[05:27.120 --> 05:33.120] Now, in this case, what we've got for these elements, let's talk about how each one of [05:33.120 --> 05:37.360] them is actually going to work. [05:37.360 --> 05:41.320] So let's go through this. [05:41.320 --> 05:45.280] Let's talk about the first one, the defendant acted intentionally or knowingly. [05:45.280 --> 05:49.560] Is the officer intentionally pulling you over? [05:49.560 --> 05:54.480] Is the officer intentionally issuing a citation to you that doesn't apply to you? [05:54.480 --> 05:58.720] Is the officer intentionally performing an arrest under Texas law? [05:58.720 --> 06:03.880] Is the officer intentionally putting handcuffs on you in order to take you to jail if you [06:03.880 --> 06:09.240] won't sign a citation or if he doesn't like your attitude? [06:09.240 --> 06:12.440] So that element can easily met. [06:12.440 --> 06:17.320] Now, number two, the defendant threatened the plaintiff with imminent bodily injury. [06:17.320 --> 06:20.440] This is where the display of deadly weapon comes in. [06:20.440 --> 06:27.600] They're wearing a gun, they're wearing a taser, they're doing all kinds of things that would [06:27.600 --> 06:36.800] otherwise make them be considered a physical threat to the people. [06:36.800 --> 06:42.400] And if you don't leave that, resist it just for any moment of time whatsoever with the [06:42.400 --> 06:48.200] fact that you're not engaging in commerce or stand your ground and say, look, I don't [06:48.200 --> 06:52.400] consent to being arrested because this is not an arrestable offense. [06:52.400 --> 06:57.760] Just think whatsoever, see how quick this officer actually turns mean on you. [31:43.680 --> 31:48.680] The third element being the defendant's threat caused injury to the plaintiff. [31:48.680 --> 32:01.680] Well when the officer is threatening you with a loaded weapon, whether he's waving it around or carrying it in a holster, and you know he is trained and capable fully well of using it to your harm and detriment. [32:01.680 --> 32:02.680] That's imminent. [32:02.680 --> 32:03.680] Okay. [32:03.680 --> 32:16.680] And the injury that can result is you're you're falsely imprisoned, you're wrongfully arrested, your, your liberty is lost unlawfully without due process of law. [32:16.680 --> 32:22.680] In cases where they tell your car your property is stolen, and so on and so forth. [32:22.680 --> 32:28.680] There are numerous and egregious ways in which this element occurs. [32:28.680 --> 32:39.680] And if we actually go back and look at what the imminent means here, what it specifically says is imminent means on the verge of happening or near at hand. [32:39.680 --> 32:49.680] So, as I was stating, if you don't think it's on the verge of happening or near at hand, tell the officer to take a hike, because he's using the law improperly. [32:49.680 --> 32:50.680] Okay. [32:50.680 --> 32:55.680] Tell the officer that you're not going to sign the citation because the citation doesn't apply to you. [32:55.680 --> 33:04.680] Even just be reasonable and try to, you know, sign the citation, agree to everything, and he may still arrest you and do the same thing anyway. [33:04.680 --> 33:07.680] Either way, it's all imminent. [33:07.680 --> 33:17.680] So, that first cause of action, there's definitely going to be all the elements are easily provable by the actions of the officer. [33:17.680 --> 33:22.680] Now, the second element that we've got going here is going to be one on breach of contract. [33:22.680 --> 33:30.680] The breach of contract calls for failure of the officer to abide by his oath under the Constitution. [33:30.680 --> 33:41.680] And because he is not abiding by his oath under the Constitution, he is in breach of contract because he has made a promise to the public of which, as Randy puts it, [33:41.680 --> 33:46.680] we are third-party beneficiaries of the contract he has made. [33:46.680 --> 33:50.680] Now, here's the deal about any public office. [33:50.680 --> 33:53.680] No public office is mandatory. [33:53.680 --> 33:56.680] All public offices are voluntary. [33:56.680 --> 33:58.680] You must volunteer to run. [33:58.680 --> 34:04.680] You must do what is required in order to get elected, but you must volunteer to run. [34:04.680 --> 34:10.680] And