[06:41.740 --> 06:45.740] I hope everybody's doing well and getting ready for Christmas [06:45.740 --> 06:49.240] On the things that we went over in the seminar for those that came [06:49.240 --> 06:54.240] You know that we talk a lot about Rule 4.13, Chapter 521 [06:54.240 --> 06:55.740] Where it deals with the driver's license [06:55.740 --> 06:58.240] And how the driver's license is actually divided up [06:58.240 --> 07:02.740] Into three different things that are classified as the driver's license [07:02.740 --> 07:04.740] There is the temporary license [07:04.740 --> 07:06.740] There is the learner's permit [07:06.740 --> 07:09.740] And there is the occupational license [07:09.740 --> 07:13.740] Well, a couple of the things that I've been looking at over the past couple weeks [07:13.740 --> 07:19.240] Have been dealing with more and more information out of the Texas Administrative Code [07:19.240 --> 07:22.240] So what I wanted to tell you tonight was about a couple of things [07:22.240 --> 07:25.240] That I found that go hand in hand with that [07:25.240 --> 07:32.240] For instance, in Title 37, Part 1, Chapter 15, Subchapter A, Licensing Requirements [07:32.240 --> 07:36.740] You have Rule 15.5, Learner's License Instruction Permit [07:36.740 --> 07:42.740] This section tells you exactly what the learner's permit in Section 521 is [07:42.740 --> 07:49.740] A learner's license authorizes the driving of the same vehicles authorized by a classified driver's license [07:49.740 --> 07:54.740] A learner's license is a regular photo-type Class A, B, or C license restricted to [07:54.740 --> 07:59.740] Accompanied by a licensed driver age 21 or over in the front seat [07:59.740 --> 08:03.740] Or on a Class M, which means that you're also allowed to operate a motorcycle [08:03.740 --> 08:09.240] Licensed motorcycle operator age 21 or over in-site, okay? [08:09.240 --> 08:15.240] So that just confirms what we were talking about in the seminar regarding the learner's license [08:15.240 --> 08:18.740] It is one that most people don't have any longer [08:18.740 --> 08:22.740] They only get it when they first get out of driver's ed or whatever [08:22.740 --> 08:28.740] But the entire thing is that the driver's ed program was initiated to go hand in hand [08:28.740 --> 08:32.740] With another program that's no longer published in Texas law [08:32.740 --> 08:36.740] And that has to do with training commercial drivers [08:36.740 --> 08:39.740] And that's what driver's ed actually does [08:39.740 --> 08:44.740] It trains you to get prepared for taking the examination side [08:44.740 --> 08:49.740] Of the non-commercial yet commercial driver's license [08:49.740 --> 08:53.740] The 521 license is still a commercial license [08:53.740 --> 08:58.740] It just does not have the hazardous materials placard endorsement [08:58.740 --> 09:02.740] That is on the 522 commercial license [09:02.740 --> 09:07.740] In fact, the major difference between the types of vehicles in 521 and 522 [09:07.740 --> 09:13.740] Is that the hazardous placard is available to the commercial driver's license side [09:13.740 --> 09:17.740] And it's not available to the driver's license side [09:17.740 --> 09:24.740] Now by the same distinction, 522 does not speak directly to having a motorcycle endorsement [09:24.740 --> 09:27.740] On the commercial driver's license [09:27.740 --> 09:31.740] But it does speak to having it in chapter 521 [09:31.740 --> 09:34.740] However, a friend of mine I met in Wal-Mart the other day [09:34.740 --> 09:37.740] Happens to have a commercial driver's license [09:37.740 --> 09:43.740] His commercial driver's license has the motorcycle endorsement from 521 [09:43.740 --> 09:47.740] Which once again reinforces what I said at the seminar [09:47.740 --> 09:53.740] Is that the commercial driver's license is in fact the only driver's license in Texas [09:53.740 --> 09:59.740] And that the hazardous materials placard is the only real difference [09:59.740 --> 10:03.740] Between the endorsements and the abilities on each one [10:03.740 --> 10:07.740] The classification of the types of motor vehicle in both chapters are the same [10:07.740 --> 10:09.740] Weight restrictions are the same [10:09.740 --> 10:11.740] Use restrictions are the same [10:11.740 --> 10:16.740] They're identical in every respect except for those two various endorsements [10:16.740 --> 10:20.740] Now, another interesting thing I found [10:20.740 --> 10:27.740] Was that in section 15.16 it talks about the motorcycle license and what it issues [10:27.740 --> 10:32.740] And then you go down to 15.7 which deals with the occupational license [10:32.740 --> 10:38.740] This is the third of those that's available to the driver's license section of 521 [10:38.740 --> 10:46.740] And that is in Title 37, Part 1, Chapter 15, Subchapter A, Rule 15.7 [10:46.740 --> 10:49.740] Occupational License Essential Need [10:49.740 --> 10:56.740] An occupational license authorizes the driving of any noncommercial motor vehicle [10:56.740 --> 11:01.740] Subject to the restrictions imposed and is a special license issued without photograph [11:01.740 --> 11:10.740] By the Safety Responsibility Bureau in Austin upon authorization by a district court or county court [11:10.740 --> 11:14.740] The reason that's necessary is because you lost your commercial driver's license [11:14.740 --> 11:20.740] Because of either a DUI conviction or an APR, an administrative ARP [11:20.740 --> 11:25.740] Administrative Review Procedure that yanked it away from you for whatever reason [11:25.740 --> 11:37.740] Now, in Rule 15.22, Randy, do you remember taking an oath when you got your driver's license? [11:37.740 --> 11:43.740] I gave a few. I don't remember taking one [11:43.740 --> 11:45.740] How about you, Deborah? [11:45.740 --> 11:47.740] I don't think so [11:47.740 --> 11:56.740] Okay, Rule 15.22, original driver's license applications must be verified by the applicant [11:56.740 --> 12:00.740] Before a person authorized to administer oaths [12:00.740 --> 12:05.740] Such oaths or affirmations may be administered by the following officials [12:05.740 --> 12:10.740] A judge, clerk, or commissioner of any court of record [12:10.740 --> 12:12.740] A notary public [12:12.740 --> 12:14.740] A justice of the peace [12:14.740 --> 12:19.740] And authorized employees of the Department of Public Safety [12:19.740 --> 12:25.740] Now, from outside the state of Texas, but within the physical limits of the United States and its territories [12:25.740 --> 12:29.740] A clerk of any court of record having a seal [12:29.740 --> 12:33.740] A commissioner of deeds duly appointed under the laws of the state [12:33.740 --> 12:37.740] And see a notary public [12:37.740 --> 12:44.740] Now, personally, I don't remember ever taking an oath or being administered an oath or being required to sign an oath [12:44.740 --> 12:52.740] But right here, it's saying that any original driver's license application must have one [12:52.740 --> 12:56.740] So where is it and why isn't it given at the time? [12:56.740 --> 12:58.740] And why aren't we told what's contained in the oath? [12:58.740 --> 13:02.740] Because that's one thing that's missing out of here in its entirety is what the oath is [13:02.740 --> 13:07.740] Why would somebody getting a commercial driver's license need to take an oath anyway? [13:07.740 --> 13:10.740] Well, a good question [13:10.740 --> 13:14.740] I mean, for what purpose? We're not becoming a public servant [13:14.740 --> 13:21.740] Yeah, without reading the oath, however, we won't really know that because we don't know what they're being required to promise [13:21.740 --> 13:26.740] That's why I went looking for the oath, but it was nowhere to be found [13:26.740 --> 13:36.740] Now, the other interesting things is everybody knows that the big linchpin chapter in the administrative code for authority is Chapter 4 [13:36.740 --> 13:43.740] We went over Rule 4.11, 4.12, and 4.13 in great detail at the seminar [13:43.740 --> 13:49.740] They talk all about the training and certification requirements and authorizations and so on and so forth [13:49.740 --> 13:55.740] Rule 4.31, we did not touch on this in the seminar, but it will be integrated into the seminar material [13:55.740 --> 14:00.740] And it reads thusly, Basic Enforcement Guidelines [14:00.740 --> 14:11.740] The Department of Public Safety is charged with the responsibility of enforcing registration requirements of commercial vehicles [14:11.740 --> 14:14.740] Registration requirements of commercial vehicles [14:14.740 --> 14:19.740] Doesn't say private automobiles, doesn't say a private vehicle, doesn't say non-commercial vehicles [14:19.740 --> 14:22.740] It says commercial vehicles [14:22.740 --> 14:30.740] This enforcement will be based on the statutory provisions of Texas Transportation Code, Chapter 502 [14:30.740 --> 14:36.740] Which is the registration chapter of the Texas Transportation Code [14:36.740 --> 14:44.740] And on policies and reciprocal agreements promulgated by the Texas Department of Transportation as amended [14:44.740 --> 14:53.740] Now get this, Chapter 502 is administered by the Department of Transportation, not by the Department of Public Safety [14:53.740 --> 15:01.740] Yet this requirement is listed under the rules governing the Department of Public Safety [15:01.740 --> 15:07.740] Because that's what Title 37 in the administrative code is, it's all public safety and corrections [15:07.740 --> 15:11.740] Part 1 is all Texas Department of Public Safety [15:11.740 --> 15:16.740] Chapter 4, Commercial Vehicle Regulations and Enforcement Procedures [15:16.740 --> 15:21.740] Commercial Vehicle Registration and Inspection Enforcement [15:21.740 --> 15:33.740] And way back up in 1.2, where it tells us that the Department of Public Safety can only regulate commercial and four-hire traffic [15:33.740 --> 15:42.740] Isn't a driver's license? Regulating. Isn't inspection? Regulating. Isn't registering? Regulating [15:42.740 --> 15:52.740] All of that falls under regulatory activities and all the regulatory activities of the Department of Public Safety are limited strictly to commercial vehicles [15:52.740 --> 16:00.740] Now, go to Rule 4.36, Commercial Motor Vehicle Compulsory Inspection Program [16:00.740 --> 16:04.740] So now we've gone from registration to inspection [16:04.740 --> 16:18.740] In sub-item A, all commercial motor vehicles registered in this state shall be required to pass an annual inspection of all safety equipment required by the Federal Motor Carrier Safety Regulations [16:18.740 --> 16:37.740] Sub-item B, all commercial motor vehicles required to be inspected under the Federal Motor Carrier Safety Regulations are also subject to the regular state inspection requirements as provided in Texas Transportation Code Chapter 548 [16:37.740 --> 16:50.740] All right. Monday night is Eddie's night to discuss traffic issues [18:26.740 --> 18:33.740] Tonight he's going over the administrative code, sections of it, so Eddie, you are just about to get to inspections of vehicles [18:33.740 --> 18:42.740] Yes, and like I say, Chapter 548 of the Texas Transportation Code is the chapter that deals with motor vehicle inspections [18:42.740 --> 18:48.740] And again, motor vehicle and commercial motor vehicle are exactly the same thing [18:48.740 --> 18:57.740] The only difference between them is that the commercial motor vehicle can display a hazardous materials placard [18:57.740 --> 19:05.740] That's the only difference. How can I say this and know it's true? Well, let's go a little