [01:09:00.840 --> 01:09:12.840] then yeah, you probably have a lawsuit provided you can show that you didn't actually break any of the rules they're accusing you of breaking. [01:09:12.840 --> 01:09:24.840] Well, from what I see, she paid them. They took $51 too much money from her for a cab that she didn't ask for. And then they fined her $150. [01:09:24.840 --> 01:09:39.840] Yep. But the thing about it is, Art, do you know that Florida does auto-renew? Is this something new or is this something they've done for how long? [01:09:39.840 --> 01:09:40.840] What, the auto-renew? [01:09:40.840 --> 01:09:43.840] Yeah, the auto-renew of a registration. [01:09:43.840 --> 01:10:03.840] I don't know. I've never dealt with it. I'm just new down here. And I got my Freightliner pickup truck. I got that registered in Michigan. I don't even run it down here. It's got an address up home and I leave it there. [01:10:03.840 --> 01:10:06.840] Okay. But how long have you been in Florida? [01:10:06.840 --> 01:10:07.840] A couple years. [01:10:07.840 --> 01:10:11.840] And how long have you registered cars in Florida? [01:10:11.840 --> 01:10:19.840] Well, swapping on for a couple of years, but I also, I lived in Michigan for the last couple of years. [01:10:19.840 --> 01:10:23.840] Yeah, but I'm not worried about Michigan because we're not dealing with Michigan, are we? [01:10:23.840 --> 01:10:24.840] No. [01:10:24.840 --> 01:10:38.840] Okay. So you need to understand what the rules are in Florida if you're going to register the car. Does Florida do auto-renew every year for a car unless they're notified to do otherwise? [01:10:38.840 --> 01:10:42.840] Not that I know of because they have no way to collect it. [01:10:42.840 --> 01:10:46.840] Well, then how did they charge her $51 if they have no way to collect it? [01:10:46.840 --> 01:10:57.840] Well, she went in there. She went down there to get her plate, her tab for the one car and the other one was just in the envelope, the other registration. [01:10:57.840 --> 01:11:05.840] So she just automatically gave her that one figure and I guess she was going to be a nice lady and give it to her. [01:11:05.840 --> 01:11:09.840] But we didn't even own the car. When would have told her that if she asked? [01:11:09.840 --> 01:11:10.840] Okay. I told Bonnie, you got no recourse at all in this. Your recourse is pay them or drive a follow license, which is what she's doing. That's the only recourse you have. But the problem is when she's talking about the $51, okay, and the second registration for the other car, why didn't she notice that she was being charged too much? Why didn't she say something? [01:11:52.840 --> 01:12:06.840] Because the bill for both cars only came to $82. And where we come from, $82 isn't bad for one car. Did she get a receipt for all this? Well, my vanity place. And I said, well, that's not even registered. My car is from Georgia. That car is from Georgia until I get the motor in and get it running. Why do I want to register? Why do I want to put insurance on it? [01:12:47.840 --> 01:12:55.840] Well, wait a minute. How did they get information about that car if that car was not originally registered in Florida? [01:12:55.840 --> 01:13:03.840] They didn't get the registration or the information about my new car. They just had red information from. [01:13:03.840 --> 01:13:13.840] Okay. Here we go full circle back to what we were talking about before. Okay. The vanity plate she issued the tag for was a Florida plate, right? [01:13:13.840 --> 01:13:14.840] Yep. [01:13:14.840 --> 01:13:30.840] Then it doesn't make a damn about the car. We're talking about the plate, which you could not put those plates on that car unless you deregistered those plates from the other car. [01:13:30.840 --> 01:13:36.840] Well, wouldn't you do that when you took the title for the new car down there? [01:13:36.840 --> 01:13:48.840] As far as getting it put on the new one, yes. As far as deregistering it from the old one, when you sold it and you knew you weren't going to transfer the plate with it, no, you do that immediately. [01:13:48.840 --> 01:13:52.840] How do you know you're supposed to deregister? Where we come from, they