[06:21.360 --> 06:28.400] So it is my contention that absent a specific restriction [06:28.400 --> 06:32.960] by the legislature, then the legislature intended that every [06:32.960 --> 06:37.760] grand jury have power to examine into any criminal [06:37.760 --> 06:42.440] accusation, no matter where it occurred within the boundaries [06:42.440 --> 06:45.240] of the state of Texas. [06:45.240 --> 06:48.720] And that's what I'll be testing. [06:48.720 --> 06:56.760] What this will mean is if you have a problem with a public [06:56.760 --> 07:02.480] official, say in Travis County, and the Travis County district [07:02.480 --> 07:06.600] attorney interferes with your access to the grand jury, you [07:06.600 --> 07:09.480] can go file that in another county. [07:09.480 --> 07:13.520] Or if you file it in Travis County, and Travis County no [07:13.520 --> 07:23.000] bills, a no bill by a grand jury is not a bar to further [07:23.000 --> 07:27.560] presentment, what the rationale is. [07:27.560 --> 07:30.400] If you present a case to a grand jury and you have insufficient [07:30.400 --> 07:33.240] evidence, the grand jury can kick it out. [07:33.240 --> 07:36.400] When you get more evidence, you can come back and file again. [07:36.400 --> 07:41.320] Since there was a no bill, and since the accused did not [07:41.320 --> 07:50.760] participate in the hearing, then the accused is not injured [07:50.760 --> 07:52.640] in any way. [07:52.640 --> 07:56.840] So if you find more evidence, you can come back and keep [07:56.840 --> 07:59.840] filing until you get an indictment. [07:59.840 --> 08:07.120] Or if the way I'm reading the law turns out to be accurate, [08:07.120 --> 08:09.440] then you can take it to any other grand jury in the state [08:09.440 --> 08:11.640] you want to. [08:11.640 --> 08:18.200] While someone may violate a law in a county you're in and [08:18.200 --> 08:20.880] happen to be good buddies with the prosecutor attorney, [08:20.880 --> 08:23.760] the prosecutor attorney doesn't want to prosecute him, or [08:23.760 --> 08:26.640] perhaps this person is a public official in the county [08:26.640 --> 08:31.680] you're in and has a considerable amount of [08:31.680 --> 08:32.920] political clout. [08:35.040 --> 08:38.760] He's not likely to have as much political clout in a county on [08:38.760 --> 08:42.040] the other side of the state as he does here. [08:42.040 --> 08:46.960] So this would open the door to taking a complaint against anyone [08:46.960 --> 08:50.520] to any grand jury in the state of Texas. [08:50.520 --> 08:56.200] That would be the first crack in their cosmic egg, and I [08:56.200 --> 09:00.200] hope to have mine prepared and filed tomorrow. [09:00.200 --> 09:04.640] And I'll let you know tomorrow evening how that works out. [09:04.640 --> 09:08.320] We do have Jeff from Mississippi on. [09:27.800 --> 09:32.800] And I have been studying the power of an affidavit and the [09:32.800 --> 09:35.000] power of testimony. [09:35.000 --> 09:39.240] And this is something that I have never really put much [09:39.240 --> 09:40.560] weight into. [09:40.560 --> 09:44.360] Most of the time that I go to court, I either don't testify, [09:44.360 --> 09:46.920] or if I do, it's over something silly. [09:46.920 --> 09:50.520] I just defend myself on stupid questions. [09:50.520 --> 09:55.600] So the things that I've been studying are, if I get up and [09:55.600 --> 10:02.040] testify, to put in affidavits and actually read the [10:02.040 --> 10:06.200] affidavit into the microphone while I'm testifying. [10:06.200 --> 10:10.600] And also, that motions really don't have much power unless [10:10.600 --> 10:12.640] they're sworn to. [10:12.640 --> 10:16.960] And then if I get up and testify, that they are also [10:16.960 --> 10:18.560] true and fact. [10:18.560 --> 10:20.560] So I have a motion. [10:20.560 --> 10:20.920] Hold on. [10:20.920 --> 10:25.160] Let me correct a little bit, a misconception there. [10:25.160 --> 10:27.800] A motion, depending on what it is, may not [10:27.800 --> 10:29.600] need to be sworn to. [10:29.600 --> 10:33.720] The only time the motion needs to be sworn to is when it [10:33.720 --> 10:36.960] contains statements of fact. [10:36.960 --> 10:39.920] The statements of fact must be sworn to. [10:39.920 --> 10:44.440] If you're just asking the judge to do something, like [10:44.440 --> 10:48.800] grant a continuance, or a continuance sometimes needs a [10:48.800 --> 10:53.760] sworn affidavit, but if you're asking the judge maybe to [10:53.760 --> 11:00.600] postpone the case for some holiday or something, you don't [11:00.600 --> 11:03.080] have to testify that there's a holiday. [11:03.080 --> 11:06.240] So it doesn't need to be verified. [11:06.240 --> 11:11.040] Only if there are material facts stated in the motion [11:11.040 --> 11:12.640] then they need to be verified. [11:12.640 --> 11:15.280] OK, I'll stop you to work on it now. [11:15.280 --> 11:19.920] So with my motion hearing coming up, my question is, is [11:19.920 --> 11:24.120] as soon as the hearing starts, as soon as it commences, do I [11:24.120 --> 11:26.720] need to demand the judge to swear me in immediately? [11:30.400 --> 11:34.200] No, this is a criminal case. [11:34.200 --> 11:43.680] And as I understand, unless you have an opportunity to [11:43.680 --> 11:48.800] present evidence prior to the prosecution, you wouldn't be [11:48.800 --> 11:51.520] able to do that. [11:51.520 --> 11:54.320] The only time you'd be sworn in is if you were going to [11:54.320 --> 11:57.560] present testimony. [11:57.560 --> 12:00.280] And the way a criminal case works is a prosecutor gets to [12:00.280 --> 12:02.480] do his thing first. [12:02.480 --> 12:06.560] OK, because I do have the land title for the campus [12:06.560 --> 12:11.280] apartments, and they also never had [12:11.280 --> 12:12.960] transcripts to the grand jury. [12:12.960 --> 12:15.720] The things that I've been studying, and you can clarify [12:15.720 --> 12:20.440] this, basically in a nutshell I've heard, or this is what [12:20.440 --> 12:23.600] I've translated, is that if you get up and you start [12:23.600 --> 12:26.760] speaking in front of the judge or arguing or this and