[01:53.440 --> 01:58.000] The Texas Civil Rights Project and the Texas Rio Grande Legal Aid are representing 17 Mexican [01:58.000 --> 02:02.200] and Central American families in a lawsuit against the Lone Star State because the Texas [02:02.200 --> 02:07.000] County's registrar's office has been refusing to accept parents who present foreign national [02:07.000 --> 02:09.240] passports as a valid form of identification. [02:09.240 --> 02:12.600] Subsequently, they are being denied birth certificates to their children. [02:12.600 --> 02:16.440] The families are claiming that the registrars are violating the 14th Amendment's Equal Protection [02:16.440 --> 02:19.280] Clause as well as violating the Supremacy Clause. [02:19.280 --> 02:23.120] The Texas Attorney General's office has apparently asked the court to dismiss the lawsuit saying [02:23.120 --> 02:26.840] the agency is protected from litigation by the 11th Amendment and that the state cannot [02:26.840 --> 02:30.200] be taken to federal court under its sovereign immunity provisions. [02:30.200 --> 02:38.800] Legal experts, however, are saying that the case is likely to go forward to court. [07:51.760 --> 07:54.760] You don't want anybody shooting any of yours [07:54.760 --> 07:59.760] But none of you have any qualms about shooting anyone else [07:59.760 --> 08:02.760] So you can go home to your fried chicken and mashed potatoes [08:02.760 --> 08:05.760] And feel like you did something good [08:05.760 --> 08:10.760] You take no responsibility and suffer no liability [08:10.760 --> 08:14.760] When you kill an innocent [08:14.760 --> 08:17.760] It is not until very recently that any of you have started [08:17.760 --> 08:25.760] Facing any music whatsoever for what you've done [08:25.760 --> 08:30.760] There has been a statute on the books in Texas since 1963 [08:30.760 --> 08:35.760] That deals with aggravated assault by a public servant [08:35.760 --> 08:38.760] And it's a first degree felony [08:38.760 --> 08:45.760] And since 1963 up until 2012 or 2013 [08:45.760 --> 08:50.760] Not a single law enforcement officer in Texas [08:50.760 --> 08:55.760] Had ever been prosecuted under that charge [08:55.760 --> 08:56.760] Not one [08:56.760 --> 08:58.760] We know it happened [08:58.760 --> 09:01.760] We know it happens a lot [09:01.760 --> 09:07.760] Hell, Texas is in the news almost more than any state other than Arizona [09:07.760 --> 09:09.760] And New York [09:09.760 --> 09:11.760] And possibly Boston [09:11.760 --> 09:15.760] For its police abuse [09:15.760 --> 09:18.760] And yet, how many years is that? [09:18.760 --> 09:21.760] 63 to 2012 [09:21.760 --> 09:25.760] That's almost 50 years, folks [09:25.760 --> 09:28.760] For 50 years [09:28.760 --> 09:35.760] Not a single law enforcement officer was ever charged with aggravated assault [09:35.760 --> 09:40.760] When the only criteria for them to commit the offense is [09:40.760 --> 09:45.760] They do an act that constitutes simple assault [09:45.760 --> 09:50.760] Which means that it in some way or fashion causes a palpable harm [09:50.760 --> 09:52.760] A bodily injury [09:52.760 --> 09:53.760] It can be a scrape [09:53.760 --> 09:54.760] It can be a bruise [09:54.760 --> 10:01.760] It can be any marking that shows you suffered an injury at the hands of the officer [10:01.760 --> 10:07.760] Even to the point of nerve damage when they put you to the incus too tight [10:07.760 --> 10:10.760] And if when he committed that simple assault [10:10.760 --> 10:15.760] That public servant was displaying a deadly weapon [10:15.760 --> 10:22.760] He is guilty of aggravated assault [10:22.760 --> 10:25.760] Now this would be easy to do if they shoot you with a taser [10:25.760 --> 10:29.760] Because you've got holes in you from that taser where the barbs go in [10:29.760 --> 10:35.760] Not to mention the electrical shock from their high dollar cattle prod there that they're using [10:35.760 --> 10:39.760] And they use them on you just like a cattle prod [10:39.760 --> 10:41.760] To ensure compliance [10:41.760 --> 