[00:54.000 --> 01:01.000] The Chicago Police Department is experimenting with a new program designed to predict whether a person will commit a crime in the near future. [01:01.000 --> 01:11.000] In recent years, predictive analytical systems have become increasingly popular with police departments determined to stop crime before it happens, also known as pre-crime. [01:11.000 --> 01:18.000] One of the CPD's tools is a heat list, a list of around 400 citizens who are most likely to commit a violent crime. [01:18.000 --> 01:28.000] Hani Fakori of the Electronic Frontier Foundation stated, My fear is that these programs are creating an environment where police can show up at anyone's door at any time for any reason. [01:28.000 --> 01:34.000] CPD Commander Jonathan Lewis believes this program will become a national best practice. [01:34.000 --> 01:41.000] The CPD received more than $2 million from the National Institute of Justice to test the program. [01:41.000 --> 01:53.000] In the latest debate on what to do with cryptocurrencies, Senator Joe Manchin has mailed a letter to Treasury Secretary Jack Lew, Fed Chairwoman Janet Yellen, and other regulators asking them to take action against Bitcoin. [01:53.000 --> 02:02.000] Senator Manchin described Bitcoin's use on the Silk Road online marketplace and other black markets as a reason for regulation or an outright ban. [02:02.000 --> 02:12.000] The Senator stated, The clear ends of Bitcoin for either transaction and illegal goods and services or speculative gambling make me wary of its use. [02:12.000 --> 02:20.000] A coalition of environmental and human rights groups have called on the United Nations to stop the eviction of the indigenous Ngobi community of Panama. [02:20.000 --> 02:28.000] The community is being forcibly evicted from their land as the Barro Blanco hydroelectric dam project is launched in western Panama. [02:28.000 --> 02:34.000] The community claims it was not consulted for the project and if evicted they will lose their land, food, water, and culture. [02:34.000 --> 02:42.000] Winnie Bagama of the Ngobi organization stated, Our lands and natural resources are the most important aspect of our culture. [02:42.000 --> 02:45.000] Every day we fear we will be forced from our home. [02:45.000 --> 02:54.000] The groups are also calling on the financing companies and their home countries to suspend the project until steps are taken to prevent further violations of human rights. [04:24.000 --> 04:36.000] And family law that we've been doing and stirring a little stuff up here in the Dallas-Fort Worth area [04:36.000 --> 04:48.000] And always it seems that everywhere I go everybody seems to feel that family law is the most corrupt there is [04:48.000 --> 04:56.000] And sometimes I don't like to think that way but sometimes I think they might be right. [05:18.000 --> 05:33.000] Why did you have to act so mean? Don't you know you're a human being? [05:33.000 --> 05:38.000] Born of a mother with a lover, a father Reflection comes and reflection goes [05:38.000 --> 05:43.000] I know sometimes you wanna let go [05:43.000 --> 05:48.000] Okay, I'm back again. We're having a minor technical difficulty [05:48.000 --> 05:54.000] But we've been dealing with some family law issues [05:54.000 --> 06:00.000] And everywhere I go in the country everybody talks about family law being the most corrupt [06:00.000 --> 06:07.000] And the reason I don't like to think that way is because I imagine myself as a family law judge [06:07.000 --> 06:15.000] If I were a family law judge and I did my job right, nobody would be happy [06:15.000 --> 06:20.000] Everybody would feel like the other guy got the better deal [06:20.000 --> 06:25.000] And that would only be because I gave everybody a better deal [06:25.000 --> 06:32.000] It seems like in family law with emotions running as high as they do [06:32.000 --> 06:39.000] Everybody feels like they should get everything and the other guy's the total scumbag [06:39.000 --> 06:42.000] And I'm the poor mistreated hero [06:42.000 --> 06:52.000] I understand the problem but in looking at what appears to be going on in the family law arena [06:52.000 --> 06:56.000] There appears to be another dynamic [06:56.000 --> 07:01.000] And I know if there's any lawyers listening they won't like to hear this part [07:01.000 --> 07:13.000] But it certainly appears that in family law matters we have people who tend to be vulnerable [07:13.000 --> 07:20.000] People who are in very difficult emotional situations [07:20.000 --> 07:27.000] And they are at their most vulnerable [07:27.000 --> 07:31.000] They are easy marks [07:31.000 --> 07:43.000] And it is unfortunate but it's sort of the nature of the human animal as a predator by his nature to prey [07:43.000 --> 07:50.000] And if you're a lawyer and you work with people in family law all the time [07:50.000 --> 07:58.000] Over time you're going to have to kind of become immune to the pathos [07:58.000 --> 08:02.000] To the misery and frustration everybody's going through [08:02.000 --> 08:09.000] Because if you allow yourself to feel all that misery and frustration you won't be able to do your job [08:09.000 --> 08:16.000] Well that has an unfortunate side effect in that [08:16.000 --> 08:25.000] People tend to begin