[01:05.400 --> 01:09.520] In the news today, a program designed to record computer keystrokes has been found in hacking [01:09.520 --> 01:14.920] operations by the NSA and GCHQ in several countries around the world. [01:14.920 --> 01:18.920] Researchers at the Kipursky Lab says the source code to the program matched the code of a [01:18.920 --> 01:22.840] spying tool known as Regen, which was previously revealed by Edward Snowden. [01:22.840 --> 01:27.960] It appears that the Regen platform was used for spying operations conducted by the so-called [01:27.960 --> 01:29.440] Five Eyes Nations. [01:29.440 --> 01:34.880] The anti-virus company Symantec had previously said the program was well disguised and difficult [01:34.880 --> 01:39.160] to trace. [01:39.160 --> 01:43.460] The defense had another difficult time on day eight of the Ross Ulbricht trial. [01:43.460 --> 01:48.240] The day began with IRS Special Agent Gary Ulbricht further connecting Ulbricht to Silk [01:48.240 --> 01:54.880] Road private chats, this time making it extremely personal, tying references to DPR having Poison [01:54.880 --> 02:00.120] Oak to emails from the same time period, with Ulbricht telling his girlfriend at the time [02:00.120 --> 02:04.760] he quote, got Poison Oak taking trash out of a train, end quote. [02:04.760 --> 02:09.840] Ulbricht also testified about private chats with DPR, saying he went on a first date, [02:09.840 --> 02:15.960] then the state showed email messages for Ulbricht from OkCupid around the same time, with a [02:15.960 --> 02:19.240] message from a woman saying she enjoyed their time together. [02:19.240 --> 02:23.960] Additionally, the government showed a Silk Road spreadsheet with an IP address used by [02:23.960 --> 02:29.680] DPR that was tied to Google records of IPs that Ulbricht used to connect to his Gmail [02:29.680 --> 02:30.680] account. [10:06.800 --> 10:10.800] Because we've got to keep up to date about what's going on with the Texas State Capitol. [10:10.800 --> 10:12.800] Because right now we have constitutional carry. [10:12.800 --> 10:17.800] There's a big fight going on right now with constitutional carry and open carry. [10:17.800 --> 10:20.800] And what they're trying to do is actually trying to divide us. [10:20.800 --> 10:23.800] We're actually, we are a big happy family. [10:23.800 --> 10:26.800] And no matter what happens, we may have our grievances. [10:26.800 --> 10:29.800] We may have our disagreements. [10:29.800 --> 10:31.800] But we are one big happy family. [10:31.800 --> 10:36.800] And we're moving forward with trying to get constitutional carry passed here in the state of Texas. [10:36.800 --> 10:37.800] Yes. [10:37.800 --> 10:41.800] Why don't we talk about that a little bit, this constitutional carry bill. [10:41.800 --> 10:45.800] I want to get your take on, well, just everything you have to say about it. [10:45.800 --> 10:50.800] But in particular, one comment that I wanted to make is that I've heard some rumblings [10:50.800 --> 10:58.800] that some of the CHL instructors or gun store owners are actually not very happy about this bill [10:58.800 --> 11:03.800] and are somewhat opposed to it basically for financial reasons. [11:03.800 --> 11:11.800] You know, they are afraid that the demand in the market for a CHL is going to decrease [11:11.800 --> 11:15.800] if people are able to open carry without a license. [11:15.800 --> 11:19.800] And I just really don't see that. [11:19.800 --> 11:26.800] I mean, I'm not in the business personally, but just as a firearm owner myself, I mean, you know, [11:26.800 --> 11:28.800] there's going to be times you're going to want to open carry. [11:28.800 --> 11:31.800] Well, there's going to be times you're going to want to conceal too. [11:31.800 --> 11:33.800] I'm not going to always want it on my hip. [11:33.800 --> 11:35.800] Sometimes I'm going to want to have a firearm, [11:35.800 --> 11:40.800] but I'm not necessarily going to want to display it everywhere, you know. [11:40.800 --> 11:45.800] So I really don't see how it's going to take away the demand or the desire to have a CHL [11:45.800 --> 11:46.800] just because we can open carry. [11:46.800 --> 11:49.800] I mean, that's just me personally as a firearm owner. [11:49.800 --> 11:54.800] What is your take on this, Michael, and what else do you have to comment on concerning this bill? [11:54.800 --> 11:59.800] Well, you know, we don't know how it's going to affect the different gun stores. [11:59.800 --> 12:03.800] You know, it could, the classes may decline just slightly, a little bit. [12:03.800 --> 12:06.800] But you know what? You got to think of it like this. [12:06.800 --> 12:09.800] You know, I think some people are actually being a little selfish, [12:09.800 --> 12:14.800] and they're thinking only about the money aspects of it, you know, them trying to make money. [12:14.800 --> 12:16.800] They're not thinking about the liberty aspect of it. [12:16.800 --> 12:20.800] They're not thinking about the constitutional reality of what we're facing here. [12:20.800 --> 12:22.800] We're talking about constitutional carry. [12:22.800 --> 12:27.800] We're talking about a right that has been given to us by our Constitution. [12:27.800 --> 12:30.800] You know, it's not called the Bill of Needs. It's called the Bill of Rights. [12:30.800 --> 12:32.800] And so this is what we're discussing here. [12:32.800 --> 12:36.800] So, you know, some people are being a little selfish, you know, and like I said, [12:36.800 --> 12:38.800] they're just thinking about that money aspects of it. [12:38.800 --> 12:41.800] You know, it's got to be about the people, liberty. [12:41.800 --> 12:42.800] We're talking about the freedom. [12:42.800 --> 12:47.800] You know, that's what we're, you know, here to make a difference and make change. [12:47.800 --> 12:54.800] Absolutely. And I mean, another comment I have on that issue is I think it actually has the potential [12:54.800 --> 12:58.800] to increase the business for CHL, and here's why. [12:58.800 --> 13:03.800] There's a lot of people out there that don't want to bother with the classes [13:03.800 --> 13:06.800] or maybe they don't want to do the licensing thing, you know, [13:06.800 --> 13:08.800] because they're just reluctant to go there. [13:08.800 --> 13:11.800] And so they just don't carry their gun on their person. [13:11.800 --> 13:18.800] They keep it in their car because you can keep it in your car, you know, without a license. [13:18.800 --> 13:25.800] And you can carry technically concealed just not in certain places like especially public places [13:25.800 --> 13:27.800] where they sell alcohol. [13:27.800 --> 13:31.800] You know, as long as you're on private property, you can obviously do what you want on private property. [13:31.800 --> 13:37.800] But at any rate, the point being is that once people who maybe are not carrying at all right now [13:37.800 --> 13:43.800] or just maybe leaving it in their car, once they get a taste of having that firearm with them all the time, [13:43.800 --> 13:46.800] they may say, hey, you know, this is really cool. [13:46.800 --> 13:50.800] I really like having my firearm with me everywhere I go. [13:50.800 --> 13:55.800] But, you know, now I'm realizing that there are some situations where I may want to conceal it. [13:55.800 --> 13:59.800] I think it could actually increase the business because it would, you know, [13:59.800 --> 14:02.800] just lead people in that direction once they start open carrying. [14:02.800 --> 14:04.800] That's just my take on it. [14:04.800 --> 14:07.800] Right. And let me give you the differences of what, you know, what we're talking about here. [14:07.800 --> 14:11.800] We're talking constitutional carry, which means that you would be able to openly [14:11.800 --> 14:14.800] or conceal your firearm without a license. [14:14.800 --> 14:18.800] Okay. You'll be able to openly or conceal that handgun without a license. [14:18.800 --> 14:24.800] And then there's a possibility of another bill being passed, which is a handgun license bill. [14:24.800 --> 14:26.800] You'll be able to open carry with just a handgun license. [14:26.800 --> 14:29.800] So kind of like what Oklahoma has. [14:29.800 --> 14:32.800] You can open carry your handgun in the state of Oklahoma, [14:32.800 --> 14:36.800] but you need a handgun license to open carry it or conceal carry it. [14:36.800 --> 14:38.800] So those are going to be the differences. [14:38.800 --> 14:43.800] Okay. So now wait a minute. Are you saying this constitutional carry bill, I thought it was just for open carry. [14:43.800 --> 14:44.800] Are you saying? [14:44.800 --> 14:46.800] There are two different types of bills. [14:46.800 --> 14:51.800] There's your constitutional bill, and then there's your open carry with a handgun license. [14:51.800 --> 14:54.800] So with the constitutional carry, that includes concealed. [14:54.800 --> 14:58.800] Are you saying that that would do away with the need for the handgun license altogether? [14:58.800 --> 14:59.800] That is correct. [14:59.800 --> 15:03.800] Oh, okay. Wow. I thought it was just for open carry. Okay. [15:03.800 --> 15:07.800] No. It means constitutional carry means that you would be able to carry your handgun [15:07.800 --> 15:09.800] openly or concealed without a license. [15:09.800 --> 15:12.800] Okay. So it completely do away with a handgun license altogether. [15:12.800 --> 15:15.800] Okay. Now I understand why they're so upset. [15:15.800 --> 15:17.800] But it does not remove the concealed. [15:17.800 --> 15:20.800] Texas will still have a concealed handgun license program, [15:20.800 --> 15:25.800] because in order