you volunteer your service to the people as long as you hold that office. [34:10.680 --> 34:19.680] You make a promise through that oath to uphold and defend and support the Constitution of Texas and the Constitution of the United States of America [34:19.680 --> 34:24.680] and that you will faithfully execute the laws thereof, okay? [34:24.680 --> 34:32.680] As long as those laws remain in accordance with the first part of that oath being both of those Constitutions. [34:32.680 --> 34:37.680] So when this public servant violates that, they are in breach of contract with the people. [34:37.680 --> 34:41.680] Here are the necessary elements to prove that. [34:41.680 --> 34:44.680] The elements of an action for breach of contract are the following. [34:44.680 --> 34:48.680] One, there is a valid enforceable contract. [34:48.680 --> 34:50.680] You have an oath of office. [34:50.680 --> 34:59.680] It is supposed to be signed and verified with the signature and verification signature of two public officials or the public official [34:59.680 --> 35:05.680] and someone that is authorized by law to administer the oath to the public official, okay? [35:05.680 --> 35:13.680] So you can show that there is a valid enforceable contract by getting a copy of the signed oath of office. [35:13.680 --> 35:18.680] Two, the plaintiff is a proper party to sue for breach of the contract. [35:18.680 --> 35:24.680] We are third party beneficiaries to the oath of office taken by that public servant. [35:24.680 --> 35:31.680] When they breach their duty, they are in violation of the contract they have with we the people. [35:31.680 --> 35:39.680] Three, the plaintiff performed, tendered performance of or was excused from performing its contractual obligations. [35:39.680 --> 35:46.680] We as the people have none other than to hold our public servants to their duty, okay? [35:46.680 --> 35:52.680] We don't have a performance necessity under the Constitution and the oath of office. [35:52.680 --> 35:54.680] They do. [35:54.680 --> 35:56.680] The defendant breached the contract. [35:56.680 --> 36:04.680] If they violate their oath, they act in contrast to the Constitution, the people's rights, or the laws of the state. [36:04.680 --> 36:08.680] They are in breach, okay? [36:08.680 --> 36:12.680] Number five, the defendant's breach caused the plaintiff injury. [36:12.680 --> 36:19.680] Well, again, we're back to the same injury sustained at the other side that we talked about just a minute ago. [36:19.680 --> 36:20.680] You've been falsely arrested. [36:20.680 --> 36:23.680] You've had your property taken without due process of law. [36:23.680 --> 36:26.680] You've been falsely imprisoned. [36:26.680 --> 36:31.680] You've been basically embarrassed in public. [36:31.680 --> 36:36.680] They usually, like for instance here in Nacogdoches, they publish the arrest reports in the paper. [36:36.680 --> 36:39.680] So people are going to know you've been arrested, people that weren't even there. [36:39.680 --> 36:41.680] They're going to know. [36:41.680 --> 36:48.680] They're not going to have the whole truth as to how you got arrested or why because they really just say driving without a license, [36:48.680 --> 36:52.680] arrested, blah, blah, blah, in the name of the individual. [36:52.680 --> 36:53.680] That's really all they put. [36:53.680 --> 36:56.680] It doesn't matter whether the charge has been proven or anything else. [36:56.680 --> 37:01.680] They just simply publish in the paper what you were charged with and the fact that you were arrested. [37:01.680 --> 37:03.680] So you've been publicly humiliated. [37:03.680 --> 37:11.680] You've been defamed, okay, even though the charges against you haven't been proven. [37:11.680 --> 37:14.680] So that's part of the issues here. [37:14.680 --> 37:18.680] There are several ways we can go about working on that cause of action. [37:18.680 --> 37:23.680] Now, I do know that we've got several that we're working on. [37:23.680 --> 37:26.680] The other one is going to be conversion. [37:26.680 --> 37:33.680] The conversion comes in when your funds are taken for public use unlawfully or for any other use without your consent [37:33.680 --> 37:35.680] in an unlawful manner. [37:35.680 --> 37:37.680] That's where