to look at their clients merely as clients and not as human beings [08:25.000 --> 08:32.000] And from what I've seen it appears as though [08:32.000 --> 08:43.000] There are a lot of lawyers out there who look at their clients and calculate how much estate their client has available [08:43.000 --> 08:51.000] And it appears as though this is truly our four-sided chessboard [08:51.000 --> 08:56.000] If any area of law is truly a four-sided chessboard [08:56.000 --> 09:01.000] And by that I mean you go before the court and you have a lawyer representing you [09:01.000 --> 09:06.000] And you think you and your lawyer are against the world [09:06.000 --> 09:10.000] But it's not really that way [09:10.000 --> 09:18.000] Because you have your lawyer on one side, you have the other client's lawyer on the other side [09:18.000 --> 09:24.000] And then you have the judge there across the table from you [09:24.000 --> 09:31.000] And all of these individuals have relationships [09:31.000 --> 09:34.000] You're the only one with a disadvantage [09:34.000 --> 09:41.000] One lawyer has a relationship with you and he has a relationship with the judge and with the other lawyer [09:41.000 --> 09:47.000] The other lawyer is in the same place, the judge has a relationship with both lawyers [09:47.000 --> 09:50.000] The other client has a relationship with his lawyer [09:50.000 --> 09:55.000] But you've only got one link in this whole chain [09:55.000 --> 10:05.000] And what it looks like is the lawyers kind of have a tacit agreement to look over the estate of the two litigants [10:05.000 --> 10:09.000] And see how much of that estate they can swallow [10:09.000 --> 10:14.000] Before they allow the litigants to come together and find just an equitable outcome [10:14.000 --> 10:18.000] If by that time there is an equitable outcome [10:18.000 --> 10:27.000] And we have been looking at the courts here in the Dallas-Fort Worth area [10:27.000 --> 10:32.000] And as much as I don't like to see it that way [10:32.000 --> 10:38.000] I was absolutely astounded at what a horrible mess it is [10:38.000 --> 10:51.000] We had a woman going into court and everybody who talks to me about a family law issue feels terribly mistreated [10:51.000 --> 10:54.000] And so I come to expect that [10:54.000 --> 11:00.000] I try to listen for the clues as to what's really going on [11:00.000 --> 11:11.000] Because every lawyer has this adage and this knowledge that your client never tells you everything [11:11.000 --> 11:14.000] It's not because the client doesn't mean to [11:14.000 --> 11:19.000] When a client is talking to a potential lawyer, he's trying to sell the lawyer [11:19.000 --> 11:29.000] And when you tell your inner mind to bring me up some stuff that I can use to get this lawyer to want to represent me [11:29.000 --> 11:34.000] It's not going to tend to bring up the bad stuff [11:34.000 --> 11:38.000] It's going to look at the facts and circumstances [11:38.000 --> 11:40.000] It's going to look favorable to you [11:40.000 --> 11:44.000] And that's what it's going to bring to mind [11:44.000 --> 11:46.000] Some of the stuff he really needs to know [11:46.000 --> 11:49.000] Well, that's not likely to look so good [11:49.000 --> 11:51.000] So you tend not to tell him [11:51.000 --> 11:55.000] Well, they understand that, I understand that [11:55.000 --> 12:00.000] So I look for the clues to tell me what's missing [12:00.000 --> 12:05.000] And here I found some clues but not enough [12:05.000 --> 12:08.000] And I went to look a little bit closer at what was going on [12:08.000 --> 12:11.000] And it turned out she was right [12:11.000 --> 12:15.000] Her husband was well connected [12:15.000 --> 12:21.000] And it looked as though she was blaming her husband for all this [12:21.000 --> 12:26.000] She looked at it and I was blaming the lawyers for it [12:26.000 --> 12:29.000] At the time she didn't have a lawyer [12:29.000 --> 12:34.000] Her ex-husband did have a lawyer [12:34.000 --> 12:36.000] But he still had money [12:36.000 --> 12:39.000] So the lawyer kept turning things [12:39.000 --> 12:44.000] This guy's lawyer keeps turning things so he can pull more money out of his client [12:44.000 --> 12:47.000] That's how it appeared [12:47.000 --> 13:00.000] And she went into court and we helped her file a motion to disqualify the judge [13:00.000 --> 13:07.000] Because the judge had done some things that were clearly improper [13:07.000 --> 13:12.000] This is a routine we see over and over in the courts [13:12.000 --> 13:22.000] Where if the court is asking you, they will issue a warrant while you're not around [13:22.000 --> 13:24.000] Ex parte [13:24.000 --> 13:29.000] And in this case, the woman had child support she couldn't pay [13:29.000 --> 13:35.000] Because she's taking care of her father who she's providing hospice for [13:35.000 --> 13:39.000] He's dying of cancer [13:39.000 --> 13:45.000] And she was the only support for him, the only help he had so she couldn't get a job [13:45.000 --> 13:48.000] And couldn't pay child support [13:48.000 --> 13:53.000] So the second attorney general's lawyer [13:53.000 --> 13:57.000] A week or so before a hearing was coming up [13:57.000 --> 14:02.000] Filed a motion to revoke, she was on probation for not paying child