This is Rule of Law Radio with Eddie Craig and Deborah Stevens. [04:21.880 --> 04:27.880] It is Monday night, December 6, 2010. Tonight is traffic night. [04:27.880 --> 04:31.880] We're going to be dealing with one particular subject tonight. [04:31.880 --> 04:37.880] We're going to go over what constitutes unauthorized practice of law. [04:37.880 --> 04:43.880] This presentation hopefully will not take too long and we can start taking phone callers here pretty soon. [04:43.880 --> 04:48.880] But if you are where you can access the internet, go to the Texas government website, [04:48.880 --> 04:54.880] to the legislative enactments sections where you can get to the actual statutes and codes [04:54.880 --> 05:01.880] and look in subchapter D which is section 81.101. [05:01.880 --> 05:07.880] This section, subchapter G deals specifically with the unauthorized practice of law. [05:07.880 --> 05:11.880] Now I'm going to read each of these sections and I'm going to kind of break them down [05:11.880 --> 05:17.880] as to exactly what they're attempting to do and exactly why we can tell them to go jump in the lake. [05:17.880 --> 05:22.880] Okay, 81.101, definition, subsection A. [05:22.880 --> 05:29.880] In this chapter, the practice of law means the preparation of a pleading or other document [05:29.880 --> 05:34.880] incident to an action or special proceeding or the management of the action or proceeding [05:34.880 --> 05:40.880] on behalf of a client before a judge in court as well as a service rendered out of court [05:40.880 --> 05:45.880] including the giving of advice or the rendering of any service requiring the use of legal skill [05:45.880 --> 05:50.880] or knowledge such as preparing a will, contract or other instrument, [05:50.880 --> 05:56.880] the legal effect of which under the facts and conclusions involved must be carefully determined. [05:56.880 --> 06:03.880] Subsection B, the definition in this section is not exclusive and does not deprive the judicial branch [06:03.880 --> 06:08.880] of the power and authority under both this chapter and the adjudicated cases [06:08.880 --> 06:15.880] to determine whether other services and acts not enumerated may constitute the practice of law. [06:15.880 --> 06:23.880] C, in this section, the practice of law does not include the design, creation, publication, distribution, [06:23.880 --> 06:30.880] display or sale including publication, distribution, display or sale by means of an Internet website [06:30.880 --> 06:36.880] of written materials, books, forms, computer software or similar products [06:36.880 --> 06:42.880] if the products clearly and conspicuously state that the products are not a substitute for the advice of an attorney. [06:42.880 --> 06:48.880] This subsection does not authorize the use of the products or similar media in violation of Chapter 83 [06:48.880 --> 06:53.880] and does not affect the applicability or enforceability of that chapter. [06:53.880 --> 06:59.880] Now, let's talk about 81.0101 here for just a second. [06:59.880 --> 07:03.880] The Supreme Court, as we'll see when we get to the next section, [07:03.880 --> 07:09.880] is the one that is outlining these rules for this particular statute. [07:09.880 --> 07:11.880] Now, understand something here. [07:11.880 --> 07:18.880] The judicial branch of government cannot create law. [07:18.880 --> 07:21.880] That includes the Supreme Court. [07:21.880 --> 07:25.880] That includes the Court of Criminal Appeals. [07:25.880 --> 07:29.880] They cannot create law. [07:29.880 --> 07:37.880] They can create judicial interpretations of existing law, but they cannot create law. [07:37.880 --> 07:43.880] So when this says that this is creating a definition of the practice of law [07:43.880 --> 07:51.880] and that the judicial branch can determine whether or not a particular action involves the practice of law, [07:51.880 --> 07:59.880] then there is a certain restriction placed upon the judicial branch as to who they may apply that definition to. [07:59.880 --> 08:05.880] Reason being, if it is not a law, it can only be a rule. [08:05.880 --> 08:11.880] And if it's a rule, then it cannot be applied to the people themselves. [08:11.880 --> 08:15.880] Only laws can be applied to the people. [08:15.880 --> 08:23.880] The rules apply only to those that are subject to the particular whims of the courts. [08:23.880 --> 08:30.880] In this case, employees of the courts, officers of the courts, and so on and so forth. [08:30.880 --> 08:35.880] But it cannot, does not apply to you and I. [08:35.880 --> 08:43.880] Section 81.1011, exception for certain legal assistance. [08:43.880 --> 08:50.880] Subsection A, notwithstanding Subsection 81.101A, [08:50.880 --> 08:57.880] the practice of law does not include technical advice, consultation, and document completion assistance [08:57.880 --> 09:02.880] provided by an employee or volunteer of an area agency on aging, [09:02.880 --> 09:09.880] affiliated with the Texas Department on Aging, who meets the requirements of Subsection B [09:09.880 --> 09:13.880] if that advice, consultation, and assistance