Because there's now a news story that there was some guy [06:44.800 --> 06:48.800] that was on some plane with some person that threw up and then died [06:48.800 --> 06:52.800] and was diagnosed with Ebola and that person somehow mysteriously wound up in Williamson County [06:52.800 --> 06:56.800] and then right at the same time we had one mysteriously wind up [06:56.800 --> 07:00.800] in Travis County. I guarantee you folks, before this is all said and done [07:00.800 --> 07:04.800] we will have mystery diseases popping up in every county [07:04.800 --> 07:08.800] trying to prompt people to rush down and get vaccinated [07:08.800 --> 07:12.800] against an imaginary anything [07:12.800 --> 07:16.800] so that now you've been specifically targeted. Don't forget how this can [07:16.800 --> 07:20.800] work. Not only do they get to inject you with whatever [07:20.800 --> 07:24.800] concoction they're wanting you to take that they can use [07:24.800 --> 07:28.800] against you personally later, but at the same time [07:28.800 --> 07:32.800] when they pull that needle out of your arm, what does it have [07:32.800 --> 07:36.800] on it? Your DNA. Now they [07:36.800 --> 07:40.800] can take whatever they injected you with and whatever catalyst activates it [07:40.800 --> 07:44.800] and target it specifically to the DNA of the individual [07:44.800 --> 07:48.800] they just injected. They can do all this [07:48.800 --> 07:52.800] on the fly because the injector can both inject and [07:52.800 --> 07:56.800] collect all in one fell motion. How inept [14:36.800 --> 14:40.800] do you have to be to understand that infected people got on airplanes without your knowledge [14:40.800 --> 14:44.800] and brought it to this country? Well I'm sorry [14:44.800 --> 14:48.800] how inept do you have to be not to understand that that was possible especially considering [14:48.800 --> 14:52.800] that there was an interview done with a doctor who has [14:52.800 --> 14:56.800] handled Ebola epidemics in Africa and said that [14:56.800 --> 15:00.800] this outbreak is completely different than any [15:00.800 --> 15:04.800] she has ever seen. This particular [15:04.800 --> 15:08.800] outbreak has taken much longer for the person to show symptoms [15:08.800 --> 15:12.800] and then much longer after symptoms are displayed [15:12.800 --> 15:16.800] to actually die thus ensuring [15:16.800 --> 15:20.800] that it could be [15:20.800 --> 15:24.800] more readily carried into a larger portion of the population [15:24.800 --> 15:28.800] before anyone knew the person was ill. [15:28.800 --> 15:32.800] Now how did Ebola get from what it was [15:32.800 --> 15:36.800] to that point that quickly [15:36.800 --> 15:40.800] without a helping hand? Why does [15:40.800 --> 15:44.800] American CDC have patents on Ebola? [15:44.800 --> 15:48.800] Could it be because they're producing the strains that do this? [15:48.800 --> 15:52.800] Could it be because they're not only looking for [15:52.800 --> 15:56.800] ways to cure it but they're manufacturing ways to make it worse? [24:46.800 --> 24:50.800] Yeah but I mean just from a logical standpoint this is the argument [24:50.800 --> 24:54.800] that a lot of the UCC folks make yet I'm sitting here asking [24:54.800 --> 24:58.800] why do you presume that a living man [24:58.800 --> 25:02.800] can or would or should file commercial [25:02.800 --> 25:06.800] paperwork to establish something the paperwork can't [25:06.800 --> 25:10.800] possibly establish. [26:54.800 --> 26:58.800] So first off you're going to have to convince [26:58.800 --> 27:02.800] yourself that what you do have in your head is wrong [27:02.800 --> 27:06.800] before you're going to be willing to listen to some things that might be right. [35:12.800 --> 35:16.800] Not showing proof of financial responsibility. [35:16.800 --> 35:20.800] And the suspension will be November 15th when it starts. [35:20.800 --> 35:24.800] And that is what I want to tell you. Here we go. [35:24.800 --> 35:28.800] Yeah, again, that case was never adjudicated, correct? [35:28.800 --> 35:32.800] No. And you don't know if they ever filed an actual complaint [35:32.800 --> 35:36.800] or if Oregon actually requires a complaint, but [35:36.800 --> 35:40.800] in any case, yeah, you should be able to fight it. What they [35:40.800 --> 35:44.800] may likely try to do is get you to request that the case be reopened [35:44.800 --> 35:48.800] so that they don't have to do it and they can re-establish a statute of limitations on it [35:48.800 --> 35:52.800] if it can be done and proceed from there. [35:52.800 --> 35:56.800] So be very careful what you do, but [35:56.800 --> 36:00.800] don't let them get away with it. Sure, sure. [36:00.800 --> 36:04.800] But I should, as you state a lot of times in your seminars, [36:04.800 --> 36:08.800] you don't really have to do that much. You just say very little, [36:08.800 --> 36:12.800] you shut up, and when you're done shutting up, you shut up some more and then you're done with that, [36:12.800 --> 36:16.800] shut up even more. That's correct. [36:16.800 --> 36:20.800] And make them prove to you that I am a driver [36:20.800 --> 36:24.800] and I'm regulated under their authority to [36:24.800 --> 36:28.800] perform what they want me to do. I'm just going to engage in just the necessary traveling [36:36.800 --> 36:40.800] after November the 15th. And at the time I do get traffic stopped [36:40.800 --> 36:44.800] and just follow the script, whatever happens happens, [36:44.800 --> 36:48.800] I comply with the officer, whatever he does, except for not giving up my rights [36:48.800 --> 36:52.800] and let him do what he's going to do, and then [36:52.800 --> 36:56.800] if he rusts me, takes me to jail and pounds my automobile, [36:56.800 --> 37:00.800] at that point I get an attorney, from that point forward [37:00.800 --> 37:04.800] after that happens. If you get an attorney, then [37:04.800 --> 37:08.800] you're already gone. [37:08.800 --> 37:12.800] That's the part about you needing to learn the rules for yourself. [37:12.800 --> 37:16.800] That way if you get an attorney, you know how to control them. [37:16.800 --> 37:20.800] And if you don't get an attorney, then you know how to fight it yourself. [37:20.800 --> 37:24.800] But if you don't know how to control that attorney, you're at his mercy. [37:24.800 --> 37:28.800] And he doesn't care that he is supposed to be working for you, [37:28.800 --> 37:32.800] he doesn't work for you. [37:32.800 --> 37:36.800] So I should fight this pro per then? [37:36.800 --> 37:40.800] Well, if you are capable of doing it, yes. Hence the reason why I tell people [37:40.800 --> 37:44.800] look, yeah, you have a right to do this, but until you're able to take it [37:44.800 --> 