[01:25.000 --> 01:28.000] Justice for Sandra was their objective and slogan. [01:28.000 --> 01:33.000] Authorities have said that Bland hanged herself while in custody in finding her family disputes. [01:33.000 --> 01:38.000] The Houston Chronicle reported yesterday that dozens of protesters protested outside a residence [01:38.000 --> 01:44.000] in Caddy, west of Houston, where it was believed to be the state trooper who arrested Bland's household. [01:44.000 --> 01:47.000] They were calling for him to be fired and criminally charged. [01:47.000 --> 01:55.000] The trooper is on administrative leave pending an investigation. [01:55.000 --> 02:00.000] Georgetown, Texas Republican Senator Charles Schwartner is organizing a Health and Human [02:00.000 --> 02:04.000] Services Committee meeting for this Wednesday to seriously consider recommendations to strengthen [02:04.000 --> 02:10.000] regulations on abortion providers, including further restrictions on the sale of fetal tissue. [02:10.000 --> 02:14.000] He also invited Planned Parenthood organizations of Texas to attend the meeting. [02:14.000 --> 02:18.000] Since Texas Planned Parenthood came up in the first hidden video released by the Center [02:18.000 --> 02:23.000] of Medical Progress, which led Governor Greg Abbott and Attorney General Ken Paxton to [02:23.000 --> 02:28.000] investigate if any Texas laws were broken, late-term abortions and the selling of fetal [02:28.000 --> 02:55.000] tissue and organs are illegal in Texas. [04:35.000 --> 04:41.000] It is August 10th, 2015, and we are rolling right along through the year. [04:41.000 --> 04:46.000] All right, something I want to talk about tonight is city abatements. [04:46.000 --> 04:53.000] And the reason this subject is up is because I had the Austin Police Department today without [04:53.000 --> 04:59.000] a warrant, court order, or any type of due process steal one of my cars parked in front [04:59.000 --> 05:05.000] of the house where I live, allegedly abating an abandoned vehicle, which their own paperwork [05:05.000 --> 05:11.000] makes very clear what an abandoned vehicle is, and the fact that my car, parked where [05:11.000 --> 05:17.000] it was, in the shape that it's in, where it runs, and it does all of that, is not abandoned. [05:17.000 --> 05:20.000] Not in any way, shape, or form is it abandoned. [05:20.000 --> 05:25.000] What they didn't like was the fact that the car does not have state plates and stickers [05:25.000 --> 05:26.000] on it. [05:26.000 --> 05:28.000] That's what they didn't like. [05:28.000 --> 05:33.000] The problem is that they can't do anything about that. [05:33.000 --> 05:38.000] And the reason they can't do anything about that is because if the transportation code [05:38.000 --> 05:46.000] was actually valid, they have an issue with the fact that Texas specifically prohibits [05:46.000 --> 05:53.000] municipalities from requiring the registration of motor vehicles and private automobiles. [05:53.000 --> 05:59.000] They are forbidden by the transportation code to require registration. [05:59.000 --> 06:07.000] So that means that if the reason they're taking your car is because, according to them, it [06:07.000 --> 06:14.000] violates municipal ordinance to have it parked on the street when it isn't registered, then [06:14.000 --> 06:21.000] their ordinance already being used against a member of the public and private property [06:21.000 --> 06:23.000] violates the Constitution. [06:23.000 --> 06:28.000] But it violates the Constitution in the fact that it violates state law prohibiting exactly [06:28.000 --> 06:32.000] what they're doing. [06:32.000 --> 06:38.000] So this is something we're going to need to do something about in every municipality. [06:38.000 --> 06:40.000] But I would like to start here. [06:40.000 --> 06:44.000] I would like to be the go-to person for getting this rolling. [06:44.000 --> 06:52.000] Now, I've got some Facebook followers and stuff that one of whom, Mr. Jerry Howe, is [06:52.000 --> 06:56.000] a self-described expert on filing Title 42 lawsuits. [06:56.000 --> 07:00.000] And I'm not in any way attempting to demean his capabilities by saying self-described. [07:00.000 --> 07:03.000] I'm a self-described expert on the transportation code. [07:03.000 --> 07:07.000] I'm a self-described expert on the