[01:12.000 --> 01:16.000] Transportation Secretary Anthony Foxx told reporters, quote, the signal we're setting [01:16.000 --> 01:20.000] today is that when you're in the national airspace, it is a very serious matter. [01:20.000 --> 01:24.000] According to the Federal Aviation Administration, pilots of passenger planes and other aircraft [01:24.000 --> 01:28.000] have been reporting more than 100 sightings or close calls with civilian drones a month, [01:28.000 --> 01:30.000] a significant increase from just last year. [01:30.000 --> 01:35.000] Under current FAA guidelines, drone owners are not supposed to fly their aircraft above [01:35.000 --> 01:39.000] 400 feet or within five miles of an airport without permission, but regulators have been [01:39.000 --> 01:41.000] unable to prosecute rule breakers. [01:41.000 --> 01:45.000] The FAA and the Transportation Department are setting up a team composed of government [01:45.000 --> 01:48.000] officials and industry representatives to write up new regulatory codes. [01:48.000 --> 01:52.000] Foxx also stated that the group has until November 20 to finalize its recommendations [01:52.000 --> 01:55.000] that the government can set up the registry before Christmas. [02:01.000 --> 02:10.000] The FAA stated that it will impose penalties on anyone who does not comply. [02:10.000 --> 02:14.000] The Eighth Circuit Court of Appeals will hear oral arguments Tuesday on a dispute between [02:14.000 --> 02:18.000] former Minnesota Governor Jesse Ventura and the State of American Sniper author Chris Kyle. [02:18.000 --> 02:24.000] Ventura won a $1.8 million settlement last year for a passage in Kyle's book, which he said was false. [02:24.000 --> 02:28.000] Apparently, Kyle described punching out a man, which was later identified as Ventura. [02:28.000 --> 02:32.000] The issue that many First Amendment scholars are bringing up is that the judge improperly [02:32.000 --> 02:38.000] instructed jurors on the actual malice definition, which holds public figures at a higher standard, [02:38.000 --> 02:43.000] improving defamation. [05:09.000 --> 05:14.000] And I bring that up because if you haven't been coming to the classes or listening to the show [05:14.000 --> 05:18.000] or putting these things into practice of paying attention to what your public servants are doing, [05:18.000 --> 05:22.000] then most likely you fall into the category of too busy to care. [05:22.000 --> 05:25.000] Well, folks, we're running out of time to start caring. [05:25.000 --> 05:31.000] And we're most certainly running out of time for that caring to turn into something useful. [06:22.000 --> 06:29.000] But despite your belief or lack of belief, there are many things that are in the Bible [06:29.000 --> 06:34.000] that definitely rate according to the life I've lived. [06:34.000 --> 06:42.000] I can find references in the Bible to many things that I've seen in my life as to exactly how things turn out. [06:42.000 --> 06:47.000] Now, anybody with any real life experience could probably write the same thing down and somebody else [06:47.000 --> 06:54.000] would run across it later because human beings tend to repeat the same patterns being human beings. [06:54.000 --> 06:55.000] And that's all okay, too. [06:55.000 --> 07:02.000] Either way, it's a way to learn and a way to understand and put into context the things that are going on in your life, [07:02.000 --> 07:06.000] whether it be your first experience or your hundred. [07:06.000 --> 07:15.000] And my experience with a lot of this is that we are being told that good is evil and evil is good. [07:15.000 --> 07:19.000] Political correctness is proper. [07:19.000 --> 07:27.000] And telling the truth is somehow no longer a virtue. [07:27.000 --> 07:32.000] In fact, it's becoming a criminal act. [07:32.000 --> 07:42.000] This, of course, goes into exactly how it was portrayed in Orwell's 1984, telling the truth was a criminal act, [07:42.000 --> 07:51.000] if the truth involved exposing what the government was doing to the people and how. [07:51.000 --> 07:53.000] And now we see more and more of it every day. [07:53.000 --> 08:02.000] We have Hillary Clinton, who exposed top secret information using an illegal email server from her home with no security, [08:02.000 --> 08:07.000] no anything, and she is running for president. [08:07.000 --> 08:15.000] You have Edward Snowden, who exposed everything that the government was doing wrong. [08:15.000 --> 08:20.000] And he did it through proper channels as far as being a whistleblower. [08:20.000 --> 08:31.000] And he did not release information that would have cost lives like Hillary did, and he's wanted for treason. [08:31.000 --> 08:35.000] We're calling good evil and evil good. [08:35.000 --> 08:39.000] We're completely off our nut in America anymore. [08:39.000 --> 08:44.000] We have no common sense left in this country. [08:44.000 --> 08:50.000] We could not be more off course if we were the Titanic. [08:50.000 --> 09:00.000] And the unfortunate thing is we're off course enough that we're going to wind up just like the Titanic. [09:00.000 --> 09:03.000] And I, for one, I'm not fond of that concept. [09:03.000 --> 09:11.000] That's not how I was raised to think or how I was raised to live or the kind of things that I want to see happen. [09:11.000 --> 09:16.000] Never, ever. [09:16.000 --> 09:20.000] We've got to fix what's going on here. [09:20.000 --> 09:22.000] We can go the Gandhi way. [09:22.000 --> 09:25.000] We can go the Revolutionary War way. [09:25.000 --> 09:26.000] Okay? [09:26.000 --> 09:31.000] But we need to do something. [09:31.000 --> 09:34.000] Because if we don't, it's gone. [09:34.000 --> 09:41.000] The American dream has now become the American nightmare and the American disillusionment. [09:41.000 --> 09:52.000] And the more you hold on to the dream of what was but do nothing to bring it back, the more fleeting it's going to become. [09:52.000 --> 09:59.000] And the more you're going to live in despair for hopes lost and dashed against the rocks. [09:59.000 --> 10:09.000] Because right now, every time I try to explain how things work and why it's wrong or anything else, [10:09.000 --> 10:18.000] I hear more despair about, well, if we can't do anything, if we can't do anything, and people just give up. [10:18.000 --> 10:21.000] Well, that's wrong. [10:21.000 --> 10:23.000] We can do something. [10:23.000 --> 10:34.000] What we cannot do, however, is go through the normal channels that those that have betrayed this country have set up to run us through. [10:34.000 --> 10:41.000] You cannot fix a broken system by following the rules that system created. [10:41.000 --> 10:45.000] That would be oxymoronic. [10:45.000 --> 10:56.000] You cannot fix a system from within the same system using the same rules that screwed up the system. [10:56.000 --> 11:00.000] It just won't work. [11:00.000 --> 11:10.000] Sometimes it is actually a better idea to simply blow the bridge and wreck the train. [11:10.000 --> 11:15.000] And if