[00:00.000 --> 00:05.360] This news brief brought to you by the International News Net. [00:05.360 --> 00:11.320] Barack Obama said Wednesday he assumes Osama bin Laden is still alive, despite remarks [00:11.320 --> 00:15.400] to the contrary by Pakistan's intelligence service. [00:15.400 --> 00:20.120] Obama defended his decision to send thousands more troops to Afghanistan over the objections [00:20.120 --> 00:22.240] of fellow Democrats. [00:22.240 --> 00:28.000] Attorney General Eric Holder said Wednesday about 30 detainees currently held at Guantanamo [00:28.000 --> 00:30.080] had been cleared for release. [00:30.080 --> 00:35.680] Holder said the US is weeks away from asking certain countries to take detainees. [00:35.680 --> 00:40.560] Holder said that the Obama administration might cooperate with a Spanish investigation [00:40.560 --> 00:45.480] of former Bush administration officials over the treatment of terror suspects. [00:45.480 --> 00:50.640] Barack Obama rejected former Vice President Dick Cheney's defense of waterboarding. [00:50.640 --> 00:55.400] At a White House press conference marking his first 100 days in office, Obama said, [00:55.400 --> 01:06.560] I believe waterboarding was torture and whatever legal rationale was used, it was a mistake. [01:06.560 --> 01:13.120] Natural News reports that in the late 1990s, the US public health service petitioned drug [01:13.120 --> 01:18.400] companies to remove thimerosal from vaccines intended for children. [01:18.400 --> 01:23.720] In one study, researchers found that children who received just three vaccines containing [01:23.720 --> 01:31.080] thimerosal were 27 more times likely to develop autism compared to children vaccinated without [01:31.080 --> 01:32.080] it. [01:32.080 --> 01:39.040] Despite the evidence, mercury is still being added to vaccines at completely unsafe levels. [01:39.040 --> 01:44.560] Vaccines are composed of protein, bacterial and viral matter as well as preservatives, [01:44.560 --> 01:47.340] neutralizers and carrying agents. [01:47.340 --> 01:52.560] By injecting foreign substances directly into the bloodstream, the human body stands little [01:52.560 --> 01:56.000] or no chance of neutralizing the poisons. [01:56.000 --> 02:01.240] The sudden appearance of a poison in the bloodstream causes an allergic reaction wherein the immune [02:01.240 --> 02:06.720] system uses an arsenal of antibodies to prevent death from poisoning. [02:06.720 --> 02:13.040] Among the causes of anaphylactic shock are immunizations for diphtheria, tetanus, hepatitis [02:13.040 --> 02:17.920] B and whooping cough. [02:17.920 --> 02:23.800] The World Health Organization raised its infectious disease alert level Wednesday, but scientists [02:23.800 --> 02:30.660] are concluding the current outbreak of swine flu isn't as fatal as previous flu pandemics. [02:30.660 --> 02:35.360] In fact, the current outbreak may not even do as much damage as the run-of-the-mill flu [02:35.360 --> 02:37.560] outbreaks that occur every winter. [02:37.560 --> 02:43.360] Dr. Christopher Olson, a molecular virologist, said that normal influenza kills hundreds [02:43.360 --> 02:48.560] of thousands of people annually around the world, but preliminary evidence from genetic [02:48.560 --> 02:54.960] labs, epidemiology models and simple mathematics suggest that the worst-case scenarios will [02:54.960 --> 02:57.960] be avoided in the current outbreak. [02:57.960 --> 03:08.960] You are listening to the Rule of Law Radio Network at ruleoflawradio.com, live free speech [03:08.960 --> 03:15.960] talk radio at its best. [03:38.960 --> 03:59.960] Bad boys, bad boys, whatcha gonna do, whatcha gonna do when they come for you? [03:59.960 --> 04:07.960] Bad boys, bad boys, whatcha gonna do, whatcha gonna do when they come for you? [04:07.960 --> 04:11.320] What are you gonna do when we come for you? [04:11.320 --> 04:18.880] This is the Rule of Law, Randy Kelton and Deborah Stevens here on ruleoflawradio.com. [04:18.880 --> 04:28.600] So tonight, Randy, you're gonna discuss the strategy of how you're gonna handle this criminal [04:28.600 --> 04:35.040] trespass case, right, that they arrested you for last week when you went to the FBI. [04:35.040 --> 04:39.480] And actually, I had a question, I never really found out about what happened. [04:39.480 --> 04:43.440] So apparently, I mean, you told us a story about what happened at the Secretary of State's [04:43.440 --> 04:50.640] office, maybe you could go, you know, review that history. [04:50.640 --> 04:57.640] When they brought you to jail, did the FBI call APD or did the FBI bring you there? [04:57.640 --> 05:02.040] No, the FBI called the Austin PD. [05:02.040 --> 05:08.120] So the Austin PD went and got you from the FBI's office and brought you back to the municipal [05:08.120 --> 05:11.040] jail or the county jail, okay. [05:11.040 --> 05:17.500] Before the Fed talked to me, he ran NCIC on me. [05:17.500 --> 05:26.920] And it seems that the DPS issued the warrant, got the warrant issued and then put it on [05:26.920 --> 05:33.480] the NCIC to make sure that if I got stopped anywhere, I'd get arrested and taken to jail. [05:33.480 --> 05:38.120] And I think they were hoping it would be a lot more inconvenient than it was. [05:38.120 --> 05:42.440] Now, Randy, is that standard for a Class B misdemeanor to be on NCIC? [05:42.440 --> 05:44.640] This is Class B. No, it isn't. [05:44.640 --> 05:47.480] Yeah, Class B. I'm sorry, that's what I meant, Class B. [05:47.480 --> 05:49.840] No, it's not standard. [05:49.840 --> 05:52.400] That's why it surprised me so much. [05:52.400 --> 05:53.620] But they were setting me up. [05:53.620 --> 06:01.100] They knew with the information requests I had filed, they knew I was coming after them. [06:01.100 --> 06:06.680] So I guess they thought that if they kicked me around a little bit that I would tuck my [06:06.680 --> 06:11.400] tail between my legs and run for cover. [06:11.400 --> 06:19.640] Well, not bloody likely. [06:19.640 --> 06:26.160] The complaint, the whole thing was just that they filed was a mess. [06:26.160 --> 06:30.120] And there's no way you can stand up in court. [06:30.120 --> 06:35.320] So they have nothing to try to frighten me with. [06:35.320 --> 06:42.120] And what they did was open the door so now I can come after them. [06:42.120 --> 06:46.120] Civil discovery is somewhat different than criminal. [06:46.120 --> 06:52.840] So if I sued them, there was a lot that I couldn't get in a civil action that I can [06:52.840 --> 06:56.240] get in a criminal action. [06:56.240 --> 06:59.760] Now I get to come after them criminally. [06:59.760 --> 07:05.160] And frankly, we're going to fight. [07:05.160 --> 07:08.440] I'll be going into court Monday. [07:08.440 --> 07:15.920] And generally, the first hearing they call is for the purpose of finding out whether [07:15.920 --> 07:19.680] or not I have an attorney. [07:19.680 --> 07:27.040] And when they call me in to find out if I have an attorney, we're going to have a problem. [07:27.040 --> 07:39.760] Because I have Chapter 28 of the Texas Code of Criminal Procedure, Title 28 of the 2801 [07:39.760 --> 07:47.520] Code of Criminal Procedure specifies what a judge can call, can summon someone into court [07:47.520 --> 07:49.680] for. [07:49.680 --> 07:51.320] And there's a whole number of things. [07:51.320 --> 07:58.340] But to find out if he has an attorney is not one of them. [07:58.340 --> 08:05.320] So when I get to court, first thing I'm going to want to know is what am I doing here? [08:05.320 --> 08:09.520] And he's going to say they wanted to find out if I had an attorney or not. [08:09.520 --> 08:13.560] And I'm going to tell him, well, that's not the question I asked. [08:13.560 --> 08:22.160] I want to know under what specific statutory authority did you summon me under threat of [08:22.160 --> 08:27.200] arrest to come here before this court? [08:27.200 --> 08:30.740] And he's going to do some little song and dance. [08:30.740 --> 08:41.640] And then I'm going to point him toward Chapter 28, Title 2801 of the Texas Code of Criminal [08:41.640 --> 08:49.000] Procedure, which specifies what a judge can summon someone to court for. [08:49.000 --> 08:56.760] And ask him to tell me which one of those in that list did he summon me for. [08:56.760 --> 09:03.600] And he's going to suggest that he summoned me under his inherent power as a judge. [09:03.600 --> 09:10.640] He said, well, that will be nice if you had that inherent power. [09:10.640 --> 09:19.120] But where a power is specified by the legislature, it cannot arbitrarily be expanded on by a [09:19.120 --> 09:23.040] supposed inherent power of the court. [09:23.040 --> 09:29.640] The legislature went to the trouble to very clearly specify what a person can be summoned [09:29.640 --> 09:33.520] to court for. [09:33.520 --> 09:38.600] And to find out if he has an attorney is not in the list, Bubba. [09:38.600 --> 09:47.760] So when he can't give me a good reason, I'm going to ask him to disqualify himself as [09:47.760 --> 09:53.520] he has committed a criminal act from the bench to my detriment. [09:53.520 --> 10:01.360] And I will be preparing criminal charges to present to a grand jury against him. [10:01.360 --> 10:06.560] And I'm going to ask him to disqualify himself until such time as the criminal allegations [10:06.560 --> 10:10.400] can be adjudicated. [10:10.400 --> 10:17.760] That might be when I get thrown in jail for contempt of court, or it might not. [10:17.760 --> 10:27.480] What I really expect him to do is refuse to disqualify himself and continue on. [10:27.480 --> 10:32.320] He's going to ask me if I have an attorney and I'm going to tell him I'm not ready yet [10:32.320 --> 10:37.080] to answer any questions of this court until there's a court established that it has subject [10:37.080 --> 10:42.200] matter jurisdiction over me. [10:42.200 --> 10:48.040] And I will maintain that the documents before the court are insufficient to invoke subject [10:48.040 --> 10:50.880] matter jurisdiction of the court. [10:50.880 --> 10:58.160] And I'll direct the court to the statement of cause against me and in that statement [10:58.160 --> 11:08.880] of cause, the officer makes some statements that are insufficient on their face. [11:08.880 --> 11:11.720] Let me read this to you. [11:11.720 --> 11:19.080] If he, for those of you who don't know the story, I went to get an aposteele from the [11:19.080 --> 11:25.400] secretary of state and aposteele is just where the state verifies that a notary who notarized [11:25.400 --> 11:30.640] the document really is a notary and that's for documents going out of country. [11:30.640 --> 11:35.080] They wouldn't notarize it so I called the DPS to memorialize the refusal and take a [11:35.080 --> 11:41.600] complaint which the officer refused to do and ordered me from the room, the building, [11:41.600 --> 11:46.720] and physically forced me up to the lobby and then let me leave the lobby, wanted my identification [11:46.720 --> 11:51.200] which I gave him, then he wanted my driver's license which I wouldn't give him, and they [11:51.200 --> 11:56.400] wound up knocking the crap out of me and arresting me. [11:56.400 --> 12:00.960] Let me read the statement by officer Enrico Cruz. [12:00.960 --> 12:08.040] I, officer Enrico Cruz, derised at the James Rutter building and went to room B205, the [12:08.040 --> 12:12.440] officer secretary of state notary public section. [12:12.440 --> 12:18.080] I made contact with Kelton Randall D who had some personal papers of his which he was trying [12:18.080 --> 12:27.720] to get an aposteele from the secretary of state, attorney Hoang Nahilda. [12:27.720 --> 12:33.000] Hoang noticeably irritated, advised Kelton again as she had already explained to him [12:33.000 --> 12:37.400] before that an aposteele could not be issued to him legally from her office because the [12:37.400 --> 12:42.160] document is only issued and attached to documents pertaining to business outside the United [12:42.160 --> 12:43.160] States of America. [12:43.160 --> 12:47.960] I asked Miss Hoang if this meant that Mr. Kelton could no longer be helped and she said [12:47.960 --> 12:48.960] yes. [12:48.960 --> 12:54.040] I then advised Kelton that his business there was done and he needed to leave. [12:54.040 --> 12:58.240] He wanted to explain some more details as to why he should be allowed to receive one [12:58.240 --> 13:05.560] and I stopped him and asked him to come with me because I would be escorting him outside. [13:05.560 --> 13:10.840] He became agitated in the lobby area when I asked him to provide me with his identification. [13:10.840 --> 13:14.040] He said no I won't and attempted to leave. [13:14.040 --> 13:19.280] I advised him that he would be arrested for failure to identify himself properly. [13:19.280 --> 13:22.800] Kelton then grudgingly gave me his Texas identification card. [13:22.800 --> 13:27.280] I then asked him for his Texas driver's license and he said it was none of my business and [13:27.280 --> 13:29.160] he would not provide it. [13:29.160 --> 13:34.280] I told Kelton to have a seat while I waited for DPS communications to advise me of any [13:34.280 --> 13:39.960] history or alarms at which point he tried to leave again and I repeated to him that [13:39.960 --> 13:43.640] he would be arrested for leaving. [13:43.640 --> 13:49.440] I was notified by DPS communication that he had a Texas driver's license 09456456 and [13:49.440 --> 13:50.960] the status was clear. [13:50.960 --> 13:55.700] I gave Kelton his Texas identification card back and said that he would be receiving a [13:55.700 --> 14:00.560] criminal trespass warning and that he was free to leave. [14:00.560 --> 14:03.680] That is a bold faced lie. [14:03.680 --> 14:06.000] Kelton then repeated no I won't. [14:06.000 --> 14:12.320] I called APD and they are coming to take my complaint because you falsely arrested me. [14:12.320 --> 14:17.260] My supervisor Sergeant Stephen McNeil who had arrived took Mr. Kelton outside to advise [14:17.260 --> 14:19.040] him he was free to leave. [14:19.040 --> 14:22.160] Kelton said no I am waiting for APD. [14:22.160 --> 14:28.840] The phone call to APD dispatched by Officer John Esposito to confirm that an officer was [14:28.840 --> 14:32.040] en route to take a report turned out negative. [14:32.040 --> 14:36.680] APD advised Esposito there was nothing on their