[04:45.000 --> 04:47.000] At least everybody that was there seemed to think so. [04:47.000 --> 04:51.000] We actually had a body count this time, higher than three. [04:51.000 --> 04:56.000] It's really disappointing when I look around at all the emails I'm getting screaming for help [04:56.000 --> 04:58.000] and so many of the phone numbers are local [04:58.000 --> 05:04.000] and yet these bodies never seem to make it to a class that would actually help them. [05:04.000 --> 05:12.000] But to each his own, and that suicide hotline thing is obviously working in high gear these days. [05:12.000 --> 05:15.000] But in any case, yesterday was a very good class. [05:15.000 --> 05:21.000] I had several people that, even some of the regulars, were more light bulbs clicked on [05:21.000 --> 05:26.000] and new ideas obviously were developed. [05:26.000 --> 05:33.000] Now, in case none of you know this yet, I am working on the second book for a due process [05:33.000 --> 05:40.000] in relation to not only the traffic cases but pretty much any type of misdemeanor or low grade felony, [05:40.000 --> 05:47.000] anything under a capital felony, these processes pretty much apply to, doesn't really matter. [05:47.000 --> 05:52.000] The difference here is that you have some procedural differences [05:52.000 --> 05:56.000] based upon the Class C offenses versus the rest of them, [05:56.000 --> 06:07.000] but the majority of them in other areas outside of just municipal and JP court processing are the same. [06:07.000 --> 06:12.000] Now, none of these courts, of course, act like they're the same. [06:12.000 --> 06:20.000] And in fact, they are in such a state that they are actually brought up in this new book. [06:20.000 --> 06:27.000] And some of the things I want to go over that I've written into it today while I was working on it, [06:27.000 --> 06:31.000] I want to go ahead and read some of the passages that I've put into it [06:31.000 --> 06:35.000] just so people can get a better understanding of what's actually going on. [06:35.000 --> 06:43.000] Now, folks, when you read or hear me speak about this, it will sound like I am down on the whole system. [06:43.000 --> 06:53.000] And as a system, I am. But as irreconcilable or unreparable, I'm not. [06:53.000 --> 07:01.000] There are ways to fix it. I just don't know if there's any political way to fix it. [07:01.000 --> 07:07.000] But that's something people have to decide for themselves once they figure out what's going on. [07:07.000 --> 07:13.000] And at the moment, my job is to do that, help you figure out what's actually going on. [07:13.000 --> 07:22.000] And I spend a great deal of my time analyzing, arguing over, and pointing out, and revisiting, [07:22.000 --> 07:27.000] and arguing some more, and pointing out some more, repointing here, repointing there, [07:27.000 --> 07:33.000] to try and figure out myself how a lot of this is actually working versus how it's supposed to work. [07:33.000 --> 07:41.000] It is not an easy task, believe me. And I understand that not everybody has the time in it that I have. [07:41.000 --> 07:51.000] But I fail to recognize that as a viable excuse if I'm giving you the information that I have [07:51.000 --> 07:55.000] and you're not having to do all the work I did to get it. [07:55.000 --> 08:03.000] So every single day what you know, or at least every single day that you listen to me talk about this stuff, [08:03.000 --> 08:08.000] you should know exactly what I know, at least as far as the topics discussed. [08:08.000 --> 08:15.000] And I'm hoping that I'm saying and doing it in such a way that I pique your interest to go out and verify it [08:15.000 --> 08:21.000] and see if you can find something different or better or more correct than I did. [08:21.000 --> 08:27.000] If I'm not doing that, now I'm depressed and disappointed. [08:27.000 --> 08:33.000] And I don't know yet whether it's because of myself or because of you. [08:33.000 --> 08:37.000] If you're not acting, then I'm disappointed in you. [08:37.000 --> 08:41.000] If I'm doing it wrong, then I'm disappointed in you for not telling me, [08:41.000 --> 08:46.000] and I'm disappointed in me for not recognizing it. [08:46.000 --> 08:52.000] So that being said, let me go over some of the stuff that I wrote into the book today. [08:52.000 --> 08:55.000] What has made it possible for the courts of our legal system, [08:55.000 --> 09:00.000] once at least trying to appear to be based upon truly serving justice, [09:00.000 --> 09:04.000] through the earnest seeking of facts and evidence consistent with the truth, [09:04.000 --> 09:08.000] to devolve into the logically and legally ignorant, morally and ethically bankrupt, [09:08.000 --> 09:15.000] hypocritical and judicially elitist bottomless pits of tyranny and despair of our modern times? [09:15.000 --> 09:18.000] Overall, the answer is logically simple enough. [09:18.000 --> 09:22.000] Almost any lawyer you encounter would be perfectly willing to sell out every one he knows, [09:22.000 --> 09:26.000] every client he has, and every moral and ethical idea he ever held [09:26.000 --> 09:30.000] in pursuit of power, fame, and the almighty dollar. [09:30.000 --> 09:34.000] And while this is basically true of many occupations in America these days, [09:34.000 --> 09:39.000] I find consolation in the thought that there is a collection of especially heinous pits in hell [09:39.000 --> 09:45.000] reserved for bankers, politicians, lawyers, and judges of the sort described above. [09:45.000 --> 09:49.000] Virtually all lawyers are unethical and immoral elitists, [09:49.000 --> 09:53.000] but cowardly scumbags who operate in either total fear of [09:53.000 --> 09:58.000] or in direct courtroom partnership with judges for their whole career, [09:58.000 --> 10:01.000] at least until they can become one themselves. [10:01.000 --> 10:05.000] Meanwhile, virtually all municipal and justice court judges [10:05.000 --> 10:11.000] are either little political control freak trolls with