for you to travel outside of the state of Texas to neighboring states, [15:25.800 --> 15:28.800] you're going to have to have that CHL if you want to conceal your handgun. [15:28.800 --> 15:32.800] So it's not going to remove the concealed handgun license. [15:32.800 --> 15:33.800] I see. I see. [15:33.800 --> 15:39.800] But in reality, it's going to slow down the amount of people that are getting their CHLs. [15:39.800 --> 15:42.800] And that's the reality of it, and that's what some people are afraid of. [15:42.800 --> 15:45.800] Well, how much support does this bill have right now? [15:45.800 --> 15:47.800] Well, it actually has a lot of support. [15:47.800 --> 15:50.800] You have a lot of different groups that have joined forces together, [15:50.800 --> 15:54.800] going back and forth to the Texas State Capitol and lobbying their legislators [15:54.800 --> 15:58.800] to let them know that this is something that we're very passionate about. [15:58.800 --> 16:03.800] Also, you have the lieutenant governor, Dan Patrick, who actually has it on his website [16:03.800 --> 16:08.800] as one of the fifth bullet points, and he said that he is going to fight for open carry. [16:08.800 --> 16:11.800] Now, he wavered just a little bit this week, [16:11.800 --> 16:15.800] and I think we were able to get him to come right back on track, [16:15.800 --> 16:21.800] because he wavered a little bit and said that there was no support in the legislator for it, [16:21.800 --> 16:25.800] but then I think he found that he was wrong this week by all the phone calls he was receiving [16:25.800 --> 16:29.800] and the fact that we shut his phone lines down and jammed his email up, [16:29.800 --> 16:32.800] that now he knows there is support for open carry in the state of Texas, [16:32.800 --> 16:35.800] and he's back on track with supporting constitutional carry. [16:35.800 --> 16:36.800] That's excellent. [16:36.800 --> 16:38.800] I want to hear more about this when we get on the other side, [16:38.800 --> 16:43.800] and there are some other bills that are of importance that need to be discussed here. [21:25.800 --> 21:33.800] But right now we're talking with Michael about some very important legislation that may come to pass here in Texas. [21:33.800 --> 21:41.800] There's a constitutional carry bill on the table, and there's also this open carry bill on the table, [21:41.800 --> 21:46.800] which apparently would license open carry as well as concealed carry. [21:46.800 --> 21:51.800] And, Michael, give us your take on the difference between the two, [21:51.800 --> 21:54.800] and particularly I want to know as far as the level of support. [21:54.800 --> 22:02.800] Do we have any idea as far as the members of Congress, which one they support more, [22:02.800 --> 22:05.800] or is there a lot of support for either bill? [22:05.800 --> 22:07.800] What are we looking at here? [22:07.800 --> 22:10.800] Okay. Well, first of all, the difference is you have your constitutional carry, [22:10.800 --> 22:17.800] which means that you would be able to openly carry a handgun or concealed carry a handgun without a license. [22:17.800 --> 22:21.800] And then you have license carry, which means that you would need to have a handgun license [22:21.800 --> 22:26.800] in order to openly carry or concealed carry your handgun. [22:26.800 --> 22:30.800] So those are the two different types of bill. There's a constitutional bill and a license carry bill. [22:30.800 --> 22:38.800] Now, as far as support, well, we have to go back to the fact that the majority of people that are in our state house [22:38.800 --> 22:41.800] and also our state senate are Republicans. [22:41.800 --> 22:49.800] And the Texas Republican Party platform stated this year that constitutional carry is their main priority, [22:49.800 --> 22:54.800] is their number one priority. So it shouldn't be rocket science. [22:54.800 --> 22:57.800] It should be very simple to get open carry. [22:57.800 --> 23:02.800] Better yet, it should be very simple to get constitutional carry to actually pass this session. [23:02.800 --> 23:06.800] So we shouldn't have to ask too much. We shouldn't have to call too much. [23:06.800 --> 23:11.800] It shouldn't be a lot of work since it's the Republican Party's platform for this year. [23:11.800 --> 23:15.800] And of course, what we really want is the constitutional carry. [23:15.800 --> 23:19.800] Correct. So that way you can openly carry or concealed carry your handgun without a license. [23:19.800 --> 23:21.800] And that's the way it is in Vermont. [23:21.800 --> 23:27.800] So I think that, you know, come on. Come on, people. We're not going to let Vermont beat us, are we? [23:27.800 --> 23:30.800] And they're surrounded by a sea of blue. [23:30.800 --> 23:39.800] Exactly. Exactly. Okay. So we should be calling our reps, letting them know that we support this. [23:39.800 --> 23:44.800] And I think that's a really good idea. It looks like the momentum is heading our way. [23:44.800 --> 23:49.800] And I'm all for it. And another comment I wanted to make. [23:49.800 --> 23:55.800] I have a friend that was down at the Capitol for some of these rallies to support the constitutional carry. [23:55.800 --> 23:58.800] And of course, there's the opposers there. [23:58.800 --> 24:08.800] And the one thing, one of the main opposition slogans that they have, they hold up signs that say, who's the bad guy? [24:08.800 --> 24:12.800] Which one is the bad guy? Okay. And this has to do with open carry. [24:12.800 --> 24:21.800] So one of their big beefs is if everyone, you know, or if there's a, you know, bunches of people running around with guns on their hips, [24:21.800 --> 24:27.800] how do you know which one is the bad guy? I mean, that to me is just the most ridiculous thing ever. [24:27.800 --> 24:33.800] And it's very simple. The good guy is going to be the one that's, you know, sitting down drinking their latte, [24:33.800 --> 24:36.800] and the bad guy is going to be the one that's trying to shoot you in your face. [24:36.800 --> 24:45.800] And that's exactly what my friend said. My friend said, how you know who the bad guy is, is which direction is his gun pointed? [24:45.800 --> 24:56.800] And the other comment I have to say about that is probably anyone who has their gun on their hip is not the bad guy [24:56.800 --> 25:02.800] because any bad guy is going to want to hide their weapon, okay, [25:02.800 --> 25:06.800] because they're fixing to do something with it that they're not supposed to. [25:06.800 --> 25:13.800] So which one is the bad guy? It's most likely someone where it looks like they don't have a gun. [25:13.800 --> 25:18.800] Okay. That's my answer to the question. So I strongly advocate the open carry for that reason alone [25:18.800 --> 25:22.800] because if somebody has a gun on their hip, they're probably not the bad guy. [25:22.800 --> 25:25.800] All right. So, Randy, you have a comment about this? [25:25.800 --> 25:32.800] Yeah. And you kind of covered it. The one who's pointing the gun at you, good chance he's the bad guy. [25:32.800 --> 25:38.800] The one pointing at the other guy, he's probably not your enemy. This is not rocket science. [25:38.800 --> 25:42.800] Yes. And if he's a bad guy, he's going to have a gun anyway, license or no license, [25:42.800 --> 25:46.800] and he's going to be pointing the gun in a nefarious direction. [25:46.800 --> 25:49.800] I was in the military and everybody had weapons. [25:49.800 --> 25:55.800] We never had that problem figuring out who to shoot at, who not to shoot at. [25:55.800 --> 26:02.800] That was not rocket science. So that argument is fallacious. [26:02.800 --> 26:08.800] It really is. It really is. It's trifling is what it is. Okay. It's trifling. All right. [26:08.800 --> 26:17.800] And it's just total inanity. I mean, it's kind of like this woman who's the mother of a child [26:17.800 --> 26:22.800] that got measles recently from out of a trip to Disney World or Disneyland or whatever, [26:22.800 --> 26:27.800] and she's bawling about how her child was vaccinated against measles, [26:27.800 --> 26:31.800] but her child got measles most likely from someone who was unvaccinated, [26:31.800 --> 26:40.800] and that's why everyone needs vaccines. What? It's like, hello, what have you been smoking, lady? [26:40.800 --> 26:45.800] It's kind of crazy. I mean, if your child has been vaccinated against measles, [26:45.800 --> 26:49.800] shouldn't your child be protected? Obviously, your child was not protected from the measles, [26:49.800 --> 26:51.800] or otherwise you wouldn't have gotten the measles, [26:51.800 --> 26:57.800] and you think that your child's going to be protected from the measles if everyone else gets vaccinated, [26:57.800 --> 27:01.800] even though your kid got vaccinated and your kid got the measles. Okay. [27:01.800 --> 27:07.800] This makes about as much sense as, you know, I don't know. It's just crazy. [27:07.800 --> 27:12.800] Anyways, sometimes people's logic just kind of blows my mind or their ill logic. [27:12.800 --> 27:15.800] And then one of the other bills that I want to mention, you know, [27:15.800 --> 27:19.800] before we get too far along is the concealed carry on campus. [27:19.800 --> 27:22.800] And there are two bills that have been filed for concealed carry on campus [27:22.800 --> 27:29.800] to allow CHL holders to carry a concealed handgun, concealed, of course, on the college campus. [27:29.800 --> 27:34.800] And there has been, you know, a lot of debate about this in the past, you know, years back, [27:34.800 --> 27:39.800] and, you know, the first thing that they will say is, well, is this about, you