[05:48.000 --> 05:55.240] I'm getting really, I don't know, it just seems to me like nobody actually cares about [05:55.240 --> 06:02.480] knowing what to do with their rights and how to behave until after it's too late. [06:02.480 --> 06:05.720] I want to repeat something I said on a prior show. [06:05.720 --> 06:12.000] The suicide hotline does you absolutely no good after you've stuck the gun in your mouth [06:12.000 --> 06:14.280] and pulled the trigger. [06:14.280 --> 06:19.280] If you're not prepared to deal with what comes down the pike during a stop or an encounter [06:19.280 --> 06:26.480] with the police, you will do the wrong thing, and that will hurt you in trying to defend [06:26.480 --> 06:28.280] yourself later. [06:28.280 --> 06:33.560] If you don't know what to do, then that's the whole reason these classes exist. [06:33.560 --> 06:38.520] If you think you know what to do and you call me and I look at you and go, no, that was [06:38.520 --> 06:45.120] definitely the wrong thing to do, then these classes were meant for you to attend. [06:45.120 --> 06:49.760] Freedom only works if you're willing to exercise the effort to be free. [06:49.760 --> 06:55.760] In order to do that, you have to know how to be free because your indoctrination has [06:55.760 --> 07:01.960] left you with the mindset that you are free when you aren't. [07:01.960 --> 07:07.760] You are trapped inside your own delusions of what freedom is versus what it isn't. [07:07.760 --> 07:11.760] You think just because you're free to walk out your front door and go somewhere, you're [07:11.760 --> 07:12.760] free. [07:12.760 --> 07:14.600] No, you're not. [07:14.600 --> 07:19.840] Because every time you try to go somewhere, you're paying your government for the privilege [07:19.840 --> 07:25.320] to do whatever it is you're doing, get in your car, travel to the mall. [07:25.320 --> 07:27.800] You name it, you're paying for it. [07:27.800 --> 07:29.120] You're not really free. [07:29.120 --> 07:35.480] You're buying their control and consent. [07:35.480 --> 07:41.080] If you don't realize that, you definitely need to be coming to the class. [07:41.080 --> 07:49.440] That being said, this is why I want to talk about what we did in class yesterday. [07:49.440 --> 07:57.000] First off, many people including the current judiciary and lawyers that do the actual work [07:57.000 --> 08:06.240] absolutely do not understand the long settled law and method of how to read, understand [08:06.240 --> 08:09.320] and interpret statute. [08:09.320 --> 08:18.000] I have a real problem with the word interpret in relation to how it's being done. [08:18.000 --> 08:26.360] This whole subject that we talked about yesterday involves and revolves around or evolves around [08:26.360 --> 08:31.040] exactly that term, interpret. [08:31.040 --> 08:35.960] The way their courts are doing it, they've set themselves these little canons of statutory [08:35.960 --> 08:36.960] interpretation. [08:36.960 --> 08:44.480] One of the canons is that all words in the statute will be given their most common meaning [08:44.480 --> 08:48.280] unless the statute defines it otherwise. [08:48.280 --> 08:55.360] My rule of thumb on that is if the statute does define it, then it absolutely is not [08:55.360 --> 09:00.600] being used in its common meaning every single time. [09:00.600 --> 09:05.360] Because if it were, the statute would not have to create a separate, distinct definition [09:05.360 --> 09:07.520] for it. [09:07.520 --> 09:15.480] Their second thing is, is that all statutes shall be interpreted in any way necessary [09:15.480 --> 09:20.160] to construe the statute as being constitutional. [09:20.160 --> 09:25.040] Even if the whole reason they're having to argue about it is because someone has declared [09:25.040 --> 09:29.960] it to be unconstitutional and wants the court to show it. [09:29.960 --> 09:32.200] They're being petitioned to do that. [09:32.200 --> 09:37.320] They have created this little thing that we will always presume that every act of the [09:37.320 --> 09:46.240] legislature is absolutely constitutional until proven otherwise. [09:46.240 --> 09:54.120] The other part of that is, is that their interpretation, when they interpret it under those conditions, [09:54.120 --> 10:00.520] that the interpretation cannot go outside of the alleged intent of the legislature and [10:00.520 --> 10:07.920] that the interpretation cannot have a ridiculous or impossible outcome. [10:07.920 --> 10:14.320] They cannot interpret the law to create a statutory or legal impossibility, nor can [10:14.320 --> 10:22.080] they create a ridiculous or unlawful conclusion, and yet they do it all the time, which means [10:22.080 --> 10:30.200] their canons of interpretation are as seriously flawed as their sense of reason. [10:30.200 --> 10:31.960] That's not the real heart of the matter here. [10:31.960 --> 10:39.960] The heart of the matter is, is the ridiculous and impossible outcomes of these canons when [10:39.960 --> 10:40.960] they use them. [10:40.960 --> 10:49.080] I'm going to give you exactly one of those examples using the Texas Constitution. [10:49.080 --> 10:55.000] The Texas Constitution has been amended so many times that calling it an original 1876 [10:55.000 --> 11:02.000] is ridiculously insane because it's nowhere near original. [11:02.000 --> 11:11.920] Now Article 1, Section 10 is one of the places where they've... The last amendment shown [11:11.920 --> 11:19.880] in the online version shows this was last amended in November 5th of 1918, and allegedly [11:19.880 --> 11:28.120] in that revision, one of the things they did was to remove the requirement that a grand [11:28.120 --> 11:33.400] jury indictment be had for anything other than a felony. [11:33.400 --> 11:37.200] Now why do I say anything other than a felony? [11:37.200 --> 11:43.000] Well, this is the way it reads, what they amended it from. [11:43.000 --> 11:48.440] Okay, let me find where this actually begins. [11:48.440 --> 11:52.520] He shall not be compelled to give evidence against himself and shall have the right of [11:52.520 --> 11:57.320] being heard by himself or counsel or both, shall be confronted by the witnesses against [11:57.320 --> 12:02.160] him and shall have compulsory process for obtaining witnesses in his favor, except that [12:02.160 --> 12:06.360] when the witnesses resides out of the state and the offense charges a violation of any [12:06.360 --> 12:10.920] of the antitrust laws of this state, the defendant in the state shall have the right to produce [12:10.920 --> 12:15.680] and have the evidence admitted by deposition under such rules and laws as the legislature [12:15.680 --> 12:17.680] may hereafter provide. [12:17.680 --> 12:22.600] Now right here in this particular section we have one problem, the courts have created [12:22.600 --> 12:31.080] a canon or a doctrine that says you cannot both represent yourself and have representative [12:31.080 --> 12:32.760] counsel. [12:32.760 --> 12:38.360] That Texas law does not allow that, well that's stupid, why? [12:38.360 --> 12:45.160] Because right here it clearly says the right of being heard by himself or counsel or both. [12:45.160 --> 12:50.160] So right off the bat that doctrine is unconstitutional on its face. [12:50.160 --> 12:52.280] But let's continue. [12:52.280 --> 12:58.960] And no person shall be held to answer for a criminal offense unless on an indictment [12:58.960 --> 13:00.640] of a grand jury. [13:00.640 --> 13:10.480] And here's the amendment, except in cases in which the punishment is by fine or imprisonment [13:10.480 --> 13:18.360] otherwise than in the penitentiary in cases of impeachment and in cases arising in the [13:18.360 --> 13:24.720] army or navy or in the militia when in actual service in time of war or public danger. [13:24.720 --> 13:30.880] Okay, unless an indictment of a grand jury except in cases in which the punishment is [13:30.880 --> 13:38.360] by fine or imprisonment, get this, they can lock you up without a grand jury indictment [13:38.360 --> 13:45.640] as long as they're incarcerating you in some place other than in the penitentiary. [13:45.640 --> 13:50.040] Now the penitentiary is a state run facility. [13:50.040 --> 13:57.960] Most all right now, all misdemeanor offenses are incarcerated in the county jails. [13:57.960 --> 14:03.120] They're never sent to the penitentiary, only felonies are sent to the penitentiary. [14:03.120 --> 14:11.120] That's my statement, you're not entitled to a grand jury indictment under this amendment [14:11.120 --> 14:14.280] except in the case of a felony. [14:14.280 --> 14:16.720] Now you might say, well, what's the big deal? [14:16.720 --> 14:18.480] Why is that a problem? [14:18.480 --> 