[10:29.880 --> 10:42.280] But in every single case, that individual openly admitted doing absolutely nothing beyond hearing the sound of my voice to prepare for what was coming next. [10:48.640 --> 11:02.800] And everybody that comes to that class can tell you there is something I tell everybody every time we're in that class, class does not end at that door. [15:57.240 --> 16:02.640] How do you form a class action lawsuit with a bunch of people that have no standing? [16:02.640 --> 16:11.560] And when I say no standing, you can't form a class action lawsuit for somebody that goes in and pays the fine and then tries to claim a harm. [16:11.560 --> 16:19.320] Because these courts have already said you've admitted to it, you've agreed to it, you've consented in every way possible. [16:19.320 --> 16:25.080] The moment you pay the fine, it's a done deal. You cannot claim a harm. [16:25.080 --> 16:33.680] So the only way to do it is to fight it tooth and nail in a case on your own and you never give up or consent. [16:33.680 --> 16:36.760] It's the only way. [19:42.840 --> 19:56.840] Yes, I asked under the Open Records Act for an open-ended professional service contract or contract agreement that the city has when they outsource to law firms or attorneys. [19:56.840 --> 20:05.840] The city said never in their history they have never had an open-ended professional service contract or contract agreement. [20:05.840 --> 20:11.840] I said, well, then how do you do business with these when you outsource with other law firms? [20:11.840 --> 20:18.840] She said, well, we just pick up the telephone and give them a call, and we don't put anything in writing. Can they do that? [20:18.840 --> 20:24.840] Absolutely not, and that's another reason why a city attorney cannot prosecute in the name of the state. [20:24.840 --> 20:33.840] They are neither sworn, they are not appointed or elected to any office, they do not take an oath, they do not take an anti-bribery statement, [20:33.840 --> 20:38.840] they do not post a bond as required by a county or district attorney as a state prosecutor. [20:38.840 --> 20:47.840] They don't qualify in any way, shape, or form despite what the legislature tried to do in 45.201. [20:47.840 --> 20:49.840] What can I do? [20:49.840 --> 20:53.840] Sue. [20:53.840 --> 21:00.840] Okay, if I sue, do I sue under violation of the Open Records Act? [21:00.840 --> 21:05.840] Well, you don't really have a cause of action that I'm aware of under the Open Records Act. [21:05.840 --> 21:06.840] You might. [21:06.840 --> 21:09.840] There's a criminal penalty for not doing the Open Records Act. [21:09.840 --> 21:17.840] But what we're talking about here is a violation of constitutional requirements as to who may prosecute in the name of the state. [21:17.840 --> 21:24.840] The issue is how do you claim a harm in order to have standing to sue? [21:24.840 --> 21:32.840] Well, technically speaking, any of these city attorneys that attempt to prosecute, whether they be actually employed by the city or they be a hired gun, [21:32.840 --> 21:39.840] like what you're discussing, they are impersonating a public servant. [21:39.840 --> 21:41.840] Under the penal code, that's the offense. [21:41.840 --> 21:44.840] They're impersonating a public servant. [21:44.840 --> 21:48.840] They're acting as a judicial officer that they are not. [21:48.840 --> 21:57.840] I've got a 78-page motion in the seminar material going against the city's attorney's authority to prosecute in the name of the state. [21:57.840 --> 22:05.840] And I use every single statute they have on the subject to prove exactly why it's not possible. [22:05.840 --> 22:09.840] It's absolutely unconstitutional for them to attempt to do what they're doing, [22:09.840 --> 22:17.840] which is yet another indication that cases prosecuted in municipal courts are not actually criminal [22:17.840 --> 22:23.840] because these people have no authority to prosecute a criminal case in the name of the state. [22:23.840 --> 22:34.840] The legislature cannot give it to them because it violates the direct assignment of that authority by the Texas Constitution to the county and district attorney's office. [22:34.840 --> 22:39.840] And a city attorney does not work for either of them. [22:39.840 --> 22:46.840] Is there a state agency who oversees the records for municipalities? [22:46.840 --> 22:51.840] No. This municipality is responsible for its own internal records. [22:51.840 --> 22:53.840] Then how can they hold them accountable? [22:53.840 --> 22:56.840] They can't. That's the other problem. [22:56.840 --> 