relates to, [09:13.880 --> 09:21.880] Sub-Item 1, a medical power of attorney or other advanced directive under Chapter 166 Health and Safety Code, [09:21.880 --> 09:30.880] or 2, a designation of guardian before need arises under Section 679 Texas Probate Code. [09:30.880 --> 09:36.880] And in Subsection B, an employee or volunteer described by Subsection A must, [09:36.880 --> 09:44.880] 1, provide benefits counseling through an area agency on aging system of access and assistance to agency clients. [09:44.880 --> 09:50.880] 2, comply with the rules adopted by the Texas Department on Aging regarding qualifications, [09:50.880 --> 09:55.880] training requirements, and other requirements for providing benefits counseling services, [09:55.880 --> 09:59.880] including legal assistance and legal awareness services. [09:59.880 --> 10:07.880] 3, have received specific training in providing the technical advice, consultation, and assistance described by Subsection A, [10:07.880 --> 10:14.880] and 4, be certified by the Texas Department on Aging as having met the requirements of this subsection. [10:14.880 --> 10:21.880] Subsection C, the Texas Department on Aging by rule shall develop certification procedures [10:21.880 --> 10:27.880] by which the department certifies that an employee or volunteer described by Subsection A [10:27.880 --> 10:32.880] has met the requirements of Subsection B, 1, 2, and 3. [10:32.880 --> 10:40.880] Okay, so they're trying to create the appearance of only one exception to the practice of law. [10:40.880 --> 10:46.880] But again, notice that the exception is made to apply only to another governmental entity [10:46.880 --> 10:50.880] and those people employed by that entity. [10:50.880 --> 10:58.880] This is all statutory rules that we'll see here in a second when we get down to 81.102 [10:58.880 --> 11:03.880] where it specifically states state bar membership is required. [11:03.880 --> 11:11.880] But again, a rule can only apply to those that are subject to the whims of the rule maker. [11:11.880 --> 11:16.880] The people are not a part of the judicial branch of government per se. [11:16.880 --> 11:22.880] We created it, we have authority over it, but we are not a part of it. [11:22.880 --> 11:28.880] The rules that are promulgated inside the judicial branch have nothing to do with us. [11:28.880 --> 11:31.880] They don't apply. [11:31.880 --> 11:35.880] Section 81.102, state bar membership required. [11:35.880 --> 11:40.880] Subsection A, except as provided by Subsection B, [11:40.880 --> 11:47.880] a person may not practice law in this state unless the person is a member of the state bar. [11:47.880 --> 11:54.880] B, the Supreme Court may promulgate rules prescribing the procedure for limited practice of law by [11:54.880 --> 11:58.880] 1, attorneys licensed in another jurisdiction, [11:58.880 --> 12:01.880] 2, bona fide law students, [12:01.880 --> 12:09.880] and 3, unlicensed graduate students who are attending or who have attended a law school approved by the Supreme Court. [12:09.880 --> 12:16.880] Now let's take a second here and figure out where the Supreme Court fits into the grand judicial structure. [12:16.880 --> 12:24.880] We have two levels to the, or two parts of the high courts here. [12:24.880 --> 12:28.880] There is a criminal side, there is a civil side. [12:28.880 --> 12:32.880] The Supreme Court is over the civil. [12:32.880 --> 12:36.880] It makes rules regarding the civil. [12:36.880 --> 12:46.880] The Texas Court of Criminal Appeals makes the rules regarding the criminal outside of the Code of Criminal Procedure. [12:46.880 --> 12:48.880] So you see the difference here? [12:48.880 --> 12:52.880] Chapter 81, for the practice of law, [12:52.880 --> 13:00.880] if the rules are promulgated by the Supreme Court of Texas and they are civil in their power and authority only, [13:00.880 --> 13:07.880] then their rules apply only to those things that involve civil cases. [13:07.880 --> 13:14.880] If they're being given power and authority over criminal practices and procedures of law, [13:14.880 --> 13:19.880] why don't they have power over the cases? [13:19.880 --> 13:21.880] The thing is they don't. [13:21.880 --> 13:23.880] They're separate. [13:23.880 --> 13:32.880] So given that, we can see that this section right away does not apply to the practice of criminal legal counsel, [13:32.880 --> 13:36.880] only to civil legal counsel under specific conditions. [13:36.880 --> 13:38.880] How do we know this? [13:38.880 --> 13:45.880] There is only one penal law in Texas that deals with the unauthorized practice of law. [13:45.880 --> 13:55.880] That is 38.123 Penal Code, and it specifically states in its language that it applies only to someone [13:55.880 --> 14:03.880] who is seeking a financial benefit for themselves by representing or preparing documentation [14:03.880 --> 14:13.880] or acting as legal counsel for someone in a suit for recovery of personal injury damages. [14:13.880 --> 14:24.880] There is absolutely no penal code statute whatsoever that deals with acting and serving as legal counsel [14:24.880 --> 14:34.880] for anyone in a criminal case or in a civil case that is not for personal injury damages. [14:34.880 --> 14:44.880] So when they start threatening proceeds and those of us that file paperwork on behalf of other people [14:44.880 --> 14:49.880] with the unauthorized practice of law, they're going to have to overcome statute. [14:49.880 --> 14:58.880] Then they're going to have to show how a rule promulgated by a civil court gained authority [14:58.880 --> 15:09.880] in place of the valid law of the legislature to charge someone with an unauthorized practice of law rule [15:09.880 --> 15:13.880] that doesn't exist as a law. [15:13.880 --> 15:20.880] They're going to have a real hard time making that one work, [15:20.880 --> 15:25.880] especially if they tried on me or someone that's been to one of these courses like the one I had Saturday [15:25.880 --> 15:30.880] on charging instruments. They're going to have a real hard time convincing these people they're guilty of [15:30.880 --> 15:39.880] the unauthorized practice of law because the statute simply does not support the accusation. [15:39.880 --> 15:50.880] Now, if you think that's good, listen to this. Section 81.103, unauthorized practice of law committee. [15:50.880 --> 15:59.880] Subsection A, the unauthorized practice of law committee is composed of nine persons appointed by the Supreme Court. [15:59.880 --> 16:06.880] Subsection B, at least three of the committee members must be non-attorneys. [16:06.880 --> 16:16.880] Subsection C, committee members serve for staggered terms of three years with three members' terms expiring each year. [16:16.880 --> 16:21.880] Subsection D, a committee member may be reappointed. [16:21.880 --> 16:25.880] Notice these people are appointed, not elected. [16:25.880 --> 16:32.880] Subsection E, each year the Supreme Court shall designate a committee member to serve as chairperson. [16:32.880 --> 16:40.880] Subsection F, all necessary and actual expenses of the committee should be provided for and paid out of the budget of the state bar. [20:04.880 --> 20:11.880] Okay, let's pick up now with section 81.104, Texas Government Code. [20:11.880 --> 20:15.880] Duties of unauthorized practice of law committee. [20:15.880 --> 20:25.880] The unauthorized practice of law committee shall, one, keep the Supreme Court and the state bar informed with respect to, sub-item A, [20:25.880 --> 20:34.880] the unauthorized practice of law by laypersons and lay agencies and the participation of attorneys in that unauthorized practice of law, [20:34.880 --> 20:40.880] and sub-item B, methods for the prevention of the unauthorized practice of law, [20:40.880 --> 20:48.880] and subsection two, seek the elimination of the unauthorized practice of law by appropriate actions and methods, [20:48.880 --> 20:51.880] including the filing of suits in the name of the committee. [20:51.880 --> 20:56.880] Now this section we really want to talk about. [20:56.880 --> 21:02.880] Now the state bar pays to fund this committee. [21:02.880 --> 21:12.880] This section specifically says the purpose of this committee is to seek the elimination of the unauthorized practice of law by appropriate actions and methods, [21:12.880 --> 21:26.880] including the filing of suits, meaning the committee is given the power to sue an individual for the unauthorized practice of law. [21:26.880 --> 21:29.880] However, there's a slight problem here. [21:29.880 --> 21:40.880] How does the committee prove injury in a suit in order to make themselves have standing to sue to begin with? [21:40.880 --> 21:43.880] Who is the committee in all of this? [21:43.880 --> 21:49.880] If at least three members of this committee are required to be non-attorneys, [21:49.880 --> 21:57.880] what would be the standing of those three members to say that they were harmed by the unauthorized practice of law? [21:57.880 --> 22:02.880] How could they claim a harm? [22:02.880 --> 22:17.880] The real issue here is that this is what the state bar is doing and has got the legislature to authorize them to do to protect the money of the attorneys and their private practice. [22:17.880 --> 22:34.880] This is about controlling access to the courts by people to fight on behalf of other people that are not under the control of the judicial branch or any other branch for that matter. [22:34.880 --> 22:44.880] Let's look at this from a real-world perspective of why this is a problem when it comes to having the requirements or the need of an attorney. [22:44.880 --> 22:52.880] First off, the attorneys are managed and under the thumb of the attorney general. [22:52.880 --> 23:03.880] They're responsible in the executive branch for managing and administering all attorneys in Texas, but they're an executive branch office. [23:03.880 --> 23:21.880] The other problem this presents is that the State Bar Act of 1939 specifically, right here in Chapter 81, creates the state bar as an administrative office of the judicial branch of government. [23:21.880 --> 23:24.880] Now what's wrong with this picture so far? [23:24.880 --> 23:42.880] You have