[05:44.800 --> 05:48.800] What it is is that someone had put up a copy [05:48.800 --> 05:53.800] of the traffic notice affidavit from the seminar, [05:53.800 --> 05:57.800] and people were posting comments on it and so on and so forth. [05:57.800 --> 06:00.800] Well, of course, people being how they are, [06:00.800 --> 06:03.800] the very first thing that was posted was a comment [06:03.800 --> 06:06.800] that just outright attacked it [06:06.800 --> 06:08.800] without even having any understanding [06:08.800 --> 06:10.800] of what it was actually saying. [06:10.800 --> 06:22.800] The website you can go to to look at this is www.elliscountyobserver.com, [06:22.800 --> 06:25.800] elliscountyobserver.com. [06:25.800 --> 06:28.800] You can go there and you can look at what's been posted so far. [06:28.800 --> 06:32.800] There's 40-some-odd comments posted at the moment, [06:32.800 --> 06:34.800] 46 to be exact, [06:34.800 --> 06:38.800] and the very large ones, of course, are mine [06:38.800 --> 06:41.800] trying to explain the reason for the affidavit, [06:41.800 --> 06:46.800] some semblance of understanding to be transferred also, [06:46.800 --> 06:49.800] and some discussion of the statutes and so on and so forth. [06:49.800 --> 06:53.800] Now, you will see that there is a lot of support [06:53.800 --> 06:56.800] for this information posted here, [06:56.800 --> 06:59.800] as well as some naysaying on the subject. [06:59.800 --> 07:03.800] And the biggest thing is the original posting [07:03.800 --> 07:05.800] that was commented on it that was talking about [07:05.800 --> 07:08.800] how the statute was being used [07:08.800 --> 07:13.800] when the statute didn't apply to the person using it. [07:13.800 --> 07:16.800] So what I did was the very first thing was I addressed that. [07:16.800 --> 07:18.800] You are absolutely correct. [07:18.800 --> 07:25.800] The statutes being applied here do not have any application at all to the people. [07:25.800 --> 07:28.800] And that's the entire point of the affidavit. [07:28.800 --> 07:33.800] The problem here is that the person doing the posting [07:33.800 --> 07:36.800] does not have an understanding of the hierarchy of law, [07:36.800 --> 07:39.800] it would appear, based upon what they posted [07:39.800 --> 07:41.800] and what their attitude on it was. [07:41.800 --> 07:43.800] So let me do a quick recap of this. [07:43.800 --> 07:50.800] The people of Texas established the state of Texas. [07:50.800 --> 07:54.800] They did this by creating and writing a constitution, okay? [07:54.800 --> 07:59.800] Within that constitution, we created our three branches of government, [07:59.800 --> 08:02.800] our legislative, our executive, and our judicial. [08:02.800 --> 08:07.800] Inside of that, we gave each one of those branches individual, [08:07.800 --> 08:13.800] separated, and forever to remain separated powers [08:13.800 --> 08:17.800] that the people delegated to these individual branches. [08:17.800 --> 08:21.800] These branches are allowed to do anything that the Constitution [08:21.800 --> 08:28.800] specifically granted them authority to do and nothing more. [08:28.800 --> 08:32.800] When the people write a constitution, it is not a blanket order. [08:32.800 --> 08:39.800] It is an order to our servant government that this is what we are allowing you to do. [08:39.800 --> 08:42.800] And only what's here is what you may do. [08:42.800 --> 08:45.800] You can't go beyond this. [08:45.800 --> 08:50.800] So we did not in any way, shape, or form within our constitution [08:50.800 --> 08:55.800] grant any powers to the legislature to regulate the people. [08:55.800 --> 08:58.800] We did not grant that authority. [08:58.800 --> 09:02.800] If you can find it in that constitution, please show it to me. [09:02.800 --> 09:05.800] It does not exist. [09:05.800 --> 09:11.800] It would be completely retarded to presume it could exist. [09:11.800 --> 09:15.800] The reason being as one of the things that I posted on the website here is [09:15.800 --> 09:19.800] I do not have the authority to tell anybody