37:48.800] to court and fight it and argue it for yourself, you're not prepared [37:48.800 --> 37:52.800] to exercise that right. You cannot [37:52.800 --> 37:56.800] go into this fight defenseless and ignorant. That's not a good combination. [37:56.800 --> 38:00.800] Okay, so when you start [38:00.800 --> 38:04.800] this fight, preparation and training had already [38:04.800 --> 38:08.800] been a past thing in your repertoire. [38:08.800 --> 38:12.800] Right. I pretty much just [38:12.800 --> 38:16.800] address the officer, what's the emergency? [38:16.800 --> 38:20.800] Pretty much and for the record, what is your name and badge number? Am I under arrest or am I free to go? [38:20.800 --> 38:24.800] Well, in Oregon, [38:24.800 --> 38:28.800] are traffic [38:28.800 --> 38:32.800] offenses infractions instead of crimes and are the infractions civil [38:32.800 --> 38:36.800] instead of criminal? I believe on this [38:36.800 --> 38:40.800] period, it doesn't make much mention to that, but I believe it's [38:40.800 --> 38:44.800] an infraction, but as far as sisters [38:44.800 --> 38:48.800] are trying to say that I'm going to have a suspended license, that would be a misdemeanor. [38:48.800 --> 38:52.800] Well, but they'll call them all kinds of things. What you need to find [38:52.800 --> 38:56.800] out is what the statute specifically says it is. Is it an [38:56.800 --> 39:00.800] infraction or is it a misdemeanor? And if it is an infraction, [39:00.800 --> 39:04.800] are infractions considered criminal in Oregon? They're not [39:04.800 --> 39:08.800] in California, they're not in Washington, they're not in New York. [39:08.800 --> 39:12.800] Right. So if they're not criminal, [39:12.800 --> 39:16.800] then what are they? [39:16.800 --> 39:20.800] And if they are civil [39:20.800 --> 39:24.800] or administrative, where was the proper due process and [39:24.800 --> 39:28.800] notice for you to have a hearing before they went this route of suspending [39:28.800 --> 39:32.800] any of this? And if the officer stopped you [39:32.800 --> 39:36.800] based upon an infraction, then he broke the law by [39:36.800 --> 39:40.800] making a false arrest and a false imprisonment and detained you for nothing [39:40.800 --> 39:44.800] because he can't stop you without a warrant [39:44.800 --> 39:48.800] for an infraction. And he can't get a warrant for an infraction [39:48.800 --> 39:52.800] because it's not a crime. [39:52.800 --> 39:56.800] So he can't swear out a warrant on probable cause, can he? [39:56.800 --> 40:00.800] No, I don't believe so. At the bottom of [40:00.800 --> 40:04.800] this form that I got has a part here [40:04.800 --> 40:08.800] that says legal authority. I'm not sure what that means, but it says legal authority [40:08.800 --> 40:12.800] says Oregon revised statutes, ORS, and it has numbers. [40:12.800 --> 40:16.800] A series of about six or seven different numbers. Well that's telling you what statute [40:16.800 --> 40:20.800] authorizes them to do what they're doing with your suspension. [40:20.800 --> 40:24.800] Right. But you need to go read that [40:24.800 --> 40:28.800] and see where it says after conviction [40:28.800 --> 40:32.800] Okay. [40:40.800 --> 40:44.800] Got anything else? So that's apparently what happened before [48:02.800 --> 48:06.800] 2011 when I came back to Oregon and I had to pay a fee [48:06.800 --> 48:10.800] to reinstate my license because they said that [48:10.800 --> 48:14.800] my license was suspended for [48:14.800 --> 48:18.800] just not applying or renewing the license, which seemed really ridiculous to me. [48:18.800 --> 48:22.800] But I didn't understand all of these things that [48:22.800 --> 48:26.800] your instruction, your programs, your seminars, and your show explains. [48:26.800 --> 48:30.800] So I paid the fee then and then shortly thereafter within a few months [48:30.800 --> 48:34.800] they do these random checks where they go about and they pick a number [48:34.800 --> 48:38.800] like a lottery system type of thing and if your number comes up they want you to [48:38.800 --> 48:42.800] just show proof that you do have financial responsibility without anything [48:42.800 --> 48:46.800] happening. When I came to Oregon it was like $110 to $120 for [49:02.800 --> 49:06.800] liability and then you have to carry uninsured motors, [49:06.800 --> 49:10.800] insurance protection as well. That's really ridiculous. [49:10.800 --> 49:14.800] It's too expensive. So I got some insurance for a little while because I had to [49:14.800 --> 49:18.800] because they were going to suspend it. This was like two and a half years ago. They were going to suspend it then [49:18.800 --> 49:22.800] but I didn't know about all what you're teaching, this truth [49:22.800 --> 49:26.800] that you're bringing out to us now. So what happened was [49:26.800 --> 49:30.800] they required me to file an SR-22, which I think [49:30.800 --> 49:34.800] that's ridiculous. That's for people who've committed certain types of violations, [49:34.800 --> 49:38.800] misdemeanor behind the wheel violations like being drunk [49:38.800 --> 49:42.800] while on the road or running into somebody or hit and run [49:42.800 --> 49:46.800] or things of that nature. [49:46.800 --> 49:50.800] I let my insurers, I cancelled my insurance [49:50.800 --> 49:54.800] in August and it takes about 60 days for them to discover it. [49:54.800 --> 49:58.800] Insurance company, whatever reports it from that SR-22 requirement [49:58.800 --> 50:02.800] filing and then contacts me to say why did I drop my insurance and you will [50:02.800 --> 50:06.800] be suspended in 30 days if you don't renew it as a threat. [50:06.800 --> 50:10.800] That's where I'm at right now. [50:10.800 --> 50:14.800] Okay. [50:14.800 --> 50:18.800] So they're suspending your license because you cancelled [50:18.800 --> 50:22.800] your insurance? Yes. [50:22.800 --> 50:26.800] So what exactly is your [50:26.800 --> 50:30.800] plan here? [50:30.800 --> 50:34.800] Well, I plan on trying to use the [50:34.800 --> 50:38.800] transportation script to the best of my ability. [50:38.800 --> 50:42.800] When that time, if it does, which is kind of a slim chance [50:42.800 --> 50:46.800] if I do get pulled over [50:46.800 --> 50:50.800] in the near future after this suspension begins. [50:50.800 --> 50:54.800] Okay. [50:54.800 --> 50:58.800] So that's step one. What are you going to do with the other 30? [50:58.800 --> 51:02.800] Well, [51:02.800 --> 51:06.800] I'm just going to let the chips fall where they may I guess. Well, they're going to [51:06.800 --> 51:10.800] fall all over you is where they're going to fall if you don't know how to [51:10.800 --> 51:14.800] catch them. Right. [51:14.800 --> 51:18.800] Well, you know they're