--> 04:22.240] He has a lot of seminar work going on [04:22.240 --> 04:26.240] It is Monday night, which is our traffic discussion night [04:26.240 --> 04:29.240] Tonight I would like to start off with presenting you with some information [04:29.240 --> 04:33.240] that I was going through today out of the local government code [04:33.240 --> 04:34.240] for here in Texas [04:34.240 --> 04:40.240] This is section 87, which is removal of county officers from office [04:40.240 --> 04:42.240] and filling of vacancies [04:42.240 --> 04:47.240] Now when you're reading down through this, you're going to find some interesting things here [04:47.240 --> 04:51.240] Mainly it's got a list of who can be removed [04:51.240 --> 04:55.240] and the fact that they can be removed by a district judge [04:55.240 --> 04:59.240] There is nothing in this section, however, for removing a district judge [04:59.240 --> 05:03.240] which I find kind of odd, considering that at least in my district [05:03.240 --> 05:07.240] some of the biggest criminals here are the district judges [05:07.240 --> 05:11.240] and the least knowledgeable in the law are the district judges [05:11.240 --> 05:19.240] But the part that I wanted to go over real quick is how this occurs [05:19.240 --> 05:22.240] I want to read you a couple of the sections out of this [05:22.240 --> 05:30.240] Section 87.015, petition for removal, subsection A [05:30.240 --> 05:36.240] A proceeding for the removal of an officer is begun by filing a written petition for removal [05:36.240 --> 05:40.240] in a district court of the county in which the officer resides [05:40.240 --> 05:42.240] meaning the officer that you want removed [05:42.240 --> 05:46.240] However, a proceeding for the removal of a district attorney [05:46.240 --> 05:50.240] is begun by filing a written petition in a district court of [05:50.240 --> 05:53.240] one, the county in which the attorney resides [05:53.240 --> 05:57.240] or two, the county where the alleged cause of removal occurred [05:57.240 --> 06:01.240] if that county is in the county attorney's judicial district [06:01.240 --> 06:08.240] Subsection B, any resident of this state who has lived for at least six months [06:08.240 --> 06:11.240] in the county in which the petition is to be filed [06:11.240 --> 06:14.240] and who is not currently under indictment in the county [06:14.240 --> 06:16.240] may file the petition [06:16.240 --> 06:19.240] Now I'm going to break right there for just a second [06:19.240 --> 06:22.240] In Nacogdoches County, you go to a district judge [06:22.240 --> 06:27.240] and ask them to file a court document for any reason [06:27.240 --> 06:31.240] and they'll threaten you with the unlicensed practice of law [06:31.240 --> 06:37.240] They did that to someone that I sent to file a habeas corpus for her son [06:37.240 --> 06:42.240] The judge threatened her with the unlicensed practice of law [06:42.240 --> 06:49.240] when the law very specifically states that anyone can file a habeas corpus [06:49.240 --> 06:55.240] So, and not one district judge did it, but both district judges did it [06:55.240 --> 07:00.240] Both of them threatened her because she was not a licensed attorney [07:00.240 --> 07:07.240] So if that's not proof positive these gentlemen do not know the law, there it is [07:07.240 --> 07:12.240] Okay, now, let me continue on here [07:12.240 --> 07:17.240] The rest of Subsection B, at least one of the parties who files the petition [07:17.240 --> 07:20.240] must swear to it at or before the filing [07:20.240 --> 07:27.240] Subsection C, the petition must be addressed to the district judge of the court in which it is filed [07:27.240 --> 07:33.240] The petition must set forth the grounds alleged for the removal of the officer in plain and intelligible language [07:33.240 --> 07:38.240] and must cite the time and place of the occurrence of each act alleged as a ground for removal [07:38.240 --> 07:42.240] with as much certainty as the nature of the case permits [07:42.240 --> 07:47.240] Section 87.016, Citation of Officer [07:47.240 --> 07:51.240] Subsection A, after a petition for removal is filed [07:51.240 --> 07:56.240] the person filing the petition shall apply to the district judge in writing for an order [07:56.240 --> 08:02.240] requiring a citation and a certified copy of the petition to be served on the officer [08:02.240 --> 08:08.240] Subsection B, if the application for the order is made during the term of the court [08:08.240 --> 08:13.240] action may not be taken on the petition until the order is granted and entered in the minutes of the court [08:13.240 --> 08:17.240] If the application is made to the judge during the vacation of the court [08:17.240 --> 08:20.240] the judge shall indicate on the petition the action taken [08:20.240 --> 08:24.240] and shall have the action entered in the minutes of the court at the next term [08:24.240 --> 08:30.240] Subsection C, if the judge refuses to issue the order for citation [08:30.240 --> 08:36.240] the petition shall be dismissed at the cost of the person filing the petition [08:36.240 --> 08:41.240] The person may not take an appeal or writ of error from the judge's decision [08:41.240 --> 08:47.240] If the judge grants the order for citation, the clerk shall issue the citation with a certified copy of the petition [08:47.240 --> 08:54.240] The judge shall require the person filing the petition to pose security for costs in the manner provided for other cases [08:54.240 --> 09:01.240] Subsection D, the citation shall order the officer to appear and answer the petition on a date fixed by the judge [09:01.240 --> 09:05.240] after the fifth day after the date the citation is served [09:05.240 --> 09:08.240] The term is computed as it is in other suits [09:08.240 --> 09:16.240] Now, one more section here, 87.017, Suspension Pending Trial Temporary Appointee [09:16.240 --> 09:22.240] Subsection A, after the issuance of the order requiring citation of the officer [09:22.240 --> 09:28.240] the district judge may temporarily suspend the officer and may appoint another person to perform the duties of the office [09:28.240 --> 09:36.240] Subsection B, the judge may not suspend the officer until the person appointed to serve executes a bond [09:36.240 --> 09:44.240] with at least two good and sufficient sureties in an amount fixed by the judge and conditioned as required by the judge [09:44.240 --> 09:53.240] The bond shall be used to pay damages and costs to the suspended officer if the grounds for removal are found at trial to be insufficient or untrue [09:53.240 --> 10:00.240] In an action to recover on the bond, it is necessary to allege and prove that the temporary appointee actively aided [10:00.240 --> 10:04.240] and instigated the filing and prosecution of the removal action [10:04.240 --> 10:10.240] The suspended officer must also serve written notice on the temporary appointee and the appointee's bondsman [10:10.240 --> 10:17.240] within 90 days after the date the bond is executed, stating that the officer intends to hold them liable on the bond [10:17.240 --> 10:19.240] and stating the grounds for that liability [10:19.240 --> 10:26.240] If the final judgment establishes the officer's right to the office, the county shall pay the officer from the general fund of the county [10:26.240 --> 10:30.240] an amount equal to the compensation received by the temporary appointee [10:30.240 --> 10:44.240] Okay, my biggest problem here so far is 87.016. Subsection C, if the judge refuses to issue the order for citation [10:44.240 --> 10:48.240] the petition shall be dismissed at the cost of the person filing the petition [10:48.240 --> 10:57.240] Now, I