[01:17.000 --> 01:22.000] Catherine Forrest, the judge in the case, gave Ross a sentence beyond what even the prosecution had requested. [01:22.000 --> 01:25.000] The minimum he could have gotten was 20 years. She instead gave him life. [01:25.000 --> 01:29.000] Ross was also ordered to pay massive fines of over $183 million, [01:29.000 --> 01:33.000] what the prosecution had estimated to be the total sales of illegal drugs and counterfeit IDs [01:33.000 --> 01:38.000] through the Silk Road at a certain Bitcoin exchange rate over the course of its time online. [01:38.000 --> 01:43.000] Any revenue from the government's sale of the Bitcoin seized from Silk Road and Ulbricht's laptop [01:43.000 --> 01:47.000] will be applied to that debt. Ross's supporters, family, as well as anonymity [01:47.000 --> 01:54.000] and property rights advocates will be pushing for retrial. [01:54.000 --> 01:57.000] ABC News was the first to report on an internal investigation [01:57.000 --> 02:00.000] conducted by the Transportation Security Administration's Red Teams, [02:00.000 --> 02:05.000] who pose as passengers, which revealed security failures at dozens of the nation's busiest airports. [04:53.000 --> 05:02.000] We are now approaching the halfway mark of this new year with not so new problems and issues [05:02.000 --> 05:05.000] that have been following us around for decades. [05:05.000 --> 05:11.000] Now, one of those, however, I'm going to give you a slam dunk way to fix tonight. [05:11.000 --> 05:19.000] And one of those issues is the red light camera situation here in Texas. [05:19.000 --> 05:27.000] Now, I can't believe that I hadn't thought to check on this before, but I came across a video [05:27.000 --> 05:37.000] where Senator Nichols, down here at the Texas Legislature, is conducting a transportation committee hearing [05:37.000 --> 05:40.000] about the red light cameras. [05:40.000 --> 05:46.000] And you can go on YouTube and you can do Texas Senator Lam Bass Cops on red light cameras. [05:46.000 --> 05:52.000] And pull that video up and watch it. It's very short. It's like a minute and eight seconds. [05:52.000 --> 05:56.000] It's very short, but it's very, very telling. [05:56.000 --> 06:05.000] Anyhow, I took it upon myself, based upon what was in that video, to go spend the afternoon [06:05.000 --> 06:14.000] researching the statutes on the red light cameras, and I'll be danged if what's in the video is not 100% correct. [06:14.000 --> 06:25.000] And what it is correct about is the fact that there is absolutely no authority in that entire chapter [06:25.000 --> 06:35.000] for municipalities to issue citations based upon red light camera violations. [06:35.000 --> 06:44.000] There is no authority to issue the citation. There is no authority to assess a fine directly [06:44.000 --> 06:50.000] or to demand payment of that fine through the citation process. [06:50.000 --> 07:03.000] Instead, it specifically states that any violation must be done as either a civil or administrative penalty. [07:03.000 --> 07:10.000] Now, the only way the administrative penalty could be applied is if we work for the city, [07:10.000 --> 07:17.000] we're contracted with the city, and by that contract or employment, we are obligated to abide by that [07:17.000 --> 07:24.000] while we're using city property or other government property and running a red light. [07:24.000 --> 07:31.000] The civil process is the only one by which they can assess a fine against we the people. [07:31.000 --> 07:40.000] And any time that fine exceeds $20, we have the right to a jury trial. [07:40.000 --> 07:46.000] That is protected in the Seventh Amendment to the United States Constitution. [07:46.000 --> 07:56.000] Any case at common law in excess of $20, the right to trial by jury shall be preserved. [07:56.000 --> 08:03.000] Now, what I want to do is I want to read you the rewrite I did on the Texas only at this time, [08:03.000 --> 08:09.000] unless you want to check your state statutes and see if it works exactly the same way there as it does here, [08:09.000 --> 08:11.000] then you can adapt the letter accordingly. [08:11.000 --> 08:17.000] But for the interim, to my knowledge, the only state that can use the second version of this, [08:17.000 --> 08:22.000] and it says this specifically for Texas, is Texas. [08:22.000 --> 08:26.000] Now, what I want to do is just read to you the brunt of what's in this [08:26.000 --> 08:30.000] in the challenge to jurisdiction and citation section. [08:30.000 --> 08:38.000] On or about whatever date, a letter arrived at my address via the United States Postal Service claiming to be a citation [08:38.000 --> 08:42.000] and stating that either by direct action or reason of ownership, [08:42.000 --> 08:47.000] I had allegedly committed some violation of a red light camera enforcement law [08:47.000 --> 08:53.000] within the city of whatever Texas on the alleged date of whatever. [08:53.000 --> 08:55.000] Okay? [08:55.000 --> 09:01.000] Now, be it known that I am aware, as you should and are deemed to also be, [09:01.000 --> 09:10.000] of the fact that Chapter 707 of the Texas Transportation Code does not in any way or manner whatsoever [09:10.000 --> 09:18.000] authorize a municipality to issue a citation and demand a payment in place of [09:18.000 --> 09:24.000] or in conjunction with a red light camera notice or attempt to forcefully or coercively [09:24.000 --> 09:34.000] or coercive collection for a citation issued without any authority of law. [09:34.000 --> 09:35.000] Let's see. [09:35.000 --> 09:41.000] Therefore, I shall proceed with the mutual understanding that you are fully aware that all of your current and future actions [09:41.000 --> 09:48.000] in this matter shall be knowing and willfully done under color of law rather than any actual lawful authority. [09:48.000 --> 09:55.000] And you are admonished to be aware that you are proceeding at your own risk of being held personally liable for these actions. [09:55.000 --> 10:05.000] It can be plainly seen in Section 707.007 Transportation Code that the only actions authorized against anyone [10:05.000 --> 10:10.000] for a red light camera enforcement action is a civil or administrative penalty. [10:10.000 --> 10:15.000] There is no mention of the issuance of a citation for any purpose whatsoever. [10:15.000 --> 10:22.000] And if it can even be said that anything therein could lawfully be applied at all to any member of the public, [10:22.000 --> 10:29.000] it could only be the civil penalty, not the administrative, as the people have a fundamental right to do process [10:29.000 --> 10:33.000] which is not available to them under administrative proceedings and sanctions. [10:33.000 --> 10:39.000] Nor are they employed by or contracted with the corporate municipality in any manner [10:39.000 --> 10:45.000] or to any degree requiring them to comply with the internal policies and procedures thereof. [10:45.000 --> 10:49.000] This is readily demonstrable by watching the linked video. [10:49.000 --> 10:53.000] In the video, Senator Robert Nichols of Texas is seen conducting a legislative hearing [10:53.000 --> 10:59.000] in which he can be seen discussing this very issue with a panel of law enforcement and municipal personnel [10:59.000 --> 11:05.000] advocating the unconstitutional continued use of red light cameras. [11:05.000 --> 11:11.000] In that video, Senator Nichols specifically asked the three law enforcement members of the panel [11:11.000 --> 11:21.000] if they could point to the statute that authorizes a municipality to issue a citation in relation to an alleged red light camera violation. [11:21.000 --> 11:27.000] Not a single member of that panel, including those in law enforcement, could identify the statute [11:27.000 --> 11:33.000] that authorized this abuse of power and authority in violation of and under cover of law. [11:33.000 --> 11:38.000] And that is because there is no such provision in statute. [11:38.000 --> 11:41.000] I then put in a link to the video. [11:41.000 --> 11:48.000] Therefore, there is absolutely no jurisdiction whatsoever that is or can be invested in any Texas court [11:48.000 --> 11:55.000] to hear any cause based upon such citation, nor can the citation be the sole