23:10.840] The only way to hold a city prosecutor, well, city attorney accountable is with a bar grievance, which is no accountability at all. [23:10.840 --> 23:11.840] Oh, gosh. [23:11.840 --> 23:13.840] Because they're not liable under a vote. [23:13.840 --> 23:20.840] They weren't voted into office. They're not liable under an appointment because who do you complain to? [23:20.840 --> 23:23.840] You go to the city manager or the mayor, oh, well, we can't interfere. [23:23.840 --> 23:25.840] We're executive. They're judicial. [23:25.840 --> 23:27.840] We can't interfere in any of that. [23:27.840 --> 23:31.840] They're not accountable to anyone for what they're doing. [23:31.840 --> 23:38.840] So the city can pretty well make or any city in Texas can pretty well make up any records they want? [23:38.840 --> 23:46.840] And technically speaking, yeah, that's pretty much true. [23:46.840 --> 23:48.840] Can I ask another question? [23:48.840 --> 23:50.840] Sure. [23:50.840 --> 23:57.840] I request to see original file dated 2004. [23:57.840 --> 24:04.840] They said that I couldn't see the file, the original file that had been destroyed, that I could only see a copy. [24:04.840 --> 24:08.840] Then I asked to see original file of 2006. [24:08.840 --> 24:13.840] They said the original file had been destroyed, but I could only see a copy. [24:13.840 --> 24:21.840] However, they consolidated both of those files into a file of 2009. [24:21.840 --> 24:32.840] And when I looked at that file, there is nothing dated in 2004 or 2006 when both of those files originated. [24:32.840 --> 24:38.840] Well, the thing is, is it all depends on how the municipalities do their record keeping. [24:38.840 --> 24:42.840] Certain records, they're allowed by statute to destroy after a certain amount of time. [24:42.840 --> 24:50.840] There's nothing in the statute that requires those records to be destroyed to have actually been archived in any other fashion in some cases. [24:50.840 --> 24:53.840] Some are, but a lot of them aren't. [24:53.840 --> 24:57.840] So when they're gone, they're gone. [24:57.840 --> 25:06.840] It all depends upon what the records are and how far back those records are required to be maintained as to whether or not you may find an original copy [25:06.840 --> 25:13.840] or whether or not if you can't get an original, you find a microfiche copy. [25:13.840 --> 25:19.840] Okay, then should I just request their policy of destroying records? [25:19.840 --> 25:24.840] Well, the policy has to be based upon state statute in relation to the type of record. [25:24.840 --> 25:28.840] So first off, you have to know where the agency's authority to keep the record comes from. [25:28.840 --> 25:34.840] Then you find out what the maintenance of the record is under pretty much a similar situation, [25:34.840 --> 25:38.840] and then what the destruction of a particular record timeframe is. [25:38.840 --> 25:49.840] All of that will be in state statute because their policy for record keeping has to be based upon what the state allows for official records. [25:49.840 --> 25:57.840] So everything you're wanting will be in either the local government code or the government code most of the time in relation to records. [25:57.840 --> 25:59.840] Okay. [26:18.840 --> 26:24.840] So given that, I just want you folks to understand when we do the classes, [26:24.840 --> 26:32.840] I always try to make sure everybody is informed that this is a fight you need to be prepared to have if you're going to go against the powers that be [26:32.840 --> 26:45.840] because at no time has any governmental entity in the history of the world ever willingly given back a power it has usurped, [26:45.840 --> 26:52.840] or outright stolen for that matter, never has happened in human history. [26:52.840 --> 27:00.840] Government never willingly gives up or gives back power it has taken. [27:00.840 --> 27:06.840] The only way has been for the people to rise up against it in some form or fashion [27:06.840 --> 27:13.840] and offer a level of resistance that was compulsory upon the state to surrender that power. [27:13.840 --> 27:17.840] In some cases, we have had a political action that's done it. [27:17.840 --> 27:22.840] Other times, it took arms to do it. [27:22.840 --> 27:30.840] That's our history worldwide as a race or species or however you want to call it. [27:30.840 --> 27:35.840] The fact is that's just human. [27:35.840 --> 27:43.840] Somebody always wants to control somebody else. [27:43.840 --> 27:56.840] It's when that somebody else says no after that somebody has managed to get an appearance of