[06:03.600 --> 06:09.600] How did you get into all this, like, Patriot movement stuff to begin with and the 9-11 Truth [06:09.600 --> 06:15.600] movement, and what moved you to found the We Are Change San Antonio chapter of We Are [06:15.600 --> 06:16.600] Change? [06:16.600 --> 06:18.600] And just give us an overview here. [06:18.600 --> 06:19.600] Okay. [06:19.600 --> 06:20.600] I'd love to do that. [06:20.600 --> 06:26.600] Well, 9-11, I woke up to that pretty much the first day when the television stations [06:26.600 --> 06:32.600] were showing footage of what was, at the time, dancing Palestinians, and the media was saying [06:32.600 --> 06:35.600] they were happy that we were being attacked. [06:35.600 --> 06:39.600] And then I just thought that was odd that they would have cameras there immediately on [06:39.600 --> 06:42.600] them, like, instantaneously on the other side of the world. [06:42.600 --> 06:44.600] They would be there recording live via satellite. [06:44.600 --> 06:49.600] So I thought that was fishy, and then ABC News says, oh, that was stock footage from [06:49.600 --> 06:50.600] a festival. [06:50.600 --> 06:53.600] Yeah, and then it turned out they were actually Israelis. [06:53.600 --> 06:54.600] Yeah. [06:54.600 --> 06:59.600] So that led me to Alex Jones wrote a tyranny. [06:59.600 --> 07:05.600] I mean, I was awake within the first couple of months, but I wasn't awake to the whole [07:05.600 --> 07:08.600] movement so much. [07:08.600 --> 07:10.600] But I did get around to that. [07:10.600 --> 07:15.600] For example, in 2004, I voted third party because I was following Infowars somewhat, [07:15.600 --> 07:18.600] but not as much as I do now in the last couple of years. [07:18.600 --> 07:23.600] But I was kind of, you know, on board, and it took the Ron Paul revolution coming around [07:23.600 --> 07:28.600] and then I started getting active, campaigning, going doorwalking every Saturday with the [07:28.600 --> 07:29.600] local meetup. [07:29.600 --> 07:34.600] And then I actually canvassed my whole precinct, my whole neighborhood, and what I would do [07:34.600 --> 07:39.600] is I would wear an MP3 player and listen to the Alex Jones show while flipping us Ron [07:39.600 --> 07:41.600] Paul slim gems at every single house. [07:41.600 --> 07:44.600] And I would have DVDs on me for people who wanted to talk. [07:44.600 --> 07:48.600] And that was kind of the beginning of weird change because I was doing that. [07:48.600 --> 07:53.600] But then come to the Texas State Republican Convention, I was a delegate. [07:53.600 --> 07:57.600] I met a lot of other great people and actually met people from San Antonio I hadn't met [07:57.600 --> 08:03.600] yet that were also young and down with Infowars and, you know, against the New World Order. [08:03.600 --> 08:06.600] And that spawned kind of weird change to San Antonio. [08:06.600 --> 08:13.600] But what it really took, the thing that just really pushed me to that edge was going and [08:13.600 --> 08:18.600] seeing Truth Rising in Austin at Alma Draft House when Alex had a screening. [08:18.600 --> 08:22.600] And I had seen some weird change videos on the net, but that was it. [08:22.600 --> 08:24.600] I was like, oh yeah, what they're doing. [08:24.600 --> 08:27.600] You know, I was still pumped up from the Ron Paul revolution and that had already died [08:27.600 --> 08:29.600] down, but I was still ready to keep going. [08:29.600 --> 08:33.600] I wasn't slowing down, any slowing down for me, which is kind of sad to see because, you [08:33.600 --> 08:37.600] know, you had so many people in the Ron Paul revolution who were amped up and, you know, [08:37.600 --> 08:38.600] they were doing stuff. [08:38.600 --> 08:42.600] And then just because Ron Paul drops out of the race, it's like, you know, they stopped [08:42.600 --> 08:43.600] their activism. [08:43.600 --> 08:46.600] They stopped fighting this information war. [08:46.600 --> 08:50.600] And that's kind of, you know, that's another factor that got me to, you know, keep going. [08:50.600 --> 08:52.600] I was like, I'm not going to be like these people and just stop. [08:52.600 --> 08:53.600] There's no stopping now. [08:53.600 --> 08:55.600] That was the beginning. [08:55.600 --> 08:59.600] So that was pretty much the beginning of We Are Change San Antonio. [08:59.600 --> 09:00.600] That's awesome. [09:00.600 --> 09:03.600] Well, tell us about some of the things that you guys do. [09:03.600 --> 09:05.600] Y'all are into like street actions and stuff like this. [09:05.600 --> 09:06.600] Give us a history. [09:06.600 --> 09:10.600] When did you find We Are Change San Antonio? [09:10.600 --> 09:13.600] That was the summer of 2008. [09:13.600 --> 09:16.600] And, you know, we already had a small group ready. [09:16.600 --> 09:23.600] You know, the Ron Paul meetup leftovers, you know, us radical info warriors, the ones that [09:23.600 --> 09:27.600] really had the courage to go and talk about 9-11 on the streets whereas most people in [09:27.600 --> 09:29.600] the meetup believed it was an inside job. [09:29.600 --> 09:31.600] They wouldn't say anything really public about it. [09:31.600 --> 09:33.600] So, you know, we kind of stood out for that. [09:33.600 --> 09:36.600] So we started doing street actions here in San Antonio. [09:36.600 --> 09:41.600] We started off at this monthly event here in San Antonio called First Friday. [09:41.600 --> 09:42.600] It's down in the Art District. [09:42.600 --> 09:45.600] The King William District is kind of like a residential neighborhood. [09:45.600 --> 09:50.600] But there's one corner that has a brewery and a bunch of art galleries. [09:50.600 --> 09:54.600] And what it is is that people used to gather every Friday night and used to be able to [09:54.600 --> 09:58.600] walk up and down about a quarter mile block and drink beer. [09:58.600 --> 09:59.600] And there'd be vendors. [09:59.600 --> 10:03.600] So a lot of different people would be out there, different crowds, different demographics. [10:03.600 --> 10:05.600] And we started off there. [10:05.600 --> 10:08.600] But more recently, First Friday, we'd still go there. [10:08.600 --> 10:12.600] And back then, we would kind of, you know, get not really great responses. [10:12.600 --> 10:15.600] And it'd be more the young people would be like, oh, yeah, 9-11 was an inside job. [10:15.600 --> 10:18.600] And we'd get comments like that. [10:18.600 --> 10:23.600] And so First Friday has really died down in the last year because they stopped allowing [10:23.600 --> 10:25.600] people to walk up and down the street with beer. [10:25.600 --> 10:30.600] But two months ago when we were out there with a free