This is the Monday Night Rule of Law Radio Show. [04:38.000 --> 04:45.000] It is May 12, 2014, and it is another Monday night off and running. [04:45.000 --> 04:55.000] All right, now, something that I want to discuss a little bit tonight deals with the stuff that I'm trying to get integrated into the new book [04:55.000 --> 05:01.000] and into the procedures of how we go to court, as you all or should most of you are aware. [05:01.000 --> 05:11.000] I've already done a script for the transportation stop, which, unfortunately, too many people are using without being properly prepared to use, [05:11.000 --> 05:15.000] and then they're wanting to know what to do after they've used it. [05:15.000 --> 05:23.000] Folks, before you begin to use that script, you need to learn how to fight what they're going to do to you. [05:23.000 --> 05:27.000] It's not rocket science to figure that out. [05:27.000 --> 05:32.000] How do you intend to start a fight with somebody bigger and more experienced with you, [05:32.000 --> 05:38.000] and you never have bothered to learn how to fight yourself? [05:38.000 --> 05:45.000] The odds are not good. It's one thing to stand up to a bully because you have no choice in that moment. [05:45.000 --> 05:50.000] It's another thing to think ahead and prepare to take the bully on and take him down. [05:50.000 --> 05:59.000] You've got to think, folks, please, because there's not a lot I can do for you about what to say and do at a stop [05:59.000 --> 06:05.000] if you're not contacting me until after it's already happened and you're already hairline deep in trouble [06:05.000 --> 06:09.000] because you did or didn't do something the right way. [06:09.000 --> 06:16.000] Until you know everything about how to handle what comes after the stop, you're taking a great risk, [06:16.000 --> 06:20.000] and then you're asking me to bail you out when you've only got a few days to deal with it [06:20.000 --> 06:25.000] because you're taking so long to either let me know it happened or you're not preparing, [06:25.000 --> 06:34.000] and I have no clue what you did wrong or right at the time, which makes my telling you anything almost impossible [06:34.000 --> 06:43.000] because I tell you to do A, B, and C. Unfortunately, A, B, C, and works only if you haven't done X, Y, Z. [06:43.000 --> 06:46.000] And I don't know whether you've done it or not. You see the problem? [06:46.000 --> 06:50.000] So if you're going to use the script, try to be prepared before you start that fight. [06:50.000 --> 06:57.000] The other one is the cross-examination script about how to deal with examination of state's witness [06:57.000 --> 07:01.000] after state has performed its direct examination. [07:01.000 --> 07:07.000] And what I'm working on now is two scripts. At the moment, they're combined. [07:07.000 --> 07:18.000] But the two scripts that I'm working on at the moment are jury voir dire and pretrial issues with the judge. [07:18.000 --> 07:25.000] Basically, I'm trying to formulate a script of questions that will allow us to get specific facts into the record, [07:25.000 --> 07:35.000] and if it's a court of no record, into the ears of court watchers that can then verify the facts of what they saw [07:35.000 --> 07:41.000] and heard and the questions that were asked and either answered a particular way or refused to be answered [07:41.000 --> 07:45.000] into affidavits that you can then file in your case. [07:45.000 --> 07:54.000] Because here's the problem with the way the courts are being conducted in these class C fine-only situations. [07:54.000 --> 08:01.000] And it doesn't matter what particular republic of the union you're in, they all handle it the same way. [08:01.000 --> 08:05.000] Deprivation of rights under color of law. There are no ifs, ands, or buts. [08:05.000 --> 08:11.000] There are no good lower courts that if they're prosecuting these cases, [08:11.000 --> 08:17.000] instead of attempting to determine whether or not you were ever engaged in an activity [08:17.000 --> 08:23.000] that would give them standing to prosecute you, this is not a good court. I don't care who's in it. [08:23.000 --> 08:26.000] It's the same argument as there's no such thing as a good cop, [08:26.000 --> 08:33.000] because a good cop would be trying to arrest the bad cops when he sees them doing something wrong, [08:33.000 --> 08:41.000] just like he would arrest an actual other type of criminal that isn't wearing a shiny badge and clothes like he's got on. [08:41.000 --> 08:50.000] Okay? So these courts have already rigged this system, and from the very moment the traffic stop begins, [08:50.000 --> 08:56.000] the system kicks into high gear to deprive you of every single protected right you have. [08:56.000 --> 09:04.000] In fact, I got an email today from someone in Idaho or Iowa or somewhere like that. [09:04.000 --> 09:07.000] I can't remember right off the top of my head. I've gotten 10 phone calls since then. [09:07.000 --> 09:16.000] But he was telling me how he got pulled over, and the cop came up and asked for the information, as they always do, [09:16.000 --> 09:21.000] and he simply said, upon advice of counsel, I can't provide you with anything else. [09:21.000 --> 09:27.000] And I'm like, well, that is not the way the script tells you to make that known to the officer, [09:27.000 --> 09:34.000] so I have no clue if this person was following the script or just winging it. I have no idea. [09:34.000 --> 09:43.000] Therefore, I have no clue as to what that person did at any other point during the stop, nor why the stop even began. [09:43.000 --> 09:47.000] So I don't really have a jumping-off point in which to recommend anything [09:47.000 --> 09:52.000] other than get the audio and video from everybody that was present. [09:52.000 --> 09:56.000] And if you made any, get that, too, and get it all together. [09:56.000 --> 10:01.000] And if you didn't make one, shame on you. Go look in the mirror and punch yourself twice, [10:01.000 --> 10:09.000] because I've told you and told you and told you, folks, you never walk out your front door or answer it, for that matter, [10:09.000 --> 10:17.000] without a recording device in your immediate possession, ever. [10:17.000 --> 10:24.000] You are literally risking your life and welfare if you do. [10:24.000 --> 10:31.000] And if you don't believe that, go on YouTube and just look around at various types of