14:31.000] think it all the things we will talk about you won't find in high school school system [14:31.000 --> 14:38.840] doesn't teach this part and they absolutely should so first I'm going to give a few basics [14:38.840 --> 14:50.440] to give reference to the remedies I'll address later and these go to some common commonly [14:50.440 --> 15:01.160] held misconceptions about the nature of the law and the system that we live in and the [15:01.160 --> 15:09.000] first one is that the courts are just that you can go to the courts and seek justice [15:10.280 --> 15:17.320] nothing could be further from the truth if you go to court you can expect the court to [15:17.320 --> 15:23.000] rule against you out of hand at every turn you know I help people with foreclosure issues and [15:23.000 --> 15:29.400] this is what I tell them if you file a case in court the banks have pretty well bought and paid [15:29.400 --> 15:35.320] for the courts the courts going to rule against you out of hand at every turn not necessarily a [15:35.320 --> 15:44.360] problem it's merely a parameter I'm an engineer engineers we we really don't have opinions about [15:44.360 --> 15:51.560] how the world should be we just have to deal with it so these are parameters expect the courts to [15:51.560 --> 16:00.360] rule against you also you should understand you will never win your case simply because you have [16:00.360 --> 16:09.080] the law and the facts on your side to think so it's naive it is not that way now it never ever has [16:09.080 --> 16:18.840] been that way I once read an interpretation of a plaque found in across in Nineveh across from [16:18.840 --> 16:28.040] Mosul in Iraq in a library they discovered there that was six thousand years old this was an [16:28.040 --> 16:36.840] Akkadian king commissioned this plaque to proclaim that he was reasserting the old law because those [16:36.840 --> 16:44.280] impositions of power and influence have so perverted the law that the citizen can no longer [16:44.280 --> 16:52.280] achieve justice if this has been going on for at least six thousand years don't expect it to [16:52.280 --> 16:56.840] change tomorrow but us [20:09.000 --> 20:15.000] in high school that they were first thing to understand is you'll never win your case [20:15.800 --> 20:22.200] simply because you have the law and the facts on your side you will win the case if you have [20:22.200 --> 20:33.320] the politics on your side everything is political and all politics is local that's the key that's [20:33.320 --> 20:41.960] the magic understanding that will change the way you go about this the school the school is [20:41.960 --> 20:52.040] school is while they have a set of rules laws and guidelines they only use those to manipulate the politics [20:53.960 --> 20:58.360] everything is about politics everything is about what my boss thinks about me [20:59.080 --> 21:05.480] and what my subordinates think about me i'm at a certain level on the totem pole [21:05.480 --> 21:11.000] everybody above me is worried about me trying to get their position and everybody below me [21:11.000 --> 21:17.240] is trying to get my position everything's political so if we're going to win our case [21:17.240 --> 21:24.760] if we're going to get something done i'm an engineer and and i'm very cognizant of the law [21:24.760 --> 21:32.840] i treat the law as a tech manual it took me a long time to understand that nobody else treats it as a [21:32.840 --> 21:38.360] nobody else treats it as a tech manual they just use it as a tool to get what they want [21:40.760 --> 21:47.320] politics is everything so how do we generate politics here one of the things when i first [21:47.320 --> 21:53.640] heard the issue the problem is clearly not the child child screaming out for help [21:53.640 --> 22:02.600] and anything we do to the child any finger we point directly at the child will bring negative [22:02.600 --> 22:10.120] politics back at us so what we have to do is think in a little higher terms [22:12.040 --> 22:18.680] what influences brought this child to this position and how can we get at those influences [22:18.680 --> 22:25.480] my first thought is that the parents were the ones who were responsible for the child [22:26.280 --> 22:32.920] 14 year olds not responsible for himself yet the parents are so how do we get at the parents [22:34.680 --> 22:45.080] in listening to people talk about this issue i get the impression that this child's use of his [22:45.080 --> 22:51.880] first amendment rights has caused a considerable amount of emotional distress [22:54.040 --> 23:02.600] now while causing somewhat emotional distress may not be legal it's certainly a civil tort [23:05.160 --> 23:11.720] and what if all you folks got together who have been traumatized by this situation [23:11.720 --> 23:18.760] and filed a tort letter with the parents first in order to sue the courts want you to [23:19.560 --> 23:27.240] exercise civil all of your civil remedies prior to using the courts they want you to use the courts [23:27.240 --> 23:35.080] as a remedy of last resort and not first resort