supporting basis [11:55.000 --> 11:59.000] for any form of civil action or criminal complaint against me. [11:59.000 --> 12:06.000] Let me be absolutely clear, the Texas legislature has granted no statutory authority of any kind [12:06.000 --> 12:13.000] to any municipality and agency thereof or to any out-of-state third-party contract vendor [12:13.000 --> 12:19.000] to issue a citation in relation to an alleged red light camera violation. [12:19.000 --> 12:25.000] As a matter of law, in any civil case at common law where the value at issue is greater than $20, [12:25.000 --> 12:28.000] the right of trial by jury is protected and preserved. [12:28.000 --> 12:31.000] I then have the constitutional amendment in there. [12:31.000 --> 12:37.000] In suits at common law where the value and controversy shall exceed $20, the right of trial by jury shall be preserved, [12:37.000 --> 12:42.000] and no fact tried by a jury shall be otherwise re-examined in any court of the United States [12:42.000 --> 12:45.000] then according to the rules of the common law. [12:45.000 --> 12:51.000] Therefore, enforcement of any such civil penalty first requires the right of due process in the form [12:51.000 --> 12:59.000] of an actual civil trial before a proper jury, just like any other civil suit must endure prior to a lawful and valid judgment. [12:59.000 --> 13:08.000] Such proceedings cannot be convened or presided over by anyone other than an actual judge of the judicial department of government, [13:08.000 --> 13:15.000] not a law enforcement officer or his agency, the same as in any other such case. [13:15.000 --> 13:19.000] To do otherwise would constitute a violation of the Separation of Powers Clause [13:19.000 --> 13:23.000] found in Article 2 of the Constitution for the State of Texas. [13:23.000 --> 13:30.000] Furthermore, the people are not a part of the corporate municipality for the purpose of being subjected to its administrative rules [13:30.000 --> 13:34.000] and regulations, as those are internally applicable only. [13:34.000 --> 13:40.000] Therefore, lawfully speaking, an administrative penalty can only be applied to one who is employed by [13:40.000 --> 13:46.000] or contracted with the corporate municipality itself, and by which employment or contractual agreement [13:46.000 --> 13:49.000] they are bound to comply with such rules and regulations, [13:49.000 --> 13:55.000] neither of which to my personal knowledge and understanding applies to either myself as one of the people [13:55.000 --> 13:58.000] or to any other member of the general public. [13:58.000 --> 14:06.000] There are simply no crimes defined against the public by which you or your employer may lawfully issue a citation [14:06.000 --> 14:12.000] for the purpose of demanding a revenue payment as you attempt to do in any other traffic citation matter. [14:12.000 --> 14:20.000] In fact, the only crimes defined by Chapter 707 are relative to the activities and actions of the personnel [14:20.000 --> 14:26.000] operating those cameras, not the general public or any individual member thereof. [14:26.000 --> 14:34.000] Therefore, you should already be aware and knowledgeable of the fact that by simple issuance of this fraudulent citation, [14:34.000 --> 14:39.000] your actions constitute a Class A misdemeanor criminal act under Texas statute. [14:39.000 --> 14:45.000] To wit, Texas Penal Code 32.48 simulating legal process. [14:45.000 --> 14:53.000] As I firmly believe that the citation is a printed document under the provisions of Section 32.48 Penal Code, [14:53.000 --> 14:59.000] it is my belief and understanding that your knowing and willful purpose in the issuance of this citation [14:59.000 --> 15:08.000] is to recklessly cause to be delivered to me a document that simulates a complaint or other court process [15:08.000 --> 15:16.000] with the intent of inducing a payment of claim as made by you or your employer in the form of the citation, [15:16.000 --> 15:25.000] as well as to cause me to submit to the punitive authority of the document and to take some action in response to the document, [15:25.000 --> 15:29.000] in