recordings that have been made, [10:31.000 --> 10:38.000] police brutality, break-ins, assaults, some by civilians, some by cops, and so on and so forth. [10:38.000 --> 10:42.000] And you'll see exactly what I'm talking about. [10:42.000 --> 10:47.000] So that choice is yours, but please don't come running to me to say, help me, help me, [10:47.000 --> 10:55.000] when I have absolutely nothing to go on as far as what kind of help you're even needing [10:55.000 --> 11:01.000] and what happened that we can use, because I don't know if I wasn't there. [11:01.000 --> 11:05.000] So I either need a full accounting from you as to what happened, and it needs to be accurate, [11:05.000 --> 11:12.000] it needs to be accurate, it needs to be truthful, or I need to see and hear the audio and video that will tell me. [11:12.000 --> 11:18.000] But even on top of that, you have to remember, I am in Texas. [11:18.000 --> 11:23.000] This is where my research into the laws has been the strongest. [11:23.000 --> 11:27.000] It's where my information and knowledge is the strongest. [11:27.000 --> 11:34.000] It is going to be your responsibility to find what you need to find in the laws where you live. [11:34.000 --> 11:37.000] So keep all of that in mind. [11:37.000 --> 11:46.000] But anyway, back to this script of pretrial issues and due process violations and the jury voir dire. [11:46.000 --> 11:49.000] I want to go over a couple of things in this script. [11:49.000 --> 11:51.000] I'm not going to go over the whole thing. [11:51.000 --> 11:57.000] But I just want to show you some of the things that will point out, beginning with these questions, [11:57.000 --> 12:04.000] as to just how many of your rights these courts know they are violating. [12:04.000 --> 12:08.000] There is no question that they know they're violating them, [12:08.000 --> 12:14.000] because the moment you get into the issue with the court about why am I being deprived of this right, [12:14.000 --> 12:22.000] that's when the court ceases to answer any questions and then starts to move forward by bully and force. [12:22.000 --> 12:25.000] They know. [12:25.000 --> 12:33.000] And if they don't know, that's proof positive they should have never been put in this position in the first place. [12:33.000 --> 12:41.000] Because how do you sit in judgment as to violations of law when you have no clue, [12:41.000 --> 12:45.000] one, anything about the law they're being charged with, [12:45.000 --> 12:52.000] and two, the laws and statutes and rules and procedures that govern how you are required [12:52.000 --> 12:59.000] to carry on and conduct those proceedings to ensure that they are fair and impartial [12:59.000 --> 13:04.000] and that the rights of all parties are properly and fully protected? [13:04.000 --> 13:14.000] How do you get into that position when you cannot demonstrate that you are competent to provide that in that manner? [13:14.000 --> 13:17.000] Well, because I know somebody. [13:17.000 --> 13:19.000] Yeah, exactly. [13:19.000 --> 13:24.000] You know somebody, but you don't know a damn thing about what you're doing. [13:24.000 --> 13:27.000] That is a problem. [13:27.000 --> 13:39.000] But folks, you're just as bad as they are when you go into this situation unprepared and expect to prevail. [13:39.000 --> 13:48.000] Even worse, you're somewhat delusional if you expect to prevail on paperwork alone. [13:48.000 --> 13:53.000] Because this is about money, and it ain't a little bit. [13:53.000 --> 13:55.000] It's a lot. [13:55.000 --> 14:05.000] In case you haven't noticed, every small town in America that is starving for cash uses their police department [14:05.000 --> 14:10.000] to increase that revenue flow. [14:10.000 --> 14:13.000] They can't raise the property taxes if it requires a vote of the people. [14:13.000 --> 14:20.000] They can't go around and increase zoning ordinances and things to allow new business to come in if the people don't approve [14:20.000 --> 14:22.000] and so on and so forth. [14:22.000 --> 14:31.000] But they can surely tell their police department, you start making sure to get as much money out of these people as you can. [14:31.000 --> 14:37.000] And they don't need a vote by the people to make that happen. [14:37.000 --> 14:46.000] There is no such thing anywhere where the police and the people they work for are allowed to collect money in fines and fees [14:46.000 --> 14:52.000] that that system is not being abused if it is being enforced. [14:52.000 --> 14:54.000] Period. [14:54.000 --> 15:00.000] They're simply too much money at stake. [15:00.000 --> 15:02.000] Now, you want to prove that to yourself? [15:02.000 --> 15:09.000] Go to whatever city you live in, to the city secretary or whoever the city financial officer is, [15:09.000 --> 15:13.000] the treasurer, the comptroller, whatever their title is in your city. [15:13.000 --> 15:23.000] You go to them and you file a public information request that asks for a summarization of information [15:23.000 --> 15:34.000] and records for a financial accounting relating to all traffic citations issued by the police department [15:34.000 --> 15:47.000] and a dissemination report of all revenues garnered by those citations broken down by where they are distributed to. [15:47.000 --> 15:54.000] And you will see exactly where all the money they're taking in goes. [15:54.000 --> 15:58.000] And you will also get to see how much it is. [15:58.000 --> 16:08.000] And here in Austin, it's tens of millions of dollars a year that Austin gets to keep. [16:08.000 --> 16:21.000] 32.6 million in 2010. I haven't got reports for 11, 12 or 13 or 14, but the one I got from 2010 shows they collected 64 million plus. [16:21.000 --> 16:27.000] Half of that went to the state, as all transportation citations do. [16:27.000 --> 16:35.000] The other half is kept by whatever legal public corporation wrote the citation, whether it be county or city. [16:35.000 --> 16:39.000] And then it's distributed for whatever they want to do with it, [16:39.000 --> 16:45.000] even though the statute specifically says they can only allocate those funds to very specific things. [16:45.000 --> 16:51.000] But get that report and you'll find out that it's probably going to places it was never authorized by law to go. [16:51.000 --> 16:54.000] All right, folks, I'm going to go into this script a little bit more on the other side. [16:54.000 --> 