that, [12:26.760 --> 12:30.680] that the judge can't hear anything you have to say until [12:30.680 --> 12:32.640] you are sworn in. [12:32.640 --> 12:33.880] Not true. [12:33.880 --> 12:35.320] OK. [12:35.320 --> 12:42.720] OK, if you are a litigant or you are an agent for a [12:42.720 --> 12:47.400] litigant, you can argue the law before the court, but you [12:47.400 --> 12:48.640] cannot testify. [12:52.640 --> 12:54.120] You can't testify. [12:54.120 --> 12:57.320] The prosecutor can't testify. [12:57.320 --> 13:01.320] If the prosecutor states anything to the court or the [13:01.320 --> 13:05.240] jury as a fact, you object. [13:05.240 --> 13:09.360] Now in the voir dire, or in the opening statement to the [13:09.360 --> 13:15.240] jury, the prosecutor will say, the prosecution will prove [13:15.240 --> 13:16.640] this. [13:16.640 --> 13:20.840] Then he can state what appear to be facts, but they're not [13:20.840 --> 13:23.040] facts before the court. [13:23.040 --> 13:25.600] He's just telling them what he's going to prove. [13:25.600 --> 13:29.600] Now if he comes before the court and he makes a direct [13:29.600 --> 13:31.240] statement of fact, you object. [13:31.240 --> 13:33.080] He can't do that. [13:33.080 --> 13:34.200] Got it. [13:34.200 --> 13:40.560] That has to be in the form of a witness sworn in or whatever [13:40.560 --> 13:42.920] the facts are that need to be entered in accordance to the [13:42.920 --> 13:44.160] rules of evidence. [13:47.280 --> 13:52.040] The agent cannot testify to the court. [13:52.040 --> 13:58.280] So when you are an advocate for yourself, you can raise [13:58.280 --> 14:01.960] issue of law or you can address facts that [14:01.960 --> 14:05.040] are before the court. [14:05.040 --> 14:10.280] But you can't bring facts before the court out of your [14:10.280 --> 14:14.080] own mouth unless you're sworn in. [14:14.080 --> 14:19.160] If you have a sworn affidavit that's included in a document [14:19.160 --> 14:21.600] that has been filed with the court, you can [14:21.600 --> 14:25.040] address that document. [14:25.040 --> 14:26.320] OK. [14:26.320 --> 14:29.560] Do you have to swear in and get up on the witness stand and [14:29.560 --> 14:33.560] read that affidavit into the microphone? [14:33.560 --> 14:37.400] Not if the affidavit is included as an attachment to [14:37.400 --> 14:39.280] a motion. [14:42.160 --> 14:45.000] Then it's before the court. [14:45.000 --> 14:49.920] But if you want to testify, if you want to bring evidence, [14:49.920 --> 14:55.840] when it becomes your time, it's a little cumbersome for [14:55.840 --> 15:00.000] the pro se to get up on the stand and ask himself questions [15:00.000 --> 15:01.840] and then answer the questions. [15:01.840 --> 15:06.000] So what is normally done is the pro se will do essentially [15:06.000 --> 15:11.320] what you have done and prepare an affidavit and ask the court [15:11.320 --> 15:16.520] for leave to read the affidavit onto the record. [15:16.520 --> 15:19.800] But once you're finished with the affidavit, then you'll be [15:19.800 --> 15:21.040] open to cross-examination. [15:21.040 --> 15:25.240] Have you watched some trials to see how they handle [15:25.240 --> 15:26.480] examination and cross? [15:30.360 --> 15:33.360] Kinds of things they can ask, kinds of things they can't ask. [15:38.120 --> 15:40.000] That took too long to answer. [15:40.000 --> 15:42.920] You really need to do that. [15:42.920 --> 15:46.240] Now, do you have a motion in limine before the court? [15:46.240 --> 15:51.600] Do you have a motion in limine before the court? [15:51.600 --> 15:52.360] Yes, I do. [15:52.360 --> 15:54.960] But it's not an affidavit form. [15:54.960 --> 15:55.600] Doesn't need to be. [15:55.600 --> 16:02.880] Motion in limine is just asking the judge to rule that the [16:02.880 --> 16:05.680] other side can't ask this question, can't ask that [16:05.680 --> 16:07.960] question, can't ask the other question. [16:07.960 --> 16:09.600] That doesn't need to be an affidavit form. [16:09.600 --> 16:12.600] That's not straight in the fact. [16:12.600 --> 16:16.080] You've got some patriots out there that say the only thing [16:16.080 --> 16:18.760] that matters before the court is an affidavit. [16:18.760 --> 16:21.440] And that's because they really don't understand [16:21.440 --> 16:23.840] how the court works. [16:23.840 --> 16:26.200] They don't file motions, they file affidavits. [16:26.200 --> 16:30.200] Well, an affidavit is just a statement of facts. [16:30.200 --> 16:32.640] It's a verified statement of facts. [16:32.640 --> 16:36.880] It does not move the court. [21:14.820 --> 21:20.820] However, with that said, if you file a motion and it's not verified. [21:20.820 --> 21:27.820] And if the law is the same in Mississippi, it most likely is in this regard. [21:27.820 --> 21:32.820] If the other party doesn't object, no harm, no foul. [21:32.820 --> 21:38.820] If the other party does object, then the judge himself can verify. [21:38.820 --> 21:42.820] Or he can give you opportunity to file a verified motion. [21:42.820 --> 21:49.820] So that's, it's almost never, it's not sudden death unless the judge is out to get you. [21:49.820 --> 21:57.820] But if you verify a motion that doesn't need to be verified, doesn't hurt anything. [21:57.820 --> 22:02.820] So when in doubt, verify. Does that make sense? [22:02.820 --> 22:09.820] Yeah, it does. I was just afraid of, you know, arguing and speaking my motions [22:09.820 --> 22:12.820] and then having none of it be heard for my appeal. It goes into the record unless the other side objects to it going into the record. [22:22.820 --> 22:23.820] Okay. [22:23.820 --> 22:27.820] They would have to ask the judge to strike. [22:27.820 --> 22:31.820] And then you have opportunity to argue the issue. [22:31.820 --> 22:40.820] And then the issue of that not going into the record gives you an option to appeal. [22:43.820 --> 22:47.820] And this is a big problem because it's happened two or three other hearings [22:47.820 --> 22:50.820] and it's so small that I haven't caught it. [22:50.820 --> 22:52.820] So now I'm looking out for it. [23:11.820 --> 23:15.820] And the judge will sit there and shut that entire