the IQ of a moldy dish sponge, [10:11.000 --> 10:16.000] having absolutely no legal skills, knowledge, understanding, experience, or training of any kind, [10:16.000 --> 10:21.000] and having only run for a judgeship because they had way too much time on their hands [10:21.000 --> 10:23.000] and no one to forcibly boss around. [10:23.000 --> 10:28.000] Or they're practicing ex-lawyers, practicing or ex-lawyers, [10:28.000 --> 10:31.000] who have become status-worshipping power-drunk tyrants [10:31.000 --> 10:34.000] with elitist versions of grandiose power and self-importance. [10:34.000 --> 10:40.000] The latter assertion becoming only more true the higher up the judicial hierarchy you progress. [10:40.000 --> 10:43.000] Couple all of that with the fact that both classes are equally ignorant [10:43.000 --> 10:47.000] of the actual written laws they pretend to know and understand, [10:47.000 --> 10:53.000] preferring instead to substitute them with their own legalistic pontifications and interpretations. [10:53.000 --> 10:59.000] Which pontificance interpretations, by the way, are almost always based solely on their own personal opinions [10:59.000 --> 11:05.000] of how things should and would operate if they were in complete control of all things law and legal. [11:05.000 --> 11:10.000] Add it all together, you now have a recipe for a judicial disaster of gargantuan proportions [11:10.000 --> 11:18.000] that will eventually manifest itself in the cesspool we have come to know today as the American system of law. [11:18.000 --> 11:23.000] Thanks to lawyers and judges, it is a daily event in every state of the union [11:23.000 --> 11:30.000] that individual Americans are accused of, quote, crimes and then forced under threats of duress [11:30.000 --> 11:38.000] and authoritarian coercion to appear before a small cabal of bureaucratic elitists [11:38.000 --> 11:43.000] and a bunch of legally ignorant total strangers who think all rights are government granted. [11:43.000 --> 11:51.000] The usually equally legally ignorant accused individuals, meaning the person, of course, has been accused, [11:51.000 --> 11:57.000] are then compelled by more threats, coercive tactics, legal half-truths, and fraudulent omissions [11:57.000 --> 12:01.000] to agree to waive virtually every one of their fundamental and due process rights [12:01.000 --> 12:08.000] and answer to accusations of administrative infractions fraudulently characterized as criminal wrongdoing. [12:08.000 --> 12:14.000] This so-called wrongdoing is allegedly perpetrated against a political fiction that doesn't actually exist, [12:14.000 --> 12:21.000] also known as a legal person, legal entity, or simply a person. [12:21.000 --> 12:25.000] And it is certainly of no little importance to understand that an accused individual [12:25.000 --> 12:31.000] cannot compel the appearance or production of this legal person for the purpose of examination, [12:31.000 --> 12:36.000] nor can they compel proof of standing by this legal person through sworn testimony, [12:36.000 --> 12:39.000] nor can they even compel production of actual evidence [12:39.000 --> 12:44.000] demonstrating that this legal person suffered any palpable harm at all [12:44.000 --> 12:49.000] for which this accused individual is liable and accountable. [12:49.000 --> 12:56.000] Furthermore, the entire accusation and claim process is initiated, directed, prosecuted, and presided over [12:56.000 --> 13:01.000] by a small tight-knit group of individuals acting entirely as third-party complainants [13:01.000 --> 13:05.000] on behalf of this legal person they all claim exists [13:05.000 --> 13:10.000] and now has legal recourse against the accused individual. [13:10.000 --> 13:16.000] This tribunal operates virtually isolated from truth and justice within its own little legal fiefdom [13:16.000 --> 13:20.000] that swallows up not only the body and livelihood, [13:20.000 --> 13:25.000] but also the fundamental and due process rights of anyone unlucky enough to be accused [13:25.000 --> 13:32.000] and caught up in the revenue enhancement vortex that reaches out for miles from the center of its corporate mall. [13:32.000 --> 13:36.000] The accused individual is eventually forced to defend themselves from one or more arbitrary [13:36.000 --> 13:42.000] and capricious accusations of breaking some even more arbitrary administrative rule or regulation [13:42.000 --> 13:48.000] which they may or may not actually be aware of, or that actually might not even exist at all, [13:48.000 --> 13:57.000] and totally regardless of which, virtually never applies in the first place to the individual being accused of violating it. [13:57.000 --> 14:03.000] Now, it doesn't seem to really bother many folks that sit on juries that all of the members of this little cabal [14:03.000 --> 14:11.000] have direct personal financial benefits involved in achieving a specific outcome at the end of this entire process, [14:11.000 --> 14:19.000] a process whereby these third-party complainants are free to allege virtually any presumptuous and unproven facts they desire, [14:19.000 --> 14:25.000] while simultaneously ignoring required procedures intended to protect the rights of the accused [14:25.000 --> 14:31.000] against the very arbitrary exercises of power that is currently underway against them. [14:31.000 --> 14:39.000] Far more often than not, these third-party complainants invent all sorts of unlawful and legally non-existent procedures within procedures [14:39.000 --> 14:45.000] and then pay it lip service by trying to pass it off as proper, fair, and impartial due process, [14:45.000 --> 14:54.000] regardless of whatever their own pre-existing procedural and regulatory rules might actually require be done. [14:54.000 --> 14:58.000] This is sometimes referred to as local rules of court. [14:58.000 --> 15:08.000] For those that have been subjected to and victimized by it, it is more aptly known as the local scheme to thwart justice and the rights of due process. [15:08.000 --> 15:18.000] As Voltaire stated, in general, the art of government consists of taking as much money as possible from one class of citizens to give to another. [15:18.000 --> 15:25.000] I have made it a personal mission in life to ensure that I am better educated and knowledgeable in the art of criminal legal due process [15:25.000 --> 15:31.000] and the rules of procedure that control it than those that I must face off against in the legal arena. [15:31.000 --> 15:39.000] I have tried to pattern that drive and ability to learn and apply based upon yet another statement of Voltaire's. [15:39.000 --> 15:49.000] I have never made but one prayer to God, a very short one, O Lord, make my enemies ridiculous, and God granted it. [15:49.000 --> 15:55.000] So ladies and gentlemen, when you go into these courts, believe me when I tell you, [15:55.000 --> 15:59.000] this book's going to show you exactly what they're supposed to do. [15:59.000 --> 16:12.000] It's going to show you exactly what they don't do and the things that they invent to do that deprive you of every right you were ever told that you had, [16:12.000 --> 16:24.000] both in the inherent protected legal sense or fundamental legal sense and in the civil legal sense as it relates to actual legal due process. [16:24.000 --> 16:32.000] It's going to violate everything, the single thing in the rule book when you actually watch them do it. [16:32.000 --> 16:37.000] This book is going to help you see that for what it is. It's going to be your roadmap. [16:37.000 --> 16:45.000] It's going to be your information, and it's going to put you in the state of mind to call a spade a spade, a liar a liar, and a thief a thief. [19:56.000 --> 19:58.000] It's an affidavit. [19:58.000 --> 20:00.000] There's a big difference. [20:00.000 --> 20:02.000] A handout is just for general information. [20:02.000 --> 20:08.000] An affidavit is something that you're trying to get him to accept for the purpose of evidence, okay? [20:08.000 --> 20:12.000] That's why your handouts are supposed to be signed and notarized if you're going to do it. [20:12.000 --> 20:23.000] However, or I'm sorry, the affidavit, you do not have to give the affidavit to them if you are video recording the encounter. [20:23.000 --> 20:35.000] The whole purpose of the affidavit originally was to take care of the fact that the officer was properly informed of the fact you were not in transportation. [20:35.000 --> 20:40.000] If you've got that on video where you're telling him that, same difference. [20:40.000 --> 20:47.000] You have the same process of getting the affidavit or the video introduced as evidence in any case. [20:47.000 --> 20:58.000] But we don't need to go through the problems of an affidavit, which the officer will most likely even refuse to accept these days [20:58.000 --> 21:03.000] because they're being trained not to take anything from you that isn't specifically what they demanded. [21:03.000 --> 21:10.000] So giving them the handouts is getting harder in most cases if they've already encountered it before. [21:10.000 --> 21:13.000] If they haven't, then you may get away with it no problem. [21:13.000 --> 21:17.000] But if they have, well, then they're going to refuse to take it. [21:17.000 --> 21:26.000] So this is the reason why I have insisted that you remember you don't leave home, especially in a car. [21:26.000 --> 21:33.000] But for any reason, you don't leave home without something that records at a minimum audio. [21:33.000 --> 21:40.000] But the best thing in the world to cover your butt from anything that might happen is going to be video. [21:40.000 --> 21:51.000] And because of that, I highly encourage you to get something that does video and audio. [21:51.000 --> 21:55.000] Now, Tommy, I hope that answers your question and you were somewhere where you could hear it. [22:29.000 --> 22:31.000] So I just walked out and said, I've got my insurance. [22:31.000 --> 22:32.000] You need to read your statutes and blah, blah, blah. [22:32.000 --> 22:33.000] And I just walked out. [22:33.000 --> 22:35.000] That was the end of it. [22:35.000 --> 22:36.000] Okay. [22:36.000 --> 22:42.000] So, you know, if I get into a collision with anyone, at least they're protected. [22:42.000 --> 22:43.000] So I believe in doing that. [22:43.000 --> 22:46.000] That's the right thing to do anyway. [22:46.000 --> 22:49.000] Well, maybe, maybe not. [22:49.000 --> 22:52.000] That all depends on whether or not you have the ability to meet it anyway. [22:52.000 --> 22:55.000] See, this is the problem with the insurance racket. [23:33.000 --> 23:38.000] Two, there's been no proof offered that you couldn't work off anything you owed. [23:38.000 --> 23:44.000] See, this, the insurance scam is also about one other thing, immediate gratification. [23:44.000 --> 23:58.000] The person that does get injured in any manner wants to be able to feel like they can be immediately but fictitiously made whole by money. [23:58.000 --> 24:11.000] What they fail to realize is, is that is going to rely entirely upon whether or not your insurance coverage decides to not pay or not. [24:11.000 --> 24:19.000] If your insurance company, which Allstate is one of those that's notorious for this, refuses to pay the claim, [24:19.000 --> 24:25.000] then you have to take the individual, not their insurance company, to court, at least here in Texas. [24:25.000 --> 24:33.000] You're not even allowed to mention the fact that person has insurance, and the only reason you're in court is because they refuse to pay. [24:33.000 --> 24:35.000] You can't even bring that up. [24:35.000 --> 24:45.000] So, it makes it look like you're trying to get blood from a turnip who can't pay it because you're not allowed to bring the issue into the jury that they have insurance. [24:45.000 --> 24:47.000] They just don't want to pay the claim. [24:47.000 --> 24:49.000] That's the only reason we're here. [24:49.000 --> 24:52.000] So, again, I'm not for compelled insurance. [24:52.000 --> 