17:00.000] Callers on the board, y'all hang on. [20:21.000 --> 20:25.000] So I don't use one to drive. And with the information I got, I was- [20:25.000 --> 20:27.000] Okay, wait a minute. Do you drive? [20:27.000 --> 20:30.000] I do. No, I'm a traveler. [20:30.000 --> 20:34.000] Okay. You need to start checking your terminology. [20:34.000 --> 20:35.000] Okay. [20:42.000 --> 20:52.000] But I ended up getting actually accosted and was put in jail for two days without seeing a judge on a suspended license. [20:52.000 --> 20:53.000] Okay. [20:53.000 --> 21:01.000] And I got out with the courts, had been on with some information, some good knowledge about the law, and the judge threw me out the first 30 days. [21:01.000 --> 21:07.000] Came back the next time, the same thing. We got to a gridlock, and he threw me out again for another recess for 30 days. [21:07.000 --> 21:16.000] I came back the last month and put an affidavit in, and he and I had a conversation about the law and jurisdiction, et cetera. [21:16.000 --> 21:19.000] And it got kind of quiet in the court room. [21:19.000 --> 21:26.000] And he told me he's going to grant me the permission to file a dismissal. [21:26.000 --> 21:33.000] And I was kind of hesitant to do that because I don't think he actually has the permission to grant me the privilege to file a- [21:33.000 --> 21:36.000] Well, no one grants you permission to file a dismissal. [21:36.000 --> 21:38.000] Everyone has the right to file a dismissal. [21:38.000 --> 21:42.000] It's a challenge to the charge or the jurisdiction of the court. [21:42.000 --> 21:45.000] It's not something the judge can grant you leave to do. [21:45.000 --> 21:48.000] You have every right to do it. [21:48.000 --> 21:49.000] Got it. [21:49.000 --> 21:55.000] So he wants to have a private setting where he and I, and I guess the district attorney, to talk about it behind closed doors. [21:55.000 --> 21:58.000] Is there any danger in that for me? [21:58.000 --> 21:59.000] Absolutely. [21:59.000 --> 22:00.000] What should I look out for? [22:00.000 --> 22:01.000] Absolutely. [22:01.000 --> 22:03.000] Terminology being first and foremost. [22:03.000 --> 22:05.000] You start having the same conversation with him. [22:05.000 --> 22:10.000] You started off with me tonight, and you may as well write your check out now. [22:10.000 --> 22:15.000] Wow. [22:15.000 --> 22:17.000] So what do you suggest? [22:17.000 --> 22:25.000] I suggest, well, again, what do you think your capabilities are as far as catching what they're doing when they do it? [22:25.000 --> 22:33.000] Because I guarantee you they are master craftsmen of language in that room, more so than you're going to be because they make a living at it. [22:33.000 --> 22:36.000] Both of them do. [22:36.000 --> 22:40.000] So how outmatched do you feel? [22:40.000 --> 22:43.000] Actually, this conversation on the radio is actually not how I went into court. [22:43.000 --> 22:49.000] I was just kind of calling in the day based on a friend's recommendation to listen, so I kind of got caught off guard. [22:49.000 --> 22:54.000] The conversation that we had the first few times was good enough for him to basically put me out of court. [22:54.000 --> 22:57.000] Well, I don't know what you mean by put you out of court. [22:57.000 --> 23:01.000] Meaning let's take a recess or you come back in 30 days. [23:01.000 --> 23:02.000] I can't handle you. [23:02.000 --> 23:06.000] We're talking about jurisdiction, and people in the courtroom are listening to you talking about this. [23:06.000 --> 23:07.000] Okay. [23:07.000 --> 23:10.000] So the very first thing, then here is what you need to make sure you do. [23:10.000 --> 23:17.000] If you have this conference with them, you discuss no topics that deal with the merits of the accusations. [23:17.000 --> 23:21.000] You deal strictly with the jurisdiction of the court. [23:21.000 --> 23:28.000] Now, considering I have no clue how you have gone about attempting to challenge the jurisdiction and on what grounds, [23:28.000 --> 23:34.000] I'm kind of advising blindly here as to what you do in regards to that specifically. [23:34.000 --> 23:45.000] I don't know because I don't know what you're asserting as your ground for the challenge or how you're asserting lack of jurisdiction. [23:45.000 --> 23:53.000] So that's going to be a conversation we're going to need to have by email or something so I can get some more details than I've got. [23:53.000 --> 23:54.000] Okay. [24:21.000 --> 24:22.000] They're trying to- [24:22.000 --> 24:24.000] Whoa, whoa, whoa, whoa, whoa, whoa, whoa. [24:24.000 --> 24:25.000] Now, see? [24:25.000 --> 24:27.000] You didn't understand my question. [24:27.000 --> 24:31.000] That right there is what they're going to do to you in that conference. [24:31.000 --> 24:35.000] See, you immediately jumped in, it's criminal. [24:35.000 --> 24:42.000] The correct response is, well, they appear to be treating it as criminal. [24:42.000 --> 24:49.000] But if I had read the statutes, I would understand that it is in actuality administrative. [24:49.000 --> 24:50.000] Right. [24:50.000 --> 24:55.000] Because nine times out of ten, the state statutes are written so that they are administrative, [24:55.000 --> 24:58.000] like for instance here in Texas. [24:58.000 --> 25:03.000] If you read the statute, it gives a definition for the term department. [25:03.000 --> 25:10.000] And in the Texas Transportation Code, every single chapter contains a reference to the department. [25:10.000 --> 25:19.000] And everything it discusses after that is the powers of those that work for that department to do the things that are in that statute. [25:19.000 --> 25:26.000] When you look up the department for the definition of it, let's take for instance the enforcement statutes [25:26.000 --> 25:34.000] and chapters of the Transportation Code here, the department means the Department of Public Safety of the state of Texas. [25:34.000 --> 25:39.000] Well, when you then go to the state administrative code, right there in the administrative code, [25:39.000 --> 25:43.000] you are told very quickly the Department of Public Safety is a state administrative agency. [25:43.000 --> 25:47.000] They are not law enforcement, period. [25:47.000 --> 25:52.000] Therefore, even though they are treating the traffic citations as criminal, [25:52.000 --> 25:59.000] the only people that have power to issue