compliance with the document, or on the basis of the document. [15:29.000 --> 15:35.000] And just in case you didn't realize it, folks, those are the specific elements required to commit a violation [15:35.000 --> 15:39.000] of 32.48 Penal Code simulating legal process. [15:39.000 --> 15:42.000] So I covered each of those points in the letter. [15:42.000 --> 15:45.000] Since I've got just a little bit over a minute before we go to break, [15:45.000 --> 15:50.000] I'm going to read just another paragraph and then we'll go to break and I'll finish it on the other side. [15:50.000 --> 15:53.000] It's only got a little bit left. [15:53.000 --> 15:54.000] Now be honest. [15:54.000 --> 16:00.000] That is your intended purpose in printing and mailing the citation, is it not? [16:00.000 --> 16:07.000] Therefore, I hereby inform you that it is my stated intention to file a criminal complaint against you personally [16:07.000 --> 16:13.000] and any other personnel involved in the process of issuing these unlawful and illegal citations, [16:13.000 --> 16:20.000] as I have reason to believe and do believe that these actions are knowingly and willfully perpetrated under color of law [16:20.000 --> 16:25.000] and in direct violation of Section 32.48 Penal Code. [16:25.000 --> 16:26.000] All right, folks. [16:26.000 --> 16:31.000] I'll finish up with the last page after we get back from this upcoming break, which is just about to start. [22:35.000 --> 22:40.000] It's the kind of speech that you wish most politicians would understand and adhere to. [22:40.000 --> 22:45.000] Now, whether or not he has done everything he should have done the way he should have done it, [22:45.000 --> 22:51.000] while he's been elected I can't say I haven't followed his career as closely as I did that of his father. [22:51.000 --> 23:03.000] But hopefully he will not fall into the same trench that so many other Johnny-come-lately-want-to-help-everybody politicians do. [23:03.000 --> 23:10.000] It's great to go up there with the intent to help get rid of the things that are destroying this country. [23:10.000 --> 23:16.000] It's another thing entirely to be able to get it done when you're the only one pushing for them. [23:16.000 --> 23:25.000] That being said, what usually happens is those that want to bring the Constitution back into full force and effect [23:25.000 --> 23:34.000] are sorely outnumbered and outgunned both politically and monetarily by those that are selling us out. [23:34.000 --> 23:42.000] And so in order to get any cooperation and traction whatsoever on any type of change for the better, [23:42.000 --> 23:52.000] the newcomers trying to bring us back to order, more or less, or essentially speaking, must compromise. [23:52.000 --> 24:02.000] The problem is is each compromise requires more and more latitude each time it comes around for them to get anything done [24:02.000 --> 24:11.000] until eventually they're doing the same things that the entrenched, indoctrinated, and controlling people already are doing. [24:11.000 --> 24:18.000] They're looking out for themselves, their wealth, their prosperity, but they're not looking out for us. [24:18.000 --> 24:26.000] That is the pitfalls that await any of those that go into politics in America alone [24:26.000 --> 24:33.000] or in numbers so few that they have no mutual support and capability to accomplish much. [24:33.000 --> 24:37.000] We need to understand that as a people. [24:37.000 --> 24:46.000] We need to stop electing if we actually are electing anyone that's ever held public office before. [24:46.000 --> 24:48.000] We just need to stop doing that. [24:48.000 --> 24:52.000] There should be a one-term limit for every politician. [24:52.000 --> 24:58.000] I don't care what his job title. A one-term limit. [24:58.000 --> 25:05.000] Don't let them stay up there so long, then so entrenched, and become so entrenched, [25:05.000 --> 25:11.000] that they control the political playing field just with a wave of their hand. [25:11.000 --> 25:17.000] That is not good for the American people in any way, shape, or form, [25:17.000 --> 25:25.000] but it is what