going to do what [51:18.800 --> 51:22.800] they're going to do. They're going to use this color of law. [51:22.800 --> 51:26.800] Okay. Alright. [51:26.800 --> 51:30.800] I can see how this argument is going to go and I'm going to tell you right now [51:30.800 --> 51:34.800] don't do what you're planning on doing. You're not prepared to do this. [51:34.800 --> 51:38.800] Okay. The fact that you're sitting here telling me what you're [51:38.800 --> 51:42.800] telling me makes it very clear to me that you do not have [51:42.800 --> 51:46.800] any idea how to fight this fight when they come knocking on your door and [51:46.800 --> 51:50.800] they will eventually come knocking on your door. How long that [51:50.800 --> 51:54.800] will be I can't say. How much you can learn between when it starts and when [51:54.800 --> 51:58.800] it stops I can't say. But until you've done that I can [51:58.800 --> 52:02.800] tell you you're picking a fight with a boxing champion and you've never even [52:02.800 --> 52:06.800] trained to get in the ring. Right. [52:06.800 --> 52:10.800] But in order for me to do anything and have [52:10.800 --> 52:14.800] a case I have to suffer. Why do you want to have a case until you [52:14.800 --> 52:18.800] learn how to fight the dang thing? Why do you [52:18.800 --> 52:22.800] want to go play a game where you are definitely going to lose [52:22.800 --> 52:26.800] without first bothering to learn the rules of the game so you might stand [52:26.800 --> 52:30.800] a chance? I've been studying some of it [52:30.800 --> 52:34.800] I just haven't had the time [52:34.800 --> 52:38.800] to sit down and study it thoroughly but at this point I'm definitely [52:38.800 --> 52:42.800] going to be doing that. I plan on hitting the books on this so to speak [52:42.800 --> 52:46.800] and learning how to do this. Well like I say I [52:46.800 --> 52:50.800] can't tell anyone what to do and I don't want to tell anyone what to do. How do they have to prove that you're a driver? [55:14.800 --> 55:18.800] By showing me the statutes [55:18.800 --> 55:22.800] that says anybody that's in their automobile, whatever. They don't have to show [55:22.800 --> 55:26.800] the statute to prove that you're a driver. [55:26.800 --> 55:30.800] Where did you get the idea they had to do that? Well you'd mentioned [55:30.800 --> 55:34.800] that you don't go in and defend yourself by [55:34.800 --> 55:38.800] trying to teach them that you're not a driver but you have to have them prove [55:38.800 --> 55:42.800] to you that you are not a driver. [55:42.800 --> 55:46.800] No. You have to get them to [55:46.800 --> 55:50.800] try to prove that you are. [55:50.800 --> 55:54.800] Yeah, that's what I mean. Okay. [56:34.800 --> 56:38.800] And what good is it going to do for you to ask [56:38.800 --> 56:42.800] some person in the DMV that question? When it comes to going [56:42.800 --> 56:46.800] to court, how does that question to that DMV employee help you? [56:46.800 --> 56:50.800] Well I want to contact the [56:50.800 --> 56:54.800] administrators, the ones that are at the top, that write these laws. [56:54.800 --> 56:58.800] They don't write them. The legislature writes them. [56:58.800 --> 57:02.800] Well the legislature votes to approve them. The [57:02.800 --> 57:06.800] agency generally writes the statutes on top of the underlying law [57:06.800 --> 57:10.800] but you're still kind of missing the point here. Okay. [57:10.800 --> 57:14.800] How do you intend to use whatever information you [57:14.800 --> 57:18.800] get from them to help you in court? [57:18.800 --> 57:22.800] Well, they can't show me anything. [57:22.800 --> 57:26.800] Who can't? I'm sure all their definitions are going to be applied [57:26.800 --> 57:30.800] to those who are drivers, who are engaged in commerce. However, if you do produce [01:05:30.800 --> 01:05:34.800] any of the accouterments of transportation and commercial use of the highways during the [01:05:34.800 --> 01:05:38.800] stop, guess what you have to do now? [01:05:38.800 --> 01:05:42.800] You have to fight on their terms. You have to fight on merits. [01:05:42.800 --> 01:05:46.800] Which means now you have to know the actual statutes and [01:05:46.800 --> 01:05:50.800] everything they're required to prove and how they're required to prove it. [01:05:50.800 --> 01:05:54.800] Therefore, you have to know how to use [01:05:54.800 --> 01:05:58.800] both sides of the same sword. [01:05:58.800 --> 01:06:02.800] Okay, three pieces of proving commercial activity [01:06:02.800 --> 01:06:06.800] and then the statutes I need to know. No. [01:06:06.800 --> 01:06:10.800] They're two different defenses and you cannot mix them. [01:06:10.800 --> 01:06:14.800] One is not engaged in transportation or any [01:06:14.800 --> 01:06:18.800] other commercial use of the highway and the other is fighting on [01:06:18.800 --> 01:06:22.800] the merits of the accusation itself. You cannot [01:06:22.800 --> 01:06:26.800] mix these defenses. They are oil and water. They are [01:06:26.800 --> 01:06:30.800] fire and gunpowder. Don't put them together. [01:06:34.800 --> 01:06:38.800] Okay, so just do one? Yeah, and which one [01:06:38.800 --> 01:06:42.800] you have to do is determine by what you do or do not do [01:06:42.800 --> 01:06:46.800] at the initial stop. [01:06:46.800 --> 01:06:50.800] Okay. [01:06:50.800 --> 01:06:54.800] Other than that, in your videos that you say [01:06:54.800 --> 01:06:58.800] very little, just certain things what the officer [01:06:58.800 --> 01:07:02.800] named for the record and his badge number, and that you say I'm not [01:07:02.800 --> 01:07:06.800] engaged in transportation. I don't know which video you're referring to, but the [01:07:06.800 --> 01:07:10.800] two and a half hour one on Infowars tells you a whole [01:07:10.800 --> 01:07:14.800] lot more than that as far as the things that you want to get onto the record. [01:07:14.800 --> 01:07:18.800] The other one is the most simple basic thing to do [01:07:18.800 --> 01:07:22.800] until you learn what your rights are and how to invoke [01:07:22.800 --> 01:07:26.800] them, but you actually want to do a little bit more than that to make [01:07:26.800 --> 01:07:30.800] the record on how you're protecting your rights and why, so that the [01:07:30.800 --> 01:07:34.800] courts can't rule against you later. That's what the transportation [01:07:34.800 --> 01:07:38.800] script tries to teach you. [01:07:42.800 --> 01:07:46.800] Okay, so it is complicated. [01:07:46.800 --> 01:07:50.800] It's a lot more complicated than it sounds, and the reason is [01:07:50.800 --> 01:07:54.800] they've designed it that way. So you have to know [01:07:54.800 --> 01:07:58.800] how to play that game and play it well, and when you