DVD sign and 200 Fall of the Republics, [10:30.600 --> 10:34.600] and we were also handing out Deborah Medina pamphlets and flyers. [10:34.600 --> 10:36.600] It was a totally different response. [10:36.600 --> 10:38.600] It was like we're preaching to the choir. [10:38.600 --> 10:41.600] You would have thought we were at a truth convention or something. [10:41.600 --> 10:46.600] It was like everybody there had somewhat of an idea about either the New World Order, [10:46.600 --> 10:50.600] Deborah Medina, and at the time, the recent debates, Info Wars. [10:50.600 --> 10:51.600] It was just crazy. [10:51.600 --> 10:54.600] I got a video, but I haven't made an actual YouTube video of it. [10:54.600 --> 10:56.600] But that was amazing. [10:56.600 --> 10:57.600] A lot of us were shocked. [10:57.600 --> 11:00.600] We were like, wow, people are really starting to wake up. [11:00.600 --> 11:03.600] So we do a lot of street actions and hand out DVDs. [11:03.600 --> 11:06.600] We have a little DVD burning tower here. [11:06.600 --> 11:12.600] And we've got great volunteers who are always donating here in San Antonio the DVDs or funds [11:12.600 --> 11:13.600] to get DVDs. [11:13.600 --> 11:18.600] We've got people donating from all around really to help us keep the DVD burning mission going. [11:18.600 --> 11:23.600] That's probably our strongest attribute is getting DVDs burnt and getting them out. [11:23.600 --> 11:28.600] And one of our first street actions from the Alamo was one of our first popular videos [11:28.600 --> 11:33.600] where the Alamo Park Police actually grabs our camera and wrestles it [11:33.600 --> 11:35.600] and is telling us to stop recording. [11:35.600 --> 11:40.600] And that was one of the first videos that got us on Prison Planet, Info Wars. [11:40.600 --> 11:42.600] And that was just amazing. [11:42.600 --> 11:46.600] I didn't realize how big that was at the time that a cop would actually violate us like that [11:46.600 --> 11:50.600] because we were still newbies and we were still green in activism. [11:50.600 --> 11:56.600] And then another time, well, basically, we'd always start off going in front of Alamo, [11:56.600 --> 11:59.600] and we were getting in trouble here and there. [11:59.600 --> 12:06.600] But more recently in September, before this September 11, 2009, we were at the mall [12:06.600 --> 12:08.600] and we thought we were recording, but the camp quarter wasn't. [12:08.600 --> 12:11.600] And we were born in this court area on the River Walk. [12:11.600 --> 12:14.600] And the cops came up to us and they said, we know who you are. [12:14.600 --> 12:17.600] You're those Info Wars Prison Planet guys. [12:17.600 --> 12:19.600] And they just smiled and let us go. [12:19.600 --> 12:20.600] They didn't do anything. [12:20.600 --> 12:23.600] And I thought we were recording, but we weren't, unfortunately. [12:23.600 --> 12:28.600] So it seems we are having an impact here in San Antonio. [12:28.600 --> 12:31.600] And keep in mind also that San Antonio is a big military town. [12:31.600 --> 12:33.600] We have like four bases here. [12:33.600 --> 12:37.600] And on the weekends down there is a bunch of people in their military uniforms [12:37.600 --> 12:39.600] or even just off duty. [12:39.600 --> 12:41.600] So we are trying to have an impact. [12:41.600 --> 12:45.600] And we're going to continue going really stronger this year. [12:45.600 --> 12:50.600] As you know, so much going on lately. [12:50.600 --> 12:52.600] Well, Matt, that's incredible. [12:52.600 --> 13:00.600] Have any police or any governors tried to grab your cameras recently? [13:00.600 --> 13:06.600] Or has that pretty much died down since it's gotten so well known [13:06.600 --> 13:09.600] that they do these kinds of things? [13:09.600 --> 13:12.600] Yeah, it went from a park policeman grabbing our cameras. [13:12.600 --> 13:16.600] So now this year, that was in 2008 and fast forward to 2010, [13:16.600 --> 13:20.600] now we actually have the Texas state governor grabbing our camera. [13:20.600 --> 13:24.600] And that was the great work of Abel Rodriguez, [13:24.600 --> 13:27.600] who was simply asking questions to the governor, Rick Perry. [13:27.600 --> 13:31.600] And Rick Perry just really did not want to be on camera [13:31.600 --> 13:33.600] and have these questions asked to him, [13:33.600 --> 13:37.600] which made him resort to physically grabbing the camera [13:37.600 --> 13:42.600] in a mob, goon-style move and tactic and turning it off [13:42.600 --> 13:44.600] and then signing Abel's book, [13:44.600 --> 13:47.600] which was the whole reason Abel's Gateway to Speak to Perry [13:47.600 --> 13:51.600] was having him sign none other than 1984 by George Orwell, [13:51.600 --> 13:53.600] as well as Animal Farm. [13:53.600 --> 13:55.600] He had both books listed. [13:55.600 --> 13:57.600] And Perry was more than happy to... [13:57.600 --> 13:59.600] You know what Perry wrote in the first book? [13:59.600 --> 14:01.600] He wrote Keep Up the Good Fight. [14:01.600 --> 14:05.600] He signed Animal Farm in 1984 and said Keep Up the Good Fight? [14:05.600 --> 14:07.600] Yes. [14:07.600 --> 14:09.600] After he grabbed Abel's camera. [14:09.600 --> 14:12.600] We're going to have Abel on in a few minutes for listeners. [14:20.600 --> 14:24.600] And we were also here when Bill Clinton was in town, [14:24.600 --> 14:29.600] and it was basically a branch of the CFR here, [14:29.600 --> 14:32.600] the World Council of Affairs. [14:32.600 --> 14:34.600] They're located on Trinity University, [14:34.600 --> 14:36.600] and they hosted Bill Clinton. [14:36.600 --> 14:38.600] And we were trying so hard to get tickets [14:38.600 --> 14:40.600] that we found some on Craigslist. [14:40.600 --> 14:42.600] And I let the guy know what we were doing. [14:42.600 --> 14:44.600] Well, really, I met the guy in person. [14:44.600 --> 14:46.600] He wanted to charge us $25 a ticket, [14:46.600 --> 14:48.600] and the tickets were free for college kids. [14:48.600 --> 14:50.600] And once I told him what we were doing, [14:50.600 --> 14:52.600] he was out here taking for free, and I gave him some DVDs. [14:52.600 --> 14:55.600] So me and Richard from San Antonio, where I changed, [14:55.600 --> 14:57.600] went to the event. [14:57.600 --> 15:00.600] And it was the total sell of being a global citizen [15:00.600 --> 15:05.600] and one of those sad stories about poor kids in other countries [15:05.600 --> 15:08.600] and volunteering to help them. [15:08.600 --> 15:10.600] But at the end of this event, [15:10.600 --> 15:14.600] the World Council of Affairs presented Bill Clinton [15:14.600 --> 15:16.600] with a golden globe, [15:16.600 --> 