[01:07.320 --> 01:12.000] In recent news, the San Antonio Franciscan missions were inscribed as a World Heritage [01:12.000 --> 01:17.960] site in a decision by UNESCO, the United Nations Education Scientific and Cultural Organization, [01:17.960 --> 01:21.660] at the World Heritage Summit yesterday morning in Bonn, Germany. [01:21.660 --> 01:26.760] This marks Texas's first World Heritage site and the 23rd in the United States, like the [01:26.760 --> 01:31.240] Statue of Liberty, the Grand Canyon, Yellowstone National Park, and others. [01:31.240 --> 01:36.080] Internationally, it puts the missions alongside sites such as the Pyramid of Giza and the [01:36.080 --> 01:37.080] Great Wall of China. [01:37.080 --> 01:41.920] The nomination process began in 2006 at the inception of the San Antonio Conservation [01:41.920 --> 01:46.920] Society, whose emblem is the sun portrayed as an all-seeing eye, with rays of light or [01:46.920 --> 01:49.400] sight beaming down on the missions. [01:49.400 --> 01:54.080] The designation is expected to be a huge impact for socioeconomic change, with over a hundred [01:54.080 --> 02:01.920] million dollars being estimated as additional tourist revenue. [02:01.920 --> 02:06.400] After the Texas Gold Bill, HB 43, calling for Texas, the only state in the union to [02:06.400 --> 02:10.960] actually have a reserve of gold to store its own reserves within its own borders, passed [02:10.960 --> 02:15.400] through the Texas Legislator and was signed by Texas Governor Greg Abbott, the Texas Comptroller's [02:15.400 --> 02:19.400] Office is now saying that they're having a tough time implementing it. [02:19.400 --> 02:24.640] Apparently the law doesn't say where the depository is to be or how it is to be built or secured. [02:24.640 --> 02:28.600] Funding was not provided either, and a provision allowing ordinary people to check their own [02:28.600 --> 02:33.240] gold or silver bouillon into the facility have added an extra layer of complications. [02:33.240 --> 02:37.080] A lot of people, both pro and con, feel that Texas may be considering secession, as well [02:37.080 --> 02:41.400] as many are saying that this place is new distrust and fiat backed by nothing versus [02:41.400 --> 02:42.920] fiat backed by gold. [02:42.920 --> 02:48.240] The Fed declined comments on the new Texas depository, as did HSBC Bank, which currently [02:48.240 --> 02:52.960] stores the state of Texas' gold bars in an underground vault in Manhattan. [03:44.680 --> 03:45.680] Somebody got away. [03:45.680 --> 03:46.680] Somebody didn't get too far. [03:46.680 --> 03:50.680] Take all the rope in Texas by the tall oak tree [03:50.680 --> 03:54.680] Round up all of them bad boys, sing a Mayan street [03:56.680 --> 03:58.680] For all the people to see [04:00.680 --> 04:04.680] That justice is one thing you should always find [04:04.680 --> 04:08.680] You gotta settle up your boys, you've gotta draw a hard line [04:08.680 --> 04:12.680] Let the gums both settle, we'll sing a victory tune [04:12.680 --> 04:16.680] And we'll all meet back at the local school [04:16.680 --> 04:21.680] We'll raise up our glasses against evil forces, singin' [04:21.680 --> 04:26.680] Let's get for my men before my horses [04:32.680 --> 04:35.680] We got too many gangsters doin' [04:35.680 --> 04:38.680] Alright folks, good evening, this is the Monday Night Rule of Law radio show [04:38.680 --> 04:43.680] It is July 6, 2015 [04:43.680 --> 04:46.680] I gotta tell you folks [04:46.680 --> 04:51.680] We keep running into the same problem with these courts and these judges [04:51.680 --> 04:54.680] Every time we turn around [04:54.680 --> 04:58.680] Where we already have the information in front of them [04:58.680 --> 05:02.680] They're ignoring it, they're not following the code of criminal procedure [05:02.680 --> 05:07.680] Or the statute relating to whatever their allegation is against you and so on and so forth [05:07.680 --> 05:13.680] So tonight I find it necessary to go over the complaint issue one more time [05:13.680 --> 05:17.680] Because I have yet another person that called me today with an issue where [05:17.680 --> 05:26.680] They were actually held in contempt of court because they refused to sign a plea before the judge [05:26.680 --> 05:30.680] And they were thrown in jail for contempt [05:30.680 --> 05:40.680] Now the problem with this is, is municipal judges and JPs are very limited on their ability to use contempt [05:40.680 --> 05:43.680] At least here in Texas [05:43.680 --> 05:51.680] In addition to this, no one is required to enter a plea at all [05:51.680 --> 06:01.680] In fact, the only authority granted to a magistrate or judge if the accused will not enter a plea and refuses to do so [06:01.680 --> 06:06.680] Is to enter a plea on their behalf of not guilty [06:06.680 --> 06:14.680] Nowhere are they authorized to take punitive action because they will not sign a plea agreement [06:14.680 --> 06:17.680] Nowhere [06:17.680 --> 06:28.680] Because the issue with signing a plea is that the plea requires the waiver of very specific due process rights in order to accomplish that feat [06:28.680 --> 06:31.680] For example [06:31.680 --> 06:39.680] If you sign or enter a plea on the record, you have just waived impersonal jurisdiction [06:39.680 --> 06:44.680] You have waived the right to notice or to complain of the lack thereof [06:44.680 --> 06:50.680] You have waived the right to challenge the form and substance of the charging instrument [06:50.680 --> 06:53.680] Even if it doesn't yet exist [06:53.680 --> 06:57.680] Which is the situation we're about to get into [06:57.680 --> 07:01.680] Now those are the three that at a minimum [07:01.680 --> 07:04.680] You throw out the window by entering a plea [07:04.680 --> 07:14.680] And those are the three that at a minimum a judge forces you to waive when they attempt to enter a plea on your behalf [07:14.680 --> 07:18.680] And none of the rest of the Code of Criminal Procedure has been complied with [07:18.680 --> 07:25.680] If they haven't given you a copy of the complaint, they haven't complied with 45.018B [07:25.680 --> 07:32.680] They haven't given you proper notice, you haven't been properly informed of the nature and cause, none of it [07:32.680 --> 07:38.680] And that's not true for a complaint anyway, it is only true for an indictment or information [07:38.680 --> 07:44.680] But since the courts have ruled over and over again, in error I might add [07:44.680 --> 07:50.680] That a complaint is the minimum bar