[04:18.040 --> 04:27.040] Looking at a press release, not a press release, a story from Baltimore PD. [04:27.040 --> 04:34.040] Baltimore PD releases new rules for videotaping police. [04:34.040 --> 04:41.040] In listening to the news reports and the prosecutor and the mayor, [04:41.040 --> 04:49.040] I get the impression that they're pretty PO'd at the police department in Baltimore. [04:49.040 --> 04:56.040] And I think the Baltimore Police Department gets it that they're pretty PO'd at them. [04:56.040 --> 05:00.040] Because, let me read this. [05:00.040 --> 05:06.040] I'm sure everybody's heard about what's going on with them prosecuting these police officers. [05:06.040 --> 05:14.040] The prosecuting attorney really threw the book at these police officers and did it early. [05:14.040 --> 05:21.040] And then the mayor came back and asked for an investigation into the police department. [05:21.040 --> 05:31.040] So you have two of the highest, most influential officials around, both of them coming at you. [05:31.040 --> 05:35.040] The police apparently have to do something to show good faith. [05:35.040 --> 05:37.040] Let me read this article. [05:37.040 --> 05:43.040] Baltimore police released an updated policy addressing citizens' ability to videotape officers [05:43.040 --> 05:47.040] as a related court case against the department continues. [05:47.040 --> 05:54.040] The hearing is set to take place Monday in the ACLU of Maryland's federal lawsuit against a city officer [05:54.040 --> 06:03.040] who allegedly deleted a video of a confrontation at the 2010 Preakness Stakes, according to Associated Press. [06:03.040 --> 06:08.040] Christopher Sharpe's constitutional rights were allegedly violated when a sergeant took his phone [06:08.040 --> 06:16.040] for evidence and the case comes on the heels of heightened national attention to the issue. [06:16.040 --> 06:24.040] The directive states officers cannot prevent or prohibit taking of photos or video [06:24.040 --> 06:27.040] depicting law enforcement activities in public. [06:27.040 --> 06:38.040] The Baltimore Sun reported which department commanders say has been the standard rule for some time [06:38.040 --> 06:42.040] but has not been a formal written guideline until now. [06:42.040 --> 06:47.040] This is an extension of the citizens' right to see. [06:47.040 --> 06:54.040] Chief legal counsel for Mark Grimes said a police officer would not go up to a citizen at a crime scene [06:54.040 --> 06:58.040] and tell the citizen to close their eyes, he said. [06:58.040 --> 07:01.040] So the officer can't tell them they can't film. [07:01.040 --> 07:11.040] If the filming is hindering and the camera person is breaking laws, however, officers may arrest. [07:11.040 --> 07:19.040] It is the mere taking of photos or videos, the order states, that does not constitute probable cause [07:19.040 --> 07:24.040] and should never be the reason for any arrest. [07:24.040 --> 07:30.040] Cameras that may contain evidence of crime in most cases require a search warrant, a search and seizure warrant. [07:30.040 --> 07:37.040] Officers can temporarily take the device but cannot view images until a decision on the warrant is made by, [07:37.040 --> 07:39.040] made the policy dictates. [07:39.040 --> 07:42.040] Few police have been given clear guidelines. [07:42.040 --> 07:49.040] Darryl W. Stevens, a former chief of police in Charlotte, Mecklenburg, North Carolina said, [07:49.040 --> 07:53.040] I think it's a big step for the city of Baltimore to do that. [07:53.040 --> 08:00.040] Baltimore police seek to dismiss Sharp's lawsuit and say the issue it brings up have been addressed [08:00.040 --> 08:06.040] through the implementation and distribution of the policies which have been emailed to officers, [08:06.040 --> 08:12.040] taught in training, described in daily roll calls and appear below. [08:12.040 --> 08:14.040] And here are the guidelines. [08:14.040 --> 08:17.040] Police photo video policy. [08:17.040 --> 08:27.040] Upon discovery that a bystander is observing, photographing or video recording the conduct of police activity, [08:27.040 --> 08:36.040] do not impede or prevent the bystander's ability to continue doing so based solely on your discovery of his or her presence. [08:36.040 --> 08:45.040] Do not seize or otherwise demand to take possession of any camera or video recording device the bystander may possess [08:45.040 --> 08:49.040] based solely on your discovery of his or her presence. [08:49.040 --> 08:56.040] Do not demand to review, manipulate or erase any images or video recording captured by the bystander [08:56.040 --> 09:01.040] based solely on your discovery of his or her presence. [09:01.040 --> 09:10.040] For investigative purposes, be mindful of the potential that the bystander may witness or capture image videos of events [09:10.040 --> 09:15.040] considered at some later time to be material