don't do that. [01:13:52.840 --> 01:13:57.840] Wait, wait, wait, wait, wait. You knew you were selling the car, right? [01:13:57.840 --> 01:13:59.840] Yeah. [01:13:59.840 --> 01:14:06.840] You knew you had taken the plates off the car that had your vanity information on it, right? [01:14:06.840 --> 01:14:07.840] Yep. [01:14:07.840 --> 01:14:12.840] Therefore, you knew the plate was not going with the car to the new owner, right? [01:14:12.840 --> 01:14:13.840] Right. [01:14:13.840 --> 01:14:19.840] And if that was to be the case, why would you not deregister it? [01:14:19.840 --> 01:14:25.840] Well, in Michigan, when we do something like that, we just take the plate off and saw it in the drawer. [01:14:25.840 --> 01:14:29.840] Okay. Are we still in Michigan? [01:14:29.840 --> 01:14:31.840] No, but how do we know for the law? [01:14:31.840 --> 01:14:35.840] How about looking it up before you do it? [01:14:35.840 --> 01:14:37.840] I guess I didn't do that. [01:14:37.840 --> 01:14:43.840] Yeah. The problem is, is what you've done is you sold a car without the plates on it. [01:14:43.840 --> 01:14:51.840] But the presumption by the DMV is the plates are still registered to that car. [01:14:51.840 --> 01:14:55.840] So if that's the case, hold on, let me finish. [01:14:55.840 --> 01:15:02.840] If that's the case and the registration for that car was due at the same time the other one was, [01:15:02.840 --> 01:15:07.840] then they naturally made the presumption that she would be in there to take care of both, [01:15:07.840 --> 01:15:10.840] even if they neither one said it. [01:15:10.840 --> 01:15:11.840] That would be the presumption. [01:15:11.840 --> 01:15:14.840] Hey, you're here to register the car. [01:15:14.840 --> 01:15:19.840] Well, they're both due, so I'm going to assume you mean both. [01:15:19.840 --> 01:15:23.840] Because they have no other information than that to go on, correct? [01:15:23.840 --> 01:15:24.840] Right. [01:15:24.840 --> 01:15:29.840] Okay. If you take a plate off of a car before you sell it [01:15:29.840 --> 01:15:33.840] because you plan on trying to get that plate transferred to another car, [01:15:33.840 --> 01:15:42.840] how can it not occur to you that deregistration from the original car isn't necessary? [01:15:42.840 --> 01:15:44.840] No matter where you're living. [01:15:44.840 --> 01:15:49.840] Because you know you cannot take a plate that is registered to one car [01:15:49.840 --> 01:15:55.840] and put it on a different car and not be committing a crime, right? [01:15:55.840 --> 01:15:59.840] Unless you go to the DMV with the plate and the new title, [01:15:59.840 --> 01:16:04.840] and I want to put these on there, which is what we always do. [01:22:58.840 --> 01:23:05.840] The argument can be made that no discussion of the second set of tags was ever done, [01:23:05.840 --> 01:23:12.840] and you didn't know or she didn't know until she got it home that they had actually charged her for two cars. [01:23:12.840 --> 01:23:13.840] Right. [01:23:13.840 --> 01:23:15.840] That's the argument. [01:23:15.840 --> 01:23:19.840] You didn't go in looking to get a set of plates without insurance. [01:23:19.840 --> 01:23:26.840] They gave you a set of plates without insurance and didn't tell you they had charged you for them. [01:23:26.840 --> 01:23:27.840] Right. [01:23:27.840 --> 01:23:30.840] Well, that's what you need to go after them on. [01:23:30.840 --> 01:23:32.840] And you need to demand that woman's job. [01:23:32.840 --> 01:23:39.840] I would start with her boss and complain to her boss and show her boss exactly what she did. [01:23:39.840 --> 01:23:48.840] And then how she acted punitively, she acted punitively against your wife without any facts or evidence in support of it. [01:23:48.840 --> 01:23:50.840] She made the mistake. [01:23:50.840 --> 01:23:56.840] She made the mistake and then saddled your wife with the blame. [01:23:56.840 --> 01:24:00.840] So you'd go to the DMV where she did it? [01:24:00.840 --> 01:24:05.840] I would start with her supervisor to get remedy. [01:24:05.840 --> 01:24:14.840] And when that fails, if that fails, now you have recourse to go after them elsewhere. [01:33:58.840 --> 01:34:01.840] I'm