authority that things get nasty [27:56.840 --> 28:01.840] because once that power's had, nobody likes to give it up. [28:01.840 --> 28:10.840] And that is one of our greatest human failings, to feel like we have to tell somebody else what they can and cannot do [28:10.840 --> 28:15.840] in their own life and in their own way as long as it was never hurting us in the first place. [34:20.840 --> 34:32.840] Well, I'm calling because you made a comment earlier about paying the fines is basically saying that, I mean, you really have no way of going back after the court after you pay the fine. [34:32.840 --> 34:36.840] And I have a situation in ULIS where they found me guilty. [34:36.840 --> 34:40.840] I wasn't able to get all of my paperwork in in time. [34:40.840 --> 34:47.840] We kind of talked about this a minute, a while ago, but I wasn't able to get all my appeal paperwork in in time, so I missed the appeal. [34:47.840 --> 34:53.840] However, I know that I could still go back and challenge jurisdiction even after I missed all of that. [34:53.840 --> 35:02.840] The problem is now is there's an alleged warrant out for my arrest because the fines weren't paid. [35:02.840 --> 35:12.840] Now, I talked to somebody else and they mentioned, well, maybe you could make you could work out a payment situation while you fight, you know, and challenge jurisdiction. [35:12.840 --> 35:14.840] Well, you want a secondary harm there, Paul? [35:14.840 --> 35:16.840] Say again? [35:16.840 --> 35:21.840] You want to get a secondary harm so you can sue the crap out of them even more? [35:21.840 --> 35:23.840] Well, that's what I was looking for, yes. [35:23.840 --> 35:26.840] Let them arrest you on the warrant because here's their problem. [35:26.840 --> 35:43.840] Title II, Code of Criminal Procedure specifically states that no fine or fee judgment may be collected unless an itemized bill signed by the officer over the case is submitted to the person required to pay. [35:43.840 --> 35:53.840] They have to itemize every single penny of the fine and the court costs in an itemized bill. [35:53.840 --> 36:01.840] If they do not, that's section of the Code of Criminal Procedure forbids collection. [36:01.840 --> 36:03.840] That's Title II. [36:03.840 --> 36:12.840] The whole Title II is about collection of judgments, and they cannot collect them if they did not properly submit the bill. [36:12.840 --> 36:14.840] So here's their problem. [36:14.840 --> 36:17.840] They never submitted a bill to you. [36:17.840 --> 36:25.840] Therefore, they cannot hold you liable for not paying a bill that was never submitted despite the judgment. [36:25.840 --> 36:31.840] Now they're going to punish you for not paying a bill they never submitted. [36:31.840 --> 36:48.840] Thus, your incarceration under that warrant and the arrest and the warrant will all be 100% illegal under the collections part of Title II because the bill was never itemized, signed, and submitted. [36:48.840 --> 36:51.840] Now here's their biggest problem. [36:51.840 --> 37:01.840] Title II is in fact positively enacted by the legislature as good binding law. [37:01.840 --> 37:05.840] Title I isn't, but Title II is. [37:05.840 --> 37:10.840] That's right on the legislature's website. [37:10.840 --> 37:12.840] So that's one of the reasons why they come. [37:12.840 --> 37:19.840] Well, there's a collection, I would say a collection agency that sent a letter not too long ago. [37:19.840 --> 37:24.840] Now if a collection agency sends you the letter, there probably is not a warrant. [37:24.840 --> 37:27.840] They lie through their teeth about the existence of a warrant. [37:27.840 --> 37:45.840] Therefore, you make the collection agency a party to your suit because they were attempting to perpetrate fraud by what they did to collect a debt that is not owed because a proper bill has never been submitted. [37:45.840 --> 37:46.840] Okay. [37:46.840 --> 37:59.840] Now here's the other thing to remember, study Title II very carefully because there has, to my knowledge, I have yet to find a case adjudicated over the failure to do a bill under Title II. [37:59.840 --> 38:03.840] No one's even ever raised the issue that I can find a case on. [38:03.840 --> 38:05.840] Okay. [38:05.840 --> 38:07.840] Well, maybe this will be the first. [38:07.840 --> 38:13.840] Yeah, this will be a case of first impression when these people are collecting all this money, but they're not doing it on a proper bill. [38:13.840 --> 38:19.840] No one has a complaint if they just go ahead and pay it despite the absence of a proper bill. [38:19.840 --> 38:30.840] If