don't, you [01:07:58.800 --> 01:08:02.800] get beat up. Financially [01:08:02.800 --> 01:08:06.800] and through frustration and everything else. [01:08:06.800 --> 01:08:10.800] Okay, but that is by design. [01:08:10.800 --> 01:08:14.800] So if you want to take this fight, go ahead, but I'm telling [01:08:14.800 --> 01:08:18.800] you right now, my opinion is you're not prepared enough to do this yet. We've already established that Rule 4.13. There's a definition [01:14:14.800 --> 01:14:18.800] for include and including and it makes the [01:14:18.800 --> 01:14:22.800] distinction saying that includes and including is inclusive [01:14:22.800 --> 01:14:26.800] and not exclusive, kind of contrary to the [01:14:26.800 --> 01:14:30.800] exclusio alter. I actually know it's not. It goes [01:14:30.800 --> 01:14:34.800] hand in hand with it. Expansive simply means that they [01:14:34.800 --> 01:14:38.800] can use anything of similar type. [01:14:38.800 --> 01:14:42.800] For instance, if the statute says includes lemons, [01:14:42.800 --> 01:14:46.800] oranges, and grapefruits, how can that be [01:14:46.800 --> 01:14:50.800] expansive beyond those? How can that rule be used? [01:14:50.800 --> 01:14:54.800] Well, if you read the ending of it, it says [01:14:54.800 --> 01:14:58.800] it's not to be construed as if something is missing in the [01:14:58.800 --> 01:15:02.800] list, that it's not included. It kind of usurps the [01:15:02.800 --> 01:15:06.800] The courts say that is incorrect. The courts [01:15:06.800 --> 01:15:10.800] say very clearly that the statute can't be overbroad that [01:15:10.800 --> 01:15:14.800] way. The statute can only list like things. [01:15:14.800 --> 01:15:18.800] So if it says oranges, lemons, and grapefruits, [01:15:18.800 --> 01:15:22.800] then that means it can include other [01:15:22.800 --> 01:15:26.800] citrus fruits, but it can't include bananas and apples. [01:15:26.800 --> 01:15:30.800] That's the rule. So that's [01:15:30.800 --> 01:15:34.800] the only way that it can be considered expansive. [01:15:34.800 --> 01:15:38.800] You can't add something to it that is not of a like thing. [01:15:38.800 --> 01:15:42.800] Okay. Alright Max, [01:19:46.800 --> 01:19:50.800] just to give you something else on this, let's take for instance the definition [01:19:50.800 --> 01:19:54.800] of the term person that's also in chapter 311 of the government code [01:19:54.800 --> 01:19:58.800] and is used throughout the statutes, right? Now the courts [01:19:58.800 --> 01:20:02.800] are continuously trying to say that the term individual [01:20:02.800 --> 01:20:06.800] when used in statutes means exactly the same thing as it does in the penal [01:20:06.800 --> 01:20:10.800] code unless the statute defines it differently. Well they try [01:20:10.800 --> 01:20:14.800] to say the same thing in relation to person, but they have a problem. They don't bother [01:20:14.800 --> 01:20:18.800] to read the Texas legislative drafting manual. So let me read you a [01:20:18.800 --> 01:20:22.800] paragraph out of the 2014 version which has been [01:20:22.800 --> 01:20:26.800] edited from the 2008 version which actually contains [01:20:26.800 --> 01:20:30.800] even further clarification here in addition to what we're about [01:20:30.800 --> 01:20:34.800] to hear. But when you look on page 14 of the legislative [01:20:34.800 --> 01:20:38.800] drafting manual for 2014 subsection H, person [01:20:38.800 --> 01:20:42.800] this is how this paragraph reads [01:20:42.800 --> 01:20:46.800] It is often desirable to define person broadly such as [01:20:46.800 --> 01:20:50.800] an individual, corporation, or association. Although [01:20:50.800 --> 01:20:54.800] this violates the rule against giving a word an artificial meaning [01:20:54.800 --> 01:20:58.800] the advantage of avoiding unnecessary repetition and the long [01:20:58.800 --> 01:21:02.800] standing practice of so defining this word outweigh the [01:21:02.800 --> 01:21:06.800] policy behind the rule. Section 1.07 of the [01:21:06.800 --> 01:21:10.800] penal code defines person in this way and as already noted [01:21:10.800 --> 01:21:14.800] penal code definitions also apply to penal laws outside the code. [01:21:14.800 --> 01:21:18.800] While it is legally unnecessary to [01:21:18.800 --> 01:21:22.800] redefine person in a penal law outside of the code except [01:21:22.800 --> 01:21:26.800] to provide a different definition, the [01:21:26.800 --> 01:21:30.800] express adoption of that definition, see the following subsection, [01:21:30.800 --> 01:21:34.800] may be helpful to alert users of the statutes who may [01:21:34.800 --> 01:21:38.800] be unaware of the general application of the penal code definitions. [01:21:38.800 --> 01:21:42.800] Now here is the kicker. The definition [01:21:42.800 --> 01:21:46.800] of person in section 311.005 [01:21:46.800 --> 01:21:50.800] government code applies to those codes [01:21:50.800 --> 01:21:54.800] which the code construction act applies and that do not [01:21:54.800 --> 01:21:58.800] otherwise define the term. Now look [01:21:58.800 --> 01:22:02.800] at the very beginning of every single one of the codes [01:22:02.800 --> 01:22:06.800] that we have and see if [01:22:06.800 --> 01:22:10.800] the code construction act is not mentioned [01:22:10.800 --> 01:22:14.800] as being applicable to that code. In the code of [01:22:14.800 --> 01:22:18.800] criminal procedure the only time that it doesn't have that is [01:22:18.800 --> 01:22:22.800] in title 1. It is in title [01:22:22.800 --> 01:22:26.800] 2. So the term person applies [01:22:26.800 --> 01:22:30.800] in title 2 as defined in 311.005 [01:22:30.800 --> 01:22:34.800] government code and there is no question [01:22:34.800 --> 01:22:38.800] that 311.005 government code is [01:22:38.800 --> 01:22:42.800] 100% legal entity [01:22:42.800 --> 01:22:46.800] i.e. commercial. [01:22:46.800 --> 01:22:50.800] Understood. [01:22:50.800 --> 01:22:54.800] I mistited it. I said 311.015 [01:22:54.800 --> 01:22:58.800] I was wrong. It was 005 just like you said. [01:22:58.800 --> 01:23:02.800] Now if you look at that section of code, like I said [01:23:02.800 --> 01:23:06.800] the only one that is out of alphabetical order is includes and including. [01:23:06.800 --> 01:23:10.800] They define that in 13. [01:23:10.800 --> 01:23:14.800] You will notice that every definition above it uses the words includes [01:23:14.800 --> 01:23:18.800] in its definition. Is the significance of them [01:23:18.800 --> 01:23:22.800] putting it at the bottom before they use the word [01:23:22.800 --> 01:23:26.800] that is extremely significant here. Now if you will look you will [01:23:26.800 --> 01:23:30.800] probably find that that section has been amended several times [01:23:30.800 --> 01:23:34.800] and when the case law came out defining the rules of statutory [01:23:34.800 --> 01:23:38.800] construction that definition usage of includes was put in there [01:23:38.800 --> 01:23:42.800] to try to circumvent the way the definition [01:23:42.800 --> 01:23:46.800] rules of statutory construction were forcing the direction of the statutes. [01:23:46.800 --> 01:23:50.800] Well they can't circumvent it. But because [01:23:50.800 --> 01:23:54.800] of the fact that they define it at the very bottom [01:23:54.800 --> 01:23:58.800] you know and before you ever get to the definition of person [01:23:58.800 --> 01:24:02.800] you know so I mean it clearly doesn't affect [01:24:02.800 --> 01:24:06.800] the definition of person when it says and its limited scope [01:24:06.800 --> 01:24:10.800] in the use of the words includes and included. Well it does [01:24:10.800 --> 01:24:14.800] again its placement is not relevant in that regard. [01:24:14.800 --> 01:24:18.800] They simply put it on the end because it didn't exist in the original [01:24:18.800 --> 01:24:22.800] numbering scheme. So rather than renumber everything else [01:24:22.800 --> 01:24:26.800] they simply put it at the bottom. That's one potential possibility. [01:24:26.800 --> 01:24:30.800] But you will never win the argument that because it came [01:24:30.800 --> 01:24:34.800] after these definitions that that does not hold true for [01:24:34.800 --> 01:24:38.800] those definitions. Yes not so much [01:24:38.800 --> 01:24:42.800] trying to understand. Yeah I'm just [01:24:42.800 --> 01:24:46.800] making people aware of that. You're not going to win that argument. [01:24:46.800 --> 01:24:50.800] They're going to argue it applies and I would tend to agree with it. But what you [01:24:50.800 --> 01:24:54.800] have to understand is what those other definitions [01:24:54.800 --> 01:24:58.800] actually say that actually help you prove [01:24:58.800 --> 01:25:02.800] the true nature of the rest of the codes statutes. [01:25:02.800 --> 01:25:06.800] Okay Eddie one more thing. Let me read out here [01:25:06.800 --> 01:25:10.800] that the actual definition of includes and including on item 13 [01:25:10.800 --> 01:25:14.800] the very last one of that general definition section. [01:25:14.800 --> 01:25:18.800] Includes and including are terms of enlargement and [01:25:18.800 --> 01:25:22.800] not of limitation or exclusive enumeration and use [01:25:22.800 --> 01:25:26.800] of the terms does not create a presumption that components not [01:25:26.800 --> 01:25:30.800] expressed are excluded. Right and that is exactly why the [01:25:30.800 --> 01:25:34.800] court said that can't be done. That would mean that they could come along [01:25:34.800 --> 01:25:38.800] and rewrite the law to it to encompass anything they [01:25:38.800 --> 01:25:42.800] want anytime they want without any legislative [01:25:42.800 --> 01:25:46.800] action whatsoever. Darn right so how do we argue [01:25:46.800 --> 01:25:50.800] that that's repugnant to law? It's not repugnant to law as [01:25:50.800 --> 01:25:54.800] long as the rules of statutory interpretation are applied. It is [01:25:54.800 --> 01:25:58.800] repugnant if they wish to argue that the rules of statutory interpretation [01:25:58.800 --> 01:26:02.800] cannot be applied. Now you can say [01:26:02.800 --> 01:26:06.800] oh great well then it's vague and overbroad and totally ambiguous. Therefore [01:26:06.800 --> 01:26:10.800] it's unconstitutional on those grounds. So we can look up [01:27:58.800 --> 01:28:02.800] and see if we can find a motion to void judgment but basically [01:28:02.800 --> 01:28:06.800] a void judgment is simply going to do the same thing that a motion for new trial [01:28:06.800 --> 01:28:10.800] does. It states the reason why the ruling of the court [01:28:10.800 --> 01:28:14.800] and the finding of the jury if there was one does not comply with [01:28:14.800 --> 01:28:18.800] law and why the judgment should be declared void [01:28:18.800 --> 01:28:22.800] and then it's filed with a higher court above that one [01:28:22.800 --> 01:28:26.800] where the trial was held in order to get the verdict overturned [01:28:26.800 --> 01:28:30.800] and that can be done either on the appeals level or it can be done [01:28:30.800 --> 01:28:34.800] outside of appeal if the issue is lack of jurisdiction. In which case [01:28:34.800 --> 01:28:38.800] I believe you're going to have a lack of jurisdiction issue. [01:28:38.800 --> 01:28:42.800] Right. So I'd have to [01:28:42.800 --> 01:28:46.800] argue does not comply with law and then the lack of jurisdiction. [01:36:18.800 --> 01:36:22.800] No one has to have a license to get insurance coverage [01:36:22.800 --> 01:36:26.800] on a car because they may be getting it for someone [01:36:26.800 --> 01:36:30.800] else. [01:36:30.800 --> 01:36:34.800] Like mom and dad may have bought a car in their kid's name, [01:36:34.800 --> 01:36:38.800] their kid has their own license, but mom and dad's paying the insurance bill. The [01:36:38.800 --> 01:36:42.800] insurance is in mom and dad's name and the kid is listed [01:36:42.800 --> 01:36:46.800] as a driver on the policy, but everything [01:36:46.800 --> 01:36:50.800] else is in the kid's name. Mom and dad can still pay [01:36:50.800 --> 01:36:54.800] for that. They don't have to have a license for that car that the kid drives to be insured [01:36:54.800 --> 01:36:58.800] and they pay for it. No, but in that case, though, the insured [01:36:58.800 --> 01:37:02.800] has a license. But that's not the one who got [01:37:02.800 --> 01:37:06.800] the coverage, which is what you said your agent told you was required. [01:37:06.800 --> 01:37:10.800] Okay, but if I want to be the [01:37:10.800 --> 01:37:14.800] insured, I'll have to do some asking him some questions. [01:37:14.800 --> 01:37:18.800] Well, again, if their contract specifically does not allow them to [01:37:18.800 --> 01:37:22.800] back out because you're not licensed, well, [01:37:22.800 --> 01:37:26.800] then they can't make that claim and prevail because it's not part of the contractual [01:37:26.800 --> 01:37:30.800] obligation. I've been [01:37:58.800 --> 01:38:02.800] looking for an attorney. I got a, back on September 4th, [01:38:02.800 --> 01:38:06.800] I got, like 8 o'clock that [01:38:06.800 --> 01:38:10.800] morning, the city cop. I'm from a little bitty town, Strong, Texas. [01:38:10.800 --> 01:38:14.800] And it's a population of 600 people with a little city marshal. He come by [01:38:14.800 --> 01:38:18.800] and he told me that my horse was out. So I got in my [01:38:18.800 --> 01:38:22.800] truck and I buy and sell trucks and kind of trade and [01:38:22.800 --> 01:38:26.800] do work, you know, buy junkers and