we don't do something, that's going to happen regardless. [11:15.000 --> 11:20.000] We just won't be the one driving. [11:20.000 --> 11:35.000] There's a reason why Jefferson said that the tree of liberty required watering from time to time with both the blood of patriots and tyrants. [11:35.000 --> 11:40.000] We want something that has never existed. [11:40.000 --> 11:46.000] Peace and prosperity without the willingness to fight to keep it. [11:46.000 --> 11:53.000] Peace and prosperity without willing to fight to establish it. [11:53.000 --> 12:12.000] This was the lesson that I believe the Founding Fathers were trying to present to us in not only the recording of the debates over the Constitution, but the enshrinement of everything that was in the Constitution to begin with. [12:12.000 --> 12:38.000] Anybody that understands rights, liberty, and limitations of power understands that every single thing the federal and state constitutions have prohibited government from doing, government has ignored and proceeded to do anyway. [12:38.000 --> 12:45.000] We were never supposed to allow them to regain the power that they now have. [12:45.000 --> 12:59.000] We were never supposed to allow one class of people to take control of the entire system and make themselves the sole beneficiaries of what's in it. [12:59.000 --> 13:01.000] But that is what we've done. [13:01.000 --> 13:12.000] We got successful, we got prosperous, which then made us fat, lazy, and apathetic. [13:12.000 --> 13:23.000] And then they began the true program of making sure that that role reversal became stronger and harder to fix. [13:23.000 --> 13:28.000] They started with our schools, the education system. [13:28.000 --> 13:33.000] It didn't matter whether it was kindergarten or college. [13:33.000 --> 13:51.000] You've got liberal status-minded teachers teaching our children that obedience is the only way to be happy, that you cannot succeed without government intervention and control of every aspect of what you do, [13:51.000 --> 13:59.000] and that you are a criminal for standing up for yourself and telling government to butt out. [13:59.000 --> 14:11.000] You are vilified in every walk of life for telling the IRS you don't owe them money and that you never did, for refusing to pay money that you didn't owe, [14:11.000 --> 14:30.000] for telling a cop to kiss your butt because he had no legal basis for pulling you over or writing you a ticket or arresting you. But those in the system expend all of their efforts to protect those things that they have put in place [14:30.000 --> 14:39.000] and that corral us into having to be the sheep rather than the watchdog. [14:39.000 --> 14:49.000] And I've never liked that role. I never liked that role when I was a child, and I got out of liking that role at a very early age. [14:49.000 --> 14:56.000] There was a reason I was rebellious. I didn't understand what it was at the time. I didn't recognize it for what it was. [14:56.000 --> 15:03.000] But I did know when someone was being a hypocrite to me, telling me, this is what you do. [15:03.000 --> 15:15.000] Don't do what you do because you've seen me do it, and don't do what you do because you've been told that A is this, but you have to do B instead. [15:15.000 --> 15:19.000] That just never worked for me. [15:19.000 --> 15:30.000] And if you think about it, this is exactly how you recognize the people that will never wake up. [15:30.000 --> 15:36.000] And there are going to be those people. They will never wake up. [15:36.000 --> 15:58.000] And they will fight tooth and nail to keep what they think is real, including aiding and abetting those in government against those of us that would say no more. [15:58.000 --> 16:18.000] The Matrix wasn't really just a movie if your eyes have been opened, if you can learn to recognize that you're being told one thing, but everything is being done completely different. [16:18.000 --> 16:26.000] But they're trying to change that. They're trying to make the two align, and not in a way that helps you, but in a way that enslaves you. [16:26.000 --> 16:37.000] They're now trying to rewrite history so that everything aligns with government has always been the one in charge. [16:37.000 --> 16:42.000] That government is the only authority in America. [16:42.000 --> 16:49.000] That the people are only as free as government wants them to be and wishes to allow. Now, remember, I just told you, you cannot fix a broken system from within the system using the same things that were used to break it in the first place. [20:18.000 --> 20:28.000] Now, here in America, we have a federal law which was codified in Title 42 pursuing public officials. [20:28.000 --> 20:42.000] But you have federal courts that are in concert and collusion with these public officials to prevent your lawsuits from being successful unless certain other things are met. [20:42.000 --> 20:51.000] It is very, very difficult to complete and win a pro se Title 42 lawsuit. [20:51.000 --> 21:03.000] And that's by design. Once again, the rules within the system were set up to prevent you from being successful as often as possible. [21:03.000 --> 21:20.000] And of course, the goal of this was to ensure that the attorneys got rich off whatever the lawsuit was by requiring you to pay them to guide you through the maze of crap that they themselves created as an obstacle to your ability to get justice. [21:20.000 --> 21:28.000] And this maze was carved out not only by the attorneys, but the attorneys who now serve as judges. [21:28.000 --> 21:39.000] They are the ones solely responsible for the difficulties inherent in our ability to hold a public servant accountable for wrongdoing. [21:39.000 --> 21:50.000] They are the sole persons liable for the fact that they have granted immunity that the people never gave them for those acts. [21:50.000 --> 21:58.000] The courts and the courts alone have concocted immunity. [21:58.000 --> 22:08.000] The word immunity does not appear in any Constitution in relation to anything done by a public servant. [22:08.000 --> 22:26.000] Nowhere. And at best, immunity could only be applied if and only if the public servant acted completely within the actual law. [22:26.000 --> 22:41.000] And the law itself was completely compliant with all Constitutional allocations of authority, the delegated power, and the rights of the people it was intended to protect. [22:41.000 --> 22:56.000] In other words, the law itself cannot in any way violate any provision of the Constitution, nor can it in any way be violative of a right in order to accomplish its designed purpose. [22:56.000 --> 23:22.000] If it was, then the public servant can't, or if it isn't, the public servant cannot claim immunity or good faith for acting under it, because just like the rest of us, a public servant is required to understand the law, the limitations of their power, and when that power is used in a method that would be violative of the Constitution. [23:22.000 --> 23:50.000] But instead, the system and