conversion comes in. [37:37.680 --> 37:40.680] These are the elements of conversion. [37:40.680 --> 37:45.680] The plaintiff owned, possessed, or had the right to immediate possession of property. [37:45.680 --> 37:53.680] Your money and your labor and your automobile, all these things are property, okay? [37:53.680 --> 37:54.680] And they want it. [37:54.680 --> 38:03.680] They take it from you without due process of law or they make you pay fines without a conviction and so on and so forth. [38:03.680 --> 38:06.680] There's numerous ways that this one can be argued. [38:06.680 --> 38:09.680] The property was personal property. [38:09.680 --> 38:13.680] Again, your money, your car, this is all personal property. [38:13.680 --> 38:19.680] The defendant wrongfully exercised dominion or control over the property. [38:19.680 --> 38:24.680] Well, if they are acting in violation of law and violation of your rights in the process, [38:24.680 --> 38:34.680] then they are wrongfully exercising dominion or control over you and whatever other property of yours they've taken control of. [38:34.680 --> 38:37.680] And four, the plaintiff suffered an injury. [38:37.680 --> 38:44.680] The injury is, as we said, the unlawful imprisonment, the false imprisonment. [38:44.680 --> 38:47.680] I'm sorry, unlawful imprisonment is another issue. [38:47.680 --> 38:53.680] False imprisonment, robbery, they took your car, they take your money, theft. [38:53.680 --> 38:55.680] There's a number of different ways to go at that. [38:55.680 --> 38:57.680] All of these are injuries. [38:57.680 --> 39:00.680] All of these are torts, okay, in what they're doing. [39:00.680 --> 39:05.680] They're depriving you once again of property and your rights. [39:05.680 --> 39:12.680] All of these things are injurious to you as the plaintiff in this case. [39:12.680 --> 39:16.680] So those are just the first three causes of action. [39:16.680 --> 39:22.680] And what I'm going to do next Monday night is I will go over some of the additional causes of action that are going to be in this [39:22.680 --> 39:25.680] and go over each of the elements. Well, one of the other causes of action we're going to have is the false imprisonment. [46:36.680 --> 46:46.680] Now, there is a difference between false imprisonment and wrongful imprisonment. Wrongful imprisonment only applies to someone that has actually been incarcerated in a state penal facility. [46:46.680 --> 46:52.680] So don't confuse the two. False imprisonment only has three elements, and these are what they are. [46:52.680 --> 47:06.680] The defendant willfully detained the plaintiff. Two, the detention was without the plaintiff's consent. And three, the detention was without legal authority or justification. [47:06.680 --> 47:19.680] Now, that's going to make a very appealing cause of action for us when we go back through the research that I've got on what constitutes a legal and lawful arrest without a warrant. [47:19.680 --> 47:25.680] And guess what? They aren't legal in Texas the way they're doing it. They're not lawful. [47:25.680 --> 47:36.680] What's happened is, is that the courts and the legislators have attempted to take the common law, which is what the people's rights under the Constitution is based on. [47:36.680 --> 47:43.680] Okay. Now, when I say rights under the Constitution, please understand the Constitution did not grant our rights. [47:43.680 --> 47:54.680] It does not grant our rights. Therefore, no changes or alterations of the Constitution in any way, shape, or form alter the rights of the people. [47:54.680 --> 48:03.680] A right is a right whether it's in the Constitution or not in the Constitution, because the Constitution does not bequeath it, nor does it create it. [48:03.680 --> 48:25.680] So please keep that in mind. When I say under the Constitution, our rights are such under the common law that we expressly forbade our public servants to abrogate or derogate our rights under the common law as defined and protected within the Constitution. [48:25.680 --> 48:33.680] We said if this is what you can do, these are the things you're forbidden from ever touching. And the Bill of Rights was one of those. [48:33.680 --> 48:38.680] If you don't understand that, read Article 1, Section 29 of the Texas