log instructing anyone to go and take [14:36.680 --> 14:41.880] a report about a false arrest from anyone named Kelton, Randall Duane. [14:41.880 --> 14:45.600] Kelton was handcuffed and arrested for criminal trespass and booked in the Travis County [14:45.600 --> 14:47.960] Jail. [14:47.960 --> 14:50.720] Well they got a problem Bubba. [14:50.720 --> 15:00.760] They will, Austin PD will have dispatch logs of me calling the police and asking them to [15:00.760 --> 15:04.200] arrest this guy because he wouldn't let me leave the building. [15:04.200 --> 15:07.760] Now Randy can you subpoena the 911 calls? [15:07.760 --> 15:08.760] Of course. [15:08.760 --> 15:16.200] Don't you, do you have to have the 911 call number first or I mean how do you do that? [15:16.200 --> 15:19.680] I can locate it by date and time. [15:19.680 --> 15:23.760] I'll have the date and time on my call log on myself. [15:23.760 --> 15:29.920] I thought you said that you can't do that because they want to keep the 911 calls secret [15:29.920 --> 15:33.440] as far as who calls to protect the caller. [15:33.440 --> 15:34.880] I'm the caller. [15:34.880 --> 15:37.120] No my phone will show that I called 911. [15:37.120 --> 15:41.520] Oh you can subpoena your own call, you just can't subpoena other people's calls. [15:41.520 --> 15:46.760] No no no I don't have to, I can subpoena these records because they pertain to a criminal [15:46.760 --> 15:53.560] action and I am the caller therefore I have a special right to access. [15:53.560 --> 16:00.300] And since they arrested me, you know this time they didn't charge me with anything, [16:00.300 --> 16:08.200] they subsequently a month later made the charge and I will be accusing them of making the [16:08.200 --> 16:15.320] charge in retaliation for my calls to the department to determine who dispatched Sergeant [16:15.320 --> 16:16.700] McNeil. [16:16.700 --> 16:24.960] And they also have a problem as they all carry personal recording devices and I have already [16:24.960 --> 16:32.760] requested those and the DPS requested an opinion from the Attorney General and the Attorney [16:32.760 --> 16:35.520] General said that they didn't have to release them. [16:35.520 --> 16:36.520] Alright. [16:36.520 --> 16:45.880] But since I have made a request for them, then they're not authorized to erase them. [16:45.880 --> 16:50.040] Okay alright we're going to break, we'll be right back, we'll hear more about this on [16:50.040 --> 16:51.040] the other side. [16:51.040 --> 16:57.120] Rule of Law, Randi Kelton and Deborah Stevens, we'll be right back. [19:23.680 --> 19:27.680] They may tear me, they may tear you, and they may tear the country [19:27.680 --> 19:32.680] They may tear up the constitution, they may rip it in three, they may give a damn about me [19:32.680 --> 19:37.680] Genocide of this country, how they may lead we, they may lead me safe [19:37.680 --> 19:42.680] Like we blind and we crazy, they may lead in with destruction, you see [19:42.680 --> 19:47.680] Nuclear weapon and big gun, they may point on the country of the man [19:47.680 --> 19:52.680] They may tear me, they may tear you, they may tear me, Lord, they may tear the country [19:52.680 --> 19:57.680] They may tear me, they may tear you, they may tear me, Lord, they may tear the country [19:57.680 --> 20:06.680] Look what we get, they don't have the answer [20:06.680 --> 20:15.680] Look what we get, they don't have the answer [20:15.680 --> 20:26.680] We have to question, we have to question why they need to we hold nuclear weapon in our country [20:26.680 --> 20:33.680] Okay, we are back. The rule of law, Randy Kelton, Deborah Stevens. [20:33.680 --> 20:38.680] Okay, Randy, you had just read the statement. Please go ahead. [20:38.680 --> 20:49.680] Yes, the problem they have is they had about a dozen officers in the building by this time [20:49.680 --> 20:59.680] And I will be able to put at least three of them on the stand and rip them to pieces [20:59.680 --> 21:04.680] Once before I was, I had a sheriff's deputy try to kill me [21:04.680 --> 21:08.680] And charged me with resisting arrest and interfering with a public servant [21:08.680 --> 21:11.680] Because he wasn't big enough to get me killed [21:11.680 --> 21:15.680] So they charged me to cover up for what they had done [21:15.680 --> 21:21.680] And when I got into court, I told the jury that I was here representing myself [21:21.680 --> 21:24.680] And I'm not going to tell you why I'm representing myself [21:24.680 --> 21:28.680] I know the stories you've heard about people representing themselves [21:28.680 --> 21:32.680] I'm not going to tell you why because the judge told me I couldn't [21:32.680 --> 21:35.680] Mr. Kelton, did you see what I mean? [21:35.680 --> 21:42.680] I told him that I'm going to tell you that these officers are going to get up here on the stand [21:42.680 --> 21:47.680] And they're going to look at you now and they're going to lie like dogs [21:47.680 --> 21:49.680] And you're not going to believe that [21:49.680 --> 21:55.680] And I'm going to tell you that the sheriff out here, pointed right in his face sitting out there in the audience [21:55.680 --> 21:57.680] That he's out to get me [21:57.680 --> 21:59.680] And you're not going to believe that [21:59.680 --> 22:02.680] And the prosecutor, even him, he's out to get me too [22:02.680 --> 22:05.680] And even the judge, and you're not going to believe that [22:05.680 --> 22:10.680] The only thing I've got going for me is the truth [22:10.680 --> 22:12.680] Watch for the truth [22:12.680 --> 22:15.680] You'll find it in the details [22:15.680 --> 22:19.680] Liars never get the details right [22:19.680 --> 22:23.680] And we have too many officers there [22:23.680 --> 22:32.680] And this officer in particular, I will have crucified him by the time we get there [22:32.680 --> 22:37.680] And he'll be in all this trouble with me [22:37.680 --> 22:45.680] Because he was forced to lie to cover up what his sergeant did [22:45.680 --> 22:50.680] Everybody else acted pretty well professional [22:50.680 --> 22:53.680] I mean, this guy held me there and that was annoying [22:53.680 --> 22:56.680] But he wasn't out of line [22:56.680 --> 22:59.680] And even when I gave him a hard time [22:59.680 --> 23:06.680] He handled himself with a relative amount of professional poise [23:06.680 --> 23:11.680] When the sergeant came, the ranking officer [23:11.680 --> 23:15.680] He came and acted like a blithering idiot [23:15.680 --> 23:18.680] It embarrassed everybody [23:18.680 --> 23:25.680] And now this officer has to perjure himself [23:25.680 --> 23:30.680] This is what the police officers call testiline [23:30.680 --> 23:36.680] And we like to give him on the stand and ask him about testiline [23:36.680 --> 23:41.680] And talk to them about how, funny thing about the truth [23:41.680 --> 23:45.680] It always lodges itself in the details [23:45.680 --> 23:50.680] So, when I start questioning you [23:50.680 --> 23:53.680] Officer Cruz, watch the details [23:53.680 --> 23:55.680] That's where I'll get you [23:55.680 --> 23:57.680] That's where you'll trip up [23:57.680 --> 24:01.680] Because you liars never get the details right [24:01.680 --> 24:03.680] But that's when I, if I ever get to court [24:03.680 --> 24:06.680] Which I doubt that I ever will [24:06.680 --> 24:10.680] Because I'm relatively certain that the prosecuting attorney [24:10.680 --> 24:13.680] When he finds out that I'm going to fight the case [24:13.680 --> 24:16.680] Is going to dismiss the case [24:16.680 --> 24:23.680] And when he does, I'm going to file criminal charges against the county attorney [24:23.680 --> 24:27.680] Because he has no such authority [24:27.680 --> 24:30.680] And when I go into court Monday [24:30.680 --> 24:36.680] I will have criminal charges against Officer Cruz [24:36.680 --> 24:41.680] There's another officer there I'll have criminal charges against [24:41.680 --> 24:48.680] And I'm debating about whether I should file against the Sergeant McNeil [24:48.680 --> 24:51.680] Sergeant McNeil is the one that lost his cool [24:51.680 --> 24:54.680] And grabbed me and slammed me into a wall [24:54.680 --> 24:57.680] And smashed my face into the wall [24:57.680 --> 25:01.680] And crushed my pin through my coat lapel [25:01.680 --> 25:06.680] He hit the wall so hard [25:06.680 --> 25:11.680] I'm considering not charging him at all [25:11.680 --> 25:15.680] Just ignoring him [25:15.680 --> 25:20.680] I charged everybody else that he got in trouble [25:20.680 --> 25:24.680] I had his lieutenant [25:24.680 --> 25:28.680] When I asked him who was the one that sent Sergeant McNeil [25:28.680 --> 25:31.680] Out there to beat the hell out of me and throw me in jail [25:31.680 --> 25:33.680] For exercising my first amendment right [25:33.680 --> 25:35.680] He said he did [25:35.680 --> 25:40.680] I said wow, thank you very much, I'm done with you [25:40.680 --> 25:47.680] So I'll file aggravated assault charges against the lieutenant [25:47.680 --> 25:50.680] And against Cruz [25:50.680 --> 25:54.680] And against the other officer, I think his name was Harker [25:54.680 --> 26:00.680] And it's a shame I have to file against Harker [26:00.680 --> 26:02.680] Harker, big black guy [26:02.680 --> 26:05.680] I knocked in the door and I looked at him and I said to myself [26:05.680 --> 26:08.680] Self, that is a proud man [26:08.680 --> 26:11.680] And I was right, he was [26:11.680 --> 26:15.680] He was a smart, proud officer [26:15.680 --> 26:17.680] And he did a good job [26:17.680 --> 26:21.680] He tried to ask me questions and I refused to answer them [26:21.680 --> 26:23.680] He tried to ask again [26:23.680 --> 26:26.680] And I asked him what part of I do not want to talk to you [26:26.680 --> 26:29.680] Do you not understand [26:29.680 --> 26:31.680] He stepped back and looked at me a minute [26:31.680 --> 26:33.680] He knew I was baiting him [26:33.680 --> 26:38.680] He said, oh Mr. Kelton, I understood you perfectly [26:38.680 --> 26:41.680] You can stop talking if you don't want to [26:41.680 --> 26:44.680] But I can talk all I choose [26:44.680 --> 26:46.680] I said well, fine [26:46.680 --> 26:49.680] You talk, I ignore [26:49.680 --> 26:52.680] And he asked me a few more questions and I ignored him [26:52.680 --> 26:57.680] And sitting there writing out a criminal complaint against [26:57.680 --> 26:59.680] The officer Cruz [26:59.680 --> 27:02.680] And after a while he quit talking to me [27:02.680 --> 27:05.680] He didn't do anything stupid [27:05.680 --> 27:08.680] And then the sergeant came in and the sergeant just lost it [27:08.680 --> 27:11.680] I think the sergeant was on drugs [27:11.680 --> 27:17.680] He gave all of the indications of having no impulse control [27:17.680 --> 27:22.680] So when they put me in the patrol car [27:22.680 --> 27:24.680] I told this black guy, he got in the car [27:24.680 --> 27:27.680] I said, oh no, no, you need to get out of here [27:27.680 --> 27:29.680] No, I have to take you to jail [27:29.680 --> 27:31.680] No, no, no, no, no [27:31.680 --> 27:34.680] You're the only one that conducted yourself with any kind of professional decorum [27:34.680 --> 27:36.680] You need to get out of here [27:36.680 --> 27:38.680] Make one of those guys take me to jail [27:38.680 --> 27:41.680] They're the ones that created this mess [27:41.680 --> 27:43.680] But he said he had to [27:43.680 --> 27:47.680] But he understood that I was indicating to him [27:47.680 --> 27:50.680] That I appreciated his professionalism [27:50.680 --> 27:53.680] When the sergeant grabbed me and slammed me into the wall [27:53.680 --> 27:57.680] Almost immediately this black guy was between us [27:57.680 --> 27:59.680] With his back to the sergeant [27:59.680 --> 28:01.680] He said, I'll cuff him [28:01.680 --> 28:04.680] And he backed the sergeant away [28:04.680 --> 28:08.680] To stop, you know, to end things so they didn't get worse [28:08.680 --> 28:11.680] I appreciated him for that [28:11.680 --> 28:16.680] But I'm going to get him on the stand [28:16.680 --> 28:18.680] And he's a proud man [28:18.680 --> 28:21.680] And when I get done with him [28:21.680 --> 28:23.680] I have all the information I need [28:23.680 --> 28:28.680] But when I start filing criminal charges against him [28:28.680 --> 28:34.680] I'll charge him with first degree felony aggravated assault [28:34.680 --> 28:38.680] And he is going to be incensed [28:38.680 --> 28:42.680] Because I did exactly to him what I did to the sergeant [28:42.680 --> 28:46.680] I told the sergeant what part of I do not want to talk to you [28:46.680 --> 28:49.680] That you would not understand [28:49.680 --> 28:52.680] When he lost his cool [28:52.680 --> 28:54.680] Well, I did the same thing to Officer Harker [28:54.680 --> 28:58.680] And he didn't lose his cool [28:58.680 --> 29:01.680] So he does everything right [29:01.680 --> 29:05.680] The sergeant comes in, screws up everything [29:05.680 --> 29:07.680] He winds up with criminal charges against him [29:07.680 --> 29:12.680] The sergeant goes scot-free [29:12.680 --> 29:15.680] They're going to be plenty mad at this sergeant [29:15.680 --> 29:21.680] I will also have criminal charges against a major Remy [29:21.680 --> 29:28.680] He's the major over the DPS for the Capitol building [29:28.680 --> 29:32.680] He told me that he was aware of my circumstance [29:32.680 --> 29:36.680] And he felt his officers acted appropriately [29:36.680 --> 29:39.680] So what that says to me is [29:39.680 --> 29:44.680] That they acted in concert and collusion toward a criminal policy [29:44.680 --> 29:47.680] Okay, Randy, all right, we're going to break [29:47.680 --> 29:51.680] They acted in concert and collusion toward a criminal policy [29:51.680 --> 29:52.680] Yes [29:52.680 --> 29:55.680] All right, we'll talk about that more on the other side [29:55.680 --> 29:58.680] The rule of law [29:58.680 --> 30:00.680] Gold prices are at historic highs [30:00.680 --> 30:03.680] And with the recent pullback, this is a great time to buy [30:03.680 --> 30:07.680] With the value of the dollar, risks of inflation, geopolitical uncertainties [30:07.680 --> 30:11.680] And instability in rural financial systems, I see gold going up much higher [30:11.680 --> 30:14.680] Hi, I'm Tim Fry at Roberts and [30:53.680 --> 30:57.680] 800-874-9760 [30:57.680 --> 31:08.680] Yeah, Mr. Officer, you're taking the law in the