know, guns on campus? [27:39.800 --> 27:44.800] It's not about guns on campus. It's about CHL holders being able to conceal their firearm inside the building. [27:44.800 --> 27:48.800] Because right now, currently, the way the law is, with a concealed handgun license, [27:48.800 --> 27:54.800] you can already have a handgun concealed on you and walk down the street sidewalk, walkways, parking lots, [27:54.800 --> 27:56.800] or garages of a college campus. [27:56.800 --> 28:02.800] So that means that right now, the way the law is, as of today, this second, with a concealed handgun license, [28:02.800 --> 28:06.800] I can walk all the way through University of Texas campus with a handgun on me. [28:06.800 --> 28:10.800] As long as it's concealed, I can stay on the street sidewalks, walkways, parking lots, or garages. [28:10.800 --> 28:12.800] I just cannot go into the building. [28:12.800 --> 28:21.800] So what this bill is that we hope will pass the session this year is to allow CHL holders to carry inside the building. [28:21.800 --> 28:29.800] Now, Michael, would constitutional carry make this campus carry bill a moot point? [28:29.800 --> 28:38.800] Not necessarily, because what they can do actually is say that if you want to be on the college campus, [28:38.800 --> 28:42.800] you'll have to have a CHL. They can restrict it for certain areas. [28:42.800 --> 28:48.800] I see. Okay, so this is another instance where having a CHL would be advantageous. [28:48.800 --> 28:55.800] That is correct. Also, we also still have the federal law that says that you're not supposed to be within a thousand feet of a school. [28:55.800 --> 28:59.800] That's an elementary school, middle school, or high school within a firearms. [28:59.800 --> 29:07.800] So that means that the exception to that rule is going to be if you have a concealed handgun license from the state where you live or if you live within a thousand feet. [29:07.800 --> 29:09.800] That's going to be a federal law. [29:09.800 --> 29:16.800] So if you want the feds to come after you, you've got to have a CHL in the state that you live in order to be within so many footage of a school. [29:16.800 --> 29:37.800] I see. Okay. And actually, there is one other bill that I wanted to get your take on concerning some nullification bill that has to do with basically it would prohibit state law enforcement from assisting federal agents from enforcing federal firearms laws. [29:37.800 --> 29:44.800] And actually, there's some mixed feelings about that one. I have a question for you on that. [29:44.800 --> 29:48.800] So we'll get to that on the other side. [38:40.800 --> 38:48.800] There's a bill also, another bill on the table here, the Nullification Bill, which basically, from my understanding, [38:48.800 --> 38:52.800] I had a conversation with a good friend of mine about this the other day, basically, [38:52.800 --> 38:56.800] and Michael has the bill in front of him so he can correct me if I'm wrong, [38:56.800 --> 39:04.800] but basically what it says is that it would prohibit state law enforcement [39:04.800 --> 39:11.800] from assisting federal law enforcement from enforcing federal firearms laws. [39:11.800 --> 39:21.800] Now, in theory, this sounds great, and there is a specific example I can give regarding felons, okay, convicted felons. [39:21.800 --> 39:27.800] I believe, and Michael can correct me if I'm wrong, I believe after five years of serving your time, being done, [39:27.800 --> 39:29.800] you can own a firearm again. [39:29.800 --> 39:30.800] That's state law. [39:30.800 --> 39:35.800] Now, according to federal law, if you're a convicted felon, you can never own a gun again, okay? [39:35.800 --> 39:41.800] So there's a discrepancy there, and so this Nullification Bill would protect people like that, [39:41.800 --> 39:48.800] and there are other issues, many other issues where it would protect firearm owners [39:48.800 --> 39:57.800] from any kind of encroaching or infringing, overbearing, draconian federal legislation of firearms laws. [39:57.800 --> 40:02.800] This is a good thing, but there's always a flip side, okay? [40:02.800 --> 40:08.800] It's a two-edged sword, so to speak, and something that my friend pointed out to me [40:08.800 --> 40:15.800] is that there is no protection in this Nullification Bill regarding issues like, say, for example, [40:15.800 --> 40:24.800] under federal firearms laws, there are protections for firearm owners who want to own certain types of [40:24.800 --> 40:31.800] high-powered silencers, like to silence a.50 cal, okay, to silence high-powered hunting rifles. [40:31.800 --> 40:37.800] There are protections, you know, and licensings for those types of silencers, [40:37.800 --> 40:46.800] and so if you take away every kind of interaction between state and feds regarding that issue, [40:46.800 --> 40:55.800] well, if the state can't enforce federal firearms laws, that means they can't enforce it at all, good or bad, okay? [40:55.800 --> 40:59.800] And so that means that they would lose the ability to have that kind of, [40:59.800 --> 41:03.800] for the state to enforce that kind of protection of owning silencers, [41:03.800 --> 41:10.800] and if the state passed any laws, if Texas passed any laws against those silencers, [41:10.800 --> 41:13.800] then there's nothing that could be done about it. [41:13.800 --> 41:18.800] And so what my friend was saying is that in theory the Nullification Law is excellent, [41:18.800 --> 41:25.800] but there needs to be some kind of caveat or some kind of protective mechanism in that Nullification Bill [41:25.800 --> 41:35.800] that would protect firearms owners as far as the same kind of protections that we have under federal firearms laws right now. [41:35.800 --> 41:38.800] We want to take away the bad stuff, but keep the good stuff, in other words. [41:38.800 --> 41:43.800] And so my friend talked to a lawyer of one of these groups that's supporting this bill, [41:43.800 --> 41:49.800] and the lawyer basically just, of course, gives the same kind of lawyerism, oh, well, that would never happen. [41:49.800 --> 41:52.800] Okay, yeah, it could happen. [41:52.800 --> 41:55.800] So go ahead, give us your take on this, Michael. [41:55.800 --> 41:58.800] And you never know what could happen because the tables could turn. [41:58.800 --> 42:01.800] Right now the Republicans are in charge in office. [42:01.800 --> 42:04.800] What happens if the Democrats take charge? [42:04.800 --> 42:07.800] Then those tables could turn a little bit. [42:07.800 --> 42:08.800] Exactly. [42:08.800 --> 42:12.800] And also keep in mind that you still have your gun stores, okay? [42:12.800 --> 42:15.800] So the gun stores are still controlled by the federal government. [42:15.800 --> 42:17.800] That's run by the ATF. [42:17.800 --> 42:22.800] So the gun stores will still have to follow the federal law. [42:22.800 --> 42:25.800] So when it comes to everything else, then that's totally different. [42:25.800 --> 42:32.800] And now I'm going to introduce Justin Delosch, who's the executive director of the Lone Star Gun Race, [42:32.800 --> 42:35.800] and he's going to tell you a little more about what he thinks about that. [42:57.800 --> 43:00.800] If we're going to protect our rights, we need to submit bills here that would do that [43:00.800 --> 43:03.800] and not rely on the federal government to do it. [43:03.800 --> 43:08.800] Well, that is exactly what my friend was recommending, [43:08.800 --> 43:13.800] that there needs to be something in this nullification bill or some kind of another bill [43:13.800 --> 43:19.800] that's introduced alongside with it that would protect people who want to own these high-powered silencers, [43:19.800 --> 43:23.800] that that needs to be done at the state level. [43:23.800 --> 43:26.800] Of course, you have to take all or nothing. [43:26.800 --> 43:29.800] With the nullification, it's all or nothing, of course. [46:48.800 --> 46:53.800] If we're going to kick the feds out altogether as far as the federal firearms laws, [46:53.800 --> 46:59.800] then we just need to be careful and, you know, institute, introduce, as it were, [46:59.800 --> 47:04.800] some legislation at the state level to protect these sort of things like the heavy, high-duty, [47:04.800 --> 47:11.800] high-powered silencers because we don't want that to be done away with here at the state level. [47:11.800 --> 47:14.800] So what is your take on that, Justin? [47:14.800 --> 47:18.800] Do we need to, is it your opinion, do we need to introduce legislation like this [47:18.800 --> 47:21.800] or do you think that that's not really necessary? [47:21.800 --> 47:25.800] I don't think we have to introduce legislation for that right now because let's keep in mind [47:25.800 --> 47:30.800] that after this session is over, we've got, what, 15, 16 months to kind of prepare for what's going to happen. [47:30.800 --> 47:37.800] Not to mention, I feel like we've got a way better chance of passing protective legislation [47:37.800 --> 47:45.800] than we do legislation that would infringe on our rights, if that makes sense. [47:45.800 --> 47:47.800] Okay, so... [47:47.800 --> 47:51.800] I guess what I'm saying is I think we have a better chance of passing legislation [47:51.800 --> 47:58.800] that's going to enforce our rights to own these devices, silencers, et cetera, [47:58.800 --> 48:00.800] use them for hunting and all that. [48:00.800 --> 48:05.800] I think we have a better chance of passing legislation in support of that versus against it. [48:05.800 --> 48:10.800] Oh, right, well, that was the whole point, that we want to pass legislation in support of that. [48:12.800 --> 48:16.800] I mean, because once we get out of this session, if that notification passes, [48:16.800 --> 48:22.800] we still have, like I say, we've got 15, 16 months until we get to the next election cycle. [48:24.800 --> 48:26.800] So it's something that we should maybe consider, [48:26.800 --> 48:36.800] but it's not something that we should be feeling like it's a hot topic that we need to do something about it right now. [48:42.800 --> 48:47.800] I'd hate to see us get too deluded and not focus on these huge issues, [48:47.800 --> 48:50.800] because if we get constitutional carry in Texas, that's going to be huge. [48:52.800 --> 48:55.800] And yeah, and there's not a whole lot of people that use those kinds of silencers, [48:55.800 --> 49:01.800] but I guess my friend is just concerned that doesn't want to see our rights getting infringed on, [49:01.800 --> 49:07.800] and he's just a little bit concerned that there's a door that could be opening in that direction. [49:07.800 --> 49:10.800] Absolutely. We should always be thinking about stuff like that. [49:10.800 --> 49:16.800] Yes, but this is something that we need to watch out for maybe coming down the pike and not right now is basically your take on it. [52:23.800 --> 52:28.800] Jeff has been hanging in there for a long, long time, years. [52:28.800 --> 52:31.800] This case has been going on. [52:31.800 --> 52:36.800] I'll probably let Jeff summarize as well, but just a quick summary. [52:36.800 --> 52:41.800] He was living in some apartments close to campus. [52:41.800 --> 52:47.800] I believe it was some campus housing or campus-related housing, but it was not on campus. [52:47.800 --> 52:52.800] And I know how this works because UT here in Austin has this kind of thing. [52:52.800 --> 52:59.800] It's basically it's like for housing, for people who don't live on campus, [52:59.800 --> 53:05.800] it's like they help you get low rent housing for students, but it's not on campus. [53:05.800 --> 53:08.800] And I don't know if this was the same situation with Jeff or not, [53:08.800 --> 53:12.800] but basically he was living in an apartment that was not on campus and had a gun, okay? [53:12.800 --> 53:15.800] And he was perfectly allowed to do that, not a problem. [53:15.800 --> 53:23.800] Well, because it was some sort of related to campus housing, they ended up running him through the wringer [53:23.800 --> 53:24.800] for having a gun on campus. [53:24.800 --> 53:28.800] And he actually ended up getting convicted even though he fought it. [53:28.800 --> 53:30.800] He served jail time. [53:30.800 --> 53:31.800] He got out. [53:31.800 --> 53:32.800] He's been appealing it. [53:32.800 --> 53:37.800] And I think he has won his appeal, but there's still stuff going on with the case. [53:37.800 --> 53:41.800] And Jeff is just talking it to him, man. [53:41.800 --> 53:47.800] I mean, the case is somewhat complicated, so I haven't been able to I can't summarize it in full right now, [53:47.800 --> 53:49.800] but let's bring him on the air. [53:49.800 --> 53:52.800] Jeff, welcome to Rule of Law. [53:52.800 --> 53:53.800] Hi. [53:53.800 --> 53:54.800] Thanks for having me on the air. [53:54.800 --> 54:01.800] Jeff, why don't you summarize your case for us because I probably didn't do that good of a job just now, [54:01.800 --> 54:03.800] or a very limited job. [54:03.800 --> 54:09.800] Why don't you summarize your case for our guests here so that they can give you some kudos? [54:09.800 --> 54:14.800] Sure. First of all, I made my first court appearance four years ago. [54:14.800 --> 54:21.800] And so four and a half years ago, I was living on the campus of Mississippi State University [54:21.800 --> 54:28.800] and the housing department wrote me a letter and they called me and said that we're overcrowded with freshmen [54:28.800 --> 54:34.800] and we're having to kick you out and we're going to move we're moving the upperclassmen off campus. [54:34.800 --> 54:40.800] So they notified me that I was leaving and that I had to go to some apartments. [54:40.800 --> 54:46.800] And so I went over there and I had a an old bolt action rifle. [54:46.800 --> 54:52.800] So it wasn't a machine gun or I mean, it wasn't like an AK-47 or a high capacity pistol or anything. [54:52.800 --> 54:59.800] It was an old bolt action rifle with a solid plate that didn't even have a detachable magazine. [54:59.800 --> 55:06.800] But anyway, I was arrested, went to trial, and I actually hung the jury on the first trial. [55:06.800 --> 55:13.800] And then they convicted me on the second one because they kept saying that I had a sniper rifle and I could have killed 400 people. [55:13.800 --> 55:16.800] So I went to the state penitentiary for a year. [55:16.800 --> 55:20.800] And then I got out and actually won my appeal. [55:20.800 --> 55:23.800] Now, what state was this? Is this the Mississippi? [55:23.800 --> 55:23.800] Mississippi. [55:23.800 --> 55:25.800] Okay, okay. [55:25.800 --> 55:33.800] So I won my appeal and while I was out, I went over to the courthouse and I walked in and I picked up the land deed for the apartments. [55:33.800 --> 55:39.800] And it turns out that they are private property the whole time, but they never raised that issue in court. [55:39.800 --> 55:44.800] And my attorney, who I fired, never bothered to raise that either. [55:44.800 --> 55:48.800] So anyway, it turned out that the land title was private property. [55:48.800 --> 55:56.800] In my closing arguments during the second trial, I did argue that the prosecution does not have the land title here in the courtroom. [55:56.800 --> 56:01.800] And the prosecution answered back that he didn't have to have the land title. [56:01.800 --> 56:06.800] So after I got out of prison, I went and picked up the land title, said it was private property. [56:06.800 --> 56:13.800] And then I won my appeal, not based on the land title, but on ineffective assistance counsel. [56:13.800 --> 56:17.800] It then got remanded back to the circuit court. [56:17.800 --> 56:21.800] That's been a year ago and they've been postponing my trials ever since. [56:21.800 --> 56:24.800] Okay, so they want to retry the case. [56:24.800 --> 56:32.800] The appeals court remanded the case back to the trial court to retry the case because you had ineffective counsel. [56:32.800 --> 56:33.800] Exactly. [56:33.800 --> 56:38.800] Okay, and so this time you're going to do it right without the attorney. [56:38.800 --> 56:41.800] So continue, please. [56:41.800 --> 56:43.800] Well, and that's where I am right now. [56:43.800 --> 56:47.800] Right now they're playing games with me. [56:47.800 --> 56:55.800] They've got me going to the courthouse every three and four days and they keep canceling every trial or every motion here. [56:55.800 --> 57:01.800] Yes, and you have to travel to go to trial here and so they keep yanking you out of your job. [57:01.800 --> 57:08.800] And they do things like they want you to be in town for a full week before trial and all this madness, right? [57:08.800 --> 57:14.800] Yes, yeah, they just got through arresting me a couple of months ago because they wanted me to show up a week before the trial. [57:14.800 --> 57:19.800] I showed up a week before the trial and they arrested me anyway without a warrant and without a hearing. [57:19.800 --> 57:20.800] They're just messing with me. [57:20.800 --> 57:25.800] They're trying to say that you violated your bond and they're revoking your bond. [57:25.800 --> 57:29.800] Yeah, yeah, or failure to appear or something. [57:29.800 --> 57:31.800] They wanted to reset his bond. [57:31.800 --> 57:33.800] They wanted to reset the bond. [57:33.800 --> 57:40.800] Okay, this is the same trick that they pulled on a friend of mine here in Austin where he shows up for trial and they said, [57:40.800 --> 57:45.800] well, we don't have time to do your trial today because there's too many other people with a traffic ticket case. [57:45.800 --> 57:51.800] And so instead we're going to have a bond hearing and we're revoking your bond. [57:51.800 --> 57:57.800] And they like quadrupled the bond, which was totally against statute and everything else, but they just did it anyway. [57:57.800 --> 58:02.800] And because he didn't have the money to pay the bond right out of his pocket, they threw him in jail. [58:02.800 --> 58:03.800] That was a trick. [58:03.800 --> 58:07.800] So I've seen this kind of thing before. [58:07.800 --> 58:11.800] Okay, well, Jeff, let's hear more about the update when we get back on the other side. [01:02:03.800 --> 01:02:07.800] Alfred also testified about private chats with DPR, [01:02:07.800 --> 01:02:09.800] saying he went on a first date, [01:02:09.800 --> 01:02:13.800] then the state showed email messages for Ulbricht from OkCupid [01:02:13.800 --> 01:02:15.800] around the same time, [01:02:15.800 --> 01:02:18.800] with a message from a woman saying she enjoyed their time together. [01:02:18.800 --> 01:02:21.800] Eventually, the government showed a Silk Road spreadsheet [01:02:21.800 --> 01:02:24.800] with an IP address used by DPR [01:02:24.800 --> 01:02:27.800] that was tied to Google records of IPs that Ulbricht used [01:02:27.800 --> 01:02:30.800] to connect to his Gmail account. [01:03:33.800 --> 01:03:37.800] It's just mind-boggling that Jeff's lawyer did not raise this issue [01:03:37.800 --> 01:03:40.800] of the fact that this was not even campus housing. [01:03:40.800 --> 01:03:42.800] It was not even on campus. [01:03:42.800 --> 01:03:44.800] Had nothing to do with campus, period. [01:03:44.800 --> 01:03:47.800] They moved him out of campus housing because it was too crowded. [01:03:47.800 --> 