those that created the rules for it have designed it so that they are given reasonable doubt under any legal duty imposed upon them, or lawful duty imposed upon them, as making a mistake for which they cannot be held accountable, or for which they have immunity created by the same public servants that were supposed to be holding accountable. [23:50.000 --> 24:07.000] It's upside down. It's wrong. It needs to stop. It needs to change. And this BS about us having the best judicial system in the world is a crock of media hype. [24:07.000 --> 24:30.000] We don't have the best judicial system in the world because we don't have the best people in the judicial system in the world. We have a bunch of self-serving morons that either want to increase their own power, their own wealth, their own ability to control other people, or that of the government that they worship and adore. [24:30.000 --> 24:48.000] The people be damned. And as long as we have even one of those in a position of authority, this country and the people in it will never be free. [24:48.000 --> 25:02.000] But until you learn what real freedom is, what real responsibility and liability is, you will never understand the concept of liberty. [25:02.000 --> 25:18.000] You can talk about it all day, but you will never understand it. And you will always see it as having some sort of reasonable limitation that some other person can dictate rather than it being dictated by natural order. [25:18.000 --> 25:47.000] And what do I mean by natural order? It's this. Just because you have rights, you have no right to use your rights to prevent, prohibit, destroy, diminish, or interfere with the free exercise thereof of the rights, person, or property of anyone else. [25:47.000 --> 25:57.000] You don't need other men to tell you that. You don't need other men to create a law telling you that you can't do that. Common sense says you can't do that. [25:57.000 --> 26:08.000] Because the moment you would decide that you wouldn't want somebody able to do that to you, then you fully understand that you also do not have the power to do it to them. [26:08.000 --> 26:22.000] And if you don't, then you're psychopathic to begin with. But people don't want the liability and responsibility that goes with this. [26:22.000 --> 26:39.000] They don't like it because that means then that they can't blame someone else for what they do or do not do. They cannot pass the buck. [26:39.000 --> 26:55.000] And nowadays, that's a cardinal sin to people that they cannot shift the blame. I mean, let's go back to the press conference here for just as an example. [26:55.000 --> 27:12.000] You have Hillary Clinton standing up there being questioned about this email server. And you have a reporter that asks her if she knowingly wiped the server. [27:12.000 --> 27:30.000] And you see this. I can't even think of a proper pronoun to apply to this thing. You see her stand there and go wipe it. You mean what, like with a cloth? [27:30.000 --> 27:46.000] And from that statement, she wants you to believe that at any other point, she would be qualified to be called president of the United States. [27:46.000 --> 28:06.000] To play that ignorant and then claim to be qualified to be president of a country or I should say in this case, a collection of countries. [28:06.000 --> 28:22.000] And yet you will have those sheeple that will not see that for what it actually is and applaud her ability to answer a question so intelligently. What, like with a cloth? [28:22.000 --> 28:29.000] We're doomed, folks. If this is the best we can do, we're doomed. [28:29.000 --> 28:39.000] We got to wake up. We got to do better. We just have to do better. [28:39.000 --> 28:50.000] I can't honestly say I would support any person running for public office. And of course, everybody goes, oh, well, then you have no reason to complain. How does the fact that I don't think any one of them is qualified to run a country and therefore my refusal to vote for them, somehow my fault that a bunch of morons other than myself did vote them in? How are you? Ah, well, so far so good. [33:59.000 --> 34:09.000] That's good. I've kind of been thrown into the wolves den here and I see your hand reaching through the light of the tunnel. [34:09.000 --> 34:28.000] I was pulled over October 9th on my travels and basically my machine was stolen from me and I need a little bit of help to see what I can do to fight this. I have no money to get it back, so I've pretty much come to the conclusion it's gone. [34:28.000 --> 34:47.000] I've already gathered my police report and I got the complaint. They're civil infractions. I've looked them up. They pose no jail time, just fines and penalties, of course. [34:47.000 --> 34:52.000] I need to know if there is anything that I should be filing now. [34:52.000 --> 34:56.000] Okay, you said that the charges against you were civil infractions. [34:56.000 --> 35:02.000] Correct. You're positive. Yes, I've already looked into the Indiana Motor Vehicle Code. [35:02.000 --> 35:10.000] Okay, and how did they confront you to make the charges? [35:10.000 --> 35:15.000] I was traveling and a police officer pulled me over. [35:15.000 --> 35:16.000] For what? [35:16.000 --> 35:42.000] I have a notice on the back of my machine that I'm not for hire. And in the state of Indiana, that little 50cc machine that I travel on is not considered having a license to operate it, but you do have to register it, of course, and pay to register it. [35:42.000 --> 35:59.000] And they give you a little bit of a test and then you get an endorsement that is placed on your ID, which I have not had since last year because I refused to get one because I don't need it, or a driver's license, and they give you a little tag to put on the back of your machine. [35:59.000 --> 36:08.000] Okay. Well, my question, but everything you're talking about that they say you're supposed to do, it's a civil infraction not to do it? [36:08.000 --> 36:09.000] Correct. [36:09.000 --> 36:19.000] Okay. And the officer confronted you on this, how specifically? [36:19.000 --> 36:31.000] He pulled me over, got out of his squad car, walked up beside me and asked me for an ID. I told him I did not carry such a thing. He asked me for registration for my motor driven cycle. [36:31.000 --> 36:42.000] And I told him I did not have such a thing. I did not ask permission for that. He asked me if I had any form of ID to hand him and I told him I do not have such a thing to hand him. [36:42.000 --> 36:57.000] And then I asked him if I was under arrest. He says no, but if you fail to ID, you will be. Now I've been going through the motor vehicle code and I haven't found out if it is a arrestable offense in and of itself for failure to ID. [36:57.000 --> 37:01.000] Well, failure to ID won't be in the motor vehicle code. [37:01.000 --> 37:05.000] Correct. It will be in criminal, I do believe, or civil. [37:05.000 --> 37:09.000] It will be in whatever they have for a penal code most likely. [37:09.000 --> 37:15.000] Yeah, we