them are those that are working under an administrative agency [25:59.000 --> 26:02.000] known as the Department of Public Safety of the state of Texas. [26:02.000 --> 26:07.000] Thus, their power is administrative. [26:07.000 --> 26:14.000] So you see, those are the types of things you need to know better when you have these conversations. [26:14.000 --> 26:23.000] Because the moment you presume something, that something is going to come back and bite you right in the behind with steel teeth. [26:23.000 --> 26:25.000] Don't need that. [26:25.000 --> 26:30.000] Okay, you may as well go sit on a bear trap if you are going to walk in there unprepared. [26:30.000 --> 26:32.000] I'll be prepared. [26:32.000 --> 26:34.000] Should this be recorded, this private session? [26:34.000 --> 26:37.000] Absolutely, but you need to be real careful. [26:37.000 --> 26:41.000] I don't know what the recording laws are in Illinois. [26:41.000 --> 26:45.000] Now, any state will let you record if everybody knows they're being recorded, [26:45.000 --> 26:49.000] but these guys aren't going to let you record them if they know you're doing it. [26:49.000 --> 26:53.000] Now, in Texas, recordings are one-party requirement. [26:53.000 --> 27:02.000] Only one party, but it must be a party engaged in the conversation, not somebody listening into it. [27:02.000 --> 27:06.000] Only one party to the conversation has to know it's being recorded. [27:06.000 --> 27:09.000] That's known as a one-party state. [27:09.000 --> 27:13.000] You need to know if Illinois is a one-party state. [27:13.000 --> 27:15.000] All right, we'll check into that. [27:15.000 --> 27:16.000] Okay. [28:38.000 --> 28:45.000] And we have to craft these questions very carefully to get that fact on the record and in the open as quickly as possible [28:45.000 --> 28:50.000] before that judge realizes what you're doing to him. [28:50.000 --> 28:56.000] So real quick, I'm going to start on these, but I expect to get interrupted here in about 30 seconds to have to take a break. [28:56.000 --> 28:57.000] All right. [28:57.000 --> 29:03.000] We walk into court, any time we walk into court, this is the first thing out of your mouth. [29:03.000 --> 29:10.000] I am here by special appearance to challenge the jurisdiction of this court, and I move that all proceedings be on the record. [29:10.000 --> 29:16.000] Judge, there are specific matters relating to jurisdiction, the rights of the accused, specific to due process, [29:16.000 --> 29:20.000] and the right of the accused for a fair and impartial trial that need to be addressed. Now, let me begin going through this specific things that we want to ask the judge. Judge, there are some specific matters relating to jurisdiction, the rights of the accused, specific to due process, and the right of the accused to a fair and impartial trial that need to be addressed. [34:08.000 --> 34:17.000] Now, the problem here is going to be getting this individual to admit you're not getting that. [34:17.000 --> 34:22.000] So, we're going to have to trick them with the questions that we're asking into getting them. [34:22.000 --> 34:28.000] And so, the question becomes, what questions are they? Well, here we go. [34:28.000 --> 34:37.000] First, I believe that this court now, what we're going to do is we're going to state for the record what we believe is going to happen. [34:37.000 --> 34:47.000] We're going to try to motivate the judge to want to defend his court as being a place where these things don't happen. [34:47.000 --> 34:53.000] Now, of course, the judge can also pretty much decide that he just wants to be mad about it and take it out on you or try to. [34:53.000 --> 35:05.000] But at the same time, it's very important that we let the record reflect that we do not expect to be treated fairly and impartially in this court. [35:05.000 --> 35:10.000] So, for my purposes, this is the way I would intend to do it. [35:10.000 --> 35:18.000] First, I believe that this court operates entirely for the purposes of unlawful taxation through fraud and excess municipal or county revenue generation, [35:18.000 --> 35:22.000] and not for seeking or providing justice to those that appear before it. [35:22.000 --> 35:31.000] Addressing the due process issues that I am about to bring forth is your opportunity to prove me wrong, and I pray that you will use it accordingly. [35:31.000 --> 35:36.000] Second, I do not believe that I can or will receive a fair and impartial trial in this court, [35:36.000 --> 35:44.000] as I believe that this court will do as it pleases despite the law, the rules of procedure, and the complete lack of factual evidence in this case, [35:44.000 --> 35:52.000] and that it will do so by conducting a completely biased and prejudicial proceeding in collusion with and aiding the prosecution to secure a conviction [35:52.000 --> 35:59.000] based entirely upon legal presumptions rather than factual evidence proving every element of the alleged offense. [35:59.000 --> 36:06.000] Therefore, if the court would be so kind as to help me get past these concerns by addressing some due process violations [36:06.000 --> 36:12.000] that I perceive as having had or will imminently occur, it will be greatly appreciated. [36:12.000 --> 36:17.000] This is where we get the court wanting to defend themselves at this point. [36:17.000 --> 36:19.000] All right. [36:19.000 --> 36:25.000] To start, I would ask the court to take judicial notice of Article 1.05 Code of Criminal Procedure, [36:25.000 --> 36:29.000] and it states that the accused has the right to know the nature and cause against him or her, [36:29.000 --> 36:33.000] and presumably the right to properly understand both. [36:33.000 --> 36:38.000] Is that correct? [36:38.000 --> 36:45.000] Then we say, does this court or do you personally, while acting in your official capacity as judge [36:45.000 --> 36:48.000] and prior to the presentment of factual evidence, [36:48.000 --> 36:57.000] presume or believe that the statutes within the transportation code automatically apply to the accused? [36:57.000 --> 37:02.000] Now, that is an entrapment question for obvious reasons. [37:02.000 --> 37:05.000] And here is where we're going to start discussion of this. [37:05.000 --> 37:06.000] Okay. [37:06.000 --> 37:08.000] But one more thing, and I'll get into that. [37:08.000 --> 37:14.000] Does this court or do you personally, while acting