hearing down and try to reschedule it [23:15.820 --> 23:20.820] and then ask me to send the paperwork or the motion to another address or something. [23:20.820 --> 23:23.820] And I know they're just stalling. They're just playing games. [23:23.820 --> 23:26.820] What would you do if the judge said that to you? [23:26.820 --> 23:30.820] Well, I never got your motion. It wasn't mailed to my personal office. [23:30.820 --> 23:34.820] That's what the judge wanted was, well, it needs to be mailed to my personal office. [23:34.820 --> 23:39.820] And then the DA said, well, I need it mailed to my personal office too. [23:39.820 --> 23:44.820] Did you mail it to the certified mail return receipt? [23:44.820 --> 23:47.820] Yes. I mailed that to the clerk. [23:47.820 --> 23:52.820] And then the DA has an office at the clerk's office. [23:52.820 --> 23:56.820] So I basically just sent two copies there. [23:56.820 --> 24:00.820] And then, of course, during the hearing, well, I need it sent to my home in Florida, [24:00.820 --> 24:03.820] you know, that kind of a thing. [24:03.820 --> 24:06.820] And they're going to do that again. [24:06.820 --> 24:09.820] And I want to stop them. [24:09.820 --> 24:16.820] Then that should, if they, okay, this is a circuit court, right? [24:16.820 --> 24:17.820] Yes. [24:17.820 --> 24:20.820] How long is the circuit court in town? [24:20.820 --> 24:22.820] For two weeks. [24:22.820 --> 24:27.820] Good. Are you at the front or the end of that two weeks? [24:27.820 --> 24:31.820] I'll be, my motion hearing will be at the front. [24:31.820 --> 24:35.820] Get yourself a petition for writ of mandamus. [24:35.820 --> 24:37.820] Assume they're going to do this. [24:37.820 --> 24:46.820] Prepare a petition for writ of mandamus for the court of appeals and have it in hand. [24:46.820 --> 24:51.820] And when they pull this stuff, you object. [24:51.820 --> 24:55.820] When they overrule your objection, then you notify the court. [24:55.820 --> 24:59.820] I have a writ of mandamus in my hand. [25:41.820 --> 25:52.820] You explain what they've been doing, that this is an ongoing practice of the court in order to punish anyone who forces the court to hold trial. [25:52.820 --> 25:59.820] They've done this before, and you've taken special pains to ensure that they actually receive the documents in question. [25:59.820 --> 26:05.820] And this is a due process violation and ask this court to order them to do what they're supposed to. [26:05.820 --> 26:07.820] It's pretty straightforward. [28:33.820 --> 28:41.820] At any rate, I called in about this a month ago saying that they still hadn't served us. [28:41.820 --> 28:47.820] We finally got a service taped to our door. [28:47.820 --> 28:54.820] It sounded interesting because it was an order for substitute service, and my wife's at home all the time. [28:54.820 --> 28:57.820] We haven't really been ducking them or anything. [28:57.820 --> 29:11.820] She's actually kind of been eager to get this ball going, and what I found interesting on it was the letter of substitute service that posted on the door [29:11.820 --> 29:19.820] was the order for substitute service and has all the different things. We tried doing this and whatnot, signed by the lawyer, [29:19.820 --> 29:25.820] and then it has a spot for the judge to sign it, and it's blank. [29:25.820 --> 29:38.820] By the odds, I went and got and printed off everything on this different face docket, and come to find out the order was denied. [29:38.820 --> 29:47.820] Oh, wonderful. [34:57.820 --> 35:02.820] No, yeah, they never sent any certified mail. We would have received that. [35:02.820 --> 35:13.820] So they were just doing this. I don't know why they would do this. Why wouldn't they send mail? Are they trying to get a default judgment? [35:13.820 --> 35:23.820] I don't know. I mean, it seems kind of awkward once again that I have no idea how to get in the mind of what they're trying to do. [35:23.820 --> 35:27.820] I mean, for a while they were just dragging their feet. [35:27.820 --> 35:38.820] If you're not, if you're only waiting for them to serve you just as a point of law, but you'd rather get to the adjudication of the issue, [35:38.820 --> 35:55.820] go ahead and respond, and once you respond, you check the record and ask for sanctions against counsel for filing a false and frivolous, oh, wait a minute, overshadowing. [35:55.820 --> 36:05.820] They claimed to you, hold on, they claim to you that this was authorized by the court? [36:05.820 --> 36:10.820] That's what it looks to me. They seem to be sending me a legal document. [36:10.820 --> 36:19.820] That sounds like Santiago Mackie. [36:19.820 --> 36:29.820] Oh, this is too good. Back to the rule, never interfere with someone when they're screwing up. [36:29.820 --> 36:45.820] Yeah, so that's what I was trying to figure out. I was like, well, what to do with this one? I mean, I actually have the answer ready. It's all typed up, you know, but now what do I do? Do I go after them criminally? [36:45.820 --> 37:00.820] You know what I mean? You counter sue for filing a false document, for presenting a false document. The judge is not likely to be happy with these guys at all. [37:00.820 --> 37:03.820] Oh, I would think not. [37:03.820 --> 37:04.820] He finds out. [37:04.820 --> 37:09.820] I would try to begin with, or else why would they have denied it? [37:09.820 --> 37:20.820] That is interesting. Sometimes when I think I've heard the stupidest thing I've come across, you come up with something better. [37:20.820 --> 37:35.820] So, you know, if I was the judge and I denied them something directly after they asked for it and they did it anyway, I would think they're not too impressed with me. [37:35.820 --> 37:46.820] So you might sue them and ask for some punitive amount, ask for sanctions against them. [37:46.820 --> 38:15.820] And it's hard for you to claim harm. Well, you might wait a few days and then go take that thing out and throw it in a mud puddle and tell them that the next door neighbor pulled this in out of the front yard of his front yard. [38:15.820 --> 38:21.820] That's what I'm trying to get to. What is the problem with service by sticking it on your front door? [38:21.820 --> 38:37.820] And I don't have a problem necessarily with service by sticking it on the front door. I mean, if they put all points of law, I don't care about service. You know, they stuck it in my hand. We're fine with that. It's the fact that personally I think they did something. [38:37.820 --> 38:50.820] Okay, then instead of a counterclaim against him because you really haven't been harmed, you don't have much of a claim. But I would ask for sanctions. [38:50.820 --> 38:53.820] And what does sanctions mean exactly? [38:53.820 --> 39:07.820] That means this is probably what skewers lawyers more than anything. I was talking to Jeff Kelly, the one, the guy that Steve Skidmore works for. [39:07.820 --> 39:24.820] And he said sanctions. These judges, they can give you sanctions for any amount they want to. There's no restriction. They can put you out of business. Lawyers are terrified about sanctions. [39:24.820 --> 39:41.820] Can you ask for sanctions for lying about judges for filing a fraudulent document or presenting you with a fraudulent document? The judge is not likely to be very happy. [39:41.820 --> 39:52.820] Yeah, I know that they didn't send me a copy with the stamp denied on it. They sent me a copy without the stamp denied on it. [39:52.820 --> 40:05.820] And you look at it and say that, you know, I noticed that the motion did not have a judge's signature on it. So therefore, I checked the record and sure enough, there was a decision. [40:05.820 --> 40:11.820] Does the one in the record have the judge's signature and mark denied? [40:11.820 --> 40:14.820] Oh, yes. I have it right in front of me. [40:14.820 --> 40:19.820] This is pretty serious. [40:19.820 --> 40:23.820] There's no other way. It's not like this one was denied and then they applied for another one. [40:23.820 --> 40:36.820] No, this is everything that's in the court docket and in the case docket. And this is the only one that's clearly marked denied in the biggest, boldest letters you can put on there. [40:36.820 --> 40:47.820] They sent you one. Oh, this should get you a good shot at them. You may get enough to pay for the credit card. [40:47.820 --> 40:55.820] Oh, lawsuits only, I mean, the credit card is only $1,500. I'm thinking cost-benefit analysis. They won't have liked that they took this case on. [40:55.820 --> 41:00.820] Have you did the debt validation routine on them? [41:00.820 --> 41:06.820] I'm about to. No, that's the same. That's part of, I do have the Michael. [41:06.820 --> 41:12.820] Debt validation needed to be done before the suit. So you haven't seen that suit yet. [41:12.820 --> 41:33.820] File the debt validation letter and then in a couple of days your neighbor will bring you this document he found blowing down the street with your name on it. [41:33.820 --> 41:38.820] That ought to make them unhappy. That's the way you get your debt validation letter in. [41:38.820 --> 41:42.820] And why is that important that you get the debt validation before the lawsuit? [41:42.820 --> 41:49.820] Once there's a lawsuit, then that kind of preempts the debt validation letter. [41:49.820 --> 42:00.820] Debt validation letter subjects the lender to statutory estoppel for many further collections until he validates the debt. [42:00.820 --> 42:10.820] So anybody out there with credit cards, send a credit card. If they're calling you, if you're behind and they're calling, send a debt validation letter. [42:10.820 --> 42:16.820] And all the debt validation letter is, there's no special verbiage. [42:16.820 --> 42:23.820] You just essentially tell them you sent me this demand that I pay you money. [42:23.820 --> 42:28.820] I don't know who you are. I don't know that I entered into a contract with you. [42:28.820 --> 42:32.820] I dispute this debt. Please prove it up. [42:32.820 --> 42:36.820] That's a debt validation letter. It doesn't have to say debt validation or any of that. [42:36.820 --> 42:42.820] It doesn't have to cite the code. Just ask them to prove it up. [42:42.820 --> 42:49.820] Until they prove it up, they're subject to statutory estoppel for many further collection efforts. [42:49.820 --> 42:57.820] Now if they're calling you, this is how you change the calling practices from a problem to entertainment. [42:57.820 --> 43:05.820] Because you put a ledger next to the phone and every time they call, you mark $1,500, $1,500. [43:05.820 --> 43:15.820] If you have a pretty good size debt, you might have to annoy the caller a little bit to make sure he calls back after you hang up on him. [43:15.820 --> 43:19.820] You get him good and mad, maybe he'll call you two or three times. [43:19.820 --> 43:27.820] $1,500. And when the $1,500 exceeds the amount that's owed, then you file a federal lawsuit. [43:27.820 --> 43:32.820] And the federal judges will actually enforce this one. There's a couple others out in the high desert. [01:04:25.820 --> 01:04:29.820] And only two of the properties have any buildings or structures on them. [01:04:29.820 --> 01:04:39.820] Where she lives in her home down in Colton, California, down in the valley, and one in Pinion Hills near Phelan outside the Wrightwood area, [01:04:39.820 --> 01:04:49.820] which is sort of mountainous on the desert side. It's down, let's see, on the side, not too far away from Victorville, Atlanta, and Hisperia. [01:04:49.820 --> 01:04:55.820] And one other property, actually there's three, correction, there's three that the house I'm talking about over in Lucerne Valley, [01:04:55.820 --> 01:05:07.820] which is about 50, 60 miles east of San Bernardino, which is maybe 30 miles, 20, 30 miles from Victorville, California. [01:05:07.820 --> 01:05:18.820] And some group of, I guess a better word to use would be dirtbags, went in there and cleaned her house out, [01:05:18.820 --> 01:05:27.820] stealing all kinds of appliances, electronics, bicycles, everything she had, musical equipment, medicine, syringes, all kinds of stuff. [01:05:27.820 --> 01:05:32.820] She's a retired nurse, so she had a lot of medical equipment that she kept up there and stored, [01:05:32.820 --> 01:05:40.820] and coins that she had, some silver, I don't know if she had gold coins, but she had collections of silver