14:25.400] Well, the problem is how this statutory or constitutional interpretation rule affects [14:25.400 --> 14:30.840] this amendment in relation to other provisions of the Texas constitution. [14:30.840 --> 14:41.200] And what I mean by that is this, they've created this amendment which has a conflict with another [14:41.200 --> 14:43.400] part of the Texas constitution. [14:43.400 --> 14:50.560] Well, one of the other rules of statutory interpretation is that when provisions of [14:50.560 --> 14:59.080] a statute or the constitution conflict with each other or with another statute or part [14:59.080 --> 15:06.400] of the constitution, then the most recent change shall be given precedent and control [15:06.400 --> 15:09.600] the outcome of the interpretation. [15:09.600 --> 15:16.720] So here is why that is a huge problem. [15:16.720 --> 15:24.360] Now how many people would agree that it's okay to amend something as long as the people [15:24.360 --> 15:32.880] have a voice in amending it and that only those things intended to be amended by the [15:32.880 --> 15:38.600] recommendation are the things that are amended with the people's knowledge and consent? [15:38.600 --> 15:46.240] In other words, they can't amend something without asking us and that amendment has to [15:46.240 --> 15:51.000] be made known as to what its intended effect is so that we know whether or not agreeing [15:51.000 --> 15:53.920] to it's a good or bad thing. [15:53.920 --> 15:59.320] They can't amend our constitution without our consent, people. [15:59.320 --> 16:02.160] So why am I raising that as an issue? [16:02.160 --> 16:08.560] Well, I'm raising that as an issue because the unintended but direct effect of that method [16:08.560 --> 16:15.600] of interpretation actually creates what I'm referring to as a cascading change of amendments [16:15.600 --> 16:19.240] to an entire body of law. [16:19.240 --> 16:24.120] Rather than the amendment being limited to the one thing that was mentioned, discussed, [16:24.120 --> 16:32.720] and is being done, it has the effect of actually changing other parts of the law simply because [16:32.720 --> 16:39.440] of that method of interpretation that the newest part controls all the other parts. [16:39.440 --> 16:43.520] So we're going to take a break and on the other side I'm going to point out that conflict [16:43.520 --> 16:50.160] and I'm going to explain to you why that problem should not be allowed to continue to exist [16:50.160 --> 16:52.360] and that rule be kicked out. [19:36.520 --> 19:43.720] Now, as I was saying, we're going to see why this method of interpretation and how the [19:43.720 --> 19:51.640] newest iteration of an amendment to any statute or the Constitution is allowed to be controlling [19:51.640 --> 19:57.200] over any other areas that deal with the same subject. [19:57.200 --> 20:01.940] As we said, this right here, this amendment to Article 1, Section 10 of the Bill of Rights [20:01.940 --> 20:08.560] specifically eliminated the requirement that before you could be charged with a crime, [20:08.560 --> 20:12.860] that there had to be a grand jury indictment. [20:12.860 --> 20:18.400] They eliminated that requirement so that they could incarcerate you in anything below a [20:18.400 --> 20:26.440] state penitentiary for up to a year and not have to get a grand jury's approval of there [20:26.440 --> 20:32.240] even being a crime that merited a trial in the first place. [20:32.240 --> 20:36.600] Now, you want to talk about subverting due process. [20:36.600 --> 20:38.960] That's what this amendment here did. [20:38.960 --> 20:43.380] But let's see what else it subverted and how it did it. [20:43.380 --> 20:52.800] If we go to Article 5, Section 17 of the Texas Constitution, which is the judicial article [20:52.800 --> 21:01.440] that deals with the judicial branch of government, and we read Section 17, we go to the second [21:01.440 --> 21:08.040] sentence and this is what it reads, grand juries impaneled in the district courts shall [21:08.040 --> 21:16.240] inquire into misdemeanors and all indictments therefore returned into the district courts [21:16.240 --> 21:25.280] shall forthwith be certified to the county courts or other inferior courts having jurisdiction [21:25.280 --> 21:28.880] to try them for trial. [21:28.880 --> 21:36.900] Now does anyone other than me see the problem with those two