[05:38.160 --> 05:44.800] For the last several weeks, meaning actually several months, the class has been three or [05:44.800 --> 05:48.000] four people tops every Sunday. [05:48.000 --> 05:55.200] I'm getting really, I don't know, it just seems to me like nobody actually cares about [05:55.200 --> 06:02.400] knowing what to do with their rights and how to behave until after it's too late. [06:02.400 --> 06:05.680] I want to repeat something I said on a prior show. [06:05.680 --> 06:11.960] The suicide hotline does you absolutely no good after you've stuck the gun in your mouth [06:11.960 --> 06:14.200] and pull the trigger. [06:14.200 --> 06:19.240] If you're not prepared to deal with what comes down the pipe during a stop or an encounter [06:19.240 --> 06:26.400] with the police, you will do the wrong thing and that will hurt you in trying to defend [06:26.400 --> 06:28.200] yourself later. [06:28.200 --> 06:33.480] If you don't know what to do, then that's the whole reason these classes exist. [06:33.480 --> 06:38.440] If you think you know what to do and you call me and I look at you and go, no, that was [06:38.440 --> 06:40.400] definitely the wrong thing to do. [06:40.400 --> 06:45.060] Then these classes were meant for you to attend. [06:45.060 --> 06:49.600] Freedom only works if you're willing to exercise the effort to be free. [06:49.600 --> 06:55.480] And in order to do that, you have to know how to be free because your indoctrination [06:55.480 --> 07:01.640] has left you with the mindset that you are free when you aren't. [07:01.640 --> 07:07.640] So you are trapped inside your own delusions of what freedom is versus what it isn't. [07:07.640 --> 07:11.640] You think just because you're free to walk out your front door and go somewhere, you're [07:11.640 --> 07:12.640] free. [07:12.640 --> 07:14.440] No, you're not. [07:14.440 --> 07:19.680] Because every time you try to go somewhere, you're paying your government for the privilege [07:19.680 --> 07:22.240] to do whatever it is you're doing. [07:22.240 --> 07:27.640] Get in your car, travel to the mall, you name it, you're paying for it. [07:27.640 --> 07:28.960] You're not really free. [07:28.960 --> 07:35.160] You're buying their control and consent. [07:35.160 --> 07:40.160] And if you don't realize that, you definitely need to be coming to the class. [07:40.160 --> 07:49.320] Now, that being said, this is why I want to talk about what we did in class yesterday. [07:49.320 --> 07:56.840] First off, many people, including the current judiciary and lawyers that do the actual work, [07:56.840 --> 08:06.120] absolutely do not understand the long-settled law and method of how to read, understand [08:06.120 --> 08:08.160] and interpret statute. [08:08.160 --> 08:17.400] Now, I have a real problem with the word interpret in relation to how it's being done. [08:17.400 --> 08:23.240] And this whole subject that we talked about yesterday involves and revolves around or [08:23.240 --> 08:30.960] evolves around exactly that term, interpret. [08:30.960 --> 08:35.800] The way their courts are doing it, they've set themselves these little canons of statutory [08:35.800 --> 08:37.760] interpretation. [08:37.760 --> 08:44.360] One of the canons is that all words in the statute will be given their most common meaning [08:44.360 --> 08:48.040] unless the statute defines it otherwise. [08:48.040 --> 08:55.240] And my rule of thumb on that is if the statute does define it, then it absolutely is not [08:55.240 --> 09:02.280] being used in its common meaning every single time, because if it were, the statute would [09:02.280 --> 09:07.440] not have to create a separate distinct definition for it. [09:07.440 --> 09:16.280] Their second thing is that all statutes shall be interpreted in any way necessary to construe [09:16.280 --> 09:22.400] the statute as being constitutional, even if the whole reason they're having to argue [09:22.400 --> 09:27.960] about it is because someone has declared it to be unconstitutional and wants the court [09:27.960 --> 09:29.760] to show it. [09:29.760 --> 09:32.120] And they're being petitioned to do that. [09:32.120 --> 09:37.200] They have created this little thing that we will always presume that every act of the [09:37.200 --> 09:43.760] legislature is absolutely constitutional until proven otherwise. [09:43.760 --> 09:51.560] Now, the other part of that is, is that their interpretation, when they interpret it under [09:51.560 --> 09:58.600] those conditions, that the interpretation cannot go outside of the alleged intent of [09:58.600 --> 10:07.640] the legislature and that the interpretation cannot have a ridiculous or impossible outcome. [10:07.640 --> 10:14.240] So they cannot interpret the law to create a statutory or legal impossibility, nor can [10:14.240 --> 10:21.920] they create a ridiculous or unlawful conclusion, and yet they do it all the time, which means [10:21.920 --> 10:29.440] their