10:45.760] It's what we used to do as kids when we had to load cows up for market [10:45.760 --> 10:50.760] We had to zap some of them in the butt with a hot shot to get them up in the trailer [10:50.760 --> 10:58.760] And the cops are using tasers exactly the same way like cattle prods [10:58.760 --> 11:01.760] And yet it's always justifiable [11:01.760 --> 11:06.760] Even if the person is laying face down with four cops standing on top of them [11:06.760 --> 11:09.760] And they couldn't comply if they wanted to [11:09.760 --> 11:11.760] Oh, he's not doing what we told him [11:11.760 --> 11:17.760] Everybody jump back and let me zap him again [11:17.760 --> 11:22.760] You get the picture yet, lady? [11:22.760 --> 11:27.760] A few bad apples, the actual real criminals that exist in society [11:27.760 --> 11:34.760] Does not give any of you the right to declare war on any of us in the public [11:34.760 --> 11:40.760] Or our property or our dogs [11:40.760 --> 11:44.760] Let that one sink in a few [11:44.760 --> 11:50.760] Now, on top of that, we've also had another shooting [11:50.760 --> 11:53.760] And this was in San Antonio [11:53.760 --> 11:57.760] A man by the name of Gilbert Flores is dead [11:57.760 --> 12:02.760] Cops showed up in response to a domestic assault [12:02.760 --> 12:06.760] When they arrived, there was a man outside pacing back and forth with a knife [12:06.760 --> 12:09.760] The officers were nowhere near him through the entire incident [12:09.760 --> 12:14.760] They were anywhere from 20 to 30 feet away, if not more in some cases [12:14.760 --> 12:18.760] And they were at least that far when they shot the man [12:18.760 --> 12:23.760] He didn't have any hostages, he was out in the open [12:23.760 --> 12:30.760] He had no cover to hide behind and wasn't attempting to [12:30.760 --> 12:35.760] And yet, though you can't tell it from the distance in the video [12:35.760 --> 12:39.760] He is told to raise his hands, and he does [12:39.760 --> 12:45.760] Now, as far away as he is from these officers, they've already got their guns pointed at him [12:45.760 --> 12:52.760] The man never moves from the spot he never looks like he's trying to move from the spot he's in [12:52.760 --> 12:57.760] He simply raises his hands, and within a count of two [12:57.760 --> 13:03.760] One, two, he is shot, he is dead [13:03.760 --> 13:09.760] Why? Why? What was the need for that? [13:09.760 --> 13:15.760] He wasn't running, both either away or toward anybody [13:15.760 --> 13:19.760] You can't tell in the video if he was holding a weapon, and even if he was [13:19.760 --> 13:25.760] At that distance with their guns already trained on him, two different officers [13:25.760 --> 13:31.760] There is no way he would have gotten to either of them if he had charged [13:31.760 --> 13:37.760] There was no reason to kill him [13:37.760 --> 13:41.760] But they did [13:41.760 --> 13:47.760] They declared war on him because he appeared to be threatening enough [13:47.760 --> 13:51.760] That they thought they might be in danger [13:51.760 --> 13:56.760] But you let one of us feel like we're in danger from one of them [13:56.760 --> 14:03.760] And we resist them with the same deadly force, and you and I are as good as dead [14:03.760 --> 14:09.760] Or as good as life in prison [14:09.760 --> 14:13.760] They've tried that every time they've done a no-knock raid [14:13.760 --> 14:17.760] They have prosecuted the person that shot the cop [14:17.760 --> 14:25.760] And so far out of however many, three people have managed to avoid getting convicted [14:25.760 --> 14:33.760] But God knows how many of them they've actually charged with this BS [14:33.760 --> 14:41.760] So you see, folks, you and I shouldn't be considered bad apples just because there are some [14:41.760 --> 14:46.760] Any more than law enforcement wants to be considered bad apples because there are some [14:46.760 --> 14:54.760] The difference here is, is that you and I don't stand by and condone the behavior of the criminals [14:54.760 --> 14:58.760] By assisting them