out there listening [09:19.800 --> 09:22.800] what they may or may not do with their property. [09:22.800 --> 09:26.800] If Randy and Deborah and I got together and cast a vote, [09:26.800 --> 09:31.800] we all three together do not have the authority to tell somebody else out there [09:31.800 --> 09:35.800] what they can or cannot do with their own property. [09:35.800 --> 09:41.800] By that same token, nobody out there can take that reverse methodology [09:41.800 --> 09:44.800] and apply it back to us, okay? [09:44.800 --> 09:50.800] Therefore, we cannot delegate that power to a governmental body. [09:50.800 --> 09:56.800] If we didn't have it to begin with, we cannot grant it to our servant government. [09:56.800 --> 10:00.800] We can't grant a greater power than we have, okay? [10:00.800 --> 10:06.800] So the limitation just from common sense alone is that government can only do [10:06.800 --> 10:10.800] the things which the people specifically granted authority for [10:10.800 --> 10:18.800] and can only regulate the things under that authority, which we as the people are not. [10:18.800 --> 10:23.800] Now, that's the first thing in this entire brick foundation we have to build [10:23.800 --> 10:27.800] is who we are versus who the government is. [10:27.800 --> 10:30.800] And they are subservient to us. [10:30.800 --> 10:33.800] It is not the other way around. [10:33.800 --> 10:41.800] Now, the biggest debate you're going to see in this is over the term person, as always, okay? [10:41.800 --> 10:45.800] And I did my best to explain it to a couple of the naysayers on here, [10:45.800 --> 10:50.800] whether or not I was successful to the majority of them, I don't know. [10:50.800 --> 10:57.800] I do know that the first poster that got the ball rolling still doesn't get it. [10:57.800 --> 11:02.800] He just reposted his same comment that I posted my last response to, [11:02.800 --> 11:05.800] saying I don't see how it gets much clearer than this. [11:05.800 --> 11:10.800] And he's citing Section 543 where it says an officer can arrest any person [11:10.800 --> 11:15.800] in violation of this chapter or this subtitle, blah, blah, blah, okay? [11:15.800 --> 11:24.800] I tried to explain to him what makes you think that the people meet the statutory definition of a person. [11:24.800 --> 11:31.800] Especially when it's very clear in the transportation code what the definition of a person is within the code. [11:31.800 --> 11:32.800] That's right. [11:32.800 --> 11:38.800] And then this poster went on to say that the statutes are all separate. [11:38.800 --> 11:42.800] No, they are absolutely not separate. [11:42.800 --> 11:46.800] It is written into the Code of Criminal Procedure that when a law is written [11:46.800 --> 11:50.800] and the statutes are written, they are written to be taken in their entirety. [11:50.800 --> 11:54.800] And when you have different statutes that are intermixed, [11:54.800 --> 12:01.800] which every statute in Texas is intermixed with at least one other statute somewhere, okay? [12:01.800 --> 12:04.800] None of them stand independent. [12:04.800 --> 12:09.800] This one will say this definition has the same meaning as the definition over in this chapter [12:09.800 --> 12:11.800] or in this completely different code. [12:11.800 --> 12:17.800] Others will say that under this code, this is a misdemeanor as defined in the penal code. [12:17.800 --> 12:20.800] So they're always inter-referencing each other. [12:20.800 --> 12:22.800] They don't stand apart. [12:22.800 --> 12:26.800] And any time you have one that references the other, [12:26.800 --> 12:30.800] then whatever is being discussed in the other relevant to that applies. [12:30.800 --> 12:33.800] It can't work any other way, okay? [12:33.800 --> 12:39.800] So the major accusation here is that I'm trying to mix the government code, [12:39.800 --> 12:41.800] the administrative code, and the transportation code. [12:41.800 --> 12:43.800] Well, duh. [12:43.800 --> 12:47.800] Every code in Texas says at the very beginning of the code, [12:47.800 --> 