have a criminal codes and procedures and civil codes and procedures. [37:15.000 --> 37:29.000] Okay. Well, here's the problem. What arrest power does any law enforcement officer have for a civil infraction? [37:29.000 --> 37:30.000] None that I know of. [37:30.000 --> 37:38.000] Exactly. So Hal was pulling you over, not an arrest. [37:38.000 --> 37:46.000] Hal was preventing you at leaving the scene at your liberty, not an arrest. [37:46.000 --> 37:54.000] Where was his warrant? When did he get it? And since this was civil, what probable cause did he state to get it? [37:54.000 --> 38:02.000] What you need to do is move to suppress any and all information obtained by the officer at the stop as the stop was illegal. [38:02.000 --> 38:09.000] And because the stop was illegal and constitutes either false arrest or false imprisonment, whichever one prevails in Indiana, [38:09.000 --> 38:16.000] everything the officer discovered is fruit of the poison tree and therefore inadmissible. [38:16.000 --> 38:26.000] And while we're here dismissing the charges against me, I would like to file charges against the officer for false imprisonment or false arrest [38:26.000 --> 38:37.000] and for theft of my private property while displaying a deadly weapon, which makes it armed robbery, if not grand theft auto. [38:37.000 --> 38:43.000] Okay. So that means I should be filing a motion to dismiss together? [38:43.000 --> 38:44.000] Yeah. [38:44.000 --> 38:45.000] With the city court? [38:45.000 --> 38:46.000] Yeah. [38:46.000 --> 38:49.000] Are there any templates out there that I could use to do this? [38:49.000 --> 38:55.000] I have no idea if there's any templates out there or not. I wrote my own. That's what's in the seminar material. [38:55.000 --> 38:58.000] So if you want a template, seminar material would be the place to get it. [38:58.000 --> 39:04.000] But if you ain't got money to get your moped back, then you ain't going to have money to get seminar material. [39:04.000 --> 39:09.000] Right. Hey, would you be willing to take payments on that? Because I do want it. [39:09.000 --> 39:17.000] Well, unfortunately, I don't have any way to ensure payments will be made. That's the only problem. [39:19.000 --> 39:29.000] And because we use that to fund the network, we can't just do it on the cuff and expect people to, you know, do what they're supposed to do because I've had too many of them that don't. [39:33.000 --> 39:43.000] But if you do a search, I'm pretty sure you'll be able to find, you know, motion to dismiss Indiana template, whatever, and find something for that. [39:43.000 --> 39:50.000] Okay. Is there anything else along the line? Because I haven't even been to the hearing. The hearing isn't set until the middle of December. [39:50.000 --> 40:00.000] So I've been doing this for a couple years now, but I haven't found a lot of things in a different code because, of course, you know, there's so many pages, it takes so long to do it. [40:00.000 --> 40:04.000] Is there anything else other than filing that motion to dismiss? [40:04.000 --> 40:12.000] Well, you need to look at the criteria of all the things that I just told you and find the case law and the arguments that support it the best. [40:12.000 --> 40:19.000] Okay. You need to be looking for case law in Indiana that says that a civil infraction is not an arrestable offense. [40:19.000 --> 40:26.000] You need to find case law that says when an officer arrests for someone for a civil infraction, he's guilty of false imprisonment or false arrest. [40:26.000 --> 40:34.000] That's where you need to be starting. Okay. And he also, like he did at the end of the stop, he set me free. [40:34.000 --> 40:38.000] Basically, he just wanted my machine. That's all it was. [40:38.000 --> 40:44.000] The point is he had no authority to stop you or take the machine. [40:44.000 --> 40:57.000] Correct. Correct. So I need to find out if he had any lawful authority basically to take the machine then. [40:57.000 --> 41:23.000] And he did not arrest it. I don't know if it's considered arrest. [46:58.000 --> 47:03.000] Yeah, you need to get the case law dealing with all those things that I mentioned, you know, [47:03.000 --> 47:11.000] what were an officer is committing a wrongdoing by arresting for someone for a civil infraction, [47:11.000 --> 47:19.000] exactly what that wrongdoing is, whether or not evidence made in such a case is admissible, and so on and so forth, [47:19.000 --> 47:26.000] which there's no reasonable way that it could be considered admissible evidence if it was seized illegally without a warrant, [47:26.000 --> 47:33.000] which anything you gave him would have been. [47:33.000 --> 47:37.000] Okay. All right. And of course, I know they're going to railroad me and I know to object. [47:37.000 --> 47:43.000] That's not necessarily true. They're going to have a hard time continuing with what they're doing if you raise the issue [47:43.000 --> 47:51.000] that there was no arrestable offense and the officer's seizure of your person for the original stop [47:51.000 --> 47:58.000] and then the seizure of your property for a civil infraction is completely improper. [47:58.000 --> 48:02.000] You need the case law to back that up, and they cannot just continue on. [48:02.000 --> 48:12.000] And if they do, then you've got a lawsuit because they have no jurisdiction to proceed if a higher court has already said they do not. [48:12.000 --> 48:18.000] Okay. If I can't find nothing in Indiana, would another state suffice? [48:18.000 --> 48:21.000] Then it does not suffice. [48:21.000 --> 48:23.000] Okay. [48:23.000 --> 48:30.000] If it does not exist in Indiana, then you raise it as what's called an issue of first impression. [48:30.000 --> 48:32.000] Okay. [48:32.000 --> 48:38.000] Meaning this has never been ruled upon in this state, so let's have a discussion. [48:38.000 --> 48:44.000] Sounds good, because we need somebody up here to do what you're doing down there. [48:44.000 --> 48:46.000] Definitely. [48:46.000 --> 48:52.000] I'd be looking forward for somebody to take up that banner in the other places in the country. [48:52.000 --> 49:01.000] I totally agree with that, because I'm having a hard time finding people that do agree with me on that aspect. [49:01.000 --> 49:06.000] They're just too asleep, I guess. Eventually they'll hit the pole. [49:06.000 --> 49:09.000] Well, it goes back to what I was saying at the beginning of the show. [49:09.000 --> 49:12.000] You're messing with their thought paradigm. [49:12.000 --> 49:19.000] You're basically telling people that everything they've ever thought and believed and held true and dear is all a big lie, [49:19.000 --> 49:26.000] and that shatters a lot of universes for people, and they're not going to give them up easily. [49:58.000 --> 50:05.000] The reason for my call, I noticed on a lot of your shows you've discussed the transportation script [50:05.000 --> 50:09.000] and specifically talking about traffic stops. [50:09.000 --> 