evidence. [09:15.040 --> 09:24.040] Before taking any police action which would stop a bystander from observing, photographing or video recording the conduct of police activity, [09:24.040 --> 09:32.040] officers must have observed the bystander committing some act deemed criminal such as obstruction, disorderly conduct [09:32.040 --> 09:37.040] or interfering with an officer's lawful duties. [09:37.040 --> 09:43.040] Those are the guidelines or the policy. [09:43.040 --> 09:53.040] I'm a little concerned with that last one because if you do anything the officer doesn't like or fail to do something he orders you to do, [09:53.040 --> 09:59.040] he'll charge you with interfering with his duties. [09:59.040 --> 10:03.040] But anyway, Deborah, what do you think? [10:03.040 --> 10:09.040] Well, it sounds good on paper. We'll see what actually happens. [10:09.040 --> 10:18.040] I mean, you know, these corrupt rogue officers are probably just going to do whatever they want anyway, the corrupt ones that is, [10:18.040 --> 10:26.040] and they'll just make something up and say that the person is interfering or whatever and not, you know, say, [10:26.040 --> 10:29.040] well, I didn't do that just because he was videotaping. [10:29.040 --> 10:38.040] I mean, plus I've seen cases where officers say that the fact of them videotaping was a distraction or a disturbance or they may say, [10:38.040 --> 10:40.040] oh, you're too close. [10:40.040 --> 10:48.040] I mean, in some municipalities they're allowed to, people are, quote, allowed to film, okay, [10:48.040 --> 10:57.040] but they have to be so far away that it's like you'd have to have a $2,000 professional camera with a zoom lens to be able to actually film anything [10:57.040 --> 11:02.040] and a $5,000 microphone to actually pick up any audio. [11:02.040 --> 11:14.040] So we'll see if they, you know, modify these policies to set some kind of a, you know, distance limit regarding filming. [11:14.040 --> 11:16.040] I think here in Austin it's pretty bad. [11:16.040 --> 11:21.040] I mean, you have to be so far away that it's just basically pointless. [11:21.040 --> 11:29.040] And so I can see this coming down the pike that something's going to happen and the officer's going to say, well, this guy was too close. [11:29.040 --> 11:32.040] So we have to set some guidelines and some standards about how far away they're going to be. [11:32.040 --> 11:33.040] So I don't know. [11:33.040 --> 11:34.040] We'll see. [11:34.040 --> 11:42.040] I mean, it sounds good on paper, but what actually is going to happen as a result of this remains to be seen. [11:42.040 --> 11:49.040] I mean, this could just be a big dog and pony show, a PR stunt in light of this lawsuit. [11:49.040 --> 12:03.040] I mean, I typically don't give much credence to these policies because it's the law that matters and case law is what matters sometimes even more than statute. [12:03.040 --> 12:06.040] And, you know, we've got Supreme Court rulings on the matter. [12:06.040 --> 12:11.040] So, yeah, their policies better be fitting with law, but we shall see. [12:11.040 --> 12:13.040] I'm skeptical. [12:13.040 --> 12:15.040] I'm dubious, but I could be wrong. [12:15.040 --> 12:17.040] We shall see. [12:17.040 --> 12:36.040] Well, this gives us leverage and this gives us precedence for going to our local policing departments and demanding that our local mayors and city councils institute these policies. [12:36.040 --> 12:40.040] Yeah, and like I said, I think there is a policy here in Austin, but it's pretty ridiculous. [12:40.040 --> 12:43.040] I mean, I can't remember exactly what the distance is. [12:43.040 --> 12:58.040] But basically you have to be so far away that seriously you would have to have like, you know, some kind of spy level multi-thousand dollar microphone to be able to pick anything up much less, you know, have any clarity of video. [12:58.040 --> 13:07.040] I mean, they basically are prohibiting people from filming by their distance requirement. [13:07.040 --> 13:09.040] And so that needs to be challenged. [13:09.040 --> 13:16.040] I mean, the average person is not going to have the level of equipment, you know, that is required. [13:16.040 --> 13:33.040] You know, the average person is not going to have $10,000 worth of AV gear in order to take good video and audio footage at the distance that the policy here is requiring that people stay away, you know. [13:33.040 --> 13:37.040] I do have a question or something that I lost track of. [13:37.040 --> 13:46.040] There was a proposal in the legislature that filming of police officers be restricted to 25 feet away. [13:46.040 --> 13:48.040] Do you know if that passed? [13:48.040 --> 13:50.040] Oh, what here in Austin? [13:50.040 --> 13:53.040] No, it was a state statute. [13:53.040 --> 13:54.040] Oh, I don't know. [13:54.040 --> 13:55.040] Legislators. [13:55.040 --> 13:56.040] I don't know. [13:56.040 --> 14:00.040] He drew a tremendous amount of heat over that one. [14:00.040 --> 14:02.040] Yeah, I don't know. [14:02.040 --> 14:16.040] But 25 feet, that's pretty far to be able to like really adequately pick up audio with a microphone on a cell phone. [14:16.040 --> 14:17.040] Yeah, audio will be a problem. [14:17.040 --> 14:19.040] Video we can do. [14:19.040 --> 14:29.040] You can go on eBay and for about $15, $20 get a telephoto lens that will clip right on to your cell phone. [14:29.040 --> 14:33.040] And I'm going to order a couple of those just for yucks. [14:33.040 --> 14:34.040] Okay. [14:34.040 --> 14:36.040] Let me know how it works out. [14:36.040 --> 14:45.040] But I recently went to the Justice of the Peace, I think precinct one in Fort Worth. [14:45.040 --> 14:53.040] This guy's swear engine is in the old courthouse in downtown Fort Worth. [14:53.040 --> 15:01.040] And when I went there with someone else, I saw this sign that said all electronic devices had to be turned off. [15:01.040 --> 15:04.040] Well, I've got a hearing aid. [15:04.040 --> 15:16.040] And so I went to the clerk and asked for the statute or the Supreme Court rule that authorized this particular requirement. [15:16.040 --> 15:19.040] And the judge came out. [15:19.040 --> 15:25.040] He was wanting to be your standard Huffy Puffy, Huffy Puffy JP. [15:25.040 --> 15:27.040] And he said, can I help you? [15:27.040 --> 15:28.040] I said, yes, you can. [15:28.040 --> 15:34.040] I see you have the sign here that orders all electronic devices to be turned off. [15:34.040 --> 15:37.040] Well, I wanted to videotape your courtroom. [15:37.040 --> 15:39.040] There's no videotaping in our courtroom. [15:39.040 --> 15:46.040] It would interfere with the proceedings. [15:46.040 --> 16:01.040] I said, can you show me the statute or the Supreme Court rule, the Supreme Court approved rule that authorizes you to make this restriction? [16:01.040 --> 16:03.040] There is no rule. [16:03.040 --> 16:04.040] Oh, there is no rule. [16:04.040 --> 16:05.040] Okay. [16:05.040 --> 16:09.040] So then I started to walk away because I was going around. [16:09.040 --> 16:10.040] I was in the office. [16:10.040 --> 16:22.040] I was going to the courtroom and I stopped and turned and looked at him and I said, well, if I videotaped your courtroom without you knowing it, that wouldn't interfere with the proceedings. [16:22.040 --> 16:24.040] Now would it? [16:24.040 --> 16:27.040] There would be no recording in the courtroom. [16:27.040 --> 16:31.040] He was absolutely furious. [16:31.040 --> 16:33.040] I don't know. [16:33.040 --> 16:36.040] I kind of do know why this is becoming a touchy subject. [16:36.040 --> 16:39.040] And I think he had figured out who it was. [16:39.040 --> 16:43.040] He was an hour late coming into the courtroom. [16:43.040 --> 16:47.040] And when he came in the courtroom, his face was glowing. [16:47.040 --> 16:50.040] He was clearly upset. [16:50.040 --> 17:00.040] And I asked the bailiff to tell the judge that I couldn't hear them because I'd already asked if they had. [20:01.960 --> 20:08.120] kind of excited because the way the judge responded, when I told the bailiff that I [20:08.120 --> 20:13.600] couldn't hear them and asked, I asked the bailiff if they had accommodation with hearing [20:13.600 --> 20:14.600] impaired. [20:14.600 --> 20:15.600] And he said, no, he didn't. [20:15.600 --> 20:18.400] Is your sound system here working? [20:18.400 --> 20:19.400] He said, no. [20:19.400 --> 20:23.920] I said, well, then you asked the court to speak up because I can't hear them. [20:23.920 --> 20:26.160] And he walked away and he didn't go ask the judge. [20:26.160 --> 20:32.480] So I walked around and walked up to the bar right where the little swinging gates are [20:32.480 --> 20:38.400] and stood there for 15 minutes. [20:38.400 --> 20:43.760] The judge never recognized me. [20:43.760 --> 20:49.280] And I suspect the reason that he didn't is by then he knew who I was and he didn't want [20:49.280 --> 20:55.160] me setting him up like I did Judge Hayes over the hearing thing. [20:55.160 --> 21:01.840] But the whole time, I was concerned the way the judge was working his jaw that he was [21:01.840 --> 21:05.240] going to crack a tooth. [21:05.240 --> 21:10.800] And that told me these guys are getting uncomfortable. [21:10.800 --> 21:17.280] My chief of police asked me what I thought about these guys in Dallas who are going around [21:17.280 --> 21:20.680] provoking the police by videotaping them. [21:20.680 --> 21:28.760] And I had to think about that a minute, partly because of the way he presented it. [21:28.760 --> 21:32.920] And it took a minute to work that through. [21:32.920 --> 21:43.920] And then my question was provoking the police find being videotaped provocative? [21:43.920 --> 21:49.280] And he said, well, these people are going around deliberately trying to