coins, [01:05:40.820 --> 01:05:47.820] and all the, I believe the copies of the deeds to her parcel land properties. [01:05:47.820 --> 01:05:53.820] And I wanted to find out for her what she needs to do, and if she's all right at this point. [01:05:53.820 --> 01:06:01.820] She claims that she still receives tax notices, property tax notices on those properties. [01:06:01.820 --> 01:06:05.820] Yes, recovering the deeds is no good deal at all. [01:06:05.820 --> 01:06:06.820] Okay. [01:06:06.820 --> 01:06:14.820] The warranty deed, or I forget what it's called, and it's got a different name in California, but it's essentially the same thing. [01:06:14.820 --> 01:06:23.820] That's the deed that grants her ownership, and any other documents, like if there's liens against any of them, they'll all be in there. [01:06:23.820 --> 01:06:32.820] But if you just go to the county recorder for the county the property's in, just do a search on her name, those will pop right up. [01:06:32.820 --> 01:06:35.820] And then you just have the clerk print you out a new one. [01:06:35.820 --> 01:06:40.820] Okay. I'll probably have to do that for her. She's not computer savvy. [01:06:40.820 --> 01:06:45.820] You can probably just call the counties and explain it to the clerk. [01:06:45.820 --> 01:06:49.820] Clerks, I tell people never mess with the clerks. [01:06:49.820 --> 01:06:55.820] The clerks are really helpful. They really try to get along with you. [01:06:55.820 --> 01:07:01.820] If you call and tell them what's happened, they will probably print you out one and mail it to you. [01:07:01.820 --> 01:07:04.820] Okay. Excellent. [01:07:04.820 --> 01:07:13.820] Now here's another type of criminal element that's affecting her life and harassing her and terrorizing her. [01:07:13.820 --> 01:07:30.820] The county of San Bernardino code enforcement has decided to start sending her notices to her property in the city of Colton at the house where she lives at because of four inch high grass. [01:07:30.820 --> 01:07:35.820] She owns the land. She owns the house, free and clear. [01:07:35.820 --> 01:07:46.820] She has an old car that's inside of the fence, inside on her driveway, inside on her property that's broke down and is not operable. [01:07:46.820 --> 01:07:49.820] Put a tarp over it. I'm sorry. [01:07:49.820 --> 01:07:52.820] Put a tarp over it. [01:07:52.820 --> 01:07:55.820] Yeah, she has a tarp over it. [01:07:55.820 --> 01:07:58.820] It ain't there. They can't see it. [01:07:58.820 --> 01:08:03.820] But they see through the fence there because she has a clear cyclone fence. [01:08:03.820 --> 01:08:09.820] But if it's got a tarp over it, they can't see it. All they can see is there's a tarp in the yard. [01:08:09.820 --> 01:08:20.820] Well, this is what's happened. They sent notices to her and they've been consistent in sending her notices that she needs to remove that car. [01:08:20.820 --> 01:08:31.820] And they're sending her notices that each time that they give her notices and reminder notices, they increase the fine that they're trying to impose on her. [01:08:31.820 --> 01:08:34.820] You need to respond to that. [01:08:34.820 --> 01:08:39.820] You can probably find the city code online. [01:08:39.820 --> 01:08:49.820] And every city that I've looked at has a tarp provision. [01:08:49.820 --> 01:08:52.820] If you can't see it, it's not there. [01:08:52.820 --> 01:08:58.820] I live next door to City Hall and I had this 40 foot bus out there. [01:08:58.820 --> 01:09:02.820] I bought the house next to me and tore it down. It's got a big lot up. [01:09:02.820 --> 01:09:07.820] And the mayor came out and told me I'd have to move that bus. [01:09:07.820 --> 01:09:12.820] He come by the next day and I had a tarp over it. [01:09:12.820 --> 01:09:17.820] He went into the City Hall and I could hear Joy. Joy's been there forever. [01:09:17.820 --> 01:09:21.820] Just cackling like a hyena. [01:09:21.820 --> 01:09:28.820] I talked to her later and the mayor come running in and asked if I had been in there looking at the city ordinances. [01:09:28.820 --> 01:09:31.820] She said, well, yes, a matter of fact, he has. [01:09:31.820 --> 01:09:38.820] Well, do you have to know what ordinance he looked at? Yeah, just so happens I do because she pointed it out to me. [01:09:38.820 --> 01:09:43.820] She showed it to the mayor and he hasn't spoke to me since. [01:09:43.820 --> 01:09:49.820] But I left that bus out there for three or four years until that tarp just deteriorated. [01:09:49.820 --> 01:09:55.820] And I didn't move it just to annoy the mayor. [01:09:55.820 --> 01:09:57.820] But anyway, check the code. [01:09:57.820 --> 01:10:07.820] You know, if you buy exotic automobiles for investment, and that's primarily what this is for, [01:10:07.820 --> 01:10:18.820] or you have a like a restoration vehicle that's not roadworthy because you're restoring it or it's an exotic vehicle [01:10:18.820 --> 01:10:21.820] that's for investment, you would never put it on the road anyway. [01:10:21.820 --> 01:10:24.820] So you don't have a license and sticker. [01:10:24.820 --> 01:10:30.820] So you put it under tarps and that way it doesn't make an eyesore for the neighborhood. [01:10:30.820 --> 01:10:32.820] So you check the code. [01:10:32.820 --> 01:10:38.820] And if the code allows it to be tarped, then every filing that this whoever has made, [01:10:38.820 --> 01:10:45.820] you file against them for tampering with the government document and official oppression. [01:10:45.820 --> 01:10:49.820] You find a whole lot of stuff to throw at them. [01:10:49.820 --> 01:10:53.820] I just had my wife bought a $5,000 couch. [01:10:53.820 --> 01:10:55.820] My daughter talked her into it. [01:10:55.820 --> 01:10:58.820] And once she got it, it was miserable. [01:10:58.820 --> 01:11:00.820] And we called them out to fix it. [01:11:00.820 --> 01:11:04.820] And they stuffed it with garbage stuffing to make it too tight. [01:11:04.820 --> 01:11:06.820] And then the stuffing would collapse. [01:11:06.820 --> 01:11:08.820] And it was a mess. [01:11:08.820 --> 01:11:15.820] And they told me they'd take it back, but you had to pay a 40% restocking fee. [01:11:15.820 --> 01:11:22.820] So I sent them a statement