50:10.000] Right. [50:10.000 --> 50:16.000] But how would that operate in relation to an actual motor vehicle accident [50:16.000 --> 50:27.000] that results in a citation being mailed to the person that the officer deemed to be at fault in a crash that he did not witness? [50:27.000 --> 50:31.000] Well, the thing is, is the officer could not testify to the facts of the crash. [50:31.000 --> 50:39.000] He could only testify to what he assumes or imagines happened based upon an investigation he made after the fact. [50:39.000 --> 50:46.000] He cannot testify to any events that led up to or occurred during the crash. [50:46.000 --> 50:54.000] He could only testify to whatever he determined in the investigation conducted after the crash. [50:54.000 --> 51:03.000] He cannot testify as to what other witnesses told him unless those witnesses are present in the courtroom [51:03.000 --> 51:08.000] or have been deposed and the depositions have been submitted into evidence, [51:08.000 --> 51:13.000] and they support whatever the officer is going to testify to. [51:13.000 --> 51:17.000] He can only testify to that of which he has personal knowledge. [51:17.000 --> 51:22.000] Anything else is hearsay? [51:22.000 --> 51:30.000] Well, the reason for that question is let me kind of give you a brief history of what happened here. [51:30.000 --> 51:38.000] Back on October 2nd, my wife was involved in a motor vehicle accident up here in North Texas in a neighboring county, [51:38.000 --> 51:44.000] or actually on a county road that is between two counties, Wichita and Archer County. [51:44.000 --> 51:49.000] And apparently she was deemed to be the one at fault in the crash. [51:49.000 --> 51:56.000] And today in the mail we got a form letter from the Texas Department of Public Safety [51:56.000 --> 52:05.000] signed by the troopers stating that the results of the investigation in the crash were that she was at fault. [52:05.000 --> 52:13.000] And accompanying that was a printout ticket and another piece of paper front and back [52:13.000 --> 52:20.000] that had a list of the justice of the peace and where to appear and that sort of thing. [52:20.000 --> 52:22.000] Well, here's the problem. [52:22.000 --> 52:31.000] The Texas Transportation Code does not authorize an officer to write a citation after the fact. [52:31.000 --> 52:38.000] They are only authorized to write citations pursuant 543.001 of the Transportation Code. [52:38.000 --> 52:50.000] And that code very specifically states any peace officer may arrest a person without warrant who is found committing. [52:50.000 --> 52:55.000] In other words, it must be in progress. [52:55.000 --> 52:56.000] All right. [52:56.000 --> 53:04.000] So in order for him to write a citation, he has to have you arrested. [53:04.000 --> 53:07.000] He can't arrest you after the fact. [53:07.000 --> 53:09.000] Which he did not. [53:09.000 --> 53:12.000] This came in the mail and it wasn't even delivered certified. [53:12.000 --> 53:13.000] Right. [53:13.000 --> 53:21.000] But there's no authority in the code for them to mail you citations after the fact. [53:21.000 --> 53:29.000] Every single instance in the code requires that they find you committing the act for which the citation was issued. [53:29.000 --> 53:35.000] It has to be in their presence or view. [53:35.000 --> 53:38.000] And to which I am aware of that. [53:38.000 --> 53:48.000] However, like I said, the fact remains that I'm looking right at the document that was mailed to me through the regular mail with the trooper's stamp on it. [53:48.000 --> 53:53.000] State of Texas and handwritten my wife's name and address. [53:53.000 --> 53:56.000] Okay. [53:56.000 --> 53:58.000] Well, here's the problem. [53:58.000 --> 54:02.000] During the crash, my wife was the injured party. [54:02.000 --> 54:08.000] The other driver was not injured other than property damage, but my wife had a head injury. [54:08.000 --> 54:15.000] She was being tended to by the fire department, put in an ambulance and sent to the emergency room. [54:15.000 --> 54:22.000] And she remembers telling the trooper asking her her name and she gave it to him. [54:22.000 --> 54:25.000] And he asked where her ID was. [54:25.000 --> 54:30.000] And she said where it was and he got it from her purse. [54:30.000 --> 54:40.000] And I'm assuming that he got the insurance information probably out of the truck. [54:40.000 --> 54:45.000] But she was under duress, of course, because she has a bleeding head injury. [54:45.000 --> 54:46.000] Okay. [54:46.000 --> 54:50.000] Well, what is your point about any of that? [54:50.000 --> 55:03.000] Well, my point to that was she was under duress and would not have been able to assert any right under the circumstances or even, you know, protect. [55:03.000 --> 55:07.000] Did he charge her with anything relating to that? [55:07.000 --> 55:09.000] She was not charged at all. [55:09.000 --> 55:11.000] Like I said, this is the first we've heard. [55:11.000 --> 55:14.000] No, you said you have a citation. [55:14.000 --> 55:19.000] What does the citation say? [55:19.000 --> 55:42.000] Like this computer printout citation states, violations, one failed to yield at a stop intersection, TXTRC 45151A, 545153J crash, whatever that is. [55:42.000 --> 55:48.000] That's the violation on this alleged instrument. [55:48.000 --> 55:49.000] Okay. [55:49.000 --> 56:00.000] So what is – I'm still trying to figure out what's your point you're trying to make about her telling them where her ID was. [56:00.000 --> 56:10.000] Well, like I said, they asked her for her name and, you know, I understand, you know, when you're during a traffic stop and they ask you to identify yourself, you know, [56:10.000 --> 56:16.000] if you're charged with something else, then you have to give, you know, those three pieces of information without a card. [56:16.000 --> 56:17.000] No. [56:17.000 --> 56:18.000] Point being – [56:18.000 --> 56:22.000] No, you're talking about the failure to ID charge. [56:22.000 --> 56:31.000] The failure to ID charge says they can't charge you with failure to ID unless you're already under arrest for some other offense and you refuse to do so, [56:31.000 --> 56:40.000] or you provide false information while doing so, or you have been lawfully detained and you provide false information. [56:40.000 --> 56:44.000] You weren't – she wasn't charged with failure to ID, was she? [56:44.000 --> 56:47.000] She was not charged at the scene for anything. [56:47.000 --> 56:50.000] But it's not in the citation either, is it? [56:50.000 --> 56:51.000] No, it's not. [56:51.000 --> 56:52.000] Okay. [56:52.000 --> 56:58.000] And you haven't been sent a complaint saying she's being charged with it, right? [56:58.000 --> 57:09.000] Like I said, other than this information that I'm scanning, I'm going to email to you so you can look at this piece of creative fiction yourself. [57:09.000 --> 57:15.000] Okay. I'm still just trying to get to the gist of what your question is in relation to this. [57:15.000 --> 