Constitution. [48:38.680 --> 48:57.680] Okay. It makes it very clear. The legislators may not create any statute, ordinance, or any other type of so-called law that interferes with anything in the Bill of Rights or with any other provision of the Texas Constitution. [48:57.680 --> 49:06.680] It's right there in black and white. Cannot miss it. You can intentionally misunderstand it and misapply it, but you can't miss it. [49:06.680 --> 49:20.680] Okay. So when they take you and they arrest you under the common law without there being a common law cause of arrest, they're acting under a statutory authority, not a lawful authority. [49:20.680 --> 49:29.680] And there is a difference. Remember, legal and lawful do not mean the same thing. Legal is what the laws of man say it is. [49:29.680 --> 49:44.680] Lawful is what the Constitution says can and cannot be done. And what cannot be done is our rights cannot be traded by legislative fiat for governmental purposes or governmental convenience. [49:44.680 --> 50:08.680] All right. So the fact that Code of Criminal Procedure 1401, Subsection B was intended to grant the law enforcement officers the authority to arrest for any offense committed in their presence is unconstitutional upon its face in that regard. [50:08.680 --> 50:26.680] Why? Because unless there is a breach of the peace or a felony and there is no authority to arrest without warrant and the legislature cannot grant such an authority because the common law contains no such authority. [50:26.680 --> 50:36.680] And as I said, the Constitution and the rights protected therein are based upon the common law, not statutory law. [50:36.680 --> 50:54.680] So the statutes do not win over the Constitution. So we can show very easily with cited case law and everything else that's going to be in this that element number three, the detention was without legal authority or justification, is provable. [50:54.680 --> 51:07.680] In fact, there's a gentleman by the name of Mr. Duncan that has had a case in court since 2003. The courts will not rule on it. They're just holding it. [51:07.680 --> 51:13.680] Which, by the way, if I ever get a constitutional amendment in place, I'm going to forbid that type of thing from happening. [51:13.680 --> 51:34.680] They'll have 30 days to render a decision or go to jail. But in any case, they've been sitting on this thing for seven years and it's a lawsuit against a state trooper because the state trooper arrested the two gentlemen without warrant and lied about the reason she arrested them [51:34.680 --> 51:50.680] and conspired with two other county deputies to falsify the cause for the arrest. And so he sued them. And it turns out that the Texas Supreme Court has it and will not rule on it. [51:50.680 --> 52:19.680] So that, most assuredly, is something that I'm going to be addressing if I manage to get in front of the legislature and asking them just exactly where do you people get off letting the courts hide behind nondecisions instead of doing their job and protecting the rights of the people and seeing that justice is done, not political power plays, for lack of a better way of putting it. [01:13:31.680 --> 01:13:44.680] So that means that the first officer, the one that wrote the citation, relied upon a conspiratorial consent and support from the other guy. [01:20:06.680 --> 01:20:17.680] But Article 5, Section 17 of the state constitution specifically states that the grand jury of the district shall check into all misdemeanor accusations. [01:21:07.680 --> 01:21:19.680] So we now have successfully tied all four actors into organized criminal activity and criminal conspiracy and intentional infliction of emotional distress and multiple other crimes. [01:21:21.680 --> 01:21:34.680] So we need to get criminal complaints done up, we need to get the motion to dismiss for lack of prosecution and lack of jurisdiction, and get those filed as soon as possible. [01:22:01.680 --> 01:22:04.680] Is that not assault? [01:22:04.680 --> 01:22:05.680] Yes, it is assault. [01:22:05.680 --> 01:22:06.680] Was he wearing a gun? [01:22:06.680 --> 01:22:07.680] Of course he was. [01:22:07.680 --> 01:22:09.680] Then it's aggravated assault. [01:22:09.680 --> 01:22:14.680] And the other bailiff in the room by letting him do it is