12:51.800] Chapter 311 government code applies to this code. [12:51.800 --> 12:56.800] So why wouldn't I intermix Chapter 311 of the government code with everything in that code? [12:56.800 --> 13:01.800] The statute itself says that's what has to be done. [13:01.800 --> 13:04.800] So of course I do it that way. [13:04.800 --> 13:10.800] The administrative code, we're talking about the authority of the Department of Public Safety. [13:10.800 --> 13:13.800] But before you can start talking about the transportation code, [13:13.800 --> 13:17.800] which is where all the actual enforcement actions occur, [13:17.800 --> 13:22.800] you have to find out where the authority to do that enforcement came from. [13:22.800 --> 13:28.800] You have to find out where that particular government agency was created, [13:28.800 --> 13:33.800] how its authority was given, and what it was established to do. [13:33.800 --> 13:39.800] They don't just appear out of thin air and start operating, okay? [13:39.800 --> 13:46.800] Somebody has to create them, and somewhere that has to be created in a law, okay? [13:46.800 --> 13:50.800] For those of you that haven't understood that from these postings, [13:50.800 --> 13:59.800] that law is the administrative code, or Chapter 37 of the administrative code [13:59.800 --> 14:01.800] is all about the Department of Public Safety. [14:01.800 --> 14:05.800] Chapter 411 government code is all about the Department of Public Safety [14:05.800 --> 14:11.800] and the Texas Department of Public Safety Commission, all right? [14:11.800 --> 14:18.800] Then you have the transportation code over which every chapter that deals with enforcement [14:18.800 --> 14:22.800] is under the authority of the Department of Public Safety. [14:22.800 --> 14:26.800] Other ones dealing with maintenance and planning and so on [14:26.800 --> 14:29.800] are under the authority of the Department of Transportation. [14:29.800 --> 14:34.800] But in any case, there has to be law that creates these agencies [14:34.800 --> 14:39.800] before these agencies can do anything. [14:39.800 --> 14:42.800] That is the purpose of the administrative code. [14:42.800 --> 14:45.800] That is the purpose of the information in the affidavit, [14:45.800 --> 14:50.800] is to establish the original foundation of the lawful authority [14:50.800 --> 14:55.800] to enforce the transportation code. [14:55.800 --> 15:01.800] And Rule 4.13 spells that out in spades. [15:01.800 --> 15:05.800] 1.2 says the authority of the Department of Public Safety [15:05.800 --> 15:12.800] is the regulation of commercial and for-hire traffic. [15:12.800 --> 15:16.800] I even posted in the blog, what is the definition of transportation? [15:16.800 --> 15:25.800] It is movement of persons and property from place to place by a commercial carrier, all right? [15:25.800 --> 15:30.800] Traffic by definition in law means commerce. [15:30.800 --> 15:36.800] So if the Department of Public Safety is only allowed to enforce traffic laws, [15:36.800 --> 15:42.800] including commerce laws, under the transportation code, [15:42.800 --> 15:48.800] the code that allows people to act in commerce as commercial or for-hire traffic [15:48.800 --> 15:52.800] to move persons and property from point A to point B, [15:52.800 --> 16:00.800] and no other statute grants any other power or authority to that department, guess what? [16:00.800 --> 16:03.800] It's the only one they've got. [16:03.800 --> 16:08.800] That's where their authority ends as well as begins. [16:08.800 --> 16:13.800] Any time a government agency acts when there is no law to support that action, [16:13.800 --> 16:18.800] that agency is acting without lawful authority. [16:18.800 --> 16:22.800] And that is exactly the case with the traffic statutes. [16:22.800 --> 16:29.800] Everything in the transportation code, if you learn to take it apart carefully, deals with commerce. [01:05:58.800 --> 01:05:59.800] Okay [01:05:59.800 --> 01:06:06.800] Chapter 111 is very, very clear, who filed suit against you for recovery of the taxes? [01:06:06.800 --> 