in their acts [14:58.760 --> 15:03.760] All the so-called good cops do [15:03.760 --> 15:11.760] Nor do they attempt to prevent the acts that they know are wrong even when they have the opportunity [15:11.760 --> 15:17.760] And the very few that you can count on one hand that have done so [15:17.760 --> 15:24.760] Were immediately kicked out of the clubhouse, never to return [15:24.760 --> 15:34.760] If the system isn't corrupt, then why is it so hell-bent on getting rid of those that expose the corruption? [15:34.760 --> 15:44.760] We're not talking about a few bad apples here, we're talking about a rotten barrel [15:44.760 --> 15:48.760] And that is the problem [15:48.760 --> 15:55.760] They have come to believe that they are more important, more special, more entitled [15:55.760 --> 15:59.760] Than the public they're supposed to serve [15:59.760 --> 16:04.760] Being a peace officer was a dangerous job to take on [16:04.760 --> 16:11.760] But when you take it, the idea is that you're willing to sacrifice yourself to protect the innocent [16:11.760 --> 16:19.760] Not kill the innocent so you have an excuse to go home yourself [16:19.760 --> 16:24.760] Nor to even kill the guilty without a fair trial when there's no need to kill them [16:24.760 --> 16:28.760] It's one thing to kill them in self-defense [16:28.760 --> 16:32.760] It's another to kill them from 20 feet away when they've surrendered [16:32.760 --> 16:36.760] Or they're face down [16:36.760 --> 16:38.760] Or they're already handcuffed in the back of a cop car [16:38.760 --> 16:44.760] And you have to shoot them in the head and then convince people it was a suicide [16:44.760 --> 16:48.760] We're not talking about a few rope in a tall tree won't fix real fast [19:57.760 --> 20:02.760] Okay, the only thing good about an attorney is his obituary [20:02.760 --> 20:04.760] That's the way I feel about it [20:04.760 --> 20:12.760] Now, that being said, some of them actually have a sense of humor in a way that at least I do [20:12.760 --> 20:14.760] And let me read you something here [20:14.760 --> 20:17.760] This is a news article out of Nashville, Tennessee [20:17.760 --> 20:22.760] The name of the county is going to sound familiar because Texas also has a Williamson County [20:22.760 --> 20:27.760] Where I would expect that this would have been something that would have actually happened there as well [20:27.760 --> 20:33.760] If any Texas attorneys actually had a good fast-thinking mind and a sense of humor to go with it [20:33.760 --> 20:35.760] Pay attention [20:35.760 --> 20:42.760] When prosecutors in Williamson County tried to ban a defense attorney from referring to them as the government in court [20:42.760 --> 20:45.760] Defense attorney Drew Justice had a demand of his own [20:45.760 --> 20:48.760] From now on, call me Captain Justice [20:48.760 --> 20:56.760] A war of words broke out in an attempted aggravated burglary case in Williamson County Circuit Court between prosecutors and justice [20:56.760 --> 20:59.760] Who is defending one of two people in the case [20:59.760 --> 21:04.760] In May, fed up with justice referring to prosecutors as the government [21:04.760 --> 21:10.760] Assistant District Attorney Tammy Reddick filed a motion to ban Justice from using the term in trial [21:10.760 --> 21:17.760] The state has noticed in the past few years that it has become commonplace during trials for attorneys, for defendants [21:17.760 --> 21:23.760] And especially Mr. Justice to refer to state's attorneys as the government, she wrote in her motion [21:23.760 --> 21:31.760] The state believes that such a reference is used in a derogatory way and is meant to make the state's attorneys seem oppressive and to inflame the jury [21:31.760 --> 21:34.760] Justice fired off his own motion in response [21:34.760 --> 21:40.760] It included conventional references to case law, the First Amendment, technical stuff that one would expect in a court filing [21:40.760 --> 21:43.760] And then he went and got creative [21:43.760 --> 21:49.760] If the court sided