head I want you to follow the law of the land [31:08.680 --> 31:17.680] I don't understand Your job is to protect officers Not to be abused [31:17.680 --> 31:31.680] When you're going to stop abuse, your power When you're going to stop abuse, your power [31:31.680 --> 31:35.680] Alright, when you're going to stop abuse your power, Mr. Officer [31:35.680 --> 31:39.680] That's pretty much what happened to you, right, Randy? [31:39.680 --> 31:43.680] And they acted in Concert and Collusion, right? [31:43.680 --> 31:47.680] Yes, well that's going to be my assertion [31:47.680 --> 31:53.680] The major said they acted in accordance with policy [31:53.680 --> 32:07.680] And I will maintain that policy when it amounts to criminal actions in Concert and Collusion one with the other [32:07.680 --> 32:11.680] That comes up criminal conspiracy [32:11.680 --> 32:21.680] Now they can supervise their officers in the performance of their legal duty [32:21.680 --> 32:23.680] And that's just fine [32:23.680 --> 32:34.680] But when they talk to their officers and agree one with the other to perform acts that are defined as crimes [32:34.680 --> 32:41.680] By the penal code of the state of Texas, that comes up a criminal conspiracy [32:41.680 --> 32:47.680] And in this case, the conspiracy was to commit not police brutality [32:47.680 --> 32:56.680] You know, if you look all through the Texas penal code, you will find no such statute [32:56.680 --> 33:01.680] Police brutality, it's not in there anywhere [33:01.680 --> 33:15.680] But there is a statute under 2202 Texas penal code that talks about assault, aggravated assault [33:15.680 --> 33:26.680] And if a person commits assault while displaying a deadly weapon, that's a second degree felony in the state of Texas [33:26.680 --> 33:36.680] Except if that person is acting under the color of an official authority [33:36.680 --> 33:42.680] Color in legal terms means pretense [33:42.680 --> 33:47.680] In which case it is a first degree felony [33:47.680 --> 33:53.680] You know, aggravated kidnapping, first degree murder [33:53.680 --> 33:56.680] They're all first degree felonies [33:56.680 --> 34:00.680] I'm sorry, first degree murder is a capital felony [34:00.680 --> 34:04.680] But murder is a first degree felony [34:04.680 --> 34:11.680] The legislature considered that really serious business [34:11.680 --> 34:23.680] And in the statute, they addressed assault by a public official or someone acting under the color of official authority [34:23.680 --> 34:31.680] They considered that before they considered an assault against a public official [34:31.680 --> 34:46.680] However, when I went to Lexus and did a search on it, on assault by a public official, I got zero hits [34:46.680 --> 34:54.680] Now, to understand how profound that is, there's a guy named Rhett Pease [34:54.680 --> 34:57.680] Rhett Pease is just an ordinary guy [34:57.680 --> 35:00.680] Well, he's kind of a pain in the neck [35:00.680 --> 35:04.680] He sues everybody [35:04.680 --> 35:09.680] Emotionally loses, sometimes I guess he wins, I don't know [35:09.680 --> 35:16.680] I one time ran Rhett Pease's name on Lexus [35:16.680 --> 35:20.680] I got every suit he ever filed [35:20.680 --> 35:23.680] It's on Lexus [35:23.680 --> 35:33.680] He's just some ordinary guy, podunk Texas, files a few lawsuits against some ordinary people and a couple against some judges and stuff [35:33.680 --> 35:39.680] But every single one of them is in Lexus [35:39.680 --> 35:53.680] Not one single case where a public official is accused of assaulting a person while displaying a deadly weapon [35:53.680 --> 36:06.680] Every single time a police officer uses force when force is not warranted while he's displaying a deadly weapon [36:06.680 --> 36:18.680] That falls under 22.02 paragraph B to A [36:18.680 --> 36:21.680] Clearly dead center right under it [36:21.680 --> 36:26.680] They call it police brutality, but that's a legal fiction [36:26.680 --> 36:29.680] There is no such thing as police brutality [36:29.680 --> 36:33.680] There is aggravated assault by a public official [36:33.680 --> 36:37.680] So I'm going to charge the assistant director of the DPS [36:37.680 --> 36:41.680] There is no director, he's retired [36:41.680 --> 36:44.680] But there is an assistant director [36:44.680 --> 36:55.680] When I go into court Monday, the first thing I will do before anything else is tell the judge that I have some papers to present to the court [36:55.680 --> 37:01.680] And the prosecutor will object because he hasn't seen them [37:01.680 --> 37:07.680] And I will tell the prosecutor, no you haven't seen them because they're not any of your business yet [37:07.680 --> 37:10.680] They will be in a minute [37:10.680 --> 37:14.680] And that will probably get the judge's attention [37:14.680 --> 37:22.680] But if the prosecutor insists on seeing them, then I'll give them to the prosecutor [37:22.680 --> 37:27.680] And tell the judge, I guess I don't need to give them to you now [37:27.680 --> 37:31.680] He does [37:31.680 --> 37:37.680] Prosecutors are going to look at them and they're going to be a stack of verified criminal affidavits [37:37.680 --> 37:40.680] And here's the deal [37:40.680 --> 37:46.680] When I present verified criminal affidavits to a judge [37:46.680 --> 37:51.680] He stops being a judge and becomes a magistrate [37:51.680 --> 37:54.680] I invoke his duty as a magistrate [37:54.680 --> 37:58.680] If the prosecuting attorney intercedes [37:58.680 --> 38:03.680] And the judge directs me to give the documents to the prosecuting attorney [38:03.680 --> 38:11.680] When he reads them, then his duty under Article 2.03 Code of Criminal Procedure is invoked [38:11.680 --> 38:20.680] I'm sorry, the statute for the judge was Article 2.10 Code of Criminal Procedure invoked the judge's duty as a magistrate [38:20.680 --> 38:24.680] And it has been given to the prosecutor [38:24.680 --> 38:28.680] When the prosecutor reads the criminal affidavit [38:28.680 --> 38:37.680] Then he has had it made known to him that a public official has violated a law relating to his office [38:37.680 --> 38:43.680] And that's covered under Article 2.03 Code of Criminal Procedure [38:43.680 --> 38:48.680] And gives the prosecutor a specific duty [38:48.680 --> 38:55.680] He gives the complaint to an information and submit both to the grand jury [38:55.680 --> 39:04.680] Article 2.05 commands him to submit a copy of the complaint to some magistrate [39:04.680 --> 39:12.680] So, now it's the prosecutor's duty to give a copy to the judge, because he's a magistrate [39:12.680 --> 39:17.680] And present the other to the grand jury [39:17.680 --> 39:20.680] Gotcha, Bubba! [39:20.680 --> 39:25.680] And what he's going to say is I have to give him to the district attorney [39:25.680 --> 39:35.680] And I will say, well, Article 2.03 did not say when a district attorney is made known [39:35.680 --> 39:41.680] It says when a prosecuting attorney is made known [39:41.680 --> 39:48.680] Unless I'm badly mistaken, you're a prosecuting attorney for the state of Texas [39:48.680 --> 39:52.680] Unless, of course, you don't have an oath of office [39:52.680 --> 39:57.680] In which case, you're an imposter [39:57.680 --> 40:02.680] And that'll be the first thing we do in the court [40:02.680 --> 40:09.680] If I can get it done, you see, all of this is a learning process [40:09.680 --> 40:16.680] What I don't always know is what kind of shenanigans they're going to try to pull [40:16.680 --> 40:20.680] If the judge just simply refuses to hear the complaints [40:20.680 --> 40:24.680] Then I'll order the prosecutor to give those to the judge [40:24.680 --> 40:28.680] In accordance with Article 2.05 code-groom procedure [40:28.680 --> 40:33.680] And frankly, I haven't done this this way in court enough [40:33.680 --> 40:39.680] To know what the prosecutor is going to try to do [40:39.680 --> 40:46.680] He'll probably launch into an ad hominem attack against me [40:46.680 --> 40:49.680] And I'll feel disparaged if he does [40:49.680 --> 40:53.680] You hurt my feelings [40:53.680 --> 40:57.680] But it'll be a test, I'll get to find out what the prosecutor does [40:57.680 --> 41:02.680] I suspect that whatever he tries to do, I'm pretty well going to be ready for it [41:02.680 --> 41:06.680] I've done this, I've messed with prosecutors enough [41:06.680 --> 41:11.680] That I've pretty well got their standard fair [41:11.680 --> 41:20.680] What he's probably going to do is tell the judge that I need to file these with a Justice of the Peace [41:20.680 --> 41:30.680] And I'm going to ask the judge to show me in some statute [41:30.680 --> 41:36.680] Where a complaint is directed to a Justice of the Peace [41:36.680 --> 41:39.680] I looked all through the code and I couldn't find it, maybe learning [41:39.680 --> 41:43.680] What I won't do is talk to the prosecutor [41:43.680 --> 41:47.680] I only talk to the judge and that drives the prosecutor crazy [41:47.680 --> 41:51.680] If the prosecutor talks to me, I ignore him [41:51.680 --> 41:59.680] Because in court, you're there to address the court, not each other [41:59.680 --> 42:03.680] So you're not supposed to talk to each other [42:03.680 --> 42:07.680] If the prosecutor's not supposed to speak to you, you're not supposed to speak to him [42:07.680 --> 42:13.680] Any time the prosecutor speaks to me, then I ask the judge to direct the prosecutor [42:13.680 --> 42:18.680] Or instruct the prosecutor to direct his comments to the court [42:18.680 --> 42:25.680] That he's not my buddy and I'm not interested in engaging in the idle conversation with him [42:25.680 --> 42:31.680] This is the first part of the plan and the other part, I've got the weekend [42:31.680 --> 42:41.680] To put together every annoying and obnoxious maneuver I can pull in front of the court [42:41.680 --> 42:48.680] I want to get a hold of Joe Edwards and kind of get down how to stand at arm's length from the court [42:48.680 --> 42:55.680] How to force the court to prove up its jurisdiction because that will be the next place I go [42:55.680 --> 42:59.680] I will claim that the court has no subject matter jurisdiction [42:59.680 --> 43:09.680] Because the documents before the court are insufficient to invoke the jurisdiction of the court [43:09.680 --> 43:12.680] There's one missing [43:12.680 --> 43:21.680] And the document that's missing is an order from a magistrate finding probable cause [43:21.680 --> 43:25.680] 1617 requires that order [43:25.680 --> 43:30.680] I have seen them in Travis County documents [43:30.680 --> 43:39.680] But I haven't, I didn't get a copy of the county court records so I'll have to check to make sure it's not there to raise that issue [43:39.680 --> 43:43.680] Okay, alright Randy we're going to break [43:43.680 --> 43:49.680] The county clerk, the county clerk, the records [43:49.680 --> 43:52.680] We'll be right back [43:58.680 --> 44:01.680] Stock markets are taking hit after hit [44:01.680 --> 44:04.680] Corrupt bankers are choking on subprime debt [44:04.680 --> 44:12.680] The Fed is busy printing dollars, dollars and more dollars to bail out Wall Street, banks and the US car industry [44:12.680 --> 44:18.680] As investors scramble for safety in the metals in the face of a further devaluation of the dollar [44:18.680 --> 44:21.680] The price of silver will only increase [44:21.680 --> 44:28.680] Some of the world's leading financial analysts believe that silver is one of the world's most important commodities [44:28.680 --> 44:31.680] With unparalleled investment opportunity for the future [44:31.680 --> 44:37.680] Now is the time to buy silver before it heads for $75 an ounce [44:37.680 --> 44:43.680] And the yellow metal roars back past $1,000 an ounce to new highs [44:43.680 --> 44:55.680] Call Maximus Holdings now at 407-608-5430 to find out how you can turn your IRA and 401k into a solid investment [44:55.680 --> 44:58.680] Silver without Holdings at 407-608-5430 for more information [45:34.680 --> 45:39.680] If you could not wait any bout too long, would your purpose best be done? [45:39.680 --> 45:45.680] Dr. Sandman, a soldier, a warrior of love, scuffling that keeps him peace [45:45.680 --> 45:48.680] All they're taking is a misunderstanding [45:48.680 --> 45:53.680] If somebody calls the police, they're watching the spotlights [45:53.680 --> 46:21.680] This is the rule of law, Randy Kelton and Deborah Stevens [46:21.680 --> 46:28.680] Okay, Randy, so the record's in the county clerk's office [46:28.680 --> 46:36.680] Yes, and I have in Travis County, if someone's arrested without a warrant [46:36.680 --> 46:41.680] If I look in the court record, I will find the magistrate's warning [46:41.680 --> 46:48.680] And the way it's written, it amounts to an order under 1617 [46:48.680 --> 46:54.680] It shows whether or not the magistrate has found probable cause [46:54.680 --> 46:59.680] And bound the person to the court, which meets the requirement of 1617 [46:59.680 --> 47:02.680] And frankly, I was pleased to see that [47:02.680 --> 47:08.680] Because at some place or other, in order for me to raise this issue [47:08.680 --> 47:16.680] Then I have to find, it helps if I find someone who's actually doing what I'm saying they should do [47:16.680 --> 47:21.680] And in this case, Travis County was actually doing it [47:21.680 --> 47:26.680] So that's good, so if I look in the court record and actually find it there [47:26.680 --> 47:30.680] Then I'm going to challenge the validity of it [47:30.680 --> 47:34.680] Maintaining that the document is insufficient [47:34.680 --> 47:39.680] That the presiding judge knows full well it's insufficient [47:39.680 --> 47:46.680] Because probable cause determination was made in a secret hearing held [47:46.680 --> 47:51.680] In the presence of the jailers and the judge and the magistrate [47:51.680 --> 48:01.680] While I was being held in a cell and physically preventing from attending the hearing [48:01.680 --> 48:05.680] And the judge is going to say, well, this is a misdemeanor [48:05.680 --> 48:09.680] And you don't have a right to an examining trial [48:09.680 --> 48:11.680] Yeah, but you were in jail [48:11.680 --> 48:13.680] Yes, so that's what I'm going to say [48:13.680 --> 48:18.680] So now the court's giving legal advice [48:18.680 --> 48:24.680] So do you want to get down here, over here and do the prosecutor's job? [48:24.680 --> 48:28.680] Or