support [14:02.000 --> 14:07.000] To revoke the probation and issue a warrant for her arrest [14:07.000 --> 14:13.000] Well, the problem is the rule of civil procedure requires that [14:13.000 --> 14:16.000] You file the motion at least three days in advance [14:16.000 --> 14:24.000] Give the other party time to prepare a response and hold a hearing [14:24.000 --> 14:27.000] An issue of cause hearing [14:27.000 --> 14:35.000] Well, the motion was issued on one day [14:35.000 --> 14:40.000] That same day, the judge issued, swore out the warrant [14:40.000 --> 14:49.000] And when we got the motion, the motion didn't have a certificate of service attached to it [14:49.000 --> 14:54.000] Now, if you file a motion that doesn't have a certificate of service attached to it [14:54.000 --> 14:58.000] Then the motion is void [14:58.000 --> 15:04.000] As it is insufficient to invoke such matter of jurisdiction in the court [15:04.000 --> 15:10.000] Now, the first thing that judge should have looked at when he held his hearing [15:10.000 --> 15:15.000] Anytime the judge holds the hearing and calls the litigant's name [15:15.000 --> 15:18.000] And the litigant doesn't step up [15:18.000 --> 15:22.000] The first thing he should do is look down at the motion [15:22.000 --> 15:27.000] And see if there is a certificate of service attached [15:27.000 --> 15:31.000] And see if there's proof of service on the certificate of service [15:31.000 --> 15:40.000] But he should ask the lawyer who filed the motion if he served the opposing party [15:40.000 --> 15:43.000] That would have seemed like the thing to do [15:43.000 --> 15:47.000] But apparently the judge didn't do that [15:47.000 --> 15:52.000] Same day he got the motion, he held a hearing and issued a warrant [15:52.000 --> 15:59.000] The reason they did that is so that when the woman showed up for court [15:59.000 --> 16:04.000] Said something to debate us about this and he said, well, you can't be arrested in the courtroom [16:04.000 --> 16:08.000] Are you kidding me? Of course you can [16:08.000 --> 16:12.000] But she never went into the courtroom [16:12.000 --> 16:18.000] You'd be standing in front of the door waiting for her and arrest her before she got in the door [16:18.000 --> 16:26.000] And then they'd take her to jail and when the judge called the individual's name [16:26.000 --> 16:32.000] They would be there and they would issue a default judgment against them [16:32.000 --> 16:36.000] Now that's all improper and inappropriate [16:36.000 --> 16:43.000] But the other party is still left having to overcome a default judgment [16:43.000 --> 16:49.000] We caught something and we'll explain what happened when we come back on the other side [16:49.000 --> 16:58.000] We'll be right back [17:19.000 --> 17:27.000] We'll be right back [17:49.000 --> 17:55.000] Are you being harassed by debt collectors with phone calls, letters, or even lawsuits? Randy Shelton, Debt Receiver, Rule of Law Radio [19:49.000 --> 19:53.000] And if I falter a little, I'm having a little trouble with my voice [19:53.000 --> 20:00.000] We had to put in an archive last week because my voice just simply was not working [20:00.000 --> 20:03.000] It's better now, but not up to par [20:03.000 --> 20:13.000] Anyway, this woman, we filed a challenge, a motion to disqualify the judge [20:13.000 --> 20:20.000] In a hearing where she didn't show up because she knew they were going to arrest her [20:20.000 --> 20:26.000] So we filed the motion to disqualify [20:26.000 --> 20:32.000] And the judge forwarded the motion to the head administrative judge of the district [20:32.000 --> 20:41.000] And the head administrative judge of the district got the motion, held an ex parte hearing, and denied the motion [20:41.000 --> 20:45.000] That is absolutely forbidden [20:45.000 --> 20:53.000] It required a set of hearings and allowed both parties to appear at the hearing and provide evidence [20:53.000 --> 20:55.000] The judge just wanted to get stood out of hand [20:55.000 --> 21:01.000] It's kind of a standard practice when a pro se files a disqualification [21:01.000 --> 21:03.000] Or a recuse [21:03.000 --> 21:11.000] So they went to the hearing with her not present just like they planned to [21:11.000 --> 21:17.000] Except the problem was if the disqualification was in the way and they knew it [21:17.000 --> 21:26.000] The next Friday, the constable showed up and arrested the woman who took her to jail [21:26.000 --> 21:34.000] Threw her down a flight of stairs, they took her to John Petersmith Hospital [21:34.000 --> 21:45.000] And because of what they did to her there, she called the FBI and filed sexual assault charges against them [21:45.000 --> 21:53.000] And all of the time they're telling her that this is what she gets for messing with this particular judge [21:53.000 --> 22:01.000] So they made it clear that they were doing this to her because she challenged this judge [22:01.000 --> 22:11.000] The next Tuesday she was back in court on a bail revocation hearing [22:11.000 --> 22:19.000] And in that one we helped to prepare a challenge to subject matter jurisdiction of the court [22:19.000 --> 22:25.000] They started this hearing and she had filed a motion with the clerk [22:25.000 --> 22:31.000] They tried to give the