01:03:49.800] Okay, this is ridiculous. [01:03:49.800 --> 01:03:54.800] And Randy and I were discussing just now in the break that the reason is [01:03:54.800 --> 01:03:58.800] because your attorney is your worst enemy. [01:03:58.800 --> 01:04:01.800] Okay, he's the one or she's the one you've got to look out for the most. [01:04:01.800 --> 01:04:04.800] I'd say probably even more than opposing counsel, all right, [01:04:04.800 --> 01:04:06.800] because they want to just sell you down the river. [01:04:06.800 --> 01:04:10.800] They just want to make deals with the prosecutor, et cetera. [01:04:10.800 --> 01:04:14.800] And they are there to make deals and further their own career. [01:04:14.800 --> 01:04:17.800] And as Randy put it so eloquently, [01:04:17.800 --> 01:04:22.800] they are there to make sure that you don't have anything [01:04:22.800 --> 01:04:24.800] that you can raise on appeal. [01:04:24.800 --> 01:04:26.800] And that just about nearly happened to Jeff. [01:04:26.800 --> 01:04:29.800] Jeff would not have had anything to raise on appeal, [01:04:29.800 --> 01:04:32.800] except all he had was ineffective counsel, [01:04:32.800 --> 01:04:36.800] most likely because of this issue about the campus housing. [01:04:36.800 --> 01:04:39.800] So he was able to appeal his case on ineffective counsel, [01:04:39.800 --> 01:04:41.800] but he couldn't appeal anything as far as the merits. [01:04:41.800 --> 01:04:43.800] So keep that in mind, people. [01:04:43.800 --> 01:04:47.800] Your attorney is there to make sure that you don't have an appeal. [01:04:47.800 --> 01:04:48.800] Right, Randy? [01:04:48.800 --> 01:04:51.800] He also used some tricks on them. [01:04:51.800 --> 01:04:56.800] You fire the attorney, you file all the motions you want filed, [01:04:56.800 --> 01:04:58.800] and then let him appoint another attorney. [01:04:58.800 --> 01:04:59.800] Yes, absolutely. [01:04:59.800 --> 01:05:01.800] Because now you've got the motions in, [01:05:01.800 --> 01:05:09.800] and the lawyer, if he doesn't, if he tries not to adjudicate the issues, [01:05:09.800 --> 01:05:11.800] then you bar-grieve him. [01:05:11.800 --> 01:05:12.800] There you go. [01:05:12.800 --> 01:05:13.800] And as soon as you bar-grieve him, [01:05:13.800 --> 01:05:17.800] he's going to move the court to remove him from the case. [01:05:17.800 --> 01:05:19.800] And then you go to the court and tell the court, [01:05:19.800 --> 01:05:21.800] don't you dare remove him from that case. [01:05:21.800 --> 01:05:23.800] He's my counsel of choice. [01:05:23.800 --> 01:05:26.800] And the judge is going to remove him from the case. [01:05:26.800 --> 01:05:30.800] Now you get to sue the judge for interfering with the private contract. [01:05:30.800 --> 01:05:34.800] Yeah, because you can't file motions in your own case if you have a lawyer. [01:05:34.800 --> 01:05:37.800] So you got to kind of, there's a window there where you have to, [01:05:37.800 --> 01:05:40.800] you can only do it when you don't have a lawyer. [01:05:40.800 --> 01:05:42.800] So Jeff did pretty good getting all this stuff in there. [01:05:42.800 --> 01:05:44.800] Yes, good job, Jeff, so far. [01:05:44.800 --> 01:05:45.800] So Jeff, continue. [01:05:45.800 --> 01:05:48.800] Randy, you had some questions or you wanted to guide him? [01:06:01.800 --> 01:06:07.800] Finally at 12, I actually knocked on the court's window and said, [01:06:07.800 --> 01:06:10.800] yes, I've been continued, right? [01:06:10.800 --> 01:06:13.800] And she said, oh, yes, you have been. [01:06:13.800 --> 01:06:18.800] And so they gave me a motion to continue, for continuance. [01:06:18.800 --> 01:06:24.800] My attorney emailed me and said that she could not be at that trial yesterday [01:06:24.800 --> 01:06:31.800] because she had another court date set and the judge would not let her go. [01:06:31.800 --> 01:06:40.800] So on my motion for continuance, my trial date was set on October the 31st. [01:06:40.800 --> 01:06:50.800] Her other trial that she postponed mine for was set on, [01:06:50.800 --> 01:06:54.800] I think it was November 26, 26 days later. [01:06:54.800 --> 01:06:57.800] So mine was set first. [01:06:57.800 --> 01:07:02.800] Her other trial is a divorce, looks like a husband and wife, [01:07:02.800 --> 01:07:05.800] and I'll read you this for the continuance. [01:07:05.800 --> 01:07:08.800] The prosaic motions filed, I'm sorry. [01:07:08.800 --> 01:07:13.800] Furthermore, the court is aware, counsel for the defendant has a trial setting [01:07:13.800 --> 01:07:18.800] in the Chancery Court of Lowndes County, Barksdale versus Barksdale, [01:07:18.800 --> 01:07:20.800] cause number something something. [01:07:20.800 --> 01:07:25.800] Honorable James Davidson, chancellor, refuses to continue the Barksdale matter [01:07:25.800 --> 01:07:31.800] and has advised counsel for the defendant that she must be present in his courtroom [01:07:31.800 --> 01:07:40.800] January 27, even though State versus Hill was set first. [01:07:40.800 --> 01:07:43.800] And anyway, I wanted to get your take on that. [01:07:43.800 --> 01:07:51.800] So that's even in, so you should file a judicial conduct complaint against the other judge. [01:07:51.800 --> 01:07:53.800] Okay, got it. [01:07:53.800 --> 01:07:57.800] That'll make him real unhappy. [01:07:57.800 --> 01:07:58.800] Okay. [01:07:58.800 --> 01:08:06.800] Now my judge allowed her to continue the case, [01:08:06.800 --> 01:08:16.800] because I have a court order from this judge that says that they can continue the case. [01:08:16.800 --> 01:08:20.800] My attorney allowed her continuance. [01:08:20.800 --> 01:08:24.800] And you should bill your attorney for your time. [01:08:24.800 --> 01:08:25.800] Okay. [01:08:25.800 --> 01:08:30.800] Can I judicial conduct grieve my judge also? [01:08:30.800 --> 01:08:32.800] Oh, yeah. [01:08:32.800 --> 01:08:33.800] Okay. [01:08:33.800 --> 01:08:35.800] So I can do both judges. [01:08:35.800 --> 01:08:37.800] Oh, absolutely, yeah. [01:08:37.800 --> 01:08:42.800] Your judge should have counseled with the other judge [01:08:42.800 --> 01:08:47.800] and notified him that this was a criminal matter and it stands before a family matter. [01:08:47.800 --> 01:08:50.800] And besides, this one was set first. [01:08:50.800 --> 01:08:54.800] This judge should have forced your trial to happen, [01:08:54.800 --> 01:09:03.800] because when the state sets it, the civil is set in conjunction with the two opposing counsels. [01:09:03.800 --> 01:09:08.800] A criminal is set by the state, and when they set it, they have a duty to be there. [01:09:08.800 --> 01:09:13.800] They're treating, they're putting your criminal issue below a civil issue. [01:09:13.800 --> 01:09:15.800] They're clearly harassing you. [01:09:15.800 --> 01:09:19.800] You should start going for the RICO suit. [01:09:19.800 --> 01:09:20.800] Okay. [01:09:20.800 --> 01:09:26.800] Now, I have been, these motions that I've been getting for these orders for continuance, [01:09:26.800 --> 01:09:35.800] several years ago I used to get them, and it would say this cause came in on for hearing on motion. [01:09:35.800 --> 01:09:37.800] Now they're not doing it. [01:09:37.800 --> 01:09:40.800] They're just spitting out a piece of paper and handing it to me, [01:09:40.800 --> 01:09:43.800] and it just has the judge's signature on it. [01:09:43.800 --> 01:09:45.800] Have you read the code? [01:09:45.800 --> 01:09:49.800] The code in Texas requires a hearing. [01:09:49.800 --> 01:09:50.800] Okay. [01:09:50.800 --> 01:09:54.800] The only thing that I could find in Mississippi are, it says, [01:09:54.800 --> 01:10:00.800] motions in other paper, an application to the court for an order shall be made by motion, [01:10:00.800 --> 01:10:04.800] which, unless made during a hearing or trial, shall be made in writing, [01:10:04.800 --> 01:10:08.800] shall state with particularity the grounds therefor, [01:10:08.800 --> 01:10:11.800] and shall set forth the relief or order sought. [01:10:11.800 --> 01:10:13.800] Okay. That's great. [01:10:13.800 --> 01:10:18.800] The requirement of writing is fulfilled if the motion is stated [01:10:18.800 --> 01:10:24.800] in a written notice of the hearing of the motion. [01:10:24.800 --> 01:10:25.800] Now, what does that mean? [01:10:25.800 --> 01:10:26.800] Okay. [01:10:26.800 --> 01:10:32.800] That means that the notice and the motion itself can be one document, [01:10:32.800 --> 01:10:34.800] and that occurs in other states. [01:10:34.800 --> 01:10:41.800] You get a motion that is titled notice of motion, [01:10:41.800 --> 01:10:44.800] but it has the notice of motion and the motion in one document. [01:10:44.800 --> 01:10:46.800] That's all that means. [01:10:46.800 --> 01:10:54.800] You need to look at continuance because in Texas, continuance has a specification. [01:10:54.800 --> 01:10:59.800] There has to be an affidavit by the filer filed in the record, [01:10:59.800 --> 01:11:01.800] and there has to be a hearing. [01:11:01.800 --> 01:11:02.800] Yeah, that's right. [01:11:02.800 --> 01:11:03.800] That's right. [01:15:27.800 --> 01:15:33.800] They're just dragging this on and on and on, and it could be that speed trial may not apply since this is a retrial, [01:15:33.800 --> 01:15:39.800] but I would think that there would have to be some provisions for speedy trial protection, even though it's a retrial, [01:15:39.800 --> 01:15:44.800] because what are they going to do, just string you along for years and years and years, forever and ever, [01:15:44.800 --> 01:15:52.800] making you show up and spend two weeks in this city that you don't live in, for how many years, once a month? [01:15:52.800 --> 01:15:54.800] I