we've had for generation upon generation here in America, and it needs to stop. [25:25.000 --> 25:32.000] So, folks, wake up, smell the BS, because they're certainly throwing enough of it at you. [25:32.000 --> 25:35.000] All right. [26:22.000 --> 26:29.000] Yeah, he's the one that pulled you over, and the infraction is not a crime business, right? [26:29.000 --> 26:41.000] Well, yeah, actually, my cousin was pulled over, but I'm stuck handling the ball because she's off and she's a minor. [26:41.000 --> 26:47.000] So, anyways, her parent wouldn't authorize her to come to court, so I did the motion, [26:47.000 --> 26:52.000] and they didn't really hear the motion, and then they had me go to another – [26:52.000 --> 26:56.000] because I didn't want to do the temporary judge, and then I went to the real judge, [26:56.000 --> 27:02.000] and then he had me wait until after lunch, and he's like, oh, I read the motion, and the motion's denied. [27:02.000 --> 27:05.000] So they basically tried to turn it into an arraignment, [27:05.000 --> 27:14.000] and he said he entered a plea of not guilty on my behalf and waived the $310 on OR, [27:14.000 --> 27:19.000] so they have a court date coming over 45 days for a trial. [27:19.000 --> 27:23.000] So I wanted to find out, like, what can I do? What can be done? [27:23.000 --> 27:29.000] Because if this is illegal, it just seems like they're just proceeding doing whatever they want to do to make sure they get – [27:29.000 --> 27:33.000] Well, that's what the trial court always does. That's what I told you. [27:33.000 --> 27:37.000] If you did go to trial, understand that you don't go to trial to win. [27:37.000 --> 27:43.000] You go to trial to make a record for appeal, and that's what you have to do. [27:43.000 --> 27:52.000] This means that you have to make your argument based upon the case law and everything else about what the officer did [27:52.000 --> 27:55.000] and why he has no authority to do it. [27:55.000 --> 28:00.000] You've got to put that in your written motions, and that's what's got to be argued at trial. [28:00.000 --> 28:09.000] You have to do that by getting the officer to answer questions about the information and why they stopped you, [28:09.000 --> 28:15.000] whether or not it's an infraction versus a crime, and so on and so forth. [28:15.000 --> 28:25.000] Okay, and that was basically in the motion, and I crafted the motion, which was actually reviewed – [28:25.000 --> 28:27.000] Yeah, I understand that's what's in the motion. [28:27.000 --> 28:33.000] Just make sure that that's what you argue at trial, regardless of how they ruled on the motion. [28:33.000 --> 28:38.000] Now, what you have to be real careful of is you have to be careful of the prosecution [28:38.000 --> 28:44.000] attempting to make a motion in Lemony that forbids you to talk about anything that was in the pretrial motions [28:44.000 --> 28:46.000] that were denied. [28:46.000 --> 28:52.000] That is a direct violation of your right to put on a defense. [28:52.000 --> 28:55.000] Now, when you say the prosecution, the trial – [28:55.000 --> 29:03.000] The prosecution will make a motion to the court – it's called a motion in Lemony – that you not be allowed to discuss [29:03.000 --> 29:15.000] or bring up any of the points that are disallowed in the motion when it was denied. [29:15.000 --> 29:22.000] And basically what they're trying to do is to prevent you from arguing any type of defense based upon the law itself, [29:22.000 --> 29:24.000] and they can't do that. [29:24.000 --> 29:27.000] That's a due process violation. [29:27.000 --> 29:35.000] Okay, when you say the prosecution, who are you referring to? Because they have the trial court where it's supposed to be – [29:35.000 --> 29:39.000] Did you ask for a trial by jury or a bench trial? [29:39.000 --> 29:45.000] I asked for a trial by jury. They said that doesn't exist in an infractive case. [29:45.000 --> 29:49.000] Well, that's another problem that you've got to worry about there. [35:08.000 --> 35:15.000] You are there to make an argument and a record for appeal, not to win. [35:15.000 --> 