the way you show the court that you've exercised [23:35.080 --> 23:42.440] your civil remedy is by sending them a tort letter you send the parents a letter notifying them [23:42.440 --> 23:51.720] of what the child has done and that the child by committing by acting in this way knowingly and [23:51.720 --> 24:03.240] intentionally caused your children and you extreme emotional distress and that's what we need to do [24:03.240 --> 24:12.600] stress and i can't see a jury on the planet who would disagree with you there's nothing worse [24:13.480 --> 24:19.480] than attacking someone's children i lost a grandson a couple of years ago [24:21.240 --> 24:26.040] i can't imagine anything worse than outliving one of my children [24:26.040 --> 24:33.320] so to have your children being threatened this will cause extreme emotional distress now granted [24:33.320 --> 24:40.200] the parents may not have anything although they may if the father was arrested for shoplifting [24:40.200 --> 24:49.800] they probably are not in the upper brackets of income however a civil action will very [24:49.800 --> 24:56.200] a civil action will very seriously get their attention because it can potentially lead to [24:56.200 --> 25:05.000] more serious issues if the father drives a car if they have a house they're looking at the [25:05.000 --> 25:12.360] possibility of losing everything and you don't have to have a law violated to get out of this way [25:12.360 --> 25:24.760] in the statements that i read he named individual persons he only named them by first name however [25:26.280 --> 25:35.640] he is in he's talking about being in school and if there's only one possible person of that name [25:35.640 --> 25:45.160] that he could be referring to then that person has been slandered and that's a torch now while [25:45.160 --> 25:52.280] you have a first amendment right you can't screen fire in a crowded theater there are limits to the [25:52.280 --> 26:01.160] first amendment rights and what the school is doing in order to avoid being sued itself it's [26:01.160 --> 26:09.800] trying to treat first amendment rights as they're totally unassailable and that is not true so send [26:09.800 --> 26:21.800] a tort letter to the to the school board give them notice that the school has failed in their duty to [26:21.800 --> 26:30.920] protect the children and they allowed this abuse of the first amendment right to inflict [26:31.400 --> 26:40.760] extreme emotional distress on all of the parents you might have everyone who has a concern send [26:40.760 --> 26:51.640] everyone who has a concern send notice to the school board that you have been harmed and come [26:51.640 --> 26:57.080] up with an amount it's generally not a good idea to just pick one out of the area you might pull [26:57.080 --> 27:05.720] some you know go on the internet and do a search for severe emotional for infliction of severe [27:05.720 --> 27:13.400] emotional distress and see what amounts have been asked for in other cases and take an amount [27:14.360 --> 27:22.440] put it in the tort letter and send it to the school board if they get about 40 or 50 tort letters [27:23.400 --> 27:30.920] that's going to get them a hopping and a jumping because in the end it's all about the money [27:30.920 --> 27:36.920] and by sending the tort letters they have official notice that this is there is a problem here [27:37.960 --> 27:48.200] if the child does anything to harm anyone even if it's not serious then you can go back to the [27:48.200 --> 27:57.320] school under the depraved heart doctrine depraved heart doctrine if you have knowledge that something [27:57.320 --> 28:06.840] bad's going to happen to someone and you have opportunity to intercede and you don't [28:08.440 --> 28:15.720] and something bad happens you could potentially be charged to under the depraved heart doctrine [28:15.720 --> 28:24.120] with whatever harm come to the person now that hasn't been adjudicated a lot in texas it is in [28:24.120 --> 28:33.160] texas law we've we've looked up and found it in texas law and since it is the the principle of [28:33.160 --> 28:40.440] the school through the school board that determines what the school does he's the one that i would name [28:40.440 --> 28:46.760] under depraved heart depraved heart is such an ugly sounding term [28:46.760 --> 28:52.440] everything is political this all goes to the politics and in line with that i have a friend [28:52.440 --> 29:00.520] who has four laws there are four rules kin's four rules first one is everything's political [29:01.720 --> 29:10.760] the second one is perception is everything so in order to create the politics the local politics [29:10.760 --> 29:18.680] the politics the local politics we work on perception so a tort letter to the [29:19.640 --> 29:23.720] the school to the school board is going to get them real excited because now they're [29:23.720 --> 29:29.720] looking at a lawsuit and that they really don't want to have to get into a depraved heart [29:30.520 --> 29:38.440] allegation against the principal is just going to look bad it's going to beyond