going to start with the rules of court. [01:34:01.840 --> 01:34:09.840] The Uniform Superior Court Rules of the State of Georgia is called Rule 26.1 under Bonds and First Appearance. [01:34:09.840 --> 01:34:17.840] And it says, immediately following any arrest, but not later than 48 hours, if the arrest was without a warrant, [01:34:17.840 --> 01:34:24.840] or 72 hours following arrest with a warrant, unless the accused has made bond. [01:34:24.840 --> 01:34:34.840] In the meantime, the arresting officer or the law officer having custody of the accused shall present the accused in person [01:34:34.840 --> 01:34:41.840] before a magistrate or other judicial officer for first appearance. [01:34:41.840 --> 01:34:45.840] Yeah, that 48 hours is what most states has in place. [01:34:45.840 --> 01:34:52.840] However, if you read through the procedure code, you'll find out that 48 hours has an intended purpose, [01:34:52.840 --> 01:34:59.840] and it's not to give the officer up to 48 hours to do his due diligence in delivering you before a magistrate. [01:34:59.840 --> 01:35:07.840] The 48 hours is the period of time in which the determination of probable cause is to be made or they have to release you. [01:35:07.840 --> 01:35:14.840] Now, that is not 48 hours to throw you away in a hole and wait for somebody else to make that determination. [01:35:14.840 --> 01:35:25.840] The warrantless arrest entitles you to a determination as to whether or not that arrest was valid before they book you into any jail. [01:35:25.840 --> 01:35:37.840] That 48 hours is there just in case circumstances, conditions, or events prevent the officer from diligently seeking a magistrate to take you immediately before. [01:35:37.840 --> 01:35:51.840] It is not leeway to throw you in jail and forget about you until hour 48 arrives, yet that is how it is used in virtually every state. [01:35:51.840 --> 01:36:01.840] And the reason for that is because most folks don't realize that the courts have ruled long ago that is not allowed. [01:36:01.840 --> 01:36:13.840] And there will be plenty of case law in every state usually, I know there is here, to back up that any time an officer does that, it is false imprisonment [01:36:13.840 --> 01:36:22.840] because he did not even attempt to locate a magistrate. He took you directly to jail. [01:36:22.840 --> 01:36:32.840] Correct. Now, the reason why I brought the uniform Superior Court rules up is because it says immediately following any arrest, [01:36:32.840 --> 01:36:37.840] it doesn't say whether it is with a warrant or without a warrant. Actually, it does say with or without a warrant. [01:36:37.840 --> 01:36:47.840] It says 48 hours with or 72 hours without or vice versa. So it does say that, but it says immediately following any arrest. [01:36:47.840 --> 01:36:54.840] Right. But that immediately following versus the 48 hours is what I am trying to draw the distinction between here. [01:36:54.840 --> 01:36:56.840] Yes. Yes. [01:36:56.840 --> 01:36:57.840] Okay. [01:36:57.840 --> 01:36:58.840] In the code. [01:36:58.840 --> 01:37:01.840] Go ahead. [01:37:01.840 --> 01:37:13.840] Now, in the code, in the official code of Georgia annotated, it says just the same or the arresting officer must bring person before judicial officer [01:37:13.840 --> 01:37:18.840] within 72 hours of arrest notice of commitment hearing. [01:37:18.840 --> 01:37:33.840] Notice of 17-4-26. Every law enforcement officer arresting under a warrant shall exercise reasonable diligence in bringing the person arrested before the judicial officer [01:37:33.840 --> 01:37:44.840] authorized to examine, commit, or receive bail in any event to present the person or to present the person arrest. [01:37:44.840 --> 01:38:02.840] The accused shall be notified as to when and where the commitment hearing is to be held and the arrested person who is not notified before hearing of the time and place of the commitment hearing shall be released. [01:38:02.840 --> 01:38:12.840] Okay. Now, that's with a warrant. Where's the statute dealing with the one without? [01:38:12.840 --> 01:38:21.840] Well, I don't have that one because that one didn't apply to me because I was arrested