canons of interpretation are as seriously flawed as their sense of reason. [10:29.440 --> 10:31.880] But that's not the real heart of the matter here. [10:31.880 --> 10:39.880] The heart of the matter is, is the ridiculous and impossible outcomes of these canons when [10:39.880 --> 10:40.880] they use them. [10:40.880 --> 10:46.880] And I'm going to give you exactly one of those examples using the Texas Constitution. [10:46.880 --> 10:53.480] Now, the Texas Constitution has been amended so many times that calling it an original [10:53.480 --> 11:02.240] 1876 is ridiculously insane because it's nowhere near original. [11:02.240 --> 11:12.000] Now, Article 1, Section 10 is one of the places where they've, the last amendment shown in [11:12.000 --> 11:18.840] the online version shows this was last amended in November 5th of 1918. [11:18.840 --> 11:27.080] And allegedly in that revision, one of the things they did was to remove the requirement [11:27.080 --> 11:33.360] that a grand jury indictment be had for anything other than a felony. [11:33.360 --> 11:37.160] Now why do I say anything other than a felony? [11:37.160 --> 11:43.000] Well, this is the way it reads what they amended it from. [11:43.000 --> 11:48.400] Okay, let me find where this actually begins. [11:48.400 --> 11:52.440] He shall not be compelled to give evidence against himself and shall have the right of [11:52.440 --> 11:57.240] being heard by himself or counsel or both, shall be confronted by the witnesses against [11:57.240 --> 12:02.080] him and shall have compulsory process for obtaining witnesses in his favor, except that [12:02.080 --> 12:06.280] when the witnesses resides out of the state and the offense charge is a violation of any [12:06.280 --> 12:10.840] of the antitrust laws of this state, the defendant in the state shall have the right to produce [12:10.840 --> 12:15.600] and have the evidence admitted by deposition under such rules and laws as the legislature [12:15.600 --> 12:17.640] may hereafter provide. [12:17.640 --> 12:21.600] Now right here in this particular section, we have one problem. [12:21.600 --> 12:29.160] The courts have created a canon or a doctrine that says you cannot both represent yourself [12:29.160 --> 12:35.560] and have representative counsel that Texas law does not allow that. [12:35.560 --> 12:37.440] Well, that's stupid. [12:37.440 --> 12:38.440] Why? [12:38.440 --> 12:45.120] Because right here it clearly says the right of being heard by himself or counsel or both. [12:45.120 --> 12:50.120] So right off the bat, that doctrine is unconstitutional on its face. [12:50.120 --> 12:52.240] But let's continue. [12:52.240 --> 12:58.920] And no person shall be held to answer for a criminal offense unless on an indictment [12:58.920 --> 13:00.600] of a grand jury. [13:00.600 --> 13:10.440] And here's the amendment, except in cases in which the punishment is by fine or imprisonment [13:10.440 --> 13:18.320] otherwise than in the penitentiary in cases of impeachment and in cases arising in the [13:18.320 --> 13:24.560] army or Navy or in the militia when an actual service in time of war or public danger. [13:24.560 --> 13:30.840] Okay, unless an indictment of a grand jury, except in cases in which the punishment is [13:30.840 --> 13:38.320] by fine or imprisonment, get this, they can lock you up without a grand jury indictment [13:38.320 --> 13:45.600] as long as they're incarcerating you in some place other than in the penitentiary. [13:45.600 --> 13:50.000] Now the penitentiary is a state run facility. [13:50.000 --> 13:57.920] Most all right now, all misdemeanor offenses are incarcerated in the county jails. [13:57.920 --> 14:00.040] They're never sent to the penitentiary. [14:00.040 --> 14:03.080] Only felonies are sent to the penitentiary. [14:03.080 --> 14:11.040] That's my statement, you're not entitled to a grand jury indictment under this amendment [14:11.040 --> 14:14.240] except in the case of a felony. [14:14.240 --> 14:16.640] Now you might say, well, what's the big deal? [14:16.640 --> 14:18.400] Why is that a problem? [14:18.400 --> 14:25.360] Well, the problem is how this statutory or constitutional interpretation rule affects [14:25.360 --> 14:30.760] this amendment in relation to other provisions of the Texas constitution. [14:30.760 --> 14:41.120] And what I mean by that is this, they've created this amendment which has a conflict with another [14:41.120 --> 14:43.320] part of the Texas constitution. [14:43.320 --> 14:50.480] Well, one of the other rules of statutory interpretation is that when provisions of [14:50.480 --> 14:59.000] a statute or the constitution conflict with each other or with another statute or part [14:59.000 --> 15:06.320] of the constitution, then the most recent change shall be given precedent and control [15:06.320 --> 15:09.520] the outcome of the interpretation. [15:09.520 --> 15:16.640] So here is why that is a huge