with Reddick, he demanded his client no longer be referred to as the defendant [21:49.760 --> 21:55.760] But instead be called Mr. The Citizen Accused or That Innocent Man [21:55.760 --> 22:00.760] Since all defendants are presumed innocent until a judge or jury finds them guilty [22:00.760 --> 22:07.760] As for himself, clearly lawyer or defense attorney wouldn't do him well justice [22:07.760 --> 22:13.760] Rather, counsel for the citizen accused should be referred to primarily as the defender of the innocent [22:13.760 --> 22:19.760] Alternatively, counsel would also accept the designation guardian of the realm [22:19.760 --> 22:28.760] And since prosecutors are often referred to formally as general in court, justice, in an effort to be flexible, offered up a military title of his own [22:28.760 --> 22:33.760] Whenever addressed by name, the name Captain Justice will be appropriate [22:33.760 --> 22:40.760] Gathering steam, he went on to say that even the defense wasn't adequate and that the resistance would be far more appropriate [22:40.760 --> 22:45.760] He then concluded his motion, returning to the formal language of court documents, sort of [22:45.760 --> 22:54.760] Wherefore, Captain Justice, guardian of the realm and leader of the resistance, primarily asked that the court deny the state's motion as lacking legal basis [22:54.760 --> 23:00.760] Reddick couldn't be reached to comment on her motion or justice's response because she was in court Thursday [23:00.760 --> 23:07.760] Her boss, Williamson County District Attorney Kim Helper, said her prosecutor was just trying to make sure the focus stayed on the facts of the case [23:07.760 --> 23:13.760] We're a little disappointed at the response that talked about Captain Justice, defender of the realm, Helper said [23:13.760 --> 23:17.760] From my perspective, it seemed a little bit, I don't know what the right word would be [23:17.760 --> 23:20.760] The response did not appear to be in good faith [23:20.760 --> 23:26.760] Justice didn't want to talk about the specifics of the case, but said the judge recently tossed out Reddick's motion in court [23:26.760 --> 23:29.760] He said the word government wasn't derogatory [23:29.760 --> 23:33.760] All in a day's work for Captain Justice [23:33.760 --> 23:36.760] At least this attorney had a sense of humor and knew how to use it [23:36.760 --> 23:45.760] Prosecutors are notorious for trying to throw wrenches in anybody's ability to refer to them as the oppressive individuals they are [23:45.760 --> 23:48.760] While I realize prosecutors have a job to do [23:48.760 --> 23:59.760] The Supreme Court rulings, the state court rulings, the bar associations, and the undermining of American justice as a whole, however [23:59.760 --> 24:09.760] Has given them way too much latitude and power in how to get a conviction regardless of the facts [24:09.760 --> 24:15.760] There used to be a saying in the world of justice, the truth will out [24:15.760 --> 24:19.760] There was another one, veritas, meaning truth [24:19.760 --> 24:28.760] Those things are as foreign to an American courtroom in any state of the union today as teeth are in a chicken [24:28.760 --> 24:39.760] I'm telling you, it's laughable that we would even refer to this with the name justice system [24:39.760 --> 24:46.760] All right, folks, that being said, we had one caller up on the board and they're gone now [24:46.760 --> 24:48.760] They're either being screened or they dropped [24:48.760 --> 24:58.760] Calling number 512-646-1984, we need some callers up on the board with some questions, queries, comments, or stories [24:58.760 --> 25:02.760] Anything will work as long as we got somebody and something good to talk about [25:02.760 --> 25:09.760] Now, before [25:13.760 --> 25:18.760] And I only talked about three, one, humorous, and two, deal with police shootings [25:18.760 --> 25:24.760] And then you look at the number of police shootings that have occurred in 2015, which is coming up on 1,000 [25:24.760 --> 25:28.760] And that's of the ones we actually have