provoke the [21:49.280 --> 21:50.320] police. [21:50.320 --> 21:55.160] And I told him, I think that is a wonderful thing. [21:55.160 --> 22:05.860] Because it gives the police opportunity to learn to control their personal passions. [22:05.860 --> 22:10.040] They can get as furious as they want to. [22:10.040 --> 22:17.440] The problem is they're staring down the lens of this camera and they can't go into court [22:17.440 --> 22:23.880] and make up some god awful story about all the terrible things this guy did because we [22:23.880 --> 22:26.040] can see what goes on. [22:26.040 --> 22:29.840] So the police have to learn to control themselves. [22:29.840 --> 22:40.920] Now, the chief was not too pleased with my response, but in that respect, I get people [22:40.920 --> 22:47.480] send me a lot of videos of police improprieties. [22:47.480 --> 22:54.600] The last few videos I have gotten where the police were being videotaped, their behavior [22:54.600 --> 23:01.840] was dramatically different than it was six months ago. [23:01.840 --> 23:08.840] None of these latest videos had the police interfering with the people videotaping them, [23:08.840 --> 23:12.600] except for the ones inside the courtroom. [23:12.600 --> 23:20.680] And even there, I was amazed at how restrained these bailiffs were being. [23:20.680 --> 23:23.320] These guys are on a hot seat. [23:23.320 --> 23:33.280] Police all over the country right now feel like they're not trusted and feel like they're [23:33.280 --> 23:37.560] being watched in every move they make. [23:37.560 --> 23:45.480] It's my opinion that if that concerns a policeman, he should take that pistol off his hip, go [23:45.480 --> 23:49.000] out and pick up dead cats and skunks off the highway. [23:49.000 --> 23:54.800] If you're worrying about the public seeing what you're doing, then you don't need to [23:54.800 --> 23:57.080] have a pistol on your hip. [23:57.080 --> 24:00.440] Well, that's my story and I'm sticking to it. [24:00.440 --> 24:10.240] I do have some more on that subject and associated subjects of how the pressure on the police [24:10.240 --> 24:14.240] is beginning to change their policies and practices. [25:07.680 --> 25:17.160] And when I go into court, I'm still, I'm still an average Joe, I'm an amateur. [25:24.200 --> 25:28.920] So I go in, I still make a lot of mistakes and I still don't do things, but I went in [25:28.920 --> 25:33.920] with a shotgun theory and that is I just started blasting everything. [25:50.560 --> 25:55.480] So I think that, I think that even though I was crude, I think I set up a really good [25:55.480 --> 26:03.960] trap and they stepped into it and I lost my case, but I knew I would, but it was a very [26:03.960 --> 26:11.400] interesting experience because the DA, even with the, I had more proof that the apartment [26:11.400 --> 26:16.120] building was off campus than, and they didn't have any proof that it was on. [26:16.120 --> 26:20.000] But the DA basically just got up and snapped his fingers and told the jury to convict me [26:20.000 --> 26:24.240] and they had this look of fear like, okay, and they just did. [26:24.240 --> 26:33.840] So I realized how easy it is to get a jury to do anything you want, but yeah, the trial, [26:33.840 --> 26:40.680] I objected to the roommate that supposedly turned me in, never showed up. [26:40.680 --> 26:48.360] So I objected to hearsay because he was the one that supposedly left the police in. [26:48.360 --> 26:54.760] And when, as soon as the police officer said that the roommate let us in, I said, objection [26:54.760 --> 26:59.320] hearsay, the roommate's not here and you have no probable cause. [26:59.320 --> 27:03.080] You entered the building illegally and they overruled it. [27:03.080 --> 27:04.960] So they basically overruled everything. [27:04.960 --> 27:08.720] They entered in about 36 documents and not one of them was original. [27:08.720 --> 27:10.960] They were all copies. [27:10.960 --> 27:15.320] I objected to every last one of them. [27:15.320 --> 27:21.800] The DA accidentally went into the jury room during the trial and so- [27:21.800 --> 27:24.120] Whoa, hold on. [27:24.120 --> 27:26.360] During the trial or during deliberation? [27:26.360 --> 27:34.320] No, not during deliberation, but just during one of the recesses, the DA went into the [27:34.320 --> 27:35.320] jury room. [27:35.320 --> 27:38.400] I guess he thought it was a bathroom or something. [27:38.400 --> 27:39.400] And so he came out. [27:39.400 --> 27:42.880] I mean, we were all seated, but he came back out. [27:42.880 --> 27:45.680] People had gone to the bathroom and stuff and he came back out and they started up and [27:45.680 --> 27:48.240] he said, your honor, I accidentally stuck my head in the jury room. [27:48.240 --> 27:54.280] Well, I objected about five times and claimed jury tampering. [27:54.280 --> 27:59.840] I probably don't have a leg to