problem. [15:16.640 --> 15:24.280] Now how many people would agree that it's okay to amend something as long as the people [15:24.280 --> 15:32.800] have a voice in amending it and that only those things intended to be amended by the [15:32.800 --> 15:38.720] recommendation are the things that are amended with the people's knowledge and consent? [15:38.720 --> 15:46.160] In other words, they can't amend something without asking us and that amendment has to [15:46.160 --> 15:50.920] be made known as to what its intended effect is so that we know whether or not agreeing [15:50.920 --> 15:53.840] to it's a good or bad thing. [15:53.840 --> 15:59.280] They can't amend our constitution without our consent, people. [15:59.280 --> 16:02.080] So why am I raising that as an issue? [16:02.080 --> 16:08.520] Well, I'm raising that as an issue because the unintended but direct effect of that method [16:08.520 --> 16:15.560] of interpretation actually creates what I'm referring to as a cascading change of amendments [16:15.560 --> 16:19.200] to an entire body of law. [16:19.200 --> 16:23.840] Rather than the amendment being limited to the one thing that was mentioned, discussed [16:23.840 --> 16:32.680] and is being done, it has the effect of actually changing other parts of the law simply because [16:32.680 --> 16:39.400] of that method of interpretation that the newest part controls all the other parts. [16:39.400 --> 16:43.480] So we're going to take a break and on the other side I'm going to point out that conflict [16:43.480 --> 16:50.120] and I'm going to explain to you why that problem should not be allowed to continue to exist [16:50.120 --> 16:52.360] and that rule be kicked out. [19:37.120 --> 19:43.640] Now as I was saying, we are going to see why this method of interpretation and how the [19:43.640 --> 19:51.560] newest iteration of an amendment to any statute or the constitution is allowed to be controlling [19:51.560 --> 19:57.120] over any other areas that deal with the same subject. [19:57.120 --> 20:01.880] As we said, this right here, this amendment to Article 1, Section 10 of the Bill of Rights [20:01.880 --> 20:08.520] specifically eliminated the requirement that before you could be charged with a crime, [20:08.520 --> 20:12.820] that there had to be a grand jury indictment. [20:12.820 --> 20:18.360] They eliminated that requirement so that they could incarcerate you in anything below a [20:18.360 --> 20:26.400] state penitentiary for up to a year and not have to get a grand jury's approval of there [20:26.400 --> 20:32.960] even being a crime that merited a trial in the first place. [20:32.960 --> 20:38.920] Now you want to talk about subverting due process, that's what this amendment here did. [20:38.920 --> 20:43.340] But let's see what else it subverted and how it did it. [20:43.340 --> 20:52.760] If we go to Article 5, Section 17 of the Texas Constitution, which is the judicial article [20:52.760 --> 21:01.400] that deals with the judicial branch of government, and we read Section 17, we go to the second [21:01.400 --> 21:08.000] sentence and this is what it reads, grand juries impaneled in the district courts shall [21:08.000 --> 21:16.200] inquire into misdemeanors and all indictments therefore returned into the district courts [21:16.200 --> 21:25.240] shall forthwith be certified to the county courts or other inferior courts having jurisdiction [21:25.240 --> 21:28.840] to try them for trial. [21:28.840 --> 21:36.880] Now does anyone other than me see the problem with those two provisions? [21:36.880 --> 21:42.200] You have the Bill of Rights portion saying you don't have a right to a grand jury indictment [21:42.200 --> 21:48.200] for anything other than a felony and then you have Section 17 right here that says the [21:48.200 --> 21:55.800] duty of the grand jury is not only to investigate a misdemeanor but to also hand down an indictment [21:55.800 --> 21:59.860] before a prosecution can take place. [21:59.860 --> 22:08.520] But according to the rules of statutory interpretation used by the courts, Article 5, Section 17 [22:08.520 --> 22:17.920] was amended by Article 1, Section 10 to remove this duty of the grand jury. [22:17.920 --> 22:21.040] How can that be? [22:21.040 --> 22:25.960] The people never voted on a change to Article 5, Section 17. [22:25.960 --> 22:31.920] The people never approved the removal of the grand jury from the process of investigating [22:31.920 --> 22:37.560] misdemeanors according to Article 5, Section 17. [22:37.560 --> 22:44.040] So how can Article 1, Section 10 be controlling over a completely separate part of the Texas [22:44.040 --> 22:52.360] Constitution and surreptitiously amend it in a way that removed and altered everything [22:52.360 --> 22:57.680] about that provision? [22:57.680 --> 23:02.100] How can that happen? [23:02.100 --> 23:07.120] And if you challenge it in court, I guarantee you what they're going to do is run