for jurisdiction in a justice and municipal court [07:50.680 --> 07:55.680] Then we need to understand that as the minimum bar [07:55.680 --> 08:01.680] They at least have to do that to have jurisdiction to do anything and they aren't doing it [08:01.680 --> 08:07.680] They are simply moving ahead without the complaint [08:07.680 --> 08:18.680] Now here's the other problem that surfaces and which would be extremely hard for any prosecutor or defense attorney to argue is not the case [08:18.680 --> 08:26.680] If the minimum bar for jurisdiction in a justice and municipal court is a sworn complaint [08:26.680 --> 08:34.680] Then 27.14D is violative of the right of due process in the very first instance [08:34.680 --> 08:39.680] And here, I'm going to read that to you so you can see exactly why that is [08:39.680 --> 08:50.680] Alright, 27.14D of the Code of Criminal Procedure, it's fairly short, but this is what it reads [08:50.680 --> 08:58.680] If written notice of an offense for which maximum possible punishment is by fine only [08:58.680 --> 09:06.680] Or of a violation related to the manner, time and place of parking has been prepared, delivered and filed with the court [09:06.680 --> 09:11.680] And a legible duplicate copy has been given to the defendant [09:11.680 --> 09:19.680] The written notice serves as a complaint to which the defendant may plead guilty, not guilty, or no law contender [09:19.680 --> 09:23.680] Now, the problem right here is this [09:23.680 --> 09:31.680] First off, the citation is not sworn, can't be sworn, there's no one there to verify it when it's issued [09:31.680 --> 09:44.680] Alright, and one police officer can't verify it for another police officer because nowhere is a police officer authorized to administer oaths for these types of citations [09:44.680 --> 09:53.680] Nowhere, or I should say nowhere are they authorized to administer an oath for a complaint in relation to this [09:53.680 --> 10:02.680] If you read Chapter 45 of the Code of Criminal Procedure, it is very, very clear that you cannot swear out a complaint before a police officer [10:02.680 --> 10:04.680] Can't do it [10:04.680 --> 10:20.680] So the citation fails in the swearing portion and it fails because it does not comply with the requisites of a complaint that were put into the place by the legislature under 45.019A of the Code of Criminal Procedure [10:20.680 --> 10:40.680] And since it does not fulfill the requirements of a complaint, it is not a sworn allegation of an offense, it cannot, since the complaint is the minimum bar here, invest a court with jurisdiction of the cause [10:40.680 --> 10:50.680] And since the citation cannot invest the court with jurisdiction of the cause, no plea can be entered upon the citation alone [10:50.680 --> 10:58.680] And no entry by a judge in any court record or proceeding can be based upon the complaint alone [10:58.680 --> 11:08.680] Because they don't have any jurisdiction to be holding that proceeding or to be entering that judgment or order or anything else into the record [11:08.680 --> 11:10.680] None [11:10.680 --> 11:19.680] No complaint is filed, no plea can be entered because there's nothing to plea to [11:19.680 --> 11:21.680] That simple [11:21.680 --> 11:24.680] Cut and dry, that simple [11:24.680 --> 11:26.680] But there's more [11:26.680 --> 11:31.680] If you go on in 27.14D, you find this [11:31.680 --> 11:46.680] If the defendant pleads not guilty to the offense or fails to appear based on the written notice, a complaint shall be filed that conforms to the requirements of Chapter 45 of this Code [11:46.680 --> 11:55.680] Right here, the legislature is attempting to say that this court has jurisdiction to take a plea even when a complaint does not exist [11:55.680 --> 11:57.680] Okay? [11:57.680 --> 11:59.680] Not possible [11:59.680 --> 12:04.680] And that complaint serves as an original complaint [12:04.680 --> 12:17.680] Now notice it says if you plead not guilty or you fail to appear, the only thing the court is authorized to do is not to give you a failure to appear charge [12:17.680 --> 12:20.680] But to have a complaint created [12:20.680 --> 12:22.680] That's it [12:22.680 --> 12:24.680] Nothing else [12:24.680 --> 12:33.680] This is also true under 1517G and 14.06B [12:33.680 --> 12:35.680] Okay? [12:35.680 --> 12:41.680] Nowhere is failure to appear ever a charge in relation to a Class C [12:41.680 --> 12:48.680] Except in 45.00 or 010 of the Transportation Code [12:48.680 --> 12:51.680] 543.010, yeah [12:51.680 --> 12:59.680] And even there, it does not define it as an offense [12:59.680 --> 13:01.680] Okay? It doesn't [13:01.680 --> 13:12.680] Because it doesn't say that it's an offense of any particular classification, it's not defined as a misdemeanor, nothing [13:12.680 --> 13:13.680] So we have a problem [13:13.680 --> 13:18.680] Even if you don't show up, they're not allowed to give you failure to appear [13:18.680 --> 13:28.680] But they haven't even created a complaint yet, so they never had jurisdiction to do anything, much less say you didn't appear [13:28.680 --> 13:36.680] Because until the complaint is filed, there is no justiciable issue before any court [13:36.680 --> 13:38.680] Period [13:38.680 --> 13:46.680] There's no standing on the part of the state or anyone else to get you into that courtroom without that complaint [13:46.680 --> 13:54.680] Since the complaint is the minimum bar the courts have set, even though that violates Article 5, Section 12B of the Texas Constitution [13:54.680 --> 14:00.680] Chapter 20 of the Code of Criminal Procedure, 2.04 and 2.05 of the Code of Criminal Procedure [14:00.680 --> 14:09.680] And it never violated 15.04, 15.05, or 45.01 before it was repealed [14:09.680 --> 14:21.680] Because not a single statute in Texas has ever said that a complaint invests a court with jurisdiction of anything [14:21.680 --> 14:29.680] And even if the statute did say that, it's still in direct violation of 45.018B [14:29.680 --> 14:44.680] Now while the Texas Constitution says that the legislature has the power to create the form and substance of indictments and information as a matter of law [14:44.680 --> 14:52.680] Nowhere are they given the legislative power to make a complaint, an indictment, or information [14:52.680 --> 14:58.680] Nor are they given power to create a new form of charging instrument [14:58.680 --> 15:06.680] And the Texas Constitution, the cases, the information they relied on in the beginning to say the complaint was the one