57:29.000] My question is, I remember your whole dissertation probably last year or whatever on what constitutes a, you know, a lawful summons. [57:29.000 --> 57:30.000] Right. [57:30.000 --> 57:36.000] And this thing and stuff doesn't even muster a smell of a lawful summons. [57:36.000 --> 57:40.000] Well, nothing they do does. Nothing they do does. [57:40.000 --> 57:46.000] But what is your question in relation to it? [57:46.000 --> 57:50.000] My question in relation to this is quite simple. [57:50.000 --> 58:04.000] She is ordered on this alleged piece of garbage to appear in front of a Justice of the Peace by October 30th to enter a plea and or to pay a fine. [58:04.000 --> 58:06.000] How do we respond to this? [58:06.000 --> 58:12.000] And we have to go to the other county in order to even address this issue. [01:01:12.000 --> 01:01:20.000] Transportation Secretary Anthony Foxx told reporters, quote, The signal we're setting today is that when you're in the national airspace, it is a very serious matter. [01:01:20.000 --> 01:01:31.000] According to the Federal Aviation Administration, pilots of passenger planes and other aircraft have been reporting more than 100 sightings or close calls with civilian drones a month, a significant increase from just last year. [01:01:31.000 --> 01:01:42.000] Under current FAA guidelines, drone owners are not supposed to fly their aircraft above 400 feet or within five miles of an airport without permission, but regulators have been unable to prosecute rule breakers. [01:01:42.000 --> 01:01:49.000] The FAA and the Transportation Department are setting up a team composed of government officials and industry representatives to write up new regulatory codes. [01:01:49.000 --> 01:01:56.000] Foxx also stated that the group has until November 20 to finalize its recommendations that the government can set up the registry before Christmas. [01:01:56.000 --> 01:02:02.000] Transportation rules will also apply to people who have already bought drones in recent years, not just new owners. [01:02:02.000 --> 01:02:11.000] The FAA stated that it will impose penalties on anyone who does not comply. [01:02:11.000 --> 01:02:19.000] The Eighth Circuit Court of Appeals will hear oral arguments Tuesday on a dispute between former Minnesota Governor Jesse Ventura and the state of American slam for author Chris Kyle. [01:02:19.000 --> 01:02:24.000] Ventura won a one point eight million dollar settlement last year for a passage in Kyle's book, which he said was false. [01:02:24.000 --> 01:02:28.000] Apparently, Kyle described punching out a man, which was later identified as Ventura. [01:02:28.000 --> 01:02:43.000] The issue that many First Amendment scholars are bringing up is that the judge improperly instructed jurors on the actual malice definition, which holds public figures at a higher standard, improving defamation. The crash, like I said, occurred on the 2nd, and those citations were issued, no arrests made. [01:03:52.000 --> 01:03:57.000] Wife was released from the hospital after having her injuries treated. [01:03:57.000 --> 01:04:13.000] But as I indicated earlier, she had no way to – the three steps that you always say and stuff to – if you're not doing the right thing, you're doing the wrong thing, which is invoke your rights, demand your rights, and protect your rights. [01:04:13.000 --> 01:04:14.000] Yeah. [01:04:14.000 --> 01:04:25.000] Because my wife was being treated for a severe head trauma and neck injury and had no opportunity to even do that with the trooper because of the duress she was under. [01:04:25.000 --> 01:04:32.000] Well, but the thing about it is he didn't ask her for anything other than where her ID was. [01:04:32.000 --> 01:04:33.000] Right. [01:04:33.000 --> 01:04:45.000] Okay. So I still don't see where your issue with that is and how you're trying to use it because it sounds to me like you're trying to say that they took advantage of her to get evidence against her. [01:04:45.000 --> 01:04:50.000] They're not using her ID as evidence against her of anything. They used it to identify her. [01:04:50.000 --> 01:04:53.000] Right. [01:04:53.000 --> 01:04:56.000] Okay. [01:04:56.000 --> 01:05:08.000] There was an accident involved, okay, because there is injury and property damage, they are perfectly within their power to identify the people involved. [01:05:12.000 --> 01:05:14.000] But as to the citation determining a fault – [01:05:14.000 --> 01:05:26.000] The citation was not done because of her identifying information. The citation was done based upon whatever investigation they allegedly conducted. [01:05:26.000 --> 01:05:36.000] The problem is that the citation is after the fact, and there's no basis in law for them to send a citation after the fact. [01:05:36.000 --> 01:05:47.000] There's no authority that I know of in the transportation code that says they can send out a citation to someone for something after the fact. [01:05:47.000 --> 01:05:50.000] That's the issue right there. [01:05:50.000 --> 01:05:51.000] Correct. [01:05:51.000 --> 01:06:03.000] Okay. The other issue is the fact that you're being summoned without a proper summons, which does not comply with Chapter 23 of the Code of Criminal Procedure, most likely. [01:06:03.000 --> 01:06:23.000] While I see it, I can't confirm that, but if it doesn't comply with what Chapter 23 says it has to have, then it's not a valid summons, which means one of the first things you're going to file is a motion to quash the summons and stating that it is not a valid summons under any statute or law in Texas. [01:06:23.000 --> 01:06:24.000] Okay. [01:06:24.000 --> 01:06:40.000] Because Chapter 23 makes it very clear that the language of a summons has to tell you that you either have to report or you have to provide sound reason why you should not be required to do so. [01:06:40.000 --> 01:06:43.000] That's what a summons is. [01:06:43.000 --> 01:06:44.000] Correct. [01:06:44.000 --> 01:06:54.000] All right. Well, so that's what we're going to have to do is file something asking that question. Where do you get off telling me this is a summons and using it as the basis in law for doing it? [01:06:54.000 --> 01:07:04.000] However, the caveat to that is this. You don't know they're going to issue a warrant and say you failed to comply with the summons. [01:07:04.000 --> 01:07:12.000] Even though you can argue the summons is not a summons under law, they're going to argue that, well, it was signed and sealed by a court, so it's okay. [01:07:12.000 --> 01:07:13.000] Why? [01:07:13.000 --> 01:07:21.000] Because the courts in Texas don't play by any rules whatsoever, unless it suits them to do so. [01:07:21.000 --> 01:07:24.000] Absolutely. It's all about the bottom line, M-O-N-E-Y. [01:07:24.000 --> 01:07:27.000] Exactly. [01:07:27.000 --> 01:07:41.000] But the thing about it is it won't be this court that's making that determination. The ones above it are going to turn around and side with them, even though the law and the statute says otherwise, they're