don't know about you, but I have absolutely no faith that a judge is going to act against another public servant [10:57.240 --> 11:00.240] no matter what they've done [11:00.240 --> 11:09.240] So I can almost guarantee you that out of hand a judge is going to refuse the order for citation [11:09.240 --> 11:18.240] I know in this county they will because I've had first-hand experience with these judges refusing to abide by the law [11:18.240 --> 11:24.240] When I had the issues going on with the comptroller's office, I went down and filed an emergency injunction [11:24.240 --> 11:32.240] The judge insisted he had no jurisdiction because all tax collection matters must be taken through the court in Travis County [11:32.240 --> 11:41.240] What the judge failed to understand or take any notice of whatsoever is that the law is very specific [11:41.240 --> 11:51.240] Chapter 111 of the tax code specifically states that a collection action is initiated by the filing of a suit by the attorney general [11:51.240 --> 11:57.240] Well, there was no suit filed by the attorney general in my case [11:57.240 --> 12:01.240] There was no suit filed by the comptroller in my case [12:01.240 --> 12:10.240] Their officers just showed up with an armed goon squad full of automatic weapons and body armor and seized my business [12:10.240 --> 12:13.240] There was no suit [12:13.240 --> 12:23.240] So the letter of the law was not followed nor was it complied with in any way, shape, or form by anybody there, especially the judge [12:23.240 --> 12:33.240] who ignored that requirement of the law and refused to act upon my injunctive relief [12:33.240 --> 12:42.240] So folks, these people do not understand and even if they do, they do not care what the law says [12:42.240 --> 12:47.240] This is the reason we want to get in front of the legislature in Austin [12:47.240 --> 12:54.240] This is the reason why we need to assemble there en masse the day that we have this meeting [12:54.240 --> 12:59.240] We need to fill that gallery to overflowing [12:59.240 --> 13:09.240] And we need to make our presence felt, heard, seen, and announced that we've had enough [13:09.240 --> 13:12.240] We want this problem solved [13:12.240 --> 13:14.240] Here's the list of problems [13:14.240 --> 13:20.240] Here are the people's demands to correct the problem [13:20.240 --> 13:27.240] So when that day comes, as soon as we're able to get it set up and completed and we know when it is, we'll make sure we announce it on the show [13:27.240 --> 13:38.240] But folks, the information I gave out the other night on contacting the chairperson, the Speaker of the House for the state legislature [13:38.240 --> 13:45.240] Please put that to good use. Write in, call in, demand that they make this happen [13:45.240 --> 13:52.240] Demand that they assemble and listen to the petition of the people to tell them what they want fixed and why [13:52.240 --> 13:56.240] Because if we don't do it, it's not going to get done [13:56.240 --> 14:05.240] This section right here is going to be one of the first things, or one of the things out of the 50 I've got arranged already to be dealing with [14:05.240 --> 14:12.240] Which one of the primary issues I'm going to be bringing up down there is the absolute corruption of the justice system [14:12.240 --> 14:22.240] Right down from the clerk to every judge that will not obey the law, will not even read the law [14:22.240 --> 14:27.240] If we fix the judges, then we can fix the rest of it [14:27.240 --> 14:34.240] Because the judges are the linchpin that makes all the abuse viable for the government [14:34.240 --> 14:43.240] We put the judges under a magnifying glass in the hot sun and get that little bead drawed on them when we start seeing smoke curl up off their back [14:43.240 --> 14:51.240] We're going to get some action and it's going to be the kind we want. Let's make that happen [14:51.240 --> 14:57.240] Okay, Debra, you said there was an article that you may wish to mention tonight [14:57.240 --> 15:13.240] Yes, there's an article that came out just this past Friday actually concerning Arizona, this Arizona case [15:13.240 --> 15:28.240] It has to do with the federal lawsuit that has been filed by the federal government against the state of Arizona about Arizona's immigration law [15:28.240 --> 15:30.240] Which is not even an immigration law [15:30.240 --> 15:41.240] Basically what the law says is that if somebody has already been pulled over for a traffic stop like they ran a red light or they're suspected DUI or whatever [15:41.240 --> 15:43.240] Normal traffic stop [15:43.240 --> 15:52.240] If there's some kind of suspicion, reasonable suspicion on the part of the officer that the person he pulled over is not a U.S. citizen [15:52.240 --> 15:58.240] Like say for example they can't speak English, that would be a heads up [15:58.240 --> 16:04.240] Well then the officer would have the authority to request proof of immigration [16:04.240 --> 16:14.240] And if the person could not provide proof of citizenship status for the United States then the officer would then have the authority to arrest that person [16:14.240 --> 16:19.240] And turn them over to the U.S. immigration department [16:19.240 --> 16:24.240] I mean that's not a big deal people. I thought the police could already do that anyway [16:24.240 --> 16:34.240] I mean anytime you suspect somebody is not a proper citizen of this country, a documented citizen of this country, anybody could call immigration [16:34.240 --> 16:45.240] Okay so at any rate when we get back I'm going to read this article reporting on this hearing that was held, the first hearing in this case [16:45.240 --> 16:49.240] And you can tell right off the bat whose side the federal judge is on [16:49.240 --> 16:56.240] And it ain't the federal government so I'll tell you that. She had some very scathing remarks for the U.S. Solicitor General [16:56.240 --> 17:23.240] And I'll explain on the other side. So yeah basically the Arizona law says that if you've already been pulled over for a traffic violation [18:22.240 --> 18:32.240] Or some kind of an alleged traffic violation and an officer suspects that you're not either a U.S. citizen or a citizen of a state or an American citizen [18:32.240 --> 18:37.240] Alright so please do not send me 10,000 Skype chats about don't you know the difference between a U.S. citizen and a man [18:37.240 --> 18:50.240] Don't even go there okay. So basically the bottom line is that if there's any reason to believe that the person is not a U.S. citizen [18:50.240 --> 19:00.240] Or an American citizen or a citizen of a state then the officer can request to see proof of their immigration status [19:00.240 --> 19:08.240] And if that's not provided or proper citizenship documentation for whichever type of citizen they may happen to be is not provided [19:08.240 --> 19:16.240] Then they can at that point arrest the person and turn them over to the immigration department [19:16.240 --> 19:19.240] Which I believe has been incorporated into the Department of Homeland Security [19:19.240 --> 19:28.240] Okay so I'm going to read this article from the Washington Post. This came out on Friday concerning what happened at this hearing [19:28.240 --> 19:42.240] The first hearing where the U.S. government, the federal government is petitioning to have basically that there would be no enforcement of this law until the end of this lawsuit [19:42.240 --> 19:48.240] Now the judge hasn't ruled on the case but like I said you can tell from reading this article whose side the judge is on already [19:48.240 --> 19:59.240] Okay here it is. A federal judge pushed back Thursday against a