guilty as well? [01:22:14.680 --> 01:22:15.680] Is culpable, yes he is. [01:22:15.680 --> 01:22:18.680] And the judge that was sitting at the bench at the time? [01:22:18.680 --> 01:22:22.680] Was there a trial going on in there? [01:22:22.680 --> 01:22:26.680] I don't think the recorder was going yet, but the judge was sitting at the bench. [01:22:26.680 --> 01:22:28.680] It doesn't make any difference if the recorder was going. [01:22:28.680 --> 01:22:32.680] Was the courtroom open for public access for the purpose of any type of trial? [01:22:32.680 --> 01:22:33.680] Yes. [01:22:33.680 --> 01:22:35.680] And you just happened to go in the wrong courtroom? [01:22:35.680 --> 01:22:36.680] Yes. [01:22:36.680 --> 01:22:37.680] Okay. [01:22:37.680 --> 01:22:41.680] Then what you have is a definite violation of the law by the bailiff. [01:22:41.680 --> 01:22:43.680] Okay. [01:22:43.680 --> 01:22:53.680] Now, when I left that room, going to the correct room, we of course were a couple of minutes late. [01:22:53.680 --> 01:22:58.680] And the bailiff met us at the door and told me if I wasn't supposed to be in there, I had to get out. [01:22:58.680 --> 01:23:02.680] And I said, well, she was 16 at the time and now she's 18. [01:23:02.680 --> 01:23:09.680] And the bailiff told me, yeah, I've got to go sit in the hall until such time as the judge says it's okay for me to be in there. [01:23:09.680 --> 01:23:12.680] Yeah, let me jump in here a second. [01:23:12.680 --> 01:23:16.680] This is what happens in Williamson County Courthouse. [01:23:16.680 --> 01:23:17.680] All right. [01:23:17.680 --> 01:23:23.680] They will not, they're supposed to be public courts, but they're not for all practical purposes. [01:23:23.680 --> 01:23:30.680] They, any kind of traffic issue or even criminal case, they will not let the public in. [01:23:30.680 --> 01:23:32.680] They will not let family members in. [01:23:32.680 --> 01:23:33.680] They will not let friends in. [01:23:33.680 --> 01:23:38.680] When you're on trial in Williamson County Courthouse, you have to go in there by yourself. [01:23:38.680 --> 01:23:43.680] And if you have an attorney, the attorney gets in, but that's it in that standard procedure. [01:23:43.680 --> 01:23:45.680] This isn't just directed at Bill. [01:23:45.680 --> 01:23:58.680] And there's even a huge sign in the hallway outside the courtrooms that tell everybody under no uncertain terms that even if you're a family member, you can't get in. [01:26:29.680 --> 01:26:35.680] Now, I believe that the court recorder was going at that time, so I need to get that court recording, and I'll- [01:26:35.680 --> 01:26:39.680] But that's not going to be an issue because that's not their court. [01:26:39.680 --> 01:26:41.680] That's not that particular judge's court. [01:26:41.680 --> 01:26:42.680] Okay. [01:26:42.680 --> 01:26:43.680] So they don't make that rule. [01:28:15.680 --> 01:28:24.680] That's probably not a good idea because they're not going to let you do it, and the judge has authority to make those kinds of, you know, rules in the courtroom. [01:28:31.680 --> 01:28:40.680] And last but not least, when they told me I had to sit down and I couldn't go to the bench where the prosecutor was, it made me angry, and I was mighty upset. [01:28:40.680 --> 01:28:49.680] So I grabbed my cell phone, and I went out in the hall, and I called 911 and told them that I was having trouble in the courtroom, and I needed some assistance immediately. [01:28:49.680 --> 01:28:54.680] And shortly thereafter, I got to talk to a couple of really nice deputies up there. [01:28:54.680 --> 01:29:10.680] And just as soon as I stood up in the courtroom and said, come here to the bailiff because I need to talk to you, the judge stood up, the bailiff said, all rise, and she exited the back of the room just like that. [01:34:16.680 --> 01:34:19.680] But when I spoke with him, he actually said that he wanted to take this into a [01:34:19.680 --> 01:34:23.680] statewide, make it a statewide event. [01:34:23.680 --> 01:34:27.680] Have you guys heard of that movement, I guess, if I can say that? [01:34:27.680 --> 01:34:31.680] No, I hadn't heard of that one in particular, though I have heard from all over [01:34:31.680 --> 01:34:33.680] the place people were upset