25:00.000] If I owe you because of a harm I did, then I will work to pay you back every penny I owe you if I can humanly do so. Anyway, it's outrageous for liability for no record of any type of violations. [26:32.000 --> 26:40.000] And of course, all these things going on in a country involving police is having an effect, at least on our law enforcement up here in the state of Oregon. [26:43.000 --> 26:52.000] What's going on with police themselves, what the police are doing now here in the state of Oregon, because of all of this stuff going on all across the country, [26:52.000 --> 27:01.000] scandals going on with law enforcement officers and their violent contacts and stepping over the boundaries and police abuse all over the country. [27:01.000 --> 27:08.000] What's going on here is we have a restricted response system with the police here. [27:08.000 --> 27:11.000] If you have an incident or anything goes on, you want to report it. [27:11.000 --> 27:20.000] If it isn't life-threatening and imminently dangerous or there's children harmed or somebody who's going to get hurt, they just call you back basically. [27:20.000 --> 27:30.000] They say the officer will call you and they just discuss the issue over the phone and they will not come out physically and make contact with you. [27:30.000 --> 27:33.000] I don't know if that has been going on in Texas or not. [27:33.000 --> 27:38.000] If you've seen or heard anything like that or from anybody else that has said the same thing or not. [27:38.000 --> 27:44.000] Well, around here the ways they want to make contact with you usually involve knuckles, clubs or bullets. [27:44.000 --> 27:49.000] So they still do come out no matter what. [27:49.000 --> 27:59.000] They'll still come out and make contact and whatever happens when any incidents occur that would escalate to anything like that, I guess that's still going on. [27:59.000 --> 28:06.000] But here they're playing it safe here and they're being shy about coming out and making contact with people that are making reports of things. [28:06.000 --> 28:11.000] The officer will call you from his cell phone. [28:11.000 --> 28:12.000] Well, I mean, that's good. [28:12.000 --> 28:18.000] If officers did their job, they would not come out spoiling for a fight. [28:18.000 --> 28:22.000] They wouldn't come looking for a way to make the situation worse. [28:22.000 --> 28:32.000] They wouldn't argue with someone that clearly is not capable of the mental capacity to make an argument. [28:32.000 --> 28:34.000] I mean, I've been out there. [28:34.000 --> 28:43.000] I've seen a lot of this stuff that they're doing from the firsthand perspective with the type of people they're doing it with. [28:43.000 --> 28:50.000] There is no reason to take an individual just because they're having some sort of mental breakdown [28:50.000 --> 28:58.000] and maybe holding an object that is potentially dangerous to automatically assume that they intend to use it for a dangerous purpose. [28:58.000 --> 29:08.000] The moment you become so cowardly that everything someone does is automatically considered an affront to your personal safety, [29:08.000 --> 29:14.000] you become the dangerous individual in the encounter, period. [29:14.000 --> 29:16.000] Right, right, right. [29:16.000 --> 29:22.000] I've seen countless videos, the horror stories and documented videos on YouTube for several years. [34:25.000 --> 34:34.000] Okay, now in 2005, there's a suburb town about 30 miles southeast of Portland, where I live in a little community called Sandy. He was born and raised here, but he was the son of some Persian folks or Arabic folks. [34:47.000 --> 34:56.000] And I don't know what happened. He had a mental breakdown or something. Something occurred where they had to respond to me. I don't know if he was under influence of drugs or whatever happened. [34:56.000 --> 35:03.000] But they wound up that the whole thing is on YouTube. And it was pretty horrific what happened. [35:03.000 --> 35:08.000] There was like breaks in the communication with the dispatcher and with the police. [35:08.000 --> 35:18.000] And what happened is the individual wound up dying. He was probably 18, 19 years old. It was very tragic. And his car was torched. [35:18.000 --> 35:27.000] I don't know. It didn't make any sense. And the police were taking the trial on it. It was awful. [35:27.000 --> 35:38.000] But during the Sandy Oregon police, I have to research further what actually was finalizing that what happened in that case. But it was bad. [35:38.000 --> 35:50.000] And I think that probably had a lot to do with a lot of these departments not coming out unless there's a specific reason to come out or something that's imminent that they have to respond to. [35:50.000 --> 36:01.000] So that was what I'm thinking is probably the cause of this new system that they have. Okay. Well, thanks for the info. Sure. Sure. All right. [36:38.000 --> 36:45.000] And anybody who understands rights would know that the government does not have authority to force you to pay tolls like that. [36:45.000 --> 36:54.000] And I'm sure you've heard about the thing with Santos Bonacci because people posted about it on your timeline about how he's gotten arrested for all the toll fines that he's refused to pay. [36:54.000 --> 36:59.000] And he uses the birth certificate straw man thing to get through court, which I know you said is fraudulent. [36:59.000 --> 37:07.000] But this whole thing about toll booths is let me just think, don't you think we need a toll booth script in case they send you a letter saying you got to pay this fine just so you have a red light camera letter? [37:07.000 --> 37:15.000] Well, hey, feel free to become the toll booth expert here that we don't have booze on the roads anymore. [37:15.000 --> 37:25.000] They just simply have little things you can pass through automatically and it snaps a picture of your license plate and it will send you the bill in the mail. [37:25.000 --> 37:32.000] I wish him lots of luck with