code of criminal procedure. [07:07.000 --> 07:14.000] I'm not an expert by the means which the attorneys would want to define it in order to discredit me. [07:14.000 --> 07:20.000] But none of them could stand toe-to-toe in a room and argue any point of it with me whatsoever. [07:20.000 --> 07:26.000] So I'm willing to concede that he may very well know Title 42 just as well as I know all this other. [07:26.000 --> 07:29.000] And that's fine by me. [07:29.000 --> 07:38.000] But I want to go after these people in a federal lawsuit for using ordinances in violation of state [07:38.000 --> 07:43.000] Constitution and law to deprive of a federally protected right, the right of due process, [07:43.000 --> 07:52.000] the right to use of property, the right to be safe from unlawful search and seizure, et cetera, et cetera, et cetera. [07:52.000 --> 07:55.000] So guess what that means, folks. [08:42.000 --> 08:48.000] That would make it expensive and difficult, but not so much that it couldn't be handled. [08:48.000 --> 08:55.000] And as a member of the party suing, I could still handle the case even if it was a class action [08:55.000 --> 09:02.000] unless the federal courts are now prohibiting class actions being handled by the parties rather than an attorneys only, [09:02.000 --> 09:09.000] which again would be a violation of due process because we have the right to choose counsel or not choose counsel, [09:09.000 --> 09:14.000] even in a civil lawsuit, despite what they want you to believe. [09:14.000 --> 09:25.000] So that being said, I'm going to please ask whatever you can donate as much as you can donate as often as you can donate. [09:25.000 --> 09:32.000] I need the money to see this lawsuit through, and I cannot start it until I'm confident that I'm going to have the money to do it. [09:32.000 --> 09:40.000] Because it's just like the biblical issue of what good does it do to start building a tower without the funds [09:40.000 --> 09:43.000] just to run out of funds while you're not completed building the tower? [09:43.000 --> 09:45.000] Well, that's the issue with this lawsuit. [09:45.000 --> 09:50.000] It won't do me any good to file it if I don't have the money to see it through to the end. [09:50.000 --> 09:52.000] So, folks, I need your help. [09:52.000 --> 09:58.000] I'm going to be putting this up on Facebook as well and asking folks to donate for that purpose there. [09:58.000 --> 10:08.000] But I really, really want to be able to do this for the benefit of everyone because I can already prove that their ordinance is not law. [10:08.000 --> 10:14.000] I can prove that their ordinance, when applied to the people, violates the Texas Constitution on its face. [10:14.000 --> 10:20.000] Thus, Article 1, Section 29 says it's void. [10:20.000 --> 10:26.000] I've got case law that says when a municipality acts in a governmental fashion, it is acting as an agent of the state. [10:26.000 --> 10:34.000] Well, if the state has forbidden municipalities to do what they just did today, then somebody's going to jail [10:34.000 --> 10:38.000] because there is no immunity for unlawful acts. [10:38.000 --> 10:42.000] There is no immunity for violating state law. [10:42.000 --> 10:54.000] And these guys cannot claim not to know because that was the case that I had posted in the window of the car they took. [10:54.000 --> 11:00.000] Not only did I have the case law that says they can't do it, I had the statute that said they can't do it. [11:00.000 --> 11:03.000] And they chose to ignore it anyway. [11:03.000 --> 11:10.000] In fact, the cops that came out here the first time to talk about it argued that we can do what we want. [11:10.000 --> 11:12.000] No, dude, you can't. [11:12.000 --> 11:19.000] But you do what you think you can do and then I'll show you that you can't do what you want. [11:19.000 --> 11:22.000] So they've got one of my cars now. [11:22.000 --> 11:23.000] The other one's still here. [11:23.000 --> 11:24.000] We'll see what they do with it. [11:24.000 --> 11:29.000] They obviously didn't take it even though they had originally put stickers on both of them. [11:29.000 --> 11:31.000] And the question is why? [11:31.000 --> 11:36.000] Well, because that one, even though it's still parked there and hasn't moved in about as long as the other one has, [11:36.000 --> 