stand on, but it was sure fun to make him nervous. [27:59.840 --> 28:02.040] It was a lot of fun to make him nervous. [28:02.040 --> 28:12.600] Well, no, no, wait, this is not a witness subpoenaed from out of state. [28:12.600 --> 28:19.440] Has this prosecutor never been in the courtroom before? [28:19.440 --> 28:20.440] You know, that's what I claimed. [28:20.440 --> 28:24.600] I said that he's an officer of court, he knows exactly where he's going and he just tampered [28:24.600 --> 28:26.720] with the jury. [28:26.720 --> 28:30.240] And what they tried to say is, oh, I didn't say anything to him and all that. [28:30.240 --> 28:34.360] And I objected and said, it doesn't matter, just the possibility of contamination, jury [28:34.360 --> 28:35.360] tampering. [28:35.360 --> 28:38.160] Well, you don't know that he didn't say anything to him. [28:38.160 --> 28:46.040] You need to, and now I want to say voir dire, voir dire is not the right term. [28:46.040 --> 28:48.480] You need an opportunity to talk to the jurors. [28:48.480 --> 28:49.920] Well, they did. [28:49.920 --> 28:53.640] They pulled each of them out and each of them stood up and said, no, he didn't say anything [28:53.640 --> 28:54.640] to us. [34:14.920 --> 34:23.200] Well, that's, okay, I'll tell you, the thing that made me win, that won my case the last [34:23.200 --> 34:30.400] time did not happen this time, and that is my attorney, last time when I started griping [34:30.400 --> 34:35.160] about the missing roommate, because that's who filed the police report. [34:35.160 --> 34:38.280] So I started jumping up and down about my accusers not here. [34:38.280 --> 34:43.040] Well, I started doing it this time, and they all looked very calm. [34:43.040 --> 34:49.440] And the first time my lawyer panicked, and she got up and started arguing with me, like, [34:49.440 --> 34:54.040] oh, I've never heard of this accuser either, and he's right, and this and that. [34:54.040 --> 34:58.200] Well, just her breakdown in the courtroom is what won me in my appeal. [34:58.200 --> 35:05.520] Unfortunately, this attorney didn't say anything, and I pointed to him about three times during [35:05.520 --> 35:11.480] the trial and said, I want to hear what my attorney has to say, and everybody just kind [35:11.480 --> 35:14.800] of looked around like they had no idea what I was talking about, and my attorney never [35:14.800 --> 35:15.800] said a word. [35:15.800 --> 35:16.800] Okay. [35:16.800 --> 35:23.360] Well, the last time you got it overturned for ineffective counsel. [35:23.360 --> 35:31.720] Well, I got it overturned because the judge refused to let her withdraw because she had [35:31.720 --> 35:32.840] a mental breakdown. [35:32.840 --> 35:35.280] She started crying, and she started saying, I want to get out of here. [35:35.280 --> 35:36.280] I want to withdraw. [35:36.280 --> 35:39.000] And he said, I won't do that. [35:39.000 --> 35:44.920] Well, this attorney looked very cool and calm and collected, and he never got upset a word. [35:44.920 --> 35:45.920] That's the problem. [35:45.920 --> 35:48.120] You had ineffective counsel. [35:48.120 --> 35:50.120] Okay. [35:50.120 --> 35:54.840] And you asked counsel to assist, and counsel refused. [35:54.840 --> 35:57.640] Okay, good. [35:57.640 --> 36:00.240] So you essentially got the same thing. [36:00.240 --> 36:03.040] Well, because, see, I didn't know that. [36:03.040 --> 36:04.520] I wasn't sure. [36:04.520 --> 36:10.160] So you definitely need to have you bargrieved your counsel. [36:10.160 --> 36:18.000] Yes, I just sent a bar grievance off today, and I got him good because he didn't expect [36:18.000 --> 36:19.000] this. [36:19.000 --> 36:21.280] And they switched those witnesses out. [36:21.280 --> 36:29.760] I started screaming about it, and the DA jumped up and said, well, I sent Mr. Hill's lawyer [36:29.760 --> 36:35.320] a letter like a month ago telling that we were going to switch witnesses. [36:35.320 --> 36:41.440] And then my attorney then got up and said, yes, and I sent Mr. Hill a letter last week [36:41.440 --> 36:46.120] telling him that we were switching witnesses, and that's when I jumped up and said, I don't [36:46.120 --> 36:47.320] have a letter. [36:47.320 --> 36:52.800] I don't have a certified receipt, and I did that a couple of times to make people nervous. [36:52.800 --> 36:59.200] And my attorney finally said, well, I think I'm mailed at Friday, so it's probably getting [36:59.200 --> 37:03.200] to his house today, and, of course, I'm in the courtroom. [37:03.200 --> 37:04.200] Right. [37:04.200 --> 37:09.440] So I immediately screamed objection, ineffective assistance of counsel. [37:09.440 --> 37:10.440] Perfect. [37:10.440 --> 37:11.440] Okay, good. [37:11.440 --> 37:15.920] You've set them up much better this time. [37:15.920 --> 37:16.920] Okay. [37:16.920 --> 37:17.920] That's good. [37:17.920 --> 37:18.920] This