in your official capacity as judge, [37:14.000 --> 37:19.000] intend to allow the prosecution to automatically presume the accused guilty [37:19.000 --> 37:23.000] of any of the elements required to be proven? [37:23.000 --> 37:25.000] Now, of course, we can get a yes or no answer to that. [37:25.000 --> 37:28.000] Let's see what happens if we get a yes. [37:28.000 --> 37:34.000] If we do, we say, and do you intend to allow the prosecution to simply presume guilt [37:34.000 --> 37:36.000] of a necessary element of a criminal charge, [37:36.000 --> 37:42.000] specifically the applicability of the transportation code and the statutes therein? [37:42.000 --> 37:45.000] Again, if we get a yes, and do you intend to do so [37:45.000 --> 37:50.000] without presentment of any factual evidence supporting that presumption? [37:50.000 --> 37:54.000] If we get a no to the original question, [37:54.000 --> 37:58.000] so the prosecutor is required to prove every single element, [37:58.000 --> 38:03.000] including applicability of the statute to the accused. [38:03.000 --> 38:05.000] If he says yes, well, then we go on. [38:05.000 --> 38:08.000] If, however, we get a no. [38:08.000 --> 38:13.000] Okay, so you do intend to allow the prosecutor to presume guilt [38:13.000 --> 38:19.000] and to convict based upon personal presumptions of law rather than factual evidence. [38:19.000 --> 38:22.000] Thank you for clarifying. [38:22.000 --> 38:28.000] I ask the court to take judicial notice of Articles 11.43 and 38.03 Code of Criminal Procedure, [38:28.000 --> 38:34.000] which states that anyone accused of any alleged crime has the right to be presumed [38:34.000 --> 38:39.000] completely innocent of all elements of a charge until actually proven guilty. [38:39.000 --> 38:44.000] That would include me, is that correct? [38:44.000 --> 38:47.000] I further ask the court to take judicial notice of another provision [38:47.000 --> 38:50.000] within Article 38.03 Code of Criminal Procedure, [38:50.000 --> 38:55.000] which states no person may be convicted of an offense [38:55.000 --> 39:01.000] unless each element of the offense is proved beyond a reasonable doubt. [39:01.000 --> 39:11.000] And which provision I believe and assert would directly apply to this alleged matter, is that correct? [39:11.000 --> 39:15.000] In relation to jurisdiction specifically, at a minimum, [39:15.000 --> 39:22.000] this court must have jurisdiction of the subject matter of the individual and the venue, is that correct? [39:22.000 --> 39:26.000] In relation to jurisdiction specifically, at a minimum, [39:26.000 --> 39:30.000] state must have standing to bring the charges and pursue an action. [39:30.000 --> 39:35.000] And once it has been challenged, state must prove its standing on the record. [39:35.000 --> 39:41.000] Are those assertions of standing in relation to proper court procedure factually correct? [39:41.000 --> 39:47.000] I believe it to be true that anyone accused of any crime has the right to a fair and impartial trial, [39:47.000 --> 39:50.000] including me, is that correct? [39:50.000 --> 39:59.000] And I believe it to be true that this same right also includes the right to a fair and impartial judge, is that correct? [39:59.000 --> 40:04.000] Now, if we get to this point, and I seriously doubt we will get past number six up there [40:04.000 --> 40:08.000] where we first ask the judge if they intend to presume guilt of any element of the charge [40:08.000 --> 40:11.000] prior to the introduction of factual evidence, [40:11.000 --> 40:17.000] I believe that's where the court's going to depart from answering any questions and insist to move forward without it, [40:17.000 --> 40:24.000] in which case we're going to document that as a direct denial of due process for failure of the court [40:24.000 --> 40:30.000] to be fair and impartial and to protect the right of the accused to know the nature and cause against them [40:30.000 --> 40:40.000] pursuant Article 1, Section 10, and Article 1.05 of the Code of Criminal Procedure. [40:40.000 --> 40:50.000] These people do not follow the rules of procedure that are supposed to bind them like they are claiming these other statutes bind the rest of us. [40:50.000 --> 40:57.000] But they are going to try that, and we have got to be willing to fight them tooth and nail when they do it. [40:57.000 --> 41:02.000] Now, since I doubt we will get as far as I went, and this is not even by far complete, [41:02.000 --> 41:08.000] but as far as I got in that, real quick I want to go over a couple things dealing with the jury voir dire. [41:08.000 --> 41:12.000] We're going to attempt to do the same thing with the jury. [41:12.000 --> 41:23.000] Now, we've discussed before questions you can ask to try to trap the entire jury pool into getting disqualified because of certain things. [41:23.000 --> 41:31.000] Well, the judges have just decided to declare that they don't see the juror's response as a reason to disqualify, [41:31.000 --> 41:38.000] even if the juror has already said that they would show prejudice to the officer's testimony over that of the accused. [41:38.000 --> 41:53.000] So now what we want to do is get the juror to admit that they already have presumed you guilty of this same specific element that the court is presuming you guilty of, [41:53.000 --> 42:00.000] which is application of the statute to a non-commercial traveler rather than a commercial driver. [42:00.000 --> 42:11.000] If the jury member that you're questioning admits that they already believe and presume that that statute applies to everyone, including you, [42:11.000 --> 42:22.000] then they have already got a predisposition of guilt over innocence on that element, and you are not getting a fair and impartial jury if that is the case. [42:22.000 --> 42:30.000] So we're going to try to formulate a question that allows us to prove that through the jury member themselves. [42:30.000 --> 42:34.000] So here's what I've put together on that so far. [42:34.000 --> 42:42.000] Ladies and gentlemen of the jury, do any of you already believe that the accused in this matter, and that would be me, [42:42.000 --> 42:51.000] is already guilty of even one of the required elements of the charge or charges alleged by the prosecution? [42:51.000 --> 42:57.000] Now, of course, with that question, most of the jurors are going to say, no, I'm not presuming you guilty of