thing they had to have [15:06.680 --> 15:08.680] Let me ask you a question [15:08.680 --> 15:18.680] Before municipalities were incorporated and authorized by the Constitution to do the things they do through a city charter [15:18.680 --> 15:32.680] How could they say that a complaint alone would invest that particular court or a JP court with jurisdiction when that was never true prior to that amendment being added to the Constitution [15:32.680 --> 15:35.680] Because it's certainly not in the amended section [15:35.680 --> 15:38.680] It's not there at all [15:38.680 --> 15:46.680] In fact, the only way an ordinance gets used in Article 11 of the Texas Constitution is for them to do it for public office [15:46.680 --> 15:48.680] That's it [15:48.680 --> 15:53.680] Got nothing to do with us [15:53.680 --> 16:03.680] But as this progresses on, you can see that the complaint can never do what they want it to do because here's another problem with it [16:03.680 --> 16:11.680] Ninety-nine times out of a hundred, the complaints filed in a Class C misdemeanor case are hearsay [16:11.680 --> 16:18.680] In other words, the person saying I have reason to believe and do believe is not a competent fact witness [16:18.680 --> 16:22.680] They don't have personal knowledge [16:22.680 --> 16:25.680] Now, what that leads up to is this [16:25.680 --> 16:32.680] While anyone can file a complaint, the complaint cannot be sworn to by just anyone [16:32.680 --> 16:42.680] Because it's not an affidavit unless the person doing the swearing is also a competent fact witness to that which they're swearing to [16:42.680 --> 16:50.680] Plus, I have reason to believe and do believe is qualifying language, and that's not acceptable under the law of affidavits [16:50.680 --> 16:59.680] All right, folks, hang on. new forms, which they didn't do [20:49.680 --> 20:58.680] And then use them in a manner that makes the law inconsistently applied from one venue to the next [20:58.680 --> 21:04.680] Now get this, that's another problem with the equal protection of the law in this case [21:04.680 --> 21:12.680] While they simplified the rules of procedure for the justice and municipal courts under chapter 45 [21:12.680 --> 21:20.680] There's nothing that says that the defendant can't use everything that's normally used [21:20.680 --> 21:23.680] And do it the same way it's normally done [21:23.680 --> 21:33.680] Even though it's allowed to be more informal, it cannot be informal to the point of deprivation of rights or denial of due process [21:33.680 --> 21:39.680] Which is exactly what these judges take it to mean and allows them to do [21:39.680 --> 21:47.680] Because none of these judges read your pleadings, none of them will rule upon the merits of the pleadings [21:47.680 --> 21:50.680] They just blanket deny them because they never read them [21:50.680 --> 21:54.680] And even if they had read them, they were going to rule against you anyway [21:54.680 --> 21:58.680] No matter what facts and law you put in front of them [21:58.680 --> 22:04.680] Because their paychecks depend upon it [22:04.680 --> 22:10.680] Nothing about these courts is set up to dispense justice [22:10.680 --> 22:19.680] And the more you look at what I'm talking about in relation to the complaint and the rulings by the courts I'm getting you in there, the more obvious that becomes [22:19.680 --> 22:25.680] So since they're not following chapter 2 of the Code of Criminal Procedure and the 2.04 and 2.05 [22:25.680 --> 22:32.680] Where it specifically says that in all misdemeanor cases, an information has to be filed [22:32.680 --> 22:44.680] It does not create any exception other than if they're in a county where there is no county attorney, then they can prosecute by complaint alone [22:44.680 --> 22:53.680] And not a single one of these court cases that are being decided today has ever bothered to go back and read the statute [22:53.680 --> 23:09.680] They completely rely upon 1958 and 2007 and 1994 and 95 and 96 case law that does not comply with the statute [23:09.680 --> 23:24.680] In other words, the law is only what the judges, i.e. the lawyers, that now where the title of judge, the attorneys, I'm sorry, not lawyers, attorneys [23:24.680 --> 23:29.680] That now where the title of judge want it to be [23:29.680 --> 23:32.680] It's not what the legislature passed and it's not what they wrote down [23:32.680 --> 23:35.680] It's what the courts want it to be [23:35.680 --> 23:45.680] Now this is the problem with having attorneys in the judiciary, attorneys in the executive, and attorneys in the legislature [23:45.680 --> 23:57.680] You get collusion and conspiracy to defraud the people of their rights and their ability to use the law for remedy [23:57.680 --> 24:04.680] There is absolutely no remedy built into these courts at all [24:04.680 --> 24:15.680] Because everything these courts do is based upon the irrebuttable presumption that you were engaged in transportation [24:15.680 --> 24:21.680] In order to be subject to these bogus regulatory statutes in the first place [24:21.680 --> 24:31.680] And then when they make the allegation, they fail to do what they're supposed to do by creating a complaint [24:31.680 --> 24:41.680] And then using that complaint as the basis to get an actual charging instrument, which would then invest somebody with jurisdiction to go further [24:41.680 --> 24:55.680] Now understand that the complaint, since it can be signed by anybody, and since it is usually signed by someone making it hearsay [24:55.680 --> 25:04.680] Logic says that if hearsay is inadmissible in a court of law, except under very specific exceptions [25:04.680 --> 25:17.680] Then an instrument that is based entirely upon hearsay cannot possibly be the grounds for investing a court with jurisdiction to prosecute [25:17.680 --> 25:33.680] Just can't do it, because the person that puts you in front of that judge doesn't know thing one about what they swore to, not one [25:33.680 --> 25:38.680] And here is the other problem [25:38.680 --> 25:44.680] Let's look at how the citations get processed depending upon a particular location [25:44.680 --> 25:51.680] In very small locations, the officer may actually come in, turn them in and fill out complaints while they're there [25:51.680 --> 26:01.680] They also may simply come in, drop off a bundle of complaint, or I'm sorry, fill out their citations, drop off the citations and fill out a complaint while they're there [26:01.680 --> 26:10.680] Or drop off just a bundle of citations