contention by the Obama Justice Department that a tough new Arizona immigration law set to take effect next week [19:59.240 --> 20:06.240] Would cause irreparable harm and intrude into the federal immigration enforcement [20:06.240 --> 20:14.240] The judge says why can't Arizona be as inhospitable as they wish to people who have entered or remain in the United States? [20:14.240 --> 20:21.240] U.S. District Judge Susan Bolton asked in appointed exchange with Deputy Solicitor General Edwin Needler [20:21.240 --> 20:28.240] Her comment came during a rare federal court hearing in the Justice Department's lawsuit against Arizona and Governor Jan Brewer [20:28.240 --> 20:38.240] Bolton, a Democratic appointee, also questioned a core part of the Justice Department's argument that she should declare the law unconstitutional [20:38.240 --> 20:46.240] Quote, that it is preempted by federal law because immigration enforcement is an exclusive federal prerogative [20:46.240 --> 20:54.240] How is there a preemption issue? the judge asked. I understand there may be other issues but you're arguing preemption [20:54.240 --> 21:01.240] Where is the preemption if everybody who is arrested for some crime has their immigration status checked? Borna, Arizona's lead attorney [22:31.240 --> 22:36.240] Well, the status quo is simply unacceptable [22:36.240 --> 22:41.240] The law, which Brewer signed in April, empowers police to question people they have [22:41.240 --> 22:48.240] Quote, reasonable suspicion are illegal immigrants and to send them to federal authorities for possible deportation [22:48.240 --> 22:54.240] President Obama, or should I say, Barry Sartaro, has strongly condemned the law [22:54.240 --> 23:01.240] And the Justice Department filed suit July 6, setting up an unusual clash between the federal government and the state [23:01.240 --> 23:04.240] Over who should enforce the nation's immigration laws [23:04.240 --> 23:09.240] Bolton did not indicate how she might rule, saying only that she will take the matter under advisement [23:09.240 --> 23:14.240] But she did subject Justice Department lawyers to some pointed questions [23:14.240 --> 23:21.240] Needler responded to her query about why Arizona authorities don't have the right to be inhospitable to illegal immigrants [23:21.240 --> 23:26.240] By saying the law has given the state the power to enforce immigration law [23:26.240 --> 23:31.240] Quote, in frankly an unprecedented and dramatic way [23:31.240 --> 23:32.240] All right, I'm going to break here [23:32.240 --> 23:41.240] I don't see how this Arizona law is granting the police with any power to enforce immigration issues whatsoever [23:41.240 --> 23:46.240] It just gives them the authority to question and check their immigration status [23:46.240 --> 23:50.240] And if they can't provide proof of it, then they turn them over to the feds [23:50.240 --> 23:53.240] Okay, again, I don't see what the big deal is [23:53.240 --> 23:59.240] Anybody can do that, anybody can call the immigration department if they suspect somebody is an illegal alien [23:59.240 --> 24:03.240] So whatever, at any rate, back to the article [24:03.240 --> 24:08.240] Quote, it is not for one of our states to be inhospitable in the way this statute does [24:08.240 --> 24:14.240] Needler said, citing his main argument, the legal doctrine of preemption [24:14.240 --> 24:20.240] Based on the Constitution's supremacy clause, it says federal law trumps state statutes [24:20.240 --> 24:26.240] Because the federal government has, quote, preeminent authority to regulate immigration matters [24:26.240 --> 24:30.240] The government's lawsuit argues the Arizona law must be struck down [24:30.240 --> 24:33.240] Bolton questioned key parts of that argument [24:33.240 --> 24:38.240] Especially relating to a section of the law that appears to require immigration status checks [24:38.240 --> 24:45.240] If police stop someone for another law enforcement purpose and suspect the person is an illegal immigrant [24:45.240 --> 24:50.240] Needler said the conflict with the federal law comes because the status checks are mandatory [24:50.240 --> 24:58.240] Which could lead to federal agencies being overwhelmed with deportation requests [24:58.240 --> 25:06.240] Top officials at U.S. Immigration and Customs Enforcement, whose agents will handle most of the calls from Arizona authorities [25:06.240 --> 25:11.240] If the law takes effect, have said they will not necessarily respond to every call [25:11.240 --> 25:18.240] Okay, folks, I just nearly fell out of my chair laughing when I read that paragraph in this article [25:18.240 --> 25:23.240] If I was the judge, I think I would have fallen out of the chair laughing on the bench [25:23.240 --> 25:30.240] Needler, this is the government solicitor general, is saying that there's a conflict with federal law [25:30.240 --> 25:37.240] Because basically the federal agencies would be overwhelmed with deportation requests [25:37.240 --> 25:44.240] Okay, if I was the judge, I would have said, Mr. Needler, can you please show me the statute [25:44.240 --> 25:50.240] That says that these agencies cannot be overwhelmed with deportation requests? [25:50.240 --> 25:54.240] I mean, how is that a conflict with federal law? [25:54.240 --> 25:58.240] I mean, this guy is a clown [25:58.240 --> 26:03.240] Well, that goes right along the same argument, though, that they'd be saying, you know [26:03.240 --> 26:08.240] How can you say there's too much oil in the Gulf to clean up so you're just not going to do it? [26:08.240 --> 26:09.240] Yeah, right, I know [26:09.240 --> 26:15.240] Well, there's a conflict with federal law because the agencies are just going to be overwhelmed with deportation requests [26:15.240 --> 26:23.240] Well, the Arizona attorney should have argued that the lack of enforcement by the federal government [26:23.240 --> 26:30.240] on those requirements of the immigration portions of the Constitution and the laws associated with it [26:30.240 --> 26:33.240] border on criminal neglect [26:33.240 --> 26:35.240] That's what he should have argued [26:35.240 --> 26:43.240] Yeah, well, that might be somewhere, but it did say earlier in the article that the solicitor [26:43.240 --> 26:49.240] I mean, not the solicitor, that the state of Arizona's attorney was arguing that the government [26:49.240 --> 26:52.240] That the federal government has failed to act, was the quote [26:52.240 --> 26:59.240] And so, yeah, but he does need to take it one step further that it is criminal neglect [26:59.240 --> 27:00.240] Okay, back to the art [27:00.240 --> 27:07.240] But still, I mean, if I was that judge, I would have said, can you please cite the statute and clause number? [27:07.240 --> 27:09.240] And what title is that, Mr. Needler? [27:09.240 --> 27:17.240] That of the federal law that says these agencies cannot be overwhelmed with requests [27:17.240 --> 27:22.240] I mean, just exactly what clause is that in which statute, Mr. Needler? [27:22.240 --> 27:25.240] I mean, what a ridiculous argument [27:25.240 --> 27:29.240] Okay, there's really no flexibility, Needler said [27:29.240 --> 27:31.240] Well, no, there's not [27:31.240 --> 27:35.240] I mean, you're either in this country legally or you're not [27:35.240 --> 27:37.240] Okay, back to the article [27:37.240 --> 27:42.240] He added that the Arizona law might lead to police harassment of U.S. citizens [27:42.240 --> 27:50.240] and is threatening to harm vital cooperation along the border with Mexican authorities who have strongly condemned the law [27:50.240 --> 27:55.240] Quote, these are very concrete harms, very substantial foreign policy concerns [27:55.240 --> 28:02.240] He said, Borama, that's the attorney for Arizona, Borama ridiculed the foreign policy concerns [28:02.240 --> 28:07.240] Quote, foreign outrage doesn't make the law preempted [28:07.240 --> 28:12.240] He said, he accused the Obama administration of ignoring requests from Brewer [28:12.240 --> 28:16.240] and numerous other governors for more help in securing the border [28:16.240 --> 28:22.240] Quote, you can't catch them if you don't know about them, he said, and they don't want to know about them [28:22.240 --> 28:25.240] Bolton is hearing six other lawsuits filed against the Arizona law [28:25.240 --> 28:31.240] A former Arizona state court judge, she was nominated for the federal bench by Bill Clinton [28:31.240 --> 28:35.240] but legal observers say she is hard to pigeonhole ideologically [28:35.240 --> 28:38.240] Outside the gleaming glass and white iron courthouse [28:38.240 --> 28:41.240] I don't know why that's necessary in the article [28:41.240 --> 28:46.240] Anyway, name for former Supreme Court Justice, Senator O'Connor, an angry subtext [28:46.240 --> 28:51.240] reflected the divide over how to handle the nation's estimated 12 million illegal immigrants [28:51.240 --> 28:54.240] Yeah, I think it's more like 30 or 40 [28:54.240 --> 29:01.240] Anyway, opponents of the Arizona law clasped hands, prayed and held signs condemning it [29:01.240 --> 29:05.240] This law is racist, the police are harassing us because of our brown skin [29:05.240 --> 29:10.240] said Marcia Calderon, who sat next to a painting of the Virgin Mary affixed with a sign saying [29:10.240 --> 29:15.240] Stop SB 1070, as the immigration law is known [29:15.240 --> 29:20.240] Nearby, Brandy Barron waved an American flag and expressed her support for the law [29:20.240 --> 29:23.240] and her disgust at efforts to overturn it [29:23.240 --> 29:26.240] I am amazed that the Justice Department would have the nerve to sue us [29:26.240 --> 29:30.240] for trying to get laws that are already on the books enforced [29:30.240 --> 29:31.240] she said [29:31.240 --> 29:34.240] Indeed [29:34.240 --> 29:37.240] I mean, what's the big deal? is the one that was required to enforce the laws [34:07.240 --> 34:11.240] that would have prevented the necessity of the Arizona law [34:11.240 --> 34:17.240] Yeah, I would love for him to have to stay on the witness stand [34:17.240 --> 34:19.240] because he's told senators this in private [34:19.240 --> 34:22.240] and senators have gone public about this statement [34:22.240 --> 34:26.240] that Obama has told the senators or some key senators [34:26.240 --> 34:29.240] that he is not going to enforce immigration laws [34:29.240 --> 34:36.240] he is not going to make sure that the border is secure until he gets his immigration reform [34:36.240 --> 34:42.240] i.e. amnesty for all the illegal aliens that are already in the country [34:42.240 --> 34:46.240] I'd love to hear him have to of the above [36:45.240 --> 36:49.240] And Kagan is no exception, she's a Goldman Sachs herself [36:49.240 --> 36:55.240] I can't think of anybody on Capitol Hill worth keeping [36:55.240 --> 36:58.240] right down to the mailboy [36:58.240 --> 37:03.240] And half of them are all dual citizens of Israel as well, I might add [37:03.240 --> 37:06.240] So they have absolutely no allegiance to this country whatsoever [37:06.240 --> 37:08.240] or doing what's good for this nation [37:08.240 --> 37:11.240] Well, but the problem is you can't be a dual citizen [37:11.240 --> 37:14.240] No, I know, I know [37:14.240 --> 37:23.240] I mean, the people of America have just gotten way too understanding and apathetic [37:23.240 --> 37:25.240] Just way too much people [37:25.240 --> 37:28.240] Yeah, and that is another law that's not being enforced [37:28.240 --> 37:31.240] It's selective enforcement [37:31.240 --> 37:35.240] These special people, they get to keep both passports [37:35.240 --> 37:39.240] They get to keep their passport from Israel and they get to have an American passport too [37:39.240 --> 37:41.240] They get to have dual citizenship [37:41.240 --> 37:43.240] But the common man doesn't get to have dual citizenship [37:43.240 --> 37:47.240] You want to be a citizen here, you have to give up the citizenship of your other country [37:47.240 --> 37:50.240] So yeah, it's just laws are being broken everywhere [37:50.240 --> 37:53.240] It's total lawlessness, it's rampant [37:53.240 --> 38:00.240] It's like these people that declare, have the irrational declaration [38:00.240 --> 38:03.240] that nobody should be allowed to own a gun [38:03.240 --> 38:05.240] I mean, that's just utter stupidity [38:05.240 --> 38:10.240] Let's put this sign in our front yards, [39:32.240 --> 39:41.240] Well, first of all, now that I was thinking of this, the Libertarian Party of Connecticut is having its convention on the 21st of August [39:41.240 --> 39:46.240] And we have an awesome keynote speaker [39:46.240 --> 39:48.240] Ron Paul? [39:48.240 --> 39:52.240] No, Randy Kellen [39:52.240 --> 39:53.240] Who's he? [39:53.240 --> 39:58.240] I don't know who he is. You guys may have heard of him [39:58.240 --> 40:07.240] But aside from that, we actually found the Secretary of State, and our state is not exactly the sharpest tool in her shed [40:07.240 --> 40:09.240] Or any shed for that matter [40:09.240 --> 40:15.240] She actually came out with a press release and a media campaign using state funds, mind you [40:15.240 --> 40:24.240] And what she's doing is she's actively encouraging unaffiliated voters, of which the voter rolls consist of 42 percent of those [40:24.240 --> 40:30.240] To register in the Democratic and Republican parties [40:30.240 --> 40:39.240] And she put that on a press release that she was urging these people to change their affiliation [40:39.240 --> 40:43.240] Well, that all worked out real well, huh? [40:43.240 --> 40:53.240] As a matter of fact, since she did that, what I went ahead and did is I filed a complaint with the Federal Elections Commission [40:53.240 --> 40:58.240] Since it probably cost more than $5,000 and it influenced the federal election [40:58.240 --> 41:04.240] And the same complaint was actually mailed to the Office, the State Office of Ethics [41:04.240 --> 41:09.240] And the same complaint was also mailed to the State Election Enforcement Commission [41:09.240 --> 41:15.240] And I also set it up as a tort letter to her in her personal capacity [41:15.240 --> 41:22.240] Where I basically said, stop doing this or, you know, respond within 60 days [41:22.240 --> 41:28.240] So essentially she threw a porcupine up in the air and now she's catching it [41:28.240 --> 41:29.240] Indeed [41:29.240 --> 41:35.240] Well, let's hope she's wearing a blindfold and no gloves [41:35.240 --> 41:39.240] I mean, you know, to do something like that is the Secretary of State [41:39.240 --> 41:47.240] And to throw that on the Secretary of State website and to, in violation of the law, misuse the state seal [41:47.240 --> 41:53.240] This is clearly not educational and that's the only grounds, you know, of what she could have done this [41:53.240 --> 42:02.240] To misuse the state seal like that, you know, she's probably going to go to jail for like at least a year over this [42:02.240 --> 42:04.240] That's all? [42:04.240 --> 42:08.240] Oh, yeah, not quite [42:08.240 --> 42:15.240] There's also Connecticut General Statute 9-355, which is an election law addressing official fraud or neglect [42:15.240 --> 42:17.240] That's another year [42:17.240 --> 42:20.240] So it's probably going to be two at least [42:20.240 --> 42:21.240] And basically [42:21.240 --> 42:26.240] Well, let's see, will any of that put