11:40.000] simply because I don't have to use my cars all that often, [11:40.000 --> 11:46.000] the car is sitting there with state plates on it and a state sticker in the windshield so they didn't touch it [11:46.000 --> 11:51.000] even though both of them are expired. [11:51.000 --> 11:54.000] So they took the car illegally. [11:54.000 --> 11:58.000] They will probably come back and take the other one illegally. [11:58.000 --> 12:00.000] I want to be able to go after them. [12:00.000 --> 12:02.000] I want to be able to make them stop this. [12:02.000 --> 12:06.000] But I cannot do it by myself financially. [14:26.000 --> 14:32.000] But anyway, a friend of his wrote the book. It's got several of the common-sense chapters. [14:32.000 --> 14:34.000] And it's basically what the whole book is comprised of. [14:34.000 --> 14:42.000] It's a bunch of rants, common-sense rants that are anywhere from two to five pages long in each chapter of the book. [14:42.000 --> 14:45.000] And it's on any particular given subject. [14:45.000 --> 14:50.000] And he's telling about all the things the way it used to be, the way it is, what's wrong with it, and so on and so forth. [14:50.000 --> 14:56.000] And so the movie is going to be taken from information that is put forth in this book. [14:56.000 --> 15:05.000] And it's going to go around – from the best description I have, it's going to be kind of a round robin deal like all of the movies [15:05.000 --> 15:08.000] like Freedom to Fascism and so on and so forth. [15:08.000 --> 15:14.000] You're going to have all these various people talking about this particular subject and giving their opinion and information on it. [15:14.000 --> 15:16.000] And I'm going to be one of those. [15:16.000 --> 15:26.000] So it should be interesting. It just isn't. The purpose of this class is to give you the tools and the means to [21:54.800 --> 22:03.560] defend yourself from these attacks, folks. I cannot understand why so many people don't [22:03.560 --> 22:10.200] make the effort to be armed ahead of time. Okay. That being said, we're going to start [22:10.200 --> 22:16.720] taking calls. A couple things about this. The sign on the trail says no [22:34.640 --> 22:40.240] motor vehicles. Okay. That's obviously a commercial language there. Even the Pennsylvania statutes [22:40.240 --> 22:45.520] make that clear, of course. Wait a minute. The police. Yeah. We understand what the definition [22:45.520 --> 22:50.680] of motor vehicle is, Andrew, but what is the designated purpose of this trail? Is it foot [22:50.680 --> 22:59.040] traffic and bicycles? Well, the catch is the police are driving on it. There are servants. [22:59.040 --> 23:02.720] If they can drive their cars, doesn't that mean the people can drive their cars or not [23:02.720 --> 23:08.260] necessarily? Not necessarily. It depends on whether or not an exception has been made [23:08.260 --> 23:13.960] in the rules for them specifically like there usually is. If there's not, then yeah, they [23:13.960 --> 23:23.800] have a problem. Okay. Of course, in a case of emergency, all bets are off for everybody, [23:23.800 --> 23:31.920] but that would have to be a case by case basis of emergency. Okay. So I guess that means [23:31.920 --> 23:38.080] only the cops can drive on it. Second thing, Santa Spinoche after his, about a year ago [23:38.080 --> 23:44.360] after that, after he got arrested for not paying his toll fees outside the courthouse, [23:44.360 --> 23:46.720] after he explained his unorthodox way of trying to beat the charges with the signature and [23:46.720 --> 23:49.800] all that. I don't want to get into that, but he did say something very interesting about [23:49.800 --> 23:56.120] how all your utility bills and everything is already paid for. And if you connect the [23:56.120 --> 24:02.880] dots, you will discover that it's the Vatican that's already paid for everything. Can you [24:02.880 --> 24:06.480] think of anything in these statutes, the codes that you can find that would show that all [24:06.480 --> 24:13.840] your utility bills and everything else is already paid for as he claims? And if something [24:13.840 --> 24:18.200] you actually can argue about that. Well, I don't know why the burden is mine [24:18.200 --> 24:23.160] to say that there is. My question is, why isn't someone asking