and someone in the office, like the clerk, fills out the complaint [26:10.680 --> 26:22.680] Now here's the thing, first off, the clerk is basing their belief entirely on their construction of the information in the citation [26:22.680 --> 26:32.680] Because the officer is normally not hanging around there to answer questions about the tickets, if they're going to just drop off a bundle of them anyway, right? [26:32.680 --> 26:44.680] They're simply going to come in there and hand off that bunch of citations, they're going to go get a standard template form and fill in the blanks with names and the other pertinent information [26:44.680 --> 26:56.680] But the clerk doesn't really have to look at the citation any further than it takes to know which kind of complaint they need [26:56.680 --> 27:12.680] And the thing is, how can the clerk be believing any of the facts asserted in this document when the document's not sworn to, it's not discussed with the person that actually did it, it's just a bunch of paper that was thrown at them [27:12.680 --> 27:23.680] And then there's another caveat, the clerk works for the court, i.e. the judge of that court [27:23.680 --> 27:38.680] Doesn't matter if there's 20 clerks and one judge, or 20 clerks and five judges, every clerk is an agent of every judge in that court [27:38.680 --> 27:51.680] As an agent of the judge, filling out these complaints from these citations from these officers, the clerk is acting as the judge's agent [27:51.680 --> 27:57.680] In other words, the judge is the one that's swearing to the complaint [27:57.680 --> 28:22.680] Then the judge is also the one that's going to conduct the trial and the proceedings before trial, like your first appearance, your motions hearing, your whatever else they scheduled you for, that judge that swore the complaint out against you is going to be the presiding judge in the case as well [28:22.680 --> 28:35.680] That is a denial of due process. The person that is accusing you is the one that gets to control how the case proceeds against you [28:35.680 --> 28:54.680] Sounds fair, don't it? [34:01.680 --> 34:03.680] Hey, good evening Eddie, thanks for taking the call [34:03.680 --> 34:05.680] Yes sir [34:05.680 --> 34:10.680] Tom, we have discussed this on a prior occasion and I'll bring you up to date [34:10.680 --> 34:23.680] Originally I received a parking citation and it was placed under the windshield wiper of the automobile [34:23.680 --> 34:32.680] And I filed a bunch of motions and subsequently they dismissed the case [34:32.680 --> 34:41.680] There were many public information requests involved surrounding this and they never would provide discovery [34:41.680 --> 34:58.680] But they ended up dismissing it and something that was really questionable about the whole thing was that when I went and inspected my court file [34:58.680 --> 35:09.680] There was a court copy of the citation which was at the bottom was an affidavit of probable cause [35:09.680 --> 35:16.680] And the affidavit was the constable and it had a notary stamp [35:16.680 --> 35:22.680] And my citation was issued on September 11th at 730 at night [35:22.680 --> 35:27.680] The notary stamp was of the same date and after I pulled [35:27.680 --> 35:36.680] I put in a public information request to get this notary's work hours because she worked in the constable's office there in the records division [35:36.680 --> 35:46.680] And she got off that day at 5 p.m. so she was not anywhere near the courthouse which is where the constable is located [35:46.680 --> 35:56.680] And there were in fact three or four, because I pulled a sampling of cases from that week from the court [35:56.680 --> 36:06.680] And there were several for that night that happened after 5 p.m. which had her notary's stamp and her stamp signature [36:06.680 --> 36:11.680] And the date which was the same date as the citation issue [36:11.680 --> 36:18.680] Okay, well let me ask a question. What was the latest time one of those was done? [36:18.680 --> 36:20.680] 1130 at night [36:20.680 --> 36:29.680] Okay, so understand this before you continue. Notaries take their signature stamps and pads with them almost everywhere they go [36:29.680 --> 36:38.680] Including home or they have alternate sets for at home just in case somebody calls them up with an emergency that needs to be notarized [36:38.680 --> 36:42.680] That way they don't have to travel all the way in the office to do it [36:42.680 --> 36:50.680] A friend of mine was a notary and she lived real close to where I lived at the time and rather than go all the way in the town [36:50.680 --> 36:53.680] She always had notary's stuff at home too [36:53.680 --> 37:00.680] So it's entirely possible this guy had went by there on his way in or whatever that night and got it done [37:00.680 --> 37:02.680] Now that's one possibility [37:02.680 --> 37:03.680] Hang on [37:03.680 --> 37:07.680] Then she would have several officers or constables going by her house and in that living room [37:07.680 --> 37:12.680] Well, that may be possible. I don't know how popular she is, but that's not really my point [37:12.680 --> 37:19.680] My point is is that it's possible and you don't have proof that it isn't being done. Not yet [37:19.680 --> 37:25.680] But here's the alternative which is where you're trying to go and I'm going to clear it up for everyone else [37:25.680 --> 37:33.680] If the notary is pre stamping these documents before there's an actual citation issued on them [37:33.680 --> 37:37.680] That's illegal [37:37.680 --> 37:46.680] The notary cannot verify the signatures on or the contents of these documents as being sworn to [37:46.680 --> 37:50.680] If it's not if the facts of it aren't sworn to in front of them [37:50.680 --> 37:57.680] See, there's a difference between swearing to the signature on the document [37:57.680 --> 38:05.680] And that the document is true and correct and the person in front of me is the one that signed it [38:05.680 --> 38:10.680] Because there they're swearing to two sets of fact patterns [38:10.680 --> 38:14.680] So it really depends on what the jurat says as to whether or not you've got a problem [38:14.680 --> 38:24.680] But in either case, normally the job of a notary is to verify the person signing it, not the document itself [38:24.680 --> 38:31.680] But again, that depends on what the document is and what it requires [38:31.680 --> 38:33.680] Do you follow? [38:33.680 --> 38:38.680] I do follow and the next day, which was a Friday, she was off