home [23:07.120 --> 23:16.760] to mama and start screaming, statutory interpretation rule, latest change controls it all. [23:16.760 --> 23:18.920] It's fraud, people. [23:18.920 --> 23:21.680] It's judicial fraud. [23:21.680 --> 23:24.640] It's legislative fraud. [23:24.640 --> 23:30.360] It's a fraud upon we the people who set down the rules and then when these guys didn't [23:30.360 --> 23:36.040] like them, went out looking for ways to amend the protections so they could gain control [23:36.040 --> 23:45.200] over our lives with these illegal non-indictment convictions for non-freaking crimes. [23:45.200 --> 23:51.320] Crimes without victims, crimes without evidence, crimes without proof of any kind, you can [23:51.320 --> 23:57.000] now go to jail because of plea bargains and the fact that the grand jury never gets to [23:57.000 --> 24:02.160] look at the so-called evidence to see whether or not you should have ever been taken to [24:02.160 --> 24:07.560] trial in the first place. [24:07.560 --> 24:13.440] And I hate to point fingers at the guys in class yesterday, but it really, really bothered [24:13.440 --> 24:18.120] me when I asked the question and all I got was blank stares. [24:18.120 --> 24:25.000] The question was very simply, how many of you have actually read these parts of the [24:25.000 --> 24:26.000] Texas Constitution? [24:26.000 --> 24:30.080] Now, the part that bothered me was a couple of these guys have been coming to class for [24:30.080 --> 24:38.400] a very long time and I know everybody's got work and everybody's busy and all that stuff, [24:38.400 --> 24:43.200] but geez Louise folks, you're talking about the things that are used to take control of [24:43.200 --> 24:46.880] your life and take it away from you. [24:46.880 --> 24:52.240] And you act like it doesn't matter because you won't learn what the limitations on the [24:52.240 --> 24:56.760] authority to even do it actually are. [24:56.760 --> 24:58.640] And that bothers me. [24:58.640 --> 25:03.520] What the hell are we even doing here trying to bring you this information and provide [25:03.520 --> 25:10.600] you with the knowledge to use it properly and you won't even take the time for yourselves [25:10.600 --> 25:18.840] to look at it. [25:18.840 --> 25:26.320] It really, really makes me wonder what the hell I'm doing here. [25:26.320 --> 25:31.600] I can guarantee you the powers that be that are trying to rob you of your freedom and [25:31.600 --> 25:34.400] your liberty haven't read this. [35:35.560 --> 35:39.280] It doesn't matter, you don't have to go out and get a traffic ticket to try to affect [35:39.280 --> 35:41.400] change in relation to what we're dealing with here. [35:41.400 --> 35:45.960] You can go have a face to face meeting with your local representative, preferably in large [35:45.960 --> 35:51.760] numbers, you know, 5, 10, 15 people at a time going, hey, why are you ignoring this? [35:51.760 --> 35:54.080] Why do you allow this to happen up there? [35:54.080 --> 35:58.520] Why are you cutting deals with these other folks and not looking out for our best interest [35:58.520 --> 36:05.160] when you pass these idiotic laws that deprive us of what should be a common everyday right? [36:05.160 --> 36:07.320] That's one way of doing it. [36:07.320 --> 36:12.000] But the bigger you can make those groups or the more of them you can organize to pay visits [36:12.000 --> 36:16.320] to their office and say, hey, see that nice oak tree outside your window there? [36:16.320 --> 36:20.840] Can you imagine what that would look like with your carcass hanging from it? [36:20.840 --> 36:25.440] You know, just general stuff like that where they get the idea we are not at all pleased [36:25.440 --> 36:30.640] and if you come back here with another disappointing representation of our will and our liberty [36:30.640 --> 36:36.160] and freedom, then we're going to try to do our best to remove yours to act on our behalf [36:36.160 --> 36:41.760] and to punish you for it when we get control and create laws that make you the criminal. [36:41.760 --> 36:44.360] Makes sense. [36:44.360 --> 36:50.600] I mean, we really, if there was ever to be a constitutional convention that needs to [36:50.600 --> 36:54.720] start in your state level and it needs to start with the people of that state, not its [36:54.720 --> 37:00.320] legislature or its other so-called representatives, and we need to write, I have yet to see a [37:00.320 --> 37:07.400] single constitution in any state whatsoever that actually has punitive provisions for [37:07.400 --> 37:10.240] the public servants that violate it. [37:10.240 --> 37:13.240] That needs to change. [37:13.240 --> 37:17.840] It needs to be written right into the constitution that a public servant that fails to adhere [37:17.840 --> 37:23.840] to their oath to uphold it in every single provision and to abide by it in its strict [37:23.840 --> 37:28.740] disconstruction