reported [25:28.760 --> 25:36.760] There was, what, 1,400 in 2014, there was 1,100 in 2013 [25:36.760 --> 25:43.760] No one knows how many there actually are each year because we don't know how many of them ever hit the mainstream [25:43.760 --> 25:49.760] We don't know how many of them are done outside of the view of the public to record them and put them up there [25:49.760 --> 25:55.760] So the question can be asked, why was that person shot? [35:03.760 --> 35:21.760] No, by the local police department, they pulled me over, because I failed to use my blinker within 100 feet, they didn't cite me for that, but they towed my car, and dragged me in on a warrant that TABC issued me for over serving a patron at the local bar [35:21.760 --> 35:28.760] And I was wondering, I never signed anything, they just issued me a warrant, I mean I got a lawyer fighting the case on Wednesday, I paid him 500 bucks [35:28.760 --> 35:40.760] So I was just, you know, you usually go over traffic, but I was just wondering, is there any way that I could have asserted my rights, so that I could better defeat this case, if it ever happens again [35:40.760 --> 35:51.760] Well again, if they didn't cite you with anything when they pulled you over, the problem is, how did they measure the distance of the 100 feet, etc, etc, etc [35:51.760 --> 36:01.760] No, I'm talking about TABC issued a warrant for me, that's the reason why they took me to jail, is that a warrant issued by TABC for over serving a gentleman, like two months ago [36:01.760 --> 36:07.760] How did TABC get, how did TABC determine whose name to put on the warrant [36:07.760 --> 36:11.760] I was there working at the bar that night [36:11.760 --> 36:13.760] Were you the only one working at the bar? [36:13.760 --> 36:16.760] When they basically raided the place [36:16.760 --> 36:32.760] Well how, okay, but here's my question, how could they have raided the place and went to this one guy, unless someone in there either worked with TABC or the black guy was TABC [36:32.760 --> 36:40.760] I suspected that, yeah, because they called his parents to come get him up, he was like this young college kid, so [36:40.760 --> 36:41.760] Okay [36:41.760 --> 36:44.760] They basically issued the bar like a [36:44.760 --> 36:50.760] Did they conduct a, did they do a sobriety test on the guy [36:50.760 --> 36:51.760] No [36:51.760 --> 36:53.760] Did they do a breathalyzer [36:53.760 --> 36:54.760] No [36:54.760 --> 36:56.760] Did they do blood [36:56.760 --> 36:57.760] No [36:57.760 --> 37:03.760] Then how did they make a determination he was over served, i.e. intoxicated [37:03.760 --> 37:06.760] I guess just by their own assumption, so [37:06.760 --> 37:10.760] Really, where did they get their medical degree [37:10.760 --> 37:14.760] Which one of them is qualified to diagnose intoxication [37:14.760 --> 37:17.760] Yes sir [37:17.760 --> 37:20.760] Those are good questions that I should have asked [37:20.760 --> 37:27.760] But I was, I was just nervous and just all the patrons left so basically you know I got, I lost about $300 in revenue [37:27.760 --> 37:32.760] Because it was around 11 o'clock, so you know basically just set the place for the night [37:32.760 --> 37:35.760] But I wasn't really sure on how to assert my rights [37:35.760 --> 37:39.760] You know they asked me my name and said like I could or couldn't be prosecuted [37:39.760 --> 37:47.760] All those things were coming up while they were interrogating me you know at the time of you know the raid or whatever [37:47.760 --> 37:48.760] Yeah [37:48.760 --> 37:52.760] Well whether or not you could have prevented them from doing what they're doing that's [37:52.760 --> 37:56.760] That's going to always be up in the air, they're going to do what they're going to do [37:56.760 --> 38:02.760] But you may have a suit for malicious prosecution after the fact [38:02.760 --> 38:05.760] If they move forward with it at all [38:05.760 --> 38:12.760] Yeah because I mean I had to pay to get my car out of the impound, I had to pay my bond, I had