I hope the prosecutor says it [48:28.680 --> 48:37.680] Then I'm going to ask the court to demonstrate how bail can be set in any case [48:37.680 --> 48:41.680] Without an examining trial [48:41.680 --> 48:42.680] Good point [48:42.680 --> 48:47.680] Bail was set in this matter and if bail was set [48:47.680 --> 48:51.680] There must have been an examining trial [48:51.680 --> 48:56.680] Direct the court to 17.05 Code of Criminal Procedure [48:56.680 --> 49:03.680] It clearly states that bail is set in and into before a magistrate after an examining trial [49:03.680 --> 49:06.680] And that's exclusive [49:06.680 --> 49:09.680] That's the only time [49:09.680 --> 49:14.680] Even a judge is not here authorized to set bail [49:14.680 --> 49:22.680] Judges in other places are authorized to change the amount of bail but not set it [49:22.680 --> 49:27.680] That's set in a criminal case after an examining trial [49:27.680 --> 49:32.680] So the presupposition must be that there was an examining trial [49:32.680 --> 49:36.680] And since the magistrate advised me of bail [49:36.680 --> 49:41.680] It's reasonable to believe that he's the one that said it [49:41.680 --> 49:46.680] So when did he have this examining trial? [49:46.680 --> 49:53.680] And under what authority was evidence presented to the court? [49:53.680 --> 49:57.680] Outside a proper hearing [49:57.680 --> 50:05.680] Because obviously the judge had documents in his hand relating to me, how'd he get them? [50:05.680 --> 50:09.680] And I'm going to ask the judge to arrest the magistrate [50:09.680 --> 50:15.680] Because there will be criminal complaints against the magistrate in the stack that I brought [50:15.680 --> 50:22.680] I don't know how far we'll get, the judge may just blow the whole thing off [50:22.680 --> 50:30.680] And say, this case is continued, you're to come back next day [50:30.680 --> 50:35.680] So if he does that, that's what I really expect him to do, is just kind of blow me out of there [50:35.680 --> 50:40.680] Because he's likely to be bushwhacked by me [50:40.680 --> 50:44.680] He's not going to know who I am when I come in the door [50:44.680 --> 50:46.680] And he's not going to know until I land on him [50:46.680 --> 50:49.680] I don't know about that, Randy [50:49.680 --> 50:52.680] I think they know who you are by now [50:52.680 --> 50:59.680] Well, I'm sure that the DPS is not waving a red flag [50:59.680 --> 51:04.680] They're trying to mitigate their potential liability [51:04.680 --> 51:08.680] So they're not going to raise a red flag [51:08.680 --> 51:17.680] And so probably, unless the judge, unless they've gotten together and talked about this no good SOB who's causing trouble [51:17.680 --> 51:21.680] He's not going to really know who I am until I land on him [51:21.680 --> 51:27.680] And then he's going to want to back up, regroup and find out what's going on here [51:27.680 --> 51:32.680] So I expect what he'll do is a very quick continuance [51:32.680 --> 51:36.680] To which I will object and demand my right to a speedy trial [51:36.680 --> 51:41.680] I'll tell the court I am ready for trial right now [51:41.680 --> 51:45.680] And since the Speedy Trial Act has been overturned [51:45.680 --> 51:50.680] The prosecution no longer has 90 days in which to get me to court [51:50.680 --> 51:55.680] Without having to show cause for delay, he doesn't have any time [51:55.680 --> 52:01.680] So, after the showing of cause for delay, I want to be tried right here, right now [52:01.680 --> 52:04.680] I'm ready [52:04.680 --> 52:08.680] And they're not going to be ready [52:08.680 --> 52:11.680] So he's going to refuse that [52:11.680 --> 52:16.680] But he will know that I know [52:16.680 --> 52:25.680] And for anybody out there, if you get a criminal charge, always make a demand for speedy trial [52:25.680 --> 52:30.680] There are a number of just ordinary motions that should be filed [52:30.680 --> 52:33.680] Demand for court reporter [52:33.680 --> 52:37.680] Invoke the rule of witnesses [52:37.680 --> 52:45.680] That means that no two witnesses, no one witness can hear the testimony of another witness [52:45.680 --> 52:53.680] And frankly, that's how I crucified these officers in the trial where the deputy tried to kill me [52:53.680 --> 53:00.680] Because the officer who committed the act against me [53:00.680 --> 53:03.680] I embarrassed him really bad on the stand [53:03.680 --> 53:09.680] He got off the stand and went in the district attorney's office with all the other officers [53:09.680 --> 53:14.680] And talked to the sheriff about his testimony [53:14.680 --> 53:18.680] And told the sheriff something I had said to him [53:18.680 --> 53:25.680] And the sheriff, when I called him to the stand, repeated what this officer told him [53:25.680 --> 53:29.680] Not understanding the importance of it [53:29.680 --> 53:34.680] And the jury knew exactly where he got this information [53:34.680 --> 53:41.680] They knew that he had talked to the other witness before he come on the stand [53:41.680 --> 53:44.680] And repeated something that was said in court [53:44.680 --> 53:49.680] So the rule of witnesses is a good one to file [53:49.680 --> 53:58.680] The reason I won the case was that the two officers couldn't hear each other's testimony on the stand [53:58.680 --> 54:03.680] I called one right after the other so they didn't get a chance to discuss it either [54:03.680 --> 54:06.680] And I asked them both the same questions [54:06.680 --> 54:11.680] One answered one way, the other answered the other way [54:11.680 --> 54:14.680] Really critical questions [54:14.680 --> 54:19.680] And it's what I told the jury, the details, watch the details [54:19.680 --> 54:20.680] So that's where we get them [54:20.680 --> 54:23.680] So rule of witnesses is a real good one to file [54:23.680 --> 54:25.680] And there is an inliminy motion [54:25.680 --> 54:27.680] Motion inliminy [54:27.680 --> 54:32.680] L-I-M-I-N-I-E, I think [54:32.680 --> 54:35.680] Something like that, it's an odd spelling [54:35.680 --> 54:45.680] An inliminy motion is a motion that lists all of the questions the other side is forbidden to ask [54:45.680 --> 54:57.680] One of the questions is to ask about any prior interactions or experience with the individual [54:57.680 --> 55:05.680] The county attorney asked the sheriff if he had ever had any prior experience with Mr. Kelton [55:05.680 --> 55:07.680] I objected [55:07.680 --> 55:09.680] The judge overruled [55:09.680 --> 55:15.680] That exact question was in my inliminy motion [55:15.680 --> 55:20.680] And the judge forbade the prosecutor to ask the question [55:20.680 --> 55:23.680] In a motion hearing 8 o'clock that morning [55:23.680 --> 55:29.680] But before the jury, he allowed him to ask it [55:29.680 --> 55:32.680] Bad move, Bubba [55:32.680 --> 55:38.680] Because he let the sheriff just run off at the mouth about what a scoundrel I was [55:38.680 --> 55:44.680] And that's when he made the statement that he had heard from the other officer [55:44.680 --> 55:49.680] And nailed their hides to the wall [55:49.680 --> 55:54.680] So inliminy motion, good motion to file, Brady motion [55:54.680 --> 56:01.680] In a criminal case, Brady is a discovery motion [56:01.680 --> 56:03.680] And it's a lot more extensive [56:03.680 --> 56:09.680] I have about a 15 page Brady motion [56:09.680 --> 56:14.680] The way I find good motions is I go through court records [56:14.680 --> 56:18.680] You go down and you try to find the thickest case you can [56:18.680 --> 56:22.680] Because that's the one where somebody had a lot of money [56:22.680 --> 56:29.680] And he could afford to hire an expensive attorney who's not afraid of the judge [56:29.680 --> 56:33.680] And put on a good defense [56:33.680 --> 56:38.680] And going through those kinds of files, I found some incredible motions [56:38.680 --> 56:42.680] I've got a 30 page inliminy motion [56:42.680 --> 56:44.680] In my inliminy motion, I was in court [56:44.680 --> 56:48.680] And the judge is going through all of these questions [56:48.680 --> 56:53.680] And I had one in there that forbid the prosecutor [56:53.680 --> 56:58.680] To ask any questions concerning any hypnotic interviews [56:58.680 --> 57:01.680] And the judge, he's pretty ticked off [57:01.680 --> 57:04.680] Because he knows most of these don't have anything to do with anything [57:04.680 --> 57:07.680] He said, Mr. Kelter, were you hypnotized? [57:07.680 --> 57:09.680] And I said, well, I don't know, judge [57:09.680 --> 57:13.680] You know how I make you, forget that kind of stuff, ask him [57:13.680 --> 57:17.680] And the judge, deny, deny, deny [57:17.680 --> 57:21.680] Oh, it drove him crazy, it was a hoot [57:21.680 --> 57:23.680] And there was a whole stack of questions of that nature [57:23.680 --> 57:25.680] Everything you could think of [57:25.680 --> 57:30.680] So I have that in my blanks on my jurisprudence site [57:30.680 --> 57:33.680] The Brady and the inliminy [57:33.680 --> 57:39.680] And a number of just standard motions you should always file [57:39.680 --> 57:50.680] One of the things you should always file is a, I want to say a jury challenge [57:50.680 --> 57:53.680] Anyway, there's a statement you make to the jury [57:53.680 --> 57:55.680] I'll think of the term in a minute [57:55.680 --> 58:01.680] I don't have that on my website because it changes jury instructions [58:01.680 --> 58:05.680] Jury instructions is an art form [58:05.680 --> 58:07.680] Frankly, it's one I'm not good at yet [58:07.680 --> 58:09.680] It takes some more study [58:09.680 --> 58:13.680] But anybody who's going to fight their own case needs to know about jury instructions [58:13.680 --> 58:16.680] And there are books on jury instructions [58:16.680 --> 58:20.680] And you can go on the internet and do a search for it [58:20.680 --> 58:24.680] There are standard jury instructions [58:24.680 --> 58:29.680] And it's good to know those, to have those filed in the case [58:29.680 --> 58:34.680] Because it tends to short circuit the crap hole of the prosecutor president [58:34.680 --> 58:40.680] So when I get in there Monday, I'm going to try to have all of those standard motions [58:40.680 --> 58:44.680] Plus a bunch of the really annoying motions [58:44.680 --> 58:46.680] Okay, all right, we're going to break [58:46.680 --> 58:49.680] Jury instructions, I want to hear more about this when we get back [58:49.680 --> 58:53.680] All right, and we also have Randy from Texas on the line [58:53.680 --> 59:20.680] Randy and Randy, we'll be right back [59:23.680 --> 59:50.680] Okay. [01:03:19.680 --> 01:03:20.680] I'm here [01:03:20.680 --> 01:03:23.680] Hey how you doing tonight, thanks for calling in, what's on your mind? [01:03:23.680 --> 01:03:32.680] I wanted to ask a little bit about the difference and especially in this particular instance that Randy's talking about [01:03:32.680 --> 01:03:38.680] How do they have in person of jurisdiction of you to properly place you before the court [01:03:38.680 --> 01:03:42.680] I know you said that there's an issue with subject matter jurisdiction [01:03:42.680 --> 01:03:48.680] But why wouldn't you fight it under something along the lines of insufficiency or failure of due process [01:03:48.680 --> 01:03:53.680] To actually have jurisdiction over you to place you before the court [01:03:53.680 --> 01:04:00.680] Well because failure of due process doesn't cost them impersonal jurisdiction [01:04:00.680 --> 01:04:07.680] Failure of due process causes them subject matter jurisdiction [01:04:07.680 --> 01:04:14.680] And subject matter jurisdiction is a lot better because it cannot be waived [01:04:14.680 --> 01:04:19.680] And subject matter jurisdiction must come first [01:04:19.680 --> 01:04:27.680] They first must demonstrate that they have jurisdiction over the subject matter [01:04:27.680 --> 01:04:34.680] And then they have to demonstrate that they have jurisdiction over the individual personally [01:04:34.680 --> 01:04:39.680] But you had said that you wanted to talk to Joe Edwards about being at arm's length from the court [01:04:39.680 --> 01:04:44.680] And if you were to make a special appearance and argue that they didn't have in personum [01:04:44.680 --> 01:04:49.680] Which would be the, you would have to argue that first or else you would waive it [01:04:49.680 --> 01:04:55.680] Yeah but I can't be in personum jurisdiction in this case [01:04:55.680 --> 01:05:02.680] Okay but I guess then my question is why not, what has occurred that gives them that [01:05:02.680 --> 01:05:07.680] I am within the territorial boundaries of the state of Texas [01:05:07.680 --> 01:05:18.680] In this case the allegation of the location of the offense is within the territorial boundaries of the county of Travis [01:05:18.680 --> 01:05:31.680] And I have an allegation that I was observed to violate a penal statute within the boundaries of the county [01:05:31.680 --> 01:05:37.680] That gives the county in personum jurisdiction over me [01:05:37.680 --> 01:05:44.680] Now these other guys have some more arcane ways of arguing in personum jurisdiction [01:05:44.680 --> 01:05:50.680] But I'm not familiar enough with them yet [01:05:50.680 --> 01:06:01.680] You know this stuff of me being a man on the land and not the corporate entity [01:06:01.680 --> 01:06:08.680] I've heard people make that argument but it always winds up an argument that goes to a legal conclusion [01:06:08.680 --> 01:06:13.680] They don't get there directly from law [01:06:13.680 --> 01:06:17.680] Or at least not enough that I would be able to argue it in a court [01:06:17.680 --> 01:06:25.680] So the last thing I want to do is get into an argument where I'm going to get my behind kicked [01:06:25.680 --> 01:06:28.680] Right [01:06:28.680 --> 01:06:34.680] And you know there may well be a good argument there and if some folks have got me some good arguments [01:06:34.680 --> 01:06:38.680] I would be more than happy to throw them in the judges face [01:06:38.680 --> 01:06:43.680] I want everything I can throw at them that I can find [01:06:43.680 --> 01:06:48.680] But first, before anything else can happen [01:06:48.680 --> 01:06:52.680] The court has to demonstrate subject matter jurisdiction [01:06:52.680 --> 01:06:57.680] And there are a lot of ways for them to lose subject matter jurisdiction [01:06:57.680 --> 01:07:09.680] And one of the primary ways I'm able to demonstrate here is