bit further on in Rule 4.36 [19:05.740 --> 19:12.740] If you go to sub item F, for purposes of the commercial motor vehicle compulsory inspection program [19:12.740 --> 19:21.740] The term commercial motor vehicle means a self-propelled or towed vehicle used on a public highway to transport passengers or property [19:21.740 --> 19:29.740] If. Now look up the definition in any chapter of the transportation code for either vehicle or motor vehicle [19:29.740 --> 19:37.740] You will find almost exactly that same definition, except where this one uses the word towed [19:37.740 --> 19:43.740] It uses the word drawn, which is exactly the same thing, okay? [19:43.740 --> 19:49.740] A trailer is drawn upon the highway. A trailer is towed upon the highway [19:49.740 --> 20:07.740] Now, then if you go down after the passengers or property if, items 1 through 7 is the exact same vehicle weight classifications and use classifications that appear in Chapter 522 and Chapter 521 [20:07.740 --> 20:10.740] Right down to the T [20:10.740 --> 20:20.740] Now, in each one of these you will find that these all apply to a motor vehicle slash commercial motor vehicle because they're used interchangeably [20:20.740 --> 20:29.740] Now, let's go down to the last thing I'll talk about before we start taking callers and that is subsection G of Rule 4.36 [20:29.740 --> 20:35.740] Exceptions to the commercial motor vehicle safety inspection program are [20:35.740 --> 20:48.740] You go to number 3, the occasional transportation of personal property by individuals not for compensation or in the furtherance of a commercial enterprise [20:48.740 --> 20:58.740] Now, what does that mean? Well, what that means is that if you own a semi and a box trailer, a semi and a flatbed trailer or anything else that would normally be classified [20:58.740 --> 21:08.740] Just from appearances alone as a commercial vehicle as long as it is not used for commercial purposes [21:08.740 --> 21:17.740] But simply for the purposes of moving your property from one place to another it is exempt from the inspection program [21:17.740 --> 21:28.740] Right here in law it's exempt, okay? But if the vehicle is not required to be registered anyway because it's not being used in commerce [21:28.740 --> 21:37.740] It's exempted from inspection for exactly the same reason, okay? You can't have one without the other [21:37.740 --> 21:45.740] So if one's excluded they have to both be excluded, especially if the registration is the one that's required first [21:45.740 --> 21:50.740] You can't inspect it without it being registered, okay? Now in Rule 4.13, now that's the one where we talked about where an officer of any kind can enforce the commercial motor vehicle code [22:40.740 --> 22:45.740] And who can do it, municipal, sheriff, so on and so forth [22:45.740 --> 22:50.740] However, we didn't get down far enough to the rest of that section which is sub-item C [22:50.740 --> 22:53.740] We went over A and B, but let's take a quick look at C [22:53.740 --> 22:57.740] Maintaining Certification [22:57.740 --> 23:05.740] To maintain certification, to conduct inspections and enforce the federal safety regulations, a peace officer must [23:05.740 --> 23:11.740] A, successfully complete the required annual certification training [23:11.740 --> 23:16.740] They have to renew this every single year [23:16.740 --> 23:24.740] Sub-item B, perform a minimum of 32 level 1 inspections per calendar year [23:24.740 --> 23:33.740] Now I don't know about in your town, but in Nacogdoches, if you see a municipal cop inspecting anything except for the inside of his own eyelids when he's parked in his cruiser [23:33.740 --> 23:37.740] Then you're going to surprise me because I've never seen it done [23:37.740 --> 23:39.740] It's going to be a donut [23:39.740 --> 23:48.740] Yeah, now they'll fine tooth comb that donut, but they're not going to be out inspecting a vehicle of any kind anywhere [23:48.740 --> 23:53.740] So, they've never done the certification inspections [23:53.740 --> 23:56.740] They've never renewed them every year [23:56.740 --> 24:00.740] What are they doing enforcing traffic law? [24:00.740 --> 24:05.740] It's a scam, that's all it is, it's a scam [24:05.740 --> 24:14.740] The law is very specific in the fact that the ability to enforce traffic statutes is not automatic [24:14.740 --> 24:25.740] There are training requirements involved, there are certification requirements involved, there are hands-on training requirements involved [24:25.740 --> 24:33.740] And every one of these three things is required by law [24:33.740 --> 24:38.740] Now everybody out there, I can hear it now, there's a lot of people going, well, but he keeps reading the federal rules [24:38.740 --> 24:43.740] Well, guess what? The entire transportation code is based on the federal rules [24:43.740 --> 24:50.740] They have nothing to do with the state except for those engaged in intrastate commerce [24:50.740 --> 24:55.740] But the original rules are those that are set forth by the federal government [24:55.740 --> 25:04.740] And then they are adapted by the states for the intrastate commerce and the interstate commerce of motor vehicles [25:04.740 --> 25:10.740] You and I are not engaged in intrastate or intrastate commerce in our private automobiles [25:10.740 --> 25:14.740] We're just not, we don't fall under these rules [25:14.740 --> 25:25.740] The reason Texas and other states wind up with their hands on so much personal, private information from the citizens of that state [25:25.740 --> 25:30.740] Is because they're dumb enough to give it to them on a driver's license application [25:30.740 --> 25:35.740] And the state every year comes back and says, well, now we're making it mandatory that you pee in a cup [25:35.740 --> 25:40.740] Now