those of a normal attorney an attorney goes into [36:48.200 --> 36:57.720] court literally dangling by his bar card a court a judge can jerk a lawyer's bar card on a whim [36:59.640 --> 37:09.640] attorneys are terrified of judges what i hope you come away from this understanding is that all of [37:09.640 --> 37:19.400] those judges are public servants they are the servants you are the masters when you walk into [37:19.400 --> 37:27.880] a court you have standing and you have power they can't deal with i had a friend who does [37:27.880 --> 37:35.400] expert witness testimony around the country and he was in florida and testifying and said the judge [37:35.400 --> 37:42.200] said the judge turned to him and said mr escoville i don't like what i'm hearing [37:43.320 --> 37:52.040] you're very close to a contempt of court charge i said what'd you say joe did you ask the bailiff [37:52.040 --> 38:02.760] to arrest the judge he said why no man a judge says that garbage to me 3605 texas penal code [38:02.760 --> 38:08.760] if you say anything for the purpose of intimidating a witness or changing a witness's testimony [38:09.480 --> 38:17.400] that's a felony in texas and i don't care if you are the judge you got a judge you have an attitude [38:17.400 --> 38:25.560] mr judge i'll show you how to get that attitude adjusted i was in the courtroom in weiss county didn't have this turned on click stuck it in his face will you say that again [38:48.040 --> 38:53.880] well he didn't he ran out of the courtroom i charged him with making a terroristic threat [38:53.880 --> 39:02.040] that your public officials absolutely do not know the law that they are under [39:04.120 --> 39:08.360] read the penal code i have people read the penal code code criminal procedure [39:09.160 --> 39:17.240] they look like really big books they're kind of big but 90 of what's in there really doesn't apply [39:17.240 --> 39:23.560] except to really unusual circumstances and they're in outline format so there's a whole lot of uh [39:23.560 --> 39:29.800] white space in there take out your penal code read through it quickly don't try to understand [39:29.800 --> 39:35.320] all of it just read it then go back and read it again do the same thing with code of criminal [39:35.320 --> 39:40.520] procedure and you'll get into sections about property and about probate that you really don't [39:40.520 --> 39:48.360] care about it won't take long at all then when you go to the court you'll know their law better than [39:48.360 --> 39:57.720] they do and i can tell you they hate that so once we get the civil part down now we go for the [39:57.720 --> 40:07.160] officials if you have a complaint against anyone never give it to the district attorney never give [40:07.160 --> 40:15.640] it to the police department make up a complaint and take it to a magistrate every judge is a [40:15.640 --> 40:22.600] magistrate the problem with doing that is the judges have been trained to believe they're not [40:22.600 --> 40:29.640] magistrates so when you go to the judge with a criminal complaint he's going to tell you that [40:29.640 --> 40:39.960] you have to go somewhere else and when they do that they have violated 39.03 penal code if you're [40:39.960 --> 40:46.920] going to have any dealings with public officials you have you should have this one memorized [40:47.880 --> 40:56.760] 39.03 penal code comes from the Ku Klux Klan act 1871 after the war during the reconstruction [40:56.760 --> 41:02.680] the north sent all these uh carpetbaggers down to the south to tell the south how to run their [41:02.680 --> 41:11.000] business they left the sheriffs and mayors and constables in place so that the whole legal [41:11.000 --> 41:17.000] structure didn't fall apart they just gave them new directions and for the most part the judges [41:17.000 --> 41:22.280] and the sheriffs and the constables sent the carpetbaggers back in and they put together [41:22.280 --> 41:27.400] the Ku Klux Klan and the Ku Klux Klan is running around doing anything it wanted to so they passed [41:27.400 --> 41:37.640] this act that said that if a public official violates a law relating to his office or fails [41:37.640 --> 41:43.320] to perform a duty he is required to perform i'm sorry let me back up and do that correctly [41:43.320 --> 41:49.400] if a public official acting under the color pretense of his authority exerts or purports [41:49.400 --> 41:57.000] to exerted authority he does not expressly have or fails to perform a duty he is required to perform [41:57.960 --> 42:01.640] and in the process denies a citizen full free access to her enjoyment right [42:02.760 --> 42:08.680] well that's class a misdemeanor most people know about the Ku Klux Klan act because of 42 u.s code [42:08.680 --> 42:15.480] 1983 that's the portion of the code that authorizes you to sue this individual [42:15.480 --> 42:20.040] that's the second part of the Ku Klux Klan act the first part makes it criminal everybody [42:20.040 --> 42:30.680] forgets about that part so if you have a principle here that this principle has certain duties [42:30.680 --> 42:38.360] read what his duties are and if you can construe that he failed to perform a duty he was required [42:38.360 --> 42:42.360] to perform then you go down to the magistrate and file a criminal complaint against him [42:42.360 --> 42:48.440] and file a criminal complaint against him okay with that said you're not going to get the [42:48.440 --> 42:55.800] principal prosecuted we don't care about that that's all politics as soon as you file that [42:55.800 --> 43:01.080] complaint the judges are so you need to accept the police department well say okay so you go [43:01.080 --> 43:05.480] to the police department file a complaint against the judge for not taking the complaint [43:05.480 --> 43:14.360] i just did that today with the tarrant county district court i accused the justice of the [43:14.360 --> 43:20.520] peace of failing to act on a criminal complaint against another justice of the peace [43:21.800 --> 43:26.680] and i call this my little my tar baby syndrome i go to a public official and ask them to do [43:26.680 --> 43:33.640] something and they don't do it you see i have a rule never ask a public official to do anything [43:33.640 --> 43:39.880] you actually want them to do because you never ask a public official to do anything that the law [43:39.880 --> 43:45.880] does not specifically command them to do when they don't you get state statutes and in texas 39.03 [47:24.680 --> 47:33.160] penal code texas is unique in that it has two statutes on this subject it has an official [47:33.160 --> 47:40.360] misconduct statute in every other state i've been to this the official misconduct statute is the only [47:40.360 --> 47:47.800] one and it covers the whole area texas we have it broken into two official misconduct official [47:47.800 --> 47:55.720] oppression official misconduct goes to a public official misabusing his office using equipment [47:55.720 --> 48:05.160] or misappropriating funds those kinds of things official oppression separate statute distinct from [48:05.160 --> 48:12.840] official misconduct the fa public official acting under the color or pretense of his office exerts [48:12.840 --> 48:17.240] or purports to exert an authority he does not expressly have or fails to perform a duty he is [48:17.240 --> 48:22.120] required to perform and in the process denies a citizen in the full and free access to her [48:22.120 --> 48:29.160] enjoyment of right that's crime in the states texas one other statute you all should know [48:29.160 --> 48:38.200] no article 2.03 texas code of criminal procedure chapter two duties of officers first one they [48:38.200 --> 48:44.040] address the prosecuting attorneys 2.01 it shall be the primary duty the prosecuting attorney not to [48:44.040 --> 48:50.120] secure conviction but to ensure that justice is served he shall not seek witnesses or evidence [48:50.120 --> 48:54.040] that may show the innocence of the accused to mitigate the guilt of the accused well that's [48:54.040 --> 49:00.520] nice high-minded rhetoric but it really doesn't tell the prosecutor do anything specific 2.02 [49:01.400 --> 49:05.960] tells the district attorney what kind of cases he'll handle the county attorney what he'll handle [49:06.760 --> 49:16.760] 2.03 the very first statute that addresses something the prosecutor must do if a prosecuting [49:16.760 --> 49:23.000] attorney is made known in any manner that a public official has violated a law relating to his office [49:23.000 --> 49:30.520] he shall reduce complaint and information submitted to the grand jury shall does not mean may matter [49:30.520 --> 49:39.320] can if he wants to now 2.04 2.05 address how the prosecuting attorney will handle criminal complaints [49:39.320 --> 49:50.840] against everybody else 2.03 is a special statute exempted out of the normal procedure so it must be [49:50.840 --> 49:59.240] given special emphasis you are in Tarrant County and you have what is probably the only district [49:59.240 --> 50:08.120] attorney in the state of Texas who will abide by this rule you're in the right county at the right time [50:09.800 --> 50:18.600] Sheriff Sherrod Wilson was a judge prior to being the district attorney and she was well known for [50:18.600 --> 50:30.040] following law and this morning she followed law to the letter so with that said once you [50:31.720 --> 50:35.560] ask a public official to do something he's required to do and that's why I say never ask [50:35.560 --> 50:42.840] a public official to do anything that they're not required to do let me back up and say that right [50:42.840 --> 50:50.440] never ask a public official anything you actually want him to do because you got this little invisible [50:50.440 --> 50:57.400] tar baby and I go around to public officials and say I got this little tar baby here you want to [50:57.400 --> 51:05.160] touch it here go ahead touch it Lake Worth I get some records the judge comes I'm looking at these [51:05.160 --> 51:09.000] records the judge comes out and said Mr. Kelton you can't look at those records uh you are a [51:09.000 --> 51:14.840] security risk I'm a security