him to prove up what [24:23.160 --> 24:28.800] he's saying? Where's your documentation that proves what you're saying is true? Don't [24:28.800 --> 24:36.560] give me some esoteric puzzle of inferences upon inferences. Show me the, the no more [24:36.560 --> 24:42.320] than one inference, logical inference from actual factual evidence and documentation [24:42.320 --> 24:49.320] that you have. If you can't do that, then sorry, I'm not buying it. And in all these [24:49.320 --> 24:53.960] times I've watched people make this argument. No one's been able to do that. No one's willing [24:53.960 --> 25:01.280] to do that. They all talk about it. No one can prove it. They just keep arguing. That's [25:01.280 --> 25:05.920] the way it is. Well, guess what? Your public servants keep arguing. That's the way it is [25:05.920 --> 25:15.560] too. And we know how full of crap they are. That's right. He goes, your [26:37.920 --> 26:42.680] Boston license is suspended. I said, Massachusetts? I said, I've never been in Massachusetts in [26:42.680 --> 26:47.960] my life. What are you talking about? So he takes me back to the car and I said, you got [26:47.960 --> 26:53.400] the wrong guy. Then he comes back and says, well, you only have a Florida ID. I said, [26:53.400 --> 27:00.600] no, I said, I have a Florida driver's license. It expired in 2006. So he takes me now to [27:00.600 --> 27:05.640] the station. He comes back and he says, I was wrong. You never had a Boston driver's, [27:05.640 --> 27:11.160] Massachusetts driver's license. I said, I told you. He goes, but in North Dakota, he [27:11.160 --> 27:15.960] goes, if your driver's license is suspended in any other state, you know, you can't drive [27:15.960 --> 27:20.200] here. I said, well, I'm not suspended. I said, my driver's license expired because [27:20.200 --> 27:24.280] well, in New Jersey, your driver's privileges are suspended. I said, yes, they are. I said, [27:24.280 --> 27:28.040] I have a surcharge that I don't pay. I said, I can't drive in the state of New Jersey [27:28.040 --> 27:32.360] unless I pay a surcharge. So I said, my license is not suspended. My Florida deal, I can drive [27:32.360 --> 27:39.800] in Pennsylvania, Ohio, Delaware, Georgia, Texas. I said, I get pulled over. They run [27:39.800 --> 27:43.080] my license. It says expired. I get a ticket. I said, I got pulled over in South Dakota [27:43.080 --> 27:47.800] last year. They ran my license and they gave me a ticket for driving on expired license. [27:47.800 --> 27:52.440] He goes, well, here, it's not like that. If you don't pay, take another state and you're [27:52.440 --> 27:57.160] suspended in that state, you can't drive in this state. So how would I know I can drive [27:57.160 --> 28:01.880] in your state then? If I can drive in every other state and it's only an expired license, [28:01.880 --> 28:12.120] why would I get arrested? Most of them [28:21.080 --> 28:28.280] have in their state statutes what is called a driver's license compact. Therefore, the federal statutes would be superior [34:58.520 --> 35:05.240] to the state statutes in relation to it. And if you look in each state code hard enough, [35:05.240 --> 35:10.920] hard enough, you will find the references to Title 49. You need to look both in your [35:10.920 --> 35:15.960] state administrative code and you need to look both in your state DMV motor vehicle [35:15.960 --> 35:18.920] or transportation code, whatever they're calling it there. [35:23.080 --> 35:27.160] Okay, I'm not from Minnesota, like I said, from Florida, but I got pulled over there, [35:27.160 --> 35:32.040] but I got to go to court on the 20th and. Well, they're taking you to task under [35:32.040 --> 35:35.800] Minnesota law with a compact they have with New Jersey, right? [35:37.480 --> 35:39.800] Yeah. Well, then you need to know both. [35:41.640 --> 35:47.080] You need to know that both of them are members of that compact. You need to argue that both of them [35:47.080 --> 35:53.000] are using Title 49 as the basis for their statutes, but you need to be able to prove it. [35:53.000 --> 36:00.360] Right. They will try to tell you that the state owns the highways. They do not. [36:37.240 --> 36:43.080] The people own the highways and the people have an absolute right to their use for their own [36:43.080 --> 