01:06:11.800] Well, the representatives of the county, which is a law firm, I might have been right [01:06:11.800 --> 01:06:17.800] Well, then they have a problem, okay? [01:06:17.800 --> 01:06:28.800] Because according to Chapter 111, the collection procedures under Chapter 111 cannot be implemented unless the attorney general is the one that files suit [01:06:28.800 --> 01:06:34.800] So the first thing you want to find, look at the paperwork you've been given dealing with this [01:06:34.800 --> 01:06:40.800] Find out under what statutory authority they took you to court [01:06:40.800 --> 01:06:47.800] If they are using the law of Chapter 111 tax code to take you to court, they have a severe problem [01:06:47.800 --> 01:06:50.800] First off, the tax code is an administrative code [01:06:50.800 --> 01:06:55.800] Have they exhausted all administrative remedies according to the Administrative Procedures Act? [01:06:55.800 --> 01:06:58.800] If they haven't, the court does not have jurisdiction [01:06:58.800 --> 01:07:09.800] If they're collecting under Chapter 111 of the tax code and the attorney general is not the one named in the suit as the prosecuting party [01:07:09.800 --> 01:07:14.800] The court has no jurisdiction because the other party has no standing [01:07:14.800 --> 01:07:18.800] And you need to challenge that fact [01:07:18.800 --> 01:07:20.800] Okay, that never established jurisdiction [01:07:20.800 --> 01:07:27.800] Actually, I have a little bit more to this story, but go ahead [01:07:27.800 --> 01:07:32.800] Yeah, well, this puts them in a major catch-22 for two reasons, okay? [01:07:32.800 --> 01:07:42.800] First thing is the Texas Constitution forbids the state to charge and collect ad valorem property taxes, which is why the county is doing it, okay? [01:07:42.800 --> 01:07:43.800] Right [01:07:43.800 --> 01:07:54.800] But if the county is actually attempting to use Chapter 111 to collect those taxes, then they've crossed over into an area that only the state can enforce [01:07:54.800 --> 01:07:57.800] I don't think they are. I think they're using case law [01:07:57.800 --> 01:08:00.800] Case law is not law, okay? [01:08:00.800 --> 01:08:05.800] There has to be a statute that the case law is based on. What is it? [01:08:05.800 --> 01:08:13.800] What statute are they using to get you into court that says give them jurisdiction to sue you for this money or this property? [01:08:13.800 --> 01:08:16.800] Okay, I'll find out [01:08:16.800 --> 01:08:20.800] And as soon as you do that, send me an email on the website [01:08:20.800 --> 01:08:27.800] I'll go look it up and verify what they're taking you to court on and how it applies to you or doesn't apply to you [01:08:27.800 --> 01:08:28.800] Okay [01:08:28.800 --> 01:08:30.800] And then we'll do [01:08:30.800 --> 01:08:44.800] I did a counterclaim. Halfway through, they submitted some case law documents to the public, to the judge and everybody else, and into the file folder [01:08:44.800 --> 01:08:54.800] Actually on the top left-hand corner, they had pencil-written the Republic of Texas case with my last name [01:08:54.800 --> 01:08:57.800] Now you need to go after them, okay? [01:08:57.800 --> 01:09:00.800] That's why we did a libel suit against them [01:09:00.800 --> 01:09:04.800] Okay, you also need to do a malicious prosecution suit [01:09:04.800 --> 01:09:06.800] Okay [01:09:06.800 --> 01:09:15.800] Because if they're acting without authority and what they did by writing that on the document was they tampered with the court, basically [01:09:15.800 --> 01:09:20.800] Because they wrote that to introduce a prejudice against you within the court [01:09:20.800 --> 01:09:27.800] This is something that I started putting into my motions that I was telling Randy about that these courts have started to do [01:09:27.800 --> 01:09:37.800] That any time one of the people stands up and says the Constitution, my rights and the law says the first thing they do is label you Republic of Texas [01:09:37.800 --> 01:09:45.800] And put that down somewhere so that when the court gets