for the rights of the people is considered to be committing sedition or [37:28.740 --> 37:34.880] treason and shall be arrestable upon sight by any citizen making that claim. [37:34.880 --> 37:36.120] I wholly agree with that. [37:36.120 --> 37:41.160] That to me makes the most logical sense, and I get so aggravated when you see all this [37:41.160 --> 37:45.400] going on and you just come to think, well, there's nothing really you can do about it. [37:45.400 --> 37:47.240] It's just the way the system is, quote unquote. [37:47.240 --> 37:50.120] Well, the thing is, is that is exactly the point. [37:50.120 --> 37:52.160] That's how the system is. [37:52.160 --> 37:54.360] It's not the system we set up. [37:54.360 --> 38:00.080] It's the one they've created behind our backs and created solely for their benefit and not [38:00.080 --> 38:01.080] ours. [38:01.080 --> 38:04.960] That's why we need to change it, and that's what we need to understand and realize. [38:04.960 --> 38:05.960] Definitely. [38:05.960 --> 38:06.960] Definitely. [38:06.960 --> 38:11.680] I wholeheartedly agree with you on that, and it's just so frustrating that this has [38:11.680 --> 38:19.120] been allowed to happen, but it's refreshing to know that if we get together and we organize [38:19.120 --> 38:24.280] and we stand up for what is correct and just, that it can be corrected. [38:24.280 --> 38:27.880] It can be put back into its proper alignment, and that's the thing that really keeps me [38:27.880 --> 38:30.160] going even though it seems daunting. [38:30.160 --> 38:35.880] I think that it is definitely possible, and the harder and the swifter and the more fronts [38:35.880 --> 38:42.440] that we attack on, or not attack, but address, then the better, the quicker, and ultimately [38:42.440 --> 38:45.960] the better quality of life will come of it. [38:45.960 --> 38:49.960] Well, that's my hope and my goal. [38:49.960 --> 38:55.660] Whether or not we will get there without an actual revolution, well, that really depends [38:55.660 --> 39:00.320] on whether or not the people actually wake up in enough numbers to make that happen, [39:00.320 --> 39:08.120] but as long as it's only a few having to resist the complacency of the many against the other [39:08.120 --> 39:14.800] many that have seized control of everything else, then I don't see how that's going to [39:14.800 --> 39:16.080] be possible. [39:16.080 --> 39:17.560] I understand. [39:17.560 --> 39:21.520] Well, let me ask you this. [39:21.520 --> 39:29.000] What is a manner or what is something that may be comforting, because maybe the lack [39:29.000 --> 39:34.800] of exercising or coming to action is a fear of retribution, because we all heard these [39:34.800 --> 39:38.600] stories about, well, they got active and they did this, and all of a sudden the IRS is knee [39:38.600 --> 39:42.200] deep and all these other people are harassing them. [39:42.200 --> 39:50.560] Is there anything that you can think of that would create a safer feeling, I guess, that [39:50.560 --> 39:56.320] if you do exercise this and you do bring up protest to this outrageous, egregious activity, [39:56.320 --> 39:59.640] that you're not going to be too concerned that your life's going to get turned upside [39:59.640 --> 40:00.640] down? [40:00.640 --> 40:04.480] The only way that's going to happen is mass education of the people that are going to [40:04.480 --> 40:07.780] wind up on the juries they try to throw you in front of. [40:07.780 --> 40:11.760] When the jury says not guilty, that's the end of it. [40:11.760 --> 40:17.320] If they try to circumvent the jury, then they are calling for us to become violent and start [40:17.320 --> 40:23.320] a revolution, because they are now fully intent on removing the rule of law and the rights [40:23.320 --> 40:27.360] of the people, regardless of what the jury does. [40:27.360 --> 40:32.600] That's our last bastion of defense against what they're doing, is that jury. [40:32.600 --> 40:38.660] An educated jury that knows that they can say that's not right and say we're not going [40:38.660 --> 40:44.660] to find them guilty and then declare them not guilty, that would put a crimp in it, [40:44.660 --> 40:49.680] because then no matter what the government tried to do, they cannot get that conviction [40:49.680 --> 40:50.680] in court. [40:50.680 --> 40:55.760] Then if we also have people knowledgeable on the juries and the grand juries, when a [40:55.760 --> 41:02.640] citizen comes in or an individual, some people hate the word citizen, but when we come in [41:02.640 --> 41:08.800] and say look, this public servant committed a crime, they did this, they did this, and [41:08.800 --> 41:13.760] here's the evidence and the information relating to it, give them an indictment, and the grand [41:13.760 --> 41:19.320] jury actually does so, and then educated people sit on the actual jury at trial and says you [41:19.320 --> 