I walked up to you and said, give me $20 or else, and you actually pull out your wallet and give me $20 and I never brandished a weapon or actually I never even said or else. [38:30.840 --> 38:32.840] I just said, give me $20. [38:32.840 --> 38:34.840] And you did. [38:34.840 --> 38:37.840] Did I rob you? [38:37.840 --> 38:38.840] No. [38:38.840 --> 38:39.840] Exactly. [38:39.840 --> 38:42.840] Neither did they. [38:42.840 --> 38:52.840] But if they do it under force and duress, and they haven't complied with law for the proper collection methods, that is a threat. [38:52.840 --> 38:53.840] That's a harm. [38:53.840 --> 38:58.840] That's armed robbery if a cop arrests you on that warrant. [38:58.840 --> 39:00.840] And you have to pay it. [39:00.840 --> 39:03.840] That is absolute extortion. [39:03.840 --> 39:15.840] So then, okay, so then once arrested, one of the things I can't stand, I can't allow for right now is to be out of work because I'm the one that provides for the household. [39:15.840 --> 39:17.840] So according to the amount of... [39:17.840 --> 39:18.840] I understand that. [39:18.840 --> 39:23.840] So what you do is you get a habeas corpus prepared before you do this. [39:23.840 --> 39:34.840] And you lay out in the habeas corpus exactly why you were arrested, exactly why the arrest is illegal under Title II, and that you want the case reviewed by a sitting judge. [39:34.840 --> 39:42.840] And you have that waiting in the wings the moment they arrest you for someone to go file in a district court. [39:42.840 --> 39:44.840] Okay. [39:44.840 --> 39:45.840] Okay. [39:45.840 --> 39:46.840] That's the smart play. [39:46.840 --> 39:50.840] You be ready for what they're going to do. [39:50.840 --> 39:54.840] Yeah, because it's a habeas warrant. [39:54.840 --> 39:59.840] Obviously, I couldn't just be able to go up with a surety bond and bond out that way. [39:59.840 --> 40:05.840] Right, because they're saying they're arresting you for failure to pay the judgment and you didn't perfect your appeal. [40:05.840 --> 40:09.840] So because of that, the judgment is supposedly good. [40:09.840 --> 40:15.840] Well, the problem is in order to collect that judgment, there are specific rules and they didn't follow them. [40:15.840 --> 40:21.840] Therefore, according to those same rules, you are not liable for the payment of that judgment yet. [40:21.840 --> 40:29.840] But they're punishing you for not paying a judgment they haven't validated by the submission of the itemized bill. [40:29.840 --> 40:31.840] Okay. [40:31.840 --> 40:32.840] Okay. [40:32.840 --> 40:34.840] So I will have a habeas corpus prepared. [40:34.840 --> 40:35.840] That will be cool. [40:35.840 --> 40:36.840] I appreciate it, man. [40:36.840 --> 40:42.840] Yeah, but don't get into their hands until you have finished the study of Title II and got that put into that habeas. [40:51.840 --> 40:59.840] Yeah, he and I have actually been talking about Title II over the last week about the things that they are not doing that they're absolutely required to do. [40:59.840 --> 41:01.840] It's just not, they're not doing it right. [41:01.840 --> 41:10.840] And it says right there in the statute, no fee, finer fee may be collected unless that bill is served. [41:10.840 --> 41:12.840] And that has not been done yet. [41:12.840 --> 41:13.840] That has not been done. [41:13.840 --> 41:20.840] They can't just write down one big lump sum and give it to you and say this is your judgment, pay it, not according to Title II. [41:20.840 --> 41:29.840] And not only that, when they itemize that bill, they can only put down what they actually did and deserve the fee for. [41:29.840 --> 41:35.840] And the fee cannot exceed the amount of the fee authorized by Title II. [41:35.840 --> 41:49.840] So if they're going above and beyond the fees that are set forth in Title II, now they're committing fraud under color of law because that fee is not authorized by statute. [41:49.840 --> 41:56.840] It cannot be collected, nor can it be collected in an amount greater than what the statute allows for that fee. [41:56.840 --> 41:59.840] Okay. [41:59.840 --> 42:01.840] Okay. [42:01.840 --> 42:03.840] Well, let me go ahead and get started on that. [42:03.840 --> 42:08.840] By the way, I want to let you know that, you know, I've been, you know, got all the seminar material. [42:08.840 --> 42:09.840] We talked about that before. [42:09.840 --> 42:12.840] And I've filed them into the two courts that I'm currently involved with. [42:12.840 --> 42:15.840] And right now, they keep resetting. [42:15.840 --> 42:21.840] They will