provisions? [21:36.900 --> 21:42.240] You have the Bill of Rights portion saying you don't have a right to a grand jury indictment [21:42.240 --> 21:48.240] for anything other than a felony and then you have Section 17 right here that says the [21:48.240 --> 21:55.800] duty of the grand jury is not only to investigate a misdemeanor but to also hand down an indictment [21:55.800 --> 21:59.880] before a prosecution can take place. [21:59.880 --> 22:08.560] But according to the rules of statutory interpretation used by the courts, Article 5, Section 17 [22:08.560 --> 22:17.920] was amended by Article 1, Section 10 to remove this duty of the grand jury. [22:17.920 --> 22:21.040] How can that be? [22:21.040 --> 22:25.960] The people never voted on a change to Article 5, Section 17. [22:25.960 --> 22:31.920] The people never approved the removal of the grand jury from the process of investigating [22:31.920 --> 22:37.560] misdemeanors according to Article 5, Section 17. [22:37.560 --> 22:44.040] So how can Article 1, Section 10 be controlling over a completely separate part of the Texas [22:44.040 --> 22:52.340] Constitution and surreptitiously amend it in a way that removed and altered everything [22:52.340 --> 22:57.680] about that provision? [22:57.680 --> 23:02.080] How can that happen? [23:02.080 --> 23:07.120] And if you challenge it in court, I guarantee you what they're going to do is run home [23:07.120 --> 23:16.800] to mama and start screaming, statutory interpretation rule, latest change controls it all. [23:16.800 --> 23:18.920] It's fraud, people. [23:18.920 --> 23:21.700] It's judicial fraud. [23:21.700 --> 23:24.640] It's legislative fraud. [23:24.640 --> 23:30.400] It's a fraud upon we the people who set down the rules and then when these guys didn't [23:30.400 --> 23:36.080] like them, went out looking for ways to amend the protections so they could gain control [23:36.080 --> 23:45.240] over our lives with these illegal non-indictment convictions for non-freaking crimes. [23:45.240 --> 23:51.360] Crimes without victims, crimes without evidence, crimes without proof of any kind, you can [23:51.360 --> 23:57.040] now go to jail because of plea bargains and the fact that the grand jury never gets to [23:57.040 --> 24:02.200] look at the so-called evidence to see whether or not you should have ever been taken to [24:02.200 --> 24:07.600] trial in the first place. [24:07.600 --> 24:13.440] And I hate to point fingers at the guys in class yesterday, but it really, really bothered [24:13.440 --> 24:18.140] me when I asked a question and all I got was blank stares. [24:18.140 --> 24:25.040] The question was very simply, how many of you have actually read these parts of the [24:25.040 --> 24:26.040] Texas Constitution? [24:26.040 --> 24:30.120] Now, the part that bothered me was a couple of these guys have been coming to class for [24:30.120 --> 24:33.280] a very long time. [24:33.280 --> 24:40.040] And I know everybody's got work and everybody's busy and all that stuff, but geez Louise folks, [24:40.040 --> 24:44.480] you're talking about the things that are used to take control of your life and take it away [24:44.480 --> 24:46.920] from you. [24:46.920 --> 24:52.280] And you act like it doesn't matter because you won't learn what the limitations on the [24:52.280 --> 24:56.800] authority to even do it actually are. [24:56.800 --> 24:58.680] And that bothers me. [24:58.680 --> 25:03.560] What the hell are we even doing here trying to bring you this information and provide [25:03.560 --> 25:10.640] you with the knowledge to use it properly and you won't even take the time for yourselves [25:10.640 --> 25:18.880] to look at it. [25:18.880 --> 25:26.360] It really, really makes me wonder what the hell I'm doing here. [25:26.360 --> 25:31.640] I can guarantee you the powers that be that are trying to rob you of your freedom and [25:31.640 --> 25:34.440] your liberty haven't read this. [25:34.440 --> 25:40.760] And if they have, they've chosen to ignore it, distort it, mutate it, corrupt it and [25:40.760 --> 25:47.200] whatever it takes to keep the power in their hands and not in ours. [25:47.200 --> 25:58.640] And yet nobody is taking the effort to heart to become knowledgeable and skillful and telling [25:58.640 --> 26:01.840] them, I'm sorry, it doesn't work that way. [26:01.840 --> 26:08.320] It can't work that way because