sounds good. [37:18.920 --> 37:19.920] This is good. [37:19.920 --> 37:27.240] Well, the second time I got him is I tried to call the judge to the stand. [37:27.240 --> 37:28.680] I just thought, oh, to heck with it. [37:28.680 --> 37:29.680] Let's have a good time. [37:29.680 --> 37:31.920] So do you have any witnesses? [37:31.920 --> 37:32.920] Yes, you. [37:32.920 --> 37:34.520] I can't come down. [37:34.520 --> 37:35.520] Yes, you can. [37:35.520 --> 37:38.680] You arrested me in October without a bond hearing and without a warrant. [37:38.680 --> 37:39.680] Why? [37:39.680 --> 37:41.400] You need to take the stand. [37:41.400 --> 37:43.920] People started yelling and screaming. [37:43.920 --> 37:48.800] Finally, my attorney jumped up and he said, oh, well, you had arrested him for failure [37:48.800 --> 37:49.800] to appear. [37:49.800 --> 37:52.800] And I said, objection, perjury. [37:52.800 --> 37:58.000] That had been like two years before. [37:58.000 --> 38:03.360] I got arrested seven days before my court date, so there's no failure to appear. [38:03.360 --> 38:05.480] So I said, objection, perjury. [38:05.480 --> 38:06.480] He's lying. [38:06.480 --> 38:10.200] What do you think about that? [38:10.200 --> 38:12.200] I think that's great. [38:12.200 --> 38:13.200] Okay, good. [38:13.200 --> 38:21.080] I think it's going to indicate that your attorney was deliberately contriving to get you found [38:21.080 --> 38:22.080] guilty. [38:22.080 --> 38:24.720] Okay, good. [38:24.720 --> 38:27.600] This will feed your RICO suit. [38:27.600 --> 38:31.520] Okay, that's fantastic. [38:31.520 --> 38:38.200] All of this, this goes, probably your case more than most any that I've heard goes to [38:38.200 --> 38:47.360] RICO because it appears as though anyone who chooses to plead not guilty and fight their [38:47.360 --> 38:54.320] case are subject to this routine where they're called into court and then have to stay in [38:54.320 --> 38:59.080] town waiting for the court for a week and then they don't get to them and then they [38:59.080 --> 39:05.560] have to come back again over and over and over to make it virtually impossible to fight [39:05.560 --> 39:06.560] your case. [39:06.560 --> 39:14.680] So you're probably an anomaly and I do suggest you go down and carefully examine the records [39:14.680 --> 39:25.360] and see how many people actually have a full blown trial in that court on criminal issues. [39:25.360 --> 39:26.560] It will surprise you. [39:26.560 --> 39:30.960] The last time I went through the records in the county I live in, it's a relatively small [39:30.960 --> 39:44.440] county, I did January to July 1631 felony conviction, felony indictments brought one [39:44.440 --> 39:49.280] person plead not guilty by the public record. [39:49.280 --> 39:53.000] He was prosecuted, found guilty, headed overturned on appeal. [39:53.000 --> 39:56.800] One trial, they couldn't get it right. [39:56.800 --> 40:06.160] You will probably find something very similar and that goes directly to RICO. [40:06.160 --> 40:12.360] Now just for the record I knew this would happen but I did it correctly and I got it [40:12.360 --> 40:18.200] on the record perfectly and that is when they held the rifle up I said objection, this infringes [40:18.200 --> 40:23.400] my second amendment right to keep and bear arms and he overruled it and 50 people sat [40:23.400 --> 40:25.520] there and listened to him and I did it right. [40:25.520 --> 40:30.080] I wasn't screaming or rolling around on the floor being disruptive because that's what [40:30.080 --> 40:31.320] they're always going to go to. [40:31.320 --> 40:36.920] No, I just sat there and did it and then in my directed verdict I said the same thing, [40:36.920 --> 40:40.760] second amendment right violation and he overruled it. [40:40.760 --> 40:44.760] So if there's any question it's on the paper. [40:44.760 --> 40:52.320] Yes, the whole thing is your only purpose in the trial court is setting the record for [40:52.320 --> 40:53.520] appeal. [40:53.520 --> 40:58.880] Now I had the land title that had private property but as soon as I pulled that out [40:58.880 --> 41:04.640] the DA started screaming and they suppressed that but I did so much hooping and hollering [41:04.640 --> 41:07.120] that the jury certainly heard it. [41:07.120 --> 41:12.480] I waved that thing around in the air, here's the owner, they still suppressed it. [41:12.480 --> 41:18.200] Now I got a question is I tried to read my affidavits into the record and they denied [41:18.200 --> 41:23.080] me they suppressed it and I objected, you're denying me the right to due process. [41:23.080 --> 41:28.200] It doesn't matter overruled and I said objection I take a rule to your exception just like [41:28.200 --> 41:35.200] what you taught me and so I but I never did get to read my affidavits into the record [41:35.200 --> 41:41.240] because they kept cutting me