continue to reset because I don't think that they're ready to stand up against it. [42:21.840 --> 42:23.840] That's possible. [42:23.840 --> 42:25.840] Yeah, well, that's what it looks like right now. [42:25.840 --> 42:36.840] But what I would do is I would go ahead and file a notice to the court to withdraw the warrant and say, look, you can't issue a warrant for failure to pay this. [42:41.840 --> 42:47.840] That shows that you gave them the chance to administratively resolve the problem. [42:47.840 --> 42:54.840] And they failed to do it when they don't send you an itemized bill as required. [42:54.840 --> 42:55.840] Okay. [42:55.840 --> 42:57.840] That way your bases are covered. [42:57.840 --> 43:01.840] Now you've exhausted all administrative remedy on that side. [43:01.840 --> 43:05.840] So when they act, you can go straight to lawsuit. [43:05.840 --> 43:07.840] Okay. [47:26.840 --> 47:28.840] A city councilman was fielding questions, [47:28.840 --> 47:33.840] and one of them was regarding an ordinance that they recently passed within the [47:33.840 --> 47:44.840] last month that any vehicle impounded for lack of insurance cannot be released [47:44.840 --> 47:48.840] unless you provide the total or the private run business with proof of [47:48.840 --> 47:51.840] liability insurance. [47:51.840 --> 47:59.840] I asked him, I said, well, do you know who this actually affects? [47:59.840 --> 48:00.840] He says everybody. [48:00.840 --> 48:05.840] And I said, well, and I gave him some definitions out of the U.S. Code and [48:05.840 --> 48:14.840] Texas statutes, which clearly state that the wording in their ordinance applies [48:14.840 --> 48:16.840] only to commercial activity. [48:16.840 --> 48:20.840] And I said, now, in light of those definitions that I just provided you, [48:20.840 --> 48:25.840] who are you saying that this law, this ordinance applies to? [48:25.840 --> 48:27.840] And, of course, he would never answer. [48:27.840 --> 48:30.840] Well, of course not. [48:30.840 --> 48:31.840] They lose money. [49:14.840 --> 49:21.840] So, and I'm trying, I don't really know how to articulate the relationship [49:21.840 --> 49:26.840] between just your average citizen and the corporate entity and its ordinances [49:26.840 --> 49:27.840] that they pass. [49:27.840 --> 49:32.840] I'm not sure how to articulate, you know, whether or not we have to comply [49:32.840 --> 49:33.840] with it. [49:33.840 --> 49:34.840] Okay. [49:42.840 --> 49:47.840] And when you're talking to somebody whose entire source of power comes from [49:47.840 --> 49:52.840] the ability to enact ordinances and treat them as law, you're not going to [49:52.840 --> 49:56.840] get cooperation no matter how rational and how much evidence you prove [49:56.840 --> 49:57.840] and provide. [49:57.840 --> 49:59.840] Okay. [49:59.840 --> 50:04.840] So what you're dealing with here is a mindset, not lack of facts or lack of [50:04.840 --> 50:06.840] ability to explain. [50:06.840 --> 50:12.840] You have a willful ignorance concept that they will not give up on because of [50:12.840 --> 50:17.840] their so-called plausible deniability factor. [50:17.840 --> 50:20.840] I didn't know. [50:20.840 --> 50:21.840] Okay. [50:21.840 --> 50:28.840] So the issue here becomes what they perceive as reality versus what you know [50:28.840 --> 50:30.840] reality to be. [50:30.840 --> 50:36.840] What you've got is a bunch of fictitious state courts and fictitious governmental [50:36.840 --> 50:42.840] actions that create the appearance of authority in an ordinance as law. [50:42.840 --> 50:47.840] In fact, the legislature violated the Texas Constitution the moment it defined [50:47.840 --> 50:56.840] the term law in various codes and said that the term law means and included [50:56.840 --> 51:02.840] county and municipal ordinances as a part of the definition of law. [51:02.840 --> 51:04.840] Now, here's the problem. [51:04.840 --> 51:10.840] That right there proves beyond a shadow of a doubt that any code that defines [51:10.840 --> 51:18.840] law as including an ordinance, that's going to be 100% proof positive that [51:18.840 --> 51:26.840] that statute does not apply to the common man in Texas, does not apply. [51:26.840 --> 51:27.840] Why? [51:27.840 --> 51:32.840] Because the ordinance, if it's considered law, is only law binding upon the [51:32.840 --> 51:40.840] corporation's employees, contractors, and the legal entities within its area [51:40.840 --> 51:43.840] of jurisdiction, its territorial boundaries. [51:43.840 --> 51:45.840] That's it. [51:45.840 --> 51:48.840] And that includes everyone