35:20.000] Because they are going to do the same thing to prevent you from winning. [35:20.000 --> 35:24.000] They're going to not play by the rules. [35:24.000 --> 35:25.000] Okay. [35:25.000 --> 35:32.000] Your job is to document every single time they do not play by the rules. [35:38.000 --> 35:44.000] So the fact that I was insisting on a trial by jury, and they're saying no trial by jury exists. [35:44.000 --> 35:46.000] I asked for a different venue. [35:46.000 --> 35:49.000] They said that no, there's no trial by jury in the traffic. [35:49.000 --> 35:50.000] So they had... [35:50.000 --> 35:55.000] Have you talked to Kevin about how that works out there? [35:55.000 --> 35:58.000] I have not. [35:58.000 --> 35:59.000] Okay. [35:59.000 --> 36:04.000] So I just went today, and I was like, let me give him a rest, because I had to call him at court, [36:04.000 --> 36:08.000] because I panicked, because I go in there, and then they want you to sign some waiver [36:08.000 --> 36:11.000] that your case is going to be heard by not a judge. [36:11.000 --> 36:15.000] So I didn't agree to that, and then that's how they had me wait to see the judge. [36:15.000 --> 36:18.000] The judge read the motion, and then he denied the motion. [36:18.000 --> 36:22.000] He entered a not guilty, and I was saying, well, Your Honor, I'm not here for an arraignment. [36:22.000 --> 36:24.000] I'm here for my motion. [36:24.000 --> 36:29.000] Well, your motion's denied, so I'm going to enter a not guilty plea on your behalf. [36:29.000 --> 36:32.000] And then he requested bail, and I said, well, bail for what? [36:32.000 --> 36:33.000] I haven't been charged with any crime. [36:33.000 --> 36:36.000] So I'm following, like, the information you guys are giving me. [36:36.000 --> 36:39.000] Like I said, it's like it's working, but they're, like, slow stepping. [36:39.000 --> 36:42.000] So he's like, well, enter an OR in your own requirements. [36:42.000 --> 36:47.000] And so he sends me down to the clerk, and then they have me sign this arraignment paper, [36:47.000 --> 36:55.000] which is a request for trial, not guilty plea, for July 7th. [36:55.000 --> 36:58.000] Excuse me, July, yeah, July 7th. [36:58.000 --> 37:01.000] Did you sign it? [37:01.000 --> 37:02.000] Yeah. [37:02.000 --> 37:04.000] Why? [37:04.000 --> 37:07.000] It says agreement to appear for trial. [37:07.000 --> 37:09.000] That's kind of not my point. [37:09.000 --> 37:11.000] I don't care what it says. [37:11.000 --> 37:13.000] Why did you sign it? [37:13.000 --> 37:17.000] Because they said that was the only option, and honestly, [37:17.000 --> 37:23.000] my phone was dead after being in there all day from 10 in the morning to 2.30. [37:23.000 --> 37:25.000] Let me ask you this. [37:25.000 --> 37:34.000] What do you think the worst thing that could have happened would have been had you refused to sign it and left? [37:34.000 --> 37:36.000] I have no idea. [37:36.000 --> 37:37.000] I don't know, I guess. [37:37.000 --> 37:38.000] I don't know. [37:38.000 --> 37:39.000] I don't know. [37:39.000 --> 37:45.000] I would have just tacked a bunch of stuff onto my license and blocked my driver's license. [37:45.000 --> 37:50.000] Well, that's not necessarily true because you haven't been convicted of anything. [37:50.000 --> 37:56.000] See, the thing is they're wanting you to enter a plea, but no one's given you an actual complaint. [37:56.000 --> 38:02.000] By entering the plea, you waived your right to challenge whatever complaint they put up there. [38:02.000 --> 38:05.000] But I didn't enter the plea, the judge did. [38:05.000 --> 38:11.000] That's why you should not have signed it. [38:11.000 --> 38:13.000] Do you follow? [38:13.000 --> 38:21.000] Yeah, I follow, but in all the help that Kevin's getting, he didn't mention anything about not signing this thing if they gave me this thing. [38:21.000 --> 38:23.000] Well, you need... [38:23.000 --> 38:25.000] I understand that. [38:25.000 --> 38:29.000] He may not have thought that far ahead with all the other stuff he's got, but... [38:59.000 --> 39:12.000] Okay, so while I understand your frustration, at