her on a no-fly list to prevent her from owning a gun? [47:00.240 --> 47:05.240] Okay, so basically way back then, my iPod was stolen [47:05.240 --> 47:10.240] Back in February, my iPod was stolen while I was on a school bus [47:10.240 --> 47:13.240] We had undeniable video evidence of this [47:13.240 --> 47:18.240] And after several weeks of, you know, we complained until the resource officer did all that [47:18.240 --> 47:23.240] The school board didn't do anything until, you know, my mom actually complained to them [47:23.240 --> 47:26.240] With a formal email and all that [47:26.240 --> 47:31.240] And they proceeded and they went through the processes [47:31.240 --> 47:35.240] They arrested for theft of an iPod belonging to me, he pled guilty [47:35.240 --> 47:41.240] He received suspended sentence and unsupervised probation for six months [47:41.240 --> 47:45.240] But still no iPod, still no restitution [47:45.240 --> 47:46.240] They never gave the iPod back [47:46.240 --> 47:50.240] I think I remember your father calling in about this story [47:50.240 --> 47:57.240] And what was discussed was that criminal charges should be filed against the parents [47:57.240 --> 48:04.240] And the child who still has your iPod for possession of stolen property [48:04.240 --> 48:07.240] That is a separate crime other than theft [48:07.240 --> 48:10.240] But when I tried to do that, I was actually at the DA [48:10.240 --> 48:19.240] And when we tried to do that, the DA told me that you can't do that because it's still the same [48:19.240 --> 48:21.240] Well, it's not the same [48:21.240 --> 48:23.240] He doesn't know what he's talking about [48:23.240 --> 48:24.240] Double jeopardy or something [48:24.240 --> 48:27.240] Yeah, he doesn't know what he's talking about, but it's not the same [48:27.240 --> 48:30.240] It's a separate law and he needs to [48:30.240 --> 48:35.240] And we told your father that criminal charges need to be filed against the parents [48:35.240 --> 48:38.240] The parents haven't had any charges filed against them yet [48:38.240 --> 48:43.240] Because since the child is technically a minor, the parents are responsible for what the child does [48:43.240 --> 48:47.240] And all the property that's in the house [48:47.240 --> 48:48.240] Okay [48:48.240 --> 48:55.240] Possession of stolen property, he's been charged with stealing the property originally, but that's the child [48:55.240 --> 49:00.240] Now you need to press charges against the parents for possession of stolen property [49:00.240 --> 49:05.240] Separate offense, the DA knows this, they just don't want to do the job and the legwork [49:05.240 --> 49:09.240] And if they don't, yeah, and nothing has been filed against the parents yet [49:09.240 --> 49:12.240] So you all need to go after the parents [49:12.240 --> 49:14.240] Okay [49:14.240 --> 49:15.240] Okay [49:15.240 --> 49:20.240] What if the DA won't touch it? [01:08:19.240 --> 01:08:31.240] I'm not sure yet, like I say, I don't think that, he keeps telling me, like I said in a previous call, he said that the prosecuting attorney agreed to move to dismiss it [01:08:31.240 --> 01:08:38.240] So I haven't seen that on any paper, and they're still wanting us to go to a pretrial hearing, and of course the judge has the final say on that bill [01:08:38.240 --> 01:08:41.240] He's got to approve that, but [01:08:41.240 --> 01:08:51.240] Yeah, the prosecuting attorney has to file a request for dismissal, which the judge has to approve, but it's extremely rare when a judge will not approve a dismissal [01:08:51.240 --> 01:08:59.240] when the prosecuting attorney states, we're wanting a dismissal because it's a false accusation, we have no proof there was no crime [01:08:59.240 --> 01:09:09.240] So any judge that wants to proceed after that has a severe issue about impartiality and a right of due process [01:09:09.240 --> 01:09:16.240] Right, now is that something that I should be able to go find in the court file? [01:12:37.240 --> 01:12:38.240] Yes, go ahead [01:12:38.240 --> 01:12:46.240] Okay, yes, my background is pretty much, I have a banking background primarily in mortgages [01:12:46.240 --> 01:12:51.240] And I'm actually trying to help a friend from a foreclosure [01:12:51.240 --> 01:13:06.240] And I came across you guys actually from listening through Alex Jones and Randy Kelton just kind of stuck out there like someone that really was protecting the people [01:13:06.240 --> 01:13:12.240] So that's partially why I'm calling in because I was hoping I could speak with him, but it sounds like he's out [01:13:12.240 --> 01:13:21.240] He's actually giving a seminar tonight on mortgage fraud, so he's not here with us tonight, but he will be back on Thursday night [01:13:21.240 --> 01:13:24.240] But Eddie and I could speak with you [01:13:24.240 --> 01:13:34.240] Yes, it's funny you mention that because that's actually how my friend, that was her defense because if you look at constitutional money, gold and silver coins shall pay off [01:13:34.240 --> 01:13:42.240] That's Article 1, Section 2, I think which clause it is, Article 1, Section 2 though [01:13:42.240 --> 01:13:50.240] And basically she had someone, she hired some people to write up pleadings for her and she got a jury trial [01:13:50.240 --> 01:13:57.240] And so she beat the odds in California to get the actual trial on an unlawful container, it's really rare [01:13:57.240 --> 01:14:09.240] So we're on a good roll and I just wanted to continue that good streak and Randy seemed like he was really good at making the judges, the district attorneys obey so to speak [01:14:09.240 --> 01:14:15.240] Yeah, now the way that I know that Randy handles mortgage fraud issues because I understand what you're saying about the Constitution [01:14:15.240 --> 01:14:25.240] But there are legal tender laws and so that can get complicated because certain laws have been passed, but Randy doesn't deal with all of that [01:14:25.240 --> 01:14:32.240] And also you have to deal with HJR 192 which says that no longer can debts be paid but they have to be discharged [01:14:32.240 --> 01:14:35.240] So then there's the whole commercial aspect of it as well [01:14:35.240 --> 01:14:44.240] But the way that Randy deals with it is that he doesn't go to those issues, he doesn't approach things from that kind of a point of view [01:14:44.240 --> 01:15:00.240] He looks for legal violations, he looks for violations in law that have been made on the part of the banking industry because there are very specific laws regulating the mortgage industry from state to state and also at the federal level [01:15:00.240 --> 01:15:16.240] And pretty much every mortgage has literally hundreds of violations in the paperwork of the mortgage itself violating statutes at the federal level and at the state level [01:15:16.240 --> 01:15:31.240] And so what he does is he does an audit, a mortgage analysis audit of the mortgage paperwork itself and discovers what all of the violations are and then helps people write up lawsuits [01:15:31.240 --> 01:15:35.240] So you don't have to get into these constitutional issues [01:15:35.240 --> 01:15:48.240] Okay, the reason why I mention this is I took the jurisdictionary Dr. Graves and he does say you can bring, he recommends case law but if you really have to you can bring [01:15:48.240 --> 01:16:00.240] And since I don't really know how to use case law because I have a banking background not a legal background, I guess they could try Lois Law or Lexis Nexus I've heard [01:16:00.240 --> 01:16:09.240] Another thing was how do you, when a judge overrules you how do you make him make sure that he's not doing a frivolous overruling, how do you