anything. [42:57.000 --> 43:05.000] But we're using this to set them into a frame of mind where we're going to be able to get them to contradict themselves. [43:05.000 --> 43:16.000] The prosecutor is alleging that the accused, once again, that would be me, is guilty of one or more violations of the Texas Transportation Code. [43:16.000 --> 43:19.000] Now, this part I expect to draw an objection. [43:19.000 --> 43:25.000] That is the code in Texas that regulates a specific commercial use activity known as transportation. [43:25.000 --> 43:31.000] Now, even if the prosecutor objects, we don't care. [43:31.000 --> 43:35.000] That statement is now in the record if it's a court of record. [43:35.000 --> 43:39.000] And during voir dire, the judge can't go back and say strike that. [43:39.000 --> 43:42.000] The judge can only say, well, ignore that and go on. [43:42.000 --> 43:44.000] You can't ask that question. [43:44.000 --> 43:49.000] But even if that happens, we can continue on from there, and I've tried to formulate these to let us do that. [43:49.000 --> 43:52.000] All right, folks, I should be able to wrap this up on the other side and start taking your calls. [43:52.000 --> 43:54.000] So everybody, please hang on the board. [47:27.000 --> 47:33.000] So we can ask them, do you understand what a required element of an offense is? [47:33.000 --> 47:36.000] And they can say yes or no. [47:36.000 --> 47:44.000] So then you can simply say, okay, some charges have a couple of elements. [47:44.000 --> 47:49.000] For instance, they have to name a date and a place. [47:49.000 --> 47:55.000] But they also would have more in some cases where they have to name a date, [47:55.000 --> 48:02.000] a place, specific actions, and whether or not there was intent or no intent, [48:02.000 --> 48:06.000] or if intent in fact is one of the necessary elements. [48:06.000 --> 48:14.000] So each thing that the statute says is a requirement in order to commit the offense [48:14.000 --> 48:20.000] is an element that the prosecutor must prove. [48:20.000 --> 48:22.000] And he has to prove them all. [48:22.000 --> 48:25.000] He cannot prove one out of five. [48:25.000 --> 48:28.000] He can't prove four out of five. [48:28.000 --> 48:31.000] He has to prove all five. [48:31.000 --> 48:38.000] If he cannot produce factual evidence beyond a reasonable doubt to each [48:38.000 --> 48:43.000] and every element, then you have to find the person innocent of that charge [48:43.000 --> 48:48.000] or they have to dismiss it because they didn't prove the charge. [48:48.000 --> 48:51.000] So now do you understand what an element is? [48:51.000 --> 48:52.000] All right. [48:52.000 --> 48:55.000] After you get to that explanation, we can go a little further down [48:55.000 --> 49:02.000] and we can say, okay, juror number one, at this moment, do you already presume [49:02.000 --> 49:08.000] that the transportation code automatically applies to the accused [49:08.000 --> 49:14.000] despite having neither seen nor heard any factual evidence proving [49:14.000 --> 49:18.000] that the accused was engaged in transportation? [49:18.000 --> 49:21.000] Now, of course, you're not going to be able to address the things [49:21.000 --> 49:24.000] that the prosecutor is going to attempt to use for that, which is, [49:24.000 --> 49:28.000] well, was he driving a motor vehicle at the time when you encountered him? [49:28.000 --> 49:30.000] What color was his motor vehicle? [49:30.000 --> 49:32.000] And so on and so forth. [49:32.000 --> 49:37.000] Because again, they're not introducing any evidence that you were driving [49:37.000 --> 49:42.000] a motor vehicle for the purpose of engaging in transportation, [49:42.000 --> 49:46.000] which is the highest point they have to prove to even have standing. [49:46.000 --> 49:50.000] If you weren't engaged in transportation, you could not be doing any of the [49:50.000 --> 49:52.000] things down here that they're accusing you of. [49:52.000 --> 49:55.000] End of story. [49:55.000 --> 49:58.000] Now, this is where the judge is going to try to create a loophole [49:58.000 --> 50:02.000] for the prosecutor to maintain suit and keep you in court. [50:02.000 --> 50:06.000] So you've got to be aware of that. [50:06.000 --> 50:11.000] Now, juror number one, would you be likely and willing to find the accused [50:11.000 --> 50:16.000] guilty of any charge even if the prosecutor failed to prove on the record, [50:16.000 --> 50:21.000] beyond a reasonable doubt, that the accused was engaged in transportation [50:21.000 --> 50:25.000] at the time of the alleged offense? [50:25.000 --> 50:29.000] Juror number one, would you be likely and willing to find the accused [50:29.000 --> 50:35.000] guilty of any charge even if the prosecutor failed to prove on the record [50:35.000 --> 50:40.000] that the transportation statutes in that code applied to the accused [50:40.000 --> 50:42.000] at the time of the alleged offense? [50:42.000 --> 50:45.000] And as we construct more questions, you're going to see that they're [50:45.000 --> 50:49.000] directed to get the same answer over and over again, that yes, [50:49.000 --> 50:56.000] the jury is willing to allow the prosecutor to assume or presume that [50:56.000 --> 51:01.000] that particular element is a done deal, that they are not willing to [51:01.000 --> 51:08.000] consider the fact that you are indeed innocent of the statute applying. [51:08.000 --> 51:11.000] So you see where that can take you? [51:11.000 --> 51:16.000] You can't get a fair trial in these courts because the jury is already [51:16.000 --> 51:20.000] presuming you guilty of one of the required elements, [51:20.000 --> 51:29.000] and it is the foundational element of everything else state has to prove. [51:29.000 --> 51:34.000] He's getting a free pass on proving that one. [51:34.000 --> 51:40.000] And that is the one upon which everything else rests. [51:40.000 --> 51:45.000] It's exactly why you do not get a fair trial. [51:45.000 --> 51:46.000] All right. [51:46.000 --> 51:49.000] I hope I didn't complicate that too much and that it made sense to folks, [51:49.000 --> 51:52.000] at least to the point where you can see where I'm trying to get to with it [51:52.000 --> 51:54.000] and how much work it's going to take. [53:04.000 --> 53:07.000] I'm assuming from what you're telling me so far, you had a car, [53:07.000 --> 53:11.000] it was parked on someone's private