motion to the judge and he would not look at it [22:31.000 --> 22:42.000] He spent two hours grilling her about a post on a blog site [22:42.000 --> 22:47.000] They have a blog site up here for people who are in family court [22:47.000 --> 22:50.000] And it was critical of this judge [22:50.000 --> 22:56.000] And he spent two hours grinding on her about it, they wanted to know who wrote that [22:56.000 --> 22:58.000] She said, I'm not telling you [22:58.000 --> 23:02.000] Well, did you write this? I'm not talking about this [23:02.000 --> 23:09.000] For two hours he ground on her and I was absolutely astounded at how well she handled her [23:09.000 --> 23:14.000] Well, actually I only was in the courtroom for about the first 30 minutes [23:14.000 --> 23:19.000] After 30 minutes I'd had enough and I asked the bailiff to get me another bailiff up here [23:19.000 --> 23:22.000] So I could file charges against this judge [23:22.000 --> 23:28.000] He refused so I went out in the hall and while I was looking for another bailiff [23:28.000 --> 23:32.000] The first bailiff came out just screaming and rapping and raving at me [23:32.000 --> 23:38.000] So I filed out 9-1-1 and there was a big brouhaha in the hall and that was my attempt [23:38.000 --> 23:44.000] I wanted to let a commotion happen [23:44.000 --> 23:49.000] So they kind of warned the judge because he was really getting out of hand [23:49.000 --> 23:57.000] And it worked because the bailiff went in and told the judge that I was out there setting him up for a federal lawsuit [23:57.000 --> 24:02.000] And I didn't have to, they did fine on their own [24:02.000 --> 24:08.000] But finally the judge went out to confer with an associate judge [24:08.000 --> 24:20.000] And apparently read the challenge to subject matter jurisdiction while he was out conferring with this associate judge [24:20.000 --> 24:25.000] And he would ask this woman, do you not think you could get a fair trial in my court? [24:25.000 --> 24:32.000] She said absolutely not, over and over and over, he just kept growing up [24:32.000 --> 24:38.000] So after he goes out and he read the challenge to subject matter jurisdiction [24:38.000 --> 24:48.000] We accused the attorney general lawyer and the judge of conspiracy, of witness tampering, [24:48.000 --> 24:57.000] obstruction of justice, official oppression and one other in the challenge to subject matter jurisdiction [24:57.000 --> 25:08.000] And the cause of the judge and this lawyer had committed these crimes under the color of their authority [25:08.000 --> 25:15.000] That they were constitutionally disqualified under due process [25:15.000 --> 25:18.000] Apparently he read that when he went out [25:18.000 --> 25:23.000] Because when they came back, I was out in Hall and I wouldn't be back in the courtroom [25:23.000 --> 25:29.000] But she said it was the difference between night and day [25:29.000 --> 25:38.000] And all of a sudden the judge is being nice to her and crawling down her ex-husband's lawyer's throat [25:38.000 --> 25:43.000] And threatened him with sanctions because he didn't like the way he asked her a question [25:43.000 --> 25:48.000] Because he felt like an offense on her constitutional rights [25:48.000 --> 25:55.000] When you start making accusations against these judges, especially if they're well founded [25:55.000 --> 26:00.000] It absolutely does get their attention [26:00.000 --> 26:06.000] And when they came out of the court they said they could not believe the difference in that courtroom [26:06.000 --> 26:13.000] Because the judge realized that he's going to have a floatering company in it [26:13.000 --> 26:20.000] And the improper ruling on the disqualification [26:20.000 --> 26:24.000] We will be going after the head administrative judge of the district as well [26:24.000 --> 26:27.000] Because his acts were just criminal [26:27.000 --> 26:30.000] If we tie him to the criminal acts of this judge [26:30.000 --> 26:34.000] This head administrative judge of the district is not going to be happy about that [26:34.000 --> 26:38.000] And we'll create ourselves some politics [26:38.000 --> 26:47.000] We're putting together a program now to start monitoring these family law judges [26:47.000 --> 26:51.000] There's so many people that feels like they're being screwed around [26:51.000 --> 26:53.000] I don't want to say they are [26:53.000 --> 26:56.000] But they certainly feel like it and certainly looks like they are [26:56.000 --> 26:58.000] But there's so many of them [26:58.000 --> 27:00.000] If we give them a little bit of training [27:00.000 --> 27:05.000] There's enough of them that right now when these folks are going into court [27:05.000 --> 27:07.000] They've always got court watchers [27:07.000 --> 27:12.000] Got people in there taking poopiest notes [27:12.000 --> 27:17.000] And they're saying it is making a tremendous difference [27:17.000 --> 27:20.000] The point of this story is [27:20.000 --> 27:27.000] The only way we're going to get anything done is take these guys on [27:27.000 --> 27:31.000] You can't be nice to your judge [27:31.000 --> 27:36.000] You have to treat the judge as if he is totally corrupt [27:36.000 --> 27:38.000] If he's not totally corrupt [27:38.000 --> 27:41.000] You won't have any reason to