that the documents before the court [01:07:09.680 --> 01:07:15.680] Are before the court as a result of fraud and violation of due process [01:07:15.680 --> 01:07:22.680] Therefore, they are insufficient to invoke the subject matter jurisdiction of the court [01:07:22.680 --> 01:07:35.680] And I will maintain that it is the court's duty to prove up its jurisdiction before it attempts to exercise jurisdiction [01:07:35.680 --> 01:07:45.680] And I'm tempted to go in and demand that the court stand down or prove up jurisdiction [01:07:45.680 --> 01:07:52.680] And when the judge fails then ask the bailiff to arrest the judge [01:07:52.680 --> 01:07:59.680] Because if I don't raise an issue to subject matter jurisdiction [01:07:59.680 --> 01:08:03.680] The court can act as if he has subject matter jurisdiction [01:08:03.680 --> 01:08:10.680] Even if he doesn't, if it's never raised it never becomes an issue [01:08:10.680 --> 01:08:16.680] But once I raise the issue of subject matter jurisdiction [01:08:16.680 --> 01:08:25.680] Then the court no longer has subject matter jurisdiction until it proves that it has subject matter jurisdiction [01:08:25.680 --> 01:08:31.680] So when he just claims he has it or just moves ahead [01:08:31.680 --> 01:08:37.680] Then I ask the bailiff to arrest him for impersonating a judicial officer [01:08:37.680 --> 01:08:46.680] Is there a complaint, a verified complaint and an information in the file? [01:08:46.680 --> 01:08:52.680] Good question, I looked at the file but at the time I was in a terrible hurry [01:08:52.680 --> 01:08:56.680] I don't think an information, oh yeah I think it will be [01:08:56.680 --> 01:09:01.680] In Travis County they have an information the next day [01:09:01.680 --> 01:09:10.680] Now I have the documents from the JP and the complaint is in there and the statement of probable cause [01:09:10.680 --> 01:09:15.680] I don't have a copy of the records that the court clerk has [01:09:15.680 --> 01:09:22.680] I will try to get those tomorrow, tomorrow is my last day I need to go down and get those [01:09:22.680 --> 01:09:27.680] You're talking about the JP, the magistrate for the [01:09:27.680 --> 01:09:32.680] Where you're supposed to go before the magistrate to see if there's probable cause? [01:09:32.680 --> 01:09:38.680] No, this is the magistrate that issued the warrant [01:09:38.680 --> 01:09:47.680] That magistrate is commanded to make the warrant open for public inspection immediately after it's executed [01:09:47.680 --> 01:09:54.680] I went down there and I got a little crapola from his clerk and as soon as she gave me about a half ounce [01:09:54.680 --> 01:10:01.680] I said wait right here I need to go get security and she really got excited [01:10:01.680 --> 01:10:07.680] And wound up going back and talking to the judge and she was in tears [01:10:07.680 --> 01:10:14.680] And you know I talked to the judge and he said well Mr. Goffman you've been here before and you've always conducted yourself with decorum [01:10:14.680 --> 01:10:22.680] Well I did this time, I just asked for the copy of the warrant and she said they didn't have it that I'd have to go to the clerk [01:10:22.680 --> 01:10:31.680] And I considered that a violation of 15.26 code of criminal procedure because the court required to have it [01:10:31.680 --> 01:10:35.680] And she said well I just couldn't find it yet [01:10:35.680 --> 01:10:40.680] I don't know that, all I know is you told me I had to go somewhere else [01:10:40.680 --> 01:10:48.680] So I went to get security just to document your refusal to show me the warrant [01:10:48.680 --> 01:10:52.680] And the judge was oh well gee whiz [01:10:52.680 --> 01:11:00.680] Once I did that they stopped being so smart mouth and got on their toes and went and found it [01:11:00.680 --> 01:11:07.680] But that was good, now they know I mean business [01:11:07.680 --> 01:11:14.680] And she had to admit to the judge that I never raised my voice, I never threatened anyone with anything [01:11:14.680 --> 01:11:17.680] I just went for security [01:11:17.680 --> 01:11:23.680] I tell you guys that works [01:11:23.680 --> 01:11:27.680] You do that to them they know you mean business [01:11:27.680 --> 01:11:34.680] Sometimes if I expect trouble I take security with me [01:11:34.680 --> 01:11:38.680] But when you were originally arrested and they took you down [01:11:38.680 --> 01:11:45.680] Aren't they supposed to take you before magistrate to determine if there's cause to hold you? [01:11:45.680 --> 01:11:52.680] Directly to the nearest magistrate by the most direct route [01:11:52.680 --> 01:11:56.680] That's Heath Boyd [01:11:56.680 --> 01:12:01.680] Under Heath Boyd, no they didn't do that, I insisted that they do that [01:12:01.680 --> 01:12:06.680] But that would be insufficiency of process right there [01:12:06.680 --> 01:12:11.680] That's a violation they can't overcome [01:12:11.680 --> 01:12:15.680] Not insufficiency of process, that goes to a different issue [01:12:15.680 --> 01:12:18.680] That would be a due process violation [01:12:18.680 --> 01:12:21.680] Okay well that's what I meant, due process, I'm sorry [01:12:21.680 --> 01:12:26.680] Clear due process violation, in Texas they call it due course of law [01:12:26.680 --> 01:12:28.680] But the terms are interchangeable [01:12:28.680 --> 01:12:33.680] In Texas they call it due process, in Texas they call it due course [01:12:33.680 --> 01:12:44.680] Under Heath Boyd, an arrest without a warrant is considered on its face to be unreasonable [01:12:44.680 --> 01:12:46.680] As a matter of law [01:12:46.680 --> 01:12:52.680] So the onus is on the police to show cause for the arrest [01:12:52.680 --> 01:12:58.680] To take me to a neutral magistrate and show cause [01:12:58.680 --> 01:13:01.680] They didn't do it [01:13:01.680 --> 01:13:05.680] And I insisted that they do it [01:13:05.680 --> 01:13:10.680] This time when they brought me in, even on a warrant they're required to do it [01:13:10.680 --> 01:13:14.680] 15-14 I believe it is [01:13:14.680 --> 01:13:21.680] So they bring me in and there's this guy in the jail with muscles and places where I don't have places [01:13:21.680 --> 01:13:28.680] And I told him you are to take me directly to the nearest magistrate [01:13:28.680 --> 01:13:32.680] And he kind of tensed up like he was going to have trouble [01:13:32.680 --> 01:13:35.680] No I have to book you in, I said I understand that [01:13:35.680 --> 01:13:38.680] But I have to ask this question [01:13:38.680 --> 01:13:41.680] I have to make this request [01:13:41.680 --> 01:13:44.680] He said well there's a magistrate in the building, you'll get to see one [01:13:44.680 --> 01:13:46.680] Well take me to see the magistrate right now [01:13:46.680 --> 01:13:48.680] I told you I have to do this [01:13:48.680 --> 01:13:54.680] I said I know but I also told you I have to make the request and you have to say no [01:13:54.680 --> 01:13:56.680] He said you want me to say no? [01:13:56.680 --> 01:13:59.680] No, no I can't say that [01:13:59.680 --> 01:14:03.680] I can only say I need you to take me to the magistrate [01:14:03.680 --> 01:14:11.680] And clearly by now he's got over being concerned with trouble and he's intrigued [01:14:11.680 --> 01:14:15.680] He said what's going on here? [01:14:15.680 --> 01:14:19.680] I said I'm just covering all the bases [01:14:19.680 --> 01:14:22.680] You're supposed to take me directly to the nearest magistrate [01:14:22.680 --> 01:14:26.680] But if I don't demand it then I can't complain about it later [01:14:26.680 --> 01:14:29.680] He said you're going to complain about me? [01:14:29.680 --> 01:14:32.680] Well yeah but only a little bit [01:14:32.680 --> 01:14:36.680] Oh well okay as long as it's only a little bit [01:14:36.680 --> 01:14:38.680] I do have to give them credit [01:14:38.680 --> 01:14:47.680] The jailers in Travis County were on the hold the least obnoxious of any jails I've ever come across [01:14:47.680 --> 01:14:52.680] And for that matter, Williamson County, when I was arrested in Williamson County [01:14:52.680 --> 01:14:57.680] The jailers were absolutely fine [01:14:57.680 --> 01:15:02.680] They were for the most part polite, they were demanding [01:15:02.680 --> 01:15:06.680] You know they wanted you to do what they said they wanted you to do [01:15:06.680 --> 01:15:09.680] But as long as you didn't give them a bunch of crapola [01:15:09.680 --> 01:15:14.680] They were just as pleasant as you could expect them to be [01:15:14.680 --> 01:15:19.680] I was frankly surprised and pleased [01:15:19.680 --> 01:15:27.680] But as I watched Williamson County it became clear that that was part of the routine [01:15:27.680 --> 01:15:30.680] If you are subservient [01:15:30.680 --> 01:15:37.680] And you do exactly what you're told when you're told how you're told without question [01:15:37.680 --> 01:15:41.680] They will treat you great, they'll be your buddies [01:15:41.680 --> 01:15:45.680] But just object in the slightest [01:15:45.680 --> 01:15:50.680] And they get real aggressive, real fast [01:15:50.680 --> 01:15:58.680] That's operant conditioning, they're training you to be a good little subservient sheeple [01:15:58.680 --> 01:16:03.680] See how nice we treat you when you kiss our behinds [01:16:03.680 --> 01:16:08.680] See how bad we treat you when you don't [01:16:08.680 --> 01:16:13.680] Anyway, back to our original question of impersonal jurisdiction and subject matter jurisdiction [01:16:13.680 --> 01:16:18.680] Subject matter goes to most every due process right [01:16:18.680 --> 01:16:23.680] So I have about 20 of them as a matter of course [01:16:23.680 --> 01:16:29.680] So in going for subject matter jurisdiction I've got a lot of things I can deal with [01:16:29.680 --> 01:16:33.680] And really wear the court down [01:16:33.680 --> 01:16:38.680] So I'm going to get an opportunity to test my skills Monday [01:16:38.680 --> 01:16:43.680] And I'd like as many people down there as I can possibly get [01:16:43.680 --> 01:16:46.680] That always intimidates the judge [01:16:46.680 --> 01:16:50.680] And it's best if everybody's in real nice clothes [01:16:50.680 --> 01:16:53.680] Alright, yes, real nice clothes [01:16:53.680 --> 01:16:58.680] When we get back, tell us where [01:16:58.680 --> 01:17:03.680] Are you looking for an investment that has no stock market risk? [01:17:11.680 --> 01:17:14.680] Is publicly traded and SEC regulated? [01:18:49.680 --> 01:18:50.680] Where's the courthouse? [01:18:50.680 --> 01:18:52.680] Tell everyone so that everyone can go down [01:18:52.680 --> 01:18:53.680] And what is the time? [01:18:53.680 --> 01:18:57.680] It's the one on 11th and Guadalupe [01:18:57.680 --> 01:18:59.680] Is it Guadalupe? [01:18:59.680 --> 01:19:00.680] Yeah, Guadalupe [01:19:00.680 --> 01:19:02.680] Yes, or 10th at Guadalupe? [01:19:02.680 --> 01:19:03.680] 10th and Guadalupe [01:19:03.680 --> 01:19:07.680] Is it the district courthouse or the county one? [01:19:07.680 --> 01:19:09.680] I don't know which one it'll be in [01:19:09.680 --> 01:19:11.680] They kind of switch back and forth [01:19:11.680 --> 01:19:14.680] I'll find out tomorrow when I go down there [01:19:14.680 --> 01:19:16.680] Okay [01:19:16.680 --> 01:19:18.680] I'll head down there early in the morning [01:19:18.680 --> 01:19:20.680] They're both right next to each other [01:19:20.680 --> 01:19:23.680] And there's one particular jailer who had an attitude [01:19:23.680 --> 01:19:27.680] And I'm going to go down and try to give him an attitude adjustment [01:19:27.680 --> 01:19:33.680] I'm going to tear a little of his attitude off [01:19:33.680 --> 01:19:37.680] Okay, so Randy, you were talking about subject matter jurisdiction [01:19:37.680 --> 01:19:39.680] Yes, I think we've kind of beat that up [01:19:39.680 --> 01:19:41.680] You guys have any questions, Randy? [01:19:41.680 --> 01:19:43.680] No, I just wanted to cover that one [01:19:43.680 --> 01:19:45.680] Because I wanted to understand the difference there [01:19:45.680 --> 01:19:47.680] And see if there was, you know [01:19:47.680 --> 01:19:49.680] You had talked about Joe Edwards [01:19:49.680 --> 01:19:52.680] And I was thinking along the lines that that would be an impersonal thing [01:19:52.680 --> 01:19:54.680] If you can keep them at bay [01:19:54.680 --> 01:19:57.680] That absolutely is [01:19:57.680 --> 01:20:00.680] And it's an arcane argument [01:20:00.680 --> 01:20:07.680] That I would very much like to be able to conduct myself [01:20:07.680 --> 01:20:13.680] With the kind of efficiency that Joe Edwards did [01:20:13.680 --> 01:20:20.680] But I'm not familiar enough with the issues that he's dealing with yet [01:20:20.680 --> 01:20:22.680] To be able to do that [01:20:22.680 --> 01:20:24.680] And I very much want to [01:20:24.680 --> 01:20:29.680] Because the more ways I can tie up and trip the judge, the better [01:20:29.680 --> 01:20:34.680] They will find out pretty quick that I'm coming after them [01:20:34.680 --> 01:20:39.680] A lot of you folks have heard Gail from Minnesota [01:20:39.680 --> 01:20:47.680] Well, she just filed 15 bar grievances against her husband's attorney [01:20:47.680 --> 01:20:50.680] And she filed a motion in the court [01:20:50.680 --> 01:20:57.680] To command her husband to release information she needed [01:20:57.680 --> 01:21:04.680] To perform an audit on his business that they'd been holding up for two years [01:21:04.680 --> 01:21:07.680] She sends in the bar grievances and the motion to the court [01:21:07.680 --> 01:21:13.680] And two days later she gets an answer to the motion [01:21:13.680 --> 01:21:17.680] Saying, I'll have, we will have this discovery this day [01:21:17.680 --> 01:21:21.680] This discovery this day, this discovery this day [01:21:21.680 --> 01:21:25.680] I think she got their attention [01:21:25.680 --> 01:21:29.680] So that's 15 bar grievances and she's got more [01:21:29.680 --> 01:21:32.680] This law firm is history [01:21:32.680 --> 01:21:35.680] And that's what I'm going to do [01:21:35.680 --> 01:21:40.680] I'm going to do it here to show, to demonstrate it can be done [01:21:40.680 --> 01:21:42.680] And it's going to be a hoot [01:21:42.680 --> 01:21:45.680] Randy, we need to move along, we've got a couple more calls [01:21:45.680 --> 01:21:48.680] This is George in Texas, thank you Randy, thanks for calling in [01:21:48.680 --> 01:21:52.680] We don't get to George, he'll run over us