put him on? [01:23:38.240 --> 01:23:47.240] Well there, some people in the group have already been foreclosed upon, most of them are in some type of foreclosure proceeding [01:23:47.240 --> 01:23:56.240] If you are, if somebody is in the foreclosure proceedings they need to sue the bank immediately, that's what will stop the foreclosure proceedings [01:23:56.240 --> 01:24:07.240] And you would do a, I've heard once you start a suit you have to consolidate the cases somehow, is that like a certain writ that you do to consolidate? Do you remember what that was about or how that works? [01:34:07.240 --> 01:34:12.240] Because you're certifying you're a resident and or a U.S. citizen [01:34:12.240 --> 01:34:20.240] What I do on the voter card when I do it is I scratched out U.S. and put in American [01:34:20.240 --> 01:34:29.240] And then right after that, I put slash Texan, Texan National [01:34:29.240 --> 01:34:36.240] And basically anywhere where it had U.S. citizen, I altered it in that regard [01:34:36.240 --> 01:34:44.240] Okay. So my basic thing to do would be mark American and then Michigan National [01:34:44.240 --> 01:34:46.240] Correct [01:34:46.240 --> 01:34:48.240] Okay. Yeah, because I [01:34:48.240 --> 01:34:53.240] And then wherever it says voter, change that to elector [01:34:53.240 --> 01:35:02.240] Oh, okay. Yeah, and when I went to do that, I said, you know what? [01:35:02.240 --> 01:35:09.240] I think I'm going to make a call and see if I really want to fill that out or sign it [01:35:09.240 --> 01:35:14.240] Because I know when you go down and deal with these people with your property tax [01:35:14.240 --> 01:35:18.240] It's like, boy, they just treat you like some [01:35:18.240 --> 01:35:23.240] Well, they're going to do that anyway because they think they're all that in a bag of chips [01:35:23.240 --> 01:35:29.240] But until you teach them otherwise, they're going to maintain the status quo on that [01:35:29.240 --> 01:35:34.240] I've gone through several times. I always go down and fight my taxes [01:35:34.240 --> 01:35:42.240] And I even went and got certified as an appraiser and went in and they said, yeah, thank you very much [01:35:42.240 --> 01:35:46.240] You know, too bad we're raising your taxes anyway [01:35:46.240 --> 01:35:52.240] Yeah. Well, I don't know what the voter registration card looks like in the air and up in Michigan [01:35:52.240 --> 01:35:56.240] But check and see also if it says resident anywhere [01:35:56.240 --> 01:36:04.240] And if it does that, then I replace resident with domiciled [01:36:04.240 --> 01:36:13.240] Okay. All right. Well, that's a thing to do then [01:36:13.240 --> 01:36:20.240] The reason I do that is because resident is very clear in law. It is somewhat temporary or transient [01:36:20.240 --> 01:36:28.240] It is by no means a domiciled permanent inhabitant, but even an inhabitant, believe it or not [01:36:28.240 --> 01:36:34.240] Under the law dictionaries has a transient term associated with it [01:36:34.240 --> 01:36:42.240] Domiciled is the only one I can find that actually apprises it as to being permanent [01:36:42.240 --> 01:36:52.240] Okay. So when you go to fight your taxes and you show them that that's the way you signed up [01:36:52.240 --> 01:36:56.240] Then that's going to make a difference with them trying to deal with it [01:36:56.240 --> 01:37:00.240] It should because if you look at the laws, it's going to deal with real property [01:37:00.240 --> 01:37:04.240] It never deals with private property. It deals with real property [01:37:04.240 --> 01:37:09.240] It deals with personal property, but none of that is private property [01:37:09.240 --> 01:37:16.240] Plus almost always you will see two other terms that are interrelated in that tax liability [01:37:16.240 --> 01:37:25.240] Resident or person, and either one of those is sometimes parlayed into the term taxpayer [01:37:25.240 --> 01:37:33.240] You need to make sure as the rabbit trail goes that you are not any of those things as they are defined [01:37:33.240 --> 01:37:36.240] And you need to point that out to them [01:37:36.240 --> 01:37:52.240] Okay. Okay, so if I haven't signed up their vote yet, then there's not really much they can do so I do [01:37:52.240 --> 01:37:59.240] Yes and no. They're still going to move against your property because your property is on the tax roll [01:37:59.240 --> 01:38:02.240] Whether you are or not [01:38:02.240 --> 01:38:04.240] Okay [01:38:04.240 --> 01:38:13.240] So the first thing you need to be looking at is how to get your property off of that tax roll [01:38:13.240 --> 01:38:41.240] Now is this the main thing to do or if we start getting into the different classification there with the property [01:38:41.240 --> 01:38:47.240] Now I can't think of that, but all right, I guess I'll have to work on that [01:38:47.240 --> 01:38:51.240] But I remember you guys had talked about it before and you said in Texas you can't do it [01:38:51.240 --> 01:38:58.240] But in most of the other states you can classify your property different than [01:38:58.240 --> 01:39:03.240] Well if you can get your property classified as private property instead of real property [01:39:03.240 --> 01:39:06.240] Then you can get it deleted from the tax roll [01:39:06.240 --> 01:39:07.240] Oh really [01:39:07.240 --> 01:39:11.240] And that's something that I've been trying to research getting done [01:39:11.240 --> 01:39:15.240] There's a gentleman that apparently teaches people how to do this [01:39:15.240 --> 01:39:19.240] And I've been trying to get him on the show, but he hasn't responded to my emails for a while [01:39:19.240 --> 01:39:21.240] I think he's very, very busy [01:39:21.240 --> 01:39:32.240] But basically what you have to do is you ask for a list of all the public property in the county from the appraisal district [01:39:32.240 --> 01:39:39.240] And then you verify that your property is not on that list by writing them yet another letter [01:39:39.240 --> 01:39:44.240] And getting them to confirm that your property is not on the list of public property [01:39:44.240 --> 01:39:48.240] And then when they do that, then you ask them to reclassify your property as private property [01:39:48.240 --> 01:39:54.240] They won't do that, so then what you do is you have to sue the appraisal district in district court [01:39:54.240 --> 01:40:01.240] And get the judge to reclassify your property as private property and then you can get it off the tax roll [01:40:01.240 --> 01:40:07.240] And I'm not clear on all the steps or what exactly the content of the suit should be and these kinds of things [01:40:07.240 --> 01:40:14.240] But if you get your only real property can be taxed with property taxes, at least here in Texas [01:40:14.240 --> 01:40:18.240] And so you get it reclassified to private property and then you can get it off the tax roll [01:40:18.240 --> 01:40:24.240] And actually that's what one of our listeners did in South Texas, Pat and Metta [01:40:24.240 --> 01:40:28.240] They got their properties reclassified to private property [01:40:28.240 --> 01:40:34.240] But in their county, their property taxes are only like 30 bucks a year, so it's like no big deal [01:40:34.240 --> 01:40:45.240] But here in Travis County, especially in our area of town, I mean, we've got our taxes are over 4 grand this year for our property [01:40:45.240 --> 01:40:48.240] I mean, it's outrageous. It'll be 5 grand the following year [01:40:48.240 --> 01:40:55.240] And so there's such a huge revenue scheme going on for Austin Independent School District that [01:40:55.240 --> 01:41:01.240] And I know somebody who works for the school board [01:41:01.240 --> 