every single bar card-carrying attorney that by definition and default is a judicial officer simply by being a member of the bar, which clearly under law is an administrative agency of the judicial branch. [23:42.880 --> 23:55.880] Then you have an executive officer that is over all of these attorneys, supposedly, and is meant to regulate and control what they do. [23:55.880 --> 24:06.880] This is a complete and total violation of Article 2, Texas Constitution, Division of Powers. [24:06.880 --> 24:11.880] It is an absolute violation. [24:11.880 --> 24:25.880] Now the other real big problem this creates is that means that there can be no judicial officer in Texas that isn't a member of the bar. [24:25.880 --> 24:51.880] Every single important job in the courts, with the exception of the Supreme Court, certain justice courts, and certain municipal courts, there is the ability to absolutely prevent the common folk from getting into that position and serving the public. [24:51.880 --> 24:58.880] All of those offices are completely controlled by attorneys. [24:58.880 --> 25:09.880] The executive office, which is supposed to have oversight of the laws, should not be controlling attorneys per se. [25:09.880 --> 25:23.880] They should be prosecuting them, which their job requires them to do, but they can't direct them, they can't administer them, because they're in a different branch of government. [25:23.880 --> 25:33.880] They can only associate with them for acting in violation of law by enforcing that law. [25:33.880 --> 25:48.880] But instead, we have multiple branches of government operating in an intermixed fashion that is strictly completely forbidden in the Texas Constitution. [25:48.880 --> 25:52.880] And yet, they're doing it. [25:52.880 --> 26:05.880] Let's not forget the other little third problem caveat, that the state bar is an unconstitutional, illegal monopoly on the practice of law. [26:05.880 --> 26:23.880] It simply violates the very basis of the Texas Constitution, which says that monopolies are just evil. They are not allowed to exist in Texas under our Constitution at all. [26:23.880 --> 26:27.880] They are forbidden. [26:27.880 --> 26:37.880] And yet, the government has two, the practice of law and the creation of distilled liquor. [26:37.880 --> 26:58.880] What's wrong with this picture, people? The very document we the people created that said these things shall not exist have been completely disobeyed and ignored by the public servants we created with that very same document. [26:58.880 --> 27:08.880] This is a severe problem, and we the people are doing nothing about it. Why? [27:08.880 --> 27:12.880] That's a question we need to get an answer to, folks. [27:12.880 --> 27:31.880] 81.105, Texas Government Code, Local Committees. This chapter does not prohibit the establishment of local unauthorized practice of law committees to assist the unauthorized practice of law committee in carrying out its purpose. [27:31.880 --> 27:56.880] Section 81.106, immunity, subsection A, the unauthorized practice of law committee, any member of the committee or any person to whom the committee has delegated authority and who is assisting the committee is not liable for any damages for an act or omission in the course of the official duties of the committee. [28:14.880 --> 28:37.880] So as you can see, this has been set up through the legislature to fully protect these people for illegally harassing the people in helping each other with court issues, with legal counsel issues, with document preparation issues. [34:07.880 --> 34:19.880] He has actually gone and hired an attorney to help him with a particular traffic case, and I've been talking to him, you know, off and on about what his attorney is doing and such. [34:19.880 --> 34:32.880] And it turns out that his attorney has already started trying to say that he is not going to do certain things certain ways. [34:32.880 --> 34:40.880] He's not actually abiding by the code of criminal procedure. He's sold him down the river so far by waiving impersonal jurisdiction. [34:40.880 --> 34:54.880] And he entered a plea based solely upon the citation. And that is a problem. So I actually sent him a copy of the original motion that we filed now, motion number one. [34:54.880 --> 35:06.880] He is someone that has the seminar material. And I actually taught the class this past Saturday on the very issues that I spoke to him about to deal with his attorney. [35:06.880 --> 35:18.880] And this is the email that he sent me back today, and I'll read that to you. And hang on just a sec, folks. [35:18.880 --> 35:29.880] All right. Now, it says, Eddie, update. My lawyer ignored my emails all last week. Today I threatened a bar grievance, and he called me within two hours. [35:29.880 --> 35:40.880] He was angry at argumentative. He even tried to give me a refund for all the money I had paid him. He said I have no legal basis to dismiss based on the Texas Code of Criminal Procedure, blah, blah, blah. [35:40.880 --> 35:46.880] I told him it doesn't matter since the law violates the Texas Constitution. It is