you've got to give us blood, now we're going to take DNA gening sequences, so on and so forth [25:40.740 --> 25:46.740] Every year they're going to make more and more demands, how long before it's your first born on the block that they want [25:46.740 --> 25:52.740] And just so you can drive when you're not actually driving, most people will give it to them [25:52.740 --> 25:58.740] We've gotten way too used to convenience and having to get permission [25:58.740 --> 26:06.740] Now, having worked in the county jail and having dealt with inmates on a personal level [26:06.740 --> 26:11.740] I can tell you that in a lot of cases these people get indoctrinated [26:11.740 --> 26:17.740] They spend enough time behind bars, they learn very quickly that in certain institutions [26:17.740 --> 26:22.740] They're not allowed to do anything without asking, anything [26:22.740 --> 26:29.740] So the first thing out of their mouth is may I, can I, hey boss, can I, all right [26:29.740 --> 26:32.740] They ask permission for everything [26:32.740 --> 26:37.740] As citizens we've pretty much become an inmate society [26:37.740 --> 26:43.740] We think that as citizens we have to ask permission for everything [26:43.740 --> 26:50.740] We can't do anything without the boss, meaning the state, given it's okay and it's blessing [26:50.740 --> 26:54.740] Otherwise if the state doesn't like it, it comes down on us, right [26:54.740 --> 26:59.740] That's the way everybody feels, that's the way everybody thinks, and it's the way everything's getting done [26:59.740 --> 27:02.740] What's the problem with this picture? [27:02.740 --> 27:11.740] Since when did we the people give up our right to be free and to be treated like we were incarcerated in our own state? [27:11.740 --> 27:15.740] I mean, let's think a minute about how the hierarchy of government is [27:15.740 --> 27:19.740] What preceded the state? [27:19.740 --> 27:22.740] The simple answer is the people did [27:22.740 --> 27:31.740] So the first level of any government hierarchy is the people, at least in a free country or supposedly free country [27:31.740 --> 27:36.740] Beneath the people you're going to have the level of the state [27:36.740 --> 27:39.740] Now the state does not exist of its own accord [27:39.740 --> 27:44.740] The state is in fact almost identical to the people [27:44.740 --> 27:51.740] But the major difference is that to be a state there has to be a geographical boundary set up and defined [27:51.740 --> 28:01.740] And generally a constitution is defined that the people of that state feel is important to their ability to live and work as a unified body [28:01.740 --> 28:05.740] So you have the people, then you have the state [28:05.740 --> 28:10.740] Now below the state you start having your individual branches of government [28:10.740 --> 28:16.740] Starting with the three branches that we created, legislative, judicial, and executive [28:16.740 --> 28:25.740] In Texas the executive is extremely short, three state officers I believe is the total number of people involved in the executive branch [28:25.740 --> 28:39.740] Then you have the judicial, which I don't see anything in the state constitution that allows any bar card carrying moron with an attitude to be automatically enrolled in that branch of government [28:39.740 --> 28:41.740] Yet that's exactly what happens [28:41.740 --> 28:44.740] They go out, they graduate college, they pass the bar [28:44.740 --> 28:53.740] They are granted access to the judicial branch of government as an officer within the government [28:53.740 --> 28:55.740] Where did the people authorize this? [28:55.740 --> 28:57.740] How did it come about? You have opportunity to recover. You were saying something right before we went to the break [46:08.740 --> 46:14.740] Oh, I was just talking about the things he was dealing with up there on the property taxes [46:14.740 --> 46:20.740] But yeah, here in Texas, it's something now that's almost correct [46:20.740 --> 46:25.740] The fact is that you rent the property out for the purpose of earning money [46:25.740 --> 46:28.740] does not place it into corporate property [46:28.740 --> 46:32.740] The people have the right to make the use of their property [46:32.740 --> 46:35.740] even if it's the purpose of making their own living [46:35.740 --> 46:39.740] without it becoming involved in a corporate enterprise [46:39.740 --> 46:42.740] There's different types of commerce [46:42.740 --> 46:47.740] If you acquire property, you have the right to use it as you see fit as one of the people [46:47.740 --> 46:53.740] Now, if you do something that puts you under their rules, such as incorporating yourself [46:53.740 --> 47:00.740] or your enterprise into a corporate entity, then you've placed yourself under the realm of their rules [47:00.740 --> 47:05.740] Most people think just because you do something to earn money [47:05.740 --> 47:13.740] with something that automatically places you under the commercial laws in every degree, and that's not true [47:13.740 --> 47:20.740] What it does is when you start accepting certain privileges of being incorporated [47:20.740 --> 47:24.740] For instance, what they call the corporate veil, that layer of protection [47:24.740 --> 47:30.740] that keeps you as a stockholder or an officer from being directly sued [47:30.740 --> 47:36.740] That's a privilege granted to you by the corporate structure [47:36.740 --> 47:39.740] Therefore, the government controls that setup [47:39.740 --> 47:44.740] Basically, they've made you a bunch of legalized thieves [47:44.740 --> 47:48.740] so that you can get away with it like all the Enron folks did [47:48.740 --> 47:55.740] But the point here being is that until you start accepting those governmental privileges [47:55.740 --> 47:59.740] using