with his truck [01:21:52.680 --> 01:21:56.680] Okay George, thank you for calling in, what's on your mind tonight? [01:21:56.680 --> 01:22:00.680] Yes, I'd like to know, you heard about that guy being held in South Bend [01:22:00.680 --> 01:22:06.680] A 60 year old homeschooler being held in South Bend, Indiana over the Patriot Act, right? [01:22:06.680 --> 01:22:07.680] Yes [01:22:07.680 --> 01:22:14.680] I'd like to know, we file a habeas corpus anywhere in the country asking for him to [01:22:14.680 --> 01:22:17.680] It's different in every jurisdiction [01:22:17.680 --> 01:22:23.680] But the problem is he's being held as an enemy combatant [01:22:23.680 --> 01:22:26.680] What I got from the story was [01:22:26.680 --> 01:22:32.680] Is that someone stole this kid's identity [01:22:32.680 --> 01:22:35.680] And did these things in his name [01:22:35.680 --> 01:22:37.680] Is this a US citizen? [01:22:37.680 --> 01:22:41.680] Yes, 16 year old boy [01:22:41.680 --> 01:22:42.680] Oh boy [01:22:42.680 --> 01:22:47.680] They come to storm in his house, you know, you're a standard storm trooper [01:22:47.680 --> 01:22:52.680] Terrify everybody, be sure you're terrified of me stuff [01:22:52.680 --> 01:22:56.680] And drug this kid off, he's been held a couple of months [01:22:56.680 --> 01:22:57.680] With no trial [01:22:57.680 --> 01:23:02.680] And unfortunately it's never been adjudicated because of the Padilla case [01:23:02.680 --> 01:23:04.680] Same thing, he was a citizen [01:23:04.680 --> 01:23:08.680] And what happened was, and he appealed it all the way to the Supreme Court [01:23:08.680 --> 01:23:12.680] And then the feds dropped the case [01:23:12.680 --> 01:23:15.680] So that the Supreme Court could never make a ruling on it [01:23:15.680 --> 01:23:17.680] So there's no precedent [01:23:17.680 --> 01:23:19.680] Now they're doing it again [01:23:19.680 --> 01:23:25.680] This time they may have a way of sabotaging themselves [01:23:25.680 --> 01:23:27.680] Well good [01:23:27.680 --> 01:23:33.680] This time a 16 year old, all American kid [01:23:33.680 --> 01:23:37.680] No issues of any kind [01:23:37.680 --> 01:23:39.680] In the heartland [01:23:39.680 --> 01:23:43.680] And these guys come in with guns in hand, storm in and drag him off [01:23:43.680 --> 01:23:47.680] They may have crapped in their milk this time [01:23:47.680 --> 01:23:52.680] This is one that everybody in America will look at and say [01:23:52.680 --> 01:23:54.680] Holy mackerel [01:23:54.680 --> 01:23:57.680] Well they can't help but sabotage themselves Randy [01:23:57.680 --> 01:24:00.680] Because what they're doing is illegal [01:24:00.680 --> 01:24:03.680] You're never smart about it [01:24:03.680 --> 01:24:09.680] The odd thing is they always seem to have to sabotage themselves [01:24:09.680 --> 01:24:13.680] That's because they know deep in their heart they're wrong, that's why [01:24:13.680 --> 01:24:18.680] When I was in Vietnam, the spooks [01:24:18.680 --> 01:24:21.680] You know they come strutting in, they're big and bad [01:24:21.680 --> 01:24:23.680] And they can do anything they want to [01:24:23.680 --> 01:24:26.680] And everybody has to listen to us [01:24:26.680 --> 01:24:30.680] And they always screwed it up [01:24:30.680 --> 01:24:32.680] It was nuts [01:24:32.680 --> 01:24:34.680] They never did anything right [01:24:34.680 --> 01:24:38.680] It's like they went out of their way to screw it up [01:24:38.680 --> 01:24:44.680] And if there's a good side to all of this bad things that's going on [01:24:44.680 --> 01:24:50.680] It's kind of in human nature to press the edge of the envelope [01:24:50.680 --> 01:24:52.680] We give them an inch, they take a mile [01:24:52.680 --> 01:24:56.680] And they always have to take a mile and a quarter [01:24:56.680 --> 01:25:00.680] They just cannot help themselves [01:25:00.680 --> 01:25:02.680] And they screw themselves [01:25:02.680 --> 01:25:08.680] Now they've pulled one off here that will scare everyone in America [01:25:08.680 --> 01:25:13.680] Every parent in America with a teenage son who has access to the internet [01:25:13.680 --> 01:25:16.680] Is subject to the same thing [01:25:16.680 --> 01:25:20.680] Some unscrupulous person could steal his identity [01:25:20.680 --> 01:25:23.680] Do these things in his name [01:25:23.680 --> 01:25:27.680] And the police simply don't care [01:25:27.680 --> 01:25:30.680] It's easier to go after the 16 year old [01:25:30.680 --> 01:25:38.680] Than go after the one who is sophisticated and knows how to hide behind children [01:25:38.680 --> 01:25:41.680] This one may be enough to get a lot of... [01:25:41.680 --> 01:25:47.680] This will move the public away from the Patriot Act [01:25:47.680 --> 01:25:52.680] So it's unfortunate this has happened to this child [01:25:52.680 --> 01:26:00.680] But it may be for our resistance to these draconian laws [01:26:00.680 --> 01:26:03.680] It may be of great assistance [01:26:03.680 --> 01:26:09.680] Well Randy, do you think that if there is sufficient mainstream public opposition [01:26:09.680 --> 01:26:15.680] That somehow that would pressure the court system to overturn it? [01:26:15.680 --> 01:26:19.680] I think what it's going to do is pressure the politicians [01:26:19.680 --> 01:26:21.680] To repeal it? [01:26:21.680 --> 01:26:25.680] Because when you start messing with the children [01:26:25.680 --> 01:26:27.680] You've got a problem [01:26:27.680 --> 01:26:31.680] But now we have the feds coming storming in like storm troopers [01:26:31.680 --> 01:26:33.680] To arrest a 16 year old boy [01:26:33.680 --> 01:26:37.680] You think it's a better route or that it would be easier [01:26:37.680 --> 01:26:42.680] To try to press for Congress to repeal it than to get it overturned in court? [01:26:42.680 --> 01:26:44.680] It would be better to get it overturned in court [01:26:44.680 --> 01:26:46.680] But which way would be easier? [01:26:46.680 --> 01:26:50.680] Which way would have better results? [01:26:50.680 --> 01:26:56.680] I don't see the Patriot Act itself getting turned over [01:26:56.680 --> 01:27:01.680] What I would see in court was these officers being admonished [01:27:01.680 --> 01:27:07.680] Or sued personally for their improper actions [01:27:07.680 --> 01:27:11.680] Why don't you see the Patriot Act being overturned in court? [01:27:11.680 --> 01:27:15.680] There's not enough to overturn the entire Patriot Act [01:27:15.680 --> 01:27:18.680] They may adjust some minor provision [01:27:18.680 --> 01:27:21.680] And that's what the courts tend to do [01:27:21.680 --> 01:27:25.680] And since it's like however many thousand pages long? [01:27:25.680 --> 01:27:27.680] Yeah, we've got all these different things [01:27:27.680 --> 01:27:29.680] Adjustment, adjustment, adjustment, adjustment [01:27:29.680 --> 01:27:31.680] Until hell freezes over they can be adjusted [01:27:31.680 --> 01:27:33.680] I see, I see [01:27:33.680 --> 01:27:36.680] More likely that the public is going to look at this [01:27:36.680 --> 01:27:38.680] And start telling their congressman [01:27:38.680 --> 01:27:41.680] You voted for this [01:27:41.680 --> 01:27:43.680] You are history [01:27:43.680 --> 01:27:46.680] You did this to our children you scumbag [01:27:46.680 --> 01:27:50.680] And when the politicians begin to feel that heat [01:27:50.680 --> 01:27:54.680] Then they'll start moving in another direction [01:27:54.680 --> 01:27:56.680] Julio called me last night [01:27:56.680 --> 01:28:03.680] He was at the hearing on this bill for DWI checkpoints [01:28:03.680 --> 01:28:05.680] Yeah, and? [01:28:05.680 --> 01:28:07.680] And nailed them good [01:28:07.680 --> 01:28:09.680] They said there's going to have to be more hearings [01:28:09.680 --> 01:28:15.680] Julio got up there and told about a guy in Laredo [01:28:15.680 --> 01:28:17.680] The police pull him over [01:28:17.680 --> 01:28:20.680] Take him out of the car, smell alcohol [01:28:20.680 --> 01:28:23.680] Beat the crap out of him [01:28:23.680 --> 01:28:27.680] Take him to the hospital because they beat him up so bad [01:28:27.680 --> 01:28:32.680] They get there and he's in a diabetic coma [01:28:32.680 --> 01:28:36.680] He had not drank a drop of alcohol [01:28:36.680 --> 01:28:39.680] It was the diabetes that created the alcohol [01:28:39.680 --> 01:28:41.680] And the drunk like symptoms [01:28:41.680 --> 01:28:44.680] Oh wow, that's what Greg Chavan was talking about [01:28:44.680 --> 01:28:50.680] And Julio in Travis County had the same thing happen to him [01:28:50.680 --> 01:28:53.680] He had no memory until three days later [01:28:53.680 --> 01:28:56.680] They arrested him, threw him in jail [01:28:56.680 --> 01:29:01.680] Finally took him to the hospital, he nearly died from a diabetic coma [01:29:01.680 --> 01:29:03.680] And he told these guys [01:29:03.680 --> 01:29:06.680] This is like Nazi Germany [01:29:06.680 --> 01:29:11.680] He said when he said that the whole place went dead silent [01:29:11.680 --> 01:29:15.680] And then he said any questions? [01:29:15.680 --> 01:29:18.680] Dead silence [01:29:18.680 --> 01:29:21.680] So apparently they did real well last night [01:29:21.680 --> 01:29:23.680] It wasn't until one o'clock until they got before the committee [01:29:23.680 --> 01:29:25.680] Oh my goodness [01:29:25.680 --> 01:29:27.680] But they nailed them [01:29:27.680 --> 01:29:29.680] See, that's what they do [01:29:29.680 --> 01:29:35.680] They drag these hearings, the schedule of the hearings on and on and on [01:29:35.680 --> 01:29:37.680] They say it's two o'clock in the afternoon [01:29:37.680 --> 01:29:39.680] And they make people wait until one o'clock in the morning [01:29:39.680 --> 01:29:43.680] Because that's how they're trying to keep us from having a voice in our government [01:29:43.680 --> 01:29:45.680] But we can submit the written testimony too [01:29:45.680 --> 01:29:47.680] But that's great, they hung in there [01:29:47.680 --> 01:29:50.680] Good, we gotta beat it, we gotta beat it [01:29:50.680 --> 01:29:52.680] Okay, we're going to break and we've got more callers on the line [01:29:52.680 --> 01:29:54.680] We'll be right back [01:29:59.680 --> 01:30:02.680] And with the recent pullback, this is a great time to buy [01:30:02.680 --> 01:30:06.680] With the value of the dollar, risks of inflation, geopolitical uncertainties [01:30:06.680 --> 01:30:11.680] And instability in world financial systems, I see gold going up much higher [01:30:11.680 --> 01:30:14.680] Hi, I'm Tim Fry at Roberts and Roberts Brokerage [01:30:14.680 --> 01:30:18.680] Everybody should have some of their assets in investment grade precious metals [01:30:18.680 --> 01:30:22.680] At Roberts and Roberts Brokerage, you can buy gold, silver and platinum with confidence [01:30:22.680 --> 01:30:27.680] From a brokerage that specialized in the precious metals market since 1977 [01:30:27.680 --> 01:30:31.680] If you are new to precious metals, we will happily provide you with the information you need [01:30:31.680 --> 01:30:35.680] To make an informed decision, whether or not you choose to purchase from us [01:30:35.680 --> 01:30:38.680] Also, Roberts and Roberts Brokerage values your privacy [01:30:38.680 --> 01:30:42.680] And will always advise you in the event that we would be required to report any transaction [01:30:42.680 --> 01:30:47.680] If you have gold, silver or platinum you'd like to sell, we can convert it for immediate payment [01:30:47.680 --> 01:30:51.680] Call us at 800-874-9760 [01:30:51.680 --> 01:30:53.680] We're Roberts and Roberts Brokerage [01:30:53.680 --> 01:31:08.680] 800-874-9760 [01:31:23.680 --> 01:31:25.680] We're Roberts Brokerage [01:31:25.680 --> 01:31:34.680] 800-874-9760 [01:31:34.680 --> 01:31:36.680] We're Roberts Brokerage [01:31:36.680 --> 01:31:46.680] 800-874-9760 [01:31:46.680 --> 01:32:13.680] We're Roberts Brokerage [01:32:13.680 --> 01:32:16.680] School of Law Radio [01:32:16.680 --> 01:32:19.680] Randy Kelton and Deborah Stevens [01:32:19.680 --> 01:32:22.680] We're taking your calls [01:32:22.680 --> 01:32:26.680] We've got a first-time caller here, Miriam from New York [01:32:26.680 --> 01:32:30.680] Also, Mark from Wisconsin was calling in concerning an issue in New York [01:32:30.680 --> 01:32:33.680] Let's go to Miriam and Dan, we'll get right to you [01:32:33.680 --> 01:32:36.680] Hey Miriam, thank you for calling in, what's on your mind tonight? [01:32:36.680 --> 01:32:39.680] Hi there, I've been listening to your show, I think you have a great show [01:32:39.680 --> 01:32:40.680] Thank you [01:32:40.680 --> 01:32:43.680] And I just have two questions [01:32:43.680 --> 01:32:50.680] Randy cited some penal codes that invoke the power of the judge and the prosecutor [01:32:50.680 --> 01:32:54.680] Earlier, I just wanted to know if he could give those sites again [01:32:54.680 --> 01:32:55.680] Yes [01:32:55.680 --> 01:33:02.680] If you could just briefly go over the primary steps in filing a criminal report when one wants to get to a grand jury [01:33:02.680 --> 01:33:04.680] Thank you [01:33:04.680 --> 01:33:12.680] Okay, I have looked at grand juries in New York and apparently just a few years ago [01:33:12.680 --> 01:33:18.680] the legislature reworked the grand jury to make it more effective [01:33:18.680 --> 01:33:23.680] Now, the statutes I'm quoting are Texas statutes [01:33:23.680 --> 01:33:35.680] However, most all of the states have similar statutes because the statutes must reflect the federal requirements [01:33:35.680 --> 01:33:43.680] So they'll be real close, but there are a few statutes that one state will have and the other won't have [01:33:43.680 --> 01:33:54.680] In Texas, if you want to file a criminal complaint, as in most states, you prepare a criminal affidavit [01:33:54.680 --> 01:34:03.680] and there will be a specific form that the criminal affidavit is in and it varies by state [01:34:03.680 --> 01:34:11.680] It's real easy to find it, if you just go down to the clerk of the court and ask to see a criminal file [01:34:11.680 --> 01:34:15.680] Down there, you should find a criminal complaint [01:34:15.680 --> 01:34:20.680] And like in Texas, it must always run in the name of the state of Texas [01:34:20.680 --> 01:34:31.680] So it says in the name of the state of Texas, I, Randall D. Kelton, have reason to believe and do believe [01:34:31.680 --> 01:34:36.680] This is language that's pretty well stipulated [01:34:36.680 --> 01:34:42.680] The