that with mine. But all the same, I normally don't use the toll roads anyway. [37:32.000 --> 37:39.000] So that's the main reason why I don't talk about them. Don't see them, don't use them for the most part. [37:39.000 --> 37:47.000] The fact pattern of it is, is that a toll road is only applicable still to those that are using it for commerce. [37:47.000 --> 38:07.000] The roads belong to the people. Unless that road is 100% beginning to end, paid for with private funds, and it's built entirely on nonpublic private land, then it's not something they can charge us for. [38:07.000 --> 38:12.000] We have the right to use it. Only those engaged in commerce have to pay the tolls. [38:12.000 --> 38:19.000] We already paid to have the road built. That's what the road tax is for on the gasoline. [38:19.000 --> 38:26.000] Okay. The second thing I wanted to talk about is the issue with Facebook. I want to know if I have any legal recourse. [38:26.000 --> 38:33.000] I've actually been banned off Facebook since Friday and I miss you and seeing your words of wisdom in regards to the law because of this. [38:33.000 --> 38:43.000] But the point is, ever since Friday they said your account's been temporarily suspended and I had to photograph either my passport or my driver's license and then send it in to them for them to activate my account. [38:43.000 --> 38:48.000] It's already been the whole weekend and they still haven't activated it. They even sent me an email, some email accounts saying, [38:48.000 --> 38:53.000] just reply to this email with a picture of it, with two pictures of identification and your Facebook thing will get activated soon. [38:53.000 --> 39:02.000] But it hasn't happened. And I'm thinking this might have something to do with the fact that not that long ago when I was posting your in-forwards presentation on the police department Facebook pages [39:02.000 --> 39:07.000] and they kept banning me from Facebook and I kept making new accounts with my name and I think maybe they noticed that. [39:07.000 --> 39:13.000] And this is one reason why my account is suspended. But they commit false advertising in the end. [39:13.000 --> 39:17.000] They're the ones that commit false advertising because I wasn't violating their rules in any way. [39:17.000 --> 39:21.000] I was just making new accounts because they banned me illegally. [39:21.000 --> 39:28.000] Well, that's the whole point with this being their site, not yours. Everybody is arguing over, that's my page. [39:28.000 --> 39:35.000] No, it's not your page. It was never your page. If you ever thought it was and that was just proof positive, [39:35.000 --> 39:44.000] you did not read the agreement that you were signing on for when you made a page. [42:35.000 --> 42:41.000] And I guess the reason I'm calling is to kind of get a strategy as to how to approach it. [42:50.000 --> 42:58.000] He said, no. I said, well, I'm not engaging in commerce, so, you know, how can I help you? [47:02.920 --> 47:07.640] Yes, and that's the way it's done virtually everywhere by all police officers. [47:07.640 --> 47:12.940] If you question what they believe they can do, they're willing to use whatever force [47:12.940 --> 47:18.680] is necessary to prove that you will have to do it regardless and that's part of the problem. [47:18.680 --> 47:23.720] What none of them are willing to admit and what most people have failed to understand [47:23.720 --> 47:30.200] or realize these days is exactly how violative of your protected rights that attitude and [47:30.200 --> 47:33.720] experience really is. [47:33.720 --> 47:38.080] That's the problem with not knowing what your rights are, where they come from, and how [47:38.080 --> 47:41.000] you have the authority to exercise them. [49:24.120 --> 49:31.420] Well, I was pretty sure he didn't have the authority to stop me under the principle that [49:31.420 --> 49:36.640] I was traveling with a companion in a personal conveyance, not engaged in commerce and I [49:36.640 --> 49:40.880] made that clear within the first minute that he got to the window. [49:40.880 --> 49:46.840] I explained to him that I'm not engaged in commerce, I'm traveling, I'm operating in [49:46.840 --> 49:54.520] a private capacity and you have basically no authority to stop me but they ignore you [49:54.520 --> 49:58.720] and then intimidate you and then threaten you. [49:58.720 --> 50:02.440] So I guess... Right, and the things that I just said would [50:02.440 --> 50:04.240] show that's exactly what he's doing. [50:04.240 --> 50:09.160] He is threatening to harm you if you will not waive your protected rights so that he [50:09.160 --> 50:11.280] can have his way with you. [50:11.280 --> 50:12.280] Absolutely. [50:12.280 --> 50:15.080] Well, right now I drive around with your traffic... [50:15.080 --> 50:16.080] Whoa, whoa, whoa. [50:16.080 --> 50:17.080] I'm sorry. [51:29.880 --> 51:36.760] Judge, I need to know before we begin, does this court maintain it has jurisdiction if [51:36.760 --> 51:42.200] an officer violated the protected rights of an individual or has attempted to violate [51:42.200 --> 51:48.640] that individual's right of due process for the purpose of beginning this proceeding? [51:48.640 --> 51:50.760] And they're going to ask you, well, what do you mean by that? [51:50.760 --> 51:57.400] Well, judge, I had a man with a gun threatened to use that gun and then falsely imprisoned [51:57.400 --> 52:02.480] me based solely upon the presumption that I was gauged in an activity over which he [52:02.480 --> 52:05.460] had regulable authority. [52:05.460 --> 52:09.880] He then proceeded to threaten me with further violence if I would not waive fundamentally [52:09.880 --> 52:16.320] protected rights or he would attempt to convert the exercise of my fundamentally protected [52:16.320 --> 52:22.560] right into a criminal act in order to allow him to use excessive force against me and [52:22.560 --> 52:27.400] to falsely imprison me. [52:27.400 --> 52:29.600] Let's see how the judge takes