engaged in commerce? [51:48.840 --> 51:49.840] No, no, no. [51:49.840 --> 51:50.840] Not everyone. [51:50.840 --> 51:55.840] A legal entity, a mom and pop shop that's not incorporated is not a legal [51:55.840 --> 52:05.840] entity. A corporation, an LLC, a improvised partnership under state law [52:05.840 --> 52:11.840] that requires state paperwork to set up is a legal entity. [52:11.840 --> 52:13.840] Ah, okay. [52:13.840 --> 52:15.840] Okay. [52:15.840 --> 52:19.840] So I wouldn't even fill out a DBA. [52:19.840 --> 52:21.840] I wouldn't even use a different name. [52:21.840 --> 52:28.840] If I was a mom and pop shop, from now on, anything I do is my name. [52:28.840 --> 52:29.840] Okay? [52:29.840 --> 52:33.840] If I want to do a computer shop, it's Eddie Craig, Computer Repair Service, [52:33.840 --> 52:34.840] and so on. [52:34.840 --> 52:38.840] The computer repair and service is not a part of the name of the business. [52:38.840 --> 52:40.840] It's simply my name. [52:40.840 --> 52:44.840] And then what I do is computer repair, sales, and service. [52:44.840 --> 52:45.840] Okay. [52:45.840 --> 52:52.840] So now when this tow yard refuses to release my automobile or someone's [52:52.840 --> 52:59.840] automobile for failure to provide proof of minimum liability insurance, [52:59.840 --> 53:04.840] then they're subject to lawsuit as well as all the councilmen and the city [53:04.840 --> 53:05.840] manager? [53:05.840 --> 53:06.840] Absolutely. [53:06.840 --> 53:09.840] But now here's what you're going to have to do to make that. [53:09.840 --> 53:11.840] And here's the problem also. [53:11.840 --> 53:16.840] At the very least, you're going to have to suffer a harm by either A, [53:16.840 --> 53:21.840] losing the car in an illegal seizure and protesting it and documenting it as [53:21.840 --> 53:26.840] such, or you're going to have to go contract with an insurance company long [53:26.840 --> 53:32.840] enough to get the car, go get the car and get it out, and then relinquish the [53:32.840 --> 53:35.840] contract with the insurance company. [53:35.840 --> 53:41.840] That would constitute a monetary harm and a compulsory expenditure into a [53:41.840 --> 53:46.840] contract you did not agree to without actually paying a fine. [53:46.840 --> 53:47.840] Okay? [53:47.840 --> 53:49.840] You didn't pay the city. [53:49.840 --> 53:54.840] You simply got insurance so that the tow yard couldn't hold the car any [53:54.840 --> 53:55.840] longer. [53:55.840 --> 53:56.840] Okay. [53:56.840 --> 53:57.840] All right? [53:57.840 --> 53:59.840] They had to release it. [53:59.840 --> 54:07.840] Now you've got a harm and you haven't nullified the harm by paying a fine. [54:07.840 --> 54:13.840] Now, of course, a secondary harm that will tie the tow company in is if they [54:13.840 --> 54:18.840] charge you any fees above and beyond what you did with the insurance company. [54:18.840 --> 54:22.840] If you pay them a tow fee, if you pay them a storage fee, if you pay the tow [54:22.840 --> 54:27.840] company one penny for what it did, then they are now attached because they are [54:27.840 --> 54:29.840] not a fine collector. [54:29.840 --> 54:33.840] They're extorting money from you based upon an alleged authority granted them [54:33.840 --> 54:40.840] by the municipality that the municipality itself never had and did not properly [54:40.840 --> 54:45.840] train the tow company on how to fulfill their duties in relation to the [54:45.840 --> 54:50.840] ordinance by allowing them to take private property instead of commercial [54:50.840 --> 54:53.840] use motor vehicles. [54:53.840 --> 54:58.840] Okay. Now, and if they towed it from a private parking lot, then that's even [54:58.840 --> 55:00.840] more damage on top of that? [55:00.840 --> 55:05.840] Depends on whether or not it was towed under an agreement with the owner of [55:05.840 --> 55:06.840] the private parking lot. [55:06.840 --> 55:12.840] You can then attach the owner of the parking lot to that as well because they [55:12.840 --> 55:17.840] allowed your property to be stolen under a false presumption that it was able to [55:17.840 --> 55:19.840] be towed. [55:19.840 --> 55:20.840] Okay. [55:20.840 --> 55:24.840] See, even on private property, if it's open to the public, let's say it's [55:24.840 --> 55:29.840] Walmart that has it towed, Walmart is under an obligation to notify you that [55:29.840 --> 55:34.840] you're not allowed to be there because they're a publicly accessible location. [55:34.840 --> 55:37.840] Now, again, this is not set out in any case law. [55:37.840 --> 55:40.840] I'm simply talking