36:50.200] private business and pleasure. There is case after case after case at the Supreme Court level [36:50.200 --> 36:56.920] and federal level on this issue. And most states have cases on it dating way back yonder to the [36:56.920 --> 36:58.120] early 1900s. [37:05.800 --> 37:11.000] Sounds good. I mean, like I said, I actually seen on Alex Jones before and I kind of turned [37:11.000 --> 37:14.440] in the show last week and listened to you. So they kicked it out. But at the same time, I'm thinking that I should [40:18.360 --> 40:25.800] have just went on ahead and paid the 175 for the transcript because I doubt if they would have [40:25.800 --> 40:35.000] given me back the cash on the mandamus compelling the courts to pay that cash back. But yeah, [40:35.000 --> 40:42.040] I haven't heard anything about any type of ruling on the mandamus. I just heard about the appeal [40:42.040 --> 40:48.360] being denied for not having the transcript. So yeah, I chalked that up as a loss. [40:49.160 --> 40:54.280] Okay. Yeah, they tend to ignore you without that transcript. That's what I'm saying. Doesn't [40:54.280 --> 40:59.880] matter what you file on an appeal, all of your documents mean nothing without that transcript. He's like, no, you know why I stopped you? [41:41.320 --> 41:48.600] I say, am I under arrest? He's like, no, I said, am I free to go? He's like, no. So he's like, [41:49.400 --> 41:53.880] I stopped you because he's like, you know why I stopped you? I say, no, I don't know why you [41:53.880 --> 42:00.040] stopped me. You're going 40 or whatever, you're speeding back there on that street. [42:00.040 --> 42:06.440] So like in every other state, I'm assuming Michigan's law is reasonable and prudent. [42:06.440 --> 42:10.840] That's what I'm thinking to myself because I didn't even notice I was speeding if I was [42:10.840 --> 42:16.360] speeding or not, but I didn't have that conversation with him. So what I did was I just gave him my ID [42:17.560 --> 42:26.760] and he kept asking for my driver's license and my other paperwork that would show I was in commerce. [42:26.760 --> 42:33.560] And I told him, I was like, can I give him any other information that's going to incriminate me? [42:34.360 --> 42:42.600] And he just kept asking. And I got this on tape. He asked me multiple times and I asked for his [42:43.240 --> 42:48.920] superior. And good thing his superior was right there because this guy looked like he was getting [42:48.920 --> 42:58.440] in an aggressive stance. So once his superior came, he asked me to get out the car. And I know [42:58.440 --> 43:01.240] you say never get out the car, but I'm like, you know. [43:03.240 --> 43:07.240] Well, but I also say you have to be the judge of how far to take it. [43:07.720 --> 43:13.080] Exactly. So I wasn't going to take it that far. So I get out the car. They asked me, [43:13.080 --> 43:19.880] they asked me, you know, could they search me down? I was like, I don't agree with it, [43:19.880 --> 43:24.200] but it looked like you guys about to, you know, you're aggressing upon me. So I told her, I said, well, [47:19.160 --> 47:23.240] not that judge arraigned me that day because they wanted me to sign some paperwork. [47:23.240 --> 47:26.360] And I told them I wasn't going to sign anything that labeled me as a defendant. [47:28.920 --> 47:35.160] The judge basically entered a plea in for me. So I tell my public defender that. [47:35.960 --> 47:40.680] And she says, well, you didn't waive any right by him entering the plea. I say, is that legal advice? [47:40.680 --> 47:47.400] I asked her just like that. Is that legal advice? Because I had my documentation asking for withdrawal [47:47.400 --> 47:52.280] of that plea. Because if you get that plea, if you plea, you basically waive your... [47:54.280 --> 47:59.800] You waive your... The right you waive with the entering of a plea is the right to notice, [47:59.800 --> 48:04.680] the right to challenge the charging instrument, and any indictment or information that goes with it, [48:04.680 --> 48:10.840] or that is it, and impersonal jurisdiction. Those rights are waived by the entering of a plea no [48:10.840 --> 48:19.320] matter who enters it. And also, there is a probable cause hearing that needs to take place too. [48:19.320 --> 48:25.160] That's the specific statute