15:18.600] and they gave Bill Clinton the title, [15:18.600 --> 15:20.600] The Prince of Peace. [15:20.600 --> 15:22.600] And we got that on video, and unfortunately, [15:22.600 --> 15:24.600] we didn't yell out anything. [15:24.600 --> 15:26.600] We were more or less kind of mesmerized, [15:26.600 --> 15:28.600] because Richard and I are Christians, [15:28.600 --> 15:30.600] and we believe in the Bible and the Word of Jesus Christ. [15:30.600 --> 15:34.600] And in the Bible, Jesus Christ is the Prince of Peace. [15:34.600 --> 15:37.600] So to hear Bill Clinton of all people being anointed [15:37.600 --> 15:40.600] with this title and this shiny, bright, golden globe, [15:40.600 --> 15:43.600] we were just, like, standing with our mouths hanging open. [20:22.600 --> 20:28.600] Before he won the election, this was about a week before. [20:58.600 --> 21:04.600] So I went by myself, and he was surrounded by a lot of people just, you know, [21:04.600 --> 21:07.600] giggling and laughing at every single thing he said. [21:07.600 --> 21:09.600] So he just blew in and out of there. [21:09.600 --> 21:11.600] He wasn't there for more than 15 minutes. [21:11.600 --> 21:19.600] So immediately after he finished his little speech that he could help me get a thousand times, [21:19.600 --> 21:22.600] I handed him my book, and I asked him if he could sign it. [21:22.600 --> 21:25.600] It was The George Orwell's 1984. [21:25.600 --> 21:27.600] And he looked at the cover before he signed it [21:27.600 --> 21:32.600] because I know he doesn't sign some books. [21:32.600 --> 21:37.600] Abel, are you still with us? [21:56.600 --> 22:01.600] And he didn't deny it, but basically he played it off where he says, [22:01.600 --> 22:04.600] you know, there wasn't anything conspiracy going on. [22:04.600 --> 22:09.600] And he just really – he laughed it off, and everybody in the room laughed with him. [22:09.600 --> 22:13.600] But everybody in the room really doesn't know that in 1974, [22:13.600 --> 22:17.600] there's actual White House documents between Henry Kissinger and Nixon [22:17.600 --> 22:23.600] where the Bilderberg group is basically calling for the elimination of about 3 billion people. [22:23.600 --> 22:25.600] That's an actual document. You can find it. [22:25.600 --> 22:29.600] So the Bilderberg group does exist, and if people do their research, [22:29.600 --> 22:35.600] they'll find out that, you know, about 130 people are attending these highly controlled meetings. [22:35.600 --> 22:41.600] And I also got a chance to ask Rick Perry if he thought we needed a new investigation into 9-11. [22:41.600 --> 22:46.600] And to his credit, he pretty much said no, and he handed me my book back. [22:46.600 --> 22:49.600] He says, no, and here's your book back. [22:49.600 --> 22:54.600] So I said, you know, six of the commissioners are saying we need a new investigation. [22:54.600 --> 22:57.600] You know, they said that they were basically set up to fail. [22:57.600 --> 23:00.600] And, you know, basically he just walks away. [23:00.600 --> 23:03.600] So I think we're doing something right with these kind of questions, [23:03.600 --> 23:07.600] where these people are either grabbing cameras or avoiding us. [23:07.600 --> 23:13.600] So if more people can keep doing this, I think we can get that change we're looking for. [23:13.600 --> 23:16.600] So at what point did he actually grab your camera? Was that before or after? [23:16.600 --> 23:17.600] Outside. Outside. [23:17.600 --> 23:21.600] First I got his signature inside, and then I got a second chance to ask him. [23:21.600 --> 23:25.600] And when he saw me, he recognized me and knew I had the Bilderberg question. [23:25.600 --> 23:28.600] I also asked him if he supported a North American union, [23:28.600 --> 23:32.600] which he's pretty much instrumental in the trans-Texas corridor [23:32.600 --> 23:34.600] and all the toll roads that are with it. [23:34.600 --> 23:35.600] Oh, yeah. Oh, yeah. [23:35.600 --> 23:40.600] So he saw me and he recognized me, and everybody else was there was completely friendly. [23:48.600 --> 23:54.600] So this guy is very slick, you know, and it's definitely a moment to find the button, [23:54.600 --> 23:58.600] to return it on, but he didn't just grab it. He knew how to turn it off. [23:58.600 --> 24:05.600] So I bounced back and got him on camera and asked him a few more questions about 9-11. [24:05.600 --> 24:10.600] But that's about it. And then his security men, you know, they're right there with him. [24:10.600 --> 24:15.600] So you don't get too much time, you know, to ask maybe one or two questions at the most. [24:15.600 --> 24:18.600] So we've got to make the most of those two questions because, you know, [24:18.600 --> 24:22.600] you really don't get a lot of time before they, you know, force you off. [24:22.600 --> 24:25.600] Yeah, yeah. And also, yeah, it is public knowledge. [24:25.600 --> 24:28.600] I mean, it was promoted in the Dallas Morning News. [24:28.600 --> 24:32.600] It was the headline in the Dallas Morning News when he went to the Bilderberg. [24:32.600 --> 24:38.600] And it's also a violation of the Logan Act because governors... [24:38.600 --> 24:42.600] Any elected official cannot meet and discuss policy. [24:42.600 --> 24:47.600] Yes, any elected official cannot meet in private to discuss policy [24:47.600 --> 24:50.600] with heads of state of other governments. [24:50.600 --> 24:55.600] And even if you want to say, well, they weren't discussing policy, blah, blah, blah, [24:55.600 --> 24:58.600] they can't meet with members of the private sector either. [24:58.600 --> 25:01.600] So either which way you slice it, there's two aspects of the Logan Act. [25:01.600 --> 25:07.600] Either which way you slice it, he violated because he can't go as a representative [25:07.600 --> 25:13.600] of the U.S., of the United States because he's not a federal official. [25:13.600 --> 25:18.600] He's a state governor. And so that's one aspect. [25:18.600 --> 25:23.600] And if I may cut in real quick, this is Matthew. [25:23.600 --> 25:26.600] When Abel confronted Rick Perry, Rick Perry said, [25:26.600 --> 25:30.600] yes, I did attend the Bilderberg conference to speak about energy. [25:30.600 --> 25:35.600] However, in the Dallas Morning News article at the top under the headline, [25:35.600 --> 25:40.600] it says Rick Perry attended Bilderberg to speak about federalism. [25:40.600 --> 25:44.600] Yes, so that shows right there he was going to discuss policy. [25:44.600 --> 25:51.600] So I mean, unless you are a designated official of a federal government, [25:51.600 --> 25:58.600] you cannot go and discuss policy with officials of foreign