file criminal charges [27:41.000 --> 27:47.000] Or judicial conduct complaints against him because he'll do his job right [27:47.000 --> 27:50.000] And if he's not corrupt [27:50.000 --> 27:53.000] If he is a honest and understanding judge [27:53.000 --> 27:56.000] He'll understand that you're under stress and pressure [27:56.000 --> 28:01.000] And he won't hold it against you [28:01.000 --> 28:03.000] But from what I've seen [28:03.000 --> 28:07.000] They hold everything against you if you can say especially [28:07.000 --> 28:11.000] And they don't care [28:11.000 --> 28:13.000] They don't care what the law is [28:13.000 --> 28:14.000] They don't care what's right [28:14.000 --> 28:16.000] They're going to do what they want to do [28:16.000 --> 28:18.000] They want to feed their attorney friends [28:18.000 --> 28:22.000] And you're just gristing their bill [28:22.000 --> 28:25.000] Unless you stand up to it [28:25.000 --> 28:27.000] Well that's our story and I'm sticking to it [28:27.000 --> 28:30.000] We've got three callers on the board [28:30.000 --> 28:33.000] We've got about a minute before we go to the next break [28:33.000 --> 28:35.000] We've got Jeff from Mississippi [28:35.000 --> 28:39.000] Hello Jeff, let me get you unmuted [28:39.000 --> 28:43.000] Talk to me Jeff, what do you have going on now? [33:56.000 --> 34:02.000] I believe that I'm going to have the same public defender that I did last time [34:02.000 --> 34:07.000] Well, she got the appeal done [34:07.000 --> 34:09.000] That was my appeals attorney [34:09.000 --> 34:12.000] This was a separate person [34:12.000 --> 34:19.000] And she's the reason that I won the appeal or that I was favored and got a new retrial [34:19.000 --> 34:28.000] Is because during the trial, it came out that the prosecutor had hit the key witness [34:28.000 --> 34:34.000] I asked the policeman to produce the person that made the telephone call [34:34.000 --> 34:40.000] That supposedly turned me in and the prosecutor refused to bring them forward [34:40.000 --> 34:44.000] And had hidden them and had never even put that in discovery [34:44.000 --> 34:48.000] And so my attorney said, well, she didn't know who he was either [34:48.000 --> 34:55.000] And then when she found out, she asked to withdraw because it was a conflict of interest [34:55.000 --> 35:01.000] The judge would not let her withdraw and that's what won my appeal [35:01.000 --> 35:07.000] And for all I know, you know what, I'm not really sure who's going to be my public defender [35:07.000 --> 35:12.000] He needs plenty of time to prepare for the case [35:12.000 --> 35:17.000] Okay, so I need to find out who that will be [35:17.000 --> 35:19.000] Absolutely [35:19.000 --> 35:25.000] To let your public defender know, you better do this the way I... [35:25.000 --> 35:31.000] You'll give me off on bar preview into oblivion [35:31.000 --> 35:35.000] An interesting question came up and that is since the... [35:35.000 --> 35:38.000] And I know who the witness is, but I just didn't tell them in court [35:38.000 --> 35:41.000] I kept asking them to bring them forward and they refused [35:41.000 --> 35:48.000] They called them a criminal informant, but they actually took his statement and sealed it [35:48.000 --> 35:51.000] Can I do a FOIA to get that statement? [35:51.000 --> 35:52.000] No [35:52.000 --> 35:56.000] No, especially not if it's sealed, you can do discovery and get it [35:56.000 --> 35:58.000] Oh, I can do discovery? [35:58.000 --> 36:01.000] Yeah, this comes under Brady [36:01.000 --> 36:03.000] Okay [36:03.000 --> 36:05.000] You do a Brady motion for it [36:05.000 --> 36:13.000] So when I get this public defender, I do a discovery and get this person, my roommate is who it was, get their statement [36:13.000 --> 36:14.000] Absolutely [36:14.000 --> 36:17.000] I got you, I like that [36:17.000 --> 36:21.000] Okay [36:21.000 --> 36:29.000] During the court, during the trial and since we answered one question, I may not have to do the next one [36:29.000 --> 36:33.000] But the judge told me that if I would have had a suppression motion [36:33.000 --> 36:44.000] That I could have brought the roommate in to testify and then that would have all been cleared up [36:44.000 --> 36:50.000] A suppression motion to suppress the evidence? [36:50.000 --> 36:52.000] I'm not sure what that meant [36:52.000 --> 36:58.000] Probably meant to suppress any testimony of this undisclosed witness [36:58.000 --> 37:02.000] Okay [37:02.000 --> 37:06.000] Then they couldn't establish probable cause [37:06.000 --> 37:09.000] Okay [37:09.000 --> 37:13.000] Well, does that kind of fall back under the public defender getting the discovery? [37:13.000 --> 37:18.000] Well, that goes to how they got in the apartment [37:18.000 --> 37:22.000] Yeah, the roommate let them in [37:22.000 --> 37:25.000] Who let them in? Did they say who let them in? [37:25.000 --> 37:29.000] Yes, the roommate let them in and they said that in court [37:29.000 --> 37:34.000] Did they then deny that the roommate was the witness? [37:34.000 --> 37:41.000] Yes, they said that he was an undisclosed confidential informant and they would not reveal the identity [37:41.000 --> 37:45.000] So then that would indicate that it wasn't the roommate [37:45.000 --> 37:47.000] Exactly [37:47.000 --> 37:50.000] Did they bring the roommate in to testify? [37:50.000 --> 37:56.000] No, and I pitched a fit and threw a tantrum but they still refused [37:56.000 --> 37:59.000] You make sure you bring the roommate in [37:59.000 --> 38:01.000] You subpoena the roommate [38:01.000 --> 38:03.000] Okay, and I'll do that through my public defender? [38:03.000 --> 38:04.000] Yes [38:04.000 --> 38:07.000] Okay, got it [38:07.000 --> 38:15.000] Okay, you've got enough time. Do it quickly. You want the subpoena out there and plenty of time to be served [38:15.000 --> 38:17.000] Okay [38:17.000 --> 38:20.000] Yeah, I've got about two months [38:20.000 --> 38:29.000] Good, that should be enough time. This time you have evidence to show that the property is not [38:29.000 --> 38:32.000] College property, not campus property [38:32.000 --> 38:37.000] Yeah, it's not campus property. I have the land title that says it's private property [38:37.000 --> 38:42.000] However, that is dated about two years after I was arrested [38:42.000 --> 38:49.000] And I know these people, they're immediately going to say, oh well two years ago it belonged to the campus [38:49.000 --> 38:52.000] Show evidence. You've got evidence that it doesn't [38:52.000 --> 38:53.000] Uh huh [38:53.000 --> 38:58.000] They're going to say that mine is two years too new. Just go look in the county record [38:58.000 --> 39:00.000] Okay, look in the county record [39:00.000 --> 39:01.000] Got it [39:01.000 --> 39:06.000] If there's a lease, if there is a sale of the property [39:06.000 --> 39:11.000] That's going to be in, that should be in the county record, that should be in the county recorder's office [39:11.000 --> 39:14.000] Got it, county recorder, okay [39:14.000 --> 39:22.000] Even if there was a lease, if it shows to be in the name of the same party over this period of time [39:22.000 --> 39:24.000] They can't claim it was campus property [39:24.000 --> 39:26.000] No [39:26.000 --> 39:29.000] Yeah, the land title does say it's private [39:29.000 --> 39:33.000] And it goes to objective reasonableness [39:33.000 --> 39:40.000] Objective reasonable person going into a private apartment complex [39:40.000 --> 39:45.000] Would have reason to believe this is a private apartment complex and not part of the university [39:45.000 --> 39:50.000] And if you could show that in fact it was a private apartment complex [39:50.000 --> 39:57.000] And not a part of the university, even if the university could lease a portion of it, it still belonged to them [39:57.000 --> 40:00.000] You had reason to believe it wasn't part of the university [40:00.000 --> 40:02.000] That should be more than enough [40:02.000 --> 40:04.000] Yeah, okay, got it [40:04.000 --> 40:13.000] Okay, the last thing is that I have quite a bit of evidence pointing that I never had a grand jury hearing [40:13.000 --> 40:18.000] And they're going to argue like that, like cats and dogs [40:18.000 --> 40:25.000] But you told me to go get the voucher from the comptroller, the comptroller of currency? [40:25.000 --> 40:33.000] Yeah, the county comptroller, the tax assessor, not the tax assessor, the collector [40:33.000 --> 40:41.000] The comptroller of the county, the one who does all of the books for the county and disperses all of the funds [40:41.000 --> 40:48.000] Okay, well can I read off three names to you which would sound like the best person to write this letter to? [40:48.000 --> 40:49.000] Yes [40:49.000 --> 40:57.000] Okay, Michelle Tutton, an inventory clerk and payroll clerk, maintains an inventory of all items purchased [40:57.000 --> 41:02.000] She makes sure all county employees are paid, does that sound like her? [48:52.000 --> 48:56.000] And they've already noticed that the landlord, that these repairs need to be done [48:56.000 --> 49:00.000] He addressed it, wrote to my letter back, said, give me a call [49:00.000 --> 49:03.000] I'll be glad if he speaks to the repairs, I want to make you happy [49:03.000 --> 49:09.000] Well, they called, he won't return their calls [49:09.000 --> 49:14.000] Okay, they cannot not pay the rent [49:14.000 --> 49:21.000] What they can do is go to the local JP and file a complaint against them [49:21.000 --> 49:26.000] That will get his attention [49:26.000 --> 49:33.000] But it won't, no matter how you slice this up, he's still going to wind up the landlord [49:33.000 --> 49:41.000] And unless they're prepared to have him do everything he can to get him out of the property [49:41.000 --> 49:45.000] They really need to handle this informatically [49:45.000 --> 49:54.000] Yes, well, the landlord happens to be the mayor in the neighboring town [49:54.000 --> 50:02.000] Oh, that changes everything [50:02.000 --> 50:08.000] Well, when they had called and he didn't return the call, this lady shows up, okay? [50:08.000 --> 50:12.000] This lady shows up and she doesn't know which house [50:12.000 --> 50:17.000] Because the way the house is run is very confusing, they live in front of me [50:17.000 --> 50:22.000] But it faces a railroad and that is another street address than from mine [50:22.000 --> 50:24.000] So it's sort of confusing [50:24.000 --> 50:27.000] So she doesn't know which house she's going to, right? [50:27.000 --> 50:31.000] So she's knocking