to pay for my lawyer fees [38:12.760 --> 38:16.760] You know so I'm just wondering and then hopefully my lawyer he said he tried this case before [38:16.760 --> 38:25.760] Hopefully he's able to get it dismissed or you know worst case scenario I guess I flee and I get probation so [38:25.760 --> 38:28.760] Well again unless [38:28.760 --> 38:34.760] Do not let him convince you to take a plea if you feel for sure that you can beat it because [38:34.760 --> 38:38.760] How are they going to prove he was intoxicated? [55:44.680 --> 55:48.200] The thing is, is that motor vehicle [55:48.200 --> 55:51.200] is four definitions removed [55:51.200 --> 55:54.600] from what he was actually riding on, [55:55.600 --> 56:00.600] which the law identifies as a moped or motor scooter [56:04.760 --> 56:08.120] if it meets the statutory criteria [56:08.120 --> 56:10.560] that is required for it to be known [56:10.560 --> 56:12.560] as a motor scooter or moped. [56:14.240 --> 56:17.320] Now, the specific criteria for this can be found [56:17.320 --> 56:22.320] in 541.201 subsection or sub-item eight, [56:26.000 --> 56:27.720] which is the definition of moped. [01:05:03.640 --> 01:05:07.640] Well, whether or not he would have an obligation, [01:05:07.640 --> 01:05:11.240] that would depend upon how he wants to look at the case. [01:05:11.240 --> 01:05:14.880] If the guns were seized in relation to the charges, [01:05:14.880 --> 01:05:18.320] then he should certainly not be against helping you do it. Title 32, 16, Driver, [01:48:50.720 --> 01:48:57.960] quote unquote, means every person who drives or is in actual physical control of a vehicle. The statute's going to be argued [01:49:53.320 --> 01:49:57.640] that it was – that was considered, but we rejected it. We apply it to everyone. The [01:49:57.640 --> 01:50:06.040] problem is, is that can't possibly be true, any more than it can be true that – let's [01:50:06.040 --> 01:50:10.560] walk this down the line and see how we can explain it to folks here. [01:50:10.560 --> 01:50:16.520] All right. We have today all these court cases on the people's right to keep and bear arms, [01:50:16.520 --> 01:50:18.120] true or false? [01:50:18.120 --> 01:50:19.520] True. [01:50:19.520 --> 01:50:25.880] And the courts have ruled that even though today we have AR 15s, 30-odd-6s, 30-30s and [01:50:25.880 --> 01:50:31.960] blah, blah, blah, and the original founding fathers had black powder muskets, the technological [01:50:31.960 --> 01:50:40.240] advances from black powder muskets to AR 15s and 30-odd-6s, bolt action, semi-auto, auto, [01:50:40.240 --> 01:50:46.880] none of that makes a difference in the people's right to own and possess guns for the purpose [01:50:46.880 --> 01:50:50.200] of self-protection under the Second Amendment. Is that correct? [01:50:50.200 --> 01:50:53.440] I'll buy that. [01:50:53.440 --> 01:51:02.760] Okay. Then by the same analysis, people started out on foot. People learned to domesticate [01:51:02.760 --> 01:51:08.320] animals and ride them. People learned to take those domesticated animals and hook them up [01:51:08.320 --> 01:51:13.880] to inanimate objects, empower the objects with the animals' own power. We call those [01:51:13.880 --> 01:51:22.000] ox carts, chariots, horse and carriages, horse and buggies, horse and wagons, etc., etc. [01:51:22.000 --> 01:51:30.720] We go from there to bicycles. We go from there to motor cars. We go from motor cars to automobiles. [01:51:30.720 --> 01:51:35.800] We go to motor carriages. We go from motor carriages to automobiles. The automobiles [01:51:35.800 --> 01:51:43.680] get bigger in a varied type until we have the modern car, automobile, slash motor vehicle. [01:51:43.680 --> 01:51:47.840] That's technological progression just like black powder to AR 15, right? [01:51:47.840 --> 01:51:49.640] I'm following you. [01:51:49.640 --> 01:51:57.080] Why then is the technological advancements on one side sufficient to deprive us of the [01:51:57.080 --> 01:52:05.480] right to locomotion but not the right to keep and bear arms? It's