governments. [26:04.600 --> 26:08.600] He blows it off basically saying, you know, I didn't see anything conspiracy [26:08.600 --> 26:12.600] because I specifically asked him what exactly goes on there that is so, you know, [26:12.600 --> 26:17.600] with closed doors. You know, I didn't see anything conspiracy. [26:17.600 --> 26:19.600] He said, you know, there. And then he kind of laughed him off. [26:19.600 --> 26:23.600] He said, well, I did debate a woman about global warming, you know, [26:23.600 --> 26:28.600] saying that if we did create it, you know, it's not by us or something. [26:28.600 --> 26:31.600] In other words, if there is global warming, it ain't by us. [26:31.600 --> 26:34.600] You know, and then he has the whole crowd giggling to that. [32:47.600 --> 32:52.600] We were handing out, I believe it was either Loose Change or Terror Storm. [32:52.600 --> 32:59.600] And the incident you're talking about is the video and the headline of the video is Free Speech is Murder. [32:59.600 --> 33:03.600] And what I was talking about was where we actually give them the DVDs and they all looked, [33:03.600 --> 33:05.600] except them, and they were going to check them out. [33:05.600 --> 33:12.600] And a few minutes later, one of their sergeants come by and takes all the DVDs from them [33:12.600 --> 33:16.600] and basically collected them and walked away with them. [33:16.600 --> 33:18.600] Basically, I guess he threw them away. [33:18.600 --> 33:25.600] But it's just amazing how there are, yes, there are a lot of military people down there, [33:25.600 --> 33:29.600] to be able to actually get them into a conversation about 9-11 [33:29.600 --> 33:32.600] in an environment where they're not feeling threatened or anything. [33:32.600 --> 33:36.600] It's not that easy. But we do pass out the DVDs. We do our best. [33:36.600 --> 33:40.600] But it's not exactly the Cape Walk. [33:40.600 --> 33:45.600] Oh, yeah. And they love to take advantage of me being the little guy. [33:45.600 --> 33:51.600] And at one event, again, in front of the Alamo on a Saturday morning, the Houston Street Market Fair, [33:51.600 --> 33:55.600] I had two or three different guys, and one day, one street action, [33:55.600 --> 33:58.600] tell me I was a disgrace to the country. [33:58.600 --> 34:01.600] And it's where different guys tell me the same thing. [34:01.600 --> 34:06.600] I've had people spit on the ground in front of me, you know, I've had, you know, all that. [34:06.600 --> 34:12.600] We've split the claiming more than once. [34:12.600 --> 34:15.600] What was that, Matt? You had what happen? [34:15.600 --> 34:19.600] We've had the bird split to us by women. [34:19.600 --> 34:21.600] That's pretty common, though, yeah. [34:21.600 --> 34:23.600] Yeah, that's pretty common. [34:23.600 --> 34:28.600] So we do get a lot of, you know, angst from some people. [34:28.600 --> 34:33.600] But yet then we'll also have the young guys in the Air Force do take the DVDs [34:33.600 --> 34:37.600] at a local art event one Saturday. [34:37.600 --> 34:44.600] And Winter 08, it was a chalk art festival, you know, street art done with chalk. [34:44.600 --> 34:46.600] And I entered us into that. [34:46.600 --> 34:50.600] The table was there, and we did a, it's on the San AntonioTruth.org. [34:50.600 --> 34:51.600] You can see the pictures. [34:51.600 --> 34:56.600] We did a mural with McCain and Obama being part of the pyramid. [34:56.600 --> 34:59.600] And we had a group of Air Force, young Air Force guys come up to us, [34:59.600 --> 35:02.600] shake our hands and tell us what you're doing is truly American. [35:02.600 --> 35:06.600] And we had a bunch of DVDs laid out next to the mural, and they took DVDs. [35:06.600 --> 35:09.600] We had people coming up to us and shaking our hands. [35:09.600 --> 35:12.600] So, you know, for every few that we get that spit on the ground, [35:12.600 --> 35:16.600] that cussed at us, told us we were disgraced, we do have the guys with the guts [35:16.600 --> 35:19.600] in uniform come up to us to shake our hands. [35:19.600 --> 35:21.600] That's awesome. [35:21.600 --> 35:23.600] That's great. [35:23.600 --> 35:29.600] You will find that it varies quite a bit as to the mindset of some of these folks. [35:29.600 --> 35:32.600] The trainees are being newly indoctrinated. [35:32.600 --> 35:34.600] That's the first thing you have to realize. [35:34.600 --> 35:38.600] When you find them up there with their parents and everything around San Antonio, [35:38.600 --> 35:42.600] you can almost guarantee these are folks that are there either in basic [35:42.600 --> 35:44.600] or they're in tech school there, [35:44.600 --> 35:50.600] and they're very controlled as to what they're allowed to have in their possession at that time. [35:50.600 --> 35:54.600] A better option would probably be to offer it to the parents on their behalf or something, [35:54.600 --> 35:59.600] simply so the sergeant then would have no recourse in taking it. [35:59.600 --> 36:03.600] Yeah, you know, I did my advanced training there. [36:03.600 --> 36:09.600] I was at 91 Delta when I was in the military, and I know exactly that is the case. [36:09.600 --> 36:13.600] So it is difficult, but we've been getting the word out. [36:13.600 --> 36:17.600] So I think all we need are more events like we had up in Austin [36:17.600 --> 36:21.600] and just keep doing what we're doing, and we're slowly winning this, you know, [36:21.600 --> 36:25.600] because it truly is an information war. [36:25.600 --> 36:32.600] If I may, San Antonio, being that you're familiar with it being a military town, [36:32.600 --> 36:35.600] it's now actually being taken to the next level. [36:35.600 --> 36:39.600] San Antonio is being prepped to be the hub of cybersecurity. [36:39.600 --> 36:44.600] What we have here in San Antonio is the newly constructed NSA headquarters, [36:44.600 --> 36:48.600] which our local representative, Ciro Rodriguez, [36:48.600 --> 36:53.600] labels the NSA headquarters the cyber hub of the world, [36:53.600 --> 36:56.600] able to contain all the cyber data of the world. [36:56.600 --> 36:59.600] If you're driven by that, the building is huge, [36:59.600 --> 37:04.600] and you know how much information, you know, you can keep on a little disc in your camera. [37:04.600 --> 37:09.600] Imagine how much information is being stored in, you know, in that size of facility. [37:09.600 --> 37:12.600] And, you know, today I'm in the construction field. [37:12.600 --> 37:17.600] Today a fellow electrician who worked with the contractor who built the NSA headquarters [37:17.600 --> 37:22.600] told me about these underground levels under the NSA headquarters [37:22.600 --> 37:26.600] and basically millions of dollars worth of data cable being run. [37:26.600 --> 37:32.600] And he was told that the building was being built for a bilingual training for the military. [01:04:24.600 --> 01:04:31.600] Yeah, well, in the 1925 Code under Article 7214, there is an oath of assessor, [01:04:31.600 --> 01:04:34.600] and it starts out with these words, [01:04:34.600 --> 01:04:37.600] every tax assessor and deputy tax assessor in this state, [01:04:37.600 --> 01:04:41.600] in addition to the oath prescribed by the Constitution of this state, [01:04:41.600 --> 01:04:45.600] shall, before entering upon the duties of his office, [01:04:45.600 --> 01:04:47.600] take and subscribe to the following oath. [01:04:47.600 --> 01:04:50.600] And in part, this is a long oath. [01:04:50.600 --> 01:04:54.600] It's way longer than the constitutional requirement, but this is basically the beginning of what it says, [01:04:54.600 --> 01:04:57.600] which is what makes this important. [01:04:57.600 --> 01:05:03.600] I, and whatever their name is, tax assessor or deputy tax assessor, as the case may be, [01:05:03.600 --> 01:05:06.600] in and for whatever county, Texas, [01:05:06.600 --> 01:05:14.600] do solemnly swear that I will personally view and inspect all the real estate and improvements thereon [01:05:14.600 --> 01:05:26.600] subject to taxation lying in said county that may be rendered to me for taxation by any corporation or individual [01:05:26.600 --> 01:05:31.600] or by their agent or representative as fully as may be practicable, [01:05:31.600 --> 01:05:34.600] and that I will, as fully as is practicable, [01:05:34.600 --> 01:05:41.600] view and inspect all other property in said county rendered to me as aforesaid. [01:05:41.600 --> 01:05:44.600] Now, that's just the beginning of this. [01:05:44.600 --> 01:05:52.600] But this right here, when was the last time you saw a tax assessor actually personally go and inspect a piece of property [01:05:52.600 --> 01:05:54.600] before assessing a tax on it? [01:05:54.600 --> 01:05:56.600] I've never seen one do it. [01:05:56.600 --> 01:05:58.600] I've never even heard of such a thing. [01:05:58.600 --> 01:06:03.600] I've never seen one on a piece of property that's had a tax bill sent to it. [01:06:03.600 --> 01:06:06.600] And I've actually questioned them. [01:06:06.600 --> 01:06:09.600] For instance, they sent me a tax bill for $25,000. [01:06:09.600 --> 01:06:12.600] I told them to go climb up a tree and jump. [01:06:12.600 --> 01:06:14.600] Number one, I wasn't paying it. [01:06:14.600 --> 01:06:19.600] Number two, there hadn't been anybody out there to assess what the value of my property was. [01:06:19.600 --> 01:06:22.600] If they had, I'd have known it. [01:06:22.600 --> 01:06:24.600] And no one's been out there and they admit it. [01:06:24.600 --> 01:06:26.600] No, we haven't ever come out there. [01:06:26.600 --> 01:06:29.600] We just based upon the records of such and such. [01:06:29.600 --> 01:06:31.600] I'm going like, yeah, that's what I figured. [01:06:31.600 --> 01:06:35.600] Well, this right here proves they're supposed to personally inspect it [01:06:35.600 --> 01:06:38.600] and ascertain what the fair market value is. [01:06:38.600 --> 01:06:40.600] They don't do that. [01:06:40.600 --> 01:06:44.600] When they cough up a number out of thin air without doing what the law requires them to do, [01:06:44.600 --> 01:06:46.600] guess what, folks? [01:06:46.600 --> 01:06:49.600] They're committing fraud. [01:06:49.600 --> 01:06:52.600] And we need to go after them for it. [01:06:52.600 --> 01:06:54.600] Now, this is the other interesting part. [01:06:54.600 --> 01:07:00.600] The 1925 codes required an awful lot of O's of office for folks. [01:07:00.600 --> 01:07:05.600] This is what had to be done for the oath of the board [01:07:05.600 --> 01:07:09.600] when a county commissioner's court convenes for equalization of taxation of property. [01:07:09.600 --> 01:07:13.600] Listen to this, oath of board. [01:07:13.600 --> 01:07:16.600] When a commissioner's court convenes as a board of equalization [01:07:16.600 --> 01:07:22.600] before considering the subject of equalization of property values for the purposes of taxation, [01:07:22.600 --> 01:07:26.600] each member of the court, including the county judge, [01:07:26.600 --> 01:07:30.600] shall take and subscribe to the following oath. [01:07:30.600 --> 01:07:37.600] I, their name, a member of the board of equalization of whatever county for the year A.D. whatever, [01:07:37.600 --> 01:07:43.600] hereby solemnly swear that in the performance of my duties as a member of such board for said year, [01:07:43.600 --> 01:07:51.600] I will not vote to allow any taxable property to stand assessed on the tax rolls of said county for said year [01:07:51.600 --> 01:07:55.600] at any sum which I believe to be less than its true market value, [01:07:55.600 --> 01:08:00.600] or if it has no market value, then it's real value. [01:08:00.600 --> 01:08:03.600] Now, the value is not the important part here. [01:08:03.600 --> 01:08:09.600] The important part here is when was the last time the commissioner's court convened with the county judge [01:08:09.600 --> 01:08:16.600] and before setting an equalization board in motion, took this oath. [01:08:16.600 --> 01:08:24.600] Now, the section that follows both of these is Neglect of Duty Cause for Removal. [01:08:24.600 --> 01:08:31.600] And it goes through all the things necessary to have the county commissioners, the assessor, the county judge, [01:08:31.600 --> 01:08:37.600] whoever didn't abide by these statutes, to have them removed. [01:08:37.600 --> 01:08:43.600] Guess what does not appear in any current version of the statutes? [01:08:43.600 --> 01:08:52.600] Neither of these oaths, nor the Neglect of Duty for Cause Removal statute. [01:08:52.600 --> 01:08:54.600] Why is that? [01:08:54.600 --> 01:09:00.600] If it turns out that we go look at the actual book and there is a certification by the secretary of state [01:09:00.600 --> 01:09:10.600] that that publication is a true and correct copy of the actual laws from 1925, where are these oaths? [01:09:10.600 --> 01:09:15.600] If they're not in there, then the current statutes are not a true and correct copy. [01:09:15.600 --> 01:09:21.600] Somebody is committing fraud through omission, and they're doing it intentionally. [01:09:21.600 --> 01:09:29.600] And we need to make a state about it, a state that can be smelled around the country if I can help it. [01:09:29.600 --> 01:09:31.600] But that's all I got for the moment. [01:09:31.600 --> 01:09:33.600] There will be more later. [01:09:33.600 --> 