risk yes Miss Kelton you're a security risk I close the records push [51:14.840 --> 51:19.720] him across the counter and the bailiff is standing there I said Mr. Bailiff did you see that yes Mr. [51:19.720 --> 51:26.360] Kelton I did arrest that woman why can't arrest her she's the judge should I know arrest her [51:26.360 --> 51:33.480] anyway well I can't arrest her this is her court oh Mr. Bailiff you are confused this is not her [51:33.480 --> 51:39.960] court this is my court and I very generously allow her to administer it according to my law she just [51:39.960 --> 51:46.040] broke one in your sight in your present arrest her well I can't arrest the judge uh let me take you [51:46.040 --> 51:52.760] down to my boss so he takes me downstairs to the elected constable and the constable said what can [51:52.760 --> 51:58.760] I do for you and I turned to the bailiff and I said arrest him arrest him why would I arrest him [51:58.760 --> 52:04.040] because he's a chicken he wouldn't arrest the judge then the guy said I'm not going to arrest [52:04.040 --> 52:10.280] the judge so the constable refused to arrest his constable so I went across to the sheriff's [52:10.280 --> 52:17.480] department and asked them to arrest the constable and while I'm waiting for a deputy to come to take [52:17.480 --> 52:23.560] my complaint the constable came over and said Mr. Kelton uh if you would like I will take your [52:23.560 --> 52:31.720] I will take your complaint to the district attorney oh no no no don't do that uh I'll get to the [52:31.720 --> 52:39.480] district attorney but I haven't got everybody to touch my tar baby yet and he said you're what [52:39.480 --> 52:45.560] I said I got this little tar baby and the judge stuck to it and and the constables your constables [52:45.560 --> 52:50.440] stuck to it and and you stuck to it now I want to get the sheriff's department to stick to it [52:50.440 --> 52:57.000] but and he stood there and watched me stick the captain of the sheriff's department to it [52:58.760 --> 53:04.760] this will have when they know that you're there setting them up [53:06.600 --> 53:16.040] you will change everything in order to do that read the code it's not as difficult as it seems [53:16.040 --> 53:22.600] I've I have yet to find a single police officer or prosecutor who has read the code [53:22.600 --> 53:29.560] and especially not someone in the school system when you've read the code and you walk them down [53:29.560 --> 53:36.920] it now you've got somebody that wants to make you happy and not have you coming back threatening [53:36.920 --> 53:44.200] their career again that's kind of the basic uh we're we're constrained on time tonight tomorrow [53:44.200 --> 53:51.400] and I'll do a --> 55:37.320] that part then they get to just blow them off they hate pro se's because every once in a while they [55:37.320 --> 55:45.640] come across the pro se from hell that judge say about two words I don't like first thing I'll do [55:45.640 --> 55:50.920] is file a motion to disqualify then I'll file a judicial conduct complaint against him with the [55:50.920 --> 55:57.400] state commission on judicial conduct and then depending on what he's done I'll file a criminal [55:57.400 --> 56:03.240] complaint with him with a local magistrate and just get everybody just to hopping up and down [56:04.360 --> 56:14.360] I get a lawyer that says something to the court that's not exactly true or a lawyer give me advice [56:14.360 --> 56:24.040] that's not correct or a lawyer fail to address an issue that's pertinent to your case a lawyer not [56:24.040 --> 56:35.720] call me back when he said he would what I'm doing here is walking down the Texas bar association [56:35.720 --> 56:43.640] standards the standards lay out standards of professional ethics and all these things I mention [56:43.640 --> 56:53.000] and go to standards and that will subject the lawyer to a bar grievance now if you file a bar [56:53.000 --> 56:58.440] grievance against the lawyer in the state of Texas be he your lawyer or be he the lawyer for the [56:59.640 --> 57:06.520] school where the lawyer advises the school board or the principal to do a certain something a [57:06.520 --> 57:11.320] certain thing if you file a bar grievance against him the state bar of Texas is going to get that [57:11.320 --> 57:17.480] bar grievance they're going to send you a letter back saying we examined into your complaint and [57:17.480 --> 57:21.480] find it does not rise to the level of misconduct and then they're going to throw it in the trash [57:23.400 --> 57:24.440] and that's a good thing [57:27.080 --> 57:32.520] the reason it's a good thing is their insurance carrier knows they're going to throw it in the [57:32.520 --> 57:40.680] trash so how does their insurance carrier measure their level of risk by valid bar grievances well [57:40.680 --> 57:47.800] heck that's all in the trash a this friend of mine's daughter the police marched into the school room [01:49:58.600 --> 01:50:05.160] two of them picked this kid up carried him off out took him in another room and just read him