that I speak to. Well, ask your attorney this. And so what makes it way worse is that when I finally got [01:04:53.320 --> 01:04:58.680] this hole opened up, the carpet removed and look down in there, it's full of mold. And I've maintained [01:04:58.680 --> 01:05:05.720] monitor humidity for like the last year and it's like, you know, 80 to 100% humidity. So my daughter's having crazy reactions, mold, allergic reactions and [01:05:25.720 --> 01:05:32.520] food reactions as a result. And I told, man, I probably called like 10, 15, I don't know, [01:05:32.520 --> 01:05:36.280] I called so many different attorneys, told them the whole story that I just told you minus the [01:05:36.280 --> 01:05:41.560] recent medical discoveries from my daughter. But they always said they would give me a call back [01:05:41.560 --> 01:05:45.640] and I never got a call back. So after listening to your show, I kind of got inspired to maybe [01:05:46.200 --> 01:05:51.880] go get jurisdictionary and try to do it myself. And I just want to see what you think about it. [01:05:51.880 --> 01:05:56.600] Well, I think you have a case and I think you would do well with jurisdictionary to apply it. You would have to be able to prove that they also knew that you were [01:06:40.680 --> 01:06:45.960] buying a house under false pretenses. They may have very well sold it to you under the same [01:06:45.960 --> 01:06:52.360] auspices under which you bought it. This is what we were told. But one thing it does tell you is [01:06:52.360 --> 01:06:55.400] that there was no foundation inspection of the house. [01:06:57.400 --> 01:07:01.800] Right. They represented it as if it was a slab in front of them. If you look at the house, you can say, well, and it would at least prompt [01:07:25.960 --> 01:07:29.960] an experienced person to ask the question, is that a solid slab? [01:07:29.960 --> 01:07:36.280] The question is, is that a solid slab foundation through the whole thing? Because I hadn't [01:07:36.280 --> 01:07:41.960] inspected and everything. But it sounds like from what you're saying, I got a good shot at doing [01:07:41.960 --> 01:07:47.480] this. I'm going to get to your dictionary. Are you saying you hired someone to inspect the house? [01:07:48.600 --> 01:07:57.160] Yes, sir. I did. And what did they tell you? Actually, he didn't know that it existed. Right, because it says here, it says, Section 16, it says, [01:26:22.760 --> 01:26:29.240] every bill shall be read on three different days in each house, unless in case of urgency, [01:26:29.880 --> 01:26:36.600] three-fourths of the house where such bill is so depending shall deem it expedient to dispense [01:26:36.600 --> 01:26:42.840] with this rule, and every bill having passed both houses shall be signed by the speakers of their [01:26:42.840 --> 01:26:51.720] respective houses. Now, is there anything further down though that says what this urgency can be [01:26:52.920 --> 01:26:57.160] in order to be there? Because that's one of the things about the Texas Constitution on this [01:26:57.160 --> 01:27:04.120] particular point. It is adamantly clear that the state of emergency that must exist in order to [01:27:04.120 --> 01:27:11.320] suspend these rules, regardless of the number of votes, is a state of emergency based upon disasters [01:27:11.320 --> 01:27:18.600] from enemy attack. That's explicit in the Constitution. No other emergency clause authorizes [01:27:18.600 --> 01:27:26.280] the suspension of that clause, and here in Texas that clause says, no bill shall have the force [01:27:26.280 --> 01:27:32.920] and effect of law until it has been read on the floor of each house over three several days [01:27:32.920 --> 01:27:41.480] and public discussion held thereon. So right there, they're completely dead as far as the [01:27:41.480 --> 01:27:48.120] Texas Constitution is concerned. What they're actually telling [01:36:34.120 --> 01:36:42.600] you though is you are to use the common term or phrase as it is defined in law. Now, the logic of my statement on this is this, if they actually meant [01:36:58.360 --> 01:37:05.240] that every time a term or phrase is not defined by statute, that you are supposed to go to American [01:37:05.240 --> 01:37:11.560] heritage or Webster's, we would not have blacks and Andersons and any of the rest of the legal [01:37:11.560 --> 01:37:19.160] dictionaries. Those legal dictionaries exist for a reason. And the reason is to get the law's [01:37:19.160 --> 01:37:26.280] viewpoint of what a specific term or phrase means first. And only if the law doesn't define it, [01:37:26.280 --> 01:37:29.640] do we then go down and define it in the common vernacular. [01:37:31.800 --> 01:37:39.800] Well, as I recall, I was perusing the revised statutes of Louisiana. I don't recall that [01:37:39.800 --> 01:37:47.800] travel was ever mentioned. And it probably was not. Yeah, I was, I called it to a local talk radio [01:37:47.800 --> 01:37:55.640] show and there was a lawyer on and I was bringing up the topics of, you know, the right to travel [01:37:55.640 --> 01:38:01.960] and there wasn't a corpus de lecti, et cetera, you know, the stuff on your show. And when I told him [01:38:01.960 --> 01:38:06.680] I had the right to travel, he threw back at me, well, sure, you could travel wherever you want. [01:38:06.680 --> 01:38:13.800] You just can't do it in your vehicle. And so, of course, this was on the radio and I was trying to [01:38:13.800 --> 01:38:20.680] get the defined terms, but he just steamrolled me and ridiculed me over the air. So, I wanted to cut [01:38:20.680 --> 01:38:27.640] through all of that and know if they ever say, yeah, you can travel, but you can't do it in a vehicle. [01:38:27.640 --> 01:38:34.840] Actually, the Supreme Court and the high courts in most every state say this attorney is a moron. [01:38:35.800 --> 01:38:42.600] The case law to support the right to travel is there. It's just being ignored for the revenue [01:38:42.600 --> 01:38:52.920] it generates. It's exactly like jury nullification. The jury has the absolute right, but the courts [01:38:52.920 --> 01:39:00.600] forbid anyone to tell them. The courts forbid them to be on a jury if they intend to exercise it. [01:39:01.160 --> 01:39:05.640] It's exactly the same thing. They have the right to do it. They don't have to tell anybody they're [01:39:05.640 --> 01:39:13.000] going to do it. They just can. The same thing with the right to travel. The case law specifically says that this includes an automobile just as much as it does a [01:39:24.680 --> 01:39:31.080] horse and a carriage. It's like any other provision of the Constitution that is valid through history. [01:39:31.080 --> 01:39:37.560] Just because technology changes the mode of locomotion does not invalidate the right. [01:51:10.520 --> 01:51:18.680] No, no, no. 1925 is the original statutes that all current codes are based on here in Texas. [01:51:19.560 --> 01:51:26.760] Everything has been amended since 1925. There hasn't been any new law. There's only been [01:51:26.760 --> 01:51:35.240] amendments to the underlying law. And the underlying law is certified as 1925 by the [01:51:35.240 --> 01:51:43.080] secretary of state. That's here in Texas. I don't know about Virginia. Keep that in mind. [01:51:44.680 --> 01:51:50.120] How would you suggest I go about finding out the base law in... [01:51:50.120 --> 01:51:54.440] Well, the first thing you need to do is find a set of whatever the original codes were there [01:51:54.440 --> 01:51:59.640] in West Virginia. And in the very first couple of pages, you should have a certification by [01:51:59.640 --> 01:52:06.600] the secretary of state saying what actual law that statutory code is in compliance with. [01:52:08.920 --> 01:52:15.800] But you may have to go back as far as 1990 or even earlier to find one that [01:52:15.800 --> 01:52:21.720] I don't know about Virginia. Here in 1996 is when they stopped using Vernon's and [01:52:21.720 --> 01:52:26.280] David's civil statutes, which had those certifications in the front of them. [01:52:26.280 --> 01:52:31.240] None of the codes now are certified in any way by the secretary of state as being compliant with [01:52:31.240 --> 01:52:36.440] underlying law. And the reason is, is because they're not. They're not even close. They're not [01:52:36.440 --> 01:52:43.320] constitutionally compliant or statutorily compliant or underlying legislation compliant, I should say. [01:52:43.320 --> 01:52:54.200] Understood. Understood. Also in the seminar there, you talked about three legal definitions [01:52:54.200 --> 01:52:59.640] of the word being if you feel appropriate.