01:09:36.600] Well, we definitely have to do something about it. [01:09:36.600 --> 01:09:44.600] And, you know, speaking of this oath thing, the reason, or at least one of the reasons, [01:09:44.600 --> 01:09:49.600] why I finally realized it's so important, why these people have to have an oath, [01:09:49.600 --> 01:09:56.600] why they need to take it is because that's where a human being crosses the line [01:09:56.600 --> 01:10:07.600] between just being a sovereign human being crosses the line over to being a public servant subject to us. [01:10:07.600 --> 01:10:11.600] And they have to be bound by their conscience because now they're placed in a position [01:10:11.600 --> 01:10:17.600] of being able to deprive the sovereign people of life, liberty, and property. [01:10:17.600 --> 01:10:20.600] And that's why they have to take an oath. [01:10:20.600 --> 01:10:23.600] And that's where they cross that line over, and they have to do it. [01:10:23.600 --> 01:10:26.600] And I've been trying to figure out why they don't do it. [01:10:26.600 --> 01:10:31.600] And I think one of the reasons is because they're not using their real names. [01:10:31.600 --> 01:10:32.600] They're using aliases. [01:10:32.600 --> 01:10:34.600] And these oaths have to be notarized. [01:10:34.600 --> 01:10:40.600] And a notary is an officer of the court, and they're not going to put their butt on the line to go to jail [01:10:40.600 --> 01:10:50.600] and lose their commission for notarizing a document where it's not really the person who's signing. [01:10:50.600 --> 01:10:58.600] That's basically what a notary is for, is that the notary verifies that you are who you say you are when you sign that paper. [01:10:58.600 --> 01:11:04.600] So the oath is very important because without that oath, they're not a public servant. [01:11:04.600 --> 01:11:06.600] They haven't been bound by their conscience. [01:11:06.600 --> 01:11:07.600] That is correct. [01:11:07.600 --> 01:11:15.600] They have not crossed the line to be bound by their conscience to be a servant of the people. [01:11:15.600 --> 01:11:17.600] And that is absolutely necessary. [01:11:17.600 --> 01:11:27.600] That is the only assurance that we have that they are not going to just rampantly deprive us of our life, liberty, and property. [01:11:27.600 --> 01:11:29.600] That's why they have to take that oath. [01:11:29.600 --> 01:11:39.600] Right. And the problem they've got is that the entire reason for the oath is because the founding fathers knew men were inherently treacherous. [01:11:39.600 --> 01:11:40.600] Right. [01:11:40.600 --> 01:11:42.600] The oath is there to make them accountable. [01:11:42.600 --> 01:11:43.600] Absolutely. [01:11:43.600 --> 01:11:52.600] But now since these people did not take the oath, then in true understanding of the terminology, [01:11:52.600 --> 01:11:58.600] they have usurped the powers of office to which they do not belong. [01:11:58.600 --> 01:12:00.600] They're imposters. [01:12:00.600 --> 01:12:04.600] Which means we can get rid of them through a quote-unquote warranty procedure. [01:12:04.600 --> 01:12:08.600] I think the statute says they abandoned the office. [01:12:08.600 --> 01:12:10.600] They can't abandon an office that never qualifies them. [01:12:10.600 --> 01:12:11.600] That's right. [01:12:11.600 --> 01:12:13.600] They never took office in the first place. [01:12:13.600 --> 01:12:16.600] It's kind of like Barry Sartaro. [01:12:16.600 --> 01:12:21.600] It's not proper to put him through impeachment proceedings because he never took office. [01:12:21.600 --> 01:12:24.600] He's illegally occupying it. [01:12:24.600 --> 01:12:31.600] If you're appointed to the office, then in order to complete the process, you have to swear to the oath. [01:12:31.600 --> 01:12:36.600] If you fail to swear to the oath, you abandon the office you were appointed to. [01:12:36.600 --> 01:12:47.600] Well, but the only part about that I disagree with, Randy, is that it specifically states the beginning of these oaths before presuming the duties of office. [01:15:06.600 --> 01:15:09.600] I stopped at a convenience store and I turned my headlights off [01:15:09.600 --> 01:15:12.600] because they were shining right in the window at some people. [01:15:12.600 --> 01:15:15.600] And I forgot to turn them back on, so they pulled me over. [01:15:15.600 --> 01:15:20.600] And the two officers, you know, started asking me questions, blah, blah, blah. [01:15:20.600 --> 01:15:24.600] And they were about to let me go when the K-9 cop pulled up. [01:15:24.600 --> 01:15:25.600] They didn't call him. [01:15:25.600 --> 01:15:26.600] He just showed up. [01:15:26.600 --> 01:15:29.600] And I sat there and watched this happen. [01:15:29.600 --> 01:15:31.600] He walked up to the window. [01:15:31.600 --> 01:15:35.600] He walked up to the two officers, talked for a little while, went up to my truck, [01:15:35.600 --> 01:15:37.600] asked one of the officers. [01:15:37.600 --> 01:15:39.600] He said, I smell marijuana. [01:15:39.600 --> 01:15:41.600] Do you smell marijuana? [01:15:41.600 --> 01:15:43.600] And the officer said no. [01:15:43.600 --> 01:15:45.600] So he asked the other officer. [01:15:45.600 --> 01:15:46.600] He said no. [01:15:46.600 --> 01:15:52.600] So he calls in another officer in another car, came up five or ten minutes later, [01:15:52.600 --> 01:15:59.600] walked him up to my truck and asked him, you know, very, very directly, [01:15:59.600 --> 01:16:00.600] I smell marijuana. [01:16:00.600 --> 01:16:01.600] Do you smell marijuana? [01:16:01.600 --> 01:16:03.600] And finally he said yes. [01:16:03.600 --> 01:16:08.600] I was on the side of the road for two hours before I actually went to jail. [01:16:08.600 --> 01:16:12.600] And they actually did find him, which I was surprised because, you know, [01:16:12.600 --> 01:16:17.600] I didn't have anything on me that I knew of, you know, for sure in my truck. [01:16:17.600 --> 01:16:20.600] I don't carry, you know, I don't have any of that on me ever. [01:16:20.600 --> 01:16:22.600] Well, but you said you never saw it. [01:16:22.600 --> 01:16:25.600] So how do you know they found something that you're sure of? [01:16:25.600 --> 01:16:26.600] What then? [01:16:26.600 --> 01:16:27.600] You said you never saw it. [01:19:01.600 --> 01:19:04.600] I told the judge I was going to represent myself, [01:19:04.600 --> 01:19:09.600] and he told me a little lame parable about the judge who thought he was an electrician [01:19:09.600 --> 01:19:15.600] and burned his house down, which was, you know, just silly. [01:19:15.600 --> 01:19:21.600] But anyhow, he said go ahead and try him, you know, and so I did. [01:19:21.600 --> 