about him. [01:34:33.680 --> 01:34:37.680] Well, I do know somebody who pretty much single-handedly got the red light [01:34:37.680 --> 01:34:40.680] cameras removed from College Station, Texas. [01:34:40.680 --> 01:34:41.680] Wow. [01:34:41.680 --> 01:34:43.680] Yeah, he went on a campaign, went on a crusade. [01:34:43.680 --> 01:34:47.680] He was doing a fast, and it was a real public thing, [01:34:47.680 --> 01:34:49.680] and he was out on the street every day. [01:34:49.680 --> 01:34:53.680] And they pressure, he filed a lawsuit, and they pressured the city council. [01:34:53.680 --> 01:34:58.680] And he just rallied so much support from the community and so much pressure on [01:34:58.680 --> 01:35:03.680] city council that eventually city council got rid of him. [01:35:03.680 --> 01:35:05.680] Now, there is one other thing you may want to consider while you're going [01:35:05.680 --> 01:35:07.680] after that, though. [01:35:07.680 --> 01:35:14.680] Originally, the information that was provided to these cities regarding the [01:35:14.680 --> 01:35:20.680] installation and management of these cameras at the intersections specifically [01:35:20.680 --> 01:35:27.680] stated in the vendor material that they were aware that there will be an [01:35:27.680 --> 01:35:30.680] increase in rear-end collisions. [01:35:30.680 --> 01:35:37.680] So they instituted through contract a program knowing in advance that it would [01:35:37.680 --> 01:35:40.680] cause injury to the public. [01:35:40.680 --> 01:35:42.680] Yeah. [01:35:42.680 --> 01:35:46.680] Now, that's right in the vendor's documentation regarding those lights, [01:35:46.680 --> 01:35:50.680] those cameras at those lights, that there will be an increase. [01:35:50.680 --> 01:35:56.680] We are aware that there will be an increase in rear-end collision incidents. [01:35:56.680 --> 01:36:03.680] Was that what they mean into no end or did they expect a change or that's [01:36:03.680 --> 01:36:05.680] just how the language was written out? [01:36:05.680 --> 01:36:08.680] That's just how the language was written out in the information. [01:36:08.680 --> 01:36:14.680] They're aware that what they're doing causes an initial harm upon the public. [01:36:14.680 --> 01:36:17.680] Whether or not it levels out is irrelevant. [01:36:17.680 --> 01:36:20.680] That's like saying because we were firing bullets across Main Street the [01:36:20.680 --> 01:36:24.680] first six months and killed 15 people, [01:36:24.680 --> 01:36:27.680] everybody eventually learned not to walk across that intersection of [01:36:27.680 --> 01:36:29.680] Main Street. [01:36:29.680 --> 01:36:31.680] That's just stupidity. [01:36:31.680 --> 01:36:34.680] Yeah, because it doesn't mean that 15 people died. [01:36:34.680 --> 01:36:36.680] Exactly. [01:36:36.680 --> 01:36:40.680] So the fact that they knew they were going to cause an increase in property [01:36:40.680 --> 01:36:46.680] damages to the public but instituted the cameras anyway shows a complete [01:36:46.680 --> 01:36:53.680] willful negligence for public safety and the willingness to neglect the [01:36:53.680 --> 01:36:56.680] public safety for the revenue. [01:36:56.680 --> 01:36:58.680] Yeah. [01:36:58.680 --> 01:37:00.680] Well, we're going after it. [01:37:00.680 --> 01:37:02.680] And that's one of the things I know he's big on. [01:37:02.680 --> 01:37:06.680] I can't say that I'm ten toes deep into the actual language, [01:37:06.680 --> 01:37:09.680] but he can lay it out, I guess, just as well as you are. [01:40:51.680 --> 01:40:57.680] You need photographs of your automobile at a distance and of the front and back [01:40:57.680 --> 01:41:02.680] plates on that automobile and the registration for that automobile. [01:41:02.680 --> 01:41:05.680] You need copies of all that, certified copies. [01:41:05.680 --> 01:41:08.680] This is the thing, though, because I can work on getting it, [01:41:08.680 --> 01:41:10.680] but it was a rental car. [01:41:10.680 --> 01:41:13.680] So do I just call the rental company and get them to... [01:41:13.680 --> 01:41:16.680] You have a copy of the rental agreement, right? [01:41:16.680 --> 01:41:19.680] Oh, I could probably get it again, yeah. [01:41:19.680 --> 01:41:22.680] Okay, get a copy of the rental agreement and make sure