with a warrant. And I don't have the one without a warrant. [01:38:21.840 --> 01:38:22.840] Okay. [01:38:22.840 --> 01:38:25.840] Written down on this particular one. I don't have it on this. [01:38:25.840 --> 01:38:37.840] So in your particular situation, you were arrested on a warrant, but am I correct in stating the reason you're bringing it up is that they somehow did not comply with these provisions you're reading? [01:38:37.840 --> 01:38:47.840] Oh, they sure did not. And they did take me directly to a jail in an adjacent county. The next county, over. [01:38:47.840 --> 01:38:53.840] Yeah, but how long were you there before you appeared before that magistrate? [01:38:53.840 --> 01:39:01.840] Until they took me to the county where the warrant originated, which was four days. [01:39:01.840 --> 01:39:09.840] Right. But when you say four days, are you taking nights or are you taking only days? [01:39:09.840 --> 01:39:24.840] From the day, from the morning, from the minute I was arrested, which was on a Sunday to the Wednesday that they transported me from one county to the next. [01:39:24.840 --> 01:39:29.840] Did that time exceed 72 hours? [01:39:29.840 --> 01:39:32.840] Yes. [01:39:32.840 --> 01:39:35.840] Okay. [01:39:35.840 --> 01:39:45.840] By how much? [01:39:45.840 --> 01:39:48.840] I'm going to say by at least six or seven hours. [01:39:48.840 --> 01:39:51.840] Okay. [01:39:51.840 --> 01:40:14.840] Then you might have a margin for which you have an error and or cause of action. Because if the courts have ruled that that leeway is 30 to 40 minutes versus six hours, then you may be able to sue for false imprisonment. [01:40:14.840 --> 01:40:25.840] Okay. If the courts have said that up to eight hours beyond the 72 is acceptable, then that would be so nice. [01:40:25.840 --> 01:40:30.840] Because remember, you said that these are superior court rules, right? [01:40:30.840 --> 01:40:47.840] Okay. One of the one of these statutes, which is rule 26.1, that was the uniform superior court rules of the state of Georgia. Right. When I just read to you with the official code of Georgia, that's found at 17-4-26. [01:40:47.840 --> 01:40:56.840] But I don't see that they're in conflict. They both have the same time requirement, right? [01:40:56.840 --> 01:41:09.840] This one doesn't have a time requirement. This one says every law officer arresting under a warrant shall exercise reasonable diligence in bringing the person arrested before a judicial officer. [01:41:09.840 --> 01:41:26.840] Yeah. But somewhere there's got to be a rule that stipulates what reasonable is in this case. And it looks like the superior court has said 72 hours if arrested with a warrant is reasonable. So the question is, is has that same court or a higher court if there is one, which I don't think there will be, will there? [01:41:41.840 --> 01:41:48.840] That is your Supreme Court, is it not? [01:41:48.840 --> 01:41:50.840] No. [01:41:50.840 --> 01:41:56.840] Well, I can't see that the rules will be different across the state of Georgia is what I'm getting at. [01:41:56.840 --> 01:42:06.840] So whoever's making these rules would have to have the authority to make it statewide. Generally, that's the Supreme Court of the state. So if that's the case, then the question is, has that court said their 72 hour determination is written in stone, or have they given it some leeway for error and or delay? [01:42:36.840 --> 01:42:41.840] It all depends on what claim you wind up with and where you're going to file it. [01:42:54.840 --> 01:43:02.840] As far as in state, I don't know what your particular state would allow if you're going to pursue it in a state case issue. [01:43:02.840 --> 01:43:10.840] So it really depends on where you're filing, and it is possible to sue in both simultaneously if you can afford to do that. [01:46:46.840 --> 01:46:55.840] Okay, because when I was looking this up a while back, I came up with a few cases, actually here in the state of Georgia, [01:46:55.840 --> 01:47:04.840] where it actually says an officer under a warrant should exercise reasonable diligence in bringing the person arrested before a judicial officer. [01:47:04.840 --> 01:47:11.840] While the