on everybody's door trying to find this particular house [50:31.000 --> 50:34.000] To scream and yell at them [50:34.000 --> 50:38.000] But no one opens the door for her, I told them, I said, you don't have to open doors to nobody [50:38.000 --> 50:40.000] You don't know her [50:40.000 --> 50:47.000] You know, she doesn't exist because you have not been notified who she is, okay? [50:47.000 --> 51:00.000] Well, she finally told the neighbor below me, the other one, that they owe her, him, her, not him, $1,500 [51:00.000 --> 51:03.000] Two days later, she comes back, beating on the doors [51:03.000 --> 51:07.000] And I opened up the door because she's looking through everybody's mailboxes [51:07.000 --> 51:11.000] I said, excuse me, you know, and she said, can you see me? [51:11.000 --> 51:13.000] I said, yes, I can see you [51:13.000 --> 51:16.000] And she said, do you know so-and-so? [51:16.000 --> 51:18.000] And I said, no, I don't [51:18.000 --> 51:20.000] She said, you know where so-and-so is? [51:20.000 --> 51:23.000] I said, I have no idea how this house is run [51:23.000 --> 51:28.000] And she said, wait, if you see them, you tell them they owe me $1,800 [51:28.000 --> 51:32.000] I still have no idea who this woman is, okay? [51:32.000 --> 51:39.000] Well, anyway, the situation has escalated a little bit [51:39.000 --> 51:44.000] So now, after we sent them official first notice [51:44.000 --> 51:51.000] Because in the TNC codes, once you notice the landlords, they have to do something about it [51:51.000 --> 51:58.000] And at some point, if they don't, I don't know how we're going to enforce this [51:58.000 --> 52:07.000] But he's supposed to pay for them additional housing while they're working on this house, okay? [52:07.000 --> 52:13.000] Okay, if he's the mayor, get that done at the JP's office [52:13.000 --> 52:20.000] And when you go in, when they go in talking about suing the mayor [52:20.000 --> 52:23.000] You can bet the phone lines are going to line up [52:23.000 --> 52:29.000] So probably the best thing they could do is not really sue the mayor [52:29.000 --> 52:36.000] But go down to the city where the mayor is the mayor [52:36.000 --> 52:45.000] And ask a magistrate there, what do you do when you have a landlord who won't take care of property? [52:45.000 --> 52:49.000] How do you go about suing to get the landlord to take care of the property? [52:49.000 --> 52:54.000] And you can look in the property code for renter's rights [52:54.000 --> 52:57.000] Yes, I've done did that, okay? [52:57.000 --> 52:59.000] We've done sent you the codes and everything, okay? [52:59.000 --> 53:05.000] And it says that if he does not comply after he has been given a notice [53:05.000 --> 53:11.000] That they can withhold the rent without any problem [53:11.000 --> 53:13.000] Oh, you can in Tennessee? Okay, hold on, have you called the police and charged him with the trespass? [01:04:49.000 --> 01:04:59.000] Yes, and they are not investigating it because he has a special warranty deed, so they are saying it's a civil matter [01:04:59.000 --> 01:05:05.000] Okay, and they may be what? How did he get the warranty deed? [01:06:41.000 --> 01:06:54.000] The deed is faulty because the foreclosure was faulty, they had never, I'd actually never received any kind of, what is it, service [01:06:54.000 --> 01:07:01.000] And I've already gone through this with Bank of America and FHA saying that it was a fraudulent foreclosure [01:07:01.000 --> 01:07:11.000] I was, my, the foreclosure that was entered into the public record was one of the robo-signed foreclosures through David J. Stern [01:07:11.000 --> 01:07:19.000] And actually upon looking through the record, there were all kinds of like documents that were entered into the court record [01:07:19.000 --> 01:07:28.000] That were supposedly from me that weren't, like that I didn't submit to the court, somebody submitted, you know, on my behalf [01:07:28.000 --> 01:07:32.000] Okay [01:07:32.000 --> 01:07:41.000] Then the remedy for this issue is a quiet title action against the substitute trustee's deed [01:07:41.000 --> 01:07:46.000] Now, they may call it something different in Florida [01:07:46.000 --> 01:07:54.000] In Texas, we have a quiet title action, and we have a trespassed tri-title action [01:07:54.000 --> 01:08:01.000] If this were Texas, the remedy of choice would be trespass to tri-title [01:08:01.000 --> 01:08:12.000] Because there is a title in the record, you have to challenge that title and show that your title is more valid than that title [01:08:12.000 --> 01:08:21.000] And you do that by showing that the process to get to that title was flawed [01:08:21.000 --> 01:08:26.000] It's hard for me, you know, I can spend quite a bit of time here [01:08:26.000 --> 01:08:35.000] Have you went down to the county recorder's office and pulled all of the documents filed with the county recorder's office [01:08:35.000 --> 01:08:41.000] Since the date you received the warranted deed to the property? He said yes I did [01:36:53.000 --> 01:37:00.000] He didn't really say anything but still, you know, he said well we reject your motion to dismiss so we're going to go to trial [01:37:00.000 --> 01:37:04.000] So I was just wondering what exactly she should do next [01:37:04.000 --> 