41:24.960] know what, you committed a crime against a fellow human being and used the power of your [41:24.960 --> 41:31.960] office to do them harm, you're going to pay for that and send their butt to prison. [41:31.960 --> 41:36.840] The question of the masses is the answer to your question, it's the only answer to your [41:36.840 --> 41:39.760] question short of brass and lead. [42:41.120 --> 42:42.120] Yeah. [42:42.120 --> 42:45.400] For the first about seven, they didn't even have a complaint file. [42:45.400 --> 42:50.160] Finally, one day I told them, this court has absolutely zero jurisdiction, but I know what [42:50.160 --> 42:54.240] will happen if I don't show up, there'll be a warrant out for me, which still would and [42:54.240 --> 42:56.200] you can't touch them effectively. [42:56.200 --> 42:57.200] Okay. [42:57.200 --> 42:58.200] Yeah. [42:58.200 --> 42:59.200] And that's what I'm saying. [42:59.200 --> 43:02.360] That's exactly what we need to change at the constitutional level is to make it where they [43:02.360 --> 43:04.000] can't hide behind immunity. [49:07.560 --> 49:11.360] In this Georgetown ticket deal that I was dealing with, one day they had a visiting [49:11.360 --> 49:16.960] judge, a female judge, she looked like a gorilla, who came from Round Rock and she tried to [49:16.960 --> 49:20.240] threaten me with contempt if I didn't sign the plea form. [49:20.240 --> 49:25.000] So what I did was I wrote, not sign voluntary, I asked through all the guilty and not guilty [49:25.000 --> 49:27.760] and wrote being ordered under threat of contempt to sign it, you know. [49:27.760 --> 49:31.280] In other words, I took a chance because she could have had me thrown in jail for contempt [49:31.280 --> 49:32.560] and what could I do to her? [49:32.560 --> 49:35.600] You could sue her because that's way outside of her jurisdiction. [49:35.600 --> 49:36.600] Yeah, yeah. [49:36.600 --> 49:40.160] I mean, that's a possibility, but it would take a long battle. [49:40.160 --> 49:41.160] We both know that. [49:41.160 --> 49:42.160] Well, it always would. [50:05.440 --> 50:07.880] Sometimes they'll have two or three of them in there and they're standing there with one [50:07.880 --> 50:11.200] hand on a nightstick and the other hand on the page, they're glaring at you, just waiting [50:11.200 --> 50:13.520] for the judge to tell them to attack you. [50:15.520 --> 50:20.480] There's a lot of change, but anyway, this was a visiting judge and I happened to talk [50:20.480 --> 50:26.080] to this prosecutor and I said, was there an assignment by the presiding judge of this [50:26.080 --> 50:27.080] region? [50:27.080 --> 50:29.400] And he said, well, no, not really, but we'd have to reschedule and all that. [50:29.400 --> 50:31.560] I said, well, just let it go. [50:31.560 --> 50:33.920] You know, but that's the kind of Mickey Mouse stuff they do. [50:33.920 --> 50:37.280] Somebody wanted a day off, they phoned the judge, said, come in and take my place with [50:37.280 --> 50:41.120] no paperwork, no legality, no nothing, okay? [50:41.120 --> 50:44.880] And I sat through, you know, the first thing they do is tell everybody you're required [50:44.880 --> 50:45.880] to plead. [50:45.880 --> 50:47.680] These people don't even have complaints filed against them. [50:47.680 --> 50:51.160] The whole room is full of ignorant people and the courts tell them repeatedly, you must [50:51.160 --> 50:54.680] enter a plea of guilty, not guilty or no contest. [50:54.680 --> 50:59.040] Yeah, and that right there is judicial fraud. [50:59.040 --> 51:05.040] That right there should be grounds for dismissal for being completely inept and incompetent [51:05.040 --> 51:06.880] in your judicial function. [51:06.880 --> 51:07.880] And they do it all day. [51:07.880 --> 51:10.800] As a matter of fact, they had it broadcast before the judge came in. [51:10.800 --> 51:14.920] They were broadcast on two screens in that courtroom about your choices. [53:23.360 --> 53:28.280] After I got out of prison, my appeals attorney had already written my brief. [53:28.280 --> 53:33.640] I get out of jail and go to city hall and I get the land title and the land title says [53:33.640 --> 53:35.240] private property. [53:35.240 --> 53:41.400] I also get a letter from the clerk of the court that says that there are no transcripts [53:41.400 --> 53:46.760] for the grand jury, which as far as I'm concerned, that means they never had a grand jury hearing. [53:46.760 --> 53:52.680] I then turned around and tried to get my appeals attorney to file that in my case and she is [53:52.680 --> 53:53.680] refusing. [53:53.680 --> 54:00.200] She wrote me a letter saying that she will not file those papers in my case, that I could [54:00.200 --> 54:02.360] file them if I wanted to. [54:02.360 --> 54:06.880] Yeah, because she knows full well that as long as you're represented by counsel, the [54:06.880 --> 54:09.520] court