this stage, I'm not the one to be asking what to do because the what to do, he's going to know a lot better than me. [39:12.000 --> 39:14.000] Right. [39:14.000 --> 39:23.000] Now, the one thing I can tell you is that certain things they do do are universally stupid and unjust and deny due process. [39:23.000 --> 39:27.000] And what you've discussed is one of them. [39:27.000 --> 39:33.000] Okay, by entering a plea on my behalf when I wasn't there for an arraignment, I was there for the motion. [39:33.000 --> 39:35.000] The motion is denied. [39:35.000 --> 39:47.000] So then the judge just steamrolls on and says that they're entering a plea of not guilty on my behalf. [39:47.000 --> 39:51.000] And when that happened, you should have immediately objected. [39:51.000 --> 40:01.000] Anytime they ever tell you they're entering a plea on your behalf and you haven't refused to enter a plea, but all you have to do is ask the court. [40:01.000 --> 40:09.000] Is the court willing to accept an unconscionable plea that will deprive me of my due process rights? [40:09.000 --> 40:12.000] That's all you have to ask him. [40:12.000 --> 40:14.000] And of course, what's he going to say? [40:14.000 --> 40:18.000] Yes. [40:18.000 --> 40:22.000] And if the court will say no, well, we can't do that, well, great. [40:22.000 --> 40:28.000] Then at the moment, because it would be unconscionable of me to do so, I cannot enter a plea. [40:28.000 --> 40:30.000] I'm not refusing. [40:30.000 --> 40:34.000] I'm just saying at the moment, I can't do that. [40:34.000 --> 40:41.000] And the reason for that is is because technically you haven't been given proper service or notice of anything. [40:41.000 --> 40:46.000] There's a lot of things that these states are doing to bypass due process and the rights of the accused. [40:46.000 --> 40:55.000] They're treating it like they can do whatever they want through these administrative processes, pretending they're judicial processes, and they can't. [40:55.000 --> 41:08.000] But those are the things that Kevin will have a lot more information about based upon the California Constitution than what I do because I have not studied the California Constitution in depth. [41:08.000 --> 41:10.000] He has. [41:10.000 --> 41:16.000] Right. [41:16.000 --> 41:17.000] Okay. [41:17.000 --> 41:18.000] So I'm not trying to put you off. [41:18.000 --> 41:28.000] I'm just telling you, I am no longer your best resource when it comes to questions about what they did and why they did it and what you should do next. [47:17.000 --> 47:25.000] And I was telling you that the judge said that he had not entered judgment against me. [47:25.000 --> 47:34.000] And he sent out that there was some, I guess, building receipts [47:34.000 --> 47:38.000] or whatever you want to call them, saying that I owe 400 bucks. [47:38.000 --> 47:45.000] So I filed the motion in saying that I want to motion to correct the record. [47:45.000 --> 47:51.000] So the judge said that he had not entered judgment. [47:51.000 --> 47:55.000] Therefore, he denied my motion to correct the record. [47:55.000 --> 48:01.000] So I was just going back and forth with this judge trying to get him to rule on my pleadings [48:01.000 --> 48:06.000] because he had already stated that he had not entered judgment. [48:06.000 --> 48:12.000] So I filed the motion stating that I wanted to dismissal with prejudice [48:12.000 --> 48:23.000] because basically the tickets that were sent to my house saying that I owed money [48:23.000 --> 48:29.000] were basically like a threat and tampering with me. [48:29.000 --> 48:33.000] And I just kept filing motions. [48:33.000 --> 48:36.000] So he never answered me, never answered me. [48:36.000 --> 48:44.000] So the other day on, I think, Friday, I go to the mailbox and voila. [48:44.000 --> 48:54.000] There is the court envelope saying, oh, this is my judgment on the whole matter. [48:54.000 --> 49:00.000] So this is the second judgment against me that I have in this matter. [49:00.000 --> 49:07.000] And the opinion that he put together, relevant facts, this discussion and decision, [49:07.000 --> 