fix them up. [01:38:26.800 --> 01:38:30.800] I didn't have registration. My driver's license expired [01:38:30.800 --> 01:38:34.800] I think back in 2005. You know, I've just kind of been getting around pretty lucky, I guess. [01:38:34.800 --> 01:38:38.800] But I've heard that you don't have to have [01:38:38.800 --> 01:38:42.800] no insurance, no driver's license and all that stuff, you know, and I'm a firm believer [01:38:42.800 --> 01:38:46.800] in kind of exercising it, you know, but I didn't really [01:38:46.800 --> 01:38:50.800] know exactly where to look for all the information. Anyways, he followed [01:38:50.800 --> 01:38:54.800] me in my old truck to go pin my horse up and [01:38:54.800 --> 01:38:58.800] I told him I'm leaving town. I mean, I got the closest hardware store [01:38:58.800 --> 01:39:02.800] 30 miles down the road. I went to get some wire and stuff and [01:39:02.800 --> 01:39:06.800] well, he knew that he watched me leave town. He watched me drive with no driver's license [01:39:06.800 --> 01:39:10.800] with no registration on the window or nothing. [01:39:10.800 --> 01:39:14.800] Well, I pulled back into town at 1130 at lunch [01:39:14.800 --> 01:39:18.800] and there was about a half a block from my house, there was a drug [01:39:18.800 --> 01:39:22.800] task force, there was the city marshal, county cops. [01:39:22.800 --> 01:39:26.800] They just turned their lights on like there was a convoy kind of in the line, you know, [01:39:26.800 --> 01:39:30.800] and I just pulled in my driveway. Well, they jumped out with their [01:39:30.800 --> 01:39:34.800] guns, hollering, they were going to shoot my dog and I mean just all kinds of crazy stuff [01:39:34.800 --> 01:39:38.800] and I was like, can I help you all, you know? And he said, [01:39:38.800 --> 01:39:42.800] I don't know your dog, he threatened me. He said, the reason I pulled [01:39:42.800 --> 01:39:46.800] you over is for no registration. I was like, okay. I said, [01:39:46.800 --> 01:39:50.800] you normally do all this for, you know, guns drawn and hollering, [01:39:50.800 --> 01:39:54.800] six cops, six powers and I don't know how many cops there was. [01:39:54.800 --> 01:39:58.800] And he said, he said, he was going to shoot my dog and I told him [01:39:58.800 --> 01:40:02.800] to go ahead. I said, I guess if you feel threatened, sure. I said, I don't know what to tell you. [01:40:02.800 --> 01:40:06.800] And anyways, I dialed my attorney at the time. [01:40:06.800 --> 01:40:10.800] He's a real good friend of mine. He's a former judge in Eastland County [01:40:10.800 --> 01:40:14.800] and I had him on speakerphone and I sat there, I was like, [01:40:14.800 --> 01:40:18.800] I explained to him the situation real fast. Well, they was hollering, hang up the phone, [01:40:18.800 --> 01:40:22.800] hang up the phone. And they slapped it out of my hand [01:40:22.800 --> 01:40:26.800] and they all jumped on me and handcuffed me. [01:40:26.800 --> 01:40:30.800] No warrant, no nothing. I mean, this is all he said. I heard you was a drug dealer. [01:40:30.800 --> 01:40:34.800] I said, well, I apologize. I said, I heard you was one. [01:40:34.800 --> 01:40:38.800] I said, but they don't make it true, you know. Anyways, they took me to [01:40:38.800 --> 01:40:42.800] jail for expired driver's license, expired registration, [01:40:42.800 --> 01:40:46.800] or whatever, financial responsibility, [01:40:46.800 --> 01:40:50.800] whatever you call it, and no insurance. [01:40:50.800 --> 01:40:54.800] And there was four railroad spots in the back of my truck from [01:40:54.800 --> 01:40:58.800] hell, I bought a bunch of railroad, old junk iron from the railroad [01:40:58.800 --> 01:41:02.800] place down the road here about two years ago [01:41:02.800 --> 01:41:06.800] and I have a receipt for that. But they charged me with theft under 50 [01:41:06.800 --> 01:41:10.800] for the four railroad spikes. And anyway, [01:41:10.800 --> 01:41:14.800] when I got out, they took me to jail and I got out. [01:41:14.800 --> 01:41:18.800] They charged you for theft of the railroad spikes? Yes. [01:41:18.800 --> 01:41:22.800] On what evidence? Who complained that they had [01:41:22.800 --> 01:41:26.800] spikes stolen and that the ones found in your truck were the spikes that were allegedly [01:41:26.800 --> 01:41:30.800] stolen? That's what he was [01:41:30.800 --> 01:41:34.800] assuming. Right, that's exactly what he was doing. [01:41:34.800 --> 01:41:38.800] He said I was not allowed to have them because they were railroad property. [01:41:38.800 --> 01:41:42.800] Okay, well, that's baloney. They leave them in the Dablam railroad ties [01:41:42.800 --> 01:41:46.800] all the time and they sell those to the public. [01:41:46.800 --> 01:41:50.800] Yes, sir. So, this cop [01:41:50.800 --> 01:41:54.800] Yeah, well, this cop's already in trouble, so go ahead. [01:41:54.800 --> 01:41:58.800] Yeah, when I got out of jail, you know, they just [01:41:58.800 --> 01:42:02.800] dropped me off over there, didn't book me in or nothing. He just put me in a salad pot with the jailer and took off. [01:42:02.800 --> 01:42:06.800] Well, the guy was nice enough to put me in the [01:42:06.800 --> 01:42:10.800] cell with the phone and I called my lawyer and he arranged for me to get out. [01:42:10.800 --> 01:42:14.800] But when I got home, I was going through my [01:42:14.800 --> 01:42:18.800] surveillance camera, you know, looking at the recordings [01:42:18.800 --> 01:42:22.800] at 8.30 when I left town [01:42:22.800 --> 01:42:26.800] I guess it was about 10 o'clock, 9.30, there was a task force, the county [01:42:26.800 --> 01:42:30.800] cops, the city cops, there was cops all over my house and they knew I was not [01:42:30.800 --> 01:42:34.800] here. They was in my shop, they was all up [01:42:34.800 --> 01:42:38.800] I mean, for about 30-45 minutes they was here looking around. So, where's the warrant? [01:42:38.800 --> 01:42:42.800] There is not one. Exactly, and now you've got [01:42:42.800 --> 01:42:46.800] them all on camera illegally searching your [01:42:46.800 --> 01:42:50.800] property. Well, then they realized that there was security cameras [01:42:50.800 --> 01:42:54.800] after they had been here for about 30 minutes, so the lead task force [01:42:54.800 --> 01:42:58.800] guy, there was one on top of my shop, an overview of the whole place [01:42:58.800 --> 01:43:02.800] well, he goes and he touches the wires on the cameras, the ones that he sees. [01:43:02.800 --> 01:43:06.800] Okay, so now he's tampering with the evidence, there's another [01:43:06.800 --> 01:43:10.800] felony. Right, but the question is, I mean, I cannot [01:43:10.800 --> 01:43:14.800] find, I was called the ACLU and [01:43:14.800 --> 01:43:18.800] I think, yeah, yeah, ACLU