going to rewrite it to suit how they wish to conduct business. [01:07:41.000 --> 01:07:48.000] Not how the legislature said they must conduct business. [01:07:48.000 --> 01:08:01.000] Okay, so fair enough. I can tell you right now that my wife is definitely ill-equipped and stuff to go into a court and argue pretty much anything. She's still fairly shaken up from the accident. [01:08:01.000 --> 01:08:13.000] Well, the thing about it is the citation, they could care less whether or not they actually get to charge you on the citation in this case, because let me tell you why the citation exists. [01:08:13.000 --> 01:08:26.000] It's got nothing to do actually with charging your wife. It has to do with giving evidence to the other side to sue you or your insurance company as the person at fault in the accident. [01:08:26.000 --> 01:08:32.000] That is one of the pieces of evidence they're going to use to do that if they pursue it in that way. [01:08:32.000 --> 01:08:48.000] Now, if the insurance companies agree and settle, it ain't no big deal. But if they don't, that citation from that investigation is something the other side's counsel will use against yours in order to get money, bank on it. [01:08:48.000 --> 01:08:53.000] Right. [01:08:53.000 --> 01:08:56.000] So how should we proceed from here? [01:08:56.000 --> 01:09:07.000] Well, I just told you, you have to file a motion to quash the summons and a motion to dismiss the charge. [01:09:07.000 --> 01:09:23.000] Okay. Like I said, let me go ahead. I already scanned it and I will send you a copy of that so that you can look at it. I personally have not even seen the accident report, so I don't even know what's contained in it. I was not in the accident. I was not present. [01:09:23.000 --> 01:09:30.000] It was my wife traveling to pick up a co-worker on her way to work when the accident occurred. [01:09:30.000 --> 01:09:38.000] Okay. Well, you can send it and I'll take a look at it. [01:09:46.000 --> 01:10:12.000] So would you suggest and stuff just for the – I know it kind of flies in the face of what you're trying to teach everyone and stuff about trying to defend yourself against these kinds of bogus charges and stuff, but we're looking at it from the point if she takes the defensive driving to get it removed, it's still going to – would it still count against her record and count against her in a – [01:10:12.000 --> 01:10:20.000] I have no way of telling you that. That's entirely up to whatever the judge wishes to grant or not grant. [01:10:20.000 --> 01:10:21.000] Okay. [01:10:21.000 --> 01:10:33.000] But the issue here is whether or not there's a law to actually break. If you understand the argument about why the transportation code itself is unconstitutional in Texas, then there's no law to break. [01:10:33.000 --> 01:11:01.000] There's no charge to be made. There's no record to update. There's no record to hold over somebody's head because it's facilitated through the use of a code that is unconstitutional, unlawful, and illegal in Texas because it was passed completely outside of all constitutional authority, prohibitions, and mandates on how laws in Texas are to be made. [01:11:01.000 --> 01:11:13.000] And I remember you making that point well on several occasions, and I do totally understand that. I just – my question was this thing doesn't even fit the – [01:11:13.000 --> 01:11:30.000] And they never do. They never, ever do. The courts in Texas don't know a darn thing about the law, only how they wanted the law to be. They're going to do what they want, how they want. They run my details. However, they do it these days, the technology that they possess where you just laser a plate. And then they decide to back off and pull away and go 10-8. [01:13:24.000 --> 01:13:36.000] So, I can't figure out what they're doing. Anyway, I wrote you in an email and I was just only asking your opinion, what you may think, why they're doing that. [01:13:36.000 --> 01:13:46.000] Well, because that's the practice they have when it comes to anyone. Any car they see, they automatically start accessing the information on. [01:13:46.000 --> 01:14:02.000] And especially if it's one that they've had a briefing over because of a prior encounter or several, they'll do it every time. But most of the time, they're running and accessing that information even when no crime has been committed. [01:14:02.000 --> 01:14:15.000] Now, here's the problem. In most states, it is illegal for a police officer to access the information in those systems without a proper reason for doing so. [01:14:15.000 --> 01:14:30.000] And the only way they get a proper reason is the investigation of an actual crime. Well, unless they see one, why are they typing in information and scanning it? [01:14:30.000 --> 01:14:40.000] This stuff about the Supreme Court ruling that license plate scanners are just fine for scanning your plates because your plates are in the public. [01:14:40.000 --> 01:14:54.000] Well, that may be true, but the information that's attached to that plate that they're accessing through that scan is not public, or at least it's not supposed to be. [01:14:54.000 --> 01:15:06.000] And their own policies and procedures make it illegal for them to access that information without a viable reason for doing so. [01:15:06.000 --> 01:15:21.000] Well, they got me with a suspended license and driving without insurance, allegedly driving without insurance. So they know what my record is, but they choose not to restock again, apparently. [01:15:21.000 --> 01:15:32.000] Well, again, you're making the presumption that they ran the information in the first place. They don't always do it. [01:15:32.000 --> 01:15:42.000] Okay. Do you get out and go back and watch them do that? Or are you just assuming that because they pulled up behind you that they did it? [01:24:48.000 --> 01:24:59.000] See, this is something most people aren't even bothering to look at, what constitutes a first sale that makes something a motor vehicle. [01:24:59.000 --> 01:25:09.000] When you go read the definitions for first sale, you find out real quick it ain't your car. [01:25:09.000 --> 01:25:18.000] But what you did when you bought it was let that assumption rest with the dealer that that's what you were buying it for. [01:25:18.000 --> 01:25:27.000] And then you gave them power of attorney to file all the necessary paperwork to have it registered for that purpose. [01:25:27.000 --> 01:25:31.000] You're not getting another MSO or MCO. [01:25:31.000 --> 01:25:34.000] They will only issue the one that came with the car. [01:25:34.000 --> 01:25:42.000] And that was sent to the state the first time the car was bought by anyone, even though that's not the way it's supposed to work. [01:25:42.000 --> 01:25:58.000] The state then microfished the original, shredded the original, and burned the original so that it can never be brought back up to challenge the state's claim as to an interest in the car. [01:25:58.000 --> 01:26:04.000] Not ownership, but an interest