your property for the purpose of earning a living for you and your family [47:59.740 --> 48:02.740] does not place you under their control [48:02.740 --> 48:06.740] So don't get confused over those particular points [48:06.740 --> 48:11.740] Yeah, I used to be a corporation and I let the corporation die [48:11.740 --> 48:14.740] and I'm nothing now basically [48:14.740 --> 48:21.740] But what my strategy was to do was to have an affidavit of denial of corporate status [48:21.740 --> 48:29.740] as me as a man, and present them my acceptance of the land patent [48:29.740 --> 48:37.740] and the fact that what they're saying is that they're foreclosing governmental units [48:37.740 --> 48:43.740] under General Property Tax Act, Public Act 206 of 1893 [48:43.740 --> 48:49.740] And I'm going to argue that as an assignee of the land patent holder [48:49.740 --> 48:54.740] that I am not subject to this statute [48:54.740 --> 49:00.740] and hopefully that carries some weight and if not, I've paid A for B [49:00.740 --> 49:05.740] and they did not return the payment [49:05.740 --> 49:09.740] They did not acknowledge any defects in it [49:09.740 --> 49:12.740] It's been much longer than 30 days [49:12.740 --> 49:18.740] It falls under the UCC law of having been paid and rejected [49:18.740 --> 49:21.740] Therefore, it's discharged [49:21.740 --> 49:26.740] They're claiming they're not under the UCC, which is absurd [49:26.740 --> 49:30.740] Okay, well I got one other question for you though [49:30.740 --> 49:35.740] How much of this time that you spent studying the way that that process allegedly works [49:35.740 --> 49:41.740] did you actually use to figure out what the actual law is in your state? [49:41.740 --> 49:46.740] How well do you know the property tax statutes? [51:15.740 --> 51:19.740] Once you figure out what the state constitution does or does not allow [51:19.740 --> 51:24.740] it becomes very easy to see whether or not the statutes conform [51:24.740 --> 51:27.740] If the statutes don't conform, they're unconstitutional [51:27.740 --> 51:32.740] If they do conform and the constitution limited to what it can be applied to [51:32.740 --> 51:41.740] then all you have to do is ensure you're not within the category of applicability and you're done [51:41.740 --> 51:46.740] What was that Randy was talking about with having two years to buy it back [51:46.740 --> 51:52.740] because I don't know what happens should I be foreclosed upon [51:52.740 --> 52:02.740] If I purchase a property at a tax sale, the original owner has opportunity to repurchase [52:02.740 --> 52:09.740] If it's agricultural land here in Texas, they've got two years [52:09.740 --> 52:17.740] so I don't have clear title until that time period to recover it is expired [52:17.740 --> 52:21.740] Now Randy, is that federal or is that state? [01:07:03.740 --> 01:07:09.740] The temporary license is a license issued to an out-of-state applicant [01:07:09.740 --> 01:07:12.740] or a person in the military not living in the state [01:07:12.740 --> 01:07:14.740] and it's issued without a picture [01:07:14.740 --> 01:07:20.740] And once the person receiving it travels back into the state and is here in excess of 45 days [01:07:20.740 --> 01:07:25.740] they must have it go in and get a picture taken and have the license redone [01:07:25.740 --> 01:07:29.740] Well once the picture is added it's no longer a temporary license [01:07:29.740 --> 01:07:31.740] So what kind of license does it become? [01:07:31.740 --> 01:07:37.740] It doesn't become the occupational license because that one can only be issued by a court [01:07:37.740 --> 01:07:42.740] It doesn't become a learner's permit because then you would still have to have somebody in the front seat [01:07:42.740 --> 01:07:45.740] with you 21 years of age or older carrying a license [01:07:45.740 --> 01:07:47.740] You have to do it [01:07:47.740 --> 01:07:52.740] So the only other thing dealing with a license takes you right back to chapter 522 [01:07:52.740 --> 01:07:54.740] which is a commercial driver's license [01:07:54.740 --> 01:07:58.740] There is only one kind of license in Texas [01:07:58.740 --> 01:08:04.740] It's just whether or not you can haul hazardous materials in commerce that's the difference [01:08:04.740 --> 01:08:11.740] Ah, that sheds a lot of light on it [01:08:11.740 --> 01:08:14.740] Yeah, because as I look at this I kept saying how do I fit in? [01:33:37.740 --> 01:33:40.740] I don't know that I did [01:33:40.740 --> 01:33:45.740] That may be why he didn't address it [01:33:45.740 --> 01:33:52.740] Your actions, you have to move the court [01:33:52.740 --> 01:34:00.740] And when you file an action in the court, you have to tell the judge what you want the judge to do [01:34:00.740 --> 01:34:05.740] Tell the judge the facts that have been developed [01:34:05.740 --> 01:34:15.740] The law as it applies to those facts and how that law based on these facts require him to do this thing [01:34:15.740 --> 01:34:20.740] Then demand that the judge do that thing [01:34:20.740 --> 01:34:27.740] As opposed to what most people think, you're not asking the judge to do anything, you're demanding that he do what he's required to do [01:34:27.740 --> 01:34:34.740] And that's what a motion is, you're moving the court, you're not begging the court, you're not praying to the court [01:34:34.740 --> 01:34:37.740] You're moving the court to do what the law tells him to do [01:34:37.740 --> 01:34:45.740] Now if you don't give him the law, if you give him something other than the law [01:34:45.740 --> 01:34:52.740] Even if he agrees with you, he has no authority to rule in your favor [01:34:52.740 --> 01:34:55.740] He must rule on the law [01:34:55.740 --> 01:35:08.740] His only purpose is to develop facts in the case and