that they list the VIN [01:41:22.680 --> 01:41:26.680] number and all the other information regarding the license plate and state of [01:41:26.680 --> 01:41:31.680] registration with what they send you, okay? [01:41:36.680 --> 01:41:40.680] You make the officer testify that he wrote that citation, [01:41:40.680 --> 01:41:44.680] that he put all the information on that citation, okay, [01:41:44.680 --> 01:41:47.680] and that he swore it was true and correct. [01:41:47.680 --> 01:41:50.680] Don't spill the beans just yet. [01:41:50.680 --> 01:41:54.680] Is it true, officer, that you signed this ticket under penalty of perjury and [01:41:54.680 --> 01:41:57.680] put that complaint under penalty of perjury that all the information you [01:41:57.680 --> 01:42:00.680] presented to this court is true and correct? [01:42:00.680 --> 01:42:03.680] He's going to have to say yes. [01:42:03.680 --> 01:42:06.680] Then you're going to introduce into evidence your copy of the rental [01:42:06.680 --> 01:42:10.680] agreement and the information from the car company stating that it is not [01:42:10.680 --> 01:42:15.680] registered in Texas, that the plates do not belong to a Texas automobile, [01:42:15.680 --> 01:42:18.680] that the ticket is flawed because it says it does, [01:42:18.680 --> 01:42:23.680] so the officer has identified the completely incorrect vehicle. [01:42:23.680 --> 01:42:28.680] If you wanted to testify to everything on that ticket, make, model, year, [01:42:28.680 --> 01:42:33.680] everything, okay, and then you're going to hit him with, [01:42:33.680 --> 01:42:35.680] and you said it was registered in Texas. [01:42:35.680 --> 01:42:36.680] Is that correct? [01:42:36.680 --> 01:42:38.680] No, it was a rental car. [01:42:38.680 --> 01:42:40.680] It had Georgia plates, but he said the citation. [01:43:08.680 --> 01:43:14.680] And when they match up correctly and then the license and registration [01:43:14.680 --> 01:43:19.680] point do not, then that's a fatal flaw because he has failed to identify [01:43:19.680 --> 01:43:21.680] the proper vehicle. [01:43:21.680 --> 01:43:26.680] He's basically cited you with driving a vehicle that doesn't exist. [01:43:26.680 --> 01:43:28.680] Yeah. [01:43:28.680 --> 01:43:32.680] But as Randy suggested, you need to go to the DMV and get a report from [01:43:32.680 --> 01:43:36.680] them stating, does that license number exist in Texas? [01:49:32.680 --> 01:49:38.680] I've also heard you mention the three questions to ask when you get pulled [01:49:38.680 --> 01:49:45.680] over, and one of the things I wanted to know after hearing that was if you [01:49:45.680 --> 01:49:52.680] were driving around without registration and license, how would the officer ever [01:49:52.680 --> 01:49:53.680] be able to give you a ticket? [01:49:53.680 --> 01:50:00.680] He wouldn't know who you are until he arrested you or until he...well, I guess [01:50:00.680 --> 01:50:03.680] I don't even know if he'd ever be able to get your identification from you [01:50:03.680 --> 01:50:09.680] because you're telling us to shut up after asking the three questions. [01:50:09.680 --> 01:50:14.680] Yeah, if they arrest you, shut up because they're required to give you counsel. [01:50:14.680 --> 01:50:16.680] At least here in Texas they are. [01:50:16.680 --> 01:50:20.680] You need to find out what the deal is in your state, but here in Texas they're [01:50:20.680 --> 01:50:24.680] required to give you counsel when they arrest you for these purposes. [01:50:24.680 --> 01:50:27.680] They don't want to, but they are. [01:50:27.680 --> 01:50:32.680] But the reason I tell most folks to shut up is because most folks know just [01:50:32.680 --> 01:50:36.680] enough to get themselves in way over their head and they don't know how to [01:50:36.680 --> 01:50:38.680] swim. [01:50:38.680 --> 01:50:43.680] I do what I do because I have spent 11 years studying this statute. [01:50:43.680 --> 01:50:45.680] I know it forwards and backwards. [01:50:45.680 --> 01:50:52.680] I can argue it toe-to-toe with anybody and have done so. [01:50:52.680 --> 01:50:57.680] If he's determined to give you a ticket, though, he has to get that [01:50:57.680 --> 01:50:59.680] information, correct? [01:50:59.680 --> 01:51:03.680] Usually what they'll do is threaten you