and I was called about 8 different [01:43:18.800 --> 01:43:22.800] attorneys and I can't, they all kind of sounded excited right at first [01:43:22.800 --> 01:43:26.800] until I tell them it's Palapinta County. Well, then they don't want [01:43:26.800 --> 01:43:30.800] to, it's like they all back out, I can't find nobody to take my case and I was going to see [01:43:30.800 --> 01:43:34.800] I just happened to run on years, I've been looking since before. Don't override it if they deleted anything [01:48:12.800 --> 01:48:16.800] on it, because that's tampering with evidence right there. The moment [01:48:16.800 --> 01:48:20.800] they touched that DVR and cut those wires to the camera, they were tampering [01:48:20.800 --> 01:48:24.800] with evidence. That again is a felony in Texas. [01:48:24.800 --> 01:48:28.800] Right, and that's good. I mean, because he said [01:48:28.800 --> 01:48:32.800] it was a false, I guess, he had a neighbor [01:48:32.800 --> 01:48:36.800] anonymous complaint. Right, they always have an anonymous complaint. [01:48:36.800 --> 01:48:40.800] It's how they justify the crap they pull [01:48:40.800 --> 01:48:44.800] when they actually don't have any justification for the crap they pull. [01:48:44.800 --> 01:48:48.800] Right, and I heard you [01:48:48.800 --> 01:48:52.800] from Austin, Texas, is that right? I'm not from Austin, but I'm in Austin. [01:48:52.800 --> 01:48:56.800] Okay, in Austin. I didn't know if [01:48:56.800 --> 01:49:00.800] there was somebody around that area, because this county [01:49:00.800 --> 01:49:04.800] I don't know how to explain it. Well, if by somebody you [01:49:04.800 --> 01:49:08.800] mean an attorney. It's corrupted all the way to the top. [01:49:08.800 --> 01:49:12.800] If I went and filed a complaint, they would arrest me for something, I'm sure. [01:49:12.800 --> 01:49:16.800] Since the day I got arrested, I've got them on my video [01:49:16.800 --> 01:49:20.800] of my home surveillance up at my house like five different times harassing [01:49:20.800 --> 01:49:24.800] me, you know what I mean? Right. Well, what you need to do first is contact the [01:49:24.800 --> 01:49:28.800] DOJ in Washington. Go to the Department of Justice [01:49:28.800 --> 01:49:32.800] website and file a complaint there, and they will [01:49:32.800 --> 01:49:36.800] get in touch with you. And you can tell them all of the [01:49:36.800 --> 01:49:40.800] stuff that you've told me. And [01:49:40.800 --> 01:49:44.800] fortunately, they tend to do something about it [01:49:44.800 --> 01:49:48.800] to some degree in some places. I can't guarantee whether they will or they won't. [01:49:48.800 --> 01:49:52.800] But on the criminal side, they would go after them if [01:49:52.800 --> 01:49:56.800] they can. Now, they may not go after them for the most serious stuff that [01:49:56.800 --> 01:50:00.800] they would have, but they've definitely got serious charges that can be [01:50:00.800 --> 01:50:04.800] levied against them, the cops that is. So, start with [01:50:04.800 --> 01:50:08.800] the Department of Justice and file a criminal complaint there, contact the [01:50:08.800 --> 01:50:12.800] FBI, and contact the United States Attorney in your [01:50:12.800 --> 01:50:16.800] area. And tell them you wish to file criminal [01:50:16.800 --> 01:50:20.800] complaints directly with them in relation to what happened. [01:50:20.800 --> 01:50:24.800] And also that you have video evidence that has been erased, but [01:50:24.800 --> 01:50:28.800] you intend to have it recovered. The reason you need to unplug... [01:50:28.800 --> 01:50:32.800] I still have some of it. I had most of it. I mean, I got them cut into [01:50:32.800 --> 01:50:36.800] wires. Okay. Well, you need as much of it showing they were [01:50:36.800 --> 01:50:40.800] actually searching your property as possible. You especially need any of it [01:50:40.800 --> 01:50:44.800] that was showing that if any of your cameras were still working [01:50:44.800 --> 01:50:48.800] when they came at you with their weapons pointed at you. [01:50:48.800 --> 01:50:52.800] Because that was excessive force. That was abuse of official capacity. [01:50:52.800 --> 01:50:56.800] That was official oppression. That was official misconduct. That was [01:50:56.800 --> 01:51:00.800] aggravated assault. That was aggravated kidnapping. [01:51:00.800 --> 01:51:04.800] And then they towed my truck out of my driveway [01:51:04.800 --> 01:51:08.800] 40 miles down the road. And that's armed robbery. [01:51:08.800 --> 01:51:12.800] And okay, like that truck, it didn't have [01:51:12.800 --> 01:51:16.800] no registration at the time. And I still don't have a driver's license, though. [01:51:16.800 --> 01:51:20.800] I refuse to get one because I'm a traveler, you know. [01:51:20.800 --> 01:51:24.800] Right. But a friend [01:51:24.800 --> 01:51:28.800] of mine borrowed my truck and she got pulled over and they give her [01:51:28.800 --> 01:51:32.800] no insurance, no registration, and all this stuff. Well, [01:51:32.800 --> 01:51:36.800] I went and got the, I let her go get the register. [01:51:36.800 --> 01:51:40.800] She said she'd pay for it and she went and got the truck registered so she could get out of her [01:51:40.800 --> 01:51:44.800] all her tickets because she, is that going to affect me? [01:51:44.800 --> 01:51:48.800] In my case? Well, [01:51:48.800 --> 01:51:52.800] as far as what they did, no. Okay. [01:51:52.800 --> 01:51:56.800] But now, was, how soon [01:51:56.800 --> 01:52:00.800] after this event occurred was it registered? [01:52:00.800 --> 01:52:04.800] Probably through, probably close to three weeks. [01:52:04.800 --> 01:52:08.800] Okay. Did they send you, when did they [01:52:08.800 --> 01:52:12.800] tell you you had to appear in court? Well, see, I haven't [01:52:12.800 --> 01:52:16.800] because I pled not guilty. [01:52:16.800 --> 01:52:20.800] They're supposed to be contacting me whenever I go to court because [01:52:20.800 --> 01:52:24.800] I pled not guilty on all four counts. The payoffs under $50, then no insurance, no [01:52:24.800 --> 01:52:28.800] driver's license, and no registration. Okay, but you haven't been [01:52:28.800 --> 01:52:32.800] to court on it yet. No, I haven't, but my friend, she [01:52:32.800 --> 01:52:36.800] when she borrowed my truck, the state was going to give her like $500. No, no, no, I got all that. [01:52:36.800 --> 01:52:40.800] I'm just saying that you haven't been to court for all of the things they [01:52:40.800 --> 01:52:44.800] charged you with, and in the meantime, it has been registered [01:52:44.800 --> 01:52:48.800] and everything else, right? [01:52:48.800 --> 01:52:52.800] Well, it's been, yes, it's been registered and registered. Okay, so at least as far [01:52:52.800 --> 01:52:56.800] as the registration and stuff like that goes, and you couldn't have got the [01:52:56.800 --> 01:53:00.800] registration without some form of insurance, so somewhere there will be an [01:53:00.800 --> 01:53:04.800] insurance card, so that's two of the charges that you could get [01:53:04.800 --> 01:53:08.800] wiped out if they've made those charges. The no driver's license is something you [01:53:08.800 --> 01:53:12.800] still have to fight if they charged you with that, but everything else [01:53:12.800 --> 01:53:16.800] inspection, registration, and insurance should be covered by what your friend went and did [01:53:16.800 --> 01:53:20.800] with the truck. Okay, but I'm under the impression, I mean, if [01:53:20.800 --> 01:53:24.800] I'm just, if I'm not driving for commerce, I'm not... Well, again, you have to decide [01:53:24.800 --> 01:53:28.800] because you're not going to be able to mix the defenses. If you go in and [01:53:28.800 --> 01:53:32.800] provide all of this to get these [01:53:32.800 --> 01:53:36.800] other charges dropped, then you're stuck with a merits defense on the license. [01:53:40.800 --> 01:53:44.800] Now, believe it or not, you can win a merits defense on the license [01:53:44.800 --> 01:53:48.800] if you argue it properly, because it is actually the way [01:53:48.800 --> 01:53:52.800] the statute is written, it is impossible for [01:53:52.800 --> 01:53:56.800] anyone permanently domiciled in Texas to [01:53:56.800 --> 01:54:00.800] comply with 521.025, [01:54:00.800 --> 01:54:04.800] which is what they're charging you under. [01:54:04.800 --> 01:54:08.800] Okay? It is statutorily impossible [01:54:08.800 --> 01:54:12.800] for anybody permanently domiciled in Texas [01:54:12.800 --> 01:54:16.800] to comply with the statute, and the reason for that [01:54:16.800 --> 01:54:20.800] is how driver's license is defined in the statute [01:54:20.800 --> 01:54:24.800] under 521.021, or I'm [01:54:24.800 --> 01:54:28.800] sorry, where it says that license has to be issued under 021. [01:54:28.800 --> 01:54:32.800] In the definition of driver's license, it only defines three things as a driver's [01:54:32.800 --> 01:54:36.800] license. An occupational license, a temporary [01:54:36.800 --> 01:54:40.800] license, and a learner's permit. All of those [01:54:40.800 --> 01:54:44.800] are replacements for some other kind of license [01:54:44.800 --> 01:54:48.800] that is neither defined nor discussed [01:54:48.800 --> 01:54:52.800] in the statutes as they exist. [01:54:52.800 --> 01:54:56.800] So there is actually a way to win [01:54:56.800 --> 01:55:00.800] a merits argument if you know the argument regarding [01:55:00.800 --> 01:55:04.800] driver's licenses. Because [01:55:04.800 --> 01:55:08.800] originally in Texas there were three. Operators, commercial operators, [01:55:08.800 --> 01:55:12.800] and chauffeurs. None of those are currently written [01:55:12.800 --> 01:55:16.800] into the statutes as they exist. Those terms and license [01:55:16.800 --> 01:55:20.800] types do not exist anywhere in the transportation code [01:55:20.800 --> 01:55:24.800] anymore. And every [01:55:24.800 --> 01:55:28.800] license according to 521.021 [01:55:28.800 --> 01:55:32.800] must be issued under chapter 521. [01:55:32.800 --> 01:55:36.800] That includes the commercial driver's license, which again [01:55:36.800 --> 01:55:40.800] has to be one of the things that is defined under driver's license, which [01:55:40.800 --> 01:55:44.800] again only applies to people that are not permanently domiciled [01:55:44.800 --> 01:55:48.800] in Texas or that have been convicted of a DUI and [01:55:48.800 --> 01:55:52.800] lost whatever other kind of license they allegedly are supposed [01:55:52.800 --> 01:55:56.800] to have that the statute doesn't discuss or define. [01:55:56.800 --> 01:56:00.800] See, it's a very convoluted thing and it's going to be very [01:56:00.800 --> 01:56:04.800] hard for them to prove that they can win because the statute doesn't [01:56:04.800 --> 01:56:08.800] let them win. [01:56:08.800 --> 01:56:12.800] So it would be better for me not to present the insurance [01:56:12.800 --> 01:56:16.800] in the registration. If you're going to argue not in transportation [01:56:16.800 --> 01:56:20.800] yes, but if you're simply going to argue against the charges you can [01:56:20.800 --> 01:56:24.800] get those three dropped and then go on a merits charge [01:56:24.800 --> 01:56:28.800] defense against the charge of no driver's license. [01:56:28.800 --> 01:56:32.800] So I would like to just argue that no transportation, I mean I was just [01:56:32.800 --> 01:56:36.800] traveling. Yeah, well the thing is if you're going to do that you're going to face [01:56:36.800 --> 01:56:40.800] all four charges. If they've made all four charges. [01:56:40.800 --> 01:56:44.800] Yeah, I mean [01:56:44.800 --> 01:56:48.800] I'd just be a few dollars if I don't, but if I do [01:56:48.800 --> 01:56:52.800] I think I can open a few people's eyes is what I'm hoping. [01:56:52.800 --> 01:56:56.800] If you are prepared to have that fight, as I was discussing with [01:56:56.800 --> 01:57:00.800] one of my earlier callers, if you don't know exactly [01:57:00.800 --> 01:57:04.800] how to make that argument however, you're not even going to make a record [01:57:04.800 --> 01:57:08.800] that will allow you to win it on appeal. And that is what you're going to have [01:57:08.800 --> 01:57:12.800] to do because you will not win it at trial. If you win one of these at trial [01:57:12.800 --> 01:57:16.800] it will be by sheer dumb luck because [01:57:16.800 --> 01:57:20.800] you will never get to produce the evidence at trial and they will never acknowledge [01:57:20.800 --> 01:57:24.800] the evidence at trial that you were not engaged in transportation. [01:57:24.800 --> 01:57:28.800] That's an argument that has to be made [01:57:28.800 --> 01:57:32.800] and put in the record for the appellate court to address. [01:57:32.800 --> 01:57:36.800] What would I have to do to get the dash cam? Because I mean on the dash cam [01:57:36.800 --> 01:57:40.800] you're going to have to file, cover yourself in two ways, file a public [01:57:40.800 --> 01:57:44.800] information request under 525 [01:57:44.800 --> 01:57:48.800] or 540, well it's in the government [01:57:48.800 --> 01:57:52.800] code, the open records act, and then also file [01:57:52.800 --> 01:57:56.800] what's known as a Brady motion for discovery, which is give me everything [01:57:56.800 --> 01:58:00.800] and the kitchen sink. [01:58:00.800 --> 01:58:04.800] Your attorney friend can probably help you out with that, just ask him to help you get a Brady [01:58:04.800 --> 01:58:08.800] motion together for all of it, okay?