property, yours or someone else's, [53:11.000 --> 53:15.000] and some municipal police officer has done something. [53:15.000 --> 53:19.000] What's the something? [53:19.000 --> 53:25.000] He has accosted my car. [53:25.000 --> 53:31.000] He stood there and held a vigorous and aggressive conversation with your car? [53:31.000 --> 53:33.000] Because that's what accosted means. [53:33.000 --> 53:41.000] He saw me turning off the ignition and open up the door. [53:41.000 --> 53:42.000] Okay. [53:42.000 --> 53:44.000] So he saw you getting out of the car. [53:44.000 --> 53:55.000] He made presumption because there were no state identifying plates on my private car. [53:55.000 --> 53:56.000] Okay. [53:56.000 --> 54:05.000] As a result, I was demanded to pay because my private car was towed [54:05.000 --> 54:13.000] on a municipal violation and the state, well, I won't say the state. [54:13.000 --> 54:14.000] Okay. [54:14.000 --> 54:18.000] What is the municipal violation specifically? [54:18.000 --> 54:23.000] My private car is not registered with the state. [54:23.000 --> 54:24.000] Okay. [54:24.000 --> 54:28.000] But again, the charge has to do, from what you're describing, [54:28.000 --> 54:32.000] the charge has to be something relating to the fact that the state of Maryland [54:32.000 --> 54:36.000] is trying to say that you cannot have, even on your own private property, [54:36.000 --> 54:40.000] a car that isn't registered somewhere. [54:40.000 --> 54:41.000] Exactly. [54:41.000 --> 54:45.000] So is that what the statute that you're being charged with says? [54:45.000 --> 54:46.000] Yes. [54:46.000 --> 54:49.000] Okay. [54:49.000 --> 54:51.000] Go on. [54:51.000 --> 54:57.000] As a result, to maintain the possession of my own private car, [54:57.000 --> 55:05.000] I had to pay the county that this infraction occurred in, like $40, [55:05.000 --> 55:10.000] and the tow truck company, $250. [55:10.000 --> 55:17.000] So this whole situation resulted in me being extorted out of $290. [55:17.000 --> 55:21.000] At this point, do I have any recourse? [55:21.000 --> 55:24.000] Well, again, sure you do. [55:24.000 --> 55:28.000] I mean, the officer had no warrant to seize private property. [55:28.000 --> 55:35.000] The officer did not seize the car as evidence associated with a criminal act. [55:35.000 --> 55:38.000] He didn't do it for any of those reasons. [55:38.000 --> 55:41.000] That makes it armed robbery. [55:41.000 --> 55:43.000] Okay? [55:43.000 --> 55:44.000] Okay. [55:44.000 --> 55:49.000] Now, the other issue here is I don't know what terminology [55:49.000 --> 55:53.000] or discussion or anything like that that ensued [55:53.000 --> 55:57.000] and what any recording of any of that, if any, exists [55:57.000 --> 56:02.000] would prove one way or the other for you or against you. [56:02.000 --> 56:07.000] So you need to get a copy of that by either public information request [56:07.000 --> 56:11.000] or through file discovery or something of that nature. [56:11.000 --> 56:15.000] But yeah, you have a federal lawsuit as long as you did not blow the claim [56:15.000 --> 56:20.000] of not being engaged in a regulable activity over which they had authority. [56:20.000 --> 56:25.000] If you started slinging around the same terminology you started off with with me, [56:25.000 --> 56:28.000] then you may have blown that opportunity. [56:28.000 --> 56:32.000] Folks, and Olivia, not just you, but everybody listening, [56:32.000 --> 56:35.000] just like Tyler on that first call, [56:35.000 --> 56:40.000] you better get a grip on your vocabulary and its usage. [56:40.000 --> 56:46.000] When you do not distinguish your use of a term or phrase from theirs [56:46.000 --> 56:50.000] and you're conversing with them, any of them, [56:50.000 --> 56:55.000] on a subject matter dealing with something they're accusing you of, [56:55.000 --> 57:05.000] the presumption will always be in their favor that your usage was their usage. [57:14.000 --> 57:22.000] So without that information, Olivia, I don't know how far you will get. [57:22.000 --> 57:27.000] But yeah, you have recourse if you protected everything properly [57:27.000 --> 57:31.000] because the officer hadn't proven anything. [57:31.000 --> 57:38.000] He did not seize the car for a legitimate purpose such as even civil asset forfeiture. [57:38.000 --> 57:43.000] He seized it out of spite and retribution, not because it was evidence, [57:43.000 --> 57:49.000] not because it was a weapon or anything that had been used to perpetrate a crime [57:49.000 --> 57:53.000] that he could firsthand admit he saw happen. [57:55.000 --> 57:59.000] If he didn't actually see a crime committed in his presence or view, [57:59.000 --> 58:04.000] like he's required to do here in Texas, and he issued a citation and took the car, [58:04.000 --> 58:09.000] he has an even bigger problem because he acted entirely of his own volition [58:09.000 --> 58:15.000] and not under the protection of any law associated with the duties of his office. [01:03:54.000 --> 01:03:59.000] It would have been great, you know, to have the information you've been discussing so far on the show, [01:03:59.000 --> 01:04:03.000] but, you know, I'm still working towards it. [01:04:03.000 --> 01:04:09.000] Anyway, I got the poking around and I got the judge's name and obviously the prosecuting attorney's name. [01:04:09.000 --> 01:04:12.000] And, you know, I go on Facebook and I look up and I see that they're friends. [01:04:12.000 --> 01:04:18.000] Would this be a point to request that the judge disqualify himself? [01:04:18.000 --> 01:04:24.000] Absolutely. The judge is not allowed to have a relationship with any of the parties to the case where they are presiding. [01:04:24.000 --> 01:04:29.000] Outstanding. Cool. Okay, I'm going to get that one right there in motion. [01:04:29.000 --> 01:04:30.000] All right, second question. [01:04:30.000 --> 01:04:35.000] Now, be aware that this may not, the judge may do an in-run around you and say, [01:04:35.000 --> 01:04:38.000] well, that's okay, they have different prosecutors, I'll just send a new one. [01:04:38.000 --> 01:04:41.000] Okay. [01:04:41.000 --> 01:04:48.000] What you need to do is get the judge to do something that would personally disqualify the judge. [01:04:48.000 --> 01:04:57.000] Because depending upon who is acting as the prosecutor, there may be more than one person in that pool to