officer has the authority to imprison the person arrested before the commitment trial, [01:47:11.840 --> 01:47:17.840] he should not do so arbitrarily and without reasonable cause, and that's in King v. State. [01:47:17.840 --> 01:47:21.840] Now, I have that. That was a – it looks like – [01:47:21.840 --> 01:47:30.840] Yeah, but see, right there, they said he does. Now, the question is, does that case speak directly to the issue of a warranted arrest? [01:47:30.840 --> 01:47:38.840] Something has changed here in the legislature, because when I went to go put this into the Lexus, it came out with bad case law. [01:47:38.840 --> 01:47:44.840] Yeah, it may no longer be valid, which means there's going to be new rulings on it, and if you put it in Lexus, it should have told you. [01:47:44.840 --> 01:47:48.840] Good case law and then something is bad case law? [01:47:48.840 --> 01:47:53.840] Lexus will flag it as to whether or not it's still the controlling case. [01:47:53.840 --> 01:47:59.840] So if it's now showing that it's bad case law, there are two reasons for that. [01:47:59.840 --> 01:48:08.840] It's either been overruled by another decision or it's been legislatively altered. [01:48:08.840 --> 01:48:13.840] So it's no longer a valid decision. [01:48:40.840 --> 01:48:50.840] I'm calling in regards to last week's show and some research I've done, which prompted me from that show. [01:48:50.840 --> 01:48:54.840] I believe you were talking about the speed limit in Texas. [01:48:54.840 --> 01:48:55.840] Yeah. [01:48:55.840 --> 01:49:01.840] You alluded to the fact that the statute and the bill or the law aren't the same. [01:49:01.840 --> 01:49:02.840] Correct. [01:49:02.840 --> 01:49:06.840] Because one of them said you have to have a collision or a damage or something. [01:49:06.840 --> 01:49:17.840] Anyway, so I tried to apply that in Louisiana, and I went down to my library to inquire with their books and such. [01:49:17.840 --> 01:49:24.840] The librarian told me she doesn't have that there, but referred me to the law library of Louisiana. [01:49:24.840 --> 01:49:33.840] So I called them up and got a lawyer librarian slash, and she was very nice, spent about 45 minutes on the phone with me. [01:49:33.840 --> 01:49:43.840] And I explained to her basically what I think I understood from you, and she gave me an extensive list of acts and bills, [01:49:43.840 --> 01:49:49.840] but told me that I told her my intentions were to see the difference between the bill and the act and the statute. [01:49:49.840 --> 01:49:52.840] And she said, well, the statute is the law and the bill. [01:49:52.840 --> 01:50:00.840] And once they come out as the statute, everything before that has been amended, negotiated away, [01:50:00.840 --> 01:50:06.840] or no longer applicable because everything you need is in the statute. [01:50:06.840 --> 01:50:08.840] That's not true. [01:50:08.840 --> 01:50:10.840] And here's why it's not true. [01:50:10.840 --> 01:50:11.840] Okay. [01:50:11.840 --> 01:50:20.840] If you go to the Secretary of State and you ask the Secretary of State upon what original enactments of the legislature are all current revised statutes based, [01:50:20.840 --> 01:50:24.840] they will not tell you it's the last legislative session. [01:50:24.840 --> 01:50:29.840] For instance, here in Texas, if the Secretary of State is asked to certify the statute, [01:50:29.840 --> 01:50:40.840] they have to certify it as compliant with the enactments of the legislature in 1925 because that's where the actual law is. [01:50:40.840 --> 01:50:46.840] See, the difference here is all these things this attorney is talking about, about the statute being law. [01:50:46.840 --> 01:50:47.840] No, it's not. [01:50:47.840 --> 01:50:56.840] A revised statute is not the underlying law upon which that revision is required to be based. [01:50:56.840 --> 01:50:57.840] Let me ask you this. [01:50:57.840 --> 01:51:01.840] Was she deliberately deceiving me or was she ignorant herself? [01:51:01.840 --> 01:51:05.840] She's ignorant herself would be the most likely answer. [01:51:05.840 --> 01:51:15.840] You have to remember that most lawyers today are not being taught to read and