complaint, it'll have a heading and it'll have an ending and then there'll be a middle section where you put the details [01:34:42.680 --> 01:34:49.680] So you say, you know, I'm whoever I am and I have reason to believe and do believe based on the following [01:34:49.680 --> 01:34:53.680] And then you state the facts [01:34:53.680 --> 01:34:58.680] When you state the facts, state only the facts with no argument [01:34:58.680 --> 01:35:06.680] With no terms implying your distaste or your irritation or anything like that [01:35:06.680 --> 01:35:08.680] Just the facts, ma'am [01:35:08.680 --> 01:35:10.680] State the facts clearly and succinctly [01:35:10.680 --> 01:35:13.680] This is precisely what happened [01:35:13.680 --> 01:35:18.680] And then after you've stated the facts, then you state [01:35:18.680 --> 01:35:24.680] Therefore, I allege that this person committed this criminal act [01:35:24.680 --> 01:35:29.680] I generally go after public officials so I accuse them of violating a law relating to their office [01:35:29.680 --> 01:35:36.680] I maintain, you know, I tell the facts and I maintain that this act is a violation of [01:35:36.680 --> 01:35:45.680] 1.24 Code of Criminal Procedure, which is a law relating to the official's office [01:35:45.680 --> 01:35:50.680] And when an official violates a law relating to his office, he commits a criminal act [01:35:50.680 --> 01:35:54.680] Then I'll say, and therefore honor before this certain date [01:35:54.680 --> 01:35:58.680] And generally honor before is important [01:35:58.680 --> 01:36:06.680] Because the one thing on criminal complaints that was deadly, that couldn't be fixed [01:36:06.680 --> 01:36:13.680] Was if you accuse somebody of committing a crime before they committed it [01:36:13.680 --> 01:36:21.680] If you screw up on the date so that you accuse them today of committing a crime tomorrow [01:36:21.680 --> 01:36:25.680] Can't be fixed, has to be thrown out and started over again [01:36:25.680 --> 01:36:31.680] Almost anything else in a criminal complaint can be fixed if they don't like it [01:36:31.680 --> 01:36:34.680] But be careful you get the date right [01:36:34.680 --> 01:36:40.680] Honor before the date and generally that'll be the date that you're filing the complaint [01:36:40.680 --> 01:36:46.680] This individual, name the individual, committed the violation of this statute [01:36:46.680 --> 01:36:49.680] And I always put a statute [01:36:49.680 --> 01:36:56.680] And don't say he was speeding or he committed assault or robbery [01:36:56.680 --> 01:36:59.680] Put the statute that you're citing [01:36:59.680 --> 01:37:02.680] That way there's no question about the sufficiency of the complaint [01:37:02.680 --> 01:37:05.680] And then once you got that written up [01:37:05.680 --> 01:37:09.680] Take it to a notary and have it notarized [01:37:09.680 --> 01:37:12.680] In law this is called verification [01:37:12.680 --> 01:37:19.680] Once it's notarized that becomes a verified criminal affidavit [01:37:19.680 --> 01:37:24.680] That's different than going to the police and complaining to them [01:37:24.680 --> 01:37:27.680] That invokes no duty on the police [01:37:27.680 --> 01:37:34.680] It only gives them notice that a crime might have been committed and they can go and investigate [01:37:34.680 --> 01:37:39.680] When you as a citizen, as a sovereign citizen [01:37:39.680 --> 01:37:46.680] Place in the hand of a police officer a verified criminal affidavit [01:37:46.680 --> 01:37:51.680] Now he has made known officially that a crime has been committed [01:37:51.680 --> 01:37:54.680] It bypasses his discretion [01:37:54.680 --> 01:38:01.680] Now with that said I normally don't give criminal complaints to police officers [01:38:01.680 --> 01:38:05.680] I tend to give them to magistrates [01:38:05.680 --> 01:38:10.680] Generally the lowest level judges will be the ones who take criminal complaints [01:38:10.680 --> 01:38:12.680] And they're going to object [01:38:12.680 --> 01:38:18.680] Because they tend to only get criminal complaints from police officers [01:38:18.680 --> 01:38:23.680] And this is new to them although this is very well established in laws [01:38:23.680 --> 01:38:27.680] This is how it's supposed to be done [01:38:27.680 --> 01:38:33.680] In most every state except for the common law states [01:38:33.680 --> 01:38:37.680] I mean for the commonwealths [01:38:37.680 --> 01:38:45.680] In the commonwealth you have to be personally injured by the crime in order to file the complaint [01:38:45.680 --> 01:38:49.680] In the Spanish law states like most everything else [01:38:49.680 --> 01:38:53.680] Any person who has knowledge that a crime has been committed not only has the right [01:38:53.680 --> 01:38:57.680] But the duty to file a criminal complaint [01:38:57.680 --> 01:39:02.680] Not go down complaining to the police but to file a verified criminal affidavit [01:39:02.680 --> 01:39:07.680] So you file it with the magistrate or you can file it with a prosecuting attorney [01:39:07.680 --> 01:39:13.680] Or you can send it directly to the grand jury [01:39:13.680 --> 01:39:19.680] It will depend on your state and we're kind of running out of time [01:39:19.680 --> 01:39:25.680] If you would call back tomorrow Miriam we can talk about this in more detail [01:39:25.680 --> 01:39:29.680] This is really a kind of a somewhat complex subject [01:39:29.680 --> 01:39:32.680] It's really pretty simple to file criminal complaints [01:39:32.680 --> 01:39:38.680] But it helps if you understand all the issues around it when you go to do it [01:39:38.680 --> 01:39:45.680] So that you kind of can anticipate what these people are going to do and you'll know how to deal with it [01:39:45.680 --> 01:39:49.680] So if you'll call back tomorrow night we'll do a four hour show [01:39:49.680 --> 01:39:52.680] I would love to go through this in detail [01:39:52.680 --> 01:39:54.680] Oh wonderful thank you [01:39:54.680 --> 01:39:55.680] Okay [01:39:55.680 --> 01:39:56.680] Thank you Miriam [01:39:56.680 --> 01:39:57.680] Thank you [01:39:57.680 --> 01:40:03.680] Okay we're going to go now to Dan in Connecticut because he's been waiting quite a while [01:40:03.680 --> 01:40:07.680] And then we'll go to Mark in Wisconsin one of our affiliates [01:40:07.680 --> 01:40:10.680] Is Dan for real? [01:40:10.680 --> 01:40:13.680] Dan [01:40:13.680 --> 01:40:15.680] How are you Dan? [01:40:15.680 --> 01:40:20.680] I'm pretty good just wondering if you sent my Bank of America email yet [01:40:20.680 --> 01:40:23.680] No I haven't seen an email from you in a while [01:40:23.680 --> 01:40:26.680] Really I sent you gold [01:40:26.680 --> 01:40:33.680] It involves Henry Paulson Federal Reserve Chairman Ben Bernanke [01:40:33.680 --> 01:40:39.680] Willful conspiracy to withhold information from shareholders in the SEC [01:40:39.680 --> 01:40:44.680] And threats pretty much replaced the board of directors [01:40:44.680 --> 01:40:45.680] Interesting [01:40:45.680 --> 01:40:48.680] Yeah did I get you yet? [01:40:48.680 --> 01:40:50.680] I'm looking [01:40:50.680 --> 01:40:55.680] Basically this arose from, by the way this is sworn testimony that I saw [01:40:55.680 --> 01:41:01.680] It wasn't just some guy getting online and saying yeah yeah yeah they told me to do this and whatever [01:41:01.680 --> 01:41:06.680] I don't see you are you homestead in credit restoration? [01:41:06.680 --> 01:41:07.680] No no [01:41:07.680 --> 01:41:11.680] Then you're not in here I don't see you at all [01:41:11.680 --> 01:41:18.680] Well basically I sent you a link to documents that were posted by the New York State Attorney General's office [01:41:18.680 --> 01:41:24.680] And they were conducting one of those politically correct investigations into executive compensation [01:41:24.680 --> 01:41:31.680] And it turns out the guy's last name is Lewis he was CEO of Bank of America [01:41:31.680 --> 01:41:34.680] Kind of spilled the beans on something related to the bailout [01:41:34.680 --> 01:41:42.680] And it turns out if they didn't buy Merrill Lynch Ben Bernanke and Hank Paulson were threatening to remove the board of directors [01:41:42.680 --> 01:41:50.680] And there was actually an email that the New York State Attorney General got that was circulated between the board of directors [01:41:50.680 --> 01:41:56.680] Saying we better do this or they're going to remove us and you know of course they were kind of concerned about you know [01:41:56.680 --> 01:41:58.680] Can you give us any guarantees about funding? [01:41:58.680 --> 01:42:07.680] And Hank Paulson more or less said we can't put anything in writing because then you have to disclose it to the Securities and Exchanges Commission [01:42:07.680 --> 01:42:13.680] And it turns out that Lewis had called Ben Bernanke [01:42:13.680 --> 01:42:18.680] Ben Bernanke had Hank Paulson send an email and say no can't put anything in writing [01:42:18.680 --> 01:42:22.680] But there's 44 pages of sworn testimony [01:42:22.680 --> 01:42:33.680] And it's just I don't know if I was looking for some reason to file a criminal complaint they pretty much just handed it to me [01:42:33.680 --> 01:42:39.680] So I don't know if I ended up in your junk folder but you know you might want to check again and if not shoot me an email I'll send it back to you [01:42:39.680 --> 01:42:44.680] Yeah send it back I'm looking through my email I don't see anything from you [01:42:44.680 --> 01:42:50.680] Yeah another issue I told have you ever heard of the Ridley Report before? [01:42:50.680 --> 01:42:52.680] No [01:42:52.680 --> 01:42:57.680] Guy named Dave Ridley he does a lot of video up in New Hampshire he's part of the Free State Project [01:42:57.680 --> 01:43:06.680] I dropped your name to him because he was arrested of all things for bringing a video camera into a courtroom proceeding [01:43:06.680 --> 01:43:08.680] Are you talking about Sam Donaldson? [01:43:08.680 --> 01:43:16.680] No I'm talking about Dave Ridley different guy this happened to he was also arrested for it [01:43:16.680 --> 01:43:29.680] I just went to Hayes County today and they wouldn't let me take my camera into the courthouse because it had a camera capability on it [01:43:29.680 --> 01:43:37.680] So I got the court rules and I'll be filing against the district judge for denying my first amendment [01:43:37.680 --> 01:43:47.680] First time I've ever been actually denied a camera so it was the first time I got standing [01:43:47.680 --> 01:43:55.680] Okay well I'll tell you what I'll try to send that link to you from a different address so hopefully you get it [01:43:55.680 --> 01:44:00.680] Good good I'd like to see that because that's an issue I want to take on [01:44:00.680 --> 01:44:11.680] I bushwhacked a federal magistrate in Fort Lauderdale over this issue and I would very much like to get that before the court [01:44:11.680 --> 01:44:18.680] The guy that I'm thinking of he's up in New Hampshire and they arrested a whole series of people on that [01:44:18.680 --> 01:44:23.680] He just kind of followed along with them [01:44:23.680 --> 01:44:28.680] It would be good to file criminal charges against the judge [01:44:28.680 --> 01:44:35.680] Yeah that's what I told him to do when I found out about it because I know this guy has been doing a lot of videos [01:44:35.680 --> 01:44:44.680] I know up there Open Carry has been an issue it's completely legal in New Hampshire but they're still arresting people for it [01:44:44.680 --> 01:44:53.680] But yeah I'll let you get to your callers but I will send that link concerning the Bank of America stuff from a different email address [01:44:53.680 --> 01:44:58.680] If you don't get it in Dairstow send me an email [01:44:58.680 --> 01:44:59.680] Okay [01:44:59.680 --> 01:45:01.680] Alright thank you Dan [01:45:01.680 --> 01:45:03.680] No not a problem have a good show [01:45:03.680 --> 01:45:06.680] Alright you too [01:45:06.680 --> 01:45:11.680] Okay we are going to go now to our affiliate in Madison this is Mark [01:45:11.680 --> 01:45:16.680] Hey Mark thanks for calling in and thanks for broadcasting us up in Madison Wisconsin [01:45:16.680 --> 01:45:23.680] No problem glad to do it Hey about this 16 year old who was arrested under the Patriot Act [01:45:23.680 --> 01:45:27.680] I just started listening so I just cut the tail end of what you were talking about [01:45:27.680 --> 01:45:33.680] But do you guys know what's going on with that I mean it seems to me we really have to do something about this [01:45:33.680 --> 01:45:39.680] Because what happens with that is you face a military tribunal they completely skip the judicial system altogether [01:45:39.680 --> 01:45:40.680] Yes [01:45:40.680 --> 01:45:43.680] The judicial system is not bad enough at this point [01:45:43.680 --> 01:45:52.680] What I'd like to do Randy is if you can figure out some strategy to go down there and start busting some heads I'll fly over there and do it [01:45:52.680 --> 01:45:59.680] And I'm going to get as much information as I can get on the story is he still in custody [01:45:59.680 --> 01:46:02.680] As far as I know he still is [01:46:02.680 --> 01:46:09.680] Okay well I'm going to get all the information that I can phone numbers to the sheriff and whoever else was involved with this arrest [01:46:09.680 --> 01:46:15.680] And I'm going to call every Patriot station I can for the next three days and I'm going to get those numbers to them [01:46:15.680 --> 01:46:25.680] But if you guys can figure out any sort of plan of a legal attack where I can let them know that this is not acceptable [01:46:25.680 --> 01:46:31.680] And we're not just going to let them get by because I really believe that we really slept through the Jose Padilla case [01:46:31.680 --> 01:46:43.680] He was an American arrested under the same type of act and he was put on a barge, a federal barge, prison barge for years before he even went to court [01:46:43.680 --> 01:46:48.680] Well the thing we don't want to happen is this kid to be held for years [01:46:48.680 --> 01:47:05.680] The thing that I am concerned about and I know this may strike some folks wrong is we only have the mother's words saying that this kid didn't perpetrate [01:47:05.680 --> 01:47:14.680] They're saying like a great number of bomb threats and other similar type of hoaxes [01:47:14.680 --> 01:47:21.680] And now knowing 16 year olds you know they do sometimes do really stupid stuff [01:47:21.680 --> 01:47:29.680] It's puberty, it causes brain damage and they're saying that someone else stole his identity [01:47:29.680 --> 01:47:38.680] Before we jump too far I sure would like to get a little more information [01:47:38.680 --> 01:47:44.680] Well here's where I stand Randy, I don't care if he had a bomb sitting in his garage [01:47:44.680 --> 01:47:47.680] I look at this as a beta test by the federal government [01:47:47.680 --> 01:47:55.680] They're testing to see if they can snatch people from our homes without a judge or a jury being involved [01:47:55.680 --> 01:48:01.680] And it really makes no difference to me one way or the other whether he did it or not, that's not the point [01:48:01.680 --> 01:48:09.680] The point is they took the child from his home without a benefit of seeing a judge [01:48:09.680 --> 01:48:16.680] I mean he's going to be subjected to a military tribunal if they go by the letter in the Patriot Act [01:48:16.680 --> 01:48:22.680] I don't care if he had cocaine stacked up to the rafters in his house Randy, that's not the point [01:48:22.680 --> 01:48:26.680] The point is we can't let the fed step in and start doing things [01:48:26.680 --> 01:48:34.680] The people in their own sovereign state when we've already got state laws that take care of that sort of thing [01:48:34.680 --> 01:48:41.680] Here's my problem, my warning buzzers are going off [01:48:41.680 --> 01:48:43.680] No, that's my pit bull [01:48:43.680 --> 01:48:47.680] Is that what it is? [01:48:47.680 --> 01:48:53.680] This sounds too packed, sounds too easy [01:48:53.680 --> 01:48:56.680] You know I was saying earlier how they always screw things up [01:48:56.680 --> 01:49:04.680] On second thought, I hope we're not being led down a garden path to discredit us [01:49:04.680 --> 01:49:08.680] Because that's one of their primary tools [01:49:08.680 --> 01:49:15.680] I'm almost sure he did it Randy, that's why you see it in the national news, that's why it's everywhere right now [01:49:15.680 --> 01:49:19.680] But the point is we cannot let the feds [01:49:19.680 --> 01:49:23.680] You remember when they first sold the Patriot Act to us Randy, they were saying [01:49:23.680 --> 01:49:28.680] Oh no, this is not for American citizens, this is not for American citizens [01:49:28.680 --> 01:49:33.680] And so Jose Padilla sits going to a military tribunal [01:49:33.680 --> 01:49:37.680] And here's a 16 year old child who may be facing the same thing [01:49:37.680 --> 01:49:40.680] This is Bolshevik, this is communist [01:49:40.680 --> 01:49:42.680] I agree, I agree [01:49:42.680 --> 01:49:50.680] My concern is that we be very careful in how we approach this [01:49:50.680 --> 01:49:53.680] If we run in there with righteous indignation [01:49:53.680 --> 01:49:56.680] How can they do this to this poor innocent 16 year old [01:49:56.680 --> 01:49:59.680] And it turns out to be dirty as can be [01:49:59.680 --> 01:50:04.680] We need to be aware of the potential [01:50:04.680 --> 01:50:09.680] So we go in and we say we don't care if he's guilty [01:50:09.680 --> 01:50:14.680] We don't care if he did that, that ain't the point [01:50:14.680 --> 01:50:16.680] Just like you said [01:50:16.680 --> 01:50:20.680] He should be adjudicated in the courts like any other American citizen [01:50:20.680 --> 01:50:24.680] And not taken to some secret tribunal [01:50:24.680 --> 01:50:32.680] So that he can be used as a talisman to terrify every 16 year old in the country [01:50:32.680 --> 01:50:35.680] This is not a country based on terror [01:50:35.680 --> 01:50:39.680] This is not Red China, this is not Soviet Russia [01:50:39.680 --> 01:50:41.680] This is United States [01:50:41.680 --> 01:50:45.680] And we are not here to be terrified of the brown church [01:50:45.680 --> 01:50:52.680] So my concern was make sure we fight the right fight and not get sucked in [01:50:52.680 --> 01:50:54.680] So they can discredit us [01:50:54.680 --> 01:50:56.680] What do you think the right fight is? [01:50:56.680 --> 01:51:00.680] Because I think the clock is ticking [01:51:00.680 --> 01:51:02.680] I think we should [01:51:02.680 --> 01:51:04.680] Burned all the way out on this thing [01:51:04.680 --> 01:51:09.680] The gate is closing here on the republic [01:51:09.680 --> 01:51:14.680] I don't know if you've ever studied the Bolshevik system [01:51:14.680 --> 01:51:17.680] But it is a system of terror [01:51:17.680 --> 01:51:21.680] And if we don't get on it from the get go, Randy [01:51:21.680 --> 01:51:22.680] I understand that [01:51:22.680 --> 01:51:29.680] What I don't want to do is get ourselves in a position to where they can use his guilt to discredit us [01:51:29.680 --> 01:51:34.680] If we're not sure if he's innocent or not, then we don't care if he's innocent or not [01:51:34.680 --> 01:51:36.680] That's not the issue we take up [01:51:36.680 --> 01:51:46.680] We take up the real issue, which is if he is guilty, let him be adjudicated in courts that have been adjudicating crimes for the last 200 years [01:51:46.680 --> 01:51:54.680] And we don't need a bunch of jack-legged FBI jack-booty thugs to take this over for us [01:51:54.680 --> 01:51:57.680] Okay, what do I do first then, habeas corpus? [01:51:57.680 --> 01:52:00.680] I don't know if you can [01:52:00.680 --> 01:52:04.680] I can give it to a state judge whether they accept it or not [01:52:04.680 --> 01:52:09.680] In Texas, anyone can file a writ for anyone [01:52:09.680 --> 01:52:14.680] In the federal, only the individual or his attorney can file a writ [01:52:14.680 --> 01:52:17.680] I don't know how it is in Indiana [01:52:17.680 --> 01:52:20.680] So if it's a juvenile, his mother could probably file it [01:52:20.680 --> 01:52:23.680] So I'm going to see if I can contact her too [01:52:23.680 --> 01:52:33.680] Chances are they've already set her up with a federal attorney who's dirty if I can contact him [01:52:33.680 --> 01:52:36.680] She needs to understand first thing [01:52:36.680 --> 01:52:42.680] First time that federal attorney looks the wrong direction, file a bar agreement on him [01:52:42.680 --> 01:52:47.680] And every time he moves away, she don't like to file a bar agreement on him [01:52:47.680 --> 01:52:51.680] And when they try to remove him, object to his being removed [01:52:51.680 --> 01:52:58.680] The only way we're going to get control of the attorneys is nailing their hides [01:52:58.680 --> 01:53:07.680] When we start interfering with their careers, we give them plausible deniability to do the right thing [01:53:07.680 --> 01:53:17.680] So if she does have a federally appointed attorney, she absolutely needs to be warned [01:53:17.680 --> 01:53:21.680] Of the gardening path she's going down [01:53:21.680 --> 01:53:23.680] Well, I'm going to do some research [01:53:23.680 --> 01:53:25.680] I'm going to call back tomorrow night [01:53:25.680 --> 01:53:29.680] And chances are I'm going to have some phone numbers so we can begin the harassment [01:53:29.680 --> 01:53:31.680] Wonderful, wonderful [01:53:31.680 --> 01:53:35.680] I don't know if you're interested in that, but maybe the listeners are [01:53:35.680 --> 01:53:37.680] But something's got to be done [01:53:37.680 --> 01:53:44.680] They have to know that we are not going to accept federal agents stepping into our sovereign state and taking our children [01:53:44.680 --> 01:53:48.680] Sixteen-year-old kids do stupid things every day of the week [01:53:48.680 --> 01:53:53.680] Normally they would arrest him for a night, he'd spend the night in juvenile [01:53:53.680 --> 01:53:58.680] And he'd go to court and he'd get a year's probation and maybe a $500 fine [01:53:58.680 --> 01:54:00.680] I had a sheriff in... [01:54:00.680 --> 01:54:02.680] Okay, wait a minute, wait, wait, hold on, Randy [01:54:02.680 --> 01:54:04.680] We've got four minutes left and we've got two more callers [01:54:04.680 --> 01:54:05.680] Okay [01:54:05.680 --> 01:54:07.680] Yeah, let's take our callers [01:54:07.680 --> 01:54:09.680] We'll do your story tomorrow night [01:54:09.680 --> 01:54:11.680] Okay, thanks, Mark [01:54:11.680 --> 01:54:12.680] Good night [01:54:12.680 --> 01:54:15.680] Okay, let's go to Christian in Florida [01:54:15.680 --> 01:54:16.680] Hey, Christian, thanks for calling in [01:54:16.680 --> 01:54:19.680] What's on your mind tonight? [01:54:19.680 --> 01:54:20.680] Hi, Randy, hi, Deborah [01:54:20.680 --> 01:54:24.680] Hey, what's on your mind tonight? [01:54:24.680 --> 01:54:25.680] Okay [01:54:25.680 --> 01:54:26.680] Christian? [01:54:26.680 --> 01:54:27.680] Yeah [01:54:27.680 --> 01:54:29.680] Okay, what's on your mind? [01:54:29.680 --> 01:54:34.680] Have you heard, Randy, of anybody getting arrested for... [01:54:34.680 --> 01:54:36.680] What was the charge here? [01:54:36.680 --> 01:54:44.680] Committing...resisting arrest without violence [01:54:44.680 --> 01:54:53.680] Well, no, but resisting arrest doesn't necessarily ever entail violence [01:54:53.680 --> 01:54:56.680] That's an odd thing to put in [01:54:56.680 --> 01:55:01.680] This fellow was in his house, he had been foreclosed upon [01:55:01.680 --> 01:55:04.680] And they were serving a writ of possession, they broke the door in [01:55:04.680 --> 01:55:08.680] And they shoved him to the ground and arrested him right then and there at gunpoint [01:55:08.680 --> 01:55:12.680] For resisting arrest with nonviolence [01:55:12.680 --> 01:55:15.680] How long did they...okay, okay [01:55:15.680 --> 01:55:18.680] Did they bang on the door and tell him who they were? [01:55:18.680 --> 01:55:20.680] I don't know that [01:55:20.680 --> 01:55:22.680] You hear the problem a lot of times we get [01:55:22.680 --> 01:55:25.680] And this is what I was addressing with the 16-year-old [01:55:25.680 --> 01:55:31.680] When people tell us the awful things that the officials have done to them [01:55:31.680 --> 01:55:35.680] They almost never tell us the whole story [01:55:35.680 --> 01:55:36.680] Right [01:55:36.680 --> 01:55:39.680] Especially when they're implicated [01:55:39.680 --> 01:55:46.680] If the police told them that he had to leave the house, that they had her in possession [01:55:46.680 --> 01:55:50.680] And he refused to leave, if they banged on the door he refused to open it [01:55:50.680 --> 01:55:52.680] Now they have cause to arrest him [01:55:52.680 --> 01:55:56.680] And if they notified him and he still didn't open the door [01:55:56.680 --> 01:56:01.680] Then they kicked down the door and arrest him for resisting arrest [01:56:01.680 --> 01:56:04.680] Not for anything he did after they broke the door down [01:56:04.680 --> 01:56:09.680] But for what he did before they broke the door down [01:56:09.680 --> 01:56:11.680] But I'm not sure they had a break order either [01:56:11.680 --> 01:56:14.680] I think you're required to have a break order here [01:56:14.680 --> 01:56:22.680] Well, if they have a possession order then it's not his house anymore [01:56:22.680 --> 01:56:27.680] So he can't claim that they broke into his house [01:56:27.680 --> 01:56:31.680] You cannot break into a person's house at least in Texas [01:56:31.680 --> 01:56:35.680] To arrest someone for a misdemeanor [01:56:35.680 --> 01:56:40.680] And you can't break into a third party's house [01:56:40.680 --> 01:56:44.680] To arrest someone even for a felony [01:56:44.680 --> 01:56:48.680] Unless you have a warrant authorizing you to search and seize [01:56:48.680 --> 01:56:52.680] You can have a warrant to arrest for a felony [01:56:52.680 --> 01:56:56.680] And break the person's own front door to arrest him [01:56:56.680 --> 01:56:58.680] But if he's at his next door neighbor's [01:56:58.680 --> 01:57:01.680] You can't break the next door neighbor's door [01:57:01.680 --> 01:57:06.680] You have to go get a writ to search and seize that house [01:57:06.680 --> 01:57:09.680] On a misdemeanor you can't break the door in any case [01:57:09.680 --> 01:57:11.680] Right, right [01:57:11.680 --> 01:57:14.680] So they want to present the writ [01:57:14.680 --> 01:57:18.680] The problem here is they got a writ of possession [01:57:18.680 --> 01:57:21.680] So it's not his house anymore [01:57:21.680 --> 01:57:24.680] So he can't raise that issue [01:57:24.680 --> 01:57:29.680] And their whole purpose there was to remove him from the house [01:57:29.680 --> 01:57:34.680] So, you know, the police aren't always to bad guys [01:57:34.680 --> 01:57:38.680] And if they're sent here to remove him from the house [01:57:38.680 --> 01:57:40.680] They're authorized to do that [01:57:40.680 --> 01:57:44.680] Was it being given the chance to leave peacefully [01:57:44.680 --> 01:57:48.680] That he was just at gunpoint just thrown out [01:57:48.680 --> 01:57:51.680] Well, once he didn't leave peacefully [01:57:51.680 --> 01:57:54.680] And they had to break the door [01:57:54.680 --> 01:58:00.680] They don't know what they're going to find on the other side of that door [01:58:00.680 --> 01:58:02.680] And I know we can [01:58:02.680 --> 01:58:06.680] I don't like police barging in with guns in hands [01:58:06.680 --> 01:58:08.680] And sticking them in your faces [01:58:08.680 --> 01:58:14.680] Having been in combat myself [01:58:14.680 --> 01:58:19.680] If the guy forces me to break his door [01:58:19.680 --> 01:58:22.680] I got to be careful [01:58:22.680 --> 01:58:25.680] If he's willing to force me to break the door [01:58:25.680 --> 01:58:27.680] What else is he willing to do? [01:58:27.680 --> 01:58:32.680] And in these kinds of situations you don't get two mistakes [01:58:32.680 --> 01:58:33.680] That's right [01:58:33.680 --> 01:58:35.680] Listen, listen, we're going to [01:58:35.680 --> 01:58:36.680] We're out of time [01:58:36.680 --> 01:58:38.680] I'm sorry, Dwayne from Louisiana [01:58:38.680 --> 01:58:40.680] Please call back in tomorrow night [01:58:40.680 --> 01:58:42.680] Thank you, Christian [01:58:42.680 --> 01:58:46.680] We'll be back tomorrow night for our four hour info marathon [01:58:46.680 --> 01:58:49.680] The Rule of Law, ruleoflawradio.com [01:58:49.680 --> 01:58:52.680] Randy Kelton and Deborah Stevens [01:58:52.680 --> 01:59:07.680] The Rule of Law, ruleoflawradio.com [01:59:07.680 --> 01:59:19.680] The Rule of Law, ruleoflawradio.com [01:59:19.680 --> 01:59:33.680] The Rule of Law, ruleoflawradio.com [01:59:33.680 --> 01:59:46.680] The Rule of Law, ruleoflawradio.com [01:59:46.680 --> 01:59:58.680] The Rule of Law, ruleoflawradio.com