apply the law as it comes to him to the facts in the case [01:35:08.740 --> 01:35:13.740] He's not allowed to have a personal opinion, he must apply law [01:35:13.740 --> 01:35:20.740] So if you don't give him that law to apply, he's not likely to tell you you didn't do it [01:35:20.740 --> 01:35:25.740] He's just going to rule for the one who gave him law [01:35:25.740 --> 01:35:27.740] Does that make sense? [01:35:27.740 --> 01:35:33.740] Yes, it certainly does, but he said he never even saw it [01:35:33.740 --> 01:35:34.740] Never saw what? [01:35:53.740 --> 01:35:55.740] This was about five days ago [01:35:55.740 --> 01:35:58.740] Okay, move for reconsideration [01:35:58.740 --> 01:36:08.740] You need to supply him with a statement showing why he should rule in your favor [01:36:08.740 --> 01:36:14.740] And move for reconsideration based on whatever information you have before him [01:36:14.740 --> 01:36:18.740] And in this case if he didn't see your counterclaim [01:36:18.740 --> 01:36:24.740] This is not exactly a counterclaim, a challenge to the jurisdiction is not a counterclaim [01:36:24.740 --> 01:36:26.740] That's a pleading [01:36:26.740 --> 01:36:27.740] Okay [01:36:27.740 --> 01:36:30.740] And that he has to hear [01:36:30.740 --> 01:36:36.740] If you had one before the court and you did in fact challenge the jurisdiction [01:36:36.740 --> 01:36:41.740] It makes no difference what you name a document [01:36:41.740 --> 01:36:48.740] A document is not considered based on what you call it, it's considered based on the content [01:36:48.740 --> 01:36:53.740] I was in court listening to him hearing some of Robert Fox's motions [01:36:53.740 --> 01:36:56.740] And he tended to ramble a bit [01:36:56.740 --> 01:37:01.740] And the attorney would step up with this motion and he would say [01:37:01.740 --> 01:37:07.740] I'm not sure what this is, your honor, but I think it's a challenge to the jurisdiction [01:37:07.740 --> 01:37:13.740] And the judge said well, we'll treat it as if it's a challenge to the jurisdiction [01:37:13.740 --> 01:37:16.740] See, they didn't care what he called it [01:37:16.740 --> 01:37:19.740] They will treat it for what it appears to be [01:37:19.740 --> 01:37:21.740] And you'll hear this a lot [01:37:21.740 --> 01:37:26.740] Especially when you have proceeds who are not real sophisticated in law [01:37:26.740 --> 01:37:35.740] They'll sometimes call their motion one thing, but the actual text will cause it to be something else [01:37:35.740 --> 01:37:41.740] So anyway, what's in the motion and what has to be in the motion? [01:37:41.740 --> 01:37:45.740] Tell the judge what you want him to do [01:37:45.740 --> 01:37:48.740] Give him the facts [01:37:48.740 --> 01:37:53.740] Give him the law that supports your position concerning the facts [01:37:53.740 --> 01:38:01.740] And then the prayer is not the same as a prayer in a church [01:38:01.740 --> 01:38:08.740] The prayer is where you demand that he do what the law and the facts command him to do [01:38:08.740 --> 01:38:12.740] If it ain't there, you're hosed [01:38:12.740 --> 01:38:22.740] Sometimes I'll tell you, in Pennsylvania, a friend of mine, Jeff Soder, showed me a response from the Pennsylvania Supreme Court [01:38:22.740 --> 01:38:26.740] And I was frankly astounded [01:38:26.740 --> 01:38:39.740] There were 38 pages explaining to him everything he did right, everything he did wrong, what he should do to fix it and refile [01:38:39.740 --> 01:38:43.740] I was amazed at how well treated that was [01:38:43.740 --> 01:38:47.740] But generally they won't do that [01:38:47.740 --> 01:38:53.740] Generally the court will not tell you what the problem is, they'll just blow right past you [01:38:53.740 --> 01:38:58.740] Well, he dismissed it [01:38:58.740 --> 01:39:01.740] They'd never seen it, and he dismissed it [01:39:01.740 --> 01:39:05.740] The attorney just said, I don't know what this is, it got this in the mail and da da da [01:39:05.740 --> 01:39:12.740] And he just dismissed it without even looking at it [01:39:12.740 --> 01:39:18.740] And I objected, and when I objected he said, okay [01:39:18.740 --> 01:39:22.740] He ruled in favor of the plaintiff, as soon as I objected [01:39:22.740 --> 01:39:25.740] His face turned pure red, shocked [01:39:25.740 --> 01:39:28.740] It's just a small claims court, you know [01:39:28.740 --> 01:39:33.740] And as soon as I objected, he looked shocked and just ruled in favor of the plaintiff, bang, adjourn, done [01:39:33.740 --> 01:39:40.740] Okay, move to disqualify the judge for the misconduct in office [01:39:40.740 --> 01:39:44.740] Because he has a ministerial duty to read the pleadings [01:39:44.740 --> 01:39:49.740] And move for reconsideration, move to void judgment [01:39:49.740 --> 01:39:59.740] Move for everything you can, move to void judgment because the judge violated a ministerial duty, denied you in due process, failed to read the pleadings [01:39:59.740 --> 01:40:09.740] And move to disqualify him because he violated his canons of office and denied you in due process [01:40:09.740 --> 01:40:15.740] File a judicial conduct complaint against him, file a claim against his bond [01:40:15.740 --> 01:40:19.740] And then let's get another judge in here and say next [01:40:19.740 --> 01:40:20.740] Okay [01:40:20.740 --> 01:40:24.740] Best way to, how do you defend yourself from a dog? [01:40:24.740 --> 01:40:30.740] And how is the best way to do that? Would it be to file, can I file back into that same case or do I have to? [01:40:30.740 --> 01:40:36.740] Absolutely, you file in the same case, motion to void judgment, motion to disqualify [01:40:36.740 --> 01:40:41.740] You might move for court warrant or removal, just really get ugly [01:40:41.740 --> 01:40:42.740] Okay [01:40:42.740 --> 