that one. [52:29.600 --> 52:30.600] Okay. [52:30.600 --> 52:35.200] Should I submit any motion or any... [52:35.200 --> 52:41.000] Well, yeah, there's lots of things you should submit as far as challenges to jurisdiction, [52:41.000 --> 52:43.720] motions to dismiss and so on and so forth. [52:43.720 --> 52:47.960] But here's the thing you need to understand, Dean, from the get go. [52:47.960 --> 52:52.280] Number one, nothing in what you're about to go through has a damn thing in the world to [52:52.280 --> 52:55.960] do with public safety or justice. [52:55.960 --> 53:01.960] If you have any false impression to the contrary, get rid of it right now. [53:01.960 --> 53:07.640] This has one purpose only, the extraction of money from you and the transfer of that [53:07.640 --> 53:08.800] money to them. [53:08.800 --> 53:09.800] Got it? [53:09.800 --> 53:16.200] Oh, and I'm very fond of trains, just to let you know. [53:16.200 --> 53:17.200] Okay. [53:17.200 --> 53:20.640] Well, that's good because you're going to get to ride on one, possibly more than one. [53:20.640 --> 53:21.640] Railroad is. [53:21.640 --> 53:22.640] Yes, sir. [53:22.640 --> 53:30.680] So your job from the very moment this begins is to make sure that you make the most complete [53:30.680 --> 53:37.340] and accurate record possible of every rights violation perpetrated upon you by the system [53:37.340 --> 53:40.760] in which you have become entangled, period. [53:42.760 --> 53:48.320] The reason for getting that record as complete and accurate as possible is because the higher [53:48.320 --> 53:53.920] courts are going to have to understand the argument better. [53:57.760 --> 54:04.160] Their job is not to understand, it's not to provide justice, it's to get money. [54:04.160 --> 54:08.640] The better your record is on the way up for appeal and the further you take it, the more [54:08.640 --> 54:13.760] likely you are to get it overturned on the injustices perpetrated by everything that [54:13.760 --> 54:16.320] was perpetrated in the act. [54:16.320 --> 54:17.320] Okay. [54:17.320 --> 54:18.320] Okay. [54:18.320 --> 54:24.680] So you have to document those or it will be as if they never happened. [01:05:20.280 --> 01:05:24.280] I had several motions challenging subject matter jurisdiction. [01:05:24.280 --> 01:05:31.280] He denied all of them and forcibly entered a plea for me. [01:05:31.280 --> 01:05:38.280] I told him I did not consent to him entering a plea for me, and he went ahead and set a date. [01:05:38.280 --> 01:05:49.280] And the prosecutor said, made the claim that they have subject matter jurisdiction simply because I filed for discovery. [01:05:49.280 --> 01:05:53.280] They have personal jurisdiction now if you filed discovery. [01:05:53.280 --> 01:05:58.280] They don't have subject matter jurisdiction just because you filed discovery. [01:05:58.280 --> 01:06:00.280] Okay. [01:06:00.280 --> 01:06:08.280] Subject matter jurisdiction cannot be waived, and once it's challenged in a court of limited jurisdiction, [01:06:08.280 --> 01:06:16.280] which almost every one of these lower order courts are, in other words, they're only allowed to hear certain types of cases. [01:06:16.280 --> 01:06:19.280] That's a limited jurisdiction court. [01:06:19.280 --> 01:06:27.280] If that's the case, then once jurisdiction is challenged in such a court, they are required to prove it on the record. [01:06:27.280 --> 01:06:32.280] If they fail to do that, then they never had it. [01:06:32.280 --> 01:06:42.280] And as long as your record reflects that as being the case, no proof was made or offered substantiating subject matter jurisdiction by this court. [01:06:42.280 --> 01:06:55.280] The defendant never agreed to it, and the defendant never operated or acted in such a manner as to waive it or give it, as if you even could. [01:06:55.280 --> 01:06:58.280] Yeah, as far as I know. [01:06:58.280 --> 01:07:04.280] But now let me explain one thing to you about that with a caveat for the sake of the other listeners. [01:07:04.280 --> 01:07:13.280] If you used any of the deadly sins in reference to anything they were accusing you of and your activities [01:07:13.280 --> 01:07:20.280] without objecting to its usage for the purpose of whatever they're alleging, [01:07:20.280 --> 01:07:26.280] then you made subject matter jurisdiction possible. [01:07:26.280 --> 01:07:27.280] Keep that in mind. [01:07:27.280 --> 01:07:31.280] Review everything you said carefully. [01:07:31.280 --> 01:07:34.280] You're saying if I use those terms myself. [01:07:34.280 --> 01:07:41.280] If you used it in response to anything they were asserting in a positive manner, [01:07:41.280 --> 01:07:47.280] in other words, look, I wasn't driving my car at the speed you were saying. [01:07:47.280 --> 01:07:49.280] You're done. You're over. [01:07:49.280 --> 01:07:56.280] You have agreed to the subject matter jurisdiction requirement by asserting that you were engaged in the activity they regulate. [01:07:56.280 --> 01:07:59.280] Now they've got it. [01:07:59.280 --> 01:08:00.280] You follow? [01:08:00.280 --> 01:08:02.280] I don't believe I have made any. [01:08:02.280 --> 01:08:03.280] Okay. Well, I'm not saying you did. [01:08:03.280 --> 01:08:10.280] I'm just saying for the edification of all people listening and for yourself, just in case, keep that in mind. [01:08:10.280 --> 01:08:14.280] Okay. [01:08:14.280 --> 01:08:22.280] But the one thing that I was challenging, and we had discussed this before, [01:08:22.280 --> 01:08:35.280] he's trying to push their Missouri Supreme Court Rule 38, which has to do with traffic, of course. [01:08:35.280 --> 01:08:39.280] Well, what is Supreme Court Rule 38? [01:08:39.280 --> 01:08:48.280] That's the one concerning specific citations for those statutes, [01:08:48.280 --> 01:08:53.280] and one of them included is the one that I was allegedly charged with, which... [01:08:53.280 --> 01:09:01.280] Okay. Do me a favor and email me this so-called rule so I can see exactly what the context