mean, there's got to be some speedy trial protections here. [01:15:54.800 --> 01:15:56.800] Randy, don't you think? [01:15:56.800 --> 01:16:03.800] Yes, and I was suggesting that you go after the due process issue in the federal court. [01:20:14.800 --> 01:20:17.800] And I'm just wondering what I need to do. [01:20:17.800 --> 01:20:24.800] The grand jury's meeting on Monday, and I've been reading up after listening to Randy talk about the grand jury, [01:20:24.800 --> 01:20:25.800] and I want to go talk to them. [01:20:25.800 --> 01:20:29.800] And I'm wondering, they say there's an application process when I called in, [01:20:29.800 --> 01:20:37.800] but I'm just wondering, you know, any advice that Randy or you have for me about trying to see the foreman on Monday? [01:20:37.800 --> 01:20:38.800] Okay. [01:20:38.800 --> 01:20:42.800] I was interested you should ask that question. [01:20:42.800 --> 01:20:53.800] I was at the district court in the county I live in today and had informed the court that I was there to challenge the grand jury pool [01:20:53.800 --> 01:20:56.800] before the grand jury was in panel. [01:20:56.800 --> 01:20:58.800] Oh, wow. [01:20:58.800 --> 01:21:02.800] And the judge denied me the opportunity. [01:21:02.800 --> 01:21:11.800] And after the hearing, I noticed him that I was here to challenge the pool. [01:21:11.800 --> 01:21:14.800] Well, Mr. Kelton, you should have done it right. [01:21:14.800 --> 01:21:15.800] I said, well, that's interesting, Judge. [01:21:15.800 --> 01:21:17.800] Just what is right? [01:21:17.800 --> 01:21:19.800] Well, that's for you to find out. [01:21:19.800 --> 01:21:20.800] I said, well, good. [01:21:20.800 --> 01:21:21.800] That's why I'm here. [01:21:21.800 --> 01:21:24.800] He did exactly what I wanted to in this. [01:21:24.800 --> 01:21:30.800] I was trying to keep from grinning at him because this particular judge hates me. [01:21:30.800 --> 01:21:37.800] I only filed one terroristic threat complaint against him with the attorney general. [01:21:37.800 --> 01:21:39.800] Got all huffy puffy. [01:21:39.800 --> 01:21:44.800] But he did not do what I asked him to do. [01:21:44.800 --> 01:21:48.800] And I was pleased by that. [01:21:48.800 --> 01:21:52.800] It's important you understand that part. [01:21:52.800 --> 01:21:59.800] If you're dealing with these courts and you're dealing with prosecutors and judges, [01:21:59.800 --> 01:22:05.800] never ask a public official to do anything you actually want them to do [01:22:05.800 --> 01:22:11.800] because you never ask a public official to do anything [01:22:11.800 --> 01:22:16.800] that the law does not specifically require him to do. [01:22:16.800 --> 01:22:21.800] The first thing you have to do is read the code. [01:22:21.800 --> 01:22:24.800] Yes, I've been seeing a lot of code in the last couple of weeks. [01:22:24.800 --> 01:22:26.800] It's not as big a job as you think. [01:22:26.800 --> 01:22:30.800] The first time you read it, don't try to make sense of all of it. [01:22:30.800 --> 01:22:32.800] All it'll do is give you a headache. [01:22:32.800 --> 01:22:35.800] And it has to do with the way it's put together. [01:22:35.800 --> 01:22:39.800] It's not put together like a book where you start from one place [01:22:39.800 --> 01:22:44.800] and you go to the next place and then the next place. [01:22:44.800 --> 01:22:49.800] Codes are put together over years and years and years. [01:22:49.800 --> 01:22:51.800] All of your law is in the public law. [01:22:51.800 --> 01:22:57.800] And then the states will hire a publisher to go through all of these public laws [01:22:57.800 --> 01:23:04.800] and sort them out into categories and make me up a code. [01:23:04.800 --> 01:23:06.800] I think that's the one I'm using. [01:23:06.800 --> 01:23:09.800] It's searchable and put together. [01:23:09.800 --> 01:23:16.800] Yeah, so because you have statutes in the front that refer to things [01:23:16.800 --> 01:23:20.800] that don't make sense until you read statutes in the back. [01:23:20.800 --> 01:23:21.800] So read the whole thing. [01:23:21.800 --> 01:23:22.800] Just read through it. [01:23:22.800 --> 01:23:23.800] Don't try to understand it. [01:23:23.800 --> 01:23:24.800] Don't even worry about it. [01:23:24.800 --> 01:23:26.800] Just read through it and go back. [01:23:26.800 --> 01:23:30.800] So my question that I have about it is, [01:23:30.800 --> 01:23:33.800] so I'm being sued by my ex-wife for some child support, [01:23:33.800 --> 01:23:35.800] and I've actually paid it all. [01:23:35.800 --> 01:23:37.800] And I have documentation that I've paid it all. [01:23:37.800 --> 01:23:41.800] And I tried to submit that early, and they were like, just bring it to the judge. [01:23:41.800 --> 01:23:46.800] And so when I talked to the VA for the pretrial talk where they go over the money, [01:23:46.800 --> 01:23:48.800] they figured out how much money they thought I owed. [01:23:48.800 --> 01:23:51.800] Then she asked me if I was okay with the amount, and I said no. [01:23:51.800 --> 01:23:52.800] And she asked if I had any documentation, [01:23:52.800 --> 01:23:56.800] and I produced a sworn statement from the last time they did this. [01:23:56.800 --> 01:24:00.800] And I think my ex-wife had forgotten that she had claimed something different. [01:24:00.800 --> 01:24:03.800] And so they had those two inconsistent statements. [01:24:03.800 --> 01:24:06.800] And they took my ex-wife off, talked to her, [01:24:06.800 --> 01:24:09.800] and they came back and they said, listen, let's just make it a zero deal. [01:24:09.800 --> 01:24:12.800] And it turned out that her audit were paid by $550. [01:24:12.800 --> 01:24:16.800] And so I asked the lady, I said, if I take the zero deal, [01:24:16.800 --> 01:24:18.800] will the perjury be on record? [01:24:18.800 --> 01:24:20.800] Will these two statements go into the record? [01:24:20.800 --> 01:24:24.800] Because it's important for my children that they understand, you know. [01:24:24.800 --> 01:24:30.800] And so I insisted on seeing the judge since I wanted it to be on the record. [01:24:30.800 --> 01:24:33.800] And all the paperwork went in, I think. [01:24:33.800 --> 01:24:35.800] And then so the judge looks at everything. [01:24:35.800 --> 01:24:36.800] We both take a stand. [01:24:36.800 --> 01:24:39.800] And it's obvious that my wife perjured herself, my ex-wife, [01:24:39.800 --> 01:24:41.800] because the two statements are in the record. [01:24:41.800 --> 01:24:43.800] And she claims she had forgotten. [01:24:43.800 --> 01:24:46.800] And the judge goes off to rule and comes back. [01:24:46.800 --> 01:24:49.800] And I'm thinking, well, she'll probably say zero, you know. [01:24:49.800 --> 01:24:53.800] And she may say something about the perjury, the obvious perjury or whatever. [01:24:53.800 --> 01:24:57.800] And she looked at my ex-wife and me, and she said, you know, [01:24:57.800 --> 01:25:00.800] it looks like I'm going to have to use the previous statement, [01:25:00.800 --> 01:25:03.800] because it's probably the accurate one, referring to the two. [01:25:03.800 --> 01:25:06.800] And then she said, but did you know there's a statute [01:25:06.800 --> 01:25:09.800] that you could claim interest on the arrearage, [01:25:09.800 --> 01:25:12.800] and that would more than cover this, and you'll be a few thousand dollars ahead. [01:25:12.800 --> 01:25:14.800] Would you like for me to do that for you? [01:25:14.800 --> 01:25:15.800] And I can do a judgment. [01:25:15.800 --> 01:25:16.800] And my mouth dropped. [01:25:16.800 --> 01:25:18.800] I was like, oh my God, what do I do? [01:25:18.800 --> 01:25:20.800] I didn't know. [01:25:20.800 --> 01:25:25.800] And so I'm waiting on the judge to calculate up the amount that they say that I owe. [01:25:25.800 --> 01:25:29.800] I feel like she's getting rewarded for lying on the stand about it. [01:25:29.800 --> 01:25:32.800] You know what I mean? [01:25:32.800 --> 01:25:34.800] Okay. [01:25:34.800 --> 01:25:37.800] Are you asking me for some specific advice here? [01:25:37.800 --> 01:25:41.800] Because it would be hard, because we're in the middle of something, [01:25:41.800 --> 01:25:48.800] and I don't have all of the pieces. [01:25:48.800 --> 01:25:57.800] Generally, all I can tell you is, because you've been through a family in all case, [01:25:57.800 --> 01:26:02.800] in order for the judge to rule in your favor, [01:26:02.800 --> 01:26:09.800] you have to enter evidence in the court in accordance with the rules of evidence. [01:26:09.800 --> 01:26:14.800] Just because you say something in the court doesn't put it before the court. [01:26:14.800 --> 01:26:15.800] Yes, understood. [01:26:15.800 --> 01:26:18.800] And that was the point of why I wanted to make sure those two documents, [01:26:18.800 --> 01:26:20.800] the original document went into the record, [01:26:20.800 --> 01:26:25.800] and it became a piece of evidence now in the file. [01:26:25.800 --> 01:26:26.800] The judge looked at it. [01:26:26.800 --> 01:26:27.800] Wait, wait, wait. [01:26:27.800 --> 01:26:29.800] Did you have counsel? [01:26:29.800 --> 01:26:30.800] I did not. [01:26:30.800 --> 01:26:31.800] Okay. [01:26:31.800 --> 01:26:33.800] That's probably why they screwed you around. [01:26:33.800 --> 01:26:34.800] Okay. [01:26:34.800 --> 01:26:36.800] One thing to keep in mind. [01:26:36.800 --> 01:26:44.800] Your only purpose in the trial court is to set the record for appeal. [01:26:44.800 --> 01:26:49.800] Don't worry about what the chump judge does in the trial court. [01:26:49.800 --> 01:26:53.800] You're just there to set the record for appeal. [01:26:53.800 --> 01:26:57.800] This is where cases