01:40:48.740] Motion, you have a motion, okay, I'd have to see your motion to disqualify first [01:40:48.740 --> 01:40:56.740] And what did you claim as grounds for, I'm sorry, not disqualify, your challenge to jurisdiction, what did you claim as the grounds? [01:40:56.740 --> 01:40:59.740] Or I'd have to re-look at that again [01:40:59.740 --> 01:41:04.740] Okay, that's kind of important, if you didn't have any grounds in there, but then he didn't read it so he didn't know that [01:41:04.740 --> 01:41:08.740] He didn't read it, he admitted it in a court of record that he didn't even see it [01:41:08.740 --> 01:41:14.740] Okay, that's official misconduct, he had a duty to stop right there and read the pleading [01:41:14.740 --> 01:41:15.740] Right [01:41:15.740 --> 01:41:28.740] So move to disqualify him for violating due process, file against him criminally, every state somewhere has, except New Mexico, has an official misconduct statute [01:41:28.740 --> 01:41:30.740] Okay [01:41:30.740 --> 01:41:44.740] If a public official denies a citizen in a right acting under color or pretense of an authority or fails to perform a duty they're required to perform, that's official oppression or official misconduct depending on what the state calls it [01:41:44.740 --> 01:41:46.740] And that's crime [01:41:46.740 --> 01:42:02.740] So if you find it in Wisconsin law, file that against him, motion to disqualify, and motion to avoid judgment [01:42:02.740 --> 01:42:08.740] Okay, and do I have to file like a pre-notice that I'm going to file and send it to everybody first or [01:42:08.740 --> 01:42:11.740] No, no, just file [01:42:11.740 --> 01:42:15.740] And how much time is on that, 20 days? [01:47:20.740 --> 01:47:21.740] It's a criminal statute [01:47:21.740 --> 01:47:24.740] That's right, it's a class A misdemeanor violation [01:47:24.740 --> 01:47:37.740] Class 21 or is it type 22, I know that it's on my form, it's a form that I created, I found the law because of you Randy and then I got the law and put it on the bottom [01:47:37.740 --> 01:47:47.740] So that they would know, and it's specified on the form, it says specifically that it's not a, if you don't respond it's not civil, it's criminal [01:47:47.740 --> 01:47:52.740] And it's pretty substantial, it's what, $10,000 a year in jail or something [01:47:52.740 --> 01:47:55.740] That's class A misdemeanor, six months in jail [01:47:55.740 --> 01:48:01.740] Oh, it's a class A misdemeanor, okay, class A misdemeanor, six months in jail and they're supposedly some sort of fine [01:48:01.740 --> 01:48:04.740] And I think there's a, it might be a $10,000 fine [01:48:04.740 --> 01:48:16.740] But anyway, I used, I sent that, they didn't respond, and frankly I haven't had time to do those complaints, you know, you just run out of paper [01:48:16.740 --> 01:48:24.740] But I did, I called them and I said, you know, I'm looking for this particular deputy and do you have anything? [01:48:24.740 --> 01:48:29.740] And the lady was pretty forthright, frankly I was kind of surprised [01:48:29.740 --> 01:48:36.740] She said no, you know, I mean she obviously put me in a hold for a minute and I thought, well she's going to go get a supervisor and I'm going to go through this again [01:48:36.740 --> 01:48:43.740] You know, but I just kind of work up the chain and then finally get to somebody that says, we can't help you, we don't have it, when you know it's a baloney [01:48:43.740 --> 01:48:48.740] But this lady was really forthright, she went through the database and said, yeah, I got him here, I don't see anything [01:48:48.740 --> 01:48:52.740] I said, you don't see an application for that, you see nothing whatsoever [01:48:52.740 --> 01:49:01.740] She said no, you know, and I asked her, obviously I asked her to send, you know, you can't do anything at court without it in black and white [01:49:01.740 --> 01:49:11.740] So I haven't received that fax or I haven't received the piece of mail, I don't have a check mail box today, but you know, she's got my address and the fax [01:49:11.740 --> 01:49:16.740] She's got all my information because it's all on the cover letter for the request that I sent [01:49:16.740 --> 01:49:26.740] So that stuff, you know, it's like I was talking to Steve Skidmore, the man that answers for you guys [01:49:26.740 --> 01:49:34.740] It's just something else, it's just another one of those things when you list a rule on radio [01:49:34.740 --> 01:49:42.740] And it's frankly, it's coming out of my ears, it's overwhelming because I can be in court and I'm trying to come up with things [01:49:42.740 --> 01:49:47.740] And I literally have to, I've got to write everything, I have to write it down ahead of time [01:49:47.740 --> 01:49:51.740] And then sometimes I kind of get thrown for a loop, you know [01:49:51.740 --> 01:50:00.740] But now I have this attorney and we were supposed to have, we were supposed to have a hearing Thursday [01:50:00.740 --> 01:50:05.740] And he called me Wednesday and said, well, I'm not going to be there, you know, I'm sick [01:50:05.740 --> 01:50:09.740] And I said, well, you know, whatever, and I said, well, you're going to call, right? [01:50:09.740 --> 01:50:14.740] And he said, yeah, I will call, well, I got there and the guy never called [01:50:14.740 --> 01:50:20.740] He never ever called, I walked over and talked to the clerk and I said, you know, he's gone, I need to leave too [01:50:20.740 --> 01:50:23.740] I mean, I've got to go, I need to go work, I've got to get out of here [01:50:23.740 --> 01:50:29.740] Well, he hasn't called and until he calls, you know, you're just stuck [01:50:29.740 --> 01:50:34.740] So, and as it turned out, he didn't call until Friday [01:50:34.740 --> 01:50:38.740] Or during the course of that, I had gone downstairs and I was