common sense rationale here. [55:40.840 --> 55:44.840] The problem is that the law does not always follow common sense rationale. [55:44.840 --> 55:50.840] Hence, the other reason why you need to research what you can as much as you [55:50.840 --> 55:51.840] can. [55:51.840 --> 55:53.840] Everybody clear on that. [55:53.840 --> 55:57.840] I don't want to hear later that I gave bad advice because all I'm doing is [55:57.840 --> 56:03.840] talking about the proper way for this to work because most of what I'm talking [56:03.840 --> 56:05.840] about has never been argued. [56:05.840 --> 56:10.840] Therefore, there isn't any case law on it, and if there is, I haven't found it. [56:10.840 --> 56:12.840] If you do, great. [56:12.840 --> 56:14.840] Send it to me too. [56:14.840 --> 56:20.840] But Walmart, being publicly accessible, can't just up and deny access to its [56:20.840 --> 56:23.840] parking lot to a member of the general public. [56:23.840 --> 56:28.840] Now, you pull into someone's yard, that is a different story. [56:28.840 --> 56:33.840] That's a clear trespass on private property that is not generally accessible [56:33.840 --> 56:36.840] to the public. [56:36.840 --> 56:40.840] Again, simple common sense rationale, right? [56:40.840 --> 56:41.840] That's right. [56:41.840 --> 56:47.840] So how it should work versus how they've made it work, I cannot absolutely tell [56:47.840 --> 56:48.840] you. [56:48.840 --> 56:53.840] But common sense says that's the right way for it to work. [56:53.840 --> 56:54.840] Okay. [01:03:55.840 --> 01:03:59.840] It would be whatever the legal fees would be for the city to defend. [01:03:59.840 --> 01:04:02.840] In most cases, they'll try to get recoupment of legal fees, [01:04:02.840 --> 01:04:04.840] whatever it costs them to fight you. [01:04:04.840 --> 01:04:09.840] Now the question here is, is what kind of municipality are you trying to fight? [01:04:09.840 --> 01:04:16.840] General law municipality, home rule city municipality, what kind is it? [01:04:16.840 --> 01:04:17.840] Home rule. [01:04:17.840 --> 01:04:20.840] Okay, home rule, check the city charter. [01:04:20.840 --> 01:04:25.840] Most home rule city charters contain specific language that says the [01:04:25.840 --> 01:04:32.840] municipality may sue and be sued in any court of this state. [01:04:32.840 --> 01:04:37.840] That is a waiver against suit. [01:04:37.840 --> 01:04:43.840] So when they try to say we have immunity and you can't sue us, you can say no, [01:04:43.840 --> 01:04:48.840] your city charter says you specifically waived immunity in getting sued, [01:04:48.840 --> 01:04:54.840] and in fact state statute says that any municipality can sue and be sued. [01:04:54.840 --> 01:05:00.840] Therefore, by both, there has been a waiver of immunity for every [01:05:00.840 --> 01:05:06.840] municipality in Texas, whether by its own charter and state statute or [01:05:06.840 --> 01:05:09.840] just state statute. [01:05:09.840 --> 01:05:16.840] The only time the city can claim immunity is if its actions are 100% [01:05:16.840 --> 01:05:19.840] governmental in the name of the state. [01:05:19.840 --> 01:05:26.840] In other words, they must be acting entirely on authority granted by state [01:05:26.840 --> 01:05:28.840] statute. [01:05:28.840 --> 01:05:32.840] If they are not, which is what they're doing when they're dealing with an [01:05:32.840 --> 01:05:38.840] ordinance, especially one that isn't based on state statute, they're hosed. [01:05:38.840 --> 01:05:42.840] They have no immunity for that because they are acting in what the Texas [01:05:42.840 --> 01:05:45.840] courts call one of two capacities. [01:05:45.840 --> 01:05:50.840] Texas courts have ruled that all municipalities operate in either a [01:05:50.840 --> 01:05:54.840] governmental function, meaning they are acting under state authority as an [01:05:54.840 --> 01:06:00.840] agent for the state, or they're acting in a proprietary manner, which means [01:06:00.840 --> 01:06:05.840] they're acting in a corporate capacity and have zero immunity for whatever [01:06:05.840 --> 01:06:09.840] they do in that corporate capacity. [01:06:09.840 --> 01:06:15.840] Okay, but if I was to lose, I would have to pay all their attorney expenses. [01:06:15.840 --> 01:06:20.840] Whatever they asked for that was the court granted, yes. [01:07:01.840 --> 01:07:02.840] I was just wondering. [01:07:02.840 --> 01:07:07.840] It is a city-state for a skate park, but it's a public skate park, and I'm [01:07:07.840 --> 01:07:08.840] just wondering. [01:07:43.840 --> 01:07:47.840] Now, if you were commandeering