of work [38:38.680 --> 38:42.680] But her notary appeared on many documents, again the same citations [38:42.680 --> 38:48.680] And what it appears is they have the top of the citation is what I received [38:48.680 --> 38:55.680] And they apparently it's like a half a sheet and apparently they have this affidavit that they make a copy of on the bottom [38:55.680 --> 38:57.680] And then what I believe... [38:57.680 --> 38:59.680] Do the signatures match? [38:59.680 --> 39:04.680] If you lay the signatures over each other on these copies, are they exactly the same? [39:04.680 --> 39:05.680] No, they're not [39:05.680 --> 39:10.680] Okay, then the copying portion doesn't work [39:10.680 --> 39:18.680] Okay, however, there is one other possibility, she leaves her notary stuff in there and they sign it for her [39:18.680 --> 39:20.680] Which means they're forging it [39:20.680 --> 39:23.680] Well, it's a stamp [39:23.680 --> 39:27.680] The signature is a stamp? [39:27.680 --> 39:28.680] Yes [39:28.680 --> 39:30.680] You're positive? [39:30.680 --> 39:34.680] Yeah, it all looks the same, everyone looks exactly the same [39:34.680 --> 39:37.680] Every single one looks exactly the same [39:37.680 --> 39:41.680] Wait a minute, I just... okay [39:41.680 --> 39:47.680] The signature is exactly the same, it's not in exactly the same on all the various documents is what you're talking about [39:47.680 --> 39:49.680] It's not in the same place exactly [39:49.680 --> 39:53.680] That's correct, but the signature itself is exactly the same [39:53.680 --> 40:02.680] Okay, all right, so if they have a stamp with her signature and they're using it, they're committing fraud? [40:02.680 --> 40:06.680] Well, they're also committing forgery [40:06.680 --> 40:19.680] Well, in Texas, that's fraud, but it's one other thing, tampering with a governmental record or falsifying a governmental record, both of which are felonies [40:19.680 --> 40:34.680] Right, so anyways, I sent off a public information request to her for a copy of her notary law book or a record book which is required by law to keep [40:34.680 --> 40:44.680] And she failed to respond and I called her up and she immediately put me in touch with her lieutenant in charge of records and he said, well, she doesn't have to keep a record book [40:44.680 --> 40:49.680] They'd be in line all day if she had to stand there and sign each person in [40:49.680 --> 40:52.680] They'd be in line all day long, he said, that's the way we've done it for 25 years [40:52.680 --> 40:59.680] Well, that's wrong, under Texas law, that notary has to make entries in that book [40:59.680 --> 41:09.680] Yeah, and he says, well, I don't understand it, really, he says, and we gave it to the county attorney, they don't understand it, we gave it to the DA, they don't understand it [41:09.680 --> 41:14.680] We sent it to the judge's house, they don't understand it, he said, but we called the Texas notary [41:14.680 --> 41:19.680] And he says, there's no exemption, they have to keep a notary in the law book [41:19.680 --> 41:20.680] Right [41:20.680 --> 41:23.680] He says, I think we're going to have to start doing something different around here [41:23.680 --> 41:27.680] Yeah, like grow a brain [41:27.680 --> 41:39.680] And so I got all her surety bond information and I'm preparing, I've also prepared a complaint for the attorney or the secretary of state [41:39.680 --> 41:48.680] And I'm preparing to file stuff against her bond, I don't know, that's another question I had for you, what, how should I attack the bond? [41:48.680 --> 41:53.680] Is there some special procedures because I'm having a difficult time finding information on that [41:53.680 --> 42:08.680] You can file criminal charges against her with the AG or the secretary of state's office for violating her oath under the, to be a notary, because those violations are very serious for notaries [42:08.680 --> 42:15.680] So you can get her fired from that, potentially even criminally charged for that [42:15.680 --> 42:19.680] Well, I think they can just take away her notary [42:19.680 --> 42:25.680] Yeah, they can do that, but it isn't going to invalidate anything she signed up to that point [42:25.680 --> 42:31.680] Unless, of course, you can prove that it was done fraudulently to begin with [42:31.680 --> 42:39.680] And the thing is, if she left, she wouldn't be in any real trouble if she didn't know they were using her stamp [42:39.680 --> 42:49.680] But if she knows for a fact that they were using her stamp in her absence for those documents and she played along, that's conspiracy [42:49.680 --> 42:53.680] That's organized criminal activity in Texas [42:53.680 --> 42:58.680] I agree, and I know she did, but, you know, I'm trying to figure out a way to prove it now [42:58.680 --> 43:07.680] I'm preparing to file criminal charges against the officer, the deputy constable [43:07.680 --> 43:15.680] Randy had said maybe he had filed in a Tarrant County against a Dallas County official [43:15.680 --> 43:20.680] And the DA is up to their neck in this, so I'm worried about going into Harris County [43:20.680 --> 43:25.680] I'm thinking about just filing this with the grand jury in Montgomery County [43:25.680 --> 43:28.680] I'm not quite sure how to proceed on this [43:28.680 --> 43:35.680] I'm taking my time because I want to try to get everything as correct as possible before I jump into this [43:35.680 --> 43:38.680] Okay? [47:52.680 --> 47:58.680] You can do that, but again, without actual facts and evidence, what are you going to tell them? [47:58.680 --> 48:03.680] That's the problem. You can make a complaint, but you don't have anything to actually make them do anything with it [48:03.680 --> 48:11.680] While they are authorized to initiate investigations, they very rarely do [48:11.680 --> 48:19.680] So if you go in there without any evidence to back up whatever you're complaining of, odds are it's not going to do you any good [48:19.680 --> 48:30.680] And the problem is, if you go out collecting evidence to be used for that purpose, now you're in violation of the law by acting as a private investigator [48:30.680 --> 48:36.680] Unless everything that you're getting comes directly from public records [48:36.680 --> 48:43.680] Yeah, what I have right now, it comes directly from a public information request [48:43.680 --> 48:50.680] All the documents I have is from a public information request, so what you're saying is I can't go and question her [48:50.680 --> 48:53.680] That's correct [48:53.680 --> 48:55.680] Okay [48:55.680 --> 49:00.680] That's what you intend to do with the information [49:00.680 --> 49:05.680] Okay, yeah. I will certainly keep you up to date on it [49:46.680 --> 49:55.680] But everything that you were talking about in your opening sequence is exactly how it played out in this case [49:55.680 --> 50:01.680] When I got in there with the prosecutor and the judge, just when I made my first appearance there [50:01.680 --> 50:10.680] I wasn't even in the courtroom, it was in an ante room, and I was just going in to file documents with the prosecutor [50:10.680 --> 50:17.680] And not even thinking I was going to enter a plea, and then she started saying, how do you plead? [50:17.680 --> 50:22.680] And I said, well, I don't know how to plead. I don't know what the charges are. I've seen no charging instrument [50:22.680 --> 50:25.680] Well, there's a citation, well, that's not a charging instrument [50:25.680 --> 50:31.680] Well, that is your legal conclusion is what the judge said. He had me be sitting in there [50:31.680 --> 50:38.680] And he said, go ahead and file a plea not guilty for him [50:38.680 --> 50:42.680] And you should have objected to that, objection. I haven't refused to enter a plea [50:42.680 --> 50:47.680] I haven't been served with anything that would give me proper notice to make a plea [50:47.680 --> 50:57.680] I did tell him that. I did say that. I said, this is, of course, not even in session [50:57.680 --> 51:01.680] Well, file a motion to recuse and disqualify [51:01.680 --> 51:05.680] Well, it's already done. I mean, the case has been dismissed [51:05.680 --> 51:08.680] Well, then file a judicial conduct complaint [51:08.680 --> 51:18.680] Yeah, I've been planning on doing that. I don't think, is there a statute of limitations under this? This occurred back in October [51:18.680 --> 51:19.680] Two years? [51:19.680 --> 51:23.680] Stuff with the judge. [52:19.680 --> 52:28.680] Because they are being taught by the instructors how to circumvent what's in the training materials [52:28.680 --> 52:34.680] And make it look legitimate. [54:54.680 --> 54:56.680] Well, that's the thing [54:56.680 --> 55:03.680] What it sounds to me like she's doing is running interference on the grand jury [55:03.680 --> 55:08.680] You give her the complaint, it never sees the light of day again [55:08.680 --> 55:13.680] However, when you do this, inform her of one little thing [55:13.680 --> 55:18.680] You are aware of A, the grand jury keeps minutes [55:18.680 --> 55:28.680] You are aware that B, the clerk of the court is responsible for providing those minutes available or making them available to the public [55:28.680 --> 55:36.680] C, you know how to read what was brought up at the grand jury session in those minutes [55:36.680 --> 55:42.680] And D, you're going to check and see if your complaint ever went in front of them [55:42.680 --> 55:52.680] And if your complaint didn't, E, I'll be back to press new charges directly with the grand jury on you [55:52.680 --> 55:54.680] Okay, okay [55:54.680 --> 55:58.680] That answers questions I was working on and hadn't formulated yet [55:58.680 --> 55:59.680] Okay [55:59.680 --> 56:06.680] Now, can you compare this, what I just told you, with going to the Department of Justice? appointed three months before he contacted me [01:04:02.680 --> 01:04:09.680] Whenever I did talk to him that time, he told me that there was no way that he believed I could lose the case [01:04:09.680 --> 01:04:13.680] Failure to identify, unless the jury did not go with the law [01:04:13.680 --> 01:04:19.680] So I'm thinking, well, it's that obvious that they don't have a case [01:04:19.680 --> 01:04:21.680] And is he trying to get me to drop the jury? [01:04:21.680 --> 01:04:23.680] A couple of things came up [01:04:23.680 --> 01:04:29.680] I heard you say something about the jury could lower the fine from like, say, $500 to $20 [01:04:29.680 --> 01:04:32.680] And find you guilty and deprive you the right of an appeal [01:04:32.680 --> 01:04:34.680] So I got to thinking about that [01:04:34.680 --> 01:04:36.680] I got to thinking, well, if I get the judge... [01:04:36.680 --> 01:04:37.680] Well, now, wait a minute [01:04:37.680 --> 01:04:42.680] What your attorney said, if what you told me is accurate, is not at all what you're thinking [01:04:42.680 --> 01:04:44.680] He's not trying to get you to get rid of anything [01:04:44.680 --> 01:04:50.680] He is telling you that as long as the jury understands what the law specifically requires [01:04:50.680 --> 01:04:56.680] For the failure to identify to occur, you can't lose [01:04:56.680 --> 01:05:01.680] The problem is whether or not someone can make them understand that [01:05:01.680 --> 01:05:06.680] So what I'm confused about by your statement as coming out of his mouth [01:05:06.680 --> 01:05:12.680] Is does he think he can do that or not? [01:05:12.680 --> 01:05:15.680] Well, he didn't imply, either which way [01:05:15.680 --> 01:05:16.680] Right [01:05:16.680 --> 01:05:18.680] He didn't say, I can do it or I can't do it [01:05:18.680 --> 01:05:22.680] Or I believe I can do it, but you never know what a jury's going to do [01:05:22.680 --> 01:05:24.680] I don't remember him saying anything along those lines [01:05:24.680 --> 01:05:26.680] Well, he doesn't have to do that [01:05:26.680 --> 01:05:28.680] But normally that's true [01:05:28.680 --> 01:05:30.680] You can't predict what a jury's going to do [01:05:30.680 --> 01:05:32.680] But the fact of the matter is [01:05:32.680 --> 01:05:36.680] As if the attorney presents the case or even the defendant presents the case [01:05:36.680 --> 01:05:38.680] It shows very clearly by getting the officer to testify [01:05:38.680 --> 01:05:46.680] Officer, did you ever inform me that I was under arrest for anything? [01:05:46.680 --> 01:05:47.680] No [01:05:47.680 --> 01:05:55.680] In fact, you told me that I was in an investigative detention and not a custodial arrest, didn't you? [01:05:55.680 --> 01:05:58.680] Yes [01:05:58.680 --> 01:06:04.680] Then can you please explain to me how that is consistent with the statute [01:06:04.680 --> 01:06:10.680] 3802, Code of Criminal Procedure for Failure to Identify [01:06:10.680 --> 01:06:15.680] Where the statute clearly requires that in order for me to commit the act [01:06:15.680 --> 01:06:20.680] You had to have already arrested me for some other offense [01:06:20.680 --> 01:06:27.680] And at that point, I refused to divulge my name, address, and date of birth [01:06:27.680 --> 01:06:31.680] You testified that you never arrested me until after the fact [01:06:31.680 --> 01:06:37.680] And then you charged me solely with failure to identify and nothing else [01:06:37.680 --> 01:06:38.680] Correct [01:06:38.680 --> 01:06:42.680] Now, even then, the jury doesn't need to make that decision [01:06:42.680 --> 01:06:49.680] Because if the prosecutor cannot rebut that and show that that isn't how it happened [01:06:49.680 --> 01:06:53.680] Then all you have to do is move for a directed verdict from the judge [01:06:53.680 --> 01:06:56.680] Because the state can't prove the elements of the case [01:06:56.680 --> 01:07:01.680] The officer testified the facts that they need didn't happen [01:07:01.680 --> 01:07:06.680] Okay, yeah, I've heard this before, but you're putting it in perspective [01:07:06.680 --> 01:07:09.680] So now I can focus on it better [01:07:09.680 --> 01:07:13.680] At the time, the attorney said that I responded with [01:07:13.680 --> 01:07:23.680] Well, aren't that what appeals courts are for is to review the law and not the facts [01:07:23.680 --> 01:07:25.680] You know, appeal courts are [01:07:25.680 --> 01:07:31.680] No, the appeals courts' job is to apply the law to the facts [01:07:31.680 --> 01:07:34.680] Right, right, but they don't overview the facts because they're not the trier fact [01:07:34.680 --> 01:07:36.680] They're not there firsthand [01:07:36.680 --> 01:07:38.680] I've read that somewhere before [01:07:38.680 --> 01:07:41.680] Okay, all right, well, that's great, that's great, that clarifies that [01:07:41.680 --> 01:07:45.680] Now, we were talking about this prosecutor a few minutes ago [01:07:45.680 --> 01:07:50.680] And I filed a bar grievance on her because [01:07:50.680 --> 01:07:52.680] Let me look at the rule number here [01:07:52.680 --> 01:07:58.680] Rule, this is [01:07:58.680 --> 01:08:02.680] This is disciplinary rules, rule number 3.09 [01:08:02.680 --> 01:08:10.680] A prosecutor cannot threaten or proceed to prosecute a case that they do not believe they can win [01:08:10.680 --> 01:08:14.680] Now, if my attorney says there's no way they've got the evading arrest [01:08:14.680 --> 01:08:20.680] Because that came with the defendant to identify, evading arrest with a watercraft or a vehicle [01:08:20.680 --> 01:08:24.680] He said there's no way they've dropped that, but I haven't gotten anything saying they've dropped it [01:08:24.680 --> 01:08:28.680] He's not an attorney for that case, he's the attorney for the failure to identify [01:08:28.680 --> 01:08:31.680] So they're proceeding on the failure to identify [01:08:31.680 --> 01:08:37.680] My attorney that has only talked to me once all of a sudden called me again [01:08:37.680 --> 01:08:40.680] Actually emailed me, I emailed him [01:08:40.680 --> 01:08:44.680] But anyway, he got in touch with me because I went to file criminal charges [01:08:44.680 --> 01:08:47.680] See, he's playing backfield for these guys [01:08:47.680 --> 01:08:50.680] So I get to hear from him a second time [01:08:50.680 --> 01:08:57.680] And he spent the last three months trying to negotiate a dismissal in my failure to identify [01:08:57.680 --> 01:09:01.680] And he's gotten nowhere, so now he's going to file the motion [01:09:01.680 --> 01:09:03.680] Well, I'm too late, too late [01:09:03.680 --> 01:09:06.680] I've already done a motion to relegate you to second chair [01:09:06.680 --> 01:09:09.680] And then later in the week I filed a grievance on him [01:09:09.680 --> 01:09:12.680] And he says, well, I'm going to withdraw if that's the way you feel about it [01:09:12.680 --> 01:09:16.680] So I emailed him back and I said, well, okay, if that's what you want to do, go ahead [01:09:16.680 --> 01:09:19.680] But in the meantime, here's a list of things you've got to do for them [01:09:19.680 --> 01:09:21.680] No, no, no, wait, wait, wait, wait, stop [01:09:21.680 --> 01:09:29.680] Do not ever let those words pass your lips in relation to a prosecuting attorney you've already gotten second chair [01:09:29.680 --> 01:09:36.680] Don't ever act like you're even considering giving consent for them to depart the case [01:09:36.680 --> 01:09:39.680] Oh, actually I didn't, I was just making a story [01:09:39.680 --> 01:09:44.680] No, no, no, no, when you say you go right ahead, yes, you are [01:09:44.680 --> 01:09:51.680] Even if you don't mean it, the implication of the words is there [01:09:51.680 --> 01:09:52.680] Okay [01:09:52.680 --> 01:10:01.680] The proper response is if you make any attempt to withdraw from this case, I will file another bar grievance against you [01:10:01.680 --> 01:10:10.680] And I will move the court for sanctions because you refuse to act in the capacity to which you remember hearing him say, was that his attorney or someone's attorney was threatened to withdraw [01:10:24.680 --> 01:10:30.680] And the judge either was going to grant the motion or had to grant the motion [01:10:30.680 --> 01:10:39.680] And Randy said something about charging, no, telling the judge that he would sue the judge for life [01:10:39.680 --> 01:10:47.680] But purchase interference with a contract because he was the third-party beneficiary of the contract between the state and court appointed attorney [01:10:47.680 --> 01:10:50.680] Yeah, well, I don't know how well that would work [01:10:50.680 --> 01:10:54.680] It's something to try, but I don't know that it's going to work [01:10:54.680 --> 01:10:59.680] I have plans to call Randy and see if that ever, if he actually did that and how it worked [01:10:59.680 --> 01:11:05.680] No, he's not getting out on anything, not easily anyway, no, okay [01:11:05.680 --> 01:11:17.680] Well, so there I was talking about the prosecutor filing this grievance on her for continuing with the evading to arrest and prosecuting me on the defense to identify [01:11:17.680 --> 01:11:25.680] So I don't know how well she's going to want to help me with this criminal charge when she finds out I did a bar grievance on her [01:11:25.680 --> 01:11:31.680] Because I just mailed her bar grievance Friday [01:11:31.680 --> 01:11:38.680] Well, she won't know right away because they're not allowed to tell the attorneys a bar grievance has been filed on them [01:11:38.680 --> 01:11:41.680] Right, I understood it took 10 days to 2 weeks or something like that [01:11:41.680 --> 01:11:51.680] But hey, she's asked for it, she was real nice on the phone today and come to find out this is kind of in the political field that Randy talks a