kind of in a panic [01:50:38.740 --> 01:50:42.740] Because, you know, I'm trying to do two things and I'm only one person, you know [01:50:42.740 --> 01:50:49.740] And as it turned out, the judge had revoked the bond, my bond, and I told Randy about this [01:50:49.740 --> 01:50:54.740] And then when he called, she reinstated the bond, well, she rescheduled the hearing for today [01:50:54.740 --> 01:50:58.740] Well, I went to the hospital, I had a custom test [01:50:58.740 --> 01:51:02.740] And just insane, you know [01:51:02.740 --> 01:51:06.740] And it's one of those things for the people listening [01:51:06.740 --> 01:51:10.740] When you're doing, you know, Randy, you guys know this [01:51:10.740 --> 01:51:13.740] This is just, it's a pressure game, it's BS [01:51:13.740 --> 01:51:17.740] Because every time I've mentioned anything of any substance [01:51:17.740 --> 01:51:23.740] When I was in there, actually before I'd actually heard the attorney [01:51:23.740 --> 01:51:28.740] Talking about things to bring the person that made the accusation against me before the court [01:51:28.740 --> 01:51:32.740] Bring in your judge, as such, your magistrate for this court [01:51:32.740 --> 01:51:36.740] Bring this man, you know, bring him forward and have him state his claim against me [01:51:36.740 --> 01:51:39.740] I'd like to have him sort of been examining Charles something [01:51:39.740 --> 01:51:43.740] Because nothing was done whenever, you know, he made this arrest [01:51:43.740 --> 01:51:45.740] I'd like to clear the air [01:51:45.740 --> 01:51:51.740] And it seems like that would save waste fraud and abuse issues with the court, you know [01:51:51.740 --> 01:51:54.740] They wouldn't have to go forward, it would save them time [01:51:54.740 --> 01:51:57.740] And it would kind of get down to the bottom of things, but they will not do that [01:51:57.740 --> 01:51:59.740] They just want to draw you out [01:51:59.740 --> 01:52:01.740] Well, they wouldn't get your money that way [01:52:01.740 --> 01:52:04.740] Yeah, they just, I mean, they want to string you out [01:52:04.740 --> 01:52:06.740] They just want to string you, string you, string you [01:52:06.740 --> 01:52:10.740] Well, just start, have you been filing judicial conduct complaints against the judge? [01:55:22.740 --> 01:55:29.740] Her lack of action insofar as proving up the jurisdiction of the court [01:55:29.740 --> 01:55:35.740] You challenged subject matter jurisdiction, the court failed to prove up subject matter jurisdiction [01:55:35.740 --> 01:55:38.740] Therefore, it is without subject matter jurisdiction [01:55:38.740 --> 01:55:44.740] You make that claim that the judge acted without subject matter jurisdiction [01:55:44.740 --> 01:55:54.740] Now, that's not a crime directly, in this case, you're not, last time I did it, I accused the judge of impersonating a public official [01:55:54.740 --> 01:56:09.740] But the most important thing about a lack of subject matter jurisdiction is that is the only case in which the judge is totally without any immunity of any kind [01:56:09.740 --> 01:56:13.740] That's a, that's something else [01:56:13.740 --> 01:56:20.740] It doesn't go to what you can prove up, it goes to the claim that you make [01:56:20.740 --> 01:56:29.740] You make the claim that because of these facts, the judge is without subject matter jurisdiction [01:56:29.740 --> 01:56:37.740] Now you have the opportunity to go in court and prove up, even if you can't prove it up, they still have to answer [01:56:37.740 --> 01:56:47.740] In the case in this credit card issue where we made, did a cross complaint against the judge, the county attorney filed an answer for the judge [01:56:47.740 --> 01:56:54.740] We will, the county, the answer only addressed immunity when the judge had subject matter jurisdiction [01:56:54.740 --> 01:56:58.740] It did not address lack of subject matter jurisdiction [01:56:58.740 --> 01:57:11.740] So we'll file and ask that the pleading be struck as non-responsive, counters, an amended cross complaint, including the prosecuting attorney, the county attorney [01:57:11.740 --> 01:57:22.740] And more allegations against the judge of misappropriation of public funds by using the county attorney as his private counsel [01:57:22.740 --> 01:57:23.740] Right [01:57:23.740 --> 01:57:25.740] To kick your behinds [01:57:25.740 --> 01:57:33.740] In what, in what particular, is that just a, you said that's not a criminal charge, but that is [01:57:33.740 --> 01:57:37.740] You can charge the judge with impersonating a public official [01:57:37.740 --> 01:57:40.740] It's not likely to go far, but it sounds good [01:57:40.740 --> 01:57:46.740] The point is, no subject matter jurisdiction, no immunity [01:57:46.740 --> 01:57:54.740] When the prosecutor, when the county attorney answered the complaint, he never went to lack of subject matter jurisdiction [01:57:54.740 --> 01:58:00.740] He presumed, he argued that when the judge has subject matter jurisdiction, he has absolute immunity [01:58:00.740 --> 01:58:03.740] And we'll stipulate, yes he does [01:58:03.740 --> 01:58:05.740] All right, we'll have more questions [01:58:05.740 --> 01:58:06.740] That's not the issue [01:58:06.740 --> 01:58:09.740] Okay, well listen, I'm sorry we are at the end of the show [01:58:09.740 --> 01:58:13.740] Gail, Rodney, Bill, I'm sorry we weren't able to take your call [01:58:13.740 --> 01:58:19.740] We will be back next Monday, however, so folks, try to call in a little earlier next time [01:58:19.740 --> 01:58:24.740] Remember, 512-646-1984, we will be back next Monday night [01:58:24.740 --> 01:58:30.740] We'll be doing live shows tomorrow night and Wednesday night, but Thursday and Friday we'll be running archives [01:58:30.740 --> 01:58:36.740] We'll be playing the G.