part of the park and putting up a stand and [01:07:47.840 --> 01:07:52.840] selling skateboards and rental equipment and stuff like that, absolutely, but [01:07:52.840 --> 01:07:56.840] not just to participate in the park and teach people how to do it and charge [01:07:56.840 --> 01:07:57.840] them for your time. [01:07:57.840 --> 01:07:58.840] No. [01:07:58.840 --> 01:08:01.840] Even if it was, say, like a summer camp? [01:08:01.840 --> 01:08:04.840] I mean, if it was same thing, just my time, teaching. [01:08:04.840 --> 01:08:09.840] As long as you're not taking over the use of the park for your own private [01:08:09.840 --> 01:08:11.840] gain, they don't have any say so over it. [01:08:11.840 --> 01:08:15.840] It doesn't matter if you go out there by yourself or with 50 people, does it? [01:26:03.840 --> 01:26:07.840] So for the most part you are saying that if we have to interface with such [01:26:07.840 --> 01:26:13.840] individuals and we go ahead and exercise or go ahead and go through the script, [01:26:13.840 --> 01:26:17.840] be prepared to face some consequences. [01:26:17.840 --> 01:26:20.840] It is entirely possible you will have to take some consequences. [01:26:20.840 --> 01:26:24.840] Consequences are going to exist in several different ways. [01:47:56.840 --> 01:48:01.840] But their case law has ruled that in certain misdemeanor-type cases, [01:48:01.840 --> 01:48:05.840] three months is too little, five months is too long. [01:48:05.840 --> 01:48:10.840] So your best bet is challenge it, let them keep doing it, [01:48:10.840 --> 01:48:15.840] and when you hit six, seven, eight months, bring up the speedy trial issue again. [01:55:12.840 --> 01:55:16.840] Well, there is no city ordinance that governs anything other than government-owned [01:55:16.840 --> 01:55:17.840] and operated vehicles. [01:55:17.840 --> 01:55:19.840] It's right there in Title 12 of the city ordinances. [01:55:19.840 --> 01:55:26.840] Everything their transportation applies to is government-owned and operated, nothing else. [01:55:26.840 --> 01:55:28.840] Yeah, no, I understand that. [01:55:28.840 --> 01:55:31.840] It's that selective enforcement. [01:55:31.840 --> 01:55:37.840] Yeah, well, fraudulent enforcement because that, believe it or not, [01:55:37.840 --> 01:55:41.840] that financial responsibility statute, other than the speeding statute, [01:55:41.840 --> 01:55:45.840] is the most abused statute in the transportation code. [01:55:45.840 --> 01:55:53.840] The most abused one in the code of criminal or the penal code is PI and failure to ID. [01:55:53.840 --> 01:56:00.840] Those two probably are very, very close in how abused they are by the cops to get people in the system. [01:56:00.840 --> 01:56:02.840] I see people all the time. [01:56:02.840 --> 01:56:04.840] We bail out, and that's the only charge listed here. [01:56:04.840 --> 01:56:08.840] They were not brought in on other charges, additional charges whatsoever, not even tickets. [01:56:08.840 --> 01:56:11.840] The only thing that will be listed on the charge sheet when we go to bail them out, [01:56:11.840 --> 01:56:13.840] failure ID, I'm just going, man, this is ridiculous. [01:56:13.840 --> 01:56:18.840] Yeah, they don't bother to read the statute or understand it, which proves they're not being trained. [01:56:18.840 --> 01:56:21.840] If they're not being trained, who failed to train them? [01:56:21.840 --> 01:56:23.840] Is that person responsible for that training? [01:56:23.840 --> 01:56:24.840] Absolutely. [01:56:24.840 --> 01:56:28.840] Is that person liable for the failure to train? [01:56:28.840 --> 01:56:30.840] Absolutely. [01:56:30.840 --> 01:56:37.840] Yeah, well, you know, public intoxication is used all the time just because they know they're not required to provide [01:56:37.840 --> 01:56:44.840] productivizer evidence, and they will grab somebody that's being louder or more direct than they're used to. [01:57:03.840 --> 01:57:10.840] The moment a cop seizes you without a warrant and he can produce no actual evidence of the accusation that he's made, [01:57:10.840 --> 01:57:15.840] that guy should have lost his job and been in jail for aggravated assault and kidnapping. [01:57:17.840 --> 01:57:21.840] But all they say is in my professional opinion, I've had a number of people that I've talked to over the years that have said [01:57:21.840 --> 01:57:25.840] if they even ask, give me a breathalyzer, take my blood, you're wrong. [01:57:25.840 --> 01:57:31.840] And they'll tell me, in my professional opinion, as a licensed police officer, you're intoxicated and we're going downtown.