understand actual law or how law even comes into existence. [01:51:15.840 --> 01:51:26.840] They're being taught only how to understand court interpretations of the statutes as they exist or existed at the time. [01:51:26.840 --> 01:51:30.840] They're not taught anything about actual law. [01:51:30.840 --> 01:51:37.840] They're taught about the way they want to practice it and the way the courts have ruled upon it. [01:51:37.840 --> 01:51:51.840] Okay, so I've got a list going back to 1948 in regard to the specific Louisiana revised statute 3261, traffic regulations, speed restriction. [01:51:51.840 --> 01:51:59.840] Okay, your best bet to find out where your actual root law is is to contact the Secretary of State and ask them. [01:51:59.840 --> 01:52:11.840] If you have to certify compliance of a statute with underlying law, what legislative session and year do you need to certify it as compliant with? [01:52:11.840 --> 01:52:16.840] Okay, according to her, I've got that all the way back to 1948. [01:52:16.840 --> 01:52:17.840] According to who? [01:52:17.840 --> 01:52:20.840] The librarian lawyer. [01:52:20.840 --> 01:52:21.840] Okay. [01:52:21.840 --> 01:52:22.840] The law library. [01:52:22.840 --> 01:52:26.840] Is the librarian the Secretary of State? [01:52:26.840 --> 01:52:28.840] Not to my knowledge. [01:52:28.840 --> 01:52:32.840] Then I don't care what she said. [01:52:32.840 --> 01:52:36.840] She can't certify squat, can she? [01:52:36.840 --> 01:52:37.840] Not that I know of. [01:52:37.840 --> 01:52:38.840] Okay, then. [01:52:38.840 --> 01:52:44.840] Give me the correct information to the original act, which she did cite the number in. [01:52:44.840 --> 01:52:45.840] No, no, no. [01:52:45.840 --> 01:52:52.840] She gave you the information that goes back to the historical level that she knows. [01:52:52.840 --> 01:52:56.840] That doesn't necessarily mean it is the original act. [01:52:56.840 --> 01:53:04.840] You can trace back Texas statutes 15 different times, but that's still not the original act. [01:53:04.840 --> 01:53:10.840] Do you know when the original registration act or licensing act in Texas was put into place? [01:53:10.840 --> 01:53:11.840] 1902. [01:53:11.840 --> 01:53:13.840] 1915. [01:53:13.840 --> 01:53:14.840] Okay. [01:53:14.840 --> 01:53:15.840] Okay. [01:53:15.840 --> 01:53:25.840] But the actual law that all of the revisions today are based on is 1925, 10 years later. [01:53:25.840 --> 01:53:29.840] So we don't care what the original act is either. [01:53:29.840 --> 01:53:40.840] We only care about what the last actual legislative enactments that all the current revisions sit on actually is. [01:53:40.840 --> 01:53:47.840] All the amendments sit on, because this thing has been amended one, two, three, four, five, six, six times. [01:53:47.840 --> 01:53:48.840] Right. [01:53:48.840 --> 01:53:52.840] And it may have actually been amended more. [01:53:52.840 --> 01:53:54.840] Yeah, yeah. [01:53:54.840 --> 01:53:55.840] Right. [01:53:55.840 --> 01:54:03.840] She did say because she gave me these because she said I could access it from my computer back to 97, but I couldn't. [01:54:03.840 --> 01:54:07.840] She gave me these other ones because I couldn't go on my computer and get them. [01:54:07.840 --> 01:54:13.840] So she gave me the numbers so I can contact the, what do you call them, Secretary of State. [01:54:13.840 --> 01:54:14.840] All right. [01:54:38.840 --> 01:54:45.840] I have a friend who last week had the unfortunate incident of having the APB happen to him. [01:54:45.840 --> 01:54:48.840] The story is outrageous, but that's not really what I'm calling about. [01:54:48.840 --> 01:54:54.840] I'm trying to help him through the process now, and I called the open records department on Friday, [01:54:54.840 --> 01:54:58.840] and I guess I talked to a lady who couldn't really answer my question. [01:54:58.840 --> 01:55:03.840] I guess currently APB has a website where you can look up a case number and it will give you the details. [01:55:03.840 --> 01:55:06.840] That would give you the details of the arrest, [01:55:06.840 --> 01:55:10.840] but it does not contain the officer's narrative on the website. [01:55:10.840 --> 01:55:11.840] Right. [01:55:11.840 --> 01:55:13.840] The police report will not be posted there. [01:55:13.840 --> 01:55:19.840] Right. So at that point on Friday, I couldn't access that record on the website. [01:55:19.840 --> 01:55:23.840] So I left a message with somebody at the police department. [01:55:23.840 --> 01:55:24.840] They called me back today. [01:55:24.840 --> 01:55:27.840] And from the best I can tell, she was not with open records. [01:55:27.840 --> 01:55:29.840] She wasn't the custodian of records. [01:55:29.840 --> 01:55:32.840] She was somebody calling back to answer my question. [01:55:32.840 --> 01:55:36.840] And so she told me, I told her, well, my friend was in Austin. [01:55:36.840 --> 01:55:41.840] Could he come down and get the report with the officer's narrative and everything else? [01:55:41.840 --> 01:55:44.840] And again, she wasn't the actual custodian of the record. [01:55:44.840 --> 01:55:47.840] But she said, no, we don't give out police reports. [01:55:47.840 --> 01:55:53.840] We have an opinion from the AG that says that those can only be obtained through discovery. [01:55:53.840 --> 01:55:56.840] So she was pretty much a neck downer to me. [01:55:56.840 --> 01:55:58.840] I don't think she really knew exactly. [01:55:58.840 --> 01:56:01.840] Did she give you the AG's opinion that she was referring to? [01:56:01.840 --> 01:56:03.840] No, no, she couldn't. [01:56:03.840 --> 01:56:05.840] I asked her specifics. [01:56:05.840 --> 01:56:07.840] So I was calling to ask you in your experience, [01:56:07.840 --> 01:56:13.840] can you go down there and get the officer's narrative or is that normal? [01:56:13.840 --> 01:56:17.840] Unless something has changed in the statutes, [01:56:17.840 --> 01:56:22.840] 552 of the government code, which is the Public Information Act, [01:56:22.840 --> 01:56:27.840] does not exclude police reports from public information. [01:56:27.840 --> 01:56:28.840] Right. [01:56:28.840 --> 01:56:29.840] Okay. [01:56:29.840 --> 01:56:31.840] Does not exclude them. [01:56:31.840 --> 01:56:39.840] And an AG's opinion that excludes them would have to cite a specific legal basis for why they could be. [01:56:39.840 --> 01:56:42.840] And I don't see that happening. [01:56:42.840 --> 01:56:45.840] And that's usually on a case-by-case basis, though, correct? [01:56:45.840 --> 01:56:46.840] Correct. [01:56:46.840 --> 01:56:53.840] Like, for instance, if it deals with a juvenile and those records have been sealed by the court, [01:56:53.840 --> 01:57:01.840] that would exclude any police reports relating to that record possibly if the court covered that. [01:57:01.840 --> 01:57:07.840] But generally speaking, anyone can go down and get a copy of a police report. [01:57:07.840 --> 01:57:11.840] They always try to make you pay for it, but you can get it. [01:57:11.840 --> 01:57:12.840] Okay. [01:57:12.840 --> 01:57:17.840] I just wanted to ask about your experience if you've ever seen or anything like that or if you got a report lately. [01:57:17.840 --> 01:57:25.840] Most city cops have now gotten to the point where they do their best to prevent the public from getting those police reports. [01:57:25.840 --> 01:57:29.840] They cannot make a policy that says they're only allowed in discovery. [01:57:29.840 --> 01:57:36.840] The legislature sets that, and that is 552 of the government code, the Public Information Act. [01:57:36.840 --> 01:57:37.840] Okay. [01:57:37.840 --> 01:57:43.840] I know that you probably deal with APD a lot, so I just wanted to see if you'd heard of anything like that. [01:57:43.840 --> 01:57:46.840] Well, your friend can also file a discovery request. [01:57:46.840 --> 01:57:52.840] Just go ahead and file it and get it that way as well and do a PIR and then see what happens [01:57:52.840 --> 01:58:00.840] because they would have to provide you with a copy of that AG's opinion as the reason they're not going to respond to your PIR, [01:58:00.840 --> 01:58:06.840] in which case you would then get to read it and determine whether or not that's what it actually says. [01:58:06.840 --> 01:58:07.840] Right. [01:58:07.840 --> 01:58:08.840] Okay. [01:58:08.840 --> 01:58:09.840] All right.