their hands on it, you're automatically treated without any due process rights whatsoever [01:09:45.800 --> 01:09:47.800] Not that it's any different [01:09:47.800 --> 01:09:50.800] So it prejudices the entire court system against you [01:09:50.800 --> 01:09:54.800] Right, right, and that was in the libel suit against them [01:09:54.800 --> 01:10:00.800] I mean, the first one, we did a counterclaim against them originally, but then that came up in the libel suit [01:10:00.800 --> 01:10:09.800] We went to court, I remembered or was reminded by a friend that I should pay for a jury trial, and so anyway, I went to a jury trial [01:10:09.800 --> 01:10:13.800] Wait a minute, you're the accused here, you don't have to pay for a jury trial [01:10:13.800 --> 01:10:20.800] Oh yeah, they required it being paid, I went and paid them, I took my money [01:10:20.800 --> 01:10:26.800] Okay, they charged you for the suit you filed or they charged you for the jury in your defense [01:10:26.800 --> 01:10:30.800] I don't know, the one they filed, I was the defendant on this one [01:10:30.800 --> 01:10:38.800] And so I went back and nothing was happening, we was going into hearings for the judge who kind of kept putting things off all year long [01:10:38.800 --> 01:10:44.800] But of course, the law firm was getting paid, but so the jury trial was supposed to be in November [01:10:44.800 --> 01:10:50.800] So I went to the jury trial and the jury trial had been put off because of some, you know, murder trial or something [01:10:50.800 --> 01:10:56.800] Well, it just so happened the other, the plaintiff didn't show up [01:10:56.800 --> 01:11:00.800] So the judge said, well, and they looked all over for them and he said, well, we'll try to find them [01:11:00.800 --> 01:11:03.800] They run around the courthouse in the courtroom looking for the plaintiff [01:11:03.800 --> 01:11:08.800] And supposedly they have an office in the courtroom anyway, in the courthouse, I'm sorry [01:11:08.800 --> 01:11:13.800] Couldn't find anybody, come back, she goes, well, write me an order and I'll look about signing it [01:11:13.800 --> 01:11:18.800] So we got an order to get that together and left it in her box because she'd already left [01:11:18.800 --> 01:11:25.800] And nothing happened, this was November of 2007 and nothing has happened until just recently [01:11:25.800 --> 01:11:29.800] They were bringing it back up, it's been two years [01:11:29.800 --> 01:11:34.800] Okay, you should have filed a motion for summary judgment [01:11:34.800 --> 01:11:37.800] Well, okay [01:11:37.800 --> 01:11:44.800] As well as the order to dismiss the suit with prejudice that they were coming against you with [01:11:44.800 --> 01:11:49.800] Then you should have turned around and either done the motion to dismiss [01:11:49.800 --> 01:11:52.800] Or you should have filed a motion for summary judgment in your favor [01:11:52.800 --> 01:11:59.800] You have a right to default, you should file a motion with a higher court to compel the lower court [01:11:59.800 --> 01:12:04.800] To sign the order for default judgment [01:12:04.800 --> 01:12:08.800] That is what you wrote in the order you posted with her, right? [01:12:08.800 --> 01:12:15.800] There's been, yeah, yeah, to dismiss with prejudice and all that good stuff [01:12:15.800 --> 01:12:21.800] Since then nothing actually has happened on the liable suit in two years either [01:12:21.800 --> 01:12:24.800] Actually she dismissed it but she really didn't [01:12:24.800 --> 01:12:27.800] It's really confusing [01:12:27.800 --> 01:12:33.800] The guys in the last, one of the last hearings, actually we had a hearing after the jury trial [01:12:33.800 --> 01:12:38.800] To what was supposed to happen and they got up and told the judge why they wouldn't be able to show up [01:12:38.800 --> 01:12:42.800] And, you know, she was real nice to them [01:12:42.800 --> 01:12:44.800] Yeah, like, we really care [01:12:44.800 --> 01:12:48.800] You were supposed to show up and didn't, you defaulted, no sin [01:12:48.800 --> 01:12:51.800] It's a strange deal [01:12:51.800 --> 01:12:56.800] So recently there's been a re-hearing came up [01:12:56.800 --> 01:13:00.800] That asked for a petition to enforce default judgment [01:13:00.800 --> 01:13:03.800] This is on the liable suit [01:13:03.800 --> 01:13:12.800] And so they showed up and the judge couldn't find the notice of hearing in the file folder [01:13:12.800 --> 01:13:22.800] And since she couldn't find it she said, well, I can't recognize that, you know, I have no proof that you sent it out to the defendants [01:13:22.800 --> 01:13:31.800] So it was ditched but the other side filed some other paperwork to bring up on the original case [01:13:31.800 --> 01:13:37.800] That didn't have anything to do with the hearing that we were there for [01:13:37.800 --> 01:13:39.800] It gets even better, so [01:13:39.800 --> 01:13:42.800] Were you served copies of that? [01:13:42.800 --> 01:13:45.800] Yes, yes, thanks [01:13:45.800 --> 01:13:48.800] Just recently, well, they handed them to me in the courtroom [01:13:48.800 --> 01:13:53.800] But I got, they sent them to me recently [01:13:53.800 --> 01:14:01.800] So I think they're going to try to get some kind of summary judgment on the original case where I'm a supposed defendant [01:14:01.800 --> 01:14:06.800] But they brought it up in the liable suit hearing, it's pretty strange [01:14:06.800 --> 01:14:12.800] Now, it gets even better, so even, but the judge couldn't find the notice of hearing and everything that got sent out, [01:14:12.800 --> 01:14:15.800] certified mail and half copies, no proof and everything to the Supreme Court [01:14:15.800 --> 01:14:20.800] So at the time she couldn't find the notice of hearing [01:14:20.800 --> 01:14:25.800] So she ditched anything I had to say and went with these guys [01:14:25.800 --> 01:14:27.800] Okay, press charges against the judge [01:14:27.800 --> 01:14:31.800] You produced the receipts that showed a delivery, right? [01:14:31.800 --> 01:14:36.800] Oh, well, I got it, she would accept it because the larger left [01:14:36.800 --> 01:14:40.800] But when we, I went to the clerk's office the next week [01:14:40.800 --> 01:14:49.800] And for some reason the, her clerk lady that was there in the courtroom, I saw her and she said, oh, we found it in the file folder [01:14:49.800 --> 01:14:52.800] It was there all the time [01:14:52.800 --> 01:14:55.800] Yeah, I definitely pressed charges [01:14:55.800 --> 01:14:57.800] Yeah, against the judge [01:14:57.800 --> 01:15:05.800] Motion to disqualify first, criminal charges against the judge for official oppression, 3903 penal code [01:15:05.800 --> 01:15:14.800] 3903, so you guys have something on the website that can help me do that or no? help him [01:52:37.800 --> 01:52:42.800] And the U.S. attorney filed a petition for removal of the case to federal court [01:52:42.800 --> 01:52:45.800] We filed in state district court, of course [01:52:45.800 --> 01:52:48.800] And so that's in front of the federal judge right now [01:52:48.800 --> 01:52:54.800] Well, we happened to notice this morning that Stephen Lee did not file an answer [01:52:54.800 --> 01:53:02.800] He did not file a response to our lawsuit by the Monday after the 20th day of the receipt of his service [01:53:02.800 --> 01:53:09.800] which means he has waived his defense and that there is no contest before the court right now [01:53:09.800 --> 01:53:10.800] There's nothing to remove [01:53:10.800 --> 01:53:13.800] We can file for summary judgment at this point [01:53:13.800 --> 01:53:19.800] And so we filed a petition today to the federal court in the western district here [01:53:19.800 --> 01:53:21.800] We filed a petition [01:53:21.800 --> 01:53:24.800] Actually, we filed an objection to the petition for removal to federal court [01:53:24.800 --> 01:53:29.800] And we gave many reasons why the federal court has no jurisdiction [01:53:29.800 --> 01:53:31.800] Number one, we've challenged jurisdiction [01:53:31.800 --> 01:53:34.800] That challenge to jurisdiction has to be answered, has not been answered yet [01:53:34.800 --> 01:53:40.800] And