of facts and asked them to confirm or deny any of these facts, [01:11:22.820 --> 01:11:25.820] let me know if I had any facts incorrect. [01:11:25.820 --> 01:11:31.820] And instead of doing that, they sent me back a letter telling me what great catches they made. [01:11:31.820 --> 01:11:40.820] So I prepared another letter and included in the letter the complaint I filed [01:11:40.820 --> 01:11:43.820] with the Better Business Bureau stating all of these problems. [01:11:43.820 --> 01:11:50.820] You see now they can't dispute these issues now because I already gave them the statement of facts. [01:11:50.820 --> 01:11:53.820] And they had an opportunity to dispute and they didn't. [01:11:53.820 --> 01:11:59.820] So I put the body of the Better Business Bureau complaint into this letter. [01:11:59.820 --> 01:12:05.820] And essentially it's a tort letter that I have been harmed. [01:12:05.820 --> 01:12:11.820] I have been harmed by the following colon and I dropped that complaint in there. [01:12:11.820 --> 01:12:17.820] And then I put a sentence at the bottom, you have 30 days to make, behold, or be sued. [01:12:17.820 --> 01:12:24.820] Two days later, they asked when could they come and pick up that couch and give us all our money back. [01:12:24.820 --> 01:12:31.820] So the point is don't call them and argue with them. [01:12:31.820 --> 01:12:34.820] Don't try to reason with them. [01:12:34.820 --> 01:12:38.820] Reasoning with one another is what civil human beings do. [01:12:38.820 --> 01:12:43.820] This is law. This is not civil human beings. [01:12:43.820 --> 01:12:48.820] And in law, I have a personal rule. [01:12:48.820 --> 01:12:53.820] Never ask a public official to do anything you actually want him to do. [01:12:53.820 --> 01:13:01.820] Because you never ask a public official to do anything that the law does not specifically require him to do so you get to thump him for it. [01:23:08.820 --> 01:23:10.820] He's around 80 years old. [01:23:10.820 --> 01:23:11.820] He's done a lot of things for her. [01:23:11.820 --> 01:23:17.820] He's posted notices on the properties to not trespass on the properties, and [01:23:17.820 --> 01:23:22.820] he sent some grievances back to the county code enforcement of the county of [01:23:22.820 --> 01:23:28.820] San Bernardino concerning this, and they held off a little while, but every [01:23:28.820 --> 01:23:33.820] once in a while they'll continue again sending notices to her, so I don't know. [01:34:34.820 --> 01:34:37.820] In DPS, I had commercials. [01:34:37.820 --> 01:34:42.820] You know, if you don't feel safe, drive to a safe location that's well lit and all this other stuff. [01:34:57.820 --> 01:35:10.820] And down the road I was traveling, from where he turned around and turned his lights on to where I was going, there are no turns. [01:35:37.820 --> 01:35:52.820] The administrative code that creates the DPS very clearly states the Department of Public Safety may not enforce the criminal laws, [01:35:52.820 --> 01:36:04.820] except at the request of and under the direction of local law enforcement, the legislature did not stutter. [01:36:04.820 --> 01:36:08.820] I understand that. [01:36:08.820 --> 01:36:17.820] Now, let me back up here and give you something that was told to me yesterday about what happened all day long on Monday. [01:36:17.820 --> 01:36:23.820] The Border Patrol out here decided that they could not go out and do what they normally do, [01:36:23.820 --> 01:36:26.820] and drive up and down the highway because it was so muddy and everything. [01:36:26.820 --> 01:36:32.820] We do get rain in West Texas once in a blue moon, so don't believe that we don't. [01:36:32.820 --> 01:36:38.820] And so what they decided to do is drug enforcement interdiction. [01:36:38.820 --> 01:36:46.820] And what they were doing was they would pick out somebody or an automobile that they wanted to have stopped. [01:36:46.820 --> 01:36:54.820] They would call the sheriff's office dispatch and tell them, have an officer go out and stop that automobile. [01:36:54.820 --> 01:36:57.820] That was their articulated probable cause. [01:36:57.820 --> 01:37:03.820] We both know what Border Patrol's jurisdiction is out here, and that is ZILT.0. [01:37:03.820 --> 01:37:12.820] And I've got that again out of the new TCCP, Chapter 2, and they are not peace officers. [01:37:12.820 --> 01:37:16.820] The jurisdiction is limited to very specific locations. [01:37:16.820 --> 01:37:27.820] And the Medina case out of, I think it was California, is a federal law case. [01:37:27.820 --> 01:37:31.820] The federal judge ruled that the Border Patrol may not do drug interdiction. [01:37:31.820 --> 01:37:34.820] It is against their charter. [01:37:34.820 --> 01:37:43.820] If they come across drugs in their normal duties, then they can make detention. [01:37:43.820 --> 01:37:48.820] But they have to turn whoever or whatever over to local law enforcement. [01:37:48.820 --> 01:37:56.820] They cannot direct local law enforcement in any actions, and that's what they were doing. [01:37:56.820 --> 01:38:03.820] And I was talking to a retired deputy sheriff yesterday, and she told me that what they were doing is called profiling. [01:38:03.820 --> 01:38:15.820] And last weekend, somebody tried going through my property and getting out the north end to another ranch. [01:38:15.820 --> 01:38:20.820] And on that gate is a high-security lock. [01:38:20.820 --> 01:38:22.820] That lock belongs to somebody else. [01:38:22.820 --> 01:38:31.820] I had two keys that belonged to that lock and some equipment that's all locked up with high-security locks up on the other property. [01:38:31.820 --> 01:38:39.820] Those two keys were stolen from me when I was finally stopped by that same DPS officer. [01:38:39.820 --> 01:38:43.820] What was his original probable cause? [01:38:43.820 --> 01:38:50.820] According to him, his original probable cause was I was doing 65 in a 60. [01:38:50.820 --> 01:38:55.820] And he's saying that the signs are prima facie evidence of the speed limit. [01:38:55.820 --> 01:39:01.820] Well, you know me, Randy. I don't travel fast. [01:39:01.820 --> 01:39:06.820] And being handicapped, I'm definitely not going to travel 65 down that