with arrest, and if you won't give it [01:51:03.680 --> 01:51:10.680] to them, they will then arrest you, though I have had some just say, well, [01:51:10.680 --> 01:51:12.680] I'm just going to issue you a warning. [01:51:12.680 --> 01:51:14.680] Well, fine, issue it, but who are you going to issue it to? [01:51:14.680 --> 01:51:16.680] You haven't even asked me my name. [01:51:16.680 --> 01:51:20.680] And technically here in Texas you're not required to give it to them unless [01:51:20.680 --> 01:51:25.680] you've already been lawfully arrested, not just been arrested but lawfully [01:51:25.680 --> 01:51:27.680] arrested. [01:51:27.680 --> 01:51:33.680] And without probable cause, they don't have a way to lawfully arrest you. [01:51:33.680 --> 01:51:37.680] So that's the point of issue that I stand upon. [01:51:37.680 --> 01:51:41.680] I don't have a problem with giving them my name because the first thing I [01:51:41.680 --> 01:51:45.680] give them is a judicial notice with my name on it stating this is the only [01:51:45.680 --> 01:51:48.680] piece of documentation you're going to get. [01:51:48.680 --> 01:51:52.680] So the three-question thing is for people who are more amateurs like [01:51:52.680 --> 01:51:53.680] myself. [01:51:53.680 --> 01:51:57.680] Actually, no, the three questions do serve a legal purpose. [01:51:57.680 --> 01:52:02.680] The purpose is to show that the officer acted willingly and negligently in [01:52:02.680 --> 01:52:05.680] declaring an emergency where none existed. [01:52:05.680 --> 01:52:08.680] That's the reason for question number one. [01:52:08.680 --> 01:52:12.680] Question number two, am I under arrest does two things. [01:52:12.680 --> 01:52:17.680] It shows the officer is incompetent if he answers no because in Texas law [01:52:17.680 --> 01:52:21.680] you are under arrest the moment he turned those lights on. [01:52:21.680 --> 01:52:26.680] Second, it shows the officer is willing to lie to your face if he later admits [01:52:26.680 --> 01:52:30.680] he did know you were under arrest, okay? [01:52:30.680 --> 01:52:36.680] Plus it sets the groundwork since the Supreme Court is real big on trying to [01:52:36.680 --> 01:52:43.680] say a detention is not an arrest, then we use this to show that you were not [01:52:43.680 --> 01:52:48.680] detained, you were arrested, okay? [01:52:48.680 --> 01:52:52.680] And then the third question is, am I free to go, which is the additional [01:52:52.680 --> 01:52:59.680] linchpin question to reinforce question number two. [01:52:59.680 --> 01:53:01.680] That's the purpose of the questions. [01:53:01.680 --> 01:53:06.680] They're not asked lightly nor without purpose. [01:53:06.680 --> 01:53:12.680] Now, if you were towing something, let's say, or let's just leave it at that. [01:53:12.680 --> 01:53:20.680] If you were towing something, could they at least temporarily confiscate your [01:53:20.680 --> 01:53:23.680] property and toss you in jail? [01:53:23.680 --> 01:53:29.680] I mean, although this is the right thing to do, I believe, and after you learn [01:53:29.680 --> 01:53:34.680] what your rights are and everything, it does potentially cause a lot of [01:53:34.680 --> 01:53:36.680] problems in your life. [01:53:36.680 --> 01:53:37.680] Yes, it can. [01:53:37.680 --> 01:53:41.680] And to answer your question, it works like this. [01:53:41.680 --> 01:53:46.680] As long as they are willing to violate the Constitution, they will do whatever [01:53:46.680 --> 01:53:51.680] they think they can and want to in the process, okay? [01:53:51.680 --> 01:53:55.680] So that's exactly the problem. [01:53:55.680 --> 01:54:04.680] But what I'm doing is standing up to say, you're not doing that to me anymore. [01:54:09.680 --> 01:54:15.680] Now, they may still run roughshod over you with spiked boots, but that doesn't [01:54:15.680 --> 01:54:18.680] mean you lay down and let them do it. [01:54:18.680 --> 01:54:22.680] It's all dependent upon what you're willing to put up with to get your stand [01:54:22.680 --> 01:54:27.680] in and to stay firm upon it, okay? [01:54:27.680 --> 01:54:31.680] And through all the times that my family and friends have asked me, why don't [01:54:31.680 --> 01:54:36.680] you just do this and this and stop having all these things happen to you?