49:15.000] I was cited for not having a seat or they said they pulled me over for not having a seat belt. [49:15.000 --> 49:26.000] However, they wrote me for not providing insurance and I had an equipment violation. [49:26.000 --> 49:36.000] So basically what was going on with this case is I was trying to get the judge to dismiss it [49:36.000 --> 49:42.000] because he had already ruled once and he sent me a letter in the mail. [49:42.000 --> 49:46.000] This is the second time this judge has actually contacted me. [01:34:52.000 --> 01:35:06.000] Well, it turns out that there is no authority in Chapter 707 of the Transportation Code for any municipality or police agency to issue a citation in relation to a red light camera violation. [01:35:06.000 --> 01:35:09.000] It is absolutely illegal. [01:35:09.000 --> 01:35:19.000] It is illegal to the tune of committing an actual crime under 38.42 Penal Code, which is simulation of legal process. [01:35:19.000 --> 01:35:29.000] So they're actually committing a Class A misdemeanor by issuing that red light camera citation and sending it to you and demanding a payment of money. [01:35:29.000 --> 01:35:31.000] Well, how do you confirm on that? [01:35:31.000 --> 01:35:36.000] That's what the red light camera ticket does or the red light camera letter does. [01:35:36.000 --> 01:35:44.000] When you send that to them and they then proceed against you, they have now been fully made aware of what they were doing. [01:35:44.000 --> 01:35:47.000] They knew they were doing it anyway. That's a crime. [01:35:47.000 --> 01:35:54.000] Now you can sue them, and they have no immunity for it because they were acting entirely outside of any lawful authority. [01:35:58.000 --> 01:36:17.000] They cannot claim any sort of, let's see, immunity, qualified immunity because they were not operating on any statutory basis that allowed them to make a decision one way or the other on how to act, and then they got sued accordingly. [01:41:54.000 --> 01:42:02.000] I got her to recuse herself or to leave me alone, give me a new judge, and that's all I needed, and I got the dismissal. [01:42:10.000 --> 01:42:20.000] And he actually introduced them to the VA like, wait a minute, uh-oh, but he still didn't give me a dismissal until I showed the VA enough evidence [01:42:20.000 --> 01:42:32.000] and proved to him that the cop was actually at a ticket trap, and he actually went to the cop and scared and had a little private conversation with him, [01:42:32.000 --> 01:42:36.000] and then he came back automatically and dismissed it, or asked the judge to dismiss it. [01:42:36.000 --> 01:42:38.000] So it was a lot easier. [01:42:38.000 --> 01:42:43.000] Also, I just want to say this to people listening, it is a lot easier than you think, [01:42:43.000 --> 01:42:50.000] even though you should be setting up a killable error to go to another jury appeals court. [01:42:50.000 --> 01:42:59.000] But I actually was able to get it on the first try, which you told us, you taught us, oh, it's not going to happen on the first trial. [01:53:06.000 --> 01:53:11.000] Does there still not have to be damage as a result of the breach? [01:53:11.000 --> 01:53:13.000] For a license, no. [01:53:15.000 --> 01:53:28.000] There has to be something within the terms of the contract or that is a violation of the term of the contracts that provide the conditions by which one party can seek termination of the contract. [01:54:33.000 --> 01:54:38.000] It belongs to all people for their private use and pleasure. [01:54:38.000 --> 01:54:43.000] The use of it for commercial purposes is an extraordinary use. [01:54:43.000 --> 01:54:53.000] That is why the state can license it because that extraordinary use puts extra wear and tear that the public would have to foot the bill for [01:54:53.000 --> 01:54:58.000] while the guy that's doing the tearing up is actually making a profit from it. [01:54:58.000 --> 01:55:08.000] So if I perform a California stop or rolling stop at a stop sign or I'm not wearing my seat belt or any other little infraction like that that does not cause any actual harm to anyone else's right.