of it is and how it's being applied. [01:09:01.280 --> 01:09:09.280] Okay. But the thing is he's trying to push this Rule 38, and yet, like you said before, [01:09:09.280 --> 01:09:21.280] the Missouri Constitution says they cannot charge for a misdemeanor or a felony unless by indictment or information, [01:09:21.280 --> 01:09:27.280] and all he has filed as far as charging instruments is the uniform citation. [01:09:27.280 --> 01:09:31.280] Are they telling you that it's a misdemeanor? [01:09:31.280 --> 01:09:37.280] Or are they telling you and does the statute say that it's an infraction? [01:09:37.280 --> 01:09:46.280] No, it's supposedly a misdemeanor. It says it on the docket sheet and... [01:09:46.280 --> 01:09:52.280] Okay. What does the statute say it is? [01:09:52.280 --> 01:10:01.280] I don't have that right off my... I've got it here somewhere, but I don't believe it says either or. [01:10:01.280 --> 01:10:06.280] Well, you need to figure out what it does say. [01:10:06.280 --> 01:10:10.280] If it classifies traffic offenses like, for instance, California, [01:10:10.280 --> 01:10:18.280] classifies virtually every possible offense relating to a motor vehicle as an infraction, [01:10:18.280 --> 01:10:22.280] which means if a cop chases you down for the purpose of pulling you over, [01:10:22.280 --> 01:10:30.280] he has arrested you for an infraction, which is not criminal, which means he had no arrest authority. [01:10:30.280 --> 01:10:35.280] The cop just committed a crime against you. [01:10:35.280 --> 01:10:46.280] So it's very imperative that you understand the difference in what it actually is and isn't. [01:10:46.280 --> 01:10:55.280] Can I still enter a motion to recuse and to vacate his ruling setting the trial date? [01:10:55.280 --> 01:10:57.280] You can do that anytime you want to. [01:10:57.280 --> 01:11:03.280] The only thing you have to do is figure out whether or not you have proper grounds that will force them to grant it. [01:11:03.280 --> 01:11:08.280] But again, you also have to remember you're not going into the trial court to win. [01:11:08.280 --> 01:11:15.280] Winning is a virtual impossibility when the game is already prearranged and rigged against you. [01:11:15.280 --> 01:11:19.280] Yeah, the old saying, you're not prepared to win if you're not prepared to lose. [01:11:19.280 --> 01:11:20.280] Exactly. [01:11:20.280 --> 01:11:25.280] You have to get your records set up properly objecting to every single thing they do [01:11:25.280 --> 01:11:29.280] that violates a due process right or the statutes they're operating under, [01:11:29.280 --> 01:11:38.280] especially when it's used to deprive you of any of those rights so that you have an appealable error. [01:11:38.280 --> 01:11:46.280] And if you don't document it in your pleadings and it's not a court of record, it ain't going to be there to be looked at on appeal. [01:11:46.280 --> 01:11:48.280] Well, it is a court of record. [01:11:48.280 --> 01:11:52.280] Then you've got to make sure that it's not removed from that record too. [01:11:52.280 --> 01:12:00.280] And the best way to do that is to make sure that it's put there twice, once by the court reporter and once by your pleadings. [01:12:00.280 --> 01:12:05.280] By my pleadings, okay. I will try to remember that one. [01:12:05.280 --> 01:12:13.280] Because remember, you do not go into court and leave anything you do at oral argument or assertions only. [01:12:13.280 --> 01:12:19.280] Any verbal or oral presentation gets reduced to writing in the form of a pleading or an affidavit, [01:12:19.280 --> 01:12:25.280] and it gets filed in the record so that it is there. [01:12:25.280 --> 01:12:38.280] Okay. The statute does say that any person convicted of violating subdivision one or two of subsection one, [01:12:38.280 --> 01:12:44.280] which is what I've been allegedly charged with, is guilty of a misdemeanor. [01:12:44.280 --> 01:12:50.280] Okay. Then you have constitutional grounds to challenge anything this judge does. [01:12:50.280 --> 01:12:58.280] Because without now, does your Constitution there also state that only an indictment or information [01:12:58.280 --> 01:13:02.280] invests the court with jurisdiction of the cause in such cases? [01:13:02.280 --> 01:13:05.280] It does here in Texas under Article 5, Section 12B. [01:13:05.280 --> 01:13:10.280] So find it in the Missouri Constitution and get extra support for your argument. [01:13:10.280 --> 01:13:13.280] Okay. I will look for that. [01:13:13.280 --> 01:13:23.280] Now the Constitution says only by indictment or information, [01:13:23.280 --> 01:13:30.280] and then underneath the Supreme Court rules for criminal procedure, [01:13:30.280 --> 01:13:39.280] it says that an information must have a probable cause statement attached to it. [01:13:39.280 --> 01:13:44.280] Okay. But you said they've created a rule that tries to create an exception to that [01:13:44.280 --> 01:13:51.280] under the Supreme Court rules for this case that you're being charged with, correct? [01:13:51.280 --> 01:13:58.280] Yes. It's for any alleged violation of 302.020, [01:13:58.280 --> 01:14:06.280] which is operate any vehicle upon any highway in this state unless the person has a valid license. [01:14:06.280 --> 01:14:10.280] Well, if there hasn't been a constitutional amendment allowing for that exception, [01:14:10.280 --> 01:14:19.280] the courts cannot create one because that's legislation they're not allowed to do under separation of powers. [01:14:19.280 --> 01:14:25.280] They're creating a law that doesn't exist. [01:14:25.280 --> 01:14:32.280] The court can only interpret law. It can't write it and it can't rewrite it. [01:14:32.280 --> 01:14:34.280] No. [01:14:34.280 --> 01:14:38.280] But you do have one little problem there in Missouri. [01:14:38.280 --> 01:14:46.280] Your legislature abdicated 90% of its legislative powers to the judiciary. [01:14:46.280 --> 01:14:50.280] Again, a violation most likely of your separation of powers clause, [01:14:50.280 --> 