by one of your own rules of interpretation, you have created [26:08.320 --> 26:12.960] a ridiculous or impossible outcome. [35:53.960 --> 35:58.400] Why are you cutting deals with these other folks and not looking out for our best interests [35:58.400 --> 36:05.040] when you pass these idiotic laws that deprive us of what should be a common everyday right? [36:07.160 --> 36:11.920] And the bigger you can make those groups or the more of them you can organize to pay visits [36:11.920 --> 36:16.220] to their office and say, hey, see that nice oak tree outside your window there? [36:20.760 --> 36:25.360] You know, just general stuff like that where they get the idea we are not at all pleased [36:25.360 --> 36:30.560] and if you come back here with another disappointing representation of our will and our liberty [36:30.560 --> 36:36.040] and freedom, then we're going to try to do our best to remove yours to act on our behalf [36:36.040 --> 36:42.040] and to punish you for it when we get control and create laws that make you the criminal. [36:46.280 --> 36:50.480] I mean, we really, if there was ever to be a constitutional convention that needs to [36:50.480 --> 36:54.600] start in your state level and it needs to start with the people of that state, not its [36:54.600 --> 36:59.240] legislature or its other so-called representatives, then we need to write. [36:59.240 --> 37:05.640] I have yet to see a single constitution in any state whatsoever that actually has punitive [37:05.640 --> 37:10.120] provisions for the public servants that violate it. [37:10.120 --> 37:13.120] That needs to change. [37:13.120 --> 37:17.720] It needs to be written right into the constitution that a public servant that fails to adhere [37:17.720 --> 37:23.720] to their oath to uphold it in every single provision and to abide by it in its strict [37:23.720 --> 37:28.640] disconstruction for the rights of the people is considered to be committing sedition or [37:28.640 --> 37:34.120] treason and shall be arrestable upon sight by any citizen making that claim. [37:34.120 --> 37:35.920] I wholly agree with that. [37:35.920 --> 37:41.080] That, to me, makes the most logical sense and I get so aggravated when you see all this [37:41.080 --> 37:45.240] going on and you just come to think, well, there's nothing really you can do about it. [37:45.240 --> 37:47.120] It's just the way the system is, quote unquote. [37:47.120 --> 37:50.000] Well, the thing is, is that is exactly the point. [37:50.000 --> 37:52.080] That's how the system is. [37:52.080 --> 37:54.240] It's not the system we set up. [37:54.240 --> 38:00.000] It's the one they've created behind our backs and created solely for their benefit and not [38:00.000 --> 38:01.000] ours. [38:30.040 --> 38:35.160] I think that it is definitely possible and the more and the harder and the swifter and [38:35.160 --> 38:39.920] the more fronts that we attack on, or not attack, but address, then the better, the [38:39.920 --> 38:45.680] quicker, and ultimately the better quality of life will come of it. [38:45.680 --> 38:49.880] Well, that's my hope and my goal. [38:49.880 --> 38:55.560] Whether or not we will get there without an actual revolution, well, that really depends [38:55.560 --> 39:00.200] on whether or not the people actually wake up in enough numbers to make that happen. [39:00.200 --> 39:08.000] But as long as it's only a few having to resist the complacency of the many against the other [39:08.000 --> 39:14.680] many that have seized control of everything else, then I don't see how that's going to [39:14.680 --> 39:15.680] be possible. [39:16.680 --> 39:27.160] Well, let me ask you this, what is a manner, or what is something that may be comforting, [39:27.160 --> 39:34.080] because maybe the lack of exercising or coming to action is a fear of retribution, because [39:34.080 --> 39:38.240] we all heard these stories about, well, they got to act if they did this, and all of a [39:38.240 --> 39:42.520] sudden the IRS is knee deep, and all these other people are harassing them. [39:42.520 --> 39:50.480] Is there anything that you can think of that would create a safer feeling, I guess, that [39:50.480 --> 39:56.240] if you do exercise this and you do bring up protests to this outrageous, egregious activity, [39:56.240 --> 39:59.560] that you're not going to be too concerned that your life's going to get