invalid. [35:46.880 --> 35:56.880] I particularly nailed him on the fact that you said he pled not guilty to a citation, and then the charging instrument, the complaint, is generated. [35:56.880 --> 36:02.880] He tried to say that he had not entered a plea yet, but he backed down when I reminded him that I have all the records. [36:02.880 --> 36:08.880] He also said he didn't appreciate the fact that I went down to the court to get the records and caused a scene. [36:08.880 --> 36:14.880] To make a long story short, he finally agreed to review the attached, which is the motion that I sent to them. [36:14.880 --> 36:21.880] He knows that unless he can convince me that the motion to dismiss has no legal basis, I will file a bar grievance. [36:21.880 --> 36:29.880] So I'll let you know what he comes back with. I told him no later than the 23rd because after the holidays, we'll be in close to 10 days of the pretrial. [36:29.880 --> 36:42.880] So we now have someone that has taken our first motion and given it to their attorney and demanded the attorney read it and either prove it wrong or apply what it says. [36:42.880 --> 36:47.880] Now, folks, here's what I believe you can expect out of this. [36:47.880 --> 36:55.880] First off, no attorney is going to admit he's been stupid, not if he can get away with it. [36:55.880 --> 37:08.880] But there's also going to be a real hard problem for this attorney to say this is not what the law means because it's written right there in black and white. [37:08.880 --> 37:20.880] The Code of Criminal Procedure says in the very beginning that its purpose and intent is to ensure that not only those that are required to prosecute the law under its provisions, [37:20.880 --> 37:30.880] but those whose rights are affected by it can completely and totally understand its meaning and intent. [37:30.880 --> 37:38.880] So it is written for the layman. It is written for everyone to be able to understand. [37:38.880 --> 37:54.880] So if an attorney says you don't understand it, you tell him he's a moron for suggesting such because Chapter 1 of the Code of Criminal Procedure says it was written specifically for you and I to understand it. [37:54.880 --> 38:06.880] And for the attorney to state otherwise proves not only his ignorance of the facts but of the actual law under which he is supposed to be operating. [38:06.880 --> 38:14.880] So people, the problem is the attorneys don't care enough to actually learn the law. [38:14.880 --> 38:22.880] They trust entirely upon what they're being told rather than what the law says. [38:22.880 --> 38:31.880] And when they do that, it causes problems for all of the rest of us. [38:31.880 --> 38:42.880] It causes us problems because the next person that comes along having to deal with an attorney listens to an attorney who doesn't know what they're talking about. [38:42.880 --> 38:47.880] And this gentleman is a prime example of that. [38:47.880 --> 38:59.880] I did have a chance to speak with an attorney that has attended one of my seminars and actually got to sit down and discuss with her how to defend a traffic case. [38:59.880 --> 39:05.880] And she actually thought that one of the suggestions I made was extremely clever and good. [39:05.880 --> 39:11.880] That's not to toot my own horn, but this is from an actual licensed attorney. [39:11.880 --> 39:24.880] When I explained to her that Chapter 543 Texas Transportation Code clearly states that the person being issued a citation is in a custodial arrest, [39:24.880 --> 39:37.880] that anytime the police officer demands that they provide him or her with any information that can be used against them in a court of law, [39:37.880 --> 39:44.880] they must be aware that their Fifth Amendment protections have already been invoked. [39:44.880 --> 40:00.880] Even though the officer hasn't told you you're under arrest, you are under arrest because the law created that specific requirement before the officer could issue you a citation. [40:00.880 --> 40:15.880] Chapter 543 clearly says the arresting officer may release the person arrested from custody if they sign the promise to appear. [40:15.880 --> 40:30.880] So how can you not be in a custodial arrest and an arresting officer can release you as the arrested person from custody? [40:30.880 --> 40:45.880] It would take a real politician to make the argument that you're not in a custodial arrest. And I do not use the term politician in a kind way whatsoever. [40:45.880 --> 40:54.880] There are many, many names under the sun I would rather have myself called than a bureaucrat or a politician. [40:54.880 --> 41:06.880] And most of us would consider those alternate names dirty and I would still rather be called them than politician or bureaucrat. [41:06.880 --> 41:19.880] But the problem is these guys are clueless as to what the rights of the public are, what the law requires them to be doing to protect the rights of the public, and so on and so forth. [41:19.880 --> 41:33.880] They have absolutely no idea because they haven't read it. We have allowed them to make us believe they're the only ones capable of