in the car. [01:26:04.000 --> 01:26:16.000] That interest being the public health and welfare because it's being used for commercial purposes on public highways. [01:26:16.000 --> 01:26:26.000] And because it's registered as being used for that purpose, they presume an interest in regulating it. [01:26:26.000 --> 01:26:29.000] So there's no way of reversing that or emancipating from that at this point. [01:26:29.000 --> 01:26:31.000] Sure there is. [01:26:31.000 --> 01:26:34.000] But it's not the way you're wanting to do it. [01:26:34.000 --> 01:26:46.000] The problem is, is there is no specific procedure within their system for doing it. [01:26:46.000 --> 01:26:59.000] The only way that it can be done without a system to follow is to recognize what it is and to get them to admit that it's not being used for that. [01:26:59.000 --> 01:27:04.000] And that's where the secretary of state comes in. [01:27:04.000 --> 01:27:08.000] You send the title to the secretary of state and have them do a title search. [01:27:08.000 --> 01:27:15.000] Does the state have any financial or vested interest in this property? [01:27:15.000 --> 01:27:29.000] And if not, then I intend to remove it from the jurisdiction of this state, not Texas, not Indiana, Oklahoma, Virginia, or Oregon, this state. [01:27:29.000 --> 01:27:40.000] They will send you back a certified letter stating that there are no records that would show there's an outstanding interest or lien by the state on the property. [01:27:40.000 --> 01:27:55.000] And in Texas, the deal here is supposedly that they have a replacement title that when you're moving it out of the jurisdiction of this state, then they send you back a different form of title. [01:27:55.000 --> 01:28:00.000] But I have never actually seen one of those because they never actually sent it back. [01:28:00.000 --> 01:28:06.000] There's something in the statutes that says that's what they're supposed to do, but they don't actually do it. [01:28:06.000 --> 01:28:20.000] So just like every other office in government, nobody does what their job requirements say they're required to do, probably because none of them actually read them. City of Independence and many, many others. [01:40:52.000 --> 01:40:57.000] Unlike the statutes, I do not memorize sites for case law. [01:40:57.000 --> 01:41:02.000] I memorize what it discussed, but not the case name and site. [01:41:02.000 --> 01:41:06.000] I've got too many other facts running around in my head. [01:41:23.000 --> 01:41:40.000] They're advantageous because they prove that the charges made against you at the stop for not cooperating with the officer can't be done because what they are are charges that criminalize the exercise of a right. [01:41:40.000 --> 01:41:48.000] For instance, you have the right not to be not to provide evidence or information that can be used against you in a court of law. [01:41:48.000 --> 01:42:00.000] So any statute that says you commit a crime by not providing them with information that can be used against you in a court of law is now a crime is not a valid statute. [01:42:00.000 --> 01:42:05.000] Now you get now we're talking by putting the pieces together. [01:42:05.000 --> 01:42:10.000] Okay. I just thought maybe that might be interesting to some of the listeners as well as myself. [01:42:10.000 --> 01:42:18.000] Well, you've got you've got several cases at the federal level that says the exercise of a right cannot be converted into a crime. [01:42:18.000 --> 01:42:27.000] You've got several cases that say that a right cannot be licensed by the state and a fee charged for it. [01:42:27.000 --> 01:42:38.000] And if the state attempts to do so, the person may continue to exercise the right with impunity, regardless of what the state says. [01:42:38.000 --> 01:42:46.000] That case law is all in the seminar book and everything that's on that script comes from that case law. [01:42:46.000 --> 01:42:51.000] Not that's not that one case only, but the case law that's in there. [01:42:51.000 --> 01:42:55.000] Everything is mentioned in that case law at some point or other. [01:42:55.000 --> 01:43:04.000] So that particular one you just cited would probably be used in most of these cases where somebody's getting a citation. [01:43:04.000 --> 01:43:11.000] No, no, no, the one dealing with the exercise of a right cannot be licensed. [01:43:11.000 --> 01:43:19.000] OK, it goes back to what I've tried to get people to understand about the right to travel not being the correct argument. [01:43:19.000 --> 01:43:25.000] And why a truck driver has a right to travel, [01:43:25.000 --> 01:43:34.000] except when he's actually acting under the license that he applied for to exert a privilege, right? [01:48:37.000 --> 01:48:49.000] The only way that they can do anything with that red light camera ticket is to file a civil lawsuit against you for the $75 fine and win. [01:48:49.000 --> 01:48:57.000] The fact that they are sending you a notice saying that you already owe the money is illegal. [01:48:57.000 --> 01:48:59.000] Yes, but we kind of figured. [01:48:59.000 --> 01:49:05.000] And so as soon as you go to my blog and you look at all the information there, [01:49:05.000 --> 01:49:09.000] you're going to also see all the documents that were filed with the lawsuit. [01:49:09.000 --> 01:49:17.000] Those documents contain the contact information for the attorney that's representing the gentleman in Louisiana that filed the lawsuit. [01:49:17.000 --> 01:49:27.000] You may want to get in contact with him and add your name to the list because they are suing every municipality in Texas that has a program. [01:49:27.000 --> 01:49:37.000] That would be wonderful because we've gotten a letter that's saying that our response was received too late [01:49:37.000 --> 01:49:44.000] and it's still – a violation is still pending in our name, but we can blame somebody else. [01:49:44.000 --> 01:49:52.000] And then we got a letter saying that a hearing has been scheduled, [01:49:52.000 --> 01:50:02.000] but I'm pretty sure they're trying to schedule an administrative hearing and not the trial. [01:50:02.000 --> 01:50:04.000] Well, there isn't a trial. [01:50:04.000 --> 01:50:05.000] That's just the whole thing. [01:50:05.000 --> 01:50:06.000] It's not a criminal offense. [01:50:06.000 --> 01:50:07.000] It's a civil. [01:50:07.000 --> 01:50:10.000] That's why they have to file a lawsuit. [01:50:10.000 --> 01:50:18.000] But it costs $400 to file a lawsuit, and they can only get $75 for the citation if they win. [01:50:18.000 --> 01:50:20.000] It's cost prohibitive. [01:50:20.000 --> 01:50:32.000] So what they're doing is committing fraud for the cost of a postage stamp in order to get $74 in change for free when people just pay the ticket. [01:50:32.000 --> 01:50:42.000] It's all fraud, hence the reason for the lawsuit, because the law does – and the statutes do not allow the municipalities to issue citations, [01:50:42.000 --> 01:50:47.000] nor do they allow the red-light camera companies to do it.