road. [01:39:06.820 --> 01:39:10.820] I was doing 60 cruise control set. [01:39:10.820 --> 01:39:20.820] I've been doing 60 coming down from Sheffield, already past Ranch Road 2400, and had gotten down further past that. [01:39:20.820 --> 01:39:24.820] And it was a decline that I'd already started on. [01:39:24.820 --> 01:39:29.820] So yeah, could have picked up a few, you know, two, three miles an hour. [01:39:29.820 --> 01:39:33.820] It's an old van, full-size, three-quarter ton. [01:39:33.820 --> 01:39:36.820] I've got my power wheelchair in there and everything else. [01:39:36.820 --> 01:39:40.820] And he said he was going to stop me, just give me a warning, and let me go. [01:39:40.820 --> 01:39:52.820] Well, if that was the case, then when I signaled him and everything else, and he admitted, he recognized my signals to him. [01:39:52.820 --> 01:40:07.820] But things just don't jive here, because the only things taking off my key ring were those keys to those high-security locks. [01:40:07.820 --> 01:40:09.820] Has anybody? [01:40:09.820 --> 01:40:19.820] With the knowledge of the profiling going on, I've got a fact witness to the fact of listening to the radio dispatches and everything else. [01:40:19.820 --> 01:40:27.820] We've requested the tapes and everything else right now under PIR, but I'm going to submit a motion to the court, [01:40:27.820 --> 01:40:34.820] because apparently it's already gone up to the district court for demand of... [01:40:34.820 --> 01:40:38.820] Let me make a suggestion. [01:40:38.820 --> 01:40:43.820] I was on my way to do this today, but other things interfere. [01:40:43.820 --> 01:40:45.820] Tomorrow I will do this. [01:40:45.820 --> 01:40:55.820] I'm going to go to the Tarrant County grand jury, Fort Worth, and file criminal charges against the Dallas County grand jury. [01:40:55.820 --> 01:41:06.820] I'm sorry, against the Dallas County district attorney for denying me access to the Dallas County grand jury. [01:41:06.820 --> 01:41:08.820] See the value? [01:41:08.820 --> 01:41:20.820] My argument is this, that while the grand jury was impaneled by a district judge who has statewide jurisdiction, [01:41:20.820 --> 01:41:35.820] but is restricted to a specific and limited venue, there is nothing in law that likewise limits the jurisdiction of a state grand jury. [01:41:35.820 --> 01:41:44.820] I can find nothing that would prevent me from taking a complaint to any grand jury in the state of Texas. [01:41:44.820 --> 01:41:52.820] I can probably give you five or six things that would help you with your argument there. [01:41:52.820 --> 01:41:59.820] Bring your complaint against these guys to Travis County. [01:41:59.820 --> 01:42:10.820] Well, what I did was I signed a... We had at the traffic stop location itself, border patrol, then 12 of them, [01:42:10.820 --> 01:42:16.820] two deputies, the chief deputy and one of the others, and then this DPS officer. [01:42:16.820 --> 01:42:19.820] Everybody had guns out except for me. [01:42:19.820 --> 01:42:22.820] All I got to do was eat pavement. [01:42:22.820 --> 01:42:29.820] And when he removed my keys from my pocket after I was handcuffed and everything as if I'm really dangerous, [01:42:29.820 --> 01:42:40.820] he told me I was not getting my keys back on the inventory sheet that was done by him, which he's not allowed to do. [01:42:40.820 --> 01:42:47.820] The tow truck driver is bonded and he's supposed to do the inventory, not the peace officer. [01:42:47.820 --> 01:42:52.820] Hold on. He's not acting. He's not a peace officer. [01:42:52.820 --> 01:42:58.820] He may be a peace officer, but he's not employed in the capacity of a peace officer. [01:42:58.820 --> 01:43:03.820] He's employed in the capacity of a police officer. [01:43:03.820 --> 01:43:04.820] Yeah. [01:47:47.820 --> 01:47:51.820] I thought it was just the diesel fumes causing deadheading. [01:47:51.820 --> 01:47:53.820] No, I wasn't able to get to it. [01:47:53.820 --> 01:47:59.820] Will you kind of explain what the document was about for everybody else who's listening? [01:47:59.820 --> 01:48:08.820] Well, we're looking at a breach of contract, fraud by nondisclosure, theft. [01:48:08.820 --> 01:48:12.820] I got a real estate contract through the seller, [01:48:12.820 --> 01:48:16.820] so there's no consumer protection laws involved. [01:48:16.820 --> 01:48:22.820] The real estate contract requires that I maintain hazard insurance. [01:48:22.820 --> 01:48:24.820] Let me back up a little bit. [01:48:24.820 --> 01:48:31.820] In December of 2011, we tried to buy this house through a broker, [01:48:31.820 --> 01:48:34.820] and he tried to get us financing. [01:48:34.820 --> 01:48:40.820] He had a foreclosure in 2010, so he wasn't able to get financing. [01:48:40.820 --> 01:48:44.820] So a few months later, we entered into a real estate contract with the seller, [01:48:44.820 --> 01:48:49.820] who is the owner of the real estate company. [01:48:49.820 --> 01:48:55.820] So the contract required that I maintain insurance naming the seller as a beneficiary. [01:48:55.820 --> 01:49:00.820] Well, because I'm an over-the-loop truck driver, I didn't have the opportunity to do that. [01:49:00.820 --> 01:49:02.820] They agreed that I would pay them. [01:49:02.820 --> 01:49:04.820] They would provide the insurance. [01:49:04.820 --> 01:49:07.820] You know, everybody would be happy. [01:49:07.820 --> 01:49:11.820] In April, that was in March of 2012. [01:49:11.820 --> 01:49:14.820] In April of 2012, I got a letter from the escrow company [01:49:14.820 --> 01:49:19.820] saying that the insurance did not name the seller as a beneficiary. [01:49:19.820 --> 01:49:24.820] I sent a letter back to them saying, you know, the seller made insurance arrangements. [01:49:24.820 --> 01:49:27.820] I don't know anything about it. [01:49:27.820 --> 01:49:32.820] They never responded to that, never sent me any arguments saying, [01:49:32.820 --> 01:49:35.820] no, the seller didn't agree to that or anything else, [01:49:35.820 --> 01:49:38.820] never sent me any insurance documents. [01:49:38.820 --> 01:49:45.820] A year later, they came back again and said, hey, there's no insurance on this place. [01:49:45.820 --> 01:49:49.820] And