turned upside [39:59.560 --> 40:00.560] down? [40:00.560 --> 40:04.400] The only way that's going to happen is mass education of the people that are going to [40:04.400 --> 40:07.680] wind up on the juries they try to throw you in front of. [40:07.680 --> 40:11.600] When the jury says not guilty, that's the end of it. [40:11.600 --> 40:16.800] But if they try to circumvent the jury, then they are calling for us to become violent [40:16.800 --> 40:22.880] and start a revolution, because they are now fully intent on removing the rule of law and [40:22.880 --> 40:27.280] the rights of the people, regardless of what the jury does. [40:27.280 --> 40:33.280] That's our last bastion of defense against what they're doing, is that jury, an educated [40:33.280 --> 40:39.120] jury that knows that they can say that's not right and say we're not going to find them [40:39.120 --> 40:45.800] guilty and then declare them not guilty, that would put a crimp in it, because then no matter [40:45.800 --> 40:51.240] what the government tried to do, they cannot get that conviction in court. [40:51.240 --> 40:55.680] And then if we also have people knowledgeable on the juries and the grand juries, when a [40:55.680 --> 41:01.940] citizen comes in, or an individual, since some people hate the word citizen, but when [41:01.940 --> 41:07.480] we come in and say, look, this public servant committed a crime, they did this, they did [41:07.480 --> 41:13.280] this, and here's the evidence and the information relating to it, give them an indictment, and [41:13.280 --> 41:15.520] the grand jury actually does so. [41:15.520 --> 41:20.600] And then educated people sit on the actual jury at trial and says, you know what? [41:20.600 --> 41:25.440] You committed a crime against a fellow human being and used the power of your office to [41:25.440 --> 41:26.840] do them harm. [41:26.840 --> 41:31.880] You're going to pay for that and send their butt to prison. [41:31.880 --> 41:37.440] Education of the masses is the answer to your question, it's the only answer to your question [41:37.440 --> 41:39.640] short of brass and lead. [49:20.120 --> 49:24.880] So what I did was I wrote, not sign volunteer, I asked through all the guilty and not guilty [49:24.880 --> 49:27.640] and wrote being ordered under threat of contempt to sign it, you know. [49:27.640 --> 49:31.120] In other words, I took a chance because she could have had me thrown in jail for contempt [49:31.120 --> 49:32.400] and what could I do to her? [49:32.400 --> 49:35.520] You could sue her because that's way outside of her jurisdiction. [49:35.520 --> 49:36.520] Yeah, yeah. [49:36.520 --> 49:40.000] I mean, that's a possibility, but it would take a long battle. [49:40.000 --> 49:41.000] We both know that. [49:41.000 --> 49:45.360] It always would, but you could also move to have her sanctioned because there is nothing [49:45.360 --> 49:51.320] in law that mandates the entering of a plea, as you probably well know, and there's nothing [49:51.320 --> 49:55.680] that grants the authority of a judge to hold you in contempt for refusing to do so. [49:57.440 --> 50:00.600] It was a line that she didn't feel like crossing, but I guarantee you, you know, they have the [50:00.600 --> 50:05.280] cops in there, especially if they know you and they think that you're less than cooperative. [50:05.280 --> 50:07.720] Sometimes they'll have two or three of them in there and they're standing there with one [50:07.720 --> 50:10.560] hand on a nightstick and the other hand on the page, they're glaring at you. [50:10.560 --> 50:13.440] You're just waiting for the judge to tell them to attack you. [50:13.440 --> 50:16.760] Oh yeah, I agree. [50:16.760 --> 50:21.280] But anyway, this was a visiting judge and I happened to talk to this prosecutor and I [50:21.280 --> 50:26.520] said, was there an assignment by the presiding judge of this region? [50:26.520 --> 50:29.320] And he said, well, no, no, not really, but we'd have to reschedule and all that. [50:29.320 --> 50:33.400] I said, well, just let it go, you know, but that's the kind of Mickey Mouse stuff they [50:33.400 --> 50:34.400] do. [50:34.400 --> 50:35.400] Somebody wanted a day off. [50:35.400 --> 50:38.920] They phoned the judge, said, come in and take my place with no paperwork, no legality, [50:38.920 --> 50:39.920] no nothing. [50:39.920 --> 50:40.920] Okay. [50:40.920 --> 50:44.720] And I sat through, you know, the first thing they do is tell everybody you're required [50:44.720 --> 50:45.720] to plead. [50:45.720 --> 50:47.520] These people don't even have complaints filed against them. [50:47.520 --> 50:51.000] The whole room is full of ignorant people and the courts tell them repeatedly, you must [50:51.000 --> 50:54.600] enter a plea of guilty, not guilty, no contest. [50:58.880 --> 51:04.880] That right there should be grounds for dismissal for being completely inept and incompetent [51:04.880 --> 51:06.720] in your judicial function. [53:23.200 --> 53:28.120] After I got out of prison, my appeals attorney had already written my brief. [53:28.120 --> 53:33.480] I get out of jail and go to city hall and I get the land title and the land title says [53:33.480 --> 53:35.080] private property. [53:35.080 --> 53:41.240] I also get a letter from the clerk of the court that says that there are no transcripts [53:41.240 --> 53:46.600] for the grand jury, which as far as I'm concerned, that means they never had a grand jury hearing. [53:46.600 --> 53:52.520] I then turned around and tried to get my appeals attorney to file that in my case and she is [53:52.520 --> 53:53.520] refusing. [53:53.520 --> 54:00.040] She wrote me a letter saying that she will not file those papers in my case, that I could [54:00.040 --> 54:02.160] file them if I wanted to. [54:02.160 --> 54:07.000] Yeah, because she knows full well that as long as you're represented by counsel, the [54:07.000 --> 54:09.440] court will never look at anything you file. [54:09.440 --> 54:15.600] Thus, she is well aware of the fact that once you file it, she can ask to be removed and [54:15.600 --> 54:17.640] not be responsible. [54:17.640 --> 54:18.640] Okay. [01:04:33.440 --> 01:04:38.880] Well, what I had noticed is they were using the evidence that they were using to prosecute [01:04:38.880 --> 01:04:47.720] me and other people did not have the timestamp, location, and the other requirements required [01:04:47.720 --> 01:04:51.960] to be a piece of actual evidence. [01:04:51.960 --> 01:04:56.940] And so I argued that and of course they disagreed with me. [01:04:56.940 --> 01:05:04.440] And when I told them that that was a falsely produced videotape and that you're trying [01:05:04.440 --> 01:05:11.320] to prosecute people without the proper requirements of the statute, they basically told me to [01:05:11.320 --> 01:05:12.320] go sit down. [01:05:12.320 --> 01:05:15.000] They didn't want the other people to hear that. [01:05:15.000 --> 01:05:16.000] Yeah, exactly. [01:05:16.000 --> 01:05:19.320] And they waited to adjudicate my case until the end. [01:05:42.700 --> 01:05:47.000] And when he started talking and when I'd say I disrespect, we disagree, and this is why [01:05:47.000 --> 01:05:50.200] he said to shut up or I'll have them arrest you. [01:06:11.560 --> 01:06:17.080] And I even asked the clerk, you know, before it started, I'd like to see the bar card. [01:49:30.960 --> 01:49:35.200] This is an administrative hearing, even though they're telling you it's not, it is, because [01:49:35.200 --> 01:49:39.960] this is not a judicial officer sitting up there, and you're not entitled to a jury trial. [01:49:39.960 --> 01:49:45.160] Therefore, it's not a judicial proceeding, and there is a rule of thumb, an axiom of [01:49:45.160 --> 01:49:53.360] law that says that they cannot convict you based upon irrebuttable presumptions. [01:49:53.360 --> 01:49:55.840] A presumption is exactly that. [01:49:55.840 --> 01:50:02.960] It is presumed to be true until it is proven not to be true, and you cannot say the presumption [01:50:02.960 --> 01:50:08.600] is it's true, and you never have the opportunity to say, here's why it's not. [01:50:08.600 --> 01:50:11.520] It's an irrebuttable presumption, and it is forbidden. [01:50:11.520 --> 01:50:19.560] Right, if they don't tell you that, they used everything against you, wouldn't it be proper [01:50:19.560 --> 01:50:26.360] to put the hearing officer, you know, to kind of point the law at him and say, are you intending [01:50:26.360 --> 01:50:31.680] to punish me if I exercise a constitutionally protected right? [01:50:31.680 --> 01:50:35.600] The hearing officer also threatened him, that if you do that, I'm going to fine you in contempt. [01:50:35.600 --> 01:50:36.880] Well, you just threatened me.