understanding it. [41:33.880 --> 41:42.880] Personally, I wouldn't give an attorney credit for knowing how to open a box of cereal. [41:42.880 --> 41:51.880] I don't think most of them could pour water out of a bucket if the instructions were written on the bottom. [41:51.880 --> 42:01.880] They're just that inept at simply doing something that is based upon common sense and logic. [42:01.880 --> 42:16.880] It's a certainty they're not getting it based upon the law because most of them will tell you quite clearly just by their actions and their responses that they don't have a clue what the law says. [42:16.880 --> 42:23.880] If they did, they wouldn't be trying to argue that it doesn't apply. [42:23.880 --> 42:39.880] At the seminar this weekend after this gentleman sent me the previous email where he brought to his attorney's attention that the criminal complaint that was filed against him in court was invalid. [42:39.880 --> 42:45.880] It did not meet the criteria of the Texas Constitution or the Texas statutes. [42:45.880 --> 42:50.880] It was not properly filed, and it contained erroneous information. [42:50.880 --> 42:54.880] Well, he told his attorney. [42:54.880 --> 42:57.880] The attorney said it doesn't matter if we complain about it. [42:57.880 --> 43:01.880] The state will just correct it and refile it. [43:01.880 --> 43:05.880] And I had to shake my head. [43:05.880 --> 43:11.880] And the question that I would like for you, Patrick, to ask your attorney is this. [43:11.880 --> 43:28.880] Is it your professional opinion and advice that I allow an obviously faulty complaint to be used against me to prosecute me in a criminal case? [48:56.880 --> 49:09.880] And the citation, the date that I was supposed to appear before was actually before the date I actually got stopped. [49:09.880 --> 49:13.880] So it was impossible to make it there before the date listed on the citation. [49:13.880 --> 49:19.880] So I called the court and I said, hey, what are we going to do about this? [49:19.880 --> 49:22.880] And they said, well, we sent you a letter in the mail to correct that. [49:22.880 --> 49:24.880] And I said, well, I never got it. [49:24.880 --> 49:28.880] And that's true because I only go home about every two weeks. [49:28.880 --> 49:40.880] But anyway, so they sent me another one, another letter in the mail that says State of Texas v. Hondo Davis docket number. [49:40.880 --> 49:47.880] And it says it's a pretrial dated, I'm supposed to be there December 8th at 9 a.m. [49:47.880 --> 49:55.880] And it says, at this conference, you must dispose of all pretrial matters, including but not limited to the following, [49:55.880 --> 50:00.880] exceptions to the compliant motions for continuance and the whole list of things. [50:00.880 --> 50:07.880] And it says any other pretrial issues requested by either party. [50:07.880 --> 50:22.880] And then it also says that somewhere it said that I had to have all pretrial motions in seven days before the court date. [50:22.880 --> 50:25.880] And I just wanted to ask you, are you all still there? [50:25.880 --> 50:27.880] Yeah, we're here. [50:27.880 --> 50:29.880] Okay. [50:29.880 --> 50:42.880] I just wanted to ask you if I do, in fact, have to have any motions in seven days before the pretrial. [50:42.880 --> 50:46.880] I mean, let's see. [50:46.880 --> 50:48.880] The date on the letter is the 8th. [50:48.880 --> 50:50.880] When did you receive it? [50:50.880 --> 50:53.880] Well, I just picked it up today. [50:53.880 --> 50:55.880] When is it postmarked? [50:55.880 --> 51:02.880] It is postmarked, November 16th. [51:02.880 --> 51:04.880] Okay. [51:04.880 --> 51:05.880] Okay. [51:05.880 --> 51:14.880] Well, legally speaking, they've at least got the proper amount of time because they've given you no less than 20 days to get it done. [51:14.880 --> 51:15.880] Right. [51:15.880 --> 51:24.880] So all they're saying is that they're not going to take a look at any motions that are filed within the seven days. [51:24.880 --> 51:33.880] The problem here, however, is even though it was mailed on those days, you said it was sent certified mail or it was not? [51:33.880 --> 51:36.880] It was sent certified return receipt. [51:36.880 --> 51:40.880] And that's why I didn't get it because I'm only there on the weekends if I'm at home. [51:40.880 --> 51:44.880] And post office, I had to go pick it up at the post office. [51:44.880 --> 51:45.880] Okay. [51:45.880 --> 51:46.880] So that's the day you signed for it. [51:46.880 --> 51:47.880] When was that? [51:47.880 --> 51:49.880] It was today. [51:49.880 --> 51:50.880] Okay. [51:50.880 --> 51:52.880] Then that's the problem. [51:52.880 --> 51:57.880] They can't limit you to the seven days if you did not receive the mail before today. [51:57.880 --> 52:00.880] You have no less than 10 days prior to trial. [52:00.880 --> 52:07.880] Now, you remember one of the other things we covered Saturday, do you not, Hondo, regarding the complaint? [52:07.880 --> 52:08.880] Right. [52:08.880 --> 52:20.880] You're entitled to have a copy of that complaint no less than 10 days prior