01:19:26.600] But anyhow, now I'm trying to fiddle this game plan together. [01:19:26.600 --> 01:19:33.600] I have a pretrial in about 10 days and then trial in about 20, 21, 22 days [01:19:33.600 --> 01:19:35.600] or something like that. [01:19:35.600 --> 01:19:39.600] Okay, move to dismiss Too Old to Prosecute. [01:19:39.600 --> 01:19:41.600] Move to dismiss. [01:19:41.600 --> 01:19:43.600] Too Old to Prosecute, speedy trial demand. [01:19:43.600 --> 01:19:48.600] Go to your attorney and tell him to file a motion to dismiss violations, [01:19:48.600 --> 01:19:52.600] constitutional right to a speedy trial. [01:19:52.600 --> 01:20:00.600] If he gives you any crap at all, take a copy of a bar grievance form with you, [01:20:00.600 --> 01:20:03.600] lay it down in front of him, and start filling it out. [01:20:12.600 --> 01:20:20.600] I was wondering when I was taking to jail that night, I never saw a magistrate at all. [01:20:20.600 --> 01:20:26.600] I was released on bond about five hours after I was taken in. [01:20:26.600 --> 01:20:29.600] This was about 2 o'clock in the morning. [01:20:29.600 --> 01:20:46.600] And I was wondering, do I have any way to, you know, the aggravated kidnapping or... [01:20:46.600 --> 01:20:47.600] You've got all of it. [01:20:47.600 --> 01:20:49.600] I'm charged. I have all of it. [01:20:49.600 --> 01:20:51.600] I never saw a magistrate. [01:20:51.600 --> 01:20:53.600] What time did they arrest you? [01:20:53.600 --> 01:20:55.600] They arrested me at about 11 o'clock. [01:20:55.600 --> 01:21:01.600] They can claim there was no magistrate available at that time, [01:21:01.600 --> 01:21:05.600] but they will have to show that they made an effort to locate a magistrate. [01:21:05.600 --> 01:21:06.600] And they did not. [01:21:06.600 --> 01:21:10.600] There was no due diligence made whatsoever to locate a magistrate. [01:21:10.600 --> 01:21:13.600] That can be established as a matter of policy. [01:21:13.600 --> 01:21:21.600] I suggest you prepare a tort letter to the commissioner's court [01:21:21.600 --> 01:21:28.600] and claim an action against the officers and all of the jailers who were in the jail that night. [01:21:28.600 --> 01:21:29.600] Right. [01:21:29.600 --> 01:21:35.600] And whoever the magistrate was who somebody had to sign the warrant, [01:21:35.600 --> 01:21:38.600] because there had to be a warrant issued if you were arrested. [01:21:38.600 --> 01:21:39.600] Yeah. [01:21:39.600 --> 01:21:46.600] And if there was a hearing on that, then I was not there, so that's... [01:21:46.600 --> 01:21:50.600] Good. Good. You sound like you know the routine. [01:21:50.600 --> 01:21:53.600] So you want to find the warrant. [01:21:53.600 --> 01:22:01.600] 1620, 16.20 Code of Criminal Procedure requires after an arrest without a warrant, [01:22:01.600 --> 01:22:07.600] when a determination of probable cause is made, the magistrate must create a warrant. [01:22:07.600 --> 01:22:08.600] Right. [01:22:08.600 --> 01:22:11.600] You want to know where it's at. You want to know who created it. [01:22:11.600 --> 01:22:12.600] Right. [01:22:12.600 --> 01:22:20.600] And when he created it, and when he held a hearing under Chapter 16. [01:22:20.600 --> 01:22:21.600] Right. [01:22:21.600 --> 01:22:24.600] And well, I was curious about that. [01:22:24.600 --> 01:22:33.600] I was unsure about that, because in some places in the Code, like in the Code of Criminal Procedure 17.033, [01:22:33.600 --> 01:22:40.600] when it talks about release on bond of certain persons arrested, it says in there that... [01:22:40.600 --> 01:22:44.600] Let's see. [01:22:44.600 --> 01:22:51.600] If a person has to be released on bond after the 24th hour, [01:22:51.600 --> 01:22:58.600] if the person was arrested for a misdemeanor and a magistrate has not determined whether probable cause exists. [01:22:58.600 --> 01:22:59.600] So does that mean... [01:22:59.600 --> 01:23:11.600] Release or not, it doesn't relieve the police of the duty to make a due diligence effort to take you before a magistrate. [01:23:11.600 --> 01:23:16.600] They can't just say, well, we'll just hold him 24 hours and let him go on a bond. [01:23:16.600 --> 01:23:22.600] 17.20, 21, 22 authorizes the police to set bond themselves, [01:23:22.600 --> 01:23:26.600] or to release you in certain circumstances where bond is preset. [01:23:26.600 --> 01:23:27.600] Right. [01:23:27.600 --> 01:23:36.600] But their duty to make a due diligence effort to locate a magistrate is not abated because they let you go after 24 hours. [01:23:36.600 --> 01:23:37.600] Okay. [01:23:37.600 --> 01:23:44.600] And possession of marijuana is not one of those things mentioned in 17.20, 21, 22. [01:23:44.600 --> 01:23:46.600] Right. [01:23:46.600 --> 01:23:48.600] So they've got a problem. [01:23:48.600 --> 01:23:51.600] I can file the speedy trial motion. [01:23:51.600 --> 01:23:58.600] I should go ahead and file a criminal complaint against the arresting officer. [01:23:58.600 --> 01:23:59.600] Absolutely. [01:23:59.600 --> 01:24:01.600] And against the jailers. [01:24:01.600 --> 01:24:02.600] Okay. [01:24:02.600 --> 01:24:06.600] They're the innocent party and they will scream the loudest. [01:24:06.600 --> 01:24:07.600] Right. [01:24:07.600 --> 01:24:13.600] You want discovery for the names of all the jailers who were in the jail at the time you were in there. [01:24:14.600 --> 01:24:24.600] And so I should also, I'm going to have all this, like I said, I have this court appointed attorney, so I'm not sure how that works if I'm stuck with him. [01:24:24.600 --> 01:24:25.600] Oh, that's great. [01:24:25.600 --> 01:24:27.600] You can work him over. [01:24:27.600 --> 01:24:29.600] Yeah, that's what I was thinking too. [01:24:29.600 --> 01:24:37.600] But I've got a lot of motions that I'm wanting to give to him and, you know, if he doesn't want to barge or even... [01:24:37.600 --> 01:24:49.600] Let your court appointed attorney know that you failed to adjudicate just one of my due process rights, I'll file a bar grievance against you for each one. [01:24:50.600 --> 01:25:02.600] And then I also realized going through the Texas Code of Criminal Procedure here that if you don't file these motions on your original trials, then you cannot use them in an appeal. [01:25:02.600 --> 01:25:08.600] Right, unless, the only ones you can use are challenges to subject matter jurisdiction. [01:25:08.600 --> 01:25:11.600] We absolutely need these motions filed. [01:25:11.600 --> 01:25:12.600] Right. [01:25:12.600 --> 01:25:17.600] And so I should do, I should do, I should definitely do a challenge to jurisdiction. [01:26:06.600 --> 01:26:15.600] Not if the statement is clear enough from