will never look at anything you file. [54:09.520 --> 54:15.720] Thus, she is well aware of the fact that once you file it, she can ask to be removed and [54:15.720 --> 54:17.720] not be responsible. [54:17.720 --> 54:18.720] Okay. [01:06:22.960 --> 01:06:26.640] Well, if they're going to cheat in one area, why wouldn't they cheat in every area? [01:06:26.640 --> 01:06:27.640] Yeah. [01:06:27.640 --> 01:06:28.640] So I found that kind of strange. [01:06:28.640 --> 01:06:35.760] And then I said that this adjudication was supposed to be done under oath. [01:07:44.120 --> 01:07:50.800] And then the minute I did that, then I had a FOIA request in the mail four days later. [01:07:50.800 --> 01:07:57.400] And so basically, I brought up to the hearing officer that when I, you know, that they're [01:07:57.400 --> 01:08:01.560] they were violating my due process because not only did they not give me any of my FOIA [01:08:01.560 --> 01:08:09.200] requests, but that the hearing it has to be there has to be a complaint like I think the [01:08:09.200 --> 01:08:10.720] gentleman said earlier. [01:08:10.720 --> 01:08:15.240] And then there is a hearing date that they have to put on the docket, you know, with [01:08:15.240 --> 01:08:18.320] the docket number on the back of the complaint. [01:08:18.320 --> 01:08:19.960] And then I get a hearing date. [01:08:19.960 --> 01:08:28.240] And so I told them that that my hearing should have been 40 days from that date marked on [01:08:28.240 --> 01:08:32.280] the docket, and they wouldn't show me that. [01:08:32.280 --> 01:08:37.300] And I said, this is way past the 40 days, you know, for a quick speedy trial. [01:08:37.300 --> 01:08:41.880] So they also ignored that also. [01:08:41.880 --> 01:08:47.000] And then there's just several other things that, you know, that I brought up. [01:08:47.000 --> 01:08:52.600] And they pretty much just told me, no, I'm guilty. [01:08:52.600 --> 01:08:58.000] And then basically, at the end, I nailed them with the tape. [01:08:58.000 --> 01:09:04.760] And then the adjudicator said, well, since you're not an attorney, I'm going to continue [01:09:04.760 --> 01:09:05.760] this case. [01:09:05.760 --> 01:09:09.480] So I said, let the record reflect that nobody in this courtroom asked me for my bar card [01:09:09.480 --> 01:09:11.540] or asked to see if I was an attorney. [01:09:11.540 --> 01:09:15.660] And I looked at everybody and it looked like everybody crapped in their pants. [01:09:15.660 --> 01:09:23.960] And I said, let the record reflect that I'm not an attorney and that I... [01:10:01.000 --> 01:10:06.240] But the problem is this statute here says that all these hearings are to be conducted [01:10:06.240 --> 01:10:12.800] the day that they are to be heard and that no continuations are to be given for any circumstance. [01:10:12.800 --> 01:10:17.400] So I said, you don't have the power to give me a continuance. [01:10:17.400 --> 01:10:21.480] Then he started shaking like I had a gun to his head. [01:34:27.640 --> 01:34:34.640] But yet my driver's license here in Minnesota has been suspended for child support. [01:34:34.640 --> 01:34:37.640] But they claim they don't have jurisdiction. [01:34:37.640 --> 01:34:39.640] So I'm just trying to find out how – [01:34:39.640 --> 01:34:46.640] That's because of what's known as a reciprocity agreement between the states regarding licensing. [01:34:46.640 --> 01:34:56.640] They have made it where if one state petitions another state that they want to revoke your privileges in their – [01:34:56.640 --> 01:35:05.640] the original requester state, that they have it done by revocation in your home state that issued whatever. [01:35:05.640 --> 01:35:11.640] They use that – see, this is basically an agreement that some – as an example, [01:35:11.640 --> 01:35:19.640] California is asking Minnesota to enforce its laws within Minnesota. [01:35:19.640 --> 01:35:25.640] Well, the child support agency in California knows nothing about it. [01:35:25.640 --> 01:35:33.640] So the mother has – who is in Minnesota has contacted the child support agency in Minnesota, [01:35:33.640 --> 01:35:35.640] and they're the ones acting on it, the ones in California. [01:35:35.640 --> 01:35:42.640] The child support agency in California doesn't even have a case on it. [01:35:42.640 --> 01:35:47.640] Well, the problem is if Minnesota doesn't have a case on it either, then why aren't they suspending your license? [01:35:47.640 --> 01:35:54.640] Somebody had to make the request for them to do it, or they have to have a court order to do it. [01:35:54.640 --> 01:35:57.640] The mother made the request. [01:35:57.640 --> 01:36:00.640] The mother can't make the request for the suspension. [01:36:00.640 --> 01:36:05.640] She can start a case by saying he owes me child support, and then you have to be taken to court, [01:36:05.640 --> 01:36:10.640] and the judge has to hear the issues and determine what to do