01:37:16.000] That, okay, that goes to appeal, traffic court is the most corrupt of all the courts [01:37:16.000 --> 01:37:25.000] And it is the best place to actually get your best education [01:37:25.000 --> 01:37:30.000] Since the, did the prosecutor give her proper notice? [01:51:04.000 --> 01:51:11.000] Then once you run out of being able to hold these guys off, then go out and buy a property [01:51:11.000 --> 01:51:14.000] How good is your credit? [01:52:42.000 --> 01:52:49.000] In a previous show, you said the RESPA and debt validation letters [01:52:49.000 --> 01:52:56.000] I'm not sure about the debt validation letter, but I remember you saying the RESPA was only good for approximately three years [01:52:56.000 --> 01:52:59.000] Yeah, one, two, three years [01:52:59.000 --> 01:53:08.000] Limitations, so it's, whole potato RESPA is not of any real value in and of itself [01:53:08.000 --> 01:53:25.000] However, if they violated whole potato RESPA, then during breach of covenant, generally it's covenant 16 of the Debt of Trust [01:53:25.000 --> 01:53:27.000] And that's what we look for [01:53:27.000 --> 01:53:43.000] I want to look for if USAA negotiated the beneficial interest from the note into a investment [01:53:43.000 --> 01:53:48.000] And didn't give you notice of that change of beneficial interest [01:53:48.000 --> 01:53:55.000] Then they breached the Reader-State Federal Procedures Act reporting requirement [01:53:55.000 --> 01:54:04.000] Well, you don't claim the remedy provided by the legislature when they passed the Consumer Protection Laws [01:54:04.000 --> 01:54:09.000] You claim the remedy provided in contract law from breach of contract [01:54:09.000 --> 01:54:15.000] Because they breached the governing law and servility clause of contract [01:54:15.000 --> 01:54:25.000] Now they can't come back and claim the privileges in the contract once they've reached the covenants of the contract [01:54:25.000 --> 01:54:27.000] Does that make sense? [01:54:27.000 --> 01:54:30.000] Yes, yes it does [01:54:30.000 --> 01:54:42.000] Find any new regulation law, one of the things we can always look at, in 2009 and after that they got a lot more careful [01:54:42.000 --> 01:54:46.000] So they don't leave as many breadcrumbs around [01:54:46.000 --> 01:55:04.000] So when I do an evaluation of a set of documentation, if I can't find any reporting issues or any failures to properly record [01:55:04.000 --> 01:55:12.000] If everything else fails, then you pull out the good old trusty HUD-1 settlement statement [01:55:12.000 --> 01:55:17.000] And look at the fees on the settlement statement [01:55:17.000 --> 01:55:29.000] Every time I have pulled out the HUD-1 settlement statement for someone who was in foreclosure but had been in the mortgage industry [01:55:29.000 --> 01:55:39.000] And I said, they always file fraudulent fees to the HUD-1 [01:55:39.000 --> 01:55:42.000] So we go after them for road ash fees [01:55:42.000 --> 01:55:50.000] Everybody I've told that to who was in the industry told me, don't you dare put that in there [01:55:50.000 --> 01:55:55.000] Because they knew full well I was right [01:55:55.000 --> 01:56:06.000] And if I put that in there they were afraid it might implicate them when they have done it to other people [01:56:06.000 --> 01:56:13.000] Every one of these has fraudulent fees, it's just an industry standard [01:56:13.000 --> 01:56:19.000] Not only are there fees in there for services that were never rendered [01:56:19.000 --> 01:56:31.000] There are fees charged to the principal for amounts that are forbidden to be charged to the principal [01:56:31.000 --> 01:56:36.000] It's intended that that's a part of the normal part of doing business [01:56:36.000 --> 01:56:42.000] And that's intended to be taken out of the interest that they receive on the payments you make [01:56:42.000 --> 01:56:49.000] But instead of taking it out of the interest, they add it to the principal charge interest on it for 30 years [01:56:49.000 --> 01:57:03.000] So if we can't get anything out of the sailor to property record documentation, we can always get that one [01:57:03.000 --> 01:57:06.000] And that one will keep me in court for a long time [01:57:06.000 --> 01:57:13.000] I've never ever had a bank prove up a single fee [01:57:13.000 --> 01:57:20.000] We say you found all these fees are closing, but you didn't provide any documentation to show that they were authorized to be charged by law [01:57:20.000 --> 01:57:28.000] For services actually rendered, that the fees charged were reasonable, that the services were necessary [01:57:28.000 --> 01:57:34.000] And if you didn't take an undisclosed markup on the fees charged, on the fees that were charged [01:57:34.000 --> 01:57:38.000] All of that goes to the U.S. Federal Procedures Act violation [01:57:38.000 --> 01:57:41.000] So prove them all up, we think they're all bogus [01:57:41.000 --> 01:57:44.000] Most of them are not bogus [01:57:44.000 --> 01:57:47.000] They've never proved up a single one, and they never will [01:57:47.000 --> 01:57:55.000] Because if they prove up one, and they don't prove up them all, then that would be the adverse consequence [01:57:55.000 --> 01:57:59.000] It is coverage, that's what we said to them [01:57:59.000 --> 01:58:01.000]