the, there's some ambiguity in the case law on that. [01:26:15.600 --> 01:26:22.600] Wait a minute, how can they charge you with a crime if they're not going to state specifically what statute they're accusing you of violating? [01:26:22.600 --> 01:26:25.600] That's where there's ambiguity in the case law. [01:26:25.600 --> 01:26:26.600] Well. [01:26:26.600 --> 01:26:35.600] They're saying that a statement of the statute is insufficient. There has to be a statement of the crime, of the act you're, you're accused of committing. [01:26:35.600 --> 01:26:40.600] Yeah, but that doesn't mean that they don't have to state the specific statute. [01:26:40.600 --> 01:26:43.600] That's where the case law wasn't clear. [01:26:43.600 --> 01:26:54.600] It just says that the state, to me that sounds like they're just saying that stating the statute isn't enough that you have to state what the, some kind of description of the crime. [01:26:54.600 --> 01:27:04.600] That doesn't exempt them from stating the statute that they're claiming you violated. They're just saying that may not be enough. [01:27:04.600 --> 01:27:08.600] What the case law is saying that that's enough for the filing of the complaint. [01:27:08.600 --> 01:27:17.600] Now you can file a motion for, to be advised of the nature and cause and ask for more clarity. [01:27:17.600 --> 01:27:21.600] But they're saying that's enough to make the accusation. [01:27:21.600 --> 01:27:24.600] Yeah, well, something, something's got to be wrong with that. [01:27:24.600 --> 01:27:33.600] That's, there's got to be more case law that clarifies that, Randy, because otherwise they can just say, well, you committed a crime because you ate chocolate chip cookies. [01:27:33.600 --> 01:27:35.600] I mean, they're essentially doing that. [01:27:35.600 --> 01:27:41.600] Okay. Well, they can't do that. All right. That's, that's got to be some kind of bizarre misinterpretation. [01:27:41.600 --> 01:27:50.600] There's got to be other case law. I mean, they can't just make up laws that you're breaking that have never been passed by Congress. [01:27:50.600 --> 01:27:52.600] They can't just make things up. [01:27:52.600 --> 01:27:54.600] That was a place in the case law. [01:27:54.600 --> 01:27:58.600] That does not, that does not even make sense on a common sense level. [01:27:58.600 --> 01:28:03.600] That cannot be what it means just like going back to the includes and including thing. [01:28:03.600 --> 01:28:11.600] It can't just simply be an expansive term because otherwise it can mean anything. [01:28:11.600 --> 01:28:14.600] Okay. And that just doesn't make sense on a common sense level. [01:28:14.600 --> 01:28:21.600] There's got to be other, there's got to be other details in there that, that we have overlooked. [01:48:38.600 --> 01:48:42.600] When I was in high school, and I know what's going on here, [01:48:42.600 --> 01:48:48.600] there is a transfer of custodial responsibility from the custodial guardian [01:48:48.600 --> 01:48:52.600] or custodial parent, whoever that may be, to the school system [01:48:52.600 --> 01:48:57.600] once the child is dropped off or bussed off or whatever to the school. [01:48:57.600 --> 01:49:01.600] And the school has a responsibility, a custodial responsibility [01:49:01.600 --> 01:49:04.600] over the minor at that point in time, [01:49:04.600 --> 01:49:07.600] and that's why they don't want to let kids leave campus [01:49:07.600 --> 01:49:09.600] because if anything happens to the kid, [01:49:09.600 --> 01:49:13.600] then the school can get the crapola sued out of them, [01:49:13.600 --> 01:49:16.600] and that's why they have these daytime curfew laws. [01:55:16.600 --> 01:55:19.600] Our task in this case is to articulate more clearly the boundaries [01:55:19.600 --> 01:55:22.600] of what is permissible under the Fourth Amendment. [01:55:22.600 --> 01:55:25.600] Although we hesitate to announce that the Constitution compels a specific [01:55:25.600 --> 01:55:29.600] time limit, it is important to provide some degree of certainty [01:55:29.600 --> 01:55:33.600] so that the states and counties may establish procedures with confidence [01:55:33.600 --> 01:55:37.600] that they fall within the constitutional bounds. [01:55:37.600 --> 01:55:41.600] Taking into account the competing interests articulated in Gerstein, [01:55:41.600 --> 01:55:46.600] we believe that the jurisdiction that provides judicial determinations [01:55:46.600 --> 01:55:51.600] of probable cause within 48 hours will, as a general matter, [01:55:51.600 --> 01:55:54.600] comply with the promptness requirements of Gerstein. [01:55:54.600 --> 01:55:59.600] For this reason, such jurisdictions will be immune from systematic challenges. [01:55:59.600 --> 01:56:06.600] Now, what they go on to say is if you screw up and you fall outside the 48 hours, [01:56:06.600 --> 01:56:13.600] you better have a darn good reason, and putting together, getting documents [01:56:13.600 --> 01:56:19.600] and grabbing prosecutors and things of that nature does not qualify [01:56:19.600 --> 01:56:24.600] as good enough reason, a weekend does not qualify as good enough reason [01:56:24.600 --> 01:56:30.600] to not bring you before a magistrate. [01:56:30.600 --> 01:56:37.600] There is other case law that addresses this issue in that the 48 hour [01:56:37.600 --> 01:56:40.600] has been lowered to 24. [01:56:40.600 --> 01:56:43.600] That's why they always try to get you handled by 24. [01:56:43.600 --> 01:56:53.600] But the law says there shall be no set time limit. [01:56:53.600 --> 01:56:57.600] That an officer's only defense against an allegation of false imprisonment [01:56:57.600 --> 01:57:03.600] for failure to timely take is a showing and due diligent effort to locate. [01:57:03.600 --> 01:57:08.600] The time limit only goes to prima facie. [01:57:08.600 --> 01:57:15.600] If they get you before a magistrate within the 24 hours, on the face of it, [01:57:15.600 --> 01:57:22.600] the taking is timely, and the complaint has to show that it wasn't. [01:57:22.600 --> 01:57:29.600] It's not like they give them 24 hours and that if they just barely squeak it in [01:57:29.600 --> 01:57:31.600] under the 24 hour mark, then they're good to go. [01:57:31.600 --> 01:57:35.600] It's not a deadline. They have to do it immediately. [01:57:35.600 --> 01:57:39.600] It's just that if they do it within 24 hours, it's prima facie evidence [01:57:39.600 --> 01:57:43.600] that they were timely, and if it's over 24 hours, [01:57:43.600 --> 01:57:46.600] it's prima facie evidence that it's not. [01:57:46.600 --> 01:57:49.600] It's just who the onus is on. [01:57:49.600 --> 01:57:52.600] After 24 hours, they have to prove it up.