lot about [01:11:51.680 --> 01:11:58.680] This prosecutor had the sheriff arrested a year and a half ago [01:11:58.680 --> 01:11:59.680] For what? [01:11:59.680 --> 01:12:03.680] For making terroristic threats [01:12:03.680 --> 01:12:14.680] He was arrested, oh, wait a minute, it wasn't a year ago, it was approximately a year ago, he was arrested the same week that I was arrested [01:12:14.680 --> 01:12:19.680] That's why he was not at the scene of me being arrested [01:12:19.680 --> 01:12:27.680] There was five other officers besides the arresting officer but the sheriff wasn't there because he had been arrested, he was relieved of his duties [01:12:27.680 --> 01:12:32.680] But anyway, he was acquitted in March of this year of making terroristic threats [01:12:32.680 --> 01:12:40.680] Now I knew there was a little something going on there but I got a few more pieces, a few more blanks filled in today [01:12:40.680 --> 01:12:45.680] So apparently the prosecutor and the sheriff do not see eye to eye [01:12:45.680 --> 01:12:50.680] But hey, you would think that that would mean something [01:12:50.680 --> 01:12:56.680] But in my case it's not because why are they going for this failure to identify when the complaint says right on it? Is a judge responsible? [01:50:20.680 --> 01:50:24.680] Began, started, initiated [01:50:24.680 --> 01:50:26.680] That's what it means [01:50:26.680 --> 01:50:28.680] And like I said before [01:50:28.680 --> 01:50:30.680] That's true in the county court [01:50:30.680 --> 01:50:32.680] That's true in the JP court [01:50:32.680 --> 01:50:36.680] That's true in a civil case not just a criminal case [01:50:36.680 --> 01:50:42.680] No cause is initiated, commenced, began, started [01:50:42.680 --> 01:50:46.680] Put into motion however you want to word it [01:50:46.680 --> 01:50:55.680] No case begins until a complaint of some kind has been filed [01:50:55.680 --> 01:51:02.680] Whether it be a civil complaint for a lawsuit or a criminal complaint for a criminal act [01:51:02.680 --> 01:51:06.680] That's what begins the process [01:51:06.680 --> 01:51:14.680] But that is not what invests the court with jurisdiction at all [01:51:14.680 --> 01:51:21.680] Now the plaintiff filing the cause is required to state why a particular court has jurisdiction [01:51:21.680 --> 01:51:24.680] That's not being done in these criminal cases [01:51:24.680 --> 01:51:31.680] Not being done at all because the prosecution, the plaintiff, the state is not filing any paperwork in these cases whatsoever [01:51:31.680 --> 01:51:33.680] Not even the complaint [01:51:33.680 --> 01:51:35.680] Because they can't file the complaint [01:51:35.680 --> 01:51:38.680] But they're not doing anything else either [01:51:38.680 --> 01:51:47.680] So here is our first step in the irrebuttable presumption that is used against you in these courts [01:51:47.680 --> 01:51:54.680] The jurisdiction of the court is assumed rather than proven [01:51:54.680 --> 01:51:59.680] There's nothing in the record invoking the jurisdiction of that court [01:51:59.680 --> 01:52:01.680] Nothing [01:52:01.680 --> 01:52:04.680] The complaint doesn't do it [01:52:04.680 --> 01:52:10.680] Not under the Constitution, not under statute, not under common frickin' sense [01:52:10.680 --> 01:52:14.680] It can't do it [01:52:14.680 --> 01:52:19.680] So what does? The only thing that can is an indictment or information [01:52:19.680 --> 01:52:30.680] And under 2.04 and 2.05, that can only happen when it's presented to a county or district attorney [01:52:30.680 --> 01:52:45.680] Okay? Now in misdemeanor cases, no information is actually demanded in that case by statute [01:52:45.680 --> 01:52:56.680] But the problem is Article 5, Section 12b still requires that one be created constitutionally whether the statute does or not [01:52:56.680 --> 01:53:06.680] Because it says one of those two things, an indictment or information, is the only thing that there is investing a court with jurisdiction of a cause [01:53:06.680 --> 01:53:19.680] And nowhere in the Texas Constitution does it say that the legislature may create other charging instruments and utilize them as defined by law [01:53:19.680 --> 01:53:34.680] The limits of that authority is specifically stated in the Constitution to be the legislature may assign the form and usage of indictments and information by law [01:53:34.680 --> 01:53:37.680] But it still says indictments or information [01:53:37.680 --> 01:53:47.680] It doesn't say indictments, information, or any other charging instrument created and controlled by law [01:53:47.680 --> 01:53:57.680] So common sense says the courts are doing exactly what they're not supposed to do, both in statutory and constitutional interpretation [01:53:57.680 --> 01:54:05.680] By adding stuff that isn't there, by creating exceptions that don't exist in the language [01:54:05.680 --> 01:54:20.680] By doing every single thing they're not supposed to do in violation of Article 1, Section 29, which says any law or any act by government that violates the Bill of Rights [01:54:20.680 --> 01:54:25.680] Or any other provision of the Texas Constitution is void [01:54:25.680 --> 01:54:32.680] It's not enforceable, it's not anything, it's as if it never existed [01:54:32.680 --> 01:54:45.680] So now what? Well, this brings us down to one other issue which nullifies the whole argument on every point from the get-go [01:54:45.680 --> 01:54:54.680] The unconstitutional recodification and reenactment of existing law [01:54:54.680 --> 01:55:04.680] The Texas Constitution forbids the legislature from amending or changing original acts by amendment [01:55:04.680 --> 01:55:14.680] In other words, they cannot change the subject matter of any act through the process of amendment [01:55:14.680 --> 01:55:24.680] It must conform to the original underlying law, or it is void, it is invalid [01:55:24.680 --> 01:55:29.680] Well, we've talked about the Emergency Clause numerous times [01:55:29.680 --> 01:55:52.680] Every single code that currently exists in Texas is a statutory rewrite and a statutory recodification, all of which appear to have been passed using the exact same fraudulent, fictitious, unconstitutional Emergency Clause statement [01:55:52.680 --> 01:56:02.680] The crowded condition of the calendars of each house creates a case of impending public necessity [01:56:02.680 --> 01:56:09.680] And therefore, the reading on the floor of each house and all these other rules is hereby suspended [01:56:09.680 --> 01:56:12.680] Problem!