to any proceeding in the conviction or in the process. [52:20.880 --> 52:22.880] Whether it's pretrial, anything. [52:22.880 --> 52:23.880] Do what? [52:23.880 --> 52:24.880] Right. [52:24.880 --> 52:26.880] Any proceeding whatsoever, pretrial. [52:26.880 --> 52:28.880] Any proceeding whatsoever. [52:28.880 --> 52:34.880] That's exactly how the statute reads. [52:34.880 --> 52:35.880] Okay. [52:35.880 --> 52:44.880] So they would have had to amend it if, let's say, they wanted to use my original citation as a complaint like they usually do, [52:44.880 --> 52:53.880] they would have had to amend that original complaint because it was faulty and provide me with a copy thereof. [52:53.880 --> 52:56.880] That's correct. [52:56.880 --> 53:02.880] But the problem is, as you well know, the citation is not a complaint, does not meet the requisites of a complaint, [53:02.880 --> 53:05.880] and you cannot plead to a citation. [53:05.880 --> 53:06.880] Right. [53:06.880 --> 53:07.880] Okay. [53:07.880 --> 53:13.880] So the first thing you're going to want to know is what's in the court record, of course. [53:13.880 --> 53:14.880] Right. [53:14.880 --> 53:25.880] And if there is no actual signed and verified complaint in the court record, then you file a judicial conduct complaint against the judge for calling you to court. [53:25.880 --> 53:29.880] Now, who signed the summons? [53:29.880 --> 53:33.880] It is, it's actually not signed at all. [53:33.880 --> 53:37.880] It just says thank you, municipal court judge. [53:37.880 --> 53:39.880] It's not signed? [53:39.880 --> 53:42.880] It's not signed whatsoever. [53:42.880 --> 53:44.880] Not even like a... [53:44.880 --> 53:45.880] Okay. [53:45.880 --> 53:49.880] Well, let's talk about more gross stupidity here then. [53:49.880 --> 53:55.880] What did we study this Saturday regarding the issuance of a capus in the summons? [53:55.880 --> 54:01.880] They're absolutely required to be sent out by the court in written form. [54:01.880 --> 54:03.880] Are they not? [54:03.880 --> 54:04.880] Mm-hmm. [54:04.880 --> 54:13.880] And in that written form, one of the things that's required, let me see if I can find it in the thing here. [54:13.880 --> 54:14.880] Let's see. [54:14.880 --> 54:25.880] In our motion, we have a valid summons in 23.04 Texas Code of Criminal Procedure. [54:25.880 --> 54:31.880] In misdemeanor cases, the capus or summons shall issue from a court having jurisdiction of the case. [54:31.880 --> 54:41.880] The summons shall be issued only upon request of the attorney representing the state and shall follow the same form and procedure as in a felony case. [54:41.880 --> 54:49.880] Now, in a felony case, 23.03A says the following. [54:49.880 --> 54:58.880] A capus shall be issued by the district clerk upon each indictment for felony presented after bail has been set or denied by the judge of the court. [54:58.880 --> 55:04.880] Upon the request of the attorney representing the state, a summons shall be issued by the district clerk. [55:04.880 --> 55:13.880] The capus or summons shall be delivered by the clerk or mailed to the sheriff of the county where the defendant resides or is to be found. [55:13.880 --> 55:18.880] So this was not hand-delivered by the sheriff, was it? [55:18.880 --> 55:19.880] No, sir. [55:19.880 --> 55:22.880] It wasn't issued by, well, I don't know if it was. [55:22.880 --> 55:27.880] And there's no stamp on it showing that it was issued by a court, correct? [55:27.880 --> 55:31.880] Well, it's on the municipal court letterhead. [55:31.880 --> 55:38.880] Regardless of that, there's no stamp and signature certifying it as being originated within the court, is there? [55:38.880 --> 55:40.880] No, not at all. [55:40.880 --> 55:46.880] Okay. Now, there's nothing in the statute that says that has to be there, but let's think about this logically. [55:46.880 --> 56:00.880] How can it be issued by a court having jurisdiction if it is not signed and stamped as an actual process summoned from the court? [56:00.880 --> 56:01.880] Right. The attorney told me personally that he was not going to represent me, [01:10:49.880 --> 01:10:53.880] and I asked him to send me a copy of everything he had in my file. [01:10:53.880 --> 01:11:03.880] He said the insurance claims adjuster for the person that hit me had determined that it was not their client's fault, [01:11:03.880 --> 01:11:07.880] that it was my fault, and so therefore, they weren't going to represent me. [01:11:07.880 --> 01:11:12.880] So I've got just a bad problem. What do I need to do? [01:11:12.880 --> 01:11:14.880] What does the police report say? [01:11:14.880 --> 01:11:22.880] The police report said that I claimed that she ran the red light and that she claimed that I ran the red light. [01:11:22.880 --> 01:11:24.880] What did the other witnesses say? [01:11:24.880 --> 01:11:32.880] There were no other witnesses there. It was her and her vehicle, me and my vehicle. It was 15 minutes until 11. [01:11:32.880 --> 01:11:39.880] Are there traffic cameras at this location on top of the lights or on any of the poles or anything like