about it, [01:36:10.640 --> 01:36:14.640] but your wife can't have your license suspended. [01:47:48.640 --> 01:47:52.640] And he charges $150 for it, and it's less than one page. [01:47:52.640 --> 01:47:55.640] So it's not really a strategy at all. [01:47:55.640 --> 01:48:00.640] It's a waste of $150, I think, because to get the questions answered, [01:48:00.640 --> 01:48:02.640] if you have any, you've got to buy more stuff. [01:48:02.640 --> 01:48:06.640] So I would stay away from that. [01:48:06.640 --> 01:48:11.640] And that's just information, people, I have firsthand experience with it. [01:48:11.640 --> 01:48:16.640] Yeah, and I'm telling you right now, folks, if somebody's out there telling you to do something [01:48:16.640 --> 01:48:22.640] and they can't show you supporting evidence, case law, and fact of statute and everything else [01:48:22.640 --> 01:48:29.640] as to why that's the proper course, you better step back and reconsider. [01:48:29.640 --> 01:48:32.640] Well, you listen to people and they sound really knowledgeable, [01:48:32.640 --> 01:48:36.640] and then they put out some things, and you're thinking, I'll help this guy out. [01:48:36.640 --> 01:48:43.640] Then you get something and you go, my God, and they have no intention of refunding anything. [01:48:43.640 --> 01:48:51.640] And then my call is, and I'm doing this from memory, [01:48:51.640 --> 01:48:55.640] on your side of the road with the officer, you ask the officer, [01:48:55.640 --> 01:49:02.640] do you intend to harm or punish me for exercising a constitutionally protected right? [01:49:02.640 --> 01:49:07.640] Couldn't that same type of thing be used in the court, [01:49:07.640 --> 01:49:12.640] like this photo traffic ticket this other gentleman got, [01:49:12.640 --> 01:49:17.640] that this hearing officer is presuming you guilty. [01:49:17.640 --> 01:49:22.640] He's accepted all the presumptions without disposing of for the accuser. [01:49:22.640 --> 01:49:25.640] Yeah, that's exactly the problem. [01:49:25.640 --> 01:49:31.640] From the description of what he was doing, this little, again, this is not a real court. [01:49:31.640 --> 01:49:35.640] This is an administrative hearing even though they're telling you it's not, it is, [01:49:35.640 --> 01:49:40.640] because this is not a judicial officer sitting up there and you're not entitled to a jury trial. [01:49:40.640 --> 01:49:43.640] Therefore, it's not a judicial proceeding. [01:49:43.640 --> 01:49:47.640] And there is a rule of thumb, an axiom of law that says [01:49:47.640 --> 01:49:53.640] it cannot convict you based upon irrebuttable presumptions. [01:49:53.640 --> 01:49:56.640] A presumption is exactly that. [01:49:56.640 --> 01:50:01.640] It is presumed to be true until it is proven not to be true. [01:50:01.640 --> 01:50:04.640] And you cannot say the presumption is it's true [01:50:04.640 --> 01:50:08.640] and you never have the opportunity to say here's why it's not. [01:50:08.640 --> 01:50:12.640] That's an irrebuttable presumption and it is forbidden. [01:50:12.640 --> 01:50:16.640] Right, if they don't tell you that, they used everything against you, [01:50:16.640 --> 01:50:25.640] wouldn't it be proper to put the hearing officer, you know, kind of point the law at him [01:50:25.640 --> 01:50:31.640] and say are you intending to punish me if I exercise a constitutionally protected right? [01:50:31.640 --> 01:50:33.640] The hearing officer will also threaten them. [01:50:33.640 --> 01:50:35.640] If you do that, I'm going to fine you in contempt. [01:50:35.640 --> 01:50:37.640] Well, you just threatened me. [01:50:37.640 --> 01:50:39.640] Are you threatening me? [01:50:39.640 --> 01:50:43.640] Yeah, you're threatening me with punishment for doing nothing more [01:50:43.640 --> 01:50:45.640] than invoking a fundamentally protected right. [01:50:45.640 --> 01:50:47.640] Yeah, you definitely want stuff like that in the record [01:50:47.640 --> 01:50:52.640] because that's what removes their authority and their immunity. [01:50:52.640 --> 01:50:57.640] Right, so that would be a thing to study and practice on how to do. [01:50:57.640 --> 01:50:58.640] Absolutely. [01:50:58.640 --> 01:51:03.640] Like you wouldn't freeze up, but I sure would because my tongue would get tied and everything. [01:52:19.640 --> 01:52:25.640] Act as a witness, support the other guy, and provide them with affidavit saying, [01:52:25.640 --> 01:52:30.640] here is what I believe your due process rights that were denied affect [01:52:30.640 --> 01:52:33.640] and why you should be objecting to it and how to object to it. [01:52:33.640 --> 01:52:36.640] Put it in an affidavit and give it to them. [01:52:36.640 --> 01:52:39.640] Okay, and if the judge did remove you from the courtroom, [01:52:39.640 --> 01:52:41.640] wouldn't that be tampering with the witness? [01:52:41.640 --> 01:52:44.640] No, because you're not a witness in the case before the court.