they provided me a copy of an insurance policy [01:49:49.820 --> 01:49:55.820] that I had activated in December of 2011 when we tried to buy the house through financing. [01:49:55.820 --> 01:50:05.820] That policy canceled February 28, 2012, 20 days before we entered into the real estate contract. [01:50:05.820 --> 01:50:12.820] They're claiming that the money that I paid them at close settlement [01:50:12.820 --> 01:50:15.820] was paid to the insurance company. [01:50:15.820 --> 01:50:20.820] The insurance company says, no, we never received any money on this insurance policy [01:50:20.820 --> 01:50:23.820] after the day you initiated the policy. [01:50:23.820 --> 01:50:27.820] Policy canceled February 28. [01:50:27.820 --> 01:50:32.820] And they're harassing me and threatening to cancel the contract and everything. [01:50:32.820 --> 01:50:40.820] So there's a lot more going on besides that, but kind of just give you a brief overview. [01:50:40.820 --> 01:50:44.820] Okay, this is not something that's arbitrary or capricious. [01:50:44.820 --> 01:50:54.820] It's pretty easy to establish that through the contract you paid for the insurance. [01:50:54.820 --> 01:50:59.820] And the insurance company is saying, you never was given any insurance. [01:50:59.820 --> 01:51:02.820] That sure goes straight to fraud. [01:51:02.820 --> 01:51:04.820] Yeah. [01:51:04.820 --> 01:51:09.820] Well, to make matters a little bit more fun, in November of last year, [01:51:09.820 --> 01:51:16.820] I got a copy of a letter from the seller that they had addressed to the escrow company, [01:51:16.820 --> 01:51:25.820] stating that they had obtained insurance, but they were unable to put my wife and I on it. [01:51:25.820 --> 01:51:32.820] So I called the escrow company in December, and I said, so everybody's happy now? [01:51:32.820 --> 01:51:38.820] And she said, yeah, we'll send you some documents regarding this. [01:51:38.820 --> 01:51:41.820] Never received any documents. [01:51:41.820 --> 01:51:47.820] Then the escrow company's lawyer got involved, started sending me demands for insurance [01:51:47.820 --> 01:51:55.820] and debt collection notices based on his attorney fee for providing those default notices. [01:51:55.820 --> 01:52:01.820] Then just last week, we got a letter from the seller demanding that we produce insurance [01:52:01.820 --> 01:52:05.820] or they're going to cancel the contract. [01:52:05.820 --> 01:52:09.820] We also got a letter on March 9th from the escrow company [01:52:09.820 --> 01:52:15.820] announcing that they're resigning from being the escrow agent. [01:52:15.820 --> 01:52:21.820] I've sent the escrow company several demands for accounting on the tax and insurance escrow. [01:52:21.820 --> 01:52:24.820] They've never provided me any. [01:52:24.820 --> 01:52:30.820] I've also sent them several demands to view the contract along with the warranty deed [01:52:30.820 --> 01:52:35.820] and special warranty deed that the escrow company is required to hold. [01:52:35.820 --> 01:52:37.820] They have not responded to those. [01:52:37.820 --> 01:52:41.820] Instead, they've sent me photocopies of documents. [01:52:41.820 --> 01:52:46.820] In New Mexico, if the documents are not placed in escrow, [01:52:46.820 --> 01:52:49.820] that gives the buyer grounds for rescission. [01:52:49.820 --> 01:52:55.820] And I'm maintaining that since they have refused to allow me to come down [01:52:55.820 --> 01:52:59.820] and inspect those documents, notify me at the time and place I can come and look at them, [01:52:59.820 --> 01:53:03.820] that they don't have them and that the seller never put the documents in escrow [01:53:03.820 --> 01:53:07.820] because they never intended to pass a legal title to me, [01:53:07.820 --> 01:53:13.820] that they intended to treat me as a renter and have me maintain the property [01:53:13.820 --> 01:53:16.820] and improve the property as necessary. [01:53:16.820 --> 01:53:20.820] And then at some point down the line, after they've sucked enough money out of me, [01:53:20.820 --> 01:53:24.820] then default won't kick me out. [01:53:24.820 --> 01:53:25.820] And they got the wrong guy. [01:53:25.820 --> 01:53:28.820] They got someone who will actually fight them. [01:53:28.820 --> 01:53:31.820] Well, yeah, I don't put down on the loan company that I've listened to use [01:53:31.820 --> 01:53:34.820] or on the loan contract. [01:53:34.820 --> 01:53:41.820] So who did you send the insurance payments to? [01:53:41.820 --> 01:53:42.820] Title company? [01:53:42.820 --> 01:53:47.820] Everything went to the escrow company. [01:53:47.820 --> 01:53:50.820] And you've been unable to get accounting. [01:53:50.820 --> 01:53:51.820] Okay. [01:53:51.820 --> 01:54:01.820] In New Mexico, does New Mexico provide for pre-litigation discovery? [01:54:01.820 --> 01:54:03.820] I don't know that part. [01:54:03.820 --> 01:54:05.820] I've been focusing on the administrative code, [01:54:05.820 --> 01:54:11.820] which says that they're required to provide me with any information regarding the account. [01:54:11.820 --> 01:54:15.820] They cannot conceal any information or documents or accounting, [01:54:15.820 --> 01:54:19.820] and they have to provide it within 14 days of a written request. [01:54:19.820 --> 01:54:28.820] Have you filed a complaint against the title company's license to do business? [01:57:27.820 --> 01:57:37.820] The courts have ruled that an error in the name is not a material error [01:57:37.820 --> 01:57:43.820] if the identity of the human being can be determined from the name, [01:57:43.820 --> 01:57:46.820] like if you get a ticket and they misspell your name, [01:57:46.820 --> 01:57:49.820] they get letters juxtaposed or something. [01:57:49.820 --> 01:57:55.820] The courts have ruled that that's not a material error, and they won't enforce that. [01:57:55.820 --> 01:57:59.820] They won't enforce it, even though they have my name under my upper and lower case, [01:57:59.820 --> 01:58:03.820] on my deed of trust, in my contact with the school district, [01:58:03.820 --> 01:58:05.820] it's under my upper and lower case. [01:58:05.820 --> 01:58:10.820] The court does not recognize the difference between upper and lower.