draw from. [01:04:57.000 --> 01:05:00.000] And that's a simple fix. [01:05:00.000 --> 01:05:03.000] So you need to get the judge to make it personal. [01:05:03.000 --> 01:05:08.000] Once they make it personal, there ain't no pushing that off on somebody else. [01:05:08.000 --> 01:05:11.000] You mean making it personal isn't their bias against me? [01:05:11.000 --> 01:05:12.000] Correct. [01:05:12.000 --> 01:05:13.000] Okay. [01:05:13.000 --> 01:05:16.000] And that's where that question that I asked the judge directly, [01:05:16.000 --> 01:05:26.000] do you intend to presume that any element of this charge made against the accused that they're already guilty of it? [01:05:26.000 --> 01:05:33.000] If that's the case, the judge has made it personal and it's absolutely impossible to get a fair and impartial trial from that judge. [01:05:33.000 --> 01:05:35.000] Okay. All right, I understand that. [01:05:35.000 --> 01:05:42.000] Because the Code of Criminal Procedure here in Texas, 38.03 and the 11 point, whatever I read, I forget what it is, [01:05:42.000 --> 01:05:46.000] makes it very, very clear that they cannot presume guilt over innocence. [01:05:46.000 --> 01:05:50.000] And yet 99% of the statutes in the transportation code do exactly that. [01:05:50.000 --> 01:05:58.000] And they try to do it under the cover of, let's see, implied consent. [01:05:58.000 --> 01:06:03.000] Consenting to the driver's licenses and license plates and all that good stuff. [01:06:03.000 --> 01:06:04.000] Exactly. [01:06:04.000 --> 01:06:16.000] And the problem that they seem to not understand about implied consent is that once you contest that it's implied, it's no longer implied. [01:06:16.000 --> 01:06:21.000] Once you say, I don't grant it, it's not implied anymore. [01:06:21.000 --> 01:06:25.000] Right. [01:06:25.000 --> 01:06:29.000] And they seem to think that that means that you can't say that. [01:06:29.000 --> 01:06:32.000] Boy, you got the license, therefore it's implied. [01:06:32.000 --> 01:06:38.000] It was never disclosed to me that I'd be waiving any rights, therefore it is not implied and I don't waive it. [01:06:38.000 --> 01:06:40.000] Right, exactly. [01:06:40.000 --> 01:06:47.000] See, that's the part they're forgetting, non-disclosure. [01:06:47.000 --> 01:06:48.000] All right. [01:06:48.000 --> 01:06:50.000] All right, cool. [01:06:50.000 --> 01:07:02.000] Second question, when I went to file my motions, I went to file my motion, Declination to Plea and Special Appearance, I go down to the clerk's office [01:07:02.000 --> 01:07:12.000] and they said that I would need to, I mean, this isn't really big, it's just me nitpicking, but they said that I would need to file two separate documents [01:07:12.000 --> 01:07:17.000] because I have two cases before the court that are obviously from the same stop. [01:07:17.000 --> 01:07:20.000] They asked the court to consolidate the cases. [01:07:20.000 --> 01:07:28.000] That way you can just put the citation numbers for both on the same pleadings and file them in each and file one copy in the case. [01:07:28.000 --> 01:07:29.000] All right, good. [01:07:29.000 --> 01:07:32.000] Yeah, because that was money on notaries and so on. [01:07:32.000 --> 01:07:34.000] So I just have to file a motion. [01:07:34.000 --> 01:07:39.000] File a written motion moving the court to consolidate the two citations into a single case. [01:07:39.000 --> 01:07:40.000] Okay. [01:07:40.000 --> 01:07:45.000] And then also something that was interesting, the clerks told me, and it's kind of good on them, but at the same time, [01:07:45.000 --> 01:07:52.000] I just haven't seen the whole muster, they said that if I didn't request a hearing on anything that I put in the record, [01:07:52.000 --> 01:07:54.000] that it wasn't even going to be looked at. [01:13:28.000 --> 01:13:36.000] But you have to remember the argument that the complaint is not required to contain all the elements required to be proven. [01:13:45.000 --> 01:13:53.000] And they are the only proper notice to the accused because they are the only things that contain all of the elements. [01:13:53.000 --> 01:13:59.000] If a complaint does not contain all the elements and you raise that issue, the judge is simply going to say, [01:13:59.000 --> 01:14:05.000] well, the complaint's fine because the statutes do not require that a complaint list all the elements. [01:14:25.000 --> 01:14:34.000] So it's a catch-22 problem that they have no easy fix for really because your rights have already been deprived as far as notice goes. [01:24:08.000 --> 01:24:15.000] And you need to be able to argue how and why they don't apply to you as a commercial entity regulated by those statutes. [01:24:18.000 --> 01:24:25.000] You do that by arguing the state has failed to prove the applicability of those statutes to the individual and their actions. [01:24:25.000 --> 01:24:34.000] In other words, you deny, deny, deny so that the burden of proof remains on the shoulders of those making the claim. [01:24:34.000 --> 01:24:43.000] Anything else is you attempting to disprove their claim, and you can't do it. [01:24:43.000 --> 01:24:51.000] But their problem is they can't prove their claim either if you force them to try. [01:24:51.000 --> 01:24:59.000] Right. You need, if you want that 30 to 60 days to be useful, move to Jersey and New York. [01:25:05.000 --> 01:25:08.000] Learn how to argue with a bunch of Italians. [01:25:35.000 --> 01:25:41.000] That's where the study of the procedure codes come in that deal with how the courts are required to handle these cases, [01:25:41.000 --> 01:25:49.000] which means you need to know what type of case the court is required to treat it as, civil, criminal, or administrative in any particular venue. [01:26:51.000 --> 01:26:59.000] Every state has that domain name purchased, even though it may redirect you to something completely different. [01:26:59.000 --> 01:27:05.000] You type that into the URL line, and it will take you to that state's legislative website. [01:27:05.000 --> 01:27:10.000] You just find the part on there that deals with laws and statutes or codes or whatever, [01:27:10.000 --> 01:27:15.000] and that will then lead you into the particular ones you need if you look hard enough and far enough. [01:27:15.000 --> 01:27:18.000] If you can't find it on your own, call a county clerk. [01:27:18.000 --> 01:27:20.000] Call the secretary of state.