an idiotic argument. [01:52:05.480 --> 01:52:11.320] On one side, technology can't defeat the right. On the other side, that's exactly what technology [01:52:11.320 --> 01:52:20.000] has done, defeat the right. How do we reconcile those two? [01:52:20.000 --> 01:52:22.920] That's the question. [01:52:22.920 --> 01:52:28.880] The simple answer is you can't. You can't say technology cannot destroy a right on this [01:52:28.880 --> 01:52:39.960] side and simultaneously argue but it can over here. Let's look at the arguments they use. [01:52:39.960 --> 01:52:45.040] Because of the public safety concerns with the ubiquitous existence of automobiles on [01:52:45.040 --> 01:52:50.160] the state's highways and the crowded nature of the state's highways, the state has the [01:52:50.160 --> 01:52:56.520] ability to license and regulate the use of those cars so only people proficiently trained [01:52:56.520 --> 01:52:57.760] can do that. [01:52:57.760 --> 01:53:03.560] But over here, we've got way more guns than we've got cars in the same crowded conditions [01:53:03.560 --> 01:53:09.220] carried in open public on the same crowded streets yet nobody's worried about that right [01:53:09.220 --> 01:53:14.440] being a problem except for the people, of course, who don't want you to have guns in [01:53:14.440 --> 01:53:22.000] the first place. But the courts keep ruling you can't take that one away. Well, then how [01:53:22.000 --> 01:53:28.120] are we taking this one away? How are we sitting here saying that because we've gone from traveling [01:53:28.120 --> 01:53:33.640] on foot to traveling on the modern means of the day, which is exactly the same thing we [01:53:33.640 --> 01:53:38.280] argue about self-defense with a gun, this is where technology has taken us but it doesn't [01:53:38.280 --> 01:53:42.880] take away my right to keep and bear arms. Well, this is where technology has taken us [01:53:42.880 --> 01:53:48.160] but it doesn't take away my right to travel and to free locomotion when and where I please [01:53:48.160 --> 01:53:56.520] in any manner I choose upon my own damned highway. [01:53:56.520 --> 01:54:01.680] Now a reasonable person would understand that argument but we're not talking about reasonable [01:54:01.680 --> 01:54:08.560] people we're talking about attorneys that like to control everybody else. [01:54:08.560 --> 01:54:18.200] So then that takes us interested in the actual court and you had mentioned earlier to the [01:54:18.200 --> 01:54:23.920] prior caller that the statutes aren't I don't know if you're admissible but you don't want [01:54:23.920 --> 01:54:28.920] to use those in court but you can turn that around on them as well right so when they [01:54:28.920 --> 01:54:35.400] charge you with a violation of a statute you can you can bring up that that's not the law [01:54:35.400 --> 01:54:43.680] is that is that correct? Yeah, the statute is not law it's evidence [01:54:43.680 --> 01:54:51.480] of the existence or alleged existence of an actual law but the statute is not the law [01:54:51.480 --> 01:54:57.800] right so you're charged with a violation of the statute whatever it may be no driver's [01:54:57.800 --> 01:55:02.680] license exceeding the limit so you could turn that around on them right and yeah you can [01:55:02.680 --> 01:55:07.880] say where's your proof that this statute is in proper compliance with the underlying law [01:55:07.880 --> 01:55:14.160] produce the actual legislative bill and prove the language carried forth in the statute [01:55:14.160 --> 01:55:19.720] is in compliance with that created by the bill. Yeah and that's what I was curious about [01:55:19.720 --> 01:55:27.720] back to the language with the definitions of driver, operator, motor vehicle, etc. [01:55:27.720 --> 01:55:38.360] Well so as I read earlier out of black the driver is one employed that's right off the [01:55:38.360 --> 01:55:44.320] bat it says one employed and conducting a coach carried etc. etc. etc. so how do you [01:55:44.320 --> 01:55:54.320] get the definition entered into the record?