that? [01:11:39.880 --> 01:11:47.880] No, there sure aren't. There is a toot and totem there, and that points at the gas pumps, [01:11:47.880 --> 01:11:56.880] and their gas pumps are right there. They're right on the corner, and I was thinking maybe they would have something there from their file, from their camera. [01:11:56.880 --> 01:12:04.880] I told the lawyer about it, and he said, oh, that's a long shot. She says that you ran it. [01:12:04.880 --> 01:12:11.880] Well, you go and get that video. Whether your lawyer wants it or not, go get that video. [01:12:11.880 --> 01:12:18.880] So I called, and I tried to tell the attorney before. See, he just fired me today. [01:12:18.880 --> 01:12:27.880] I mean, he just said, I'm not helping you today. He just told me today he would be sending me a letter that said that he's not going to represent me, [01:12:27.880 --> 01:12:35.880] and I said, well, then send me a copy of everything that you have in your file and everything you have on your computer concerning my case, [01:12:35.880 --> 01:12:46.880] and I want to know what. I don't want any presumptions. I want the facts, how this person from this claims representative company for insurance, [01:12:46.880 --> 01:12:57.880] how that person came to the assumption that I was the person at fault, and I have since written him a letter also telling him I didn't want any presumptions. [01:12:57.880 --> 01:13:02.880] I wanted the facts, and they sent me a copy of everything on how he came to that conclusion [01:13:02.880 --> 01:13:10.880] and a copy of everything that he had in this file about what happened during the accident and everything like that. [01:13:10.880 --> 01:13:26.880] I called the convenience store, and I told them that I had been in an accident and that I would like to have a copy of their film for that day, [01:13:26.880 --> 01:13:37.880] and they told me I'd have to go through the police department to obtain a copy of their tape. [01:13:37.880 --> 01:13:39.880] Why is that? [01:13:39.880 --> 01:13:47.880] I have no idea. That just sounded idiotic to me too, Eddie. When I heard that, I just was like, this makes no sense at all. [01:13:47.880 --> 01:13:53.880] It makes no sense at all for the attorney to tell me that he would help me, and then all of a sudden, [01:13:53.880 --> 01:14:02.880] the attorney's telling me to talk to the claims adjuster about the wreck, and I was like, that didn't make any sense to me either. [01:14:02.880 --> 01:14:12.880] Well, one of the things I'd recommend you do is go down and see if you can get a court order for discovery from a district court in your area [01:14:12.880 --> 01:14:17.880] where your case would be filed if you were going to get it filed soon. [01:14:17.880 --> 01:14:29.880] Go down and see if you can get an order of discovery that you can file on this tootin' totem, whatever it is, for a copy of that video. [01:32:59.880 --> 01:33:05.880] And I'm going to need a little bit of thinking power to figure out exactly what they did wrong that evening. [01:33:23.880 --> 01:33:31.880] And if there is no statute or internal rule regarding that particular usage of your signature, they have no leg to stand on. [01:33:41.880 --> 01:33:52.880] Well, you know, it's interesting because I'm familiar with an attorney general decision that was done when John Cornyn was attorney general. [01:33:52.880 --> 01:34:01.880] And he discussed the various statements that people write below their signature on documents. [01:34:01.880 --> 01:34:02.880] Right. [01:34:02.880 --> 01:34:07.880] And he recommended that those, he didn't state that this was an attorney general ruling, [01:34:07.880 --> 01:34:14.880] but he recommended that agencies not accept those signatures with the caveats underneath the signature. [01:34:14.880 --> 01:34:20.880] And I never do always put them above and then I sign, you know, the proper way because I'm attesting to that caveat. [01:34:20.880 --> 01:34:21.880] Right. [01:34:21.880 --> 01:34:26.880] Well, the problem they have is even the attorney general's opinion does not constitute law. [01:34:26.880 --> 01:34:29.880] His opinion has to be based on law. [01:57:18.880 --> 01:57:26.880] The penal code applies to everyone as far as a type of crime is concerned. [01:57:26.880 --> 01:57:30.880] They are actual crimes as far as what the common law constitutes as a crime, [01:57:30.880 --> 01:57:32.880] most of the time. [01:57:32.880 --> 01:57:35.880] Now, that's not true of all of them. [01:57:35.880 --> 01:57:40.880] But the penal code is supposed to be that body of law that applies to all men [01:57:40.880 --> 01:57:47.880] for the purpose of punishment, a violation of the rights or property of another. [01:57:47.880 --> 01:57:51.880] In that regard, that code applies to all. [01:57:51.880 --> 01:58:00.880] However, the question is does the code comply with the session law that created that code? [01:58:00.880 --> 01:58:03.880] That's what we have to find out and what we have to know. [01:58:03.880 --> 01:58:09.880] The rest of the codes are usually administrative in nature and don't apply to us.