off and the same thing with the land title but I did so much [41:41.240 --> 41:49.720] griping that he allowed those to be in marked identification only and I said well is that [41:49.720 --> 41:56.960] going to my appeal and he said it is on the record. [41:56.960 --> 42:01.680] I don't quite understand what that meant does that mean it's not going to appeal or it is [42:01.680 --> 42:02.680] or? [42:02.680 --> 42:11.000] Oh you've already brought up the affidavits and if you did you take this stand to testify? [42:11.000 --> 42:15.280] Yes and I started reading the affidavits. [42:15.280 --> 42:20.160] And they objected you to your reading of a prepared statement? [42:20.160 --> 42:24.640] Yes I got about six words out and everybody started screaming and then as soon as it quieted [42:24.640 --> 42:29.720] down I said about two or three more words and then they all started screaming again [42:29.720 --> 42:35.320] and then the judge ordered me not to read that. [42:35.320 --> 42:40.480] That's when you should have asked that it be entered into the record? [42:40.480 --> 42:44.480] Well I did enter it into the record and he refused to enter it into evidence. [42:44.480 --> 42:52.000] So he denied you in your right to present evidence in your defense? [42:52.000 --> 42:56.760] Well I said you denying me right to due process was that incorrect? [42:56.760 --> 42:57.760] That was correct. [42:57.760 --> 43:07.440] Oh that was correct good well finally I even stated case law tool versus state an unrefuted [43:07.440 --> 43:13.200] affidavit stands as truth and I got that in twice. [43:17.840 --> 43:23.400] Then they got me up on the stand and the DA who was normally a smart aleck said something [43:23.400 --> 43:30.640] really stupid they wouldn't let that land title get into the evidence but then he got [43:30.640 --> 43:35.920] up and said Mr. Hill did you know that you're on campus property and I said actually it's [43:35.920 --> 43:41.320] not the land title right here states that the owner owns it or it's private property [43:41.320 --> 43:47.520] it's privately owned and I thought he was going to fall apart. [48:55.720 --> 49:04.840] and I cut them down pretty good but I got two big questions the first one is at the end of the trial [49:04.840 --> 49:10.760] I said I said to the judge now I need to file for an appeal and I need to hold stop hearing [49:10.760 --> 49:20.840] hold on stop I remember the question oh when the prosecution wested did you ask that the case be [49:20.840 --> 49:27.960] dismissed for lack of evidence yes I said the defense moves for a directed verdict in my favor [49:28.840 --> 49:36.120] was that incorrect or correct that was perfect okay and then I read off about 20 things [49:36.120 --> 49:43.960] violation of the rules of evidence uh violation um the state did not have a single could not prove [49:43.960 --> 49:49.400] anything because all the uh documents were hearsay I didn't say it like that I'm just [49:49.400 --> 49:55.560] glossing it over uh lack of the accuser Andrew Hatton is missing lack of the police report it's [49:55.560 --> 50:00.920] not [01:08:11.480 --> 01:08:17.080] And he said, you know, you ought to do what is called a writ of supervisory control and get that [01:08:17.080 --> 01:08:21.800] judge in front of a panel of other judges. Now I didn't understand what he was talking about, [01:08:21.800 --> 01:08:27.400] but in Mississippi rules or in the statutes, they have one called temporary relief. [01:08:27.400 --> 01:08:32.520] I don't know what that means. Prohibition to a judge or other extraordinary writs, [01:08:32.520 --> 01:08:36.600] but none of them say writ of supervisory control. So I'm kind of lost there. [01:08:37.160 --> 01:08:45.560] That has to be administrative. Have you looked at the judicial canons for Mississippi? [01:09:21.240 --> 01:09:26.760] And I read a DA shall lose their license if they refuse to give a citizen their bond [01:09:26.760 --> 01:09:33.480] policy number or the address of the bonding company. So did they give it? [01:09:34.440 --> 01:09:38.680] No, absolutely not. They just said, oh, the court's not going to require that [01:09:38.680 --> 01:09:41.320] right now where the court's not going to require that. [01:09:43.880 --> 01:09:49.960] Now you get to go after it. Okay. You need to look at how to go after him for that. And I first, I just kind of shrugged and didn't answer. And then they kind of threw that [01:10:01.480 --> 01:10:11.640] back and forth. And then they said, we don't know what that is. And we would have to be calling her a liar. That'll work. So bring [01:15:46.280 --> 01:15:52.360] charges against the foreman to the very DA that got up and, and, and, and was defending herself. Okay, well sure it's going to be [01:22:23.320 --> 01:22:31.160] a heck of a fight because the school district is in a pretty, you know, financial environment. [01:22:31.160 --> 