are won on appeal, not in the trial court. [01:26:57.800 --> 01:27:00.800] Sometimes somebody's going to win in the trial court, [01:27:00.800 --> 01:27:04.800] but it's like tossing a coin. [01:27:04.800 --> 01:27:07.800] The law and the facts don't matter. [01:27:07.800 --> 01:27:12.800] You will never win your case simply because you have the law and the facts on your side. [01:27:12.800 --> 01:27:15.800] You will win the case if you have the politics on your side. [01:27:15.800 --> 01:27:21.800] And if you're in there, per se, you have the politics dramatically against you. [01:27:21.800 --> 01:27:23.800] Yes, I felt that way. [01:27:23.800 --> 01:27:26.800] When I realized that it wasn't going to go my way, [01:27:26.800 --> 01:27:30.800] I looked around and realized, oh, this doesn't feel like justice. [01:27:30.800 --> 01:27:33.800] I have this perjured testimony and I've paid up everything, [01:27:33.800 --> 01:27:37.800] and she found a loophole in the law that I'm going to have to pay you like five more thousand dollars. [01:27:37.800 --> 01:27:41.800] It just felt so wrong that the judge could do that. [01:27:41.800 --> 01:27:42.800] Okay. [01:27:42.800 --> 01:27:45.800] I looked down and there was writing that talked about perjury. [01:27:45.800 --> 01:27:48.800] There was quoting the state law there on the witness stand. [01:27:48.800 --> 01:27:50.800] That felt so ironic. [01:27:50.800 --> 01:27:58.800] Well, you can't prosecute them for perjury if they recant the perjury [01:27:58.800 --> 01:28:03.800] before the perjurious statement becomes obvious, [01:28:03.800 --> 01:28:08.800] before it's apparent that the perjury will come out if you recant. [01:28:08.800 --> 01:28:16.800] But if you wait until it's obvious that the perjures are there and then you recant, that's too late. [01:28:16.800 --> 01:28:22.800] But the thing is, this is the civil trial court. [01:28:22.800 --> 01:28:26.800] Criminal is a whole different animal. [01:28:26.800 --> 01:28:32.800] So what I suggest you do is prepare criminal accusations of aggravated perjury, [01:28:32.800 --> 01:28:37.800] prepare charges against the judge for subordinating perjury, [01:28:37.800 --> 01:28:41.800] and file those with your local grand jury. [01:28:41.800 --> 01:28:47.800] Yes. And so give me advice about how do I approach that? How do I go to see them? [01:28:47.800 --> 01:28:53.800] Okay. I haven't read the code in Tennessee, but I do have someone in Tennessee. [01:28:53.800 --> 01:28:57.800] And from what he's given me about the Tennessee grand jury, [01:28:57.800 --> 01:29:03.800] a grand jury will sit to hear complaints by private citizens. [01:29:03.800 --> 01:29:09.800] So you make up the complaint and see what a grand jury thinks about the judge's shenanigans. [01:29:09.800 --> 01:29:13.800] And that's what I thought. I thought it would cause her at least a judge in my favor [01:29:13.800 --> 01:29:16.800] to judge back to zero and just let it go if she knew I was talking. [01:29:16.800 --> 01:29:17.800] But it's an interesting thing. [01:29:17.800 --> 01:29:21.800] The county clerk is supposed to make a posting of the grand jury meeting times [01:29:21.800 --> 01:29:25.800] and the name of the grand jurors and everything, of the foreman. [01:29:25.800 --> 01:29:27.800] And I looked at the documents and it was very subtle, [01:29:27.800 --> 01:29:32.800] but I noticed something very interesting in the Tennessee code. [01:35:04.800 --> 01:35:11.800] And then next, the only purpose, the only, what the, I'm sorry, [01:35:11.800 --> 01:35:16.800] the duty of the trial judge is to determine the facts [01:35:16.800 --> 01:35:18.800] in accordance with the rules of evidence, [01:35:18.800 --> 01:35:24.800] then apply the law as it comes to him to the facts in the case. [01:35:24.800 --> 01:35:27.800] You can give him the most convincing arguments [01:35:27.800 --> 01:35:31.800] and compelling reasons why he should rule in your favor, [01:35:31.800 --> 01:35:36.800] but if you don't give him facts and the laws it applies to those facts, [01:35:36.800 --> 01:35:38.800] he can agree with you. [01:35:38.800 --> 01:35:42.800] He can sympathize with you, but he cannot rule in your favor. [01:35:42.800 --> 01:35:45.800] Primary thing most proceeds don't understand [01:35:45.800 --> 01:35:47.800] about how the courts actually work. [01:35:47.800 --> 01:35:50.800] The judge will sit there and listen to you and nod [01:35:50.800 --> 01:35:52.800] like he's paying attention, [01:35:52.800 --> 01:35:55.800] but you're not giving him anything he can rule on [01:35:55.800 --> 01:35:58.800] if you don't give him facts and law. [01:38:16.800 --> 01:38:20.800] We agree that we want to divorce, but beyond that, [01:38:20.800 --> 01:38:26.800] we seem to have some pretty significant disagreements, [01:38:26.800 --> 01:38:35.800] mainly regarding the debts that were accrued during the marriage. [01:38:35.800 --> 01:38:38.800] Wait a minute, I didn't understand that. [01:38:38.800 --> 01:38:43.800] What's the disagreement? It's not about property issues? [01:38:59.800 --> 01:39:08.800] Okay, he sent me the summons and voluntary entry of appearance [01:39:08.800 --> 01:39:15.800] and petition for divorce, and there are a number of errors, [01:39:15.800 --> 01:39:18.800] including the spelling of my name in the documentation, [01:39:18.800 --> 01:39:22.800] but the main issue that I'm concerned about is at the end of it, [01:39:22.800 --> 01:39:28.800] he put on a list of his debt obligations from his credit report. [01:39:28.800 --> 01:39:37.800] There are no dates to indicate that any of this occurred during the marriage, [01:39:37.800 --> 01:39:42.800] and specifically, the nature of the debts that are listed, [01:39:42.800 --> 01:39:48.800] some are things like student loans that were obviously just to him, [01:39:48.800 --> 01:39:57.800] a judgment for $5,000 to him for the university he was attending. [01:39:57.800 --> 01:40:04.800] And the main thing that I'm really concerned about is there is a judgment from rent [01:40:04.800 --> 01:40:09.800] that was unpaid during the marriage for the amount of $25,000. [01:40:09.800 --> 01:40:16.800] Okay, so what this is about is the apportionment of the debt. [01:40:16.800 --> 01:40:17.800] Exactly. [01:40:17.800 --> 01:40:18.800] Okay. [01:40:18.800 --> 01:40:20.800] That's my primary concern. [01:40:20.800 --> 01:40:26.800] Well, okay, what is the question concerning the apportionment? [01:40:26.800 --> 01:40:30.800] Okay, so the list of debts that he put on here, [01:40:30.800 --> 01:40:34.800] Kansas and Arkansas both say do 50-50, [01:40:34.800 --> 01:40:42.800] and what I'm not really clear on is what debts are considered relevant, [01:40:42.800 --> 01:40:53.800] and I do not think it is reasonable for me to be expected to pay half of his student loans or... [01:40:53.800 --> 01:40:54.800] Okay. [01:40:54.800 --> 01:40:59.800] Did he attend school while you were married? [01:40:59.800 --> 01:41:01.800] He was... [01:42:51.800 --> 01:42:53.800] Technically we're not legally separated now. [01:42:53.800 --> 01:42:55.800] We are simply legally separate. [01:42:55.800 --> 01:42:56.800] Okay. [01:42:56.800 --> 01:42:59.800] Then what they're going to say is if this is a married couple [01:42:59.800 --> 01:43:07.800] and one member of the marriage was given notice, the couple was given notice, [01:43:07.800 --> 01:43:12.800] generally they want to notice both parties, [01:43:12.800 --> 01:43:15.800] but they're not going to overturn a judgment [01:43:15.800 --> 01:43:19.800] because your husband didn't give you notice. [01:43:19.800 --> 01:43:21.800] They're going to say that was his duty. [01:43:21.800 --> 01:43:22.800] He had notice. [01:43:22.800 --> 01:43:27.800] So the other side, when they give proper notice to one of the parties, [01:43:27.800 --> 01:43:31.800] is that if they're married, both parties are noticed. [01:47:17.800 --> 01:47:23.800] When there's a divorce and the court, in a divorce case, [01:47:23.800 --> 01:47:30.800] orders that a mortgage be split up or say somebody's going to get the mortgage [01:47:30.800 --> 01:47:36.800] and the house or something like that or credit card debts to be split in half [01:47:36.800 --> 01:47:40.800] or whatever, to be honest, from a legal perspective, [01:47:40.800 --> 01:47:43.800] that's just a gentleman's agreement. [01:47:43.800 --> 01:47:48.800] It honestly means absolutely nothing. [01:47:48.800 --> 01:47:50.800] The debt collectors don't care about that. [01:47:50.800 --> 01:47:52.800] The creditors don't care about that. [01:47:52.800 --> 01:47:56.800] The mortgage companies, the lenders don't care about that. [01:47:56.800 --> 01:48:03.800] Whoever signed to borrow the money is ultimately responsible, period. [01:48:03.800 --> 01:48:08.800] It does not matter one iota what kind of ruling in a divorce court [01:48:08.800 --> 01:48:12.800] comes down about splitting up the debt, period. [01:48:12.800 --> 01:48:14.800] End of story. [01:48:14.800 --> 01:48:20.800] So if all the debt is his, if he's signed for the credit card, he is responsible. [01:48:20.800 --> 01:48:23.800] It doesn't matter what the divorce judge says. [01:48:23.800 --> 01:48:25.800] That's all there is to it. [01:48:25.800 --> 01:48:30.800] The debt collectors and the creditors have a claim against him, not you, [01:48:30.800 --> 01:48:35.800] as long as your signature was not on the documents, the original documents, [01:48:35.800 --> 01:48:40.800] to apply for the credit card or to apply for the loan if it's a student loan [01:48:40.800 --> 01:48:45.800] or to take out the mortgage if it's for a house or whatever, [01:48:45.800 --> 01:48:48.800] as long as your signature is not on any of that paperwork, [01:48:48.800 --> 01:48:51.800] you are not liable to those companies. [01:48:51.800 --> 01:48:53.800] End of story, period. [01:48:53.800 --> 01:48:58.800] Now, your ex-husband or soon-to-be ex-husband may have a claim against you. [01:48:58.800 --> 01:49:01.800] Let him sue you. [01:49:01.800 --> 01:49:03.800] I mean, this is ridiculous. [01:49:03.800 --> 01:49:08.800] I have seen people nearly get, their whole lives get ruined in situations [01:49:08.800 --> 01:49:17.800] where the husband had his name solely, only, on the house, [01:49:17.800 --> 01:49:22.800] on the mortgage, property was in his name, and the divorce, [01:49:22.800 --> 01:49:25.800] the wife ended up getting the house, [01:49:25.800 --> 01:49:29.800] and the judge ordered her responsible for what was left of the mortgage. [01:49:29.800 --> 01:49:33.800] Well, she just lived in the house and didn't pay anything. [01:49:33.800 --> 01:49:35.800] Well, guess whose credit got ruined? [01:49:35.800 --> 01:49:37.800] Guess who got the judgment? [01:49:37.800 --> 01:49:38.800] The ex-husband. [01:49:38.800 --> 01:49:43.800] It nearly ruined his life, okay, and it took a lot to get out of it [01:49:43.800 --> 01:49:46.800] because there was nothing that could be done. [01:49:46.800 --> 01:49:48.800] Her name was not on the paperwork. [01:49:48.800 --> 01:49:50.800] It's just a gentleman's agreement. [01:49:50.800 --> 01:49:55.800] That's all it is, and the original lenders, the original creditors, [01:49:55.800 --> 01:50:00.800] could care less what these divorce courts say about splitting up the debt, okay? [01:50:00.800 --> 01:50:04.800] That is the reality of the situation, and so, like I said, [01:50:04.800 --> 01:50:09.800] I don't want to overtly advise anyone to go against a court order, [01:50:09.800 --> 01:50:14.800] but hey, if you didn't sign the paper to the lender, you're not responsible. [01:50:14.800 --> 01:50:15.800] That's all there is to it. [01:50:15.800 --> 01:50:21.800] The absolute worst that could happen, really, honestly, is that you could be, [01:50:21.800 --> 01:50:24.800] I guess, you know, there's a one in a billionth of a chance [01:50:24.800 --> 01:50:28.800] that you could be held in contempt of court for not actually paying, [01:50:28.800 --> 01:50:30.800] for not going along with a court order. [01:50:30.800 --> 01:50:35.800] The likelihood of that happening is, I mean, [01:50:35.800 --> 01:50:41.800] it's probably a billionth of a chance of getting struck by lightning, okay? [01:50:41.800 --> 01:50:43.800] That's about the chance of it's going to happen. [01:50:43.800 --> 01:50:47.800] Nothing happened to this woman who totally screwed over this guy, okay, [01:50:47.800 --> 01:50:50.800] with the house, all right, nothing, okay? [01:50:50.800 --> 01:50:54.800] And so I would not be that concerned about that. [01:50:54.800 --> 01:50:58.800] I mean, I suppose your ex-husband could sue you, okay, [01:50:58.800 --> 01:51:02.800] come back and sue you and get a judgment against you in a civil court, [01:51:02.800 --> 01:51:06.800] a regular civil court, not a divorce court, but a regular civil court, [01:51:06.800 --> 01:51:10.800] and if he had that judgment, I guess, technically, [01:51:10.800 --> 01:51:14.800] he could put a claim on any property you own or, you know, [01:51:14.800 --> 01:51:18.800] show up with a constable and start hauling off furniture or something like that. [01:51:18.800 --> 01:51:22.800] The likelihood of that happening is pretty nil, all right? [01:51:22.800 --> 01:51:24.800] So that's my take on it. [01:51:24.800 --> 01:51:27.800] If it's not in your name, I just wouldn't even worry about it. [01:51:27.800 --> 01:51:31.800] And if it is in your name, then there are ways to get rid of that debt [01:51:31.800 --> 01:51:34.800] and get rid of the bad scores on your credit report. [01:51:34.800 --> 01:51:38.800] There's even ways to get a judgment out of your credit report [01:51:38.800 --> 01:51:40.800] through the Mike Maris method. [01:51:40.800 --> 01:51:42.800] It happens in out-of-court settlement. [01:51:42.800 --> 01:51:45.800] What happens is you set them up for a federal lawsuit [01:51:45.800 --> 01:51:47.800] under the Fair Credit Reporting Act [01:51:47.800 --> 01:51:50.800] and under the Fair Debt Collections Practices Act, [01:51:50.800 --> 01:51:54.800] and you hold their feet to fire in federal court. [01:51:54.800 --> 01:51:56.800] Most of the time, you don't even have to show up in court. [01:51:56.800 --> 01:52:00.800] Most of the time, they'll settle out of court with you before it even gets to court. [01:52:00.800 --> 01:52:03.800] You draft up the lawsuit, you set them up for the lawsuit, [01:52:03.800 --> 01:52:05.800] you set them up for their liability, [01:52:05.800 --> 01:52:09.800] and then you draft up the lawsuit and the violations keep adding up, [01:52:09.800 --> 01:52:12.800] and then you send them the tort letter with the draft suit. [01:52:12.800 --> 01:52:14.800] Most of the time, you don't even actually have to sue them. [01:52:14.800 --> 01:52:16.800] This works 100% of the time. [01:52:16.800 --> 01:52:18.800] I've done it, okay? [01:52:18.800 --> 01:52:21.800] And then as part of the out-of-court settlement, [01:52:21.800 --> 01:52:24.800] because they will eventually come to the table, [01:52:24.800 --> 01:52:28.800] they will eventually cry uncle and settle with you out of court [01:52:28.800 --> 01:52:34.800] so that you will drop the federal lawsuit against them under the FCRA and DCPA. [01:52:34.800 --> 01:52:37.800] And as part of the settlement agreement, you say, [01:52:37.800 --> 01:52:42.800] okay, I'll drop the suit against you if you pay me such and such amount [01:52:42.800 --> 01:52:47.800] and if you remove the judgment out of my credit report. [01:52:47.800 --> 01:52:51.800] You have a judgment against me from a state court case. [01:52:51.800 --> 01:52:55.800] You remove that judgment out of my credit report and void the judgment. [01:52:55.800 --> 01:52:58.800] You file a document in that case voiding the judgment, [01:52:58.800 --> 01:53:00.800] get that judgment out of my credit report, [01:53:00.800 --> 01:53:03.800] and then I'll drop the lawsuit against you in federal court. [01:53:03.800 --> 01:53:05.800] And they will do it, okay? [01:53:05.800 --> 01:53:07.800] They will do it. [01:53:07.800 --> 01:53:10.800] And that's all explained in the Mike Mears method. [01:53:10.800 --> 01:53:11.800] So that's my take on it. [01:53:11.800 --> 01:53:13.800] I would not even be concerned about this at all. [01:53:13.800 --> 01:53:16.800] Let me make a comment here. [01:53:16.800 --> 01:53:21.800] The debt collectors always do it wrong. [01:53:21.800 --> 01:53:23.800] Now, they know they're doing it wrong, [01:53:23.800 --> 01:53:26.800] but they make a lot of money doing it wrong. [01:53:26.800 --> 01:53:30.800] Every once in a while, somebody comes along and stings them for it. [01:53:30.800 --> 01:53:34.800] Well, it's a cost of doing business. [01:53:34.800 --> 01:53:38.800] And the beauty of the Mike Mears method is it takes advantage [01:53:38.800 --> 01:53:43.800] of the knowledge that they always do it wrong. [01:53:43.800 --> 01:53:46.800] So you might go look at that. [01:53:46.800 --> 01:53:52.800] If the debts come back to you, you have a way to make them go away. [01:53:59.800 --> 01:54:03.800] One is, in my reply, I mean, [01:54:03.800 --> 01:54:09.800] should I put all of my debts that just apply to me on that, [01:54:09.800 --> 01:54:14.800] or does it matter? [01:54:14.800 --> 01:54:19.800] Okay, from this perspective, [01:54:19.800 --> 01:54:24.800] you want the judge to order him to pay half of all your debts [01:54:24.800 --> 01:54:27.800] unless the judge is going to look at your debts [01:54:27.800 --> 01:54:30.800] and if they kind of balance out, [01:54:30.800 --> 01:54:33.800] he's going to say everybody paid it wrong. [01:54:33.800 --> 01:54:39.800] Yeah, and keep in mind, if the judge orders him to pay half of your debts, [01:54:39.800 --> 01:54:42.800] don't take that to the bank, okay? [01:54:42.800 --> 01:54:44.800] Don't rely on that. [01:55:44.800 --> 01:55:53.800] Okay, unless, if they sent the document to you [01:55:53.800 --> 01:56:00.800] and the facts of the case are clearly facts concerning your case, [01:56:00.800 --> 01:56:03.800] the fact of a clerical error or a typo [01:56:03.800 --> 01:56:07.800] or even somebody getting the wrong name on the document, [01:56:07.800 --> 01:56:13.800] they're going to consider that an unsproutonk, a correctable error [01:56:13.800 --> 01:56:16.800] and it won't be fatal at all, it'll just... [01:56:16.800 --> 01:56:19.800] Nonesproutonk is where you go in and say, [01:56:19.800 --> 01:56:22.800] there's an error we need to correct, they'll just correct it. [01:56:22.800 --> 01:56:24.800] I know there's a lot of people out there saying [01:56:24.800 --> 01:56:26.800] if they don't spell your name exactly right [01:56:26.800 --> 01:56:29.800] and it's not you and blah, blah, blah, [01:56:29.800 --> 01:56:32.800] no, the courts are not going to do that. [01:56:33.800 --> 01:56:36.800] Yeah, they won't deny somebody their remedy [01:56:36.800 --> 01:56:41.800] because of a minor technical error that's readily correctable. [01:56:41.800 --> 01:56:46.800] There are some flaws that are fatal, [01:56:46.800 --> 01:56:51.800] but they're not just typos or spelling errors. [01:56:51.800 --> 01:56:57.800] They go to filing time dead limits and something a lot more serious. [01:56:57.800 --> 01:57:00.800] Something more along the lines of process.