01:14:58.280] but until you guys hang the legislators that let that happen and replace them with ones that won't, good luck. [01:14:58.280 --> 01:15:00.280] Well, that's the problem. [01:15:00.280 --> 01:15:08.280] Half of these supposed legislators are violating that separation because they're all officers of the court. [01:15:08.280 --> 01:15:10.280] Quite a few of them are. [01:15:10.280 --> 01:15:13.280] Exactly my point. Welcome to reality. [01:15:13.280 --> 01:15:21.280] So we have lawyers who are legislating and it happens to... [01:15:21.280 --> 01:15:24.280] Every state does. Every state has a separation of powers [01:15:24.280 --> 01:15:32.280] and every state has lawyers and judges violating it hand over fist. [01:25:33.280 --> 01:25:43.280] Well, in California you have to do it using the federal statute because Civil Rico at the state level can only be pursued by the attorney general. [01:25:43.280 --> 01:25:44.280] Okay. [01:25:44.280 --> 01:25:54.280] All right, and in that case, I can tell you that you are stepping off into an area of law at the Fed that you have to watch. [01:25:54.280 --> 01:26:00.280] You're basically walking through a minefield with tripwires and overhead cover fire. [01:26:00.280 --> 01:26:07.280] I figured that, but I think that if you know it, I think it's really radioactive to have this knowledge. [01:26:07.280 --> 01:26:16.280] It is. The other side, the worst fear that any governmental entity is ever going to have is a Rico suit, especially one at the Fed. [01:26:16.280 --> 01:26:24.280] But the biggest problem is putting it in the way that the Fed wants it to such a degree that they can't arbitrarily dismiss it. [01:26:24.280 --> 01:26:35.280] That's where your biggest problem is going to come from, making sure every jot and tittle that the federal requirements have you meet so that they can't just wipe it out. [01:26:35.280 --> 01:26:43.280] What about my making myself an attorney general? [01:26:43.280 --> 01:26:47.280] You can petition to be a private attorney general for the purpose of prosecuting it, absolutely. [01:26:47.280 --> 01:26:49.280] Yes, so do you think that would be a better route? [01:26:49.280 --> 01:26:50.280] I don't know if it would be better. [01:26:50.280 --> 01:26:53.280] It's not going to change what you have to do to file it. [01:26:53.280 --> 01:26:56.280] You still have to file it exactly the same way regardless. [01:27:08.280 --> 01:27:21.280] I know it's possible under certain conditions and circumstances, but you have to be able to prove that he stepped completely outside of his jurisdictional authority to do it. [01:27:21.280 --> 01:27:34.280] If there is any way at all he can pull the blanket of immunity over himself by showing that he acted entirely within a proper judicial capacity, it doesn't even matter if it was intentionally malicious. [01:27:34.280 --> 01:27:35.280] You can't touch him. [01:27:35.280 --> 01:27:36.280] Okay, all right. [01:27:36.280 --> 01:27:39.280] So that's kind of something very difficult to do as well. [01:27:44.280 --> 01:27:56.280] But if you can show he acted in any way, shape, or form without jurisdiction to cover his butt or he's a type of judge that has no claim to immunity, then that's a whole different ballgame. [01:28:02.280 --> 01:28:13.280] We have a county judge here in Texas, a county court at law judge that used an attorney general's opinion from I believe 2004 written by the same AG that's our current AG, Greg Abbott. [01:28:13.280 --> 01:28:21.280] And it was regarding DPS officers having state authority to do certain things. [01:28:21.280 --> 01:28:29.280] Well, the AG wrote in his opinion that they are and that they were required to have an official oath of office under the Texas Constitution in order to serve. [01:28:29.280 --> 01:28:46.280] In his opinion, the AG said, because they can be hired and fired outside of the electoral process by the director of the Department of Public Safety, they are mere employees and not officers of the state and have no requirement for an oath of office. [01:28:46.280 --> 01:28:51.280] So let me ask a legal question from a lawyer point of view. [01:28:51.280 --> 01:29:00.280] If they have no authority as a state officer, then by what authority they're pretending to act as one? [01:29:00.280 --> 01:29:01.280] They don't have it. [01:29:01.280 --> 01:29:02.280] Exactly. [01:29:02.280 --> 01:29:08.280] Therefore, they could not possibly claim sovereign immunity of the state to cover them in their actions. [01:29:08.280 --> 01:29:10.280] Oh, okay. [01:29:10.280 --> 01:29:19.280] Now, if that can be proven to apply to the law enforcement, why not municipal judges or JP or any judge that isn't elected? [01:47:58.280 --> 01:48:04.280] If the state cannot prove the license was issued, the state can't prove the applicability of the statute. [01:48:04.280 --> 01:48:11.280] I like that anecdote that you mentioned or someone mentioned that the police officer asked them to produce the license. [01:48:11.280 --> 01:48:15.280] And the guy said, well, I'm not enjoying the privilege right now. Yeah. [01:48:15.280 --> 01:48:20.280] He's not enjoying the privilege. [01:52:52.280 --> 01:53:00.280] And I would really like some mentoring on how to attack their presumptions and assumptions from a defendant's point of view. [01:53:05.280 --> 01:53:11.280] In order to have jurisdiction, which is the second thing they have to have, [01:53:11.280 --> 01:53:16.280] the first is standing to assert jurisdiction. [01:57:39.280 --> 01:57:52.280] Well, they are watched over by them, but the State Office of Administrative Hearings is the original court of jurisdiction for administrative proceedings from any state administrative agency. [01:57:58.280 --> 01:58:08.280] Well, again, that depends on what law you're saying they're not following and exactly what the repercussions or results of not following it were. If you're talking about the issue of they violated a protected right, then you may have a course to go against them.