01:22:39.720] What I suggest is, is you fence it with some type of marker and then put a no trespass sign [01:22:40.440 --> 01:22:49.880] facing outside your property. Okay. Or purple ribbons. Okay. A purple ribbon, [01:22:49.880 --> 01:22:57.240] two feet long, one inch wide is a no trespassing sign in Texas. Oh, nice. Okay. Their problem, not your problem, [01:23:04.040 --> 01:23:10.760] but once you put the no trespassing sign up there, then they're likely to raise an issue. Any, any property that's not being used, [01:23:36.600 --> 01:23:45.720] you know, we had a lot of large landowners that were granted huge tracts of land and some of it, [01:23:45.720 --> 01:23:51.480] they never saw, never used, never do anything with. And the squatter's rights were developed [01:23:51.480 --> 01:23:57.000] to get people to move into Texas so that they could go to land that wasn't being used and just [01:23:57.000 --> 01:24:02.440] take it. If you find a property that's all run down and nobody's taking care of it, you go in [01:24:02.440 --> 01:24:06.760] and take care of it for seven years. There's actually a provision you can take it in four years. [01:24:07.560 --> 01:24:12.920] And in that one, you say, this part, this is, it goes to abandoned property [01:24:13.800 --> 01:24:20.440] that I've maintained it. When you first take it over, you photograph yourself with a newspaper [01:24:22.120 --> 01:24:27.720] and then clean it all up and photograph yourself with a newspaper. And then after four years, [01:24:27.720 --> 01:24:32.760] you go to the, the, the best way to do this is look for a property that's not on the tax roll. [01:24:35.080 --> 01:24:41.800] That's nobody's paying the taxes on, maybe the city's taking it back or they, they, it's on there. [01:24:42.440 --> 01:24:47.560] You know, they try to auction off properties and a lot of it never gets purchased. You can just take [01:24:47.560 --> 01:24:51.880] it over and you go to the court after four years and say, I've maintained this property. I paid [01:24:51.880 --> 01:24:59.400] the taxes on it. I want you to grant me this property and you have to publish this in some kind [01:24:59.400 --> 01:25:05.640] of local publication for 30 days. And then the judge will ask you if you did that and you say, [01:25:05.640 --> 01:25:11.560] yes. And then he'll look out on the courtroom and he'll say, do I hear any objections? Well, [01:25:11.560 --> 01:25:16.840] it won't be anybody out there. Boom, he'll give it to you. The reason he does that is [01:25:16.840 --> 01:25:22.840] they want this property back on the tax rolls. That's, that's somewhat different. [01:25:23.640 --> 01:25:29.400] You've held it and maintained it for seven years. They have a problem. [01:25:31.400 --> 01:25:37.800] So, you know, they may want to get into a long protracted court battle and they may not, [01:25:37.800 --> 01:25:47.000] probably all of the school board is a, the school district is going to want is an easement. Just a bunch of houses in a [01:26:27.400 --> 01:26:34.360] developed subdivision. Well, it doesn't make sense. How does the school district hold that property? I'm sure I'm paying for it one way or another, [01:26:42.280 --> 01:26:47.240] but they own this creek, this wet weather creek that runs through a subdivision. [01:26:47.240 --> 01:26:52.280] And I just, I don't understand it. It doesn't make sense to me. I thought it was a city, [01:26:52.280 --> 01:26:56.840] obligation to maintain this thing. And I called them and they said, no, actually that's owned by, [01:26:56.840 --> 01:27:02.440] you know, ex school district. I said, okay, why the heck do they own a wet weather creek that runs [01:27:02.440 --> 01:27:05.880] through two miles of developed neighborhood? It doesn't make sense to me. Essentially, at least where we're at, all the water is owned by Fort [01:34:41.400 --> 01:34:52.920] Worth and I know in West, in Washington State, you can't catch water in barrels [01:34:54.040 --> 01:34:58.840] but they'll come out and put you in jail because they claim they own all the water. They're accustomed to that. They think it's a safe place to land. [01:41:36.600 --> 01:41:42.360] Well, what happens is they are absolutely, it's irresistible to them, the blacklight. [01:41:42.360 --> 01:41:50.280] And so they fly down into the bucket and then go up underneath the lampshade to get to the blacklight. [01:41:50.280 --> 01:41:54.120] Okay. So you get the idea. They go down the bucket and then they go up into the lampshade. [01:41:54.120 --> 01:41:58.280] The lampshade is pointed down and it's inside the bucket. Well, they circle around for a while [01:41:58.280 --> 01:42:02.600] and they're just loving life because they're right on this blacklight. You can completely clear the area out with these [01:42:36.200 --> 01:42:39.240] mosquito traps. I'm telling you, we had like three or four of them around the property.