01:41:09.240] And she said most of the money that is collected by property taxes goes to pay outrageous salaries [01:41:09.240 --> 01:41:12.240] She works for the state comptroller's office actually [01:41:12.240 --> 01:41:16.240] And she's seen all the expenditures for all these school districts [01:41:16.240 --> 01:41:18.240] And she says in Travis County, it's so corrupt [01:41:18.240 --> 01:41:28.240] What most of the money goes to is to pay outrageously high salaries for the superintendents of the school districts [01:41:28.240 --> 01:41:32.240] I mean, we're talking in the hundreds of thousands of dollars [01:41:32.240 --> 01:41:38.240] And then meanwhile the teachers get a pittance and the schools aren't properly maintained [01:41:38.240 --> 01:41:43.240] And then of course the children are indoctrinated with government propaganda [01:41:43.240 --> 01:41:45.240] So it's just a horrible situation [01:41:45.240 --> 01:41:49.240] And I don't appreciate having to fund it, okay? [01:41:49.240 --> 01:41:56.240] And so that's one thing that I intend on eventually doing something about once I get some time [01:41:56.240 --> 01:42:00.240] Now how would the private property thing tie in with land patents? [01:42:00.240 --> 01:42:04.240] It does not. We had a whole show on that [01:42:04.240 --> 01:42:08.240] Land patents will not get you out of property taxes [01:42:08.240 --> 01:42:15.240] Having a land patent will not help you reclassify your property from real property to private property [01:42:15.240 --> 01:42:18.240] They're two totally separate things [01:42:18.240 --> 01:42:27.240] And I forgot the gentleman who has the land patent website, Team Law, teamlaw.org [01:42:27.240 --> 01:42:29.240] He makes it very clear [01:42:29.240 --> 01:42:36.240] The only reason that he does the land patents is to help people get set up as constitutional electors [01:42:36.240 --> 01:42:42.240] And to me it's kind of, I don't know, I'm not so sure I agree with what he does [01:42:42.240 --> 01:42:45.240] Let's just put it that way [01:42:45.240 --> 01:42:47.240] Because it seems somewhat subversive to me [01:42:47.240 --> 01:42:49.240] But that's just my opinion [01:42:49.240 --> 01:42:54.240] But the bottom line is this and he says it on his website and he said it on the show many times [01:42:54.240 --> 01:42:58.240] Having your land patent has nothing to do with property taxes [01:42:58.240 --> 01:43:00.240] It will not get you out of property taxes [01:43:00.240 --> 01:43:05.240] It will not help you get your property reclassified from real property to private property [01:43:05.240 --> 01:43:07.240] So just don't even go there [01:43:07.240 --> 01:43:15.240] Don't even bother with the land patents unless you're into his trip concerning becoming a constitutional elector [01:43:15.240 --> 01:43:19.240] And they've got their own governors that they've elected and all these kinds of things [01:43:19.240 --> 01:43:21.240] And I don't know what they intend to do with it [01:43:21.240 --> 01:43:27.240] I mean, do they intend on using the militias to enforce their government that they've elected? [01:45:54.240 --> 01:45:56.240] Yeah, I did, several [01:45:56.240 --> 01:45:57.240] Oh [01:45:57.240 --> 01:46:02.240] Yeah, you go look in the annotated statutes and you get the annotations [01:46:02.240 --> 01:46:05.240] And you get some cases related to that topic [01:46:05.240 --> 01:46:07.240] So that's where I started [01:46:07.240 --> 01:46:11.240] And so I found particular cases from that [01:46:11.240 --> 01:46:15.240] And then contacted the clerk of the court there to get that [01:46:15.240 --> 01:46:20.240] So one was from against the sheriff in one of the northern counties [01:46:20.240 --> 01:46:22.240] I forgot what it was [01:46:22.240 --> 01:46:25.240] But yeah, well at the time they put this in though [01:46:25.240 --> 01:46:28.240] He was already under indictment for a number of things [01:46:28.240 --> 01:46:31.240] So I don't think he survived the petition [01:46:31.240 --> 01:46:37.240] But in that he had torched somebody's car [01:46:37.240 --> 01:46:46.240] And he was sending extra patrols through this apartment complex [01:46:46.240 --> 01:46:51.240] Where he had to live without paying any rent [01:46:51.240 --> 01:46:55.240] So that was part of the things they complained about in there [01:46:55.240 --> 01:47:03.240] And then in the 90s there were two in Harris County, one against the county judge and one against the DA [01:47:03.240 --> 01:47:07.240] I don't remember if either of those succeeded but they were filed there [01:47:07.240 --> 01:47:12.240] And the one that did succeed was against the DA in Fort Bend County [01:47:12.240 --> 01:47:18.240] And so I went there and looked through that file and got a copy of the petition [01:47:18.240 --> 01:47:22.240] But that original petition had over 100 signers on it [01:47:22.240 --> 01:47:27.240] So like Randy or somebody has said [01:47:27.240 --> 01:47:30.240] A lot of these things can't really do it, it's just law [01:47:30.240 --> 01:47:32.240] It's got to become kind of political [01:47:32.240 --> 01:47:34.240] So when you get 100 people willing to put their name down [01:47:34.240 --> 01:47:36.240] That's getting kind of political [01:47:36.240 --> 01:47:41.240] But some accusations against him, I don't remember all of it [01:47:41.240 --> 01:47:44.240] But part of it he was harboring a fugitive from justice [01:47:44.240 --> 01:47:49.240] usually flows from the moment of the stop [01:49:18.240 --> 01:49:21.240] Up to the time you appear in court [01:49:21.240 --> 01:49:26.240] I'm trying to make this as effortless as possible for educational purposes [01:49:26.240 --> 01:49:31.240] That does not mean you won't have to do some work, it does not mean you won't have to do some reading [01:49:31.240 --> 01:49:38.240] But for the most part it will already be laid out for you to learn and to use [01:49:38.240 --> 01:49:45.240] Now one very important aspect of dealing with these things is that no checklist is going to do the job [01:49:45.240 --> 01:49:48.240] You have to learn to think on your feet [01:49:48.240 --> 01:49:53.240] You have to learn how to address a dynamic and fluid situation [01:49:53.240 --> 01:49:59.240] one judge may be willing to follow the law [01:50:16.240 --> 01:50:20.240] The other one may be completely unwilling to even acknowledge it exists [01:50:20.240 --> 01:50:26.240] And so you have to learn how to deal with those situations when they arise [01:50:26.240 --> 01:50:31.240] But we have a complete list of motions that we're going to be dealing with [01:50:31.240 --> 01:50:38.240] And I'll give you a quick example here of just which ones I've got done so far and the ones I'm still working on [01:50:38.240 --> 01:50:47.240] But right now we have ten pretrials and one after-the-fact pretrial along with some motions to disqualify [01:50:47.240 --> 01:50:49.240] Of which there are seven additional [01:50:49.240 --> 01:50:52.240] So right now you're talking 18 different motions [01:51:08.240 --> 01:51:12.240] You file a motion to dismiss under the Administrative Procedures Act [01:51:12.240 --> 01:51:15.240] You file a petition to demand a court of record [01:51:15.240 --> 01:51:18.240] You file a motion to dismiss no information [01:51:18.240 --> 01:51:24.240] A petition to provide a copy of indictment and information and no, they are not the same motion [01:51:24.240 --> 01:51:27.240] A petition for nature and cause of accusation [01:51:27.240 --> 01:51:31.240] A petition for the court to follow Texas Code of Criminal Procedure [01:51:31.240 --> 01:51:35.240] A petition for findings of facts and conclusions of law [01:51:35.240 --> 01:51:40.240] That is the one that you file after the judge blanket denies all the others [01:51:40.240 --> 01:51:46.240] That petition for finding of facts and conclusions of law is your arguments as to by what authority [01:51:46.240 --> 01:51:54.240] And by what statutory provision does this court dismiss without any review whatsoever [01:51:54.240 --> 01:51:59.240] The properly and timely filed motions of the defense [01:51:59.240 --> 01:52:06.240] What gave you that authority and what law are you using to make the determination you made in denying it [01:52:06.240 --> 01:52:12.240] We are basically going to build a paper trail under which we can bury these people [01:52:12.240 --> 01:52:18.240] Now folks this is going to be very important for this upcoming meeting with the legislature [01:52:18.240 --> 01:52:22.240] Every one of you that uses these documents in Texas [01:52:22.240 --> 01:52:31.240] Please, please, please make sure you get copies of the orders after they have been filed and denied by the judge [01:52:31.240 --> 01:52:39.240] Whether the judge denies it by signing it as denied or whether they refuse to sign it or even acknowledge the motion [01:52:39.240 --> 01:52:48.240] Make sure you get a copy of that and write it up and send it to me via email that here is the motion I filed [01:52:48.240 --> 01:52:58.240] The order was denied, they refused to file a finding of facts and conclusions of law on my request to do so [01:52:58.240 --> 01:53:05.240] What we want is ammunition to take before the legislature to prove the point of complete and utter abuse [01:53:05.240 --> 01:53:10.240] And corruption by the justices and the magistrates in Texas [01:53:10.240 --> 01:53:14.240] And folks we're not going to do it without your help [01:53:14.240 --> 01:53:20.240] I could fight a hundred battles a day and that won't be enough because I'm only one source [01:53:20.240 --> 01:53:28.240] We need to make this as diversified by persons, locations, counties, cities, you name it [01:53:28.240 --> 01:53:32.240] We want them from all over Texas where they're doing this [01:53:32.240 --> 01:53:38.240] Because when we stand in front of them down there and say you have judges all over the state that are doing this [01:53:38.240 --> 01:53:43.240] Knowingly and willingly, I want to be able to back that up with hard documentation [01:53:43.240 --> 01:53:50.240] So please help me out with that and if you use these motions, please make sure that you get copies of the orders [01:53:50.240 --> 01:53:54.240] Especially the fair and impartial trial [01:53:54.240 --> 01:54:02.240] If that gets denied, you immediately demand a signed copy of that order and you do two things with that signed copy [01:54:02.240 --> 01:54:11.240] You get a certified copy, you make additional copies of it, you take it right off the bat to the mayor and the city manager [01:54:11.240 --> 01:54:21.240] And you inform them that here is a signed order denying you the right of a fair and impartial trial by the judge of such and such court [01:54:21.240 --> 01:54:26.240] I will be sending a tort letter to you tomorrow with this as an attachment [01:54:26.240 --> 01:54:32.240] In the meantime, you better be figuring out what you're going to be doing about this judge [01:54:32.240 --> 01:54:38.240] You throw them into such a panic they have to go home and shovel out their pants [01:54:38.240 --> 01:54:42.240] Okay, Eddie [01:54:42.240 --> 01:54:44.240] And you went to imagery [01:54:44.240 --> 01:54:50.240] Yeah, well, the point being we want to put the fear of the people back into these public servants [01:54:50.240 --> 01:54:51.240] I call them public servants [01:54:51.240 --> 01:54:58.240] Right now they don't fear us, yeah, they don't fear us, they don't respect us, they believe themselves superior and above us [01:54:58.240 --> 01:55:11.240] We need to fix that quickly and we can do it best by puncturing their helium-filled heads that's got them floating so high [01:55:11.240 --> 01:55:13.240] So let's work on doing that [01:55:13.240 --> 01:55:16.240] The helium-filled heads of the public servants [01:55:16.240 --> 01:55:18.240] That's it [01:55:18.240 --> 01:55:24.240] Okay, well, Eddie, let me ask you a question here concerning my friend's traffic case that I've been helping him with [01:55:24.240 --> 01:55:29.240] And you already answered this for him, but I wanted to ask the question on the air because the listeners are likely to come up against this [01:55:29.240 --> 01:55:37.240] All right, he's filed a notice of appeal and his 17.02 code of criminal procedure bail has been denied [01:55:37.240 --> 01:55:47.240] Which is the constitutional bail bond which basically you submit an affidavit saying that your net worth is at least as much or more as the amount of the bond [01:55:47.240 --> 01:55:56.240] You don't have to pay the bond in cash, you can pay it in cash if you opt to, but the judges cannot require you to [01:55:56.240 --> 01:56:02.240] Well, the judge is trying to require him to do that, he wouldn't do that, the constitutional bail bond was denied [01:56:02.240 --> 01:56:09.240] And instead they're trying to get him to fill out this indigency affidavit paperwork [01:56:09.240 --> 01:56:14.240] And so he just sent him a tax return and says I don't need you guys to do my profit and loss statement for me [01:56:14.240 --> 01:56:21.240] Well, at any rate, it's kind of at a stalemate right now, the case isn't going anywhere because he can't push the appeal through [01:56:21.240 --> 01:56:27.240] Until either the indigency paperwork gets approved or he gets his bail bond [01:56:27.240 --> 01:56:37.240] Well, at any rate, in the meantime, the court has reported to the DPS office this ticket and so now his insurance rates are becoming affected [01:56:37.240 --> 01:56:44.240] So what is the remedy here because I know that in a lot of times in criminal cases, like if somebody is convicted of a crime [01:56:44.240 --> 01:56:47.240] They still go to prison while they're waiting for their appeal [01:56:47.240 --> 01:56:56.240] And so I don't know if it's lawful for them to go ahead and report this ticket to the DPS and then it will get pulled after the appeal goes through [01:56:56.240 --> 01:57:00.240] If he wins the appeal or what is the deal with that and what's the solution here? [01:57:00.240 --> 01:57:07.240] Well, the problem they face in these particular types of criminal cases is this is a fine-only offense [01:57:07.240 --> 01:57:17.240] So when they report that you've been convicted for the sole purpose of increasing your rates in order to force you to pay [01:57:17.240 --> 01:57:24.240] While it's still being sent through the appeals process, that right there is a problem [01:57:24.240 --> 01:57:37.240] Because that shows an intentional act by these judges to extort the money from you in order to prevent them reporting it [01:57:37.240 --> 01:57:40.240] In such a way as to cause your rates to go up immediately [01:57:40.240 --> 01:57:46.240] This is basically their way of strong-arming you into paying on their schedule and not your own [01:57:46.240 --> 01:57:50.240] At least not your own as in relation to your appeal process [01:57:50.240 --> 01:57:58.240] Either dropping the appeal or going ahead and paying double the amount of the traffic ticket, cash bond or whatever [01:57:58.240 --> 01:58:01.240] And so what should he do? [01:58:01